		<official-title display="yes">To allow United States courts to conduct

		  business during emergency conditions, and for other purposes.</official-title>

		<section commented="no" display-inline="no-display-inline" id="idC87E8E1F7D6E4470B3A99143AB7D8147" section-type="section-one"><enum>1.</enum><header>Short title</header>

			<subsection commented="no" display-inline="no-display-inline" id="idF81BD290993F4F1DB1CE217406877616"><enum>(a)</enum><header>Short

			 title</header><text display-inline="yes-display-inline">This Act may be cited

			 as the <quote><short-title>Federal Judiciary Emergency

			 Special Sessions Act of 2005</short-title></quote>.</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="IDbf64b94200d8427d81ae95c648b7d64c" section-type="subsequent-section"><enum>2.</enum><header>Emergency authority to

			 conduct court proceedings outside the territorial jurisdiction of the

			 court</header>

			<subsection commented="no" display-inline="no-display-inline" id="ID4d61070aa3fe4094815eca659fac16a4"><enum>(a)</enum><header>Circuit

			 courts</header><text display-inline="yes-display-inline">Section 48 of title

			 28, United States Code, is amended by adding at the end the following:</text>

				<quoted-block display-inline="no-display-inline" id="idE0DBD66E402844BBAEAB276CEB211D88" style="OLC">

					<subsection commented="no" display-inline="no-display-inline" id="ID2413a17cda6c41abafe910886616054d"><enum>(e)</enum><text display-inline="yes-display-inline">Each court of appeals may hold special

				sessions at any place within the United States outside the circuit as the

				nature of the business may require and upon such notice as the court orders,

				upon a finding by either the chief judge of the court of appeals (or, if the

				chief judge is unavailable, the most senior available active judge of the court

				of appeals) or the judicial council of the circuit that, because of emergency

				conditions, no location within the circuit is reasonably available where such

				special sessions could be held. The court may transact any business at a

				special session outside the circuit which it might transact at a regular

				session.</text>

					</subsection><subsection commented="no" display-inline="no-display-inline" id="idEF23C92BBE364A178B5A596F3686BC65"><enum>(f)</enum><text display-inline="yes-display-inline">If a court of appeals issues an order

				exercising its authority under subsection (e), the court—</text>

						<paragraph commented="no" display-inline="no-display-inline" id="idC3C5D75705224BFC801F8741DB602A13"><enum>(1)</enum><text display-inline="yes-display-inline">through the Administrative Office of the

				United States Courts, shall—</text>

							<subparagraph commented="no" display-inline="no-display-inline" id="id09EC6E75400B4FE19A98DF426609059E"><enum>(A)</enum><text display-inline="yes-display-inline">send notice of such order, including the

				reasons for the issuance of such order, to the Committee on the Judiciary of

				the Senate and the Committee on the Judiciary of the House of Representatives;

				and</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF09726359F1F4C2F802F4F0E6E52CF9B"><enum>(B)</enum><text display-inline="yes-display-inline">not later than 180 days after the

				expiration of such court order submit a brief report to the Committee on the

				Judiciary of the Senate and the Committee on the Judiciary of the House of

				Representatives describing the impact of such order, including—</text>

								<clause commented="no" display-inline="no-display-inline" id="id397CBBC3786646E8A3E4C3DC18189B24"><enum>(i)</enum><text display-inline="yes-display-inline">the reasons for the issuance of such

				order;</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="id371496B563BF4C1F95C89AF36E223978"><enum>(ii)</enum><text display-inline="yes-display-inline">the duration of such order;</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="id2894038FB03E455FB9FB9081F13FDFFF"><enum>(iii)</enum><text display-inline="yes-display-inline">the impact of such order on litigants;

				and</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="idC3D144DC1551471AA71403973CE2B385"><enum>(iv)</enum><text display-inline="yes-display-inline">the costs to the judiciary resulting from

				such order; and</text>

								</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idEB540E0D833647A987B2F0ACFE673BB0"><enum>(2)</enum><text display-inline="yes-display-inline">shall provide reasonable notice to the

				United States Marshals Service before the commencement of any special session

				held pursuant to such

				order.</text>

						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDd5953da04fc84ceab4002162b2a78d5f"><enum>(b)</enum><header>District

			 courts</header><text display-inline="yes-display-inline">Section 141 of title

			 28, United States Code, is amended—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="IDebb102f614b641afb56a959ac5e9c11a"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting <quote>(a)(1)</quote> before

