		<official-title display="yes">To amend title 11, United States Code, to

		  provide relief to victims of Hurricane Katrina and other natural

		  disasters.</official-title>

		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Hurricane Katrina Bankruptcy Relief

			 and Community Protection Act of 2005</short-title></quote>.</text>

		</section><section commented="no" display-inline="no-display-inline" id="ID076782CF11FD4C1B86344594EFE6AA3C" section-type="subsequent-section"><enum>2.</enum><header>Bankruptcy Relief for

			 Victims of Hurricane Katrina</header>

			<subsection commented="no" display-inline="no-display-inline" id="IDA2BD3292D95F4904BA436CB083D0F077"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Notwithstanding any

			 other provision of law, the provisions of title 11, United States Code, as in

			 effect on August 29, 2005, shall apply to any case described in subsection

			 (b).</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID5B4B537616594FAFB1C032A80557C354"><enum>(b)</enum><header>Eligibility</header><text display-inline="yes-display-inline">A case described in this subsection is a

			 case commenced during the 12-month period beginning on the effective date of

			 the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005, under

			 title 11, United States Code (other than under chapter 12 of that title 11), by

			 or on behalf of a debtor—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="id1E7BDB23A06641F7BB36C677615091EE"><enum>(1)</enum><text display-inline="yes-display-inline">who resides, or who resided on August 29,

			 2005, in any area that is subject to a declaration by the President of a major

			 disaster, as defined under section 102 of the Robert T. Stafford Disaster

			 Relief and Emergency Assistance Act (42 U.S.C. 5122) in connection with

			 Hurricane Katrina; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6799918639864366891E5FB383E7FCFE"><enum>(2)</enum><text display-inline="yes-display-inline">whose financial condition is materially

			 adversely affected by the major disaster.</text>

				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H92863F603B724B7FB6E0615973E8E3CE" section-type="subsequent-section"><enum>3.</enum><header>Definitions; who may

			 be a debtor</header>

			<subsection commented="no" display-inline="no-display-inline" id="HE55624758578404A812559F8FD3FBAC0"><enum>(a)</enum><header>Current monthly

			 income</header><text display-inline="yes-display-inline">Section 101(10A)(B) of

			 title 11, United States Code, is amended—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="H2ECFC66707C44567ACE5345503485FB3"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>and payments</quote> and

			 inserting <quote>payments</quote>; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H30A68FCE5021496C9373A8B1ACA1FDCB"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting before the period at the end

			 <quote>, and payments to victims of a natural disaster, on account of their

			 status as victims of a natural disaster</quote>.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HCF088251CAD04E92BC5DEA8B8EFD365"><enum>(b)</enum><header>Natural disaster;

			 natural disaster zone</header><text display-inline="yes-display-inline">Section

			 101 of title 11, United States Code, is amended—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="H161FBFD577B048D4BBDC4DE6B290C475"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (40A) and (40B)

			 as paragraphs (40C) and (40D), respectively; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA6EBC6FF35CB48639B62F3CD24CA0923"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after paragraph (40) the

			 following:</text>

					<quoted-block display-inline="no-display-inline" id="H84FE043A331E410CAA7CBB4121A12066" style="traditional">

						<paragraph commented="no" display-inline="no-display-inline" id="HE6103EC36D97423AADFD2E9C008482C9"><enum>(40A)</enum><text display-inline="yes-display-inline">The term <quote>natural disaster</quote>

				means—</text>

							<subparagraph commented="no" display-inline="no-display-inline" id="H0D8A661C50C3410D87055BE100E30097"><enum>(A)</enum><text display-inline="yes-display-inline">a major disaster, as defined in section 102

				of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (42

				U.S.C. 5122); or</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB80FD4BF7A1F49C5A69210247CCC84A4"><enum>(B)</enum><text display-inline="yes-display-inline">a situation similar to such a major

				disaster (as so defined), with respect to which a determination is made in

				accordance with State law that such situation exists.</text>

							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD2E0E5AE983F477EBECE599AFC2B2BB"><enum>(40B)</enum><text display-inline="yes-display-inline">The term <quote>natural disaster

				zone</quote> means the geographical area included in the determination of a

				natural

				disaster.</text>

						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HF0803829B9EE40838FDF385C7906F5BB"><enum>(c)</enum><header>Victim of

			 natural disaster</header><text display-inline="yes-display-inline">Section 101

			 of title 11, United States Code, is amended by adding at the end the

			 following:</text>

				<quoted-block display-inline="no-display-inline" id="H5712E9106256416FB2AEEBC567BD13F0" style="OLC">

