		<section id="S1" section-type="section-one"><enum>1.</enum><header>Release or detention of a

			 material witness</header>

			<subsection id="id20749464D83E454EB67BE8C3881712F4"><enum>(a)</enum><header>Amendments to

			 title 18</header><text>Section 3144 of title 18, United States Code, is amended

			 to read as follows:</text>

				<quoted-block display-inline="no-display-inline" id="id89DDCA4141384AC2A0D693BD32F52139" style="USC">

					<section id="idD91C15487E084076B2EC778240C6D3DC"><enum>3144.</enum><header>Release or

				detention of a material witness</header>

						<subsection id="idD84D1B5A52A04ADCA91CC75E9DD87313"><enum>(a)</enum><header>Arrest of

				material witness</header>

							<paragraph id="idDBCFD041A80B482CAFA80EADDD8FD1DD"><enum>(1)</enum><header>In

				general</header><text>A judicial officer may order the arrest of a person as a

				material witness, if it appears from an affidavit filed by a party in a

				criminal case before a court of the United States, or by an attorney for the

				Government in a matter occurring before a Federal grand jury, that there is

				probable cause to believe that—</text>

								<subparagraph id="ID5587574e5a914c539554a8f41383292a"><enum>(A)</enum><text>the testimony of

				such person is material in such case or matter; and</text>

								</subparagraph><subparagraph id="IDd3eca40d94ea4f81b8c0d90a02de3463"><enum>(B)</enum><text>the person has

				been served with a summons or subpoena and failed or refused to appear as

				required.</text>

								</subparagraph></paragraph><paragraph id="ID26e0f6895858467b8e3a83727560e9d0"><enum>(2)</enum><header>Exception</header><text>A

				judicial officer may waive the summons or subpoena requirement described in

				paragraph (1)(B), if the judicial officer finds by clear and convincing

				evidence that the service of a summons or subpoena—</text>

								<subparagraph id="id3A7CE622E3CB421289E7D4AF4F210E80"><enum>(A)</enum><text>is likely to

				result in the person fleeing; or</text>

								</subparagraph><subparagraph id="id24A5E28AA27A4F4995E3654DBF5D76DE"><enum>(B)</enum><text>cannot adequately

				secure the appearance of the person as required.</text>

								</subparagraph></paragraph></subsection><subsection id="IDcfc69944fe8a430b88fefbd644e95044"><enum>(b)</enum><header>Warrant for

				material witness</header>

							<paragraph id="id26282415BD824E1CB2C09D96D82C6242"><enum>(1)</enum><header>Requirements</header><text>A

				warrant issued under subsection (a) shall—</text>

								<subparagraph id="ID34c3b15e6fff4d1e813fa674b02c7153"><enum>(A)</enum><text>contain the name

				of the material witness or, if the name of such witness is unknown, a name or

				description by which the witness can be identified with reasonable

				certainty;</text>

								</subparagraph><subparagraph id="IDe98f99b806c94428839d475eb3914191"><enum>(B)</enum><text>specify that the

				testimony of the witness is sought in a criminal case or grand jury

				proceeding;</text>

								</subparagraph><subparagraph id="ID443b53fac5b84d6497b16dd39743e64c"><enum>(C)</enum><text>command that the

				witness be arrested and brought without unnecessary delay before a judicial

				officer;</text>

								</subparagraph><subparagraph id="ID745c682e4f6f471aac3b6b772f9a4280"><enum>(D)</enum><text>inform the

				witness of the witness’s right to retain counsel or to request that counsel be

				appointed if the witness cannot obtain counsel; and</text>

								</subparagraph><subparagraph id="ID37ade5d46b2148b48ef81a1ef9912422"><enum>(E)</enum><text>be signed by a

				judicial officer.</text>

								</subparagraph></paragraph><paragraph id="ID15970f86d18d458a950fe8607e2e5f36"><enum>(2)</enum><header>Execution of

				warrant</header>

								<subparagraph id="idA5B384CEBCA544D391CE774ACC94D85A"><enum>(A)</enum><header>Arrest of

