		  Katrina Recovery Chief Financial Officer, and for other

		  purposes.</official-title>

		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Oversight of Vital Emergency Recovery

			 Spending Enhancement and Enforcement Act of 2005</short-title></quote>.</text>

		</section><section commented="no" display-inline="no-display-inline" id="idB7C87330029147C8ACAC03926909FE0D" section-type="subsequent-section"><enum>2.</enum><header>Definitions</header>

			<subsection commented="no" display-inline="no-display-inline" id="idED2C51C1A23E46F1ABD0E2B0575804F7"><enum>(a)</enum><header>Chief Financial

			 Officer</header><text display-inline="yes-display-inline">The term <term>Chief

			 Financial Officer</term> means the Hurricane Katrina Recovery Chief Financial

			 Officer.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="idDE39A86E201E4D9CA3FC85312A6812C4"><enum>(b)</enum><header>Office</header><text display-inline="yes-display-inline">The term <term>Office</term> means the

			 Office of the Hurricane Katrina Recovery Chief Financial Officer.</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="id8045C89947894C7EB19B5FB0188E89BA" section-type="subsequent-section"><enum>3.</enum><header>Establishment and

			 functions</header>

			<subsection commented="no" display-inline="no-display-inline" id="idAF1BC8C7A3FE4363817B6234FEBD6558"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established within the Executive

			 Office of the President, the Office of the Hurricane Katrina Recovery Chief

			 Financial Officer.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="idBFDEFFBDD11048F79B04371FFE97AFF3"><enum>(b)</enum><header>Chief Financial

			 Officer</header>

				<paragraph commented="no" display-inline="no-display-inline" id="idAEECA7D4C7974A879BA7000AD2C2ACE8"><enum>(1)</enum><header>Appointment</header><text display-inline="yes-display-inline">The Hurricane Katrina Recovery Chief

			 Financial Officer shall be the head of the Office. The Chief Financial Officer

			 shall be appointed by the President, by and with the advice and consent of the

			 Senate.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5E28CD1205E54D03A472D067952DC72B"><enum>(2)</enum><header>Qualifications</header><text display-inline="yes-display-inline">The Chief Financial Officer shall have the

			 qualifications required under section 901(a)(3) of title 31, United States

			 Code.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idCA6219F698BF4F3AA206B67F2E1CE351"><enum>(c)</enum><header>Functions</header>

				<paragraph commented="no" display-inline="no-display-inline" id="idD39F3502F73643F0BE4D376849315B6E"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Chief Financial

			 Officer shall—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="id1E69D1FD02B84B8586D036652B8A9530"><enum>(A)</enum><text display-inline="yes-display-inline">be responsible for the efficient and

			 effective use of Federal funds in all activities relating to the recovery from

			 Hurricane Katrina;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id844D6C2574C84293970FC4A8DCBB78F2"><enum>(B)</enum><text display-inline="yes-display-inline">have all authorities and perform all

			 functions of a Chief Financial Officer under section 902 of title 31, United

			 States Code, with respect to all agencies and all Federal activities relating

			 to the recovery from Hurricane Katrina in accordance with paragraph (2);

			 and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id77BE3F2BEEA54ADAA639ABE6504D9362"><enum>(C)</enum><text display-inline="yes-display-inline">strive to ensure that—</text>

						<clause commented="no" display-inline="no-display-inline" id="idCB9CAE05D9C649B687121FAAA980F80A"><enum>(i)</enum><text display-inline="yes-display-inline">priority in the distribution of Federal

			 relief funds is given to individuals and organizations most in need of

			 financial assistance; and</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="id82ACADDCC36F4332BCA9F2857F925F14"><enum>(ii)</enum><text display-inline="yes-display-inline">priority in the distribution of Federal

			 reconstruction funds is given to business entities that are based in Louisiana,

			 Mississippi, Alabama, or Florida or business entities that hire workers who

			 resided in those States on August 24, 2005.</text>

						</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFCB616FE929240FFA7B62B461EE4361E"><enum>(2)</enum><header>Coordination of

