		<official-title display="yes">To provide the Secretary of Agriculture

		  with additional authority and funding to provide emergency relief, in

		  coordination with the Secretary of Homeland Security, to victims of Hurricane

		  Katrina and related conditions.</official-title>

		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Hurricane Katrina Food Assistance

			 Relief Act of 2005</short-title></quote>.</text>

		</section><section commented="no" display-inline="no-display-inline" id="idF2DA23E2BA08436091FC5C7A2E9EB6B9" section-type="subsequent-section"><enum>2.</enum><header>Definition of

			 Secretary</header><text display-inline="no-display-inline">In this Act, the

			 term <term>Secretary</term> means the Secretary of Agriculture.</text>

		</section><section commented="no" display-inline="no-display-inline" id="id568CE5BAFD034713B0DB55A729716B09" section-type="subsequent-section"><enum>3.</enum><header>Food Stamp Program

			 disaster authority</header>

			<subsection commented="no" display-inline="no-display-inline" id="idB0E819854C864F5E9F8AA34D3488CCF7"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Section 5(h) of the

			 Food Stamp Act of 1977 (7 U.S.C. 2014(h)) is amended by adding at the end the

			 following:</text>

					<paragraph commented="no" display-inline="no-display-inline" id="idC0B4606C56C84B19A843018363EAC739" indent="up1"><enum>(4)</enum><header>Response to Hurricane

				Katrina</header>

						<subparagraph commented="no" display-inline="no-display-inline" id="idDFD085FD1CEA4F43AB134630727D760A"><enum>(A)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this paragraph:</text>

							<clause commented="no" display-inline="no-display-inline" id="id7955814643E9412092AC51B44F83AC32"><enum>(i)</enum><header>Affected area</header>

								<subclause commented="no" display-inline="no-display-inline" id="idB9774FBEB69F47E2ABF197C6D185E6F1"><enum>(I)</enum><header>In

				general</header><text display-inline="yes-display-inline">The term

				<term>affected area</term> means an area of a State that the Secretary

				determines was affected by Hurricane Katrina or a related condition.</text>

								</subclause><subclause commented="no" display-inline="no-display-inline" id="id2D809D4AD69A40D0B018E0D5AA20323F"><enum>(II)</enum><header>Inclusion</header><text display-inline="yes-display-inline">The term <term>affected area</term>

				includes any area that, as a result of Hurricane Katrina or a related

				condition, was covered by—</text>

									<item commented="no" display-inline="no-display-inline" id="idA157127EA9BE49149F37A95929524252"><enum>(aa)</enum><text display-inline="yes-display-inline">a

				natural disaster declaration under section 321(a) of the

				<act-name parsable-cite="CFRDA">Consolidated Farm and Rural Development

				Act</act-name> (7 U.S.C. 1961(a)); or</text>

									</item><item commented="no" display-inline="no-display-inline" id="idA56D6E1D23814657AF580818E5A53C71"><enum>(bb)</enum><text display-inline="yes-display-inline">a

				major disaster or emergency designation under the Robert T. Stafford Disaster

				Relief and Emergency Assistance Act (42 U.S.C. 5121 et seq.).</text>

									</item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id10194AD02AAE4A488FD6D49248F186E8"><enum>(ii)</enum><header>Affected household</header>

								<subclause commented="no" display-inline="no-display-inline" id="idF2290C80E32042F9B87DB84E27BF86C1"><enum>(I)</enum><header>In

				general</header><text display-inline="yes-display-inline">The term

				<term>affected household</term> means a household—</text>

									<item commented="no" display-inline="no-display-inline" id="id69A110725D01457390E97E3FCB1F0C64"><enum>(aa)</enum><text display-inline="yes-display-inline">in an affected area;</text>

									</item><item commented="no" display-inline="no-display-inline" id="id3ADC70233AC14C6591C98F038FDF3170"><enum>(bb)</enum><text display-inline="yes-display-inline">in which a member worked immediately prior

				to August 29, 2005, in an affected area;</text>

									</item><item commented="no" display-inline="no-display-inline" id="idFC41F932A06044F7919A83EBC4ACF7B3"><enum>(cc)</enum><text display-inline="yes-display-inline">that was displaced as a result of Hurricane

