			 <quote><short-title>Abandoned Mine Land Reclamation Reform

			 Act of 2005</short-title></quote>.</text>

		</section><section commented="no" display-inline="no-display-inline" id="ID337A1B660A50401DB1DF1DCEDD88F2B3" section-type="subsequent-section"><enum>2.</enum><header>Abandoned mine

			 reclamation fund</header>

			<subsection commented="no" display-inline="no-display-inline" id="ID71B83030EEAB496EB2AD1CDE5CAEC03F"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Section 401(c) of the

			 Surface Mining Control and Reclamation Act of 1977 (30 U.S.C. 1231(c)) is

			 amended—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="ID46EC5D7CC5B14BD2B0E9D6E732154745"><enum>(1)</enum><text display-inline="yes-display-inline">by striking paragraphs (2) and (6);

			 and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD79DAD13AB894EBAAC4CDD20348DCA8E"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (3) through (5)

			 and (7) through (13) as paragraphs (2) through (11), respectively.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDA314E4ED88C74FCD98CBC9723C960A0B"><enum>(b)</enum><header>Conforming

			 amendment</header><text display-inline="yes-display-inline">Section 712(b) of

			 the Surface Mining Control and Reclamation Act of 1977 (30 U.S.C. 1302(b)) is

			 amended by striking <quote>section 401(c)(11)</quote> and inserting

			 <quote>section 401(c)(9)</quote>.</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="ID56FC3534DEC74B21902BCBFA1317BEA8" section-type="subsequent-section"><enum>3.</enum><header>Reclamation

			 fee</header>

			<subsection commented="no" display-inline="no-display-inline" id="ID6728C949486A4B1984E5AE23DFCAC93E"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Section 402 of the

			 Surface Mining Control and Reclamation Act of 1977 (30 U.S.C. 1232) is

			 amended—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="ID9C59CAAA89894EF1A1FA2AEE93FDB2F1"><enum>(1)</enum><text display-inline="yes-display-inline">by striking subsection (a) and inserting

			 the following:</text>

					<quoted-block display-inline="no-display-inline" id="ID8BF081E0E3124A85852FBCB06402F7F0" style="OLC">

						<subsection commented="no" display-inline="no-display-inline" id="ID5BA016CF57FE4939839CB46BFD1F39CF"><enum>(a)</enum><header>In

				general</header><text display-inline="yes-display-inline">Any operator of a

				coal mining operation subject to this Act shall pay to the Secretary of the

				Interior, for deposit in the fund—</text>

							<paragraph commented="no" display-inline="no-display-inline" id="IDE74FB10BA10B4330823AD38BF0766C83"><enum>(1)</enum><text display-inline="yes-display-inline">for coal produced by surface coal

				mining—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="IDCF8850EA953C456AB556E1B88B3962D6"><enum>(A)</enum><text display-inline="yes-display-inline">for the period beginning on July 1, 2006,

				and ending on October 1, 2009, 32 cents per ton of coal produced;</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID22CA1F830381455695F99CD4F1E38B83"><enum>(B)</enum><text display-inline="yes-display-inline">for the period beginning on October 1,

				2009, and ending on October 1, 2013, 30 cents per ton of coal produced;

				and</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1AECFE997CE343F7907878F483E1F27C"><enum>(C)</enum><text display-inline="yes-display-inline">for the period beginning on October 1,

				2013, and ending on October 1, 2016, 28 cents per ton of coal produced;</text>

								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5A15ACAFCB4C49408AED740646534E2E"><enum>(2)</enum><text display-inline="yes-display-inline">for coal produced by underground

				mining—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="IDBFAD5EB91B32491EA12E6B6E73622EBF"><enum>(A)</enum><text display-inline="yes-display-inline">for the period beginning on July 1, 2006,

				and ending on October 1, 2009, 15 cents per ton of coal produced;</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID7A9A0D55F5FF4D238F9C1E85082CF924"><enum>(B)</enum><text display-inline="yes-display-inline">for the period beginning on October 1,

