				<section id="IDbefbe8c91bc44bb0930ed79c4781e0ff"><enum>101.</enum><header>Authorization

			 of appropriations</header>

					<text display-inline="no-display-inline">Section 639(a) of the Head

			 Start Act (42 U.S.C. 9834(a)) is amended by striking <quote>such sums</quote>

			 and all that follows and inserting the following: <quote>$8,570,000,000 for

			 fiscal year 2006, $10,445,000,000 for fiscal year 2007, $12,384,000,000 for

			 fiscal year 2008, $14,334,000,000 for fiscal year 2009, and $16,332,000,000 for

			 fiscal year 2010.</quote>.</text>

				</section><section id="IDf6258bc5d174402e9899bf6659b8419d"><enum>102.</enum><header>Strengthening

			 Indian and migrant and seasonal Head Start programs</header>

					<text display-inline="no-display-inline">Section 640(a)(2) of the Head

			 Start Act (42 U.S.C. 9835(a)(2)) is amended by striking subparagraph (A) and

			 inserting the following:</text>

					<quoted-block display-inline="no-display-inline" id="idE3544D13FEF246FEA6885FD0749BC038" style="OLC">

						<subparagraph id="IDbb10c9873ea04ab5ba53008c06210a5c" indent="up1"><enum>(A)</enum><text>Indian Head Start programs, services

				for children with disabilities, and migrant and seasonal Head Start programs,

				except that the Secretary shall reserve for each fiscal year for use by Indian

				Head Start and migrant and seasonal Head Start programs (referred to in this

				subparagraph as `covered programs'), on a nationwide basis, a sum that is the

				total of not less than 4 percent of the amount appropriated under section

				639(a) for that fiscal year (for Indian Head Start programs), and not less than

				5 percent of that appropriated amount (for migrant and seasonal Head Start

				programs), except that—</text>

							<clause id="IDae67a4bfb17145ce886950473d495f52"><enum>(i)</enum><text>if reserving the specified

				percentages for covered programs and would reduce the number of children served

				by Head Start programs, relative to the number of children served on the date

				of enactment of the Quality Education for All Act, taking into consideration an

				appropriate adjustment for inflation, the Secretary shall reserve percentages

				that approach, as closely as practicable, the specified percentages and that do

				not cause such a reduction; and</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="ID922705593b3149e3accbab49e9c6c2d4"><enum>(ii)</enum><text>notwithstanding any other

				provision of this subparagraph, the Secretary shall reserve for each fiscal

				year for use by Indian Head Start programs and by migrant and seasonal Head

				Start programs, on a nationwide basis, not less than the amount that was

				obligated for use by Indian Head Start programs and by migrant and seasonal

				Head Start programs, respectively, for the previous fiscal year;</text>

							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>

				</section><section id="ID9084ba6095d548c2955cf4bbec5978aa"><enum>103.</enum><header>Expanding

			 Early Head Start programs</header>

					<text display-inline="no-display-inline">Section 640(a)(6) of the Head

			 Start Act (42 U.S.C. 9835(a)(6)) is amended—</text>

					<paragraph id="idDBAE494FD35F4C598BA6EEA5FF917C33"><enum>(1)</enum><text>in subparagraph

			 (A), by striking <quote>7.5 percent for fiscal year 1999</quote> and all that

			 follows and inserting <quote>12 percent for fiscal year 2006, 14 percent for

			 fiscal year 2007, 16 percent for fiscal year 2008, 18 percent for fiscal year

			 2009, and 20 percent for fiscal year 2010, of the amount appropriated pursuant

			 to section 639(a).</quote>;</text>

					</paragraph><paragraph id="IDe2c6acff914a4a1695488f9b42ede2fa"><enum>(2)</enum><text>by striking

			 subparagraph (B); and</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID58f85078ea16410d934cef2bc627bad5"><enum>(3)</enum><text>by redesignating

			 subparagraph (C) as subparagraph (B).</text>

					</paragraph></section><section id="ID58d4a5f8df7845a9a12a7cde0d12f04d"><enum>104.</enum><header>Participation

			 in Head Start programs</header>

					<subsection id="id4D4FDC2843594C71BC06C67F3EC7696B"><enum></enum><text>Section 645 of

			 the Head Start Act (42 U.S.C. 9840) is amended—</text>

						<paragraph id="idE8714ADFFB494D4AA528D99F482D464A"><enum>(1)</enum><text>in subsection

			 (a)(1)(A), by inserting <quote>130 percent of</quote> after

			 <quote>below</quote>; and</text>

						</paragraph><paragraph id="ID53b41e16a29a460980304b177420a89b"><enum>(2)</enum><text>by adding at the

			 end the following:</text>

							<quoted-block display-inline="no-display-inline" id="id888C7ADD746D4AD7B47D651AFDF0213F" style="OLC">

