		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Price Gouging Act of

			 2005</short-title></quote>.</text>

		</section><section commented="no" display-inline="no-display-inline" id="idE6B474808DCC47D984566D7AE1C61A66" section-type="subsequent-section"><enum>2.</enum><header>Price gouging

			 prohibition following major disasters</header>

			<subsection commented="no" display-inline="no-display-inline" id="idFB815CED4ED94AC797D5B48BB22DEFAB"><enum></enum><text display-inline="yes-display-inline">The Federal Trade Commission Act (15 U.S.C.

			 41 et seq.) is amended—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="id10C2103C53A14D468948B4DFDFB55614"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating sections 25 and 26 (15

			 U.S.C. 57c, 58) as sections 26 and 27, respectively; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id541A15A304C340AEA748F6BE03F3D843"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after section 24 (15 U.S.C.

			 57b–5) the following:</text>

						<section commented="no" display-inline="no-display-inline" id="idD6F026BEA9194542B1EDF532B9F79A64" section-type="subsequent-section"><enum>25.</enum><header>Protection from price

				gouging following major disasters</header>

							<subsection commented="no" display-inline="no-display-inline" id="id5657C4E062E142488DB1B4BE121A1990"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>

								<paragraph commented="no" display-inline="no-display-inline" id="id461E9ABD41E24AF1A9BF4663FB7C0A8D"><enum>(1)</enum><header>Affected

				area</header><text display-inline="yes-display-inline">The term <term>affected

				area</term> means an area affected by a major disaster declared by the

				President under Federal law in existence on the date of enactment of this

				subsection.</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD8AAFC50E6B64337BE1EE7C2F6DA4410"><enum>(2)</enum><header>Price

				gouging</header><text display-inline="yes-display-inline">The term <term>price

				gouging</term> means the charging of an unconscionably excessive price by a

				supplier in an affected area.</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5941D52C5200492A91ED388F20451988"><enum>(3)</enum><header>Supplier</header><text display-inline="yes-display-inline">The term <term>supplier</term> means any

				person that sells gasoline or diesel fuel for resale or ultimate

				consumption.</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id035D56A096354EABB60ECD3969F46A43"><enum>(4)</enum><header>Unconscionably

				excessive price</header><text display-inline="yes-display-inline">The term

				<term>unconscionably excessive price</term> means a price charged in an

				affected area for gasoline or diesel fuel that—</text>

									<subparagraph commented="no" display-inline="no-display-inline" id="id0928947254B04B588A925B05FB7C2284"><enum>(A)</enum><text display-inline="yes-display-inline">represents a gross disparity, as determined

				by the Commission in accordance with subsection (e), between the price charged

				for gasoline or diesel fuel and the average price of gasoline or diesel fuel

				charged by suppliers in the affected area during the 30-day period immediately

				before the President declares the existence of a major disaster; and</text>

									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE4A5664E07264198958FC84E07AA5131"><enum>(B)</enum><text display-inline="yes-display-inline">is not attributable to increased wholesale

				or operational costs incurred by the supplier in connection with the sale of

				gasoline or diesel fuel.</text>

									</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id3DA75D33D044413AA618CEAE413BA03D"><enum>(b)</enum><header>Determination

				of the Commission</header><text display-inline="yes-display-inline">Following

				the declaration of a major disaster by the President, the Commission

				shall—</text>

								<paragraph commented="no" display-inline="no-display-inline" id="id98FD31537FE34359BC83409087718EED"><enum>(1)</enum><text display-inline="yes-display-inline">consult with the Attorney General, the

				United States Attorney for the district in which the disaster occurred, and

				State and local law enforcement officials to determine whether any supplier in

				the affected area is charging or has charged an unconscionably excessive price

				for gasoline or diesel fuel provided in the affected area; and</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id180DB3410F024435BB3989888AF40F04"><enum>(2)</enum><text display-inline="yes-display-inline">establish within the Commission—</text>

									<subparagraph commented="no" display-inline="no-display-inline" id="id1140A6883EDF4BD4A1E4F2C9D835C367"><enum>(A)</enum><text display-inline="yes-display-inline">a toll-free hotline that a consumer may

				call to report an incidence of price gouging in the affected area; and</text>

									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0BBCF5FFE7E646688E1D029EFA4E277B"><enum>(B)</enum><text display-inline="yes-display-inline">a program to develop and distribute to the

				public informational materials in English and Spanish to assist residents of

				the affected area in detecting and avoiding price gouging.</text>

									</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id83C03E8A0B1B41F992E755BB67209CDD"><enum>(c)</enum><header>Price gouging

				involving disaster victims</header>

								<paragraph commented="no" display-inline="no-display-inline" id="idD1EF83600B914B5BB1FEEAEBCC6AEAAA"><enum>(1)</enum><header>Offense</header><text display-inline="yes-display-inline">During the 180-day period after the date on

				which a major disaster is declared by the President, no supplier shall sell, or

				offer to sell, gasoline or diesel fuel in an affected area at an unconscionably

				excessive price.</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB06216BBFE4F4218B360E5836F80D63A"><enum>(2)</enum><header>Action by

