			 title</header>
      <text display-inline="no-display-inline">This Act may be cited as

			 the <quote><short-title>20/20 Biofuels Challenge Act of

			 2005</short-title></quote>.</text>
    </section>

      <enum>2.</enum>
      <header>Definitions</header>
      <text display-inline="no-display-inline">In this Act:</text>
      <paragraph id="ID370e658e7e964e01afb503f47a96f68e" display-inline="no-display-inline" commented="no">
        <enum>(1)</enum>
        <header>Administrator</header>
        <text display-inline="yes-display-inline">The

			 term <term>Administrator</term> means the Administrator of the Environmental

			 Protection Agency.</text>
      </paragraph>
      <paragraph id="id7F4BDB9959FE46A4AC4415519F289B08" display-inline="no-display-inline" commented="no">
        <enum>(2)</enum>
        <header>Alternative

			 fuel</header>
        <text display-inline="yes-display-inline">The term <term>alternative fuel</term> has the meaning given

			 the term in section 301 of the Energy Policy Act of 1992 (42 U.S.C.

			 13211).</text>
      </paragraph>

        <enum>(3)</enum>
        <header>Cellulosic

			 biomass ethanol</header>
        <subparagraph id="ID76aa2b465e0d41c496aab57b0894342e" display-inline="no-display-inline" commented="no">
          <enum>(A)</enum>
          <header>In

			 general</header>
          <text display-inline="yes-display-inline">Subject to subparagraph (B), the term <term>cellulosic

			 biomass ethanol</term> means alternative fuels and blending components for

			 alternative fuels that are derived from cellulosic biomass feedstocks and

			 remain substantially in the liquid phase at room temperature and atmospheric

			 pressure.</text>
        </subparagraph>
        <subparagraph id="idA9482C467D4B465687D773B92F51F65E" display-inline="no-display-inline" commented="no">
          <enum>(B)</enum>
          <header>Exception</header>
          <text display-inline="yes-display-inline">If

			 a liquid alternative fuel contains components that are not derived from

			 cellulosic biomass feedstocks, only the portion of any such fuels or fuel

			 blending components that is derived from cellulosic biomass feedstocks shall be

			 considered applicable.</text>
        </subparagraph>
      </paragraph>
      <paragraph id="ID769a0bb647974a8683dcb086cddff5ab" display-inline="no-display-inline" commented="no">
        <enum>(4)</enum>
        <header>Cellulosic

			 biomass feedstock</header>
        <text display-inline="yes-display-inline">The term <term>cellulosic biomass

			 feedstock</term> means fuel derived from—</text>
        <subparagraph id="ID0544aa4efbf945a380f300971e7778e4" display-inline="no-display-inline" commented="no">
          <enum>(A)</enum>
          <text display-inline="yes-display-inline">any

			 lignocellulosic or hemicellulosic matter that is derived from organic material

			 of a plant that is planted for the purpose of producing energy (except a plant

			 produced on land enrolled in the conservation reserve program established under

			 subchapter B of chapter 1 of subtitle D of title XII of the Food Security Act

			 of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3831">16 U.S.C.

			 3831</external-xref> et seq.), if harvesting the plant would be inconsistent

			 with the purposes of the program); or</text>
        </subparagraph>
        <subparagraph id="ID175e7633a3214ebc88685011699f6fc0" display-inline="no-display-inline" commented="no">
          <enum>(B)</enum>
          <text display-inline="yes-display-inline">nonhazardous

			 lignocellulosic or hemicellulosic matter that is segregated from other waste

			 materials and is derived from—</text>
          <clause id="idB7B162F24C814BF198C76B4823376678" display-inline="no-display-inline" commented="no">
            <enum>(i)</enum>
            <text display-inline="yes-display-inline">trees and other

			 plant matter removed from the immediate vicinity of homes, other occupied

			 structures, or essential community infrastructure;</text>
          </clause>
          <clause id="IDa37737e79e3748cb8c4023a20449cbda" display-inline="no-display-inline" commented="no">
            <enum>(ii)</enum>
            <text display-inline="yes-display-inline">precommercial

