			<header>Artists’ rights and theft prevention</header>

				<enum>101.</enum>

				<header>Short title</header>

				<text display-inline="no-display-inline">This title may be cited as the

			 <quote><short-title>Artists’ Rights and Theft Prevention

			 Act of 2005</short-title></quote> or the <quote><short-title>ART Act</short-title></quote>.</text>

				<enum>102.</enum>

				<header>Criminal penalties for unauthorized recording of Motion

			 pictures in a Motion picture exhibition facility</header>

				<subsection id="IDF2FC42A5E7364FA5BE80648F05EFBAF3">

					<enum>(a)</enum>

					<header>In general</header>

					<text>Chapter 113 of title 18, United States Code, is amended by adding

			 after section 2319A the following new section:</text>

							<enum>2319B.</enum>

							<header>Unauthorized recording of Motion pictures in a Motion picture

				exhibition facility</header>

							<subsection id="ID9033B03F7B0146CF9C5F5F29E5248F31">

								<enum>(a)</enum>

								<header>Offense</header>

								<text>Any person who, without the authorization of the copyright

				owner, knowingly uses or attempts to use an audiovisual recording device to

				transmit or make a copy of a motion picture or other audiovisual work protected

				under title 17, or any part thereof, from a performance of such work in a

				motion picture exhibition facility, shall—</text>

								<paragraph id="ID11EC18BEA92A4257892762B00FF90E8F">

									<enum>(1)</enum>

									<text>be imprisoned for not more than 3 years, fined under this

				title, or both; or</text>

								</paragraph><paragraph id="IDF121BAF0302D4132B70D53542E3D6A6A">

									<enum>(2)</enum>

									<text>if the offense is a second or subsequent offense, be imprisoned

				for no more than 6 years, fined under this title, or both.</text>

								</paragraph><continuation-text continuation-text-level="subsection">The

				possession by a person of an audiovisual recording device in a motion picture

				exhibition facility may be considered as evidence in any proceeding to

				determine whether that person committed an offense under this subsection, but

				shall not, by itself, be sufficient to support a conviction of that person for

				such offense.</continuation-text></subsection><subsection id="IDBBE568FA76624BB08EB57F4B8FF72A75">