			 <quote>Special</quote>;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDa774ea3a4868406496b39fd48f7aa677"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting <quote>(2)</quote> before

			 <quote>Any</quote>; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6e74bc3507f9430f8c52aff1ddfba352"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>

					<quoted-block display-inline="no-display-inline" id="idFC2BBAB4F09F470BB9C0BFC3168F734B" style="OLC">

						<subsection commented="no" display-inline="no-display-inline" id="ID83a5ac2fd1b7486eba2bf16c0601f011"><enum>(b)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idEE31E1F43C354BE89D61929090DA8BFF"><enum>(1)</enum><text display-inline="yes-display-inline">Special sessions of the district court may

				be held at such places within the United States outside the district as the

				nature of the business may require and upon such notice as the court orders,

				upon a finding by either the chief judge of the district court (or, if the

				chief judge is unavailable, the most senior available active judge of the

				district court) or the judicial council of the circuit that, because of

				emergency conditions, no location within the district is reasonably available

				where such special sessions could be held.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4F650A17B074442583ACC14F7F9F429C" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Pursuant to this subsection, any business

				which may be transacted at a regular session of a district court may be

				transacted at a special session conducted outside the district, except that a

				criminal trial may not be conducted at a special session outside of the State

				in which the crime has been committed unless the defendant consents to such a

				criminal trial.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id09766C2206D240109FFC2B9214C843F9" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of law,

				in any case in which a special session is conducted pursuant to this

				subsection, the district court may summon jurors—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="id9B2F429050F446A1BA7C93256F7B94AA"><enum>(A)</enum><text display-inline="yes-display-inline">in

				civil proceedings, from any part of the district in which the court ordinarily

				conducts business or the district in which the court is holding a special

				session; and</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idAA3C182BD2614953AA5EE9F4B438FF3E"><enum>(B)</enum><text display-inline="yes-display-inline">in

				criminal trials, from any part of the district in which the crime has been

				committed and, if a defendant so consents, from any district in which the court

				is conducting business pursuant to this subsection.</text>

								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC14FB3A20BA64E1B98C173780A281B62" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">If a district court issues an order

				exercising its authority under paragraph (1), the court—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="id998F11DEEB3C401AA12089507CEFD812"><enum>(A)</enum><text display-inline="yes-display-inline">through the Administrative Office of the

				United States Courts, shall—</text>

									<clause commented="no" display-inline="no-display-inline" id="idED717F92CCEA451789631A6A43D4A071"><enum>(i)</enum><text display-inline="yes-display-inline">send notice of such order, including the

				reasons for the issuance of such order, to the Committee on the Judiciary of

				the Senate and the Committee on the Judiciary of the House of Representatives;

				and</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="idE600FF774C71412B92D20E4F5C34B063"><enum>(ii)</enum><text display-inline="yes-display-inline">not later than 180 days after the

				expiration of such court order submit a brief report to the Committee on the

				Judiciary of the Senate and the Committee on the Judiciary of the House of

				Representatives describing the impact of such order, including—</text>

										<subclause commented="no" display-inline="no-display-inline" id="id1B002E9B610143E0A3F2D5BBE62ECDDC"><enum>(I)</enum><text display-inline="yes-display-inline">the reasons for the issuance of such

				order;</text>

										</subclause><subclause commented="no" display-inline="no-display-inline" id="idDAFE8F4A85BA4EB09B88E553F934E239"><enum>(II)</enum><text display-inline="yes-display-inline">the duration of such order;</text>

										</subclause><subclause commented="no" display-inline="no-display-inline" id="id0C8B01B2588F40D6A458E2D4B46BAED0"><enum>(III)</enum><text display-inline="yes-display-inline">the impact of such order on litigants;

				and</text>

										</subclause><subclause commented="no" display-inline="no-display-inline" id="id6E1356E6A64D4CF6A2AE6F8961140AF2"><enum>(IV)</enum><text display-inline="yes-display-inline">the costs to the judiciary resulting from

				such order; and</text>

										</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5ED736A2764F4E87A4915FF340A71324"><enum>(B)</enum><text display-inline="yes-display-inline">shall provide reasonable notice to the