			 thinning, slash, or brush (except thinning, slash, or brush from old growth

			 forests or publicly-owned roadless areas);</text>
          </clause>
          <clause id="ID4883071773c542c88e4182c38d334550" display-inline="no-display-inline" commented="no">
            <enum>(iii)</enum>
            <text display-inline="yes-display-inline">an agricultural

			 crop, a crop byproduct, or a residue resource (except a plant produced on land

			 enrolled in the conservation reserve program, if harvesting the plant would be

			 inconsistent with the purposes of the program); or</text>
          </clause>
          <clause id="ID5224e98c4aee4efbb39eaa1a57efaa1b" display-inline="no-display-inline" commented="no">
            <enum>(iv)</enum>
            <text display-inline="yes-display-inline">miscellaneous

			 waste (such as landscape or right-of-way tree trimmings), not including—</text>
            <subclause commented="no" id="ID4476c0b618b34b4fbb90f67550d44034" display-inline="no-display-inline">
              <enum>(I)</enum>
              <text display-inline="yes-display-inline">recyclable

			 postconsumer waste paper, including such paper in municipal solid waste;</text>
            </subclause>
            <subclause commented="no" id="ID20bfd44c88af4cc3be791046d11f22bd" display-inline="no-display-inline">
              <enum>(II)</enum>
              <text display-inline="yes-display-inline">painted,

			 treated, or pressurized wood; or</text>
            </subclause>
            <subclause commented="no" display-inline="no-display-inline" id="IDc57b9d107ec54cb0b2d4e74c5620e7ca">
              <enum>(III)</enum>
              <text display-inline="yes-display-inline">wood that is

			 contaminated by plastic or metal.</text>
            </subclause>
          </clause>
        </subparagraph>
      </paragraph>
      <paragraph id="ID437af236fda54da694dc99907cfe85d4" display-inline="no-display-inline" commented="no">
        <enum>(5)</enum>
        <header>Renewable

			 fuel</header>
        <subparagraph id="IDac479bb13f2d4e89b028c6b2dc84de85" display-inline="no-display-inline" commented="no">
          <enum>(A)</enum>
          <header>In

			 general</header>
          <text display-inline="yes-display-inline">The term <term>renewable fuel</term> means motor vehicle

			 fuel that—</text>
          <clause id="ID55b91d4c1e5441c48904b38079e0b4b2" display-inline="no-display-inline" commented="no">
            <enum>(i)</enum>
            <subclause commented="no" display-inline="yes-display-inline" id="id5E1F4E08E2C84712A523E90DFC5F299A">
              <enum>(I)</enum>
              <text display-inline="yes-display-inline">is produced from grain,

			 starch, oilseeds, or other biomass; or</text>
            </subclause>
            <subclause id="IDa96b89fe030440bb9f839756f2a6f04b" indent="up1" display-inline="no-display-inline" commented="no">
              <enum>(II)</enum>
              <text display-inline="yes-display-inline">is natural gas produced from a biogas

			 source, including a landfill, sewage waste treatment plant, feedlot, or other

			 place where decaying organic material is found; and</text>
            </subclause>
          </clause>
          <clause id="ID9a9061a1b34543949b891ff28e74742e" display-inline="no-display-inline" commented="no">
            <enum>(ii)</enum>
            <text display-inline="yes-display-inline">is

			 used to replace or reduce the quantity of fossil fuel present in a fuel mixture

			 used to operate a motor vehicle.</text>
          </clause>
        </subparagraph>
        <subparagraph id="ID30f326a5283545d3a95a4ea290c962c1" display-inline="no-display-inline" commented="no">
          <enum>(B)</enum>
          <header>Inclusion</header>
          <text display-inline="yes-display-inline">The

			 term <term>renewable fuel</term> includes—</text>
          <clause id="ID7b2a5e297ca448b0b9802c8269ff03f3" display-inline="no-display-inline" commented="no">
            <enum>(i)</enum>
            <text display-inline="yes-display-inline">biodiesel, as

			 defined in section 312(f) of the Energy Policy Act of 1992 (42 U.S.C.