				witness</header><text>A warrant issued under subsection (a) shall be executed

				by arresting the material witness.</text>

								</subparagraph><subparagraph id="idB056CF5272564503AA2B1BD88DEF7462"><enum>(B)</enum><header>Warrant to be

				provided to witness</header>

									<clause id="id7418DE07710448AAAF84F7083B483F8F"><enum>(i)</enum><header>In

				general</header><text>Upon arrest, an officer possessing the warrant shall show

				such warrant to the material witness.</text>

									</clause><clause id="id12CC850556774560A96454CCE4FDE6B0"><enum>(ii)</enum><header>Warrant not in

				possession of arresting officer</header><text>If an officer does not possess

				the warrant at the time of arrest of a material witness, an officer—</text>

										<subclause id="id835B167E22514ED5802EBFA867FAAE78"><enum>(I)</enum><text>shall inform the

				witness of the existence and purpose of the warrant; and</text>

										</subclause><subclause id="id7975246C81C1494B9D0E7ED2EC27C929"><enum>(II)</enum><text>at the request

				of the witness, shall provide the warrant to the witness as soon as

				possible.</text>

										</subclause></clause></subparagraph></paragraph><paragraph id="ID3f7b32d9d8124c1c9ef98870b38a3a46"><enum>(3)</enum><header>Return of

				warrant</header>

								<subparagraph id="idF9B0A3DC507A4498A85C76449467E3B9"><enum>(A)</enum><header>After

				execution</header><text>After executing a warrant issued under subsection (a),

				an officer shall return the warrant to the judicial officer before whom the

				material witness is brought in accordance with subsection (c).</text>

								</subparagraph><subparagraph id="id3FE067B8D54342D5BA58DBF56F7B6B1B"><enum>(B)</enum><header>Unexecuted

				warrant</header><text>At the request of an attorney for the United States

				Government, an unexecuted warrant shall be brought back to and canceled by a

				judicial officer.</text>

								</subparagraph></paragraph></subsection><subsection id="ID5b900756089b46c6928cc970b0590cd1"><enum>(c)</enum><header>Initial

				appearance</header>

							<paragraph id="id54F41F0B4FE34B428472D4C1606008E7"><enum>(1)</enum><header>Appearance upon

				arrest</header><text>A material witness arrested pursuant to a warrant issued

				under subsection (a) shall be brought without unnecessary delay before a

				judicial officer.</text>

							</paragraph><paragraph id="IDa152abde38fc4b9bb4d25af8875f5d4c"><enum>(2)</enum><header>Place of

				initial appearance</header><text>The initial appearance of a material witness

				arrested pursuant to a warrant issued under subsection (a) shall be—</text>

								<subparagraph id="ID51ccb94385da4d19bf4ea59a9105f823"><enum>(A)</enum><text>in the district

				of arrest; or</text>

								</subparagraph><subparagraph id="ID7240fe7afaa44a2b8bd1a8ba844289bb"><enum>(B)</enum><text>in an adjacent

				district if—</text>

									<clause id="ID5e6ae0dc4d3e45a6b94a09a45a0d21b9"><enum>(i)</enum><text>the appearance

				can occur more promptly there; or</text>

									</clause><clause id="IDf20e1be10ba841fc963efd1f2d3a43a7"><enum>(ii)</enum><text>the warrant was

				issued there and the initial appearance will occur on the day of the

				arrest.</text>

									</clause></subparagraph></paragraph><paragraph id="IDe33ba57722014ff3b265d06619974b77"><enum>(3)</enum><header>Procedures</header><text>At

				the initial appearance described in paragraph (2), a judicial officer

				shall—</text>

								<subparagraph id="ID9d5c35c22c634578861bd34f68f90dee"><enum>(A)</enum><text>inform a material

				witness of—</text>

									<clause id="ID590db6fc078a4c37b2ce85520f7d35db"><enum>(i)</enum><text>the warrant

				against the witness, and the application and affidavit filed in support of the

				warrant; and</text>

									</clause><clause id="ID5da7c9dcf58e494694bc652415dce4a3"><enum>(ii)</enum><text>the witness’s

				right to retain counsel or to request that counsel be appointed if the witness

				cannot obtain counsel;</text>

									</clause></subparagraph><subparagraph id="IDe4c856ad061242b0829163c15c5af6ba"><enum>(B)</enum><text>allow the witness

