			<enum>1.</enum>
			<header>Short title; findings</header>
			<subsection id="ID00597F6A1ACA4E6E9649FBC06A818D96">
				<enum>(a)</enum>
				<header>Short title</header>
				<text>This Act may be cited as the <quote><short-title>Stop Counterfeiting in Manufactured Goods Act</short-title></quote>.</text>
			</subsection><subsection id="IDEE17A6B2D5E0460A9B6CE1972F9002E3">
				<enum>(b)</enum>
				<header>Findings</header>
				<text>The Congress finds that—</text>
				<paragraph id="IDCFBF2E5720CA4147BC43B3B463DF151C">
					<enum>(1)</enum>
					<text>the United States economy is losing millions of dollars in tax revenue and tens of thousands of
			 jobs because of the manufacture, distribution, and sale of counterfeit
			 goods;</text>
				</paragraph><paragraph id="ID415B1FCC35D8484EB27B7BE962FEB2F2">
					<enum>(2)</enum>
					<text>the Bureau of Customs and Border Protection estimates that counterfeiting costs the United States
			 $200 billion annually;</text>
				</paragraph><paragraph id="IDDC58E953374F4CCFB75AE6AE7DFEB2A9">
					<enum>(3)</enum>
					<text>counterfeit automobile parts, including brake pads, cost the auto industry alone billions of
			 dollars in lost sales each year;</text>
				</paragraph><paragraph id="IDB44711A84AB94B5CB8F1BD7905AF75C3">
					<enum>(4)</enum>
					<text>counterfeit products have invaded numerous industries, including those producing auto parts,
			 electrical appliances, medicines, tools, toys, office equipment, clothing,
			 and many other products;</text>
				</paragraph><paragraph id="IDCC7485473712426A86C7D64A2D45D16B">
					<enum>(5)</enum>
					<text>ties have been established between counterfeiting and terrorist organizations that use the sale of
			 counterfeit goods to raise and launder money;</text>
				</paragraph><paragraph id="ID8B57D903ADC74BBDA09C7ACB1B61C26E">
					<enum>(6)</enum>
					<text>ongoing counterfeiting of manufactured goods poses a widespread threat to public health and safety;
			 and</text>
				</paragraph><paragraph id="IDFF60CED6C4C9408DAA3C1D17F7CD0A5C">
					<enum>(7)</enum>
					<text>strong domestic criminal remedies against counterfeiting will permit the United States to seek
			 stronger anticounterfeiting provisions in bilateral and international
			 agreements with trading partners.</text>
				</paragraph></subsection></section><section id="ID85D91A818C5A4AF9A7BB1EC3D4DE8160">
			<enum>2.</enum>
			<header>Trafficking in counterfeit marks</header>
			<text display-inline="no-display-inline">Section 2320 of title 18, United States Code, is amended as follows:</text>
			<paragraph id="IDB21C707BFB5A414589CFBEB22CF9FF78">
				<enum>(1)</enum>
				<text>Subsection (a) is amended by inserting after <quote>such goods or services</quote> the following: <quote>, or intentionally traffics or attempts to traffic in labels, patches, stickers, wrappers, badges,
			 emblems, medallions, charms, boxes, containers, cans, cases, hangtags,
			 documentation, or packaging of any type or nature, knowing that a
			 counterfeit mark has been applied thereto, the use of which is likely to
			 cause confusion, to cause mistake, or to deceive,</quote>.</text>
			</paragraph><paragraph id="IDC9BABF5F171D4DC2BA17482546BC8AD3">
				<enum>(2)</enum>
				<text>Subsection (b) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="ID678197EE399A49CBB45595ABAB554BC4" style="OLC">
					<subsection id="ID7751714B9DFA40ECAFE3D23C5CFE0F29">
						<enum>(b)</enum>
						<paragraph commented="no" display-inline="yes-display-inline" id="ID66DC8DB403AF4E7691A5BF6215270B3E"><enum>(1)</enum>
							<text>The following property shall be subject to forfeiture to the United States and no property right
			 shall exist in such property:</text>
							<subparagraph id="IDD31555B5CA864D64A248A36ED3EE656A" indent="up1">
								<enum>(A)</enum>
								<text>Any article bearing or consisting of a counterfeit mark used in committing a violation of
			 subsection (a).</text>
							</subparagraph><subparagraph id="IDCA13A1CAD0724240BAB7C6FE4D9E2BDA" indent="up1">
								<enum>(B)</enum>
								<text>Any property used, in any manner or part, to commit or to facilitate the commission of a violation
			 of subsection (a).</text>
							</subparagraph></paragraph><paragraph id="ID3D092B54A4354589A41C5292E2F2B9E6" indent="up1">
							<enum>(2)</enum>
							<text>The provisions of chapter 46 of this title relating to civil forfeitures, <added-phrase reported-display-style="italic">including section 983 of this title,</added-phrase> shall extend to any seizure or civil forfeiture under this section. At the conclusion of the