								<subsection id="idA574D3EB2D3E45E8A5E57E5EE6B18D1F"><enum>(e)</enum><text>After

				demonstrating a need through a community needs assessment, a Head Start agency

				may apply to the Secretary to convert part-day sessions, particularly

				consecutive part-day sessions, into full-day sessions.</text>

								</subsection><after-quoted-block>.</after-quoted-block></quoted-block>

						</paragraph></subsection></section></subtitle><subtitle id="idACB0EE6209FB4A0FBA4441B2B0EB15DF"><enum>B</enum><header>Enhancing the

			 school readiness of Head Start children</header>

				<section id="IDd79519ebd2c843019ab898cd0e8b77f2"><enum>111.</enum><header>School

			 readiness standards</header>

					<text display-inline="no-display-inline">Section 641A(a)(1)(B)(ii) of

			 the Head Start Act (42 U.S.C. 9836(a)(1)(B)(ii)) is amended by striking

			 <quote>at a minimum</quote> and all that follows and inserting the following:

			 “at a minimum, develop and demonstrate—</text>

					<quoted-block display-inline="no-display-inline" id="id2A73A1D009294F868F1FC6B001310D83" style="OLC">

						<subclause id="ID9566a68d2ae84b39b897d7a2fa818a93" indent="up1"><enum>(I)</enum><text>language skills, including an expanded

				use of vocabulary;</text>

						</subclause><subclause id="IDc909aa6616d542cd8510b1bfbcad5059" indent="up1"><enum>(II)</enum><text>interest in and appreciation of books,

				reading, and writing (either alone or with others), phonological and phonemic

				awareness, and varied modes of expression and communication;</text>

						</subclause><subclause id="ID9fff4d31934546f890d7acc63192f7f8" indent="up1"><enum>(III)</enum><text>premathematics knowledge and skills,

				including knowledge and skills relating to aspects of classification,

				seriation, numbers, spatial relations, and time;</text>

						</subclause><subclause id="ID16d403c4ce234127a8a580ad56e8cc0e" indent="up1"><enum>(IV)</enum><text>cognitive abilities related to academic

				achievement;</text>

						</subclause><subclause id="ID2e0ffad6f6d94755a314d169961a622e" indent="up1"><enum>(V)</enum><text>abilities related to social and emotional

				development;</text>

						</subclause><subclause id="IDead5f802c940451cb49e8ac9327c9e87" indent="up1"><enum>(VI)</enum><text>gross and fine motor skills; and</text>

						</subclause><subclause id="IDe16e7506df834832bea9a17ffe392418" indent="up1"><enum>(VII)</enum><text>in the case of children with limited

				English proficiency, abilities related to progress toward acquisition of the

				English language.</text>

						</subclause><after-quoted-block>.</after-quoted-block></quoted-block>

				</section><section id="ID1e802714534c43efa79140c439320803"><enum>112.</enum><header>Staff</header>

					<subsection id="id4135159C65FC4CDA95EAF929A99E60B8"><enum>(a)</enum><header>Staff

			 qualifications and development</header><text>Section 648A of the Head Start Act

			 (42 U.S.C. 9843a) is amended—</text>

						<paragraph id="ID82cd2886b24946fea6161ade1c7d4aa9"><enum>(1)</enum><text>in subsection

			 (a)(2)—</text>

							<subparagraph id="idE5464A2AE1144B969F65F2E52ACDF1B4"><enum>(A)</enum><text>in subparagraph

			 (A)—</text>

								<clause id="id3939973B0A40475CAF5414C48BA1800A"><enum>(i)</enum><text>in

			 the matter preceding clause (i), by striking <quote>not later than September

			 30, 2003</quote> and all that follows through <quote>programs have</quote> and

			 inserting <quote>not later than the date determined under subparagraph (D) for

			 a Head Start region, each Head Start agency in the region with a center-based

			 program shall ensure that all classrooms in the program have at least 1 teacher

			 who has</quote>;</text>

								</clause><clause id="IDa2da2a3a91db4121b0908c67e67ab5d2"><enum>(ii)</enum><text>in

			 clause (i), strike <quote>an associate, baccalaureate,</quote> and insert

			 <quote>a baccalaureate</quote>; and</text>

								</clause><clause id="IDab1abb7d34414cdd9b42cedd43e84e0e"><enum>(iii)</enum><text>in clause (ii),

			 strike <quote>an associate, baccalaureate,</quote> and insert <quote>a

			 baccalaureate</quote>; and</text>

								</clause></subparagraph><subparagraph id="id9F6127B7D0864590AF7F468A499F42CE"><enum>(B)</enum><text>by striking

			 subparagraph (B) and inserting the following:</text>

								<quoted-block display-inline="no-display-inline" id="id07C19A895E394031B79554641AF23437" style="OLC">