					<paragraph commented="no" display-inline="no-display-inline" id="H7639DE9F8A814BEABFB41F2DB2CE7E8E"><enum>(56)</enum><text display-inline="yes-display-inline">The term <quote>victim of a natural

				disaster</quote> means a person—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="H5F6DBE17175847AEBC94DBAFC1B49868"><enum>(A)</enum><text display-inline="yes-display-inline">whose financial condition is materially

				adversely affected by a natural disaster; and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5A6904A7AA0240388DFA2795AF68B27C"><enum>(B)</enum><text display-inline="yes-display-inline">whose domicile, residence, or principal

				place of business in the United States, or whose principal assets in the United

				States, were located in a natural disaster zone immediately preceding the event

				that caused the natural

				disaster.</text>

						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="H402B984F8176476EBB00ED6B6BDB5F00"><enum>(d)</enum><header>Who may be a

			 debtor</header><text display-inline="yes-display-inline">Section 109(h)(4) of

			 title 11, United States Code, is amended by inserting <quote>natural

			 disaster,</quote> after <quote>disability,</quote>.</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="id182B4E57FFA242F2AFEC08AE2D162128" section-type="subsequent-section"><enum>4.</enum><header>Amendments to chapter

			 3</header><text display-inline="no-display-inline">Section 362(b)(22) of title

			 11, United States Code, is amended by inserting <quote>(excluding a debtor who

			 is a victim of a natural disaster)</quote> after <quote>debtor</quote> the

			 first place that term appears.</text>

		</section><section commented="no" display-inline="no-display-inline" id="HB5B7AA618FD741F3A7667C93C00C79" section-type="subsequent-section"><enum>5.</enum><header>Amendments to chapter

			 5</header><text display-inline="no-display-inline">Section 521 of title 11,

			 United States Code, is amended by adding at the end the following:</text>

			<quoted-block display-inline="no-display-inline" id="H219223B5EFA44DCAA6DBF08203700C" style="OLC">

				<subsection commented="no" display-inline="no-display-inline" id="H73AAB2B481E24CFE808D1E8B4110C48F"><enum>(k)</enum><text display-inline="yes-display-inline">The Court may extend any time period

				specified in this section as may be necessary if—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="H4DA0FE9A74484E5B89D100A1232400E9"><enum>(1)</enum><text display-inline="yes-display-inline">the debtor is a victim of a natural

				disaster; and</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8484D313555947CF82BFB457B83310D5"><enum>(2)</enum><text display-inline="yes-display-inline">the debtor’s status as a victim of a

				natural disaster necessitates such extension of

				time.</text>

					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

		</section><section commented="no" display-inline="no-display-inline" id="HCEF2709CB06544F2B952ED8992C9FD65" section-type="subsequent-section"><enum>6.</enum><header>Amendments to chapter

			 7</header>

			<subsection commented="no" display-inline="no-display-inline" id="H58EDBA0EEF754FEF86001F36A900B7F"><enum>(a)</enum><header>Debtor’s monthly

			 expenses</header><text display-inline="yes-display-inline">Section

			 707(b)(2)(A)(ii) of title 11, United States Code, is amended by adding at the

			 end the following:</text>

				<quoted-block display-inline="no-display-inline" id="H942F8DD77FC841F9A1798C73F75679FA" style="traditional">

					<subsection commented="no" display-inline="no-display-inline" id="H907E2370404E4C138802DC50CC58DB7C"><enum>(IV)</enum><text display-inline="yes-display-inline">In addition, the debtor’s monthly expenses

				may include the actual reasonably necessary expenses incurred as a result of

				being a victim of a natural

				disaster.</text>

					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="H3D2BE40290A34E57BC61E58BA4B4B3D0"><enum>(b)</enum><header>Limitation on

			 conversion of case</header><text display-inline="yes-display-inline">Section

			 707(b)(2) of title 11, United States Code, is amended by adding at the end the

			 following:</text>

				<quoted-block display-inline="no-display-inline" id="H648EA48ABE114466A0793C593812CA42" style="traditional">

					<subsection commented="no" display-inline="no-display-inline" id="H0CFFFBD0CFCD4052ABC95FC4CBBBA74"><enum>(E)</enum><text display-inline="yes-display-inline">Subparagraphs (A), (B), and (C) shall not

				apply, and the court may not dismiss or convert a case under this subsection,

				if the debtor is a victim of a natural

				disaster.</text>

					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="HF157C859323A41288671A3AB7015A1BB" section-type="subsequent-section"><enum>7.</enum><header>Amendments to chapter

			 11</header>

			<subsection commented="no" display-inline="no-display-inline" id="HB430F5457A234505B911B52B3355B69"><enum>(a)</enum><header>Conversion of

			 case</header><text display-inline="yes-display-inline">Section 1112(b) of title

			 11, United States Code, is amended—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="HBE80E0E1A0D344FBAC444F7545BC6BA7"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (2)(B)(i), by inserting

			 <quote>, including a natural disaster</quote> before the semicolon; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4EEC0D1D04BC44999C002674B4EA0F"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (3), by inserting

			 <quote>(including a natural disaster)</quote> after

			 <quote>circumstances</quote>.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H0E93E2B62D2747E08C705800AE37E79"><enum>(b)</enum><header>Who may file a

			 plan</header><text display-inline="yes-display-inline">Section 1121(e)(3) of

			 title 11, United States Code, is amended—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="H4D6DE45B7FEE4C7F807B5723FB24BA3C"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (A), by inserting