			 13220(f));</text>
          </clause>
          <clause id="ID9262a710275e4d15b8f928aaa8cd2af5" display-inline="no-display-inline" commented="no">
            <enum>(ii)</enum>
            <text display-inline="yes-display-inline">cellulosic

			 biomass ethanol;</text>
          </clause>
          <clause id="IDb7f89443d0544cd5a95933952a454f04" display-inline="no-display-inline" commented="no">
            <enum>(iii)</enum>
            <text display-inline="yes-display-inline">waste derived

			 ethanol; and</text>
          </clause>
          <clause id="ID00c36ca8ddec40ffa09313ca8de583c3" display-inline="no-display-inline" commented="no">
            <enum>(iv)</enum>
            <text display-inline="yes-display-inline">any blending

			 components derived from renewable fuel, except that only the renewable fuel

			 portion of any such blending component shall be considered part of the

			 applicable volume under the renewable fuel program established by this

			 Act.</text>
          </clause>
        </subparagraph>
      </paragraph>
      <paragraph id="IDcfe89d9d9cfa45db9ef7ccaf6f745bf2" display-inline="no-display-inline" commented="no">
        <enum>(6)</enum>
        <header>Waste derived

			 ethanol</header>
        <text display-inline="yes-display-inline">The term <term>waste derived ethanol</term> means ethanol

			 derived from—</text>
        <subparagraph id="IDb9f149d6915a4c5da2aab60ef0932a6f" display-inline="no-display-inline" commented="no">
          <enum>(A)</enum>
          <text display-inline="yes-display-inline">animal wastes,

			 including poultry fats and poultry wastes, and other waste materials; or</text>
        </subparagraph>
        <subparagraph id="IDbc621e3d4c064229892604cbf51fba62" display-inline="no-display-inline" commented="no">
          <enum>(B)</enum>
          <text display-inline="yes-display-inline">municipal solid

			 waste.</text>
        </subparagraph>
      </paragraph>
    </section>

      <enum>3.</enum>
      <header>Renewable fuel

			 standard</header>
      <subsection id="IDdd1625fae57b4a728cbe3ac4776e5e2b" display-inline="no-display-inline" commented="no">
        <enum>(a)</enum>
        <header>Renewable fuel

			 program</header>
        <paragraph id="IDc668fdc74f3647cdb3780d69504b165c" display-inline="no-display-inline" commented="no">
          <enum>(1)</enum>
          <header>In

			 general</header>
          <subparagraph id="IDb54041e71eb441c2bb6d23b9c73d32e0" display-inline="no-display-inline" commented="no">
            <enum>(A)</enum>
            <header>Regulations</header>
            <text display-inline="yes-display-inline">Not

			 later than 1 year after the date of enactment of this Act, the Administrator

			 shall promulgate regulations ensuring that motor vehicle fuel sold or dispensed

			 to consumers in the contiguous United States, on an annual average basis,

			 contains the applicable volume of renewable fuel specified in subsection

			 (b).</text>
          </subparagraph>
          <subparagraph id="IDc8d44a160ab64fe99edae0c079199f55" display-inline="no-display-inline" commented="no">
            <enum>(B)</enum>
            <header>Compliance</header>
            <text display-inline="yes-display-inline">Regardless

			 of the date of promulgation, the regulations shall contain compliance

			 provisions for refiners, blenders, and importers, as appropriate, to ensure

			 that the requirements of this subsection are met, unless the Administrator

			 determines compliance will violate the <act-name parsable-cite="CAA">Clean Air

			 Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42

			 U.S.C. 7401</external-xref> et seq.).</text>
          </subparagraph>
        </paragraph>
      </subsection>

        <enum>(b)</enum>
        <header>Applicable

			 volume</header>

			 2006 through 2020</header>
          <text display-inline="yes-display-inline">For the purpose of subsection (a), the

			 applicable volume for each of calendar years 2006 through 2020 shall be

			 determined in accordance with the following table:</text>

      <header>Stimulation of

			 biodiesel production</header>
      <text display-inline="no-display-inline">Sections

			 40A(e), 6426(c)(6), and 6427(e)(4)(B) of the Internal Revenue Code of 1986 (as

			 amended by section 1344 of the Energy Policy Act of 2005(a)) are each amended

			 by striking <quote>2008</quote> and inserting <quote>2010</quote>.</text>
    </section>

      <header>Full fuel

			 flexibility requirement</header>

        <text display-inline="yes-display-inline">Chapter 329 of title 49, United States Code, is amended

