		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>DNA Fingerprint Act of

			 2005</short-title></quote>.</text>

		</section><section commented="no" display-inline="no-display-inline" id="idAE3EB231E1EE45229921021F58889A34" section-type="subsequent-section"><enum>2.</enum><header>Use of opt-out

			 procedure to remove samples from national DNA index</header><text display-inline="no-display-inline">Section 210304 of the DNA Identification Act

			 of 1994 (42 U.S.C. 14132) is amended—</text>

			<paragraph commented="no" display-inline="no-display-inline" id="ID9c62e2362bfb4dff8ed6d308efe9936f"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(1)(C), by striking

			 <quote>, provided</quote> and all that follows through

			 <quote>System</quote>;</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd445e5f0a4de4b92a30b112ac801125c"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (d)(2)(A)(ii), by striking

			 <quote>all charges for</quote> and all that follows, and inserting the

			 following: “the responsible agency or official of that State receives, for each

			 charge against the person on the basis of which the analysis was or could have

			 been included in the index, a certified copy of a final court order

			 establishing that such charge has been dismissed or resulted in an acquittal.”;

			 and</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDda9fa40ce5b1481f8cbf14754e711f31"><enum>(3)</enum><text display-inline="yes-display-inline">by striking subsection (e).</text>

			</paragraph></section><section commented="no" display-inline="no-display-inline" id="IDdb11252517614703bc64cfbdcd2a3c89" section-type="subsequent-section"><enum>3.</enum><header>Expanded use of codis

			 grants</header><text display-inline="no-display-inline">Section 2(a)(1) of the

			 DNA Analysis Backlog Elimination Act of 2000 (42 U.S.C. 14135(a)(1)) is amended

			 by striking <quote>taken from individuals convicted of a qualifying State

			 offense (as determined under subsection (b)(3))</quote> and inserting

			 <quote>collected under applicable legal authority</quote>.</text>

		</section><section commented="no" display-inline="no-display-inline" id="IDf00e903d3eb04c0bbe8d7ce8aec9a0b2" section-type="subsequent-section"><enum>4.</enum><header>Authorization to

			 conduct DNA sample collection from persons arrested or detained under federal

			 authority</header>

			<subsection commented="no" display-inline="no-display-inline" id="idA887A5B54ED642B1A555D7B4AB5A6360"><enum>(a)</enum><header>In

			 General</header><text display-inline="yes-display-inline">Section 3 of the DNA

			 Analysis Backlog Elimination Act of 2000 (42 U.S.C. 14135a) is amended—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="ID3b8cc1c397bb4521b560083480374d24"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="IDa42c6970143946fe89f0a6f3f3e4be13"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>The

			 Director</quote> and inserting the following:</text>

						<quoted-block display-inline="no-display-inline" id="idAC9F824BA09A4E7D8D8A4E5281EC99C5" style="OLC">

							<subparagraph commented="no" display-inline="no-display-inline" id="ID3388fb166fb64a63b7292e74fcddda46"><enum>(A)</enum><text display-inline="yes-display-inline">The Attorney General may, as prescribed by

				the Attorney General in regulation, collect DNA samples from individuals who

				are arrested or detained under the authority of the United States. The Attorney

				General may delegate this function within the Department of Justice as provided

				in section 510 of title 28, United States Code, and may also authorize and

				direct any other agency of the United States that arrests or detains

				individuals or supervises individuals facing charges to carry out any function

				and exercise any power of the Attorney General under this section.</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID618c2e58f3d542019d35da302e28dd96"><enum>(B)</enum><text display-inline="yes-display-inline">The

				Director</text>

							</subparagraph><after-quoted-block>;

				and</after-quoted-block></quoted-block>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDd442eeb63d504634be064be8b983d2d2"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraphs (3) and (4), by striking

			 <quote>Director of the Bureau of Prisons</quote> each place it appears and

			 inserting <quote>Attorney General, the Director of the Bureau of

			 Prisons,</quote>; and</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID84fbc8d8bb734e54b5b7224bf5682619"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b), by striking

			 <quote>Director of the Bureau of Prisons</quote> and inserting <quote>Attorney

			 General, the Director of the Bureau of Prisons,</quote>.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDc04608d697c04e85bdd4c359e7a11f1d"><enum>(b)</enum><header>Conforming

			 Amendments</header><text display-inline="yes-display-inline">Subsections (b)

			 and (c)(1)(A) of section 3142 of title 18, United States Code, are each amended

			 by inserting <quote>and subject to the condition that the person cooperate in

			 the collection of a DNA sample from the person if the collection of such a

			 sample is authorized pursuant to section 3 of the DNA Analysis Backlog

			 Elimination Act of 2000 (42 U.S.C. 14135a)</quote> after <quote>period of

			 release</quote>.</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="idC566C75F22904AC498DB8571385C72D8" section-type="subsequent-section"><enum>5.</enum><header>Tolling of statute of

			 limitations for sexual-abuse offenses</header><text display-inline="no-display-inline">Section 3297 of title 18, United States

			 Code, is amended by striking <quote>except for a felony offense under chapter

			 109A,</quote>.</text>