									<subparagraph id="IDf18cda6e69dd4557899a19953669b539"><enum>(B)</enum><header>Temporary

				requirement</header><text>Until the date determined under subparagraph (D) for

				a Head Start region, the Secretary shall ensure that at least 50 percent of all

				Head Start teachers in the region in center-based programs have—</text>

										<clause id="idF498D932CD3541E99CD474AE858D7584"><enum>(i)</enum><text>an associate,

				baccalaureate, or advanced degree in early childhood education; or</text>

										</clause><clause id="idF88A48999D3949FBBF0CDEF0B86A3ED0"><enum>(ii)</enum><text>an associate,

				baccalaureate, or advanced degree in a field related to early childhood

				education, with experience in teaching preschool children.</text>

										</clause></subparagraph><subparagraph id="ID700930f6012e434981fb869b83eff7fd"><enum>(C)</enum><header>Requirement for

				new head start teachers</header><text>Not later than 3 years after the date of

				enactment of the Quality Education for All Act, the Secretary shall require

				that all teachers hired nationwide in center-based programs of Head Start

				agencies following the date of the requirement—</text>

										<clause id="ID14d94d1014ec4b9f991a27e04cc9cc0f"><enum>(i)</enum><text>have an

				associate, baccalaureate, or advanced degree in early childhood

				education;</text>

										</clause><clause id="ID7d1b89301cfb46a98185bc59e0f0ebf4"><enum>(ii)</enum><text>have an

				associate, baccalaureate, or advanced degree in a field related to early

				childhood education, with experience in teaching preschool children; or</text>

										</clause><clause id="ID64baf90731424b59a762f578755e27ff"><enum>(iii)</enum><text>be enrolled, or

				enroll not later than 1 year after the date of hire, in a program of study

				leading to an associate degree in early childhood education.</text>

										</clause></subparagraph><subparagraph id="id1D537B5075D34BDEBC4A8F1A54A4FB50"><enum>(D)</enum><header>Appropriate

				date</header><text>The Secretary shall determine an appropriate date for Head

				Start agencies in each Head Start region to reach the result described in

				subparagraph (A), but in no case shall such a date be later than 8 years after

				the date of enactment of Quality Education for All Act.</text>

									</subparagraph><subparagraph id="IDa416804fca3f4265bb7d391c9792f329"><enum>(E)</enum><header>Progress</header>

										<clause id="idFBC58134D396460E92EF80DF0F0E590B"><enum>(i)</enum><header>Requirement</header><text>The

				Secretary shall require Head Start agencies with center-based programs to

				demonstrate continuing and consistent progress each year to reach the results

				described in subparagraphs (A) and (C).</text>

										</clause><clause id="id0496175905FA43A9A93CEF12918976B9"><enum>(ii)</enum><header>Plan</header><text>Each

				State shall establish a plan for the Head Start agencies with center-based

				programs in the State to reach the results described in subparagraphs (A) and

				(C).</text>

										</clause><clause id="idEC358A82C017459C826FCFB38D261248"><enum>(iii)</enum><header>Progress</header><text>Each

				Head Start agency shall prepare and submit to the Secretary and the Governor of

				the State a report indicating the number and percentage of its teachers in

				center-based programs with child development associate credentials or

				associate, baccalaureate, or advanced degrees in early childhood education or a

				field related to early childhood education. The Secretary shall compile all

				such reports and submit a summary of the compiled reports to the Committee on

				Health, Education, Labor, and Pensions of the Senate and the Committee on

				Education and the Workforce of the House of Representatives.</text>

										</clause></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block>

							</subparagraph></paragraph><paragraph id="id06938466BA894439AB3292EB73F020B5"><enum>(2)</enum><text>in subsection

			 (a)(3), by striking <quote>(2)(A)</quote> and inserting <quote>(2)(B)</quote>;

			 and</text>

						</paragraph><paragraph id="ID19331605ab3d46c8a960769d0df8c7e6"><enum>(3)</enum><text>by adding at the

			 end the following:</text>

							<quoted-block display-inline="no-display-inline" id="idE03DA217F3F541829159441653DFD284" style="OLC">

								<subsection id="ID151efe87f5b9456bb23edb3d5b40ed35"><enum>(f)</enum><header>Pre-Literacy

				and language training</header><text>To support local efforts to enhance early

				language and pre-literacy development of children in Head Start programs, and

				to provide the children with high-quality oral language skills and environments

				that are rich in literature, in which to acquire early language and

				pre-literacy skills, each Head Start agency shall ensure that all of the

				agency's Head Start teachers receive ongoing training in language and emergent

				literacy. Such training shall also include information regarding appropriate

				curricula and assessments to improve instruction and learning. Such training

				shall include training in methods to promote phonological and phonemic

				awareness and vocabulary development in an age-appropriate and culturally and

				linguistically appropriate manner.</text>

								</subsection><subsection id="IDab2d1649b7bd4ceab27dbd2b815f32ba"><enum>(g)</enum><header>Professional

				development plans</header><text>Each Head Start agency and center shall create,

				in consultation with employees of the agency or center (including family

				service workers), a professional development plan for employees who provide

				direct services to children, including a plan for teachers, to meet the

				requirements set forth in subsection (a).</text>

								</subsection><after-quoted-block>.</after-quoted-block></quoted-block>

						</paragraph></subsection><subsection id="ID446056bf82c84999ae29b03d6898e9bb"><enum>(b)</enum><header>Attracting and

			 retaining high-quality Head Start teachers; Tribal College or University-Head

			 Start partnership program</header>

						<paragraph id="id93F6D23FA8794CDCA2CDF7BB14B62E65"><enum>(1)</enum><header>Program</header><text>The