				Katrina or a related condition to other areas of the same or another State;

				or</text>

									</item><item commented="no" display-inline="no-display-inline" id="id91EF0191E6FE4B4B98AFC761C4070331"><enum>(dd)</enum><text display-inline="yes-display-inline">that the Secretary determines should

				receive relief under this paragraph as a result of Hurricane Katrina or a

				related condition.</text>

									</item></subclause><subclause commented="no" display-inline="no-display-inline" id="idAD1031DE0EFA499BB47D3DC20FE78B1D"><enum>(II)</enum><header>Inclusion</header><text display-inline="yes-display-inline">The term <term>affected household</term>

				includes a household containing 1 or more individuals that were displaced as a

				result of Hurricane Katrina or a related condition, as determined by the

				Secretary.</text>

								</subclause></clause><clause commented="no" display-inline="no-display-inline" id="idACDBA466067245E182461DC47C4139FE"><enum>(iii)</enum><header>Disaster recovery

				period</header>

								<subclause commented="no" display-inline="no-display-inline" id="id699DDAA9A26946C987BE0B849D074E3D"><enum>(I)</enum><header>In

				general</header><text display-inline="yes-display-inline">The term

				<term>disaster recovery period</term> means the period of 180 days beginning on

				the date of enactment of this paragraph.</text>

								</subclause><subclause commented="no" display-inline="no-display-inline" id="id389A66B58B094499A411FDA11A0AE2C8"><enum>(II)</enum><header>Extension</header><text display-inline="yes-display-inline">The disaster recovery period shall be

				extended for another 180 days unless the President determines that the

				extension is not necessary to fully meet the needs of affected

				households.</text>

								</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE11CFCDAFB7F486F8D7AD992430364F1"><enum>(B)</enum><header>Disaster recovery

				period</header><text display-inline="yes-display-inline">During the disaster

				recovery period—</text>

							<clause commented="no" display-inline="no-display-inline" id="id0D89FF2BE9B946F1A5688EE16A6321B5"><enum>(i)</enum><text display-inline="yes-display-inline">clauses (iv) and (v) of subsection

				(g)(2)(B), subsections (d) and (o) of section 6, and section 8(c)(1) shall not

				apply to affected households;</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="idAD20B8358A4745D8BCD9E0C14F41247C"><enum>(ii)</enum><text display-inline="yes-display-inline">the application of an affected household

				shall be processed under the procedures established under section

				11(e)(9);</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="idC008AEA311394A54BA0274BDCAC5D528"><enum>(iii)</enum><text display-inline="yes-display-inline">the State agency shall increase the value

				to the affected household of the thrifty food plan determined under section

				3(o) by 10 percent when calculating the value of the allotment for an affected

				household under section 8(a);</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="id50825835D3A64F308C0708BFF1927372"><enum>(iv)</enum><text display-inline="yes-display-inline">the Secretary shall pay each State agency

				an amount equal to 100 percent of administrative costs allowable under section

				16(a) related to serving affected households in lieu of the payments section

				16(a) would otherwise require for those costs;</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="id1A368206FA8641E4B06E2B868344A2EB"><enum>(v)</enum><text display-inline="yes-display-inline">an affected household shall be considered

				to meet the requirements of subsection (c)(2) if the income of the affected

				household, as calculated under subsection (c)(2), does not exceed the level

				permitted under subsection (c)(1) by more than 50 percent;</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="id6BC62EB3C7EE4F3F8DBA174979904B2F"><enum>(vi)</enum><text display-inline="yes-display-inline">any resource to which the household lost

				access because of Hurricane Katrina or a related condition shall not be

				considered a financial resource under subsection (g);</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="id52FB1CE941224089A06A619A355310E6"><enum>(vii)</enum><text display-inline="yes-display-inline">any funds designated for rebuilding or