				United States Marshals Service before the commencement of any special session

				held pursuant to such

				order.</text>

								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID32b2d1aa6d7d418a91b88e88c7264389"><enum>(c)</enum><header>Bankruptcy

			 courts</header><text display-inline="yes-display-inline">Section 152(c) of

			 title 28, United States Code, is amended—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="ID09a58e69a2c2468b8b143c02db2d171c"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting <quote>(1)</quote> after

			 <quote>(c)</quote>;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2df4daa45897449ea0f61e10ac45a2d2"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>

					<quoted-block display-inline="no-display-inline" id="idAF20F9769CDF4CCDBCF9629D07E6361E" style="OLC">

						<paragraph commented="no" display-inline="no-display-inline" id="ID491518fcb2b14b298f6257ba7d883442"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idAA2FD86FE48248249501DAC67A893FE6"><enum>(A)</enum><text display-inline="yes-display-inline">Bankruptcy judges may hold court at such

				places within the United States outside the judicial district as the nature of

				the business of the court may require, and upon such notice as the court

				orders, upon a finding by either the chief judge of the bankruptcy court (or,

				if the chief judge is unavailable, the most senior available bankruptcy judge)

				or by the judicial council of the circuit that, because of emergency

				conditions, no location within the district is reasonably available where the

				bankruptcy judges could hold court.</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD2F1443E36774D62B817134EFF75A937" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">Bankruptcy judges may transact any business

				at special sessions of court held outside the district pursuant to this

				paragraph that might be transacted at a regular session.</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2BE43996B17E4823A6C2111C29D70A4B" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">If

				a bankruptcy court issues an order exercising its authority under subparagraph

				(A), the court—</text>

								<clause commented="no" display-inline="no-display-inline" id="idB65A9BAD9D664B3DA6D89455EC1DB783"><enum>(i)</enum><text display-inline="yes-display-inline">through the Administrative Office of the

				United States Courts, shall—</text>

									<subclause commented="no" display-inline="no-display-inline" id="idD39406AA91D4415FBD4C303BC7F64819"><enum>(I)</enum><text display-inline="yes-display-inline">send notice of such order, including the

				reasons for the issuance of such order, to the Committee on the Judiciary of

				the Senate and the Committee on the Judiciary of the House of Representatives;

				and</text>

									</subclause><subclause commented="no" display-inline="no-display-inline" id="id80BFF0472B964B299EAD6EC9D78046B9"><enum>(II)</enum><text display-inline="yes-display-inline">not later than 180 days after the

				expiration of such court order submit a brief report to the Committee on the

				Judiciary of the Senate and the Committee on the Judiciary of the House of

				Representatives describing the impact of such order, including—</text>

										<item commented="no" display-inline="no-display-inline" id="idE26C10EA01E14BFA84BB62B8404CFE19"><enum>(aa)</enum><text display-inline="yes-display-inline">the reasons for the issuance of such

				order;</text>

										</item><item commented="no" display-inline="no-display-inline" id="idE3DD86E555A24D5789613E0B89B6C389"><enum>(bb)</enum><text display-inline="yes-display-inline">the duration of such order;</text>

										</item><item commented="no" display-inline="no-display-inline" id="idF4186CF57B5E406784C3237502DF2D15"><enum>(cc)</enum><text display-inline="yes-display-inline">the impact of such order on litigants;

				and</text>

										</item><item commented="no" display-inline="no-display-inline" id="idF15F1458178A40F2BD130BEE5B207E3F"><enum>(dd)</enum><text display-inline="yes-display-inline">the costs to the judiciary resulting from

				such order; and</text>

										</item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idC7ECD408CA7A4E7486CEC48BD15D864C"><enum>(ii)</enum><text display-inline="yes-display-inline">shall provide reasonable notice to the

				United States Marshals Service before the commencement of any special session

				held pursuant to such

				order.</text>

								</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idFE09B0D0BE634621AE5F754E1CCE82E6"><enum>(d)</enum><header>United States

			 Magistrate judges</header><text display-inline="yes-display-inline">Section 636

			 of title 28, United States Code, is amended in subsection (a) by striking

			 <quote>territorial jurisdiction prescribed by his appointment—</quote> and

			 inserting <quote>district in which sessions are held by the court that

			 appointed the magistrate judge, at other places where that court may function,

			 and elsewhere as authorized by law—</quote>.</text>