				Commission</header>

									<subparagraph commented="no" display-inline="no-display-inline" id="id8A32485F531743E580DC68703D33368F"><enum>(A)</enum><header>In

				general</header><text display-inline="yes-display-inline">During the period

				described in paragraph (1), the Commission shall conduct investigations to

				determine whether any supplier in an affected area is in violation of paragraph

				(1).</text>

									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7990354A17514529867581FAAFE7EE0B"><enum>(B)</enum><header>Positive

				determination</header><text display-inline="yes-display-inline">If the

				Commission determines under subparagraph (A) that a supplier is in violation of

				paragraph (1), the Commission shall take any action the Commission determines

				to be appropriate to remedy the violation.</text>

									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id21240516A2D5404CBA46512D8C649602"><enum>(3)</enum><header>Civil

				penalties</header><text display-inline="yes-display-inline">A supplier that

				commits an offense described in paragraph (1) may, in a civil action brought in

				a court of competent jurisdiction, be subject to—</text>

									<subparagraph commented="no" display-inline="no-display-inline" id="id270269CD7E5D48DEB3100951B7326B21"><enum>(A)</enum><text display-inline="yes-display-inline">a civil penalty of not more than

				$500,000;</text>

									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id81406E90AC14443D98C7278FDA146BF1"><enum>(B)</enum><text display-inline="yes-display-inline">an order to pay special and punitive

				damages;</text>

									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3813653A0CC1422E8D598257A34A6DDE"><enum>(C)</enum><text display-inline="yes-display-inline">an order to pay reasonable attorney's

				fees;</text>

									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE7C7CA1940864007B385C594A6244C92"><enum>(D)</enum><text display-inline="yes-display-inline">an order to pay costs of litigation

				relating to the offense;</text>

									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9253A18FB3D2403992D104D39823AEAD"><enum>(E)</enum><text display-inline="yes-display-inline">an order for disgorgement of profits earned

				as a result of a violation of paragraph (1); and</text>

									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE68EFF8A38FB404B8BC00968BCD237BC"><enum>(F)</enum><text display-inline="yes-display-inline">any other relief determined by the court to

				be appropriate.</text>

									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9EC6F31D63F4406989F16F250534FC3E"><enum>(4)</enum><header>Criminal

				penalty</header><text display-inline="yes-display-inline">A supplier that

				knowingly commits an offense described in paragraph (1) shall be imprisoned not

				more than 1 year.</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idAB8DABCB781940ED9F79538732BAB688"><enum>(5)</enum><header>Action by

				victims</header><text display-inline="yes-display-inline">A person, Federal

				agency, State, or local government that suffers loss or damage as a result of a

				violation of paragraph (1) may bring a civil action against a supplier in any

				court of competent jurisdiction for disgorgement, special or punitive damages,

				injunctive relief, reasonable attorney's fees, costs of the litigation, and any

				other appropriate legal or equitable relief.</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id089DC926F4164135B4D1B0293A164A75"><enum>(6)</enum><header>Action by State

				attorneys general</header><text display-inline="yes-display-inline">An attorney

				general of a State, or other authorized State official, may bring a civil

				action in the name of the State, on behalf of persons residing in the State, in

				any court of competent jurisdiction for disgorgement, special or punitive

				damages, reasonable attorney's fees, costs of litigation, and any other

				appropriate legal or equitable relief.</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCC13AD3F41BF49E2BC7CB02703FD9982"><enum>(7)</enum><header>No

				preemption</header><text display-inline="yes-display-inline">Nothing in this

				section preempts any State law.</text>

								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id150A9E53877A426F9533D41FEACB93E7"><enum>(d)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of

				enactment of this subsection, and annually thereafter, the Commission shall

				submit to the Committee on Commerce, Science, and Transportation of the Senate

				and the Committee on Energy and Commerce of the House of Representatives a

				report describing—</text>

								<paragraph commented="no" display-inline="no-display-inline" id="id72F2AEE3C55343A2A043F0F3545E1328"><enum>(1)</enum><text display-inline="yes-display-inline">the number of price gouging complaints

				received by the Commission for each major disaster declared by the President

				during the preceding year;</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7B9A781CC8C046D19C6E1C99F2B37C4A"><enum>(2)</enum><text display-inline="yes-display-inline">the number of price gouging investigations

				of the Commission initiated, in progress, and completed as of the date on which

				the report is prepared;</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id35440005C8644E70820EA62D5FA576BC"><enum>(3)</enum><text display-inline="yes-display-inline">the number of enforcement actions of the

				Commission initiated, in progress, and completed as of the date on which the

				report is prepared;</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0CB67212AFB842A298CCD63700E84776"><enum>(4)</enum><text display-inline="yes-display-inline">an evaluation of the effectiveness of the

				toll-free hotline and program established under subsection (b)(2); and</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC4F44511A88C4E5C8454F1962B33E5D0"><enum>(5)</enum><text display-inline="yes-display-inline">recommendations for any additional action

				with respect to the implementation or effectiveness of this section.</text>

								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idBC62478FAABE41C5BDA05E33D63FE921"><enum>(e)</enum><header>Definition of

				gross disparity</header><text display-inline="yes-display-inline">Not later

				than 180 days after the date of enactment of this subsection, the Commission

				shall promulgate regulations to define the term <term>gross disparity</term>

				for purposes of this

				section.</text>

							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idA16963C594214B1C90D15BB0E5A4DBA3" section-type="subsequent-section"><enum>3.</enum><header>Effect of

			 Act</header><text display-inline="no-display-inline">Nothing in this Act, or an

			 amendment made by this Act, affects any authority of the Federal Trade

			 Commission in existence on the date of enactment of this Act with respect to

			 price gouging actions.</text>