				relocation (including payments from Federal, State, or local governments,

				charitable organizations, employers, or insurance companies) shall be excluded

				from consideration under subsection (g) in determining the eligibility of an

				affected household; and</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="id5FF9B9F7816142D19D7163E279B5FB89"><enum>(viii)</enum><text display-inline="yes-display-inline">an affected household may not be considered

				to customarily purchase food and prepare meals together with other individuals

				if the affected household did not customarily purchase food and prepare meals

				for home consumption with those individuals immediately prior to August 29,

				2005.</text>

							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDFC36BC0BCCD4D899DFF669F69A1F314"><enum>(C)</enum><header>Duplicate participation</header>

							<clause commented="no" display-inline="no-display-inline" id="idB05DDFCE91704A73ADE38EC1D1EBAB47"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall take such actions as

				are prudent and reasonable under the circumstances to identify affected

				households that are participating in more than 1 State and to terminate the

				duplicate participation of those households.</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="id3A708F8A73AC409299D7E87C1193AAD1"><enum>(ii)</enum><header>No action taken</header><text display-inline="yes-display-inline">Except in the case of deliberate

				falsehoods, no action may be taken against any affected household relating to

				any duplicate participation during the disaster recovery period that takes

				place prior to termination under clause (i).</text>

							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6FF155CAF2004729848559DC2D8CC678"><enum>(D)</enum><header>Claims relating to

				benefits</header><text display-inline="yes-display-inline">Except in the case

				of intentional program violations as determined under section 6(b), no claim

				may be established under section 13(b) relating to benefits issued under this

				subsection.</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5E310B136E7B412C984BC456CEE243BF"><enum>(E)</enum><header>Payment error rate</header><text display-inline="yes-display-inline">For purposes of determining the payment

				error rate of a State agency under section 16(c), the Secretary shall disregard

				any errors resulting from the application of this paragraph to an affected

				household during the disaster recovery period.</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idBB2609C9CA3B40B0A312839A566E29C1"><enum>(F)</enum><header>Effect of more generous disaster

				plans</header><text display-inline="yes-display-inline">This paragraph shall

				not supersede any provision of a plan approved under paragraph (1) that—</text>

							<clause commented="no" display-inline="no-display-inline" id="id04486F58E5A94BCBB2AC8C40BEC2E11D"><enum>(i)</enum><text display-inline="yes-display-inline">provides more complete or expeditious

				relief to affected households; or</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="idD28CA52E3CDE494BB2BBF433B41510B8"><enum>(ii)</enum><text display-inline="yes-display-inline">provides assistance to more

				individuals.</text>

							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="id87126EEDB90F4D4097094F9CC98D33FA"><enum>(b)</enum><header>Program

			 information activities</header>

				<paragraph commented="no" display-inline="no-display-inline" id="id2491150894EA43C49839668594B9BFFF"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">From funds otherwise

			 appropriated for the food stamp program established under the

			 <act-name parsable-cite="FSA77">Food Stamp Act of 1977</act-name>

			 (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C.

			 2011</external-xref> et seq.), the Secretary may use not more than $5,000,000

			 for the period of fiscal year 2005 through 2006 to enter into contracts with

			 nonprofit organizations to support household and community efforts to address

			 the food assistance and related needs resulting from Hurricane Katrina or a

			 related condition.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF646E008559349AB84B562550936CA8E"><enum>(2)</enum><header>Expediting

			 provisions</header><text display-inline="yes-display-inline">Notwithstanding

			 any other provision of law, the Secretary shall not be required—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="id48FE44CC521D40DAA8C0462285290FB3"><enum>(A)</enum><text display-inline="yes-display-inline">to provide public notice of the

			 availability of funds described in paragraph (1); or</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id90EB16796E0B4AAAB47350ABAD22382E"><enum>(B)</enum><text display-inline="yes-display-inline">to accept competitive bids for contracts

			 under this subsection.</text>

					</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="IDbcf92a32452d420595366f2b429d8752" section-type="subsequent-section"><enum>4.</enum><header>Emergency Food