				a reasonable opportunity to consult with counsel;</text>

								</subparagraph><subparagraph id="ID1e8469d1fbc943339d9978dd4ea7582d"><enum>(C)</enum><text>release or detain

				the witness as provided by subsection (d); and</text>

								</subparagraph><subparagraph id="ID0f92bd21db8c4613be397220590f8061"><enum>(D)</enum><text>if the initial

				appearance occurs in a district other than where the warrant issued, transfer

				the witness to such district, provided that the judicial officer finds that the

				witness is the same person named in the warrant.</text>

								</subparagraph></paragraph></subsection><subsection id="ID3824b94d60ab449493412b8396a496af"><enum>(d)</enum><header>Release or

				detention</header>

							<paragraph id="IDaede2edd8f46424db7c25ab30783af73"><enum>(1)</enum><header>In

				general</header><text>Upon the appearance before a judicial officer of a

				material witness arrested pursuant to a warrant issued under subsection (a),

				the judicial officer shall order the release or detention of such

				witness.</text>

							</paragraph><paragraph id="ID8c99f298541840909923ad3a899b88cc"><enum>(2)</enum><header>Release</header>

								<subparagraph id="id55F11F7626744169B934FCF263D7DFA3"><enum>(A)</enum><header>In

				general</header><text>A judicial officer shall order the release of a material

				witness arrested pursuant to a warrant issued under subsection (a) on personal

				recognizance or upon execution of an unsecured appearance bond under section

				3142(b), or on a condition or combination of conditions under section 3142(c),

				unless the judicial officer determines by clear and convincing evidence that

				such release will not reasonably assure the appearance of the witness as

				required.</text>

								</subparagraph><subparagraph id="id898412D8AED940E6A37487319AA205F7"><enum>(B)</enum><header>Testimony

				secured by deposition</header><text>No material witness may be detained because

				of the inability of the witness to comply with any condition of release if the

				testimony of such witness can adequately be secured by deposition.</text>

								</subparagraph></paragraph><paragraph id="IDe0ba6cfb64b84b9684711abe096d55fa"><enum>(3)</enum><header>Detention</header>

								<subparagraph id="id28F1E3C12EE541AFABF68A7479FF2F0F"><enum>(A)</enum><header>No reasonable

				assurance of appearance</header><text>If, after a hearing pursuant to the

				provisions of section 3142(f)(2), a judicial officer finds by clear and

				convincing evidence that no condition or combination of conditions will

				reasonably assure the appearance of a material witness as required by this

				section, such judicial officer may order that the witness be detained for a

				period not to exceed 5 days, or until the testimony of the witness can

				adequately be secured by deposition or by appearance before the court or grand

				jury, whichever is earlier.</text>

								</subparagraph><subparagraph id="id327E40976A2E4AE3BE533BAA2CE8E5B8"><enum>(B)</enum><header>Extension of

				detention</header>

									<clause id="idC0A3C4AA2BAB453BACAC1F3EEEF5AD66"><enum>(i)</enum><header>In

				general</header><text>Subject to clause (ii), upon the motion of a party (or an

				attorney for the United States Government in a matter occurring before a

				Federal grand jury), the period of detention under subparagraph (A) may be

				extended for additional periods of up to 5 days, or until the testimony of a

				material witness can adequately be secured by deposition or by appearance

				before the court or grand jury, whichever is earlier.</text>

									</clause><clause id="idCC32D609D110436BAB4F1F459A2BA604"><enum>(ii)</enum><header>Limit</header><text>The

				total period of detention under this subparagraph may not exceed—</text>

										<subclause id="idFEF3188FF26B4F2499B7A86FBCFAC969"><enum>(I)</enum><text>30 days, where

				the testimony of the witness is sought in a criminal case; or</text>

										</subclause><subclause id="id9342D36F16DE45DB9A4942C7E0FF22F1"><enum>(II)</enum><text>10 days, where

				the testimony of the witness is sought in a grand jury proceeding.</text>

										</subclause></clause></subparagraph><subparagraph id="id382A497BF1F24ECD8653F08B3FF5BD41"><enum>(C)</enum><header>Good cause

