			 title</header><text display-inline="no-display-inline">This Act may be cited as

			 the <quote><short-title>Homeland Security Management

			 Restructuring Act of 2005</short-title></quote>.</text>

			 of Homeland Secretary for Management</header>

			<subsection id="idF97C5871ED6A43C5ABA6755CAB22A630"><enum>(a)</enum><header>Establishment

			 and succession</header><text>Section 103 of the Homeland Security Act of 2002

			 (6 U.S.C. 113) is amended—</text>

				<paragraph id="id4D39B50365484A268B7EB249127EFD10"><enum>(1)</enum><text>in subsection

			 (a)—</text>

					<subparagraph id="idA0D59768395C4ACAB4E926ED0C29840A"><enum>(A)</enum><text>in the subsection

			 heading, by striking <quote><header-in-text level="subsection" style="OLC">Deputy Secretary</header-in-text></quote> and inserting

			 <quote><header-in-text level="subsection" style="OLC">Deputy

			 Secretaries</header-in-text></quote>;</text>

					</subparagraph><subparagraph id="id849E764BE007416789B87033BB01ECE0"><enum>(B)</enum><text>by striking

			 paragraph (7);</text>

					</subparagraph><subparagraph id="id0A03BAA5811E464CA0F3AE6C19A61A4B"><enum>(C)</enum><text>by redesignating

			 paragraphs (2) through (6) as paragraphs (3) through (7), respectively;

			 and</text>

			 paragraph (1) and inserting the following:</text>

							<paragraph id="id4A2F4FA080EC405197DAE2635E55EAA4"><enum>(1)</enum><header>Vacancy in

				office of secretary</header>

								<subparagraph id="id306A4DF74B4B46A99F3062CDDFF4AEDE"><enum>(A)</enum><header>Deputy

				secretary</header><text>In case of a vacancy in the office of the Secretary, or

				of the absence or disability of the Secretary, the Deputy Secretary of Homeland

				Security may exercise all the duties of that office, and for the purpose of

				section 3345 of title 5, United States Code, the Deputy Secretary of Homeland

				Security is the first assistant to the Secretary.</text>

								</subparagraph><subparagraph id="id7386CA5D4CEF4BA0839F002F9A434CE8"><enum>(B)</enum><header>Deputy

				secretary for management</header><text>When by reason of absence, disability,

				or vacancy in office, neither the Secretary nor the Deputy Secretary of

				Homeland Security is available to exercise the duties of the office of the

				Secretary, the Deputy Secretary of Homeland Security for Management shall act

				as Secretary.</text>

								</subparagraph></paragraph><paragraph id="idB77E5FC856984AE681328FAF6473776A"><enum>(2)</enum><header>Vacancy in

				office of deputy secretary</header><text>In the case of a vacancy in the office

				of the Deputy Secretary of Homeland Security, or of the absence or disability

				of the Deputy Secretary of Homeland Security, the Deputy Secretary of Homeland

				Security for Management may exercise all the duties of that office.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA9C636AD157E4A2B8C26F397A580A5DA"><enum>(3)</enum><header>Further order

				of succession</header><text>The Secretary may designate such other officers of

				the Department in further order of succession to act as

				Secretary.</text>

							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph></subsection><subsection id="id01C5DFF0A8BA4AA082B894C590A677F5"><enum>(b)</enum><header>Responsibilities</header><text>Section

			 701 of the Homeland Security Act of 2002 (6 U.S.C. 341) is amended—</text>

				<paragraph id="id7E640AA0D1FB43F4A5F80C6040FB9587"><enum>(1)</enum><text>in the section

			 heading, by striking <quote><header-in-text level="section" style="OLC">Under

			 Secretary</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">Deputy Secretary of Homeland

			 Security</header-in-text></quote>;</text>

				</paragraph><paragraph id="id0B5D5E5E481846EE95D8965853ECF672"><enum>(2)</enum><text>in subsection

			 (a)—</text>

					<subparagraph id="id0BBABDB4C77F421095FA44341434D419"><enum>(A)</enum><text>by inserting

			 <quote>The Deputy Secretary of Homeland Security for Management shall serve as

			 the Chief Management Officer and principal advisor to the Secretary on matters

			 related to the management of the Department, including management integration

			 and transformation in support of homeland security operations and

			 programs.</quote> before <quote>The Secretary</quote>;</text>

					</subparagraph><subparagraph id="idDF615FCA17554EB096D628144FB55708"><enum>(B)</enum><text>by striking

			 <quote>Under Secretary for Management</quote> and inserting <quote>Deputy

			 Secretary of Homeland Security for Management</quote>;</text>

					</subparagraph><subparagraph id="id9827722798F34B35A312FEE5EFA04799"><enum>(C)</enum><text>by striking

			 paragraph (7) and inserting the following:</text>

				planning and annual performance planning and identification and tracking of

				performance measures relating to the responsibilities of the

				Department.</text>

			 paragraph (9), and inserting the following:</text>

				and transformation process, to ensure an efficient and orderly consolidation of

				functions and personnel to the Department, including the development of a

				management integration strategy for the

				Department.</text>

					</subparagraph></paragraph></subsection><subsection id="idE20C1C2BDEC44E67AA7EE06C98CB3809"><enum>(c)</enum><header>Appointment,

			 evaluation, and reappointment</header><text>Section 701 of the Homeland

			 Security Act of 2002 (6 U.S.C. 341), as amended by this Act, is further amended

			 by adding at the end the following:</text>

				<quoted-block display-inline="no-display-inline" id="id353E8010384D471AA43D2858FC85485C" style="OLC">