			 Assistance Program and Section 32 Assistance</header>

			<subsection commented="no" display-inline="no-display-inline" id="id83902A8FED084EF990C35F356B742F32"><enum>(a)</enum><header>Definition of

			 eligible recipient</header><text display-inline="yes-display-inline">In this

			 section, the term <term>eligible recipient</term> means an individual or

			 household that, as determined by the Secretary in consultation with the

			 Secretary of Homeland Security—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="id4A16E354EDA84535A1E67B723F7A0BAC"><enum>(1)</enum><text display-inline="yes-display-inline">is a victim of Hurricane Katrina or a

			 related condition;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id01BD06FADEBA4FC5890F3982FF92F1E4"><enum>(2)</enum><text display-inline="yes-display-inline">has been displaced by Hurricane Katrina or

			 a related condition; or</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0E1402E99AB64E9CA2124B40A35AB503"><enum>(3)</enum><text display-inline="yes-display-inline">is temporarily housing 1 or more

			 individuals displaced by Hurricane Katrina or a related condition.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idE70A3D71D9224E769967FA82D357855E"><enum>(b)</enum><header>Assistance</header>

				<paragraph commented="no" display-inline="no-display-inline" id="idE12A5CD4233C42339A68AB7127770E48"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">In addition to funds

			 otherwise made available for fiscal year 2005 or 2006 to carry out the

			 emergency food assistance program established under the

			 <act-name parsable-cite="EFAA83">Emergency Food Assistance Act of

			 1983</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/7/7501">7

			 U.S.C. 7501</external-xref> et seq.), out of any funds in the Treasury not

			 otherwise appropriated, the Secretary of the Treasury shall transfer to the

			 Secretary of Agriculture $200,000,000 to remain available until expended to

			 provide a variety of food to eligible recipient agencies for providing food

			 assistance to eligible recipients, including—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="id2EDF7086227440DEB608A40EC61FC5A5"><enum>(A)</enum><text display-inline="yes-display-inline">special supplemental foods for pregnant

			 women and infants or for other individuals with special needs;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB372B420C6E6468C82CF1F361C3579C5"><enum>(B)</enum><text display-inline="yes-display-inline">infant formula;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF2F2165DEED44570943DC30FD86CDC96"><enum>(C)</enum><text display-inline="yes-display-inline">bottled water; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3653956424D7452AA89F5A8A435F0DA2"><enum>(D)</enum><text display-inline="yes-display-inline">fruit juices.</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id641A97232343463E8063D95CF7C27E24"><enum>(2)</enum><header>Use of

			 funds</header><text display-inline="yes-display-inline">Funds made available

			 under paragraph (1) may be used to provide commodities in accordance

			 with—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="idEE09F0B184F84306977A5C67DABA4C3B"><enum>(A)</enum><text display-inline="yes-display-inline">section 27 of the Food Stamp Act of 1977 (7

			 U.S.C. 2036);</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id893AB35988AC41F2BE1E2A7DF584F8C1"><enum>(B)</enum><text display-inline="yes-display-inline">section 203A of the

			 <act-name parsable-cite="EFAA83">Emergency Food Assistance Act of 1983 (7

			 U.S.C. 7504); and</act-name></text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id56A8C8B54E2C4BB3B1796956170CDCF2"><enum>(C)</enum><text display-inline="yes-display-inline">section 204 of the Emergency Food

			 Assistance Act of 1983 (7 U.S.C. 7508).</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDDDDB9AFAA4B2435EB9C6E3EA8D700BC2"><enum>(3)</enum><header>Receipt and

			 acceptance</header><text display-inline="yes-display-inline">The Secretary

			 shall be entitled to receive, shall accept, and shall use to carry out this

			 section the funds transferred under paragraph (1), without further

			 appropriation. <added-phrase reported-display-style="italic"></added-phrase></text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDcf85255f060a4fb9a44df6f5c0d7b9a7"><enum>(c)</enum><header>Section 32

			 funding</header><text display-inline="yes-display-inline">In addition to funds

			 otherwise made available under section 32 of the Act of August 24, 1935

			 (<external-xref legal-doc="usc" parsable-cite="usc/7/612c">7 U.S.C.