				2009, and ending on October 1, 2013, 12 cents per ton of coal produced;

				and</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID533B1FEE72A0400F8D71F7D33F7714DE"><enum>(C)</enum><text display-inline="yes-display-inline">for the period beginning on October 1,

				2013, and ending on October 1, 2016, 12 cents per ton of coal produced;

				and</text>

								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID388E17C2FE454A22888F28563EE88E10"><enum>(3)</enum><text display-inline="yes-display-inline">for lignite coal—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="IDDEE1E60A880043658924FB6ACDAB6229"><enum>(A)</enum><text display-inline="yes-display-inline">for the period beginning on July 1, 2006,

				and ending on October 1, 2009, 10 cents per ton of lignite coal

				produced;</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID35C11E5705504BC988B8508EA259B6A8"><enum>(B)</enum><text display-inline="yes-display-inline">for the period beginning on October 1,

				2009, and ending on October 1, 2013, 8 cents per ton of lignite coal produced;

				and</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID71D17F030C6C478DA41BD47B96E1A21F"><enum>(C)</enum><text display-inline="yes-display-inline">for the period beginning on October 1,

				2013, and ending on October 1, 2016, 8 cents per ton of lignite coal

				produced.</text>

								</subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID07D67A2CC83E42418C3790E4D84DFE7D"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b), by striking <quote>June

			 30, 2006,</quote> and all that follows through the end and inserting

			 <quote>September 30, 2016.</quote>; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID90408E9A8A754B8A95365D26B8BC287C"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (g)—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="ID834B35FEE50940F58A1EA203BAFAAC69"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1)(D), by striking <quote>in

			 any area under paragraph (2), (3), (4), or (5)</quote> and inserting

			 <quote>under paragraph (4)</quote>;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDAAC4B5A4FAC64D25B5D4BC22AB78659B"><enum>(B)</enum><text display-inline="yes-display-inline">by striking paragraph (2);</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDA8595C0F6A884DC1915CDE46E7C41B6B"><enum>(C)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (3), (4), (5),

			 (6), (7), and (8) as paragraphs (2), (3), (4), (5), (6), and (7),

			 respectively;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID01C9236F87224CE69511AEAF7C90976C"><enum>(D)</enum><text display-inline="yes-display-inline">in paragraph (2) (as redesignated by

			 subparagraph (C))—</text>

						<clause commented="no" display-inline="no-display-inline" id="ID66618EC586524F42BA78D9081A23E2B7"><enum>(i)</enum><text display-inline="yes-display-inline">in the matter preceding subparagraph (A),

			 by striking <quote>paragraphs (2) and (5)</quote> and inserting

						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDE3186A964CC64C31A5BD6D448644FC9F"><enum>(F)</enum><text display-inline="yes-display-inline">in paragraph (4) (as redesignated by

			 subparagraph (C))—</text>

						<clause commented="no" display-inline="no-display-inline" id="ID6866A1A58F7948FE86451DDF2EA0D44C"><enum>(i)</enum><text display-inline="yes-display-inline">in the first sentence, by striking

			 <quote>The Secretary shall allocate 40</quote> and inserting <quote>(A) The

			 Secretary shall allocate 60</quote>;</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="IDAFD78C0547BF4C8499013C06ABD2167E"><enum>(ii)</enum><text display-inline="yes-display-inline">in the last sentence, by striking

			 <quote>Funds allocated or expended by the Secretary under paragraphs (2), (3),

			 or (4) of this subsection</quote> and inserting <quote>Funds made available

			 under paragraph (2) or (3)</quote>; and</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="ID72A204B5D911410FA338CB3E76866500"><enum>(iii)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>

							<quoted-block display-inline="no-display-inline" id="ID5D8E7DE29F3D4D1EBE33677DC7776DD5" style="OLC">