              <text display-inline="yes-display-inline">In

				this section:</text>

                <enum>(1)</enum>
                <header>Flexible fuel

				mixture</header>
                <text display-inline="yes-display-inline">The term

				<term>flexible fuel mixture</term> means—</text>
                <subparagraph commented="no" display-inline="no-display-inline" id="id7D7AD2D18DA5455C92AB9E62806822F8">
                  <enum>(A)</enum>
                  <text display-inline="yes-display-inline">any mixture of ethanol with gasoline for a

				gasoline powered vehicle; or</text>
                </subparagraph>

                  <enum>(B)</enum>
                  <text display-inline="yes-display-inline">any mixture of biodiesel by volume with

              </paragraph>

                <enum>(2)</enum>
                <header>Vehicle</header>
                <text display-inline="yes-display-inline">The

				term <term>vehicle</term> includes—</text>
                <subparagraph id="id47E0F361F3B947819B36286561E0407D" display-inline="no-display-inline" commented="no">
                  <enum>(A)</enum>
                  <text display-inline="yes-display-inline">a passenger

				automobile;</text>
                </subparagraph>
                <subparagraph id="id63D72DF6A90945188FBCAE0B441D88ED" display-inline="no-display-inline" commented="no">
                  <enum>(B)</enum>
                  <text display-inline="yes-display-inline">an automobile

				capable of off-highway operation as defined in section 523.5 of title 49, Code

				of Federal Regulations (or any successor regulation);</text>

                  <enum>(C)</enum>

                  <text display-inline="yes-display-inline">a heavy vehicle,

				including trucks used for shipping; and</text>
                </subparagraph>

                  <enum>(E)</enum>
                  <text display-inline="yes-display-inline">a large farm

				implement that operates on either gasoline or diesel fuels.</text>
                </subparagraph>
              </paragraph>

                <enum>(3)</enum>
                <header>Water

				transportation</header>
                <subparagraph id="id07B7DF1A801A4EA79C3CEBB0E9F9F096" display-inline="no-display-inline" commented="no">
                  <enum>(A)</enum>
                  <header>In

				general</header>
                  <text display-inline="yes-display-inline">The term <term>water transportation</term> includes those

				vehicles used primarily in the transportation of people, goods, and services

				over significant distances and includes—</text>
                  <clause id="IDb7d7a967c7914573861ac434221a6b54" display-inline="no-display-inline" commented="no">
                    <enum>(i)</enum>
                    <text display-inline="yes-display-inline">public and

				commercial waterborne ferrys; and</text>
                  </clause>
                  <clause id="ID7f1554ed07c2479cbfb162d8ee7c61b8" display-inline="no-display-inline" commented="no">
                    <enum>(ii)</enum>
                    <text display-inline="yes-display-inline">barges whose

				primary use is the transport of goods and services related to interstate and

				international commerce.</text>
                  </clause>
                </subparagraph>
                <subparagraph id="idE7BCB5B9BA1C41289D9E955F6D48A901" display-inline="no-display-inline" commented="no">
                  <enum>(B)</enum>
                  <header>Exclusion</header>
                  <text display-inline="yes-display-inline">The

				term <term>water transportation</term> does not include watercraft the primary

				use of which is for personal recreational benefit.</text>
                </subparagraph>
              </paragraph>
            </subsection>
            <subsection id="idA863405D2DD24C4793FEA3B911C4BFF1" display-inline="no-display-inline" commented="no">
              <enum>(b)</enum>
              <header>Requirement</header>
              <text display-inline="yes-display-inline">Personal and commercial land and water

				transportation and shipping vehicles and vessels and large farm equipment

				manufactured after model year 2010 and capable of operating on either gasoline

				or diesel fuel shall also be capable of operating on a flexible fuel

				mixture.</text>
            </subsection>
            <subsection id="IDd670b78a21f74ebfa964992561ee30db" display-inline="no-display-inline" commented="no">
              <enum>(c)</enum>
              <header>Consumer

				information</header>
              <text display-inline="yes-display-inline">The Secretary of Transportation shall prescribe

				regulations that require the vehicle or vessel manufacturer—</text>