			 Head Start Act is amended by inserting after section 648A (42 U.S.C. 9843a) the

			 following:</text>

							<quoted-block display-inline="no-display-inline" id="idE2AF398C64974BB59230CF4664DCB22D" style="OLC">

								<section id="ID59340e8cfbf84fd6946d26f8b7a374a1"><enum>648B.</enum><header>Attracting

				and retaining high-quality head start teachers</header>

									<subsection id="IDe582155c7de1406a8ba3c0fa17122177"><enum>(a)</enum>

										<header>In general</header><text>The Secretary shall make grants to

				eligible Head Start agencies to enable the agencies to reach the results

				described in subparagraphs (A) and (C) of section 648A(a)(2). The Secretary

				shall make the grants from allotments determined under subsection (b).</text>

									</subsection><subsection id="IDcd3afe04ee2c4f77bdb6a8404eb72558"><enum>(b)</enum><header>Allotments</header><text>From

				the funds made available under section 639(c) for a fiscal year and not

				reserved under subsection (d), the Secretary shall allot to each Head Start

				agency an amount that bears the same relationship to such funds as the amount

				received by the agency under section 640 for that fiscal year bears to the

				amount received by all Head Start agencies under section 640 for that fiscal

				year.</text>

									</subsection><subsection id="ID83779cdb3eda4e4988cd6eb7e43156c0"><enum>(c)</enum><header>Salary

				plan</header><text>A Head Start agency that receives a grant under this section

				shall develop and carry out a plan to raise the average salaries of teachers in

				the agency's Head Start programs. In developing the plan, the agency shall take

				into consideration the training, level of education, and experience of the

				teachers, and the average salaries of prekindergarten and kindergarten teachers

				employed by the local educational agency for the school district in which the

				Head Start agency is located, with similar training, level of education, and

				experience.</text>

									</subsection><subsection id="id565F3EC1E4934BFD95A99C0152ABD9E5"><enum>(d)</enum><header>Salaries in

				high-Cost areas</header><text>The Secretary may reserve and use a portion of

				the funds available under section 639(c) to assist Head Start agencies located

				in high-cost areas to help reduce the discrepancy between such average salaries

				of such teachers and such average salaries of such prekindergarten and

				kindergarten teachers.</text>

									</subsection></section><section id="ID4D33A1C150F04C1BBF468C5B29F2EBEA">

									<enum>648C.</enum>

									<header>Tribal College or University-head start partnership

				program</header>

									<subsection id="ID204ADCD4EB85418EA3E45C1708B4B9D0">

										<enum>(a)</enum>

										<header>Tribal College or University-Head start partnership

				program</header>

										<paragraph id="IDF9320B83FDB248618400A3182CDD5E97">

											<enum>(1)</enum>

											<header>Grants</header>

											<text>The Secretary is authorized to award grants, of not less than 5

				years duration, to Tribal Colleges and Universities to—</text>

											<subparagraph id="ID6E56A600D4964866B38599B1A47BB76B">

												<enum>(A)</enum>

												<text>implement education programs that include tribal culture and

				language and increase the number of associate, baccalaureate, and graduate

				degrees in early childhood education and related fields that are earned by

				Indian Head Start agency staff members, parents of children served by such an

				agency, and members of the tribal community involved;</text>

											</subparagraph><subparagraph id="IDCC848021E25F4875967E2C3C7FFCF6AB">

												<enum>(B)</enum>

												<text>develop and implement the programs under subparagraph (A) in

				technology-mediated formats; and</text>

											</subparagraph><subparagraph id="ID494437239A7B468A827068CEB1B2CE63">

												<enum>(C)</enum>

												<text>provide technology literacy programs for Indian Head Start

				agency staff members and children and families of children served by such an

				agency.</text>

											</subparagraph></paragraph><paragraph id="IDF541B67F4D474683AEF984E8DC8DEB43">

											<enum>(2)</enum>

											<header>Staffing</header>

											<text>The Secretary shall ensure that the American Indian Programs

				Branch of the Head Start Bureau of the Department of Health and Human Services

				shall have staffing sufficient to administer the programs under this section

				and to provide appropriate technical assistance to Tribal Colleges and

				Universities receiving grants under this section.</text>

										</paragraph></subsection><subsection id="ID42778D7E9B1942FD80F2D9DB6BD65EAB">

										<enum>(b)</enum>

										<header>Application</header>

										<text>Each Tribal College or University desiring a grant under this

				section shall submit an application to the Secretary, at such time, in such

				manner, and containing such information as the Secretary may require, including

				a certification that the Tribal College or University has established a

				partnership with 1 or more Indian Head Start agencies for the purpose of

				conducting the activities described in subsection (a).</text>

									</subsection><subsection id="IDB73F423B508449519FF5AFB625A400A6">

										<enum>(c)</enum>

										<header>Definitions</header>

										<text>In this section:</text>

										<paragraph id="ID703D8746EB904ECDBBAA9102B95BEBBC">

											<enum>(1)</enum>

											<header>Institution of higher education</header>

											<text>The term <term>institution of higher education</term> has the

				meaning given such term in section 101(a) of the

				<act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name>

				(<external-xref legal-doc="usc" parsable-cite="usc/20/1001(a)">20 U.S.C.