								<subparagraph commented="no" display-inline="no-display-inline" id="ID65433BCC12A94191B98CA08578AB8CFC"><enum>(B)</enum><text display-inline="yes-display-inline">Any amount that is made available under

				paragraph (8) shall be in addition to amounts that are allocated under

				subparagraph (A).</text>

								</subparagraph><after-quoted-block>;

				and</after-quoted-block></quoted-block>

						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDA117DC0FC44F4CB3BA0AE41A69F32474"><enum>(G)</enum><text display-inline="yes-display-inline">by striking paragraphs (5), (6), and (7)

			 (as redesignated by subparagraph (C)) and inserting the following:</text>

						<quoted-block display-inline="no-display-inline" id="IDB745D6B678744950AAD5A9B98F30EA0A" style="OLC">

							<paragraph commented="no" display-inline="no-display-inline" id="ID28357E9D6B8A465CA96F67BDF8F196F6"><enum>(5)</enum><header>Abatement of

				acid mine drainage</header>

								<subparagraph commented="no" display-inline="no-display-inline" id="IDB4BE7F8F714D4C02AB26C1D7277831C8"><enum>(A)</enum><header>Definition of

				qualified hydrologic unit</header><text display-inline="yes-display-inline">In

				this paragraph, the term <term>qualified hydrologic unit</term> means a

				hydrologic unit—</text>

									<clause commented="no" display-inline="no-display-inline" id="ID8EDBF22624904D11A1B7E17CA3B2EA84"><enum>(i)</enum><text display-inline="yes-display-inline">in which the water quality has been

				significantly affected by acid mine drainage from coal mining practices in a

				manner that adversely affects biological resources; and</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="IDC92956817DC64EDA8164994018639175"><enum>(ii)</enum><text display-inline="yes-display-inline">that contains land and water that

				is—</text>

										<subclause commented="no" display-inline="no-display-inline" id="ID1F8E081C875A44BC8620A5E4C0D403EC"><enum>(I)</enum><text display-inline="yes-display-inline">eligible under section 404 and appropriate

				for the expenditure of moneys from the fund for the purposes specified in

				section 403(a); and</text>

										</subclause><subclause commented="no" display-inline="no-display-inline" id="ID6E4EA7406755482295922375E9D91652"><enum>(II)</enum><text display-inline="yes-display-inline">the subject of expenditures by the State

				from the forfeiture of a bond filed under section 509 or from any other State

				source to abate and treat acid mine drainage.</text>

										</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID494E201E7F274F768E8BB065D2A75341"><enum>(B)</enum><header>Use of funds

				for abatement of acid mine drainage</header><text display-inline="yes-display-inline">Any State with an approved abandoned mine

				reclamation program under section 405 may receive and retain, without regard to

				the 3-year limitation referred to in paragraph (1)(D), up to 20 percent of the

				total amount of the grants made annually to the State under paragraphs (1) and

				(4) if—</text>

									<clause commented="no" display-inline="no-display-inline" id="IDCC4CB759767948BA87572EDD4FB09B08"><enum>(i)</enum><text display-inline="yes-display-inline">the amount retained is deposited in an acid

				mine drainage abatement and treatment fund established under State law;

				and</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="ID43E485D0B3F14C2C97BB302E2C98B72F"><enum>(ii)</enum><text display-inline="yes-display-inline">the amount deposited under clause (i)

				(together with all interest earned on the amount) is expended by the State for

				the abatement of the causes and the treatment of the effects of acid mine

				drainage in a comprehensive manner within qualified hydrologic units affected

				by coal mining practices.</text>

									</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8F72DEB44A7C41A5A7A6DAC7A6DAA66C"><enum>(6)</enum><header>Certain

				reclamation projects</header><text display-inline="yes-display-inline">In

				complying with the priorities specified in section 403(a), any State or Indian

				tribe may expend amounts available in grants made annually to the State or

				tribe under paragraphs (1) and (4) for projects for the purpose specified in

				section 403(a)(3) prior to the completion of reclamation projects under

				paragraphs (1) and (2) of section 403(a) only if the expenditure is made in

				conjunction with the expenditure of funds before, on, or after the date of

				enactment of the Abandoned Mine Land Reclamation Reform Act of 2005 for

				reclamation projects under paragraphs (1) and (2) of section 403(a).</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC9486C2BD3DF45E7B49FCF72D4FA2504"><enum>(7)</enum><header>Minimum