			 agencies</header><text display-inline="yes-display-inline">In the performance

			 of the functions under paragraph (1)(B) by the Chief Financial Officer—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="id8710612960D440F2B5712187E0C031E1"><enum>(A)</enum><text display-inline="yes-display-inline">the President shall act as the head of the

			 agency and the Chief Financial Officer shall have management and oversight of

			 all agencies performing activities relating to the recovery from Hurricane

			 Katrina for purposes of the application of section 902 of title 31, United

			 States Code; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC9B53368C1744510980FA85089B58066"><enum>(B)</enum><text display-inline="yes-display-inline">the Chief Financial Officer shall

			 coordinate and have management and oversight responsibilities of each

			 applicable Chief Financial Officer in the performance of functions under

			 section 902(a) (5) and (6) of title 31, United States Code, instead of

			 performing such functions for each applicable agency.</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9A426FA374A74FFC8EE696137EC64753"><enum>(3)</enum><header>Regular

			 reports</header>

					<subparagraph commented="no" display-inline="no-display-inline" id="id6791C64303D0425C89885214761EAB1A"><enum>(A)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Every month the Chief

			 Financial Officer shall submit a financial report on the activities for which

			 the Chief Financial Officer has management and oversight responsibilities

			 to—</text>

						<clause commented="no" display-inline="no-display-inline" id="id9A1CF0185BCF458484F864C3DB1DD3F1"><enum>(i)</enum><text display-inline="yes-display-inline">the Committee on Homeland Security and

			 Governmental Affairs of the Senate;</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="id2939A47666634C5985A608B404DD8A18"><enum>(ii)</enum><text display-inline="yes-display-inline">the Committee on Homeland Security of the

			 House of Representatives;</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="idF1C40FE5A6F543E1B702BBF8BC593C5F"><enum>(iii)</enum><text display-inline="yes-display-inline">the Committees on Appropriations of the

			 Senate and House of Representatives; and</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="idFF406060570843D38D991B808DCC6106"><enum>(iv)</enum><text display-inline="yes-display-inline">the Committee on Government Reform of the

			 House of Representatives.</text>

						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5B1953A6879A482D974B200F47B82E12"><enum>(B)</enum><header>Contents</header><text display-inline="yes-display-inline">Each report under this paragraph shall

			 include—</text>

						<clause commented="no" display-inline="no-display-inline" id="id9B5ADDE846F64B338F6B92818082FB3A"><enum>(i)</enum><text display-inline="yes-display-inline">the extent to which Federal relief funds

			 have been given to individuals and organizations most in need of financial

			 assistance;</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="id4E59910CD1B040369E09635848B43E07"><enum>(ii)</enum><text display-inline="yes-display-inline">the extent to which Federal reconstruction

			 funds have been made available to business entities that are based in

			 Louisiana, Mississippi, Alabama, or Florida or business entities that hire

			 workers who resided in those States on August 24, 2005; and</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="id202C9AD8192B4BABA2A051797B5394F2"><enum>(iii)</enum><text display-inline="yes-display-inline">the extent to which Federal agencies have

			 made use of sole source or cost-plus contracts.</text>

						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2596A6ACD671482C9BF650B4D5946168"><enum>(C)</enum><header>First

			 report</header><text display-inline="yes-display-inline">The first report under

			 this paragraph shall be submitted for the first full month for which a Chief

			 Financial Officer has been appointed.</text>

					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idA71F5805363140558CEEBF7542C6EB35"><enum>(d)</enum><header>Responsibilities

			 of chief financial officers</header><text display-inline="yes-display-inline">Nothing in this Act shall be construed as

			 to relieve the responsibilities of any Chief Financial Officer under section

			 902 of title 31, United States Code.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="id0F3E66C138BD49BEBC818C1349AE2015"><enum>(e)</enum><header>Availability of

