		<official-title>To amend the Federal Crop Insurance Act to establish

		  permanent authority for the Secretary of Agriculture to quickly provide

		  disaster relief to agricultural producers that incur crop losses as a result of

		  damaging weather or related condition in federally declared disaster areas, and

		  for other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short

			 title</header><text display-inline="no-display-inline">This Act may be cited as

			 the <quote><short-title>Permanent Emergency Agricultural

			 Assistance Act</short-title></quote>.</text>

		</section><section id="H3D7C93B9F8F7478DBDBCD2F1BBCCE10"><enum>2.</enum><header>Crop disaster

			 assistance for future crop years</header><text display-inline="no-display-inline">The Federal Crop Insurance Act is amended by

			 inserting after section 518 (7 U.S.C. 1518) the following:</text>

				<section id="H031314D5E87349C7A8FCC07E48824C7"><enum>519.</enum><header>Permanent

				authority to provide emergency agricultural assistance</header>

					<subsection id="H7C72081F182F497498059D6BAB704450"><enum>(a)</enum><header>Definition of

				federally declared disaster area</header>

						<paragraph id="H9B4CFA94505E47B79903EBFA71598CFD"><enum>(1)</enum><header>In

				general</header><text>In this section, the term <term>federally declared

				disaster area</term> means a county covered by—</text>

							<subparagraph id="HD2176D7FEE8A4576A332EF95D8A96B54"><enum>(A)</enum><text>a Presidential

				declaration of major disaster issued under section 401 of the Robert T.

				Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C. 5170);

				or</text>

							</subparagraph><subparagraph id="H063B8ABB23DF4A1B863BB04B54849278"><enum>(B)</enum><text>a declaration by

				the Secretary of a disaster area under subpart A of part 1945 of title 7, Code

				of Federal Regulations (or successor regulations).</text>

							</subparagraph></paragraph><paragraph id="H7922A64D23A547DCA8CCFF3F3C320B3"><enum>(2)</enum><header>Exclusion</header><text display-inline="yes-display-inline">The term <term>federally declared disaster

				area</term> does not include a county contiguous to a county covered by a

				declaration described in paragraph (1) unless the contiguous county is also

				covered by the same designation.</text>

						</paragraph></subsection><subsection id="H4686AC0D0F444E5DA77849F031009EAD"><enum>(b)</enum><header>Authority to

				provide emergency assistance</header><text display-inline="yes-display-inline">The Secretary shall use the funds of the

				Commodity Credit Corporation to make emergency financial assistance available

				to producers on a farm that incur qualifying crop losses for an insurable crop

				due to damaging weather or related condition, as determined by the Secretary,

				that results in the designation of the county in which the farm is located as a

				federally declared disaster area.</text>

					</subsection><subsection id="H16FED4936E314558A92FEC3313D44EB9"><enum>(c)</enum><header>Administration</header><text>Except

				as provided in subsections (d) and (e), the Secretary shall make assistance

				available under this section in the same manner as provided under section 815

				of the Agriculture, Rural Development, Food and Drug Administration, and

				Related Agencies Appropriations Act, 2001 (Public Law 106–387; 114 Stat.

				1549A–55), including using the same loss thresholds for the quantity and

				quality losses as were used in administering that section.</text>

					</subsection><subsection id="H5F889F3CA5BF43E19F8FAC730062B328"><enum>(d)</enum><header>Payment

				rate</header><text>The Secretary shall make assistance available to producers

				on a farm for a crop under this section at a rate equal to 65 percent of the

				established price for the crop for any deficiency in production of 35 percent

				or more for the crop.</text>

					</subsection><subsection id="H7E6F65036A3A4DBF9C3200A87E108CCC"><enum>(e)</enum><header>Receipt

				conditioned on having crop insurance</header><text>The producers on a farm

				shall not be eligible for assistance under subsection (a) with respect to

				losses to a crop unless the producers obtained, before the losses were

				incurred, a policy or plan of insurance for the crop under this title that

				provided a level of coverage equal to or greater than 60 percent.</text>

					</subsection><subsection commented="no" display-inline="no-display-inline" id="id8AD89352A5B84BFE9DA38A1A5A458B68"><enum>(f)</enum><header>Authorization

				of appropriations</header><text display-inline="yes-display-inline">There is

				authorized to be appropriated such amounts as are necessary to reimburse the

				Commodity Credit Corporation for funds expended by the Secretary under this

				section.</text>

					</subsection><subsection id="H3D264352300F4E95AB9028DB4006B35"><enum>(g)</enum><header>Effective

				date</header><text>This section applies to the 2005 and subsequent crop

				years.</text>