				amount</header><text display-inline="yes-display-inline">In making grants

				referred to in paragraph (1)(C) and in making expenditures under paragraph

				(2)(C), the Secretary, using amounts allocated to a State or Indian tribe under

				subparagraph (A) or (B) of paragraph (1), or, as necessary, amounts available

				to the Secretary under paragraph (2), shall ensure that total grant awards or

				expenditures of not less than $2,000,000 are made annually to or in each State

				that has an approved abandoned mine reclamation program under section 405 in

				effect on June 30, 2004, the State of Tennessee, and each Indian tribe.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID28CB1B224895420B8C2A245FD0CD93E7"><enum>(8)</enum><header>Payments to

				States and Indian tribes</header>

								<subparagraph commented="no" display-inline="no-display-inline" id="IDE8A65F14518D49B095861E66ED96182D"><enum>(A)</enum><header>In

				general</header><text display-inline="yes-display-inline">The Secretary shall,

				using amounts allocated in the fund to a State or Indian tribe before October

				1, 2006, pay to the State or Indian tribe an amount equal to the sum of the

				aggregate unappropriated amount allocated to the State or Indian tribe under

				subparagraph (A) or (B) of paragraph (1) (referred to in this paragraph as the

				<quote>amount due</quote>).</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDABB58A60850B40248CBA9F2366A26287"><enum>(B)</enum><header>Schedule</header><text display-inline="yes-display-inline">Payments under subparagraph (A) shall be

				made in accordance with the following schedule:</text>

									<clause commented="no" display-inline="no-display-inline" id="IDFCCBF8529E154AC0B80621470427EE8B"><enum>(i)</enum><text display-inline="yes-display-inline">If the amount due to a State or Indian

				tribe is less than $2,000,000, the Secretary shall pay to the State or Indian

				tribe the amount due on December 31, 2006.</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="ID88101EEECA224B26AD1903C2C496B83B"><enum>(ii)</enum><text display-inline="yes-display-inline">If the amount due to a State or Indian

				tribe is $2,000,000 or more but less than $30,000,000, the Secretary shall pay

				to the State or Indian tribe—</text>

										<subclause commented="no" display-inline="no-display-inline" id="ID05822885AF44420FA1420EC86DD9944F"><enum>(I)</enum><text display-inline="yes-display-inline"><fraction>1/2</fraction> of the amount due

				on December 31, 2006; and</text>

										</subclause><subclause commented="no" display-inline="no-display-inline" id="IDB388A75BE8904476A0D6F065C2ABDB5E"><enum>(II)</enum><text display-inline="yes-display-inline"><fraction>1/2</fraction> of the amount due

				on December 31, 2007.</text>

										</subclause></clause><clause commented="no" display-inline="no-display-inline" id="ID78EE85C079B0490FB788106E3C8EC301"><enum>(iii)</enum><text display-inline="yes-display-inline">If the amount due to a State or Indian

				tribe is $30,000,000 or more but less than $100,0000,000, the Secretary shall

				pay to the State or Indian tribe—</text>

										<subclause commented="no" display-inline="no-display-inline" id="ID6FF41D1AFDF543959F5C42DF3AAB159E"><enum>(I)</enum><text display-inline="yes-display-inline"><fraction>1/3</fraction> of the amount due

				on December 31, 2006;</text>

										</subclause><subclause commented="no" display-inline="no-display-inline" id="IDB1786A7DBD2E44469EB421A330256D0D"><enum>(II)</enum><text display-inline="yes-display-inline"><fraction>1/3</fraction> of the amount due