			 <quote>(i)</quote> after <quote>(A)</quote>;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8DAA8CFE82D24918801E6FDA43CE4B4"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (C), by striking the period

			 at the end and inserting <quote>; or</quote>;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H16E451BA36BF49E59B3D90AE2508B901"><enum>(3)</enum><text display-inline="yes-display-inline">by redesignating subparagraphs (B) and (C)

			 as clauses (ii) and (iii), respectively; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5401A00E380B45D68DD0797745A2302C"><enum>(4)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>

					<quoted-block display-inline="no-display-inline" id="HC7E65E1668E54071813F4599527BDFAA" style="traditional">

				because of a natural

				disaster.</text>

						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H972DD3316CD0482B9295F97952EA892C"><enum>(c)</enum><header>Extension of

			 time for small businesses</header><text display-inline="yes-display-inline">Chapter 11 of title 11, United States Code,

			 is amended—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="HF44FF217DD5744B497958440403C1CBF"><enum>(1)</enum><text display-inline="yes-display-inline">in the table of sections, by adding at the

			 end the following:</text>

				title, in a small business case, the court may extend any deadline specified in

				the creditors and the estate; or</text>

				disaster.</text>

				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H73DE3CCE7153434F8BDD733000FAF404" section-type="subsequent-section"><enum>8.</enum><header>Amendments to chapter

			 13</header>

			<subsection commented="no" display-inline="no-display-inline" id="H58B0660C51C049AC8426B175013BD4B7"><enum>(a)</enum><header>Conversion or

			 dismissal</header><text display-inline="yes-display-inline">Section 1307(e) of

			 title 11, United States Code, is amended by adding at the end the

			 following:</text>

				<quoted-block display-inline="no-display-inline" id="idF0F80EA1B9744F438246558D4AA0EEFF" style="OLC">

					<quoted-block-continuation-text quoted-block-continuation-text-level="subsection">The Court

				may extend any time period specified in this subsection as may be necessary

			</subsection><subsection commented="no" display-inline="no-display-inline" id="H5A8D8666226C4121835C82E09168FE66"><enum>(b)</enum><header>Filing of

			 prepetition tax returns</header><text display-inline="yes-display-inline">Section 1308 of title 11, United States

			 Code, is amended by adding at the end the following:</text>

				<quoted-block display-inline="no-display-inline" id="HCA59AD09E6424159B000626892407295" style="OLC">

					<subsection commented="no" display-inline="no-display-inline" id="HEDDA8441E86343818FAB91675D1B0100"><enum>(d)</enum><text display-inline="yes-display-inline">The Court may extend any time period

				specified in this subsection as may be necessary if—</text>

						<paragraph commented="no" display-inline="no-display-inline" id="H130949F3688F41FF93AC2B36BBD8C01"><enum>(1)</enum><text display-inline="yes-display-inline">the debtor is a victim of a natural

				disaster; and</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H53698DE6E58F47C29B28783144E18614"><enum>(2)</enum><text display-inline="yes-display-inline">the debtor’s status as a victim of a

				natural disaster necessitates such extension of

				time.</text>

						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="H6F8A8C4943794526BDD543ADC86EE615" section-type="subsequent-section"><enum>9.</enum><header>Amendments to title

			 28, United States Code</header><text display-inline="no-display-inline">Section

			 1408 of title 28, United States Code, is amended—</text>

			<paragraph commented="no" display-inline="no-display-inline" id="H0D694A4C604046F19100F0AF2F00B900"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting <quote>(a)</quote> before

			 <quote>Except</quote>, and</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H41D863B8665A482496C51D537E6DB6A1"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>

				<quoted-block display-inline="no-display-inline" id="H7B7676F92B6C4115A6C7F2530842FE78" style="OLC">

					<subsection commented="no" display-inline="no-display-inline" id="HACAE8C342C3747049FCA52CDD658E570"><enum>(b)</enum><text display-inline="yes-display-inline">If a case under title 11 cannot be

				commenced in a district court described in subsection (a) because a person is

				the victim of a natural disaster (as defined in section 101 of title 11), then

				a case under title 11 may be commenced by such person in the district court for

				the district in which such person

				resides.</text>

					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			</paragraph></section><section commented="no" display-inline="no-display-inline" id="H96A2A5D432774A5CAF76F001C207DA01" section-type="subsequent-section"><enum>10.</enum><header> Effective date;

			 application of amendments</header>

			<subsection commented="no" display-inline="no-display-inline" id="HE9BC131767D64AE38FEF2077F53929FD"><enum>(a)</enum><header>Effective

			 date</header><text display-inline="yes-display-inline">This Act and the

			 amendments made by this Act shall take effect on October 18, 2005.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="H9A457266EA03406798E0491736073048"><enum>(b)</enum><header>Application of

			 amendments</header><text display-inline="yes-display-inline">The amendments

			 made by this Act shall apply only with respect to cases commenced under title

			 11 of the United States Code on and after October 17, 2005.</text>