				1001(a)</external-xref>).</text>

											<enum>(2)</enum>

											<header>Tribal College or University</header>

											<text>The term <term>Tribal College or University</term> means an

				institution—</text>

										<text>There are authorized to be appropriated to carry out this

				section, $10,000,000 for fiscal year 2006 and such sums as may be necessary for

				each of fiscal years 2007 through 2010.</text>

			 requirements relating to training</header><text display-inline="no-display-inline">Section 658E(c) of the Child Care and

			 Development Block Grant Act of 1990 (42 U.S.C. 9858c(c)) is amended by adding

			 at the end the following:</text>

						<paragraph id="id4262F861560345F2B1D61C2295358B57"><enum>(6)</enum><header>Training in

				early learning and childhood development</header><text>The State plan shall

				describe any training requirements that are in effect within the State that are

				designed to enable child care providers to promote the social, emotional,

				physical, and cognitive development of children and that are applicable to

				child care providers that provide services for which assistance is made

				available under this subchapter in the State.</text>

						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

				</section><section id="id8D89D1F49F2F435684AEBC795743DF7F"><enum>132.</enum><header>Strengthening

			 the quality of child care</header>

					<text display-inline="no-display-inline">Section 658G of the Child Care

			 and Development Block Grant Act of 1990 (42 U.S.C. 9858e) is amended to read as

			 follows:</text>

					<quoted-block display-inline="no-display-inline" id="id32024283E84E4A038C131C74ADE2E38B" style="OLC">

						<section id="id96872732A71F4335AE3C1C54F291365E"><enum>658G.</enum><header>Activities to

				improve the quality of child care</header>

							<subsection id="IDbb69475fecfc441c9d58ed3aa3a52821"><enum>(a)</enum><header>In

				general</header>

								<paragraph id="IDa2e48e6df7c24e0e936865dc02a9a41e"><enum>(1)</enum><header>Reservation</header><text>Each

				State that receives funds appropriated under section 639(a) for a fiscal year

				shall reserve and use not less than 6 percent of the funds for activities

				provided directly, or through grants or contracts with resource and referral

				organizations or other appropriate entities, that are designed to improve the

				quality of child care services.</text>

								</paragraph><paragraph id="ID88eddd9b0bfc442f813e0a35109ce74c"><enum>(2)</enum><header>Activities</header><text>The

				funds reserved under paragraph (1) may only be used to—</text>

									<subparagraph id="ID3f0b84bee85b4d1ba273078b53c65c4d"><enum>(A)</enum><text>develop and

				implement voluntary guidelines on pre-reading and language skills and

				activities, for child care programs in the State, that are aligned with State

				standards for kindergarten through grade 12 or the State's general goals for

				school preparedness;</text>

									</subparagraph><subparagraph id="ID82df487db85a44768682943173b6c3ab"><enum>(B)</enum><text>support

				activities and provide technical assistance in child care settings to enhance

				early learning for young children, to promote literacy, and to foster school

				preparedness;</text>

									</subparagraph><subparagraph id="IDff671364a3404c11a90087bcf8f750e6"><enum>(C)</enum><text>offer training,

				professional development, and educational opportunities for child care

				providers that relate to the use of developmentally appropriate and

				age-appropriate curricula, and early childhood teaching strategies, that are

				scientifically based and aligned with the social, emotional, physical, and

				cognitive development of children, including—</text>

										<clause id="ID40c3960745964332b5d07ec9d3206cc7"><enum>(i)</enum><text>developing and

				operating distance learning child care training infrastructures;</text>

										</clause><clause id="ID227ae3c42e7945cdb78ced28d15a2fae"><enum>(ii)</enum><text>developing model

				technology-based training courses;</text>

										</clause><clause id="IDd6cc55cf2f63443fa0f6a23456fc7d3a"><enum>(iii)</enum><text>offering

				training for caregivers in informal child care settings; and</text>

										</clause><clause id="ID037ea56ec3ac4a7b90346d8fb6044df6"><enum>(iv)</enum><text>offering

				training for child care providers who care for infants and toddlers and

				children with special needs;</text>

										</clause></subparagraph><subparagraph id="IDc30ddc452f804db39b929d8f11d43875"><enum>(D)</enum><text>engage in

				programs designed to increase the retention and improve the competencies of

				child care providers, including wage incentive programs and initiatives that

				establish tiered payment rates for providers that meet or exceed child care

				services guidelines, as defined by the State;</text>

									</subparagraph><subparagraph id="IDde3cf52eddfd42eeb045ecf6b0e94c10"><enum>(E)</enum><text>evaluate and

				assess the quality and effectiveness of child care programs and services

				offered in the State to young children on improving overall school

				preparedness; and</text>

									</subparagraph><subparagraph id="ID4d095e724758407db9a9752d309a360e"><enum>(F)</enum><text>carry out other