								<enum>(b)</enum>

								<header>Forfeiture and destruction</header>

								<text>When a person is convicted of a violation of subsection (a),

				the court in its judgment of conviction shall, in addition to any penalty

				provided, order the forfeiture and destruction or other disposition of all

				unauthorized copies of motion pictures or other audiovisual works protected

				under title 17, or parts thereof, and any audiovisual recording devices or

				other equipment used in connection with the offense.</text>

							</subsection><subsection id="IDFD0A0D48507E41F29CC56D6D214CB918">

								<enum>(c)</enum>

								<header>Authorized activities</header>

								<text>This section does not prevent any lawfully authorized

				investigative, protective, or intelligence activity by an officer, agent, or

				employee of the United States, a State, or a political subdivision of a State,

				or by a person acting under a contract with the United States, a State, or a

				political subdivision of a State.</text>

							</subsection><subsection id="IDDFBF41DF3AD54021B7DC057DFAD8B9E1">

								<enum>(d)</enum>

								<header>Immunity for theaters</header>

								<text>With reasonable cause, the owner or lessee of a motion picture

				exhibition facility where a motion picture or other audiovisual work is being

				exhibited, the authorized agent or employee of such owner or lessee, the

				licensor of the motion picture or other audiovisual work being exhibited, or

				the agent or employee of such licensor—</text>

								<paragraph id="ID3AE3EE472C2E4B17835D967696BB7BF6">

									<enum>(1)</enum>

									<text>may detain, in a reasonable manner and for a reasonable time,

				any person suspected of a violation of this section with respect to that motion

				picture or audiovisual work for the purpose of questioning or summoning a law

				enforcement officer; and</text>

								</paragraph><paragraph id="IDB05D6B8E7DAB418AB8F0925AB4BE2D2D">

									<enum>(2)</enum>

									<text>shall not be held liable in any civil or criminal action

				arising out of a detention under paragraph (1).</text>

								</paragraph></subsection><subsection id="ID0D277C0BD07743CA9AB0D89A50B68624">

								<enum>(e)</enum>

								<header>Victim impact statement</header>

								<paragraph id="ID5F5A4D3D106B44E59E0216A510028804">

									<enum>(1)</enum>

									<header>In general</header>

									<text>During the preparation of the presentence report under rule

				32(c) of the Federal Rules of Criminal Procedure, victims of an offense under

				this section shall be permitted to submit to the probation officer a victim

				impact statement that identifies the victim of the offense and the extent and

				scope of the injury and loss suffered by the victim, including the estimated

				economic impact of the offense on that victim.</text>

								</paragraph><paragraph id="ID4D572C03B4E1427882BF6E17C0B44AF3">

									<enum>(2)</enum>

									<header>Contents</header>

									<text>A victim impact statement submitted under this subsection shall

				include—</text>

									<subparagraph id="ID0E1796DA7F784863815BDF26BFD07306">

										<enum>(A)</enum>

										<text>producers and sellers of legitimate works affected by conduct

				involved in the offense;</text>

									</subparagraph><subparagraph id="IDA4AB1E699CCF4D2AA42C2A6D96B6F53B">

										<enum>(B)</enum>

										<text>holders of intellectual property rights in the works described

				in subparagraph (A); and</text>

									</subparagraph><subparagraph id="ID59AC22E07C4A4C9AA70DB6A602401FFC">

										<enum>(C)</enum>

										<text>the legal representatives of such producers, sellers, and

				holders.</text>

									</subparagraph></paragraph></subsection><subsection id="IDF44405656F2F40269ECE6DC929D6254B">

								<enum>(f)</enum>

								<header>State law not preempted</header>

								<text>Nothing in this section may be construed to annul or limit any

				rights or remedies under the laws of any State.</text>

							</subsection><subsection id="ID7CD3A8F9824744AB9D43919675BBE91D">

								<enum>(g)</enum>

								<header>Definitions</header>

								<text>In this section, the following definitions shall apply:</text>

								<paragraph id="IDF470C1E3F1AB406DAC6090EC745B58CE">

									<enum>(1)</enum>

									<header>Title <enum-in-header>17</enum-in-header>

				definitions</header>

									<text>The terms <term>audiovisual work</term>, <term>copy</term>,

				<term>copyright owner</term>, <term>motion picture</term>, <term>motion picture

				exhibition facility</term>, and <term>transmit</term> have, respectively, the

				meanings given those terms in section 101 of title 17.</text>

								</paragraph><paragraph id="ID4EA4EF844DC44E31A394CD33C1548436">

									<enum>(2)</enum>

									<header>Audiovisual recording device</header>

									<text>The term <term>audiovisual recording device</term> means a

				digital or analog photographic or video camera, or any other technology or

				device capable of enabling the recording or transmission of a copyrighted

				motion picture or other audiovisual work, or any part thereof, regardless of

				whether audiovisual recording is the sole or primary purpose of the

				device.</text>

								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

				</subsection><subsection id="ID4AD64D7F275D473CBA58A8CCD13136CD">

					<enum>(b)</enum>

					<header>Clerical amendment</header>

					<text>The table of sections at the beginning of chapter 113 of title

			 18, United States Code, is amended by inserting after the item relating to

			 section 2319A the following:</text>

					<header>Definition</header>

					<text>Section 101 of title 17, United States Code, is amended by

			 inserting after the definition of “Motion pictures” the following: “The term

			 “motion picture exhibition facility” means a movie theater, screening room, or

			 other venue that is being used primarily for the exhibition of a copyrighted

			 motion picture, if such exhibition is open to the public or is made to an

			 assembled group of viewers outside of a normal circle of a family and its

			 social acquaintances.”.</text>

				<enum>103.</enum>

				<header>Criminal infringement of a work being prepared for commercial

			 distribution</header>

				<subsection id="ID184326B68A8442BCBFF402A93CE5AC1A">

					<enum>(a)</enum>

					<header>Prohibited acts</header>

					<text>Section 506(a) of title 17, United States Code, is amended to

			 read as follows:</text>

							<enum>(a)</enum>

							<header>Criminal infringement</header>

							<paragraph id="IDAE95D9909111479D8FCF86815E47CDE3">

								<enum>(1)</enum>

								<header>In general</header>

								<text>Any person who willfully infringes a copyright shall be

				punished as provided under section 2319 of title 18, if the infringement was

				committed—</text>

								<subparagraph id="IDA60E93C68D5B4AB7817B9BD338B727F4">

									<enum>(A)</enum>

									<text>for purposes of commercial advantage or private financial

				gain;</text>

								</subparagraph><subparagraph id="ID4D373C1466DD4B85A56EBB2AC2E2F9BD">

									<enum>(B)</enum>

									<text>by the reproduction or distribution, including by electronic

				means, during any 180–day period, of 1 or more copies or phonorecords of 1 or

				more copyrighted works, which have a total retail value of more than $1,000;