					<subsection id="idE5E1BCFABAA54A5D9950DC63E99D8536"><enum>(c)</enum><header>Appointment,

				evaluation, and reappointment</header><text>The Deputy Secretary of Homeland

				Security for Management—</text>

						<paragraph id="ID09f20cf125874dfba1dd62e761be777d"><enum>(1)</enum><text>shall be

				appointed by the President, by and with the advice and consent of the Senate,

				from among persons who have—</text>

							<subparagraph id="id0F44346E3C234586AC1654E135BFB941"><enum>(A)</enum><text>extensive

				executive level leadership and management experience in the public or private

				sector;</text>

							</subparagraph><subparagraph id="idA9D9D21F751F433CA675FEE09E528BB6"><enum>(B)</enum><text>strong leadership

				skills;</text>

							</subparagraph><subparagraph id="idE0CD441C58464E7EA0204F7B6D1B8903"><enum>(C)</enum><text>a demonstrated

				ability to manage large and complex organizations; and</text>

							</subparagraph><subparagraph id="id91CE3E73038A465AA33845D36878F01A"><enum>(D)</enum><text>a proven record

				in achieving positive operational results;</text>

							</subparagraph></paragraph><paragraph id="ID141234536c634ec0b89c5ce3aad8efb5"><enum>(2)</enum><text>shall serve for a

				term of 5 years, but may be removed by the Secretary of Homeland Security based

				upon an unsatisfactory annual determination under paragraph (5);</text>

						</paragraph><paragraph id="IDef6079ab971b46939472ecfebd8dbaa2"><enum>(3)</enum><text>may be

				reappointed in accordance with paragraph (1), if the Secretary has made a

				satisfactory determination under paragraph (5) for the 3 most recent

				performance years;</text>

						</paragraph><paragraph id="ID4c2d04e622cf4faa91dde7690e938295"><enum>(4)</enum><text>shall enter into

				a publicly available annual performance agreement with the Secretary that shall

				set forth measurable individual and organizational goals; and</text>

						</paragraph><paragraph id="IDb82d687ba00d46ed92912a9c04b0a0ae"><enum>(5)</enum><text>shall be subject

				to an annual performance evaluation by the Secretary, who shall determine as

				part of each such evaluation whether the Deputy Secretary of Homeland Security

				for Management has made satisfactory progress toward achieving the goals set

				out in the performance agreement required under paragraph

				(4).</text>

						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection id="idFD9AD6DDB50A45DAA7C1755CEF1D95ED"><enum>(d)</enum><header>Incumbent</header><text>The

			 individual who serves in the position of Under Secretary for Management of the

			 Department of Homeland Security on the date of enactment of this Act—</text>

				<paragraph id="idFE8D8C3C5F114AF69459A7DC89EB284B"><enum>(1)</enum><text>may perform all

			 the duties of the Deputy Secretary of Homeland Security for Management at the

			 pleasure of the President, until a Deputy Secretary of Homeland Security for

			 Management is appointed in accordance with subsection (c) of section 701 of the

			 Homeland Security Act of 2002 (6 U.S.C. 341), as added by this Act; and</text>

				</paragraph><paragraph id="id87D141B485F64EED9307B8DC0A2C453F"><enum>(2)</enum><text>may be appointed

			 Deputy Secretary of Homeland Security for Management, if such appointment is

			 otherwise in accordance with sections 103 and 701 of the Homeland Security Act

			 of 2002 (6 U.S.C. 113 and 341), as amended by this Act.</text>

				</paragraph></subsection><subsection id="id5C750DF04DB54D139D119E37F4CF8484"><enum>(e)</enum><header>References</header><text>References

			 in any other Federal law, Executive order, rule, regulation, or delegation of

			 authority, or any document of or relating to the Under Secretary for Management

			 of the Department of Homeland Security shall be deemed to refer to the Deputy

			 Secretary of Homeland Security for Management.</text>

			</subsection><subsection id="id3388105F342D448086A20B613B2D0453"><enum>(f)</enum><header>Technical and

			 conforming amendments</header>

				<paragraph id="id0A16EB9A790B4AD58B9DFE4CBEB1104B"><enum>(1)</enum><header>Other

			 reference</header><text>Section 702(a) of the Homeland Security Act of 2002 (6

			 U.S.C. 342(a)) is amended by striking <quote>Under Secretary for

			 Management</quote> and inserting <quote>Deputy Secretary of Homeland Security

			 for Management</quote>.</text>

				</paragraph><paragraph id="id0C9416A408D849249B91BC37FFB0A256"><enum>(2)</enum><header>Table of

			 contents</header><text>The table of contents in section 1(b) of the Homeland

			 Security Act of 2002 (6 U.S.C. 101(b)) is amended by striking the item relating