			 612c</external-xref>), the Secretary shall use not less than $200,000,000 of

			 funds made available under that section to provide food assistance to eligible

			 recipients, including food described in subparagraphs (A) through (D) of

			 subsection (b)(1).</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="ID07a28092a3a44cdf9af622437582b536" section-type="subsequent-section"><enum>5.</enum><header>WIC Funding</header>

			<subsection commented="no" display-inline="no-display-inline" id="idB23A6E735C054F3B9204016DC3C00EA1"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Out of any funds in

			 the Treasury not otherwise appropriated, in addition to other funds otherwise

			 made available to the Secretary for fiscal year 2005 or 2006 to carry out the

			 special supplemental nutrition program for women, infants, and children

			 established by <external-xref legal-doc="act" parsable-cite="CNA66/17">section

			 17</external-xref> of the <act-name parsable-cite="CNA66">Child Nutrition Act

			 of 1966</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1786">42 U.S.C. 1786</external-xref>), the Secretary of

			 the Treasury shall transfer to the Secretary of Agriculture to carry out that

			 program $200,000,000, to remain available until September 30, 2007.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="id29554E62013541C0AB77296E2F2F00D7"><enum>(b)</enum><header>Receipt and

			 acceptance</header><text display-inline="yes-display-inline">The Secretary

			 shall be entitled to receive, shall accept, and shall use to carry out this

			 section the funds transferred under subsection (a), without further

			 appropriation. <added-phrase reported-display-style="italic"></added-phrase></text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="idBACA3BB8A6F84D8298311FEFE362DD36"><enum>(c)</enum><header>Emergency

			 designation</header><text display-inline="yes-display-inline">The amounts made

			 available by the transfer of funds in or pursuant to subsection (a) are

			 designated as an emergency requirement pursuant to section 402 of H. Con. Res.

			 95 (109th Congress).</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="idC2973BAC72DE4610AEF27A3D2CC18EBA"><enum>(d)</enum><header>Allocation of

			 funds</header><text display-inline="yes-display-inline">Notwithstanding section

			 17(i) of the <act-name parsable-cite="CNA66">Child Nutrition Act of

			 1966</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1786">42

			 U.S.C. 1786</external-xref>(i)), the Secretary may allocate funds made

			 available under subsection (a) as the Secretary determines to be necessary to

			 provide assistance to women, infants, and children who, as determined by the

			 Secretary in consultation with the Secretary of Homeland Security—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="id8103E145E5C641459968DC8EAFFD4B9A"><enum>(1)</enum><text display-inline="yes-display-inline">are victims of Hurricane Katrina or a

			 related condition; or</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8E2A02BA04304F7A8BB149E522E04053"><enum>(2)</enum><text display-inline="yes-display-inline">have been displaced by Hurricane Katrina or

			 a related condition.</text>

				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idC1E3E0FCE44A4961AD26AB3CC98D6EFC" section-type="subsequent-section"><enum>6.</enum><header>Commodity Supplemental

			 Food Program Funding</header>

			<subsection commented="no" display-inline="no-display-inline" id="id3035834535FC42448E712EA8FE0BC307"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Out of any funds in

			 the Treasury not otherwise appropriated, in addition to other funds otherwise

			 made available to the Secretary for fiscal year 2005 or 2006 to carry out the

			 commodity supplemental food program established under section 5 of the

			 Agriculture and Consumer Protection Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/7/612c note">7 U.S.C. 612c note</external-xref>;

			 <external-xref legal-doc="public-law" parsable-cite="pl/93/86">Public Law

			 93–86</external-xref>), the Secretary of the Treasury shall transfer to the

			 Secretary of Agriculture $20,000,000 to carry out that program.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="id9460875834D64B21A5376BD1E16E0C48"><enum>(b)</enum><header>Receipt and

			 acceptance</header><text display-inline="yes-display-inline">The Secretary

			 shall be entitled to receive, shall accept, and shall use to carry out this

			 section the funds transferred under subsection (a), without further

			 appropriation. <added-phrase reported-display-style="italic"></added-phrase></text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="idA1ACEDC4CCAD4AFDA953BF49B4B351BF"><enum>(c)</enum><header>Emergency

			 designation</header><text display-inline="yes-display-inline">The amounts made

			 available by the transfer of funds in or pursuant to subsection (a) are

			 designated as an emergency requirement pursuant to section 402 of H. Con. Res.