				or</text>

								</subparagraph><subparagraph id="ID1CC0EBD5770045988464D494E335D232">

									<enum>(C)</enum>

									<text>by the distribution of a work being prepared for commercial

				distribution, by making it available on a computer network accessible to

				members of the public, if such person knew or should have known that the work

				was intended for commercial distribution.</text>

								</subparagraph></paragraph><paragraph id="ID77E1399B1603434B817637306B239EC3">

								<enum>(2)</enum>

								<header>Evidence</header>

								<text>For purposes of this subsection, evidence of reproduction or

				distribution of a copyrighted work, by itself, shall not be sufficient to

				establish willful infringement of a copyright.</text>

							</paragraph><paragraph id="IDDB3DBA661109432AB414BE3AEEDF2328">

								<enum>(3)</enum>

								<header>Definition</header>

								<text>In this subsection, the term <term>work being prepared for

				commercial distribution</term> means—</text>

								<subparagraph id="ID11BA6234012E47C3BFF33FE542B5E6F0">

									<enum>(A)</enum>

									<text>a computer program, a musical work, a motion picture or other

				audiovisual work, or a sound recording, if, at the time of unauthorized

				distribution—</text>

									<clause id="ID139BF9C8C7FE418C88D0311F778F28C3">

										<enum>(i)</enum>

										<text>the copyright owner has a reasonable expectation of commercial

				distribution; and</text>

									</clause><clause id="IDA079FDE7CA7F42879BBA0D977D546E9E">

										<enum>(ii)</enum>

										<text>the copies or phonorecords of the work have not been

				commercially distributed; or</text>

									</clause></subparagraph><subparagraph id="ID30AC0B1F4CC94E929D8263FAF3200B52">

									<enum>(B)</enum>

									<text>a motion picture, if, at the time of unauthorized distribution,

				the motion picture—</text>

									<clause id="IDB252CCE62A154D48B297BD1963E98B3A">

										<enum>(i)</enum>

										<text>has been made available for viewing in a motion picture

				exhibition facility; and</text>

									</clause><clause id="IDE5EBA50C5F93432A94C4F21CF4B7CC1D">

										<enum>(ii)</enum>

										<text>has not been made available in copies for sale to the general

				public in the United States in a format intended to permit viewing outside a

				motion picture exhibition facility.</text>

									</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

				</subsection><subsection id="ID3FC1B73C9A06442CBBCADA6C127309C2">

					<enum>(b)</enum>

					<header>Criminal penalties</header>

					<text>Section 2319 of title 18, United States Code, is amended—</text>

					<paragraph id="ID3E693F19E8B741DA832E9C38E7B05E86">

						<enum>(1)</enum>

						<text>in subsection (a)—</text>

				title, or both, if the offense was committed for purposes of commercial

				advantage or private financial gain;</text>

									<enum>(3)</enum>

									<text>shall be imprisoned not more than 6 years, fined under this

				title, or both, if the offense is a second or subsequent offense; and</text>

								</paragraph><paragraph id="IDCC4CAE419A8F41C5B6A2FF0D88B720EF">

									<enum>(4)</enum>

									<text>shall be imprisoned not more than 10 years, fined under this

				title, or both, if the offense is a second or subsequent offense under

				paragraph (2).</text>

								</paragraph></subsection><after-quoted-block>;