				on December 31, 2007; and</text>

										</subclause><subclause commented="no" display-inline="no-display-inline" id="ID350F2DAB567745C0B7626A0DC65041A0"><enum>(III)</enum><text display-inline="yes-display-inline"><fraction>1/3</fraction> of the amount due

				on December 31, 2008.</text>

										</subclause></clause><clause commented="no" display-inline="no-display-inline" id="ID3CFBA36519F841DAB44E42E9427377CD"><enum>(iv)</enum><text display-inline="yes-display-inline">If the amount due to a State or Indian

				tribe is $100,000,000 or more but less than $200,0000,000, the Secretary shall

				pay to the State or Indian tribe—</text>

										<subclause commented="no" display-inline="no-display-inline" id="ID8EDFAD0036DD48989DE3CF9B513C6A54"><enum>(I)</enum><text display-inline="yes-display-inline"><fraction>1/4</fraction> of the amount due

				on December 31, 2006;</text>

										</subclause><subclause commented="no" display-inline="no-display-inline" id="IDD54AE0287FBD4A1988A4410A8C4A6DF0"><enum>(II)</enum><text display-inline="yes-display-inline"><fraction>1/4</fraction> of the amount due

				on December 31, 2007;</text>

										</subclause><subclause commented="no" display-inline="no-display-inline" id="ID518C7319E01349049263216CFD888F0E"><enum>(III)</enum><text display-inline="yes-display-inline"><fraction>1/4</fraction> of the amount due

				on December 31, 2008; and</text>

										</subclause><subclause commented="no" display-inline="no-display-inline" id="ID6F7BED0FCFF74862A795A01DA816141F"><enum>(IV)</enum><text display-inline="yes-display-inline"><fraction>1/4</fraction> of the amount due

				on December 31, 2009.</text>

				established by the State legislature or tribal council of the Indian tribe,

			 Surface Mining Control and Reclamation Act of 1977 (30 U.S.C. 1232(h)) is

			 reclamation fees by States and Indian tribes</header><text display-inline="no-display-inline">Section 402 of the Surface Mining Control

			 and Reclamation Act of 1977 (30 U.S.C. 1232) (as amended by section 4) is

			 amended by adding at the end the following:</text>

			<quoted-block display-inline="no-display-inline" id="ID8C1EC353077C4D7FAAE3EA0CA1D4A502" style="OLC">

				<subsection commented="no" display-inline="no-display-inline" id="ID79C301E1D3904A47A9DDBE9D302FC64D"><enum>(i)</enum><header>Collection of

				reclamation fees</header>

					<paragraph commented="no" display-inline="no-display-inline" id="IDF560308AE23E4A819C0E24BD9812E4E6"><enum>(1)</enum><header>In

				general</header><text display-inline="yes-display-inline">On the request of the

				Governor of a State or head of a governing body of an Indian tribe, the

				Secretary shall enter into an agreement authorizing the State or Indian tribe

				to collect the fees required under subsection (a) (referred to in this

				subsection as the <quote>reclamation fees</quote>) on or after July 1,

				2006.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID79A5587952744EF4830989EEFAD31902"><enum>(2)</enum><header>Payments</header>

						<subparagraph commented="no" display-inline="no-display-inline" id="ID3DB1BCB1C2F84F9FA261D5DBE2D0A2DB"><enum>(A)</enum><header>In

				general</header><text display-inline="yes-display-inline">Any operator of a

				coal mining operation subject to this Act, with respect to coal mined in a

				State or from land of an Indian tribe that is subject to an agreement entered

				into under paragraph (1), shall pay to the head of the State agency or Indian

				tribe that is responsible for collecting revenue from coal mining operators

				(referred to in this subsection as the <quote>agency head</quote>) the

				reclamation fees.</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID138228F7BCC7471BB75FA0E4922AAB7D"><enum>(B)</enum><header>Certification</header><text display-inline="yes-display-inline">On receipt of the reclamation fees under