				activities determined by the State to improve the quality of child care

				services provided in the State and for which measurement of outcomes relating

				to improved child safety, child well-being, or school preparedness is

				possible.</text>

									</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID121e12d021264b8eb9d7a4effca60e3e"><enum>(b)</enum><header>Certification</header><text>For

				each fiscal year beginning after September 30, 2005, the State shall annually

				submit to the Secretary a certification in which the State certifies and

				demonstrates that the State was in compliance with subsection (a) during the

				preceding fiscal year and describes how the State used funds made available to

				carry out this subchapter to comply with subsection (a) during that preceding

				fiscal year.</text>

							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

				</section></subtitle></title><title id="idB4C4BAAEE42147EDAA7D25CD4CD7D641"><enum>II</enum><header>Providing safe,

			 reliable transportation for rural school children</header>

			<section id="idAC06817EDCC84BBD96A098B80B1D4B9F"><enum>201.</enum><header>Findings and

			 purpose</header>

				<subsection id="ID7c72174ecb6248cf9efd5f573b18b7b0"><enum>(a)</enum><header>Findings</header><text>Congress

			 finds that—</text>

					<paragraph id="ID5adffe6ec8c542fc8e516b8418256b7e"><enum>(1)</enum><text>school

			 transportation issues have concerned parents, local educational agencies,

			 lawmakers, the National Highway Traffic Safety Administration, the National

			 Transportation Safety Board, and the Environmental Protection Agency for

			 years;</text>

					</paragraph><paragraph id="IDeb0dd9e7446847309321baf69ad43474"><enum>(2)</enum><text>millions of

			 children face potential future health problems because of exposure to noxious

			 fumes emitted from older school buses;</text>

					</paragraph><paragraph id="ID0b856d41e91a4dd2a1588abf794d4525"><enum>(3)</enum><text>the Environmental

			 Protection Agency established the Clean School Bus USA program to replace

			 129,000 of the oldest diesel buses that cannot be retrofitted in an effort to

			 help children and the environment by improving air quality;</text>

					</paragraph><paragraph id="ID4d79a740922041df8e655cb03a24b34e"><enum>(4)</enum><text>unfortunately,

			 many rural local educational agencies are unable to participate in that program

			 because of the specialized fuels needed to sustain a clean bus fleet;</text>

					</paragraph><paragraph id="ID34dae3bfcb094f1d8f16baff582a15be"><enum>(5)</enum><text>many rural local

			 educational agencies are operating outdated, unsafe school buses that are

			 failing inspections because of automotive flaws, resulting in the depletion of

			 the school bus fleets of the local educational agencies; and</text>

					</paragraph><paragraph id="ID3a59a1011e6742ed8b06f72d31e24484"><enum>(6)</enum><text>many rural local

			 educational agencies are unable to afford to buy newer, safer buses.</text>

					</paragraph></subsection><subsection id="ID6ee916796631490db91b027429faeaeb"><enum>(b)</enum><header>Purpose</header><text>The

			 purpose of this title is to establish within the Department of Education a

			 Federal cost-sharing program to assist rural local educational agencies with

			 older, unsafe school bus fleets in purchasing newer, safer school buses.</text>

				</subsection></section><section id="ID96a1858cd66e4d33a9b6c3502feb7c8c"><enum>202.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>

				<paragraph id="ID4ec08550bca74219ac33b2f3208817b0"><enum>(1)</enum><header>Rural local

			 educational agency</header><text>The term <term>rural local educational

			 agency</term> means a local educational agency, as defined in section 9101 of

			 the Elementary and Secondary Education Act of 1965 (20 U.S.C. 7801), with

			 respect to which—</text>

					<subparagraph id="IDeea6d0b34ed24093889c97b4a8024a1e"><enum>(A)</enum><text>each county in

			 which a school served by the local educational agency is located has a total

			 population density of fewer than 10 persons per square mile;</text>

					</subparagraph><subparagraph id="ID4eb3eb2c5a94436fb89d03fb7124671f"><enum>(B)</enum><text>all schools

			 served by the local educational agency are designated with a school locale code

			 of 7 or 8, as determined by the Secretary; or</text>

					</subparagraph><subparagraph id="ID259fb73114504889af0dafb4b639c748"><enum>(C)</enum><text>all schools

			 served by the local educational agency have been designated, by official action

			 taken by the legislature of the State in which the local educational agency is

			 located, as rural schools for purposes relating to the provision of educational

			 services to students in the State.</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9f8986f1c66e4d1d9c751165e555d271"><enum>(2)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the