				<enum>104.</enum>

				<header>Civil remedies for infringement of a work being prepared for

			 commercial distribution</header>

				<subsection id="IDAD24E677DEB04109B1B3618DB158D465">

					<enum>(a)</enum>

					<header>Preregistration</header>

					<text>Section 408 of title 17, United States Code, is amended by adding

			 at the end the following:</text>

						<subsection id="ID7F63FEB7F6174F9AA310EBCEAA939A98">

							<enum>(f)</enum>

							<header>Preregistration of works being prepared for commercial

				distribution</header>

							<paragraph id="ID6BB7E59CBAAF4F8A9BCF001442F9C981">

								<enum>(1)</enum>

								<header>Rulemaking</header>

								<text>Not later than 180 days after the date of enactment of this

				subsection, the Register of Copyrights shall issue regulations to establish

				procedures for preregistration of a work that is being prepared for commercial

				distribution and has not been published.</text>

							</paragraph><paragraph id="ID5D1292282E484C0D83513825F04C0260">

								<enum>(2)</enum>

								<header>Class of works</header>

								<text>The regulations established under paragraph (1) shall permit

				preregistration for any work that is in a class of works that the Register

				determines has had a history of infringement prior to authorized commercial

				distribution.</text>

							</paragraph><paragraph id="ID24666A7372BF4CEABAB141EBDA5801A2">

								<enum>(3)</enum>

								<header>Application for registration</header>

								<text>Not later than 3 months after the first publication of a work

				preregistered under this subsection, the applicant shall submit to the

				Copyright Office—</text>

								<subparagraph id="ID041D2AFD291847769BABC43542F5B0CA">

									<enum>(A)</enum>

									<text>an application for registration of the work;</text>

								</subparagraph><subparagraph id="ID955DB0442A2446AFBFDA5074315C8615">

									<enum>(B)</enum>

									<text>a deposit; and</text>

								</subparagraph><subparagraph id="IDC163923103884A16A90201E327FCF8D5">

									<enum>(C)</enum>

									<text>the applicable fee.</text>

								</subparagraph></paragraph><paragraph id="IDCDF6BA2EAFAC47F4B13636F0A1311F30">

								<enum>(4)</enum>

								<header>Effect of untimely application</header>

								<text>An action under this chapter for infringement of a work

				preregistered under this subsection, in a case in which the infringement

				commenced no later than 2 months after the first publication of the work, shall

				be dismissed if the items described in paragraph (3) are not submitted to the

				Copyright Office in proper form within the earlier of—</text>

								<subparagraph id="ID30B7DD2D9351432BBB9B154B96E6DD15">

									<enum>(A)</enum>

									<text>3 months after the first publication of the work; or</text>

								</subparagraph><subparagraph id="ID1AA921DBB21E40A7AC1A739F7E1079F7">

									<enum>(B)</enum>

									<text>1 month after the copyright owner has learned of the

				infringement.</text>

								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

				</subsection><subsection id="ID412F5C1A3BB04434BCEF0B8304381A42">

					<enum>(b)</enum>

					<header>Infringement actions</header>

					<text>Section 411(a) of title 17, United States Code, is amended by

			 inserting <quote>preregistration or</quote> after <quote>shall be instituted

			 until</quote>.</text>

				</subsection><subsection id="ID32DE8B23D19346EF82CD6D911C058614">

					<enum>(c)</enum>

					<header>Exclusion</header>

					<text>Section 412 of title 17, United States Code, is amended by

			 inserting after <quote>section 106A(a)</quote> the following: <quote>, an

			 action for infringement of the copyright of a work that has been preregistered

			 under section 408(f) before the commencement of the infringement and that has

			 an effective date of registration not later than the earlier of 3 months after

			 the first publication of the work or 1 month after the copyright owner has

			 learned of the infringement,</quote>.</text>

				</subsection></section><section id="ID42BBD3DB41624EF294E011FB9EEBF79D">

				<enum>105.</enum>

				<header>Federal sentencing guidelines</header>

				<subsection id="ID5245EF68B50342BFBBAF294EEEB468FA">

					<enum>(a)</enum>

					<header>Review and amendment</header>

					<text>Not later than 180 days after the date of enactment of this Act,

			 the United States Sentencing Commission, pursuant to its authority under

			 section 994 of title 28, United States Code, and in accordance with this

			 section, shall review and, if appropriate, amend the Federal sentencing

			 guidelines and policy statements applicable to persons convicted of

			 intellectual property rights crimes, including any offense under—</text>

					<paragraph id="ID8FAB853FAB4342189DCE2D0614435D0A">

						<enum>(1)</enum>

						<text>section 506, 1201, or 1202 of title 17, United States Code;

			 or</text>

					</paragraph><paragraph id="IDC8F4AA90484E4A6DA51C70EE29A9B125">

						<enum>(2)</enum>

						<text>section 2318, 2319, 2319A, 2319B, or 2320 of title 18, United

			 States Code.</text>

					</paragraph></subsection><subsection id="IDD5528421B87741D2B66996B364EE5494">

					<enum>(b)</enum>

					<header>Authorization</header>

					<text>The United States Sentencing Commission may amend the Federal

			 sentencing guidelines in accordance with the procedures set forth in section

			 21(a) of the Sentencing Act of 1987 (<external-xref legal-doc="usc" parsable-cite="usc/28/994 note">28 U.S.C. 994 note</external-xref>) as though