				subparagraph (A), the agency head shall—</text>

							<clause commented="no" display-inline="no-display-inline" id="IDE28C162572F54DF5B076681AD5CBA747"><enum>(i)</enum><text display-inline="yes-display-inline">certify to the Secretary receipt of the

				fees;</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="ID27EFAFBAACA5435B8D5DFD018CDB294E"><enum>(ii)</enum><text display-inline="yes-display-inline">remit <fraction>1/2</fraction> of the fees

				to the Secretary; and</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="IDDF2A5431DE9141E396649BCD150E9DB6"><enum>(iii)</enum><text display-inline="yes-display-inline">retain <fraction>1/2</fraction> of the fees

				as the share due to the State or Indian tribe.</text>

							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID41672ED40F61483DAB8CD74E74051858"><enum>(C)</enum><header>Limitation</header><text display-inline="yes-display-inline">A State or Indian tribe that collects

				reclamation fees under this subsection is not eligible for an allocation under

				subparagraph (A) or (B) of section 402(g)(1).</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDCBD9E3325176493FBECAC40EF6CA3C2E"><enum>(D)</enum><header>Use of

				funds</header><text display-inline="yes-display-inline">Any reclamation fees

				collected and retained by an agency head under subparagraph (A) shall be used

				by the State or Indian tribe for the purposes described in section

				403.</text>

						</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

		</section><section commented="no" display-inline="no-display-inline" id="ID94A45DACD2E146D58FA1F81BEFBE9FCE" section-type="subsequent-section"><enum>6.</enum><header>Objectives of

			 fund</header><text display-inline="no-display-inline">Section 403 of the

			 Surface Mining Control and Reclamation Act of 1977 (30 U.S.C. 1233(a)) is

			 amended—</text>

			<paragraph commented="no" display-inline="no-display-inline" id="ID5F846F74C16A4B15894B24D2B4A8F5A6"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)—</text>

				of coal mining practices; and</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="ID8893319D961A434BB9605B4068F3BE0F"><enum>(ii)</enum><text display-inline="yes-display-inline">are adjacent to a site that has been

				remediated under subparagraph (A);</text>

								</clause></subparagraph><after-quoted-block>;

				and</after-quoted-block></quoted-block>

					</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDCAA2CA2BB66740ADBC4CF2A92181380B"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (2), by striking

			 <quote>health, safety, and general welfare</quote> and inserting <quote>health

			 and safety</quote>;</text>

				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1E788359411647709FD6E1F0782A310E"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b)—</text>

			 and Reclamation Act of 1977 (30 U.S.C. 1238) is amended in the last sentence by

			 striking <quote>who owned the surface prior to May 2, 1977, and</quote>.</text>

		</section><section commented="no" display-inline="no-display-inline" id="ID3D53786EC08D4EDFB70A8148B7AEEE50" section-type="subsequent-section"><enum>9.</enum><header>Remining</header>

			<subsection commented="no" display-inline="no-display-inline" id="ID88286A8A076842C8B7DF76E950D53964"><enum>(a)</enum><header>Incentives</header><text display-inline="yes-display-inline">Title IV of the Surface Mining Control and

			 Reclamation Act of 1977 (30 U.S.C. 1231 et seq.) is amended by adding at the

			 end the following:</text>

				<quoted-block display-inline="no-display-inline" id="ID753DE3FC035344DD9D5E05F6A8415564" style="OLC">

					<section commented="no" display-inline="no-display-inline" id="ID5059249B9B2F4B479548907048CDB901" section-type="subsequent-section"><enum>415.</enum><header>Remining

				incentives</header>

						<subsection commented="no" display-inline="no-display-inline" id="ID30ED43DD3F0C45C395ED4215B7DA4666"><enum>(a)</enum><header>In

				general</header><text display-inline="yes-display-inline">Notwithstanding any

				other provision of this Act, the Secretary may, after opportunity for public

				comment, promulgate regulations that describe conditions under which amounts in

				the fund may be used to provide incentives to promote remining of eligible land

				under section 404 in a manner that leverages the use of amounts from the fund

				to achieve more reclamation with respect to the eligible land than would be

				achieved without the incentives.</text>

						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID328D7072C51242DEA9D2E8DE1C46D488"><enum>(b)</enum><header>Requirements</header><text display-inline="yes-display-inline">Any regulations promulgated under