			 95 (109th Congress).</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="idE1CF161A562C49F8B753BACD2AE48B6A"><enum>(d)</enum><header>Allocation of

			 funds</header><text display-inline="yes-display-inline">The Secretary shall use

			 funds made available under subsection (a) as the Secretary determines to be

			 necessary to provide assistance to individuals who, as determined by the

			 Secretary in consultation with the Secretary of Homeland Security—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="id4CFD5CB4B0654244B26AD56CAFF7B89F"><enum>(1)</enum><text display-inline="yes-display-inline">are victims of Hurricane Katrina or a

			 related condition; or</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE077A963B5744D0285F7956937EC3AAE"><enum>(2)</enum><text display-inline="yes-display-inline">have been displaced by Hurricane Katrina or

			 a related condition.</text>

				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID519895ad32e24914b3ca8677f863e082" section-type="subsequent-section"><enum>7.</enum><header>Report</header><text display-inline="no-display-inline">Not later than 180 days after the date of

			 enactment of this Act, the Secretary, in consultation with the Secretary of

			 Homeland Security, shall submit to the Committee on Agriculture of the House of

			 Representatives and the Committee on Agriculture, Nutrition, and Forestry of

			 the Senate a report that—</text>

			<paragraph commented="no" display-inline="no-display-inline" id="id4D031A0DD8E54120827D83267CBA43B6"><enum>(1)</enum><text display-inline="yes-display-inline">describes whether additional funding or

			 authority is needed to continue to address the food needs of eligible

			 recipients; and</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDBAF6A6981DF4F76871D02F1A91CDB33"><enum>(2)</enum><text display-inline="yes-display-inline">includes any determination by the President

			 under section 5(h)(4)(A)(iii)(II) of the Food Stamp Act of 1977 (as added by

			 section 3(a)) that an extension of the disaster recovery period is not

			 necessary to fully meet the needs of affected households.</text>

			</paragraph></section><section commented="no" display-inline="no-display-inline" id="ID0A145A4D4B6D4F02BCFB9DDBCC10A249" section-type="subsequent-section"><enum>8.</enum><header>Regulations</header>

			<subsection commented="no" display-inline="no-display-inline" id="IDE43F0B2F943E475F91FF61082E8CA70A"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Secretary may

			 promulgate such regulations as are necessary to implement this Act.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDC695C4B46B9A4B1996DE3D5E88497059"><enum>(b)</enum><header>Procedure</header><text display-inline="yes-display-inline">The promulgation of the regulations and

			 administration of this Act shall be made without regard to—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="ID7BC313864A4A432988B951E3CA3D19AE"><enum>(1)</enum><text display-inline="yes-display-inline">the notice and comment provisions of

			 section 553 of title 5, United States Code;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4184017F7EE54845A73DA81A23C0F04B"><enum>(2)</enum><text display-inline="yes-display-inline">the Statement of Policy of the Secretary of

			 Agriculture effective July 24, 1971 (36 Fed. Reg. 13804), relating to notices

			 of proposed rulemaking and public participation in rulemaking; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDAB5DEA6BF0264F59866B0776A5CA74C8"><enum>(3)</enum><text display-inline="yes-display-inline">chapter 35 of title 44, United States Code

			 (commonly known as the <quote>Paperwork Reduction Act</quote>).</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDBE84D2FB930149AE8A669395AF5802CA"><enum>(c)</enum><header>Congressional

			 review of agency rulemaking</header><text display-inline="yes-display-inline">In carrying out this section, the Secretary

			 shall use the authority provided under section 808 of title 5, United States

			 Code.</text>