			 the authority under that section had not expired.</text>

				</subsection><subsection id="IDD5417BBCA5B943F8A36A867AC8C19CC3">

					<enum>(c)</enum>

					<header>Responsibilities of United States Sentencing

			 Commission</header>

					<text>In carrying out this section, the United States Sentencing

			 Commission shall—</text>

					<paragraph id="ID29485B6475CC4866810D8548FF80CC97">

						<enum>(1)</enum>

						<text>take all appropriate measures to ensure that the Federal

			 sentencing guidelines and policy statements described in subsection (a) are

			 sufficiently stringent to deter, and adequately reflect the nature of,

			 intellectual property rights crimes;</text>

					</paragraph><paragraph id="ID2A1045DC5F03404BB3EABB9B6C687551">

			 in the media format used by the infringing party or in any other media

						<text>determine whether the scope of <quote>uploading</quote> set forth

			 in application note 3 of section 2B5.3 of the Federal sentencing guidelines is

			 adequate to address the loss attributable to people who, without authorization,

			 broadly distribute copyrighted works over the Internet; and</text>

								<enum></enum><text>Nothing in paragraph (11) shall be construed to imply further

				rights under section 106 of this title, or to have any effect on defenses or

				limitations on rights granted under any other section of this title or under

				any other paragraph of this section.</text>

					<enum>(b)</enum>

					<header>Exemption from trademark infringement</header>

					<text>Section 32 of the Trademark Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/15/1114">15 U.S.C. 1114</external-xref>) is amended by

			 adding at the end the following:</text>

							<enum>(3)</enum>

							<subparagraph commented="no" display-inline="yes-display-inline" id="IDA7F745D5EF9349BE8996B3ED6A09DA45"><enum>(A)</enum>

								<text>Any person who engages in the conduct described in paragraph

				(11) of section 110 of title 17, United States Code, and who complies with the

				requirements set forth in that paragraph is not liable on account of such

				conduct for a violation of any right under this Act. This subparagraph does not

				preclude liability, nor shall it be construed to restrict the defenses or

				limitations on rights granted under this Act, of a person for conduct not

				described in paragraph (11) of section 110 of title 17, United States Code,

				even if that person also engages in conduct described in paragraph (11) of

				section 110 of such title.</text>

							</subparagraph><subparagraph id="ID7D6E639F4A3148B49B17E0D96BB3BEED" indent="up1">

								<enum>(B)</enum>

								<text>A manufacturer, licensee, or licensor of technology that

				enables the making of limited portions of audio or video content of a motion

				picture imperceptible as described in subparagraph (A) is not liable on account

				of such manufacture or license for a violation of any right under this Act, if

				such manufacturer, licensee, or licensor ensures that the technology provides a

				clear and conspicuous notice at the beginning of each performance that the

				performance of the motion picture is altered from the performance intended by

				the director or copyright holder of the motion picture. The limitations on

				liability in subparagraph (A) and this subparagraph shall not apply to a

				manufacturer, licensee, or licensor of technology that fails to comply with

				this paragraph.</text>

							</subparagraph><subparagraph id="ID1B6637A461FD45589A15D66420DEF5B8" indent="up1">

								<enum>(C)</enum>

								<text>The requirement under subparagraph (B) to provide notice shall

				apply only with respect to technology manufactured after the end of the 180-day

				period beginning on the date of the enactment of the Family Movie Act of

				2005.</text>

							</subparagraph><subparagraph id="IDB5630D6BD4E04A0094B7DEA3B61C32F4" indent="up1">

								<enum>(D)</enum>

								<text>Any failure by a manufacturer, licensee, or licensor of

				technology to qualify for the exemption under subparagraphs (A) and (B) shall

				not be construed to create an inference that any such party that engages in

				conduct described in paragraph (11) of section 110 of title 17, United States

				Code, is liable for trademark infringement by reason of such conduct.</text>

							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

					<enum>(c)</enum>

					<header>Definition</header>

					<text>In this section, the term <term>Trademark Act of 1946</term>

			 means the Act entitled <quote>An Act to provide for the registration and

			 protection of trademarks used in commerce, to carry out the provisions of

										<text>wherever possible, undertake expanded initiatives to ensure the

				Congress, and other appropriate nonprofit archival and preservation

				organizations.</text>