				subsection (a) shall specify that the incentives shall apply only if the

				Secretary of the Interior determines, with the concurrence of the State

				regulatory authority referred to in title V, that, without the incentives, the

				eligible land would not be likely to be remined and reclaimed.</text>

						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID44D6E237780A4F3483AFC6BAA76F4C25"><enum>(c)</enum><header>Incentives</header>

							<paragraph commented="no" display-inline="no-display-inline" id="ID84FECB37732D4479BB4D9E43CDB6E05C"><enum>(1)</enum><header>In

				general</header><text display-inline="yes-display-inline">Incentives that may

				be considered for inclusion in the regulations promulgated under subsection (a)

				include—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="ID43C7001C02494C0D962ED1EC948D4B8E"><enum>(A)</enum><text display-inline="yes-display-inline">a rebate or waiver of the reclamation fees

				required under section 402(a); and</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID115963CC645B4CCD8EFE8F8F6A7AC270"><enum>(B)</enum><text display-inline="yes-display-inline">the use of amounts in the fund to provide

				financial assurance for remining operations in lieu of all or a portion of the

				performance bonds required under section 509.</text>

								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9FBEB8743CCC4963B71166B9D806C2C9"><enum>(2)</enum><header>Limitations</header>

								<subparagraph commented="no" display-inline="no-display-inline" id="ID3AB60185B1D64818AAD64FD9F15F5E9E"><enum>(A)</enum><header>Use</header><text display-inline="yes-display-inline">A rebate or waiver under paragraph (1)(A)

				shall be used only for operations that—</text>

									<clause commented="no" display-inline="no-display-inline" id="ID57D7F4BA5D8B42DFAA0A45587CEBFA99"><enum>(i)</enum><text display-inline="yes-display-inline">remove or reprocess abandoned coal mine

				waste; or</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="IDD6DCE0ACEF7A4D2D8600BD559E9C3478"><enum>(ii)</enum><text display-inline="yes-display-inline">conduct remining activities that meet the

				priorities specified in paragraph (1) or (2) of section 403(a).</text>

									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID09F712224D0C4191930139F086C98C20"><enum>(B)</enum><header>Amount</header><text display-inline="yes-display-inline">The amount of a rebate or waiver provided

				as an incentive under paragraph (1)(A) to remine or reclaim eligible land shall

				not exceed the estimated cost of reclaiming the eligible land under this

				section</text>

								</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID961350228AF047359120EFF2EA0A7701"><enum>(b)</enum><header>Extension of

			 authority</header><text display-inline="yes-display-inline">Section 510(e) of

			 the Surface Mining Control and Reclamation Act of 1977 (30 U.S.C. 1260(e)) is

			 amended in the last sentence by striking <quote>2004</quote> and inserting

			 <quote>2015</quote>.</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="IDF5BE109F97D54FF0947FB169929B23C4" section-type="subsequent-section"><enum>10.</enum><header>Interest

			 transfers</header>

			<subsection commented="no" display-inline="no-display-inline" id="ID4668FFE522574F6DB9078BDC8105FD22"><enum></enum><text display-inline="yes-display-inline">Notwithstanding any other provision of law,

			 interest credited to the fund established by section 401 of the Surface Mining

			 Control and Reclamation Act of 1977 (30 U.S.C. 1231) that are not transferred

			 to the Combined Benefit Fund referred to in section 402(h) of that Act (30

			 U.S.C. 1232(h)), before the date of enactment of this Act shall be available

			 for fiscal year 2006 and thereafter for the transfers referred to in section

			 402(h)(2) of that Act (30 U.S.C. 1232(h)(2)), in the same manner as are other

			 amounts available for the transfers.</text>
