		<official-title>To amend title 18, United States Code, to prevent

		  interference with Federal disaster relief efforts, and for other

		  purposes.</official-title>

		<section id="H5A282DDA2F804242954C263504BD528" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Emergency Relief Personnel Protection

			 Act of 2005</short-title></quote>.</text>

		</section><section id="H1EDC882F3D3F49A08433D56000C8ECD9"><enum>2.</enum><header>Creating Federal

			 crime of interfering with Federal disaster relief efforts</header>

			<subsection id="H2ECB652F503C459286ED9EC065E5ACE"><enum>(a)</enum><header>In

			 general</header><text>Chapter 65 of title 18, United States Code, is amended by

			 adding the following new section:</text>

				<quoted-block display-inline="no-display-inline" id="HEE4CEEA840824A1E9CA4E92DB5942E0" style="USC">

					<section id="H2E00418133B943529ECD68F214E6939"><enum>1370.</enum><header>Interference

				with Federal disaster relief efforts</header>

						<subsection id="H300308D408B0405F9FE5E513DDFCA82"><enum>(a)</enum><header>Prohibited

				Conduct</header><text>Whoever, during a presidentially-declared major disaster

				or emergency—</text>

							<paragraph id="H8FE36F7F28F84A7E8E465EE0FF2CE737"><enum>(1)</enum><text>forcibly assaults,

				resists, opposes, impedes, intimidates, or interferes with any officer or

				employee of the United States or of any agency in any branch of the United

				States Government (including any member of the uniformed services) while such

				officer or employee is engaged in or on account of the performance of official

				duties relating to, or in support of recovery from, the presidentially-declared

				disaster or emergency, or any person assisting such an officer or employee in

				the performance of such duties or on account of that assistance; or</text>

							</paragraph><paragraph id="H93BA83F392284C029E871023E69B1C76"><enum>(2)</enum><text>forcibly assaults,

				resists, opposes, impedes, intimidates, or interferes with any person providing

				services in support of disaster relief efforts and working in coordination with

				a Federal coordinating officer appointed pursuant to section 302, Public Law

				98–288 (42 U.S.C. 5143),</text>

							</paragraph><continuation-text continuation-text-level="subsection">shall,

				except as provided in subsection (b) of this section, be fined under this title

				or imprisoned not more than two years, or both.</continuation-text></subsection><subsection id="HB4E1F6C6A8AA453A8FEE88F40098F0FA"><enum>(b)</enum><header>Enhanced

				Penalty</header><text>Whoever, in the commission of and in relation to any act

				described in subsection (a) of this section, carries, possesses or uses a

				deadly or dangerous weapon or inflicts serious bodily injury, shall be fined

				under this title or imprisoned not more than 15 years or both, or, if the death

				of any person results, shall be punished by death or life

				imprisonment.</text>

						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection id="H0BCE42A404CE48ECA27851A28469E301"><enum>(b)</enum><header>Clerical

			 amendment</header><text>The table of sections at the beginning of chapter 86 of

			 title 18, United States Code, is amended by adding at the end the following new

			 item:</text>