			 records</header><text display-inline="yes-display-inline">Upon request to the

			 Chief Financial Officer, the Office shall make the records of the Office

			 available to the Inspector General of any Federal agency performing recovery

			 activities relating to Hurricane Katrina for the purpose of performing the

			 duties of that Inspector General under the Inspector General Act of 1978 (5

			 U.S.C. App.).</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="idBE248DD5A21B44C8B22AFE874C251EC8" section-type="subsequent-section"><enum>4.</enum><header>Reports of the

			 government accountability office</header><text display-inline="no-display-inline">The Office shall provide quarterly reports

			 to the committees specified in section 3(c)(3)(A) relating to all activities

			 and expenses approved by the Office, including—</text>

			<paragraph commented="no" display-inline="no-display-inline" id="IDfb83705120e84fe28fd317dbf24e2239"><enum>(1)</enum><text display-inline="yes-display-inline">the accuracy of reports submitted by the

			 Chief Financial Officer to Congress;</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID880a2bf0416e463f9eee13b1a8781347"><enum>(2)</enum><text display-inline="yes-display-inline">the extent to which agencies performing

			 activities relating to the recovery from Hurricane Katrina have made use of

			 sole source or cost-plus contracts;</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID920c12e8526345229768014ff17d8ee2"><enum>(3)</enum><text display-inline="yes-display-inline">the appropriate use of Federal funds by

			 State and local government agencies;</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID23b52bea17f14f67ad5bccc5becac06d"><enum>(4)</enum><text display-inline="yes-display-inline">an analysis of whether Federal relief funds

			 have been distributed to individuals and organizations most in need of

			 financial assistance and Federal reconstruction funds have been made available

			 to business entities that are based in Louisiana, Mississippi, Alabama, or

			 Florida or business entities that hire workers who resided in those States on

			 August 24, 2005; and</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE6FC64D44E6D4E288448B67A79727540"><enum>(5)</enum><text display-inline="yes-display-inline">the extent to which waste, fraud, or abuse

			 exist in the use of Federal funds relating to the recovery from Hurricane

			 Katrina.</text>

			</paragraph></section><section commented="no" display-inline="no-display-inline" id="id08712E4C4BD249DF9711D7DE277FCA05" section-type="subsequent-section"><enum>5.</enum><header>Administrative and

			 support services</header>

			<subsection commented="no" display-inline="no-display-inline" id="idD395486BF86944499EFF2F30C5339651"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The President shall

			 provide administrative and support services (including office space) for the

			 Office and the Chief Financial Officer.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="id4A6EA78353754EC3B8755C06C1BBA382"><enum>(b)</enum><header>Personnel</header><text display-inline="yes-display-inline">The President shall provide for personnel

			 for the Office through the detail of Federal employees. Any Federal employee

			 may be detailed to the Office without reimbursement, and such detail shall be

			 without interruption or loss of civil service status or privilege.</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="id53941DAAE5DD4D419D9D1AC66BD9773A" section-type="subsequent-section"><enum>6.</enum><header>Authorization of

			 appropriations</header><text display-inline="no-display-inline">There are

			 authorized to be appropriated such sums as necessary to carry out this

			 Act.</text>

		</section><section commented="no" display-inline="no-display-inline" id="id433E729B8ADE4D6FAFC22A5A21265F90" section-type="subsequent-section"><enum>7.</enum><header>Termination of

			 office</header>

			<subsection commented="no" display-inline="no-display-inline" id="id092C99EFF79D4D1A971AF028531480AF"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Office and

			 position of Chief Financial Officer shall terminate 1 year after the date of

			 enactment of this Act.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="id896B346C6E26466296B00EDAA38C52F2"><enum>(b)</enum><header>Extension</header><text display-inline="yes-display-inline">The President may extend the date of

			 termination under subsection (a) to any date occurring before 2 years after the

			 date of enactment of this Act.</text>