			 Secretary of Education.</text>

				</paragraph><paragraph id="ID85940ec905794cd594531837bbe30ab7"><enum>(3)</enum><header>School

			 bus</header><text>The term <term>school bus</term> means a vehicle the primary

			 purpose of which is to transport students to and from school or school

			 activities.</text>

				</paragraph></section><section id="IDfcfc0283ee52402a8409f2852ec30849"><enum>203.</enum><header>Grant

			 program</header>

				<subsection id="ID7db8e8a76c6046feb08df44e7fd03e8b"><enum>(a)</enum><header>In

			 general</header><text>From amounts appropriated under subsection (e) for a

			 fiscal year, the Secretary shall provide grants, on a competitive basis, to

			 rural local educational agencies to pay the Federal share of the cost of

			 purchasing new school buses.</text>

				</subsection><subsection id="IDd4860a9d2561486e8d02339d5d131e84"><enum>(b)</enum><header>Application</header>

					<paragraph id="ID6cad246b2c7b48b8a4bf2d6b6261c333"><enum>(1)</enum><header>In

			 general</header><text>Each rural local educational agency that seeks to receive

			 a grant under this title shall submit to the Secretary for approval an

			 application at such time, in such manner, and accompanied by such information

			 (in addition to information required under paragraph (2)) as the Secretary may

			 require.</text>

					</paragraph><paragraph id="ID2c46a561b8b74b9a9e1e7db9b1f01438"><enum>(2)</enum><header>Contents</header><text>Each

			 application submitted under paragraph (1) shall include—</text>

						<subparagraph id="IDc7b07d0d84034b14a9c318d224cd4d98"><enum>(A)</enum><text>documentation

			 that, of the total number of school buses operated by the rural local

			 educational agency, not less than 50 percent of the school buses are in need of

			 repair or replacement;</text>

						</subparagraph><subparagraph id="ID0a2e1eecfe6845179b6e21ace504d241"><enum>(B)</enum><text>documentation of

			 the number of miles that each school bus operated by the rural local

			 educational agency traveled in the most recent 9-month academic year;</text>

						</subparagraph><subparagraph id="IDb5e9710af5a245349bd102bf7d3d323d"><enum>(C)</enum><text>documentation

			 that the rural local educational agency is operating with a reduced fleet of

			 school buses;</text>

						</subparagraph><subparagraph id="IDad7ce268b28042839924d96779c9cf70"><enum>(D)</enum><text>a certification

			 from the rural local educational agency that—</text>

							<clause id="IDfe0105f0f3964f4188e2386461741e5e"><enum>(i)</enum><text>authorizes the

			 application of the rural local educational agency for a grant under this title;

			 and</text>

							</clause><clause id="IDecac82362ca0496aa478216933dcd4d0"><enum>(ii)</enum><text>describes the

			 dedication of the rural local educational agency to school bus replacement

			 programs and school transportation needs (including the number of new school

			 buses needed by the rural local educational agency); and</text>

							</clause></subparagraph><subparagraph id="ID58541a26414248aa8a3ef1f78b35f395"><enum>(E)</enum><text>an assurance that

			 the rural local educational agency will pay the non-Federal share of the cost

			 of the purchase of new school buses under this title from non-Federal

			 sources.</text>

						</subparagraph></paragraph></subsection><subsection id="ID6eaf897edf864f399411c8909c15cf47"><enum>(c)</enum><header>Priority</header>

					<text>In providing grants under this title, the Secretary shall give

			 priority to rural local educational agencies that, as determined by the

			 Secretary—</text>

					<paragraph id="ID3de9de33c8084582bbd2d4361c2ff92b"><enum>(1)</enum><text>are transporting

			 students in a bus manufactured before 1977;</text>

					</paragraph><paragraph id="IDd16590284f6b46018943d652ffe45591"><enum>(2)</enum><text>have a grossly

			 depleted fleet of school buses; or</text>

					</paragraph><paragraph id="IDf1e04c3893f54a399370ba4e0890ec57"><enum>(3)</enum><text>serve a school

			 that is required, under section 1116(b)(9) of the Elementary and Secondary

			 Education Act of 1965 (20 U.S.C. 6316(b)(9)), to provide transportation to

			 students to enable the students to transfer to another public school served by

			 the rural local educational agency.</text>

					</paragraph></subsection><subsection id="idD77D3BA471354D9DB1F5C394B0D7ECBB"><enum>(d)</enum><header>Use of

			 Funds</header><text>School buses purchased with grant funds awarded under

			 subsection (a) shall be in compliance with proposed air quality regulations and

			 standards of the Environmental Protection Agency for 2006.</text>

				</subsection><subsection id="id90861FE5147147DBA988DC2F00B71C41"><enum>(e)</enum><header>Payments;

			 Federal share</header>

					<paragraph id="ID5f3c253f76304a768e9393ba4973f58f"><enum>(1)</enum><header>Payments</header><text>The

			 Secretary shall pay to each rural local educational agency having an

			 application approved under this section the Federal share described in

			 paragraph (2) of the cost of purchasing such number of new school buses as is

			 specified in the approved application.</text>

					</paragraph><paragraph id="IDfe85dbc1cea6430196e972d67a6fb9dc"><enum>(2)</enum><header>Federal

			 share</header><text>The Federal share of the cost of purchasing a new school

			 bus under this title shall be 75 percent.</text>

					</paragraph></subsection></section><section id="IDd960932107034b9fbcab4e3658f66f86"><enum>204.</enum><header>Authorization

			 of appropriations</header><text display-inline="no-display-inline">There are

			 authorized to be appropriated to carry out this title $50,000,000 for fiscal

			 year 2006 and such sums as may be necessary for each of fiscal years 2007

			 through 2010.</text>

			</section></title><title id="id35DC0D0FAAF94DEB810EA9490DF6917F"><enum>III</enum><header>Sense of the