			 forfeiture proceedings, the court, unless otherwise requested by an agency
			 of the United States, shall order that any forfeited article bearing or
			 consisting of a counterfeit mark be destroyed or otherwise disposed of
			 according to law.</text>
						</paragraph><paragraph id="IDAB831F4988DB451C8135528EC25EB346" indent="up1">
							<enum>(3)</enum>
							<subparagraph commented="no" display-inline="yes-display-inline" id="IDC3C351537E574445B76C145773E45DBE"><enum>(A)</enum>
								<text>The court, in imposing sentence on a person convicted of an offense under this section, shall
			 order, in addition to any other sentence imposed, that the person forfeit
			 to the United States—</text>
								<clause id="ID5471D1033C414059BBF9E2BAA80A8745" indent="up1">
									<enum>(i)</enum>
									<text>any property constituting or derived from any proceeds the person obtained, directly or indirectly,
			 as the result of the offense;</text>
								</clause><clause id="ID81E0EB67FDDF405C9305D3C825023B58" indent="up1">
									<enum>(ii)</enum>
									<text>any of the person's property used, or intended to be used, in any manner or part, to commit,
			 facilitate, aid, or abet the commission of the offense; and</text>
								</clause><clause id="ID000F1C05B66148B8A1ADE835B8A560D3" indent="up1">
									<enum>(iii)</enum>
									<text>any article that bears or consists of a counterfeit mark used in committing the offense.</text>
								</clause></subparagraph><subparagraph id="ID4A833A17018E43E3BACA0A7E5D495FC8" indent="up1">
								<enum>(B)</enum>
								<text>The forfeiture of property under subparagraph (A), including any seizure and disposition of the
			 property and any related judicial or administrative proceeding, shall be
			 governed by the procedures set forth in section 413 of the <act-name parsable-cite="CDAPCA70">Comprehensive Drug Abuse Prevention and Control Act of 1970</act-name> (21 U.S.C. 853), other than subsection (d) of that section. Notwithstanding section 413(h) of that
			 Act, at the conclusion of the forfeiture proceedings, the court shall
			 order that any forfeited article or component of an article bearing or
			 consisting of a counterfeit mark be destroyed.</text>
							</subparagraph></paragraph><paragraph id="ID00517E7649D643DF8C144EE20E6E0EB7" indent="up1">
							<enum>(4)</enum>
							<text>When a person is convicted of an offense under this section, the court, pursuant to sections 3556,
			 3663A, and 3664, shall order the person to pay restitution to the owner of
			 the mark and any other victim of the offense as an offense against
			 property referred to in section 3663A(c)(1)(A)(ii).</text>
						</paragraph><paragraph id="IDF078B3292E1144C3803408405E164212" indent="up1">
							<enum>(5)</enum>
							<text>The term <term>victim</term>, as used in paragraph (4), has the meaning given that term in section 3663A(a)(2).</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph><paragraph id="ID5F1DB1157D1D49B6AEDB46528E484540">
				<enum>(3)</enum>
				<text>Subsection (e)(1) is amended—</text>
				<subparagraph id="IDB3F7FD19D7414E639643DA22C808AEF4">
					<enum>(A)</enum>
					<text>by striking subparagraph (A) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="IDB54B2B7DD5F140CA957F681E17EB4671" style="OLC">
						<subparagraph id="ID57A89DA5A0094E98AD78B0AB206938A1">
							<enum>(A)</enum>
							<text>a spurious mark—</text>
							<clause id="IDC49BB28174A143999E875FFC64169782">
								<enum>(i)</enum>
								<text>that is used in connection with trafficking in any goods, services, labels, patches, stickers,
			 wrappers, badges, emblems, medallions, charms, boxes, containers, cans,
			 cases, hangtags, documentation, or packaging of any type or nature;</text>
							</clause><clause id="IDDFF9CC9DCAA94FB0A41837E29A12777F">
								<enum>(ii)</enum>
								<text>that is identical with, or substantially indistinguishable from, a mark registered on the principal
			 register in the United States Patent and Trademark Office and in use,
			 whether or not the defendant knew such mark was so registered;</text>
							</clause><clause id="ID1E61C03DAECE4444B1B1CC7078F24708">
								<enum>(iii)</enum>
								<text>that is applied to or used in connection with the goods or services for which the mark is
			 registered with the United States Patent and Trademark Office, or is
			 applied to or consists of a label, patch, sticker, wrapper, badge, emblem,
			 medallion, charm, box, container, can, case, hangtag, documentation, or
			 packaging of any type or nature that is designed, marketed, or otherwise