				required</header><text>A motion under subparagraph (B) shall demonstrate good

				cause for why the testimony of a material witness could not adequately be

				secured by deposition or by appearance before the court or grand jury during

				the previous 5-day period.</text>

								</subparagraph></paragraph><paragraph id="ID9f9e2f1ebec34aa69f2cf77fb2166667"><enum>(4)</enum><header>Factors to be

				considered</header><text>A judicial officer, in determining whether a material

				witness should be released or detained—</text>

								<subparagraph id="id691625FA9544499B91AC9169466D3E44"><enum>(A)</enum><text>shall take into

				account the available information concerning the history and characteristics of

				the witness, including the information described in section 3142(g)(3)(A);

				and</text>

								</subparagraph><subparagraph id="idE907E64717984564895BA25B766EF967"><enum>(B)</enum><text>may consider

				challenges to the basis of the warrant.</text>

								</subparagraph></paragraph><paragraph id="IDc9c6354332824ca28bf1af680c44b612"><enum>(5)</enum><header>Contents of

				release order</header><text>A release order issued under paragraph (2) shall

				comply with the requirements of paragraphs (1) and (2)(B) of section

				3142(h).</text>

							</paragraph><paragraph id="ID5e98d6f0653a459981ea209826db80c6"><enum>(6)</enum><header>Contents of

				detention order</header><text>A detention order issued under paragraph (3)

				shall comply with the requirements of section 3142(i), provided that a judicial

				officer shall direct that a material witness be held—</text>

								<subparagraph id="id01C794A9281D4AD48DAE2E3856FD76D0"><enum>(A)</enum><text>in a facility

				separate and apart, to the extent practicable, from persons charged with or

				convicted of a criminal offense; and</text>

								</subparagraph><subparagraph id="idF3992FE5BCB0431D96574FE637F8B476"><enum>(B)</enum><text>under the least

				restrictive conditions possible.</text>

								</subparagraph></paragraph></subsection><subsection id="IDffd9c07876e444a7883f7da716a5eadf"><enum>(e)</enum><header>Report</header>

							<paragraph id="idFDCC74929D764768A1A47F25474143E7"><enum>(1)</enum><header>In

				general</header><text>Notwithstanding any other provision of law, the Attorney

				General shall provide to the Committees on the Judiciary of the Senate and the

				House of Representatives an annual report regarding the use of this section by

				the United States Government during the preceding 1-year period.</text>

							</paragraph><paragraph id="ID913a92413e5246b2979fbc9d1692fa97"><enum>(2)</enum><header>Content of

				report</header><text>A report required under paragraph (1) shall

				include—</text>

								<subparagraph id="ID22b5c0ebb4c5463ab9fdfa57e00cab26"><enum>(A)</enum><text>the number of

				warrants sought under subsection (a), and the number either granted or

				denied;</text>

								</subparagraph><subparagraph id="ID7aa6c4e64df0431ea6e9aa8dd30ed76c"><enum>(B)</enum><text>the number of

				material witnesses arrested pursuant to a warrant issued under subsection (a)

				whose testimony was not secured by deposition or by appearance before the court

				or grand jury, and the reasons therefore; and</text>

								</subparagraph><subparagraph id="ID074e32e2cf694fcab7d67d289d02bde6"><enum>(C)</enum><text>the average

				number of days that material witnesses arrested pursuant to a warrant issued

				under subsection (a) were

				detained.</text>

								</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection id="idE9D332869D6440229C092ED5524D95CA"><enum>(b)</enum><header>Amendment to

			 Federal Rules of Civil Procedure</header><text>Rule 46(h) of the Federal Rules

			 of Criminal Procedure is amended to read as follows:</text>

				<quoted-block display-inline="no-display-inline" id="id98FDB749F51048D4B297F45289F5C9D4" style="OLC">

					<subsection id="ID1ece84c796264e1d8001765f382ea08d"><enum>(h)</enum><header>Supervising

				detention pending trial</header><text>To eliminate unnecessary detention, the

				court must supervise the detention within the district of any defendants

				awaiting trial and of any persons held as material

				witnesses.</text>

					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection></section></legis-body>