			 intended to be used on or in connection with the goods or services for
			 which the mark is registered in the United States Patent and Trademark
			 Office; and</text>
							</clause><clause id="IDE8E903B6444740C1AAA70378F75F2240">
								<enum>(iv)</enum>
								<text>the use of which is likely to cause confusion, to cause mistake, or to deceive; or</text>
							</clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block>
				</subparagraph><subparagraph id="ID1072D1F7D3BF4DAFA8249716D2B57732">
					<enum>(B)</enum>
					<text>by amending the matter following subparagraph (B) to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="idEFC8C05B6360439394407C3EBC210691" style="OLC">
						<quoted-block-continuation-text quoted-block-continuation-text-level="paragraph">but such term does not include any mark or designation used in connection with goods or services,
			 or a mark or designation applied to labels, patches, stickers, wrappers,
			 badges, emblems, medallions, charms, boxes, containers, cans, cases,
			 hangtags, documentation, or packaging of any type or nature used in
			 connection with such goods or services, of which the manufacturer or
			 producer was, at the time of the manufacture or production in question,
			 authorized to use the mark or designation for the type of goods or
			 services so manufactured or produced, by the holder of the right to use
			 such mark or designation.</quoted-block-continuation-text><after-quoted-block>.</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="ID17FA6A58A57B47129A5C993295C163CA">
				<enum>(4)</enum>
				<text>Section 2320 is further amended—</text>
				<subparagraph id="ID7053B02FB6EA4E34B474E026DBF2CCC4">
					<enum>(A)</enum>
					<text>by redesignating subsection (f) as subsection (g); and</text>
				</subparagraph><subparagraph id="IDAFABCDEE23014BEA874F56D57B2AC5C0">
					<enum>(B)</enum>
					<text>by inserting after subsection (e) the following:</text>
					<quoted-block display-inline="no-display-inline" id="IDD0F30FDB774E44109828C9D5C7B9D06D" style="OLC">
						<subsection id="ID1C013EA456DF4C93A99BA7D7E77FC421">
							<enum>(f)</enum>
							<text>Nothing in this section shall entitle the United States to bring a criminal cause of action under
			 this section for the repackaging of genuine goods or services not intended
			 to deceive or confuse.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subparagraph></paragraph></section><section id="ID4B77DDC68ACC420AB94A7D01873F31F4">
			<enum>3.</enum>
			<header>Sentencing guidelines</header>
			<subsection id="ID055653BB2EB947F7B96EA808042EE082">
				<enum>(a)</enum>
				<header>Review and amendment</header>
				<text>Not later than 180 days after the date of enactment of this Act, the United States Sentencing
			 Commission, pursuant to its authority under section 994 of title 28,
			 United States Code, and in accordance with this section, shall review and,
			 if appropriate, amend the Federal sentencing guidelines and policy
			 statements applicable to persons convicted of any offense under section
			 2318 or 2320 of title 18, United States Code.</text>
			</subsection><subsection id="IDA927C0BB5CCC42AD9383EE87DEA1E3AC">
				<enum>(b)</enum>
				<header>Authorization</header>
				<text>The United States Sentencing Commission may amend the Federal sentencing guidelines in accordance
			 with the procedures set forth in section 21(a) of the Sentencing Act of
			 1987 (28 U.S.C. 994 note) as though the authority under that section had
			 not expired.</text>
			</subsection><subsection id="ID162175B01AD6453BA9FEB6B00CEC1C4A">
				<enum>(c)</enum>
				<header>Responsibilities of united states sentencing commission</header>
				<text>In carrying out this section, the United States Sentencing Commission shall determine whether the
			 definition of <quote>infringement amount</quote> set forth in application note 2 of section 2B5.3 of the Federal sentencing guidelines is adequate
			 to address situations in which the defendant has been convicted of one of
			 the offenses listed in subsection (a) and the item in which the defendant
			 trafficked was not an infringing item but rather was intended to
			 facilitate infringement, such as an anti-circumvention device, or the item
			 in which the defendant trafficked was infringing and also was intended to
			 facilitate infringement in another good or service, such as a counterfeit
			 label, documentation, or packaging, taking into account cases such as U.S.
			 v. Sung, 87 F.3d 194 (7th Cir. 1996).</text>
			</subsection></section></legis-body>