			 Senate regarding fully funding the Individuals with Disabilities Education Act

			 by 2011</header>

			<section id="IDc6c3de3e2c114781b34d2f8e7e235502"><enum>301.</enum><header>Findings</header>

				<subsection id="ID8e3d69cf322e4265a6b4ad0aeef56ba3"><enum>(a)</enum><header>Findings</header><text>The

			 Senate finds the following:</text>

					<paragraph id="ID9d7b3d57f55244939d2ef813f8f3f106"><enum>(1)</enum><text>Disability is a

			 natural part of the human experience and in no way diminishes the right of

			 individuals to participate in or contribute to society. Improving educational

			 results for children with disabilities is an essential element of our national

			 policy of ensuring equality of opportunity, full participation, independent

			 living, and economic self-sufficiency for individuals with disabilities.</text>

					</paragraph><paragraph id="ID7485d45f73bb44a482975659b5f7c612"><enum>(2)</enum><text>Before the date

			 of enactment of the Education for All Handicapped Children Act of 1975 (Public

			 Law 94–142), the predecessor to the Individuals with Disabilities Education Act

			 (20 U.S.C. 1400 et seq.), the educational needs of millions of children with

			 disabilities were not being fully met because—</text>

						<subparagraph id="ID69a2e908954643cdb777c34b9cddb422"><enum>(A)</enum><text>the children did

			 not receive appropriate educational services;</text>

						</subparagraph><subparagraph id="ID4a38631a7fa74fc5947ec7afc4aaa97b"><enum>(B)</enum><text>the children were

			 excluded entirely from the public school system and from being educated with

			 their peers;</text>

						</subparagraph><subparagraph id="IDdc0aea860b074f26b270b1229c1cde38"><enum>(C)</enum><text>undiagnosed

			 disabilities prevented the children from having a successful educational

			 experience; or</text>

						</subparagraph><subparagraph id="ID73e608a200024500ac3a0becb18dc789"><enum>(D)</enum><text>a lack of

			 adequate resources within the public school system forced such families to find

			 services outside the public school system.</text>

						</subparagraph></paragraph><paragraph id="ID45626b6bbc2a48219bf469ba7977fbff"><enum>(3)</enum><text>The Individuals

			 with Disabilities Education Act has been successful in ensuring children with

			 disabilities and the families of such children access to a free appropriate

			 public education and in improving educational results for children with

			 disabilities.</text>

					</paragraph><paragraph id="ID4fb31dc693ee42438b41d1459ab04455"><enum>(4)</enum><text>The

			 implementation of the Individuals with Disabilities Education Act has been

			 impeded by the Federal Government’s failure to honor the commitment it made 30

			 years ago to provide States with 40 percent of the excess costs of special

			 education.</text>

					</paragraph><paragraph id="IDc88ea28ac87e432a955ee4f6960f88f1"><enum>(5)</enum><text>While States,

			 local educational agencies, and educational service agencies are primarily

			 responsible for providing an education for all children with disabilities, it

			 is in the national interest that the Federal Government have a supporting role

			 in assisting State and local efforts to educate children with disabilities in

			 order to improve results for such children and to ensure equal protection of

			 the law.</text>

					</paragraph><paragraph id="id832B64FA9D5D4F7CA82B712CF7D591BC"><enum>(6)</enum><text>Congress passed

			 authorizing language to fully fund the Individuals with Disabilities Education

			 Act and should appropriate such sums as authorized.</text>

					</paragraph><paragraph id="ID564f16ad1b9e4120babdc54d4760971e"><enum>(7)</enum><text>A more equitable

			 allocation of resources is essential for the Federal Government to meet its

			 responsibility to provide an equal educational opportunity for all

			 individuals.</text>

					</paragraph></subsection></section><section id="IDab133e3d254b40498a965cdbdfeadfb5"><enum>302.</enum><header>Sense of the

			 Senate regarding authorization of appropriations</header>

				<subsection id="ID6797a630795c4f76afc233796b7b9cfb"><enum></enum><text>It is the sense

			 of the Senate that for the purpose of carrying out the Federal Government's

			 commitment to children, parents, and the States, there should be authorized to

			 be appropriated—</text>

					<paragraph id="IDa4cd85bc6c66468497a867e4edc6663b"><enum>(1)</enum><text>$14,648,647,143

			 or the maximum amount available for awarding grants under section 611(a)(2) of

			 the Individuals with Disabilities Education Act, whichever is lower, for fiscal

			 year 2006, and there should be appropriated $4,058,901,319 for fiscal year

			 2006, which should become available for obligation on July 1, 2006, and should

			 remain available through September 30, 2007, except that if the maximum amount

			 available for awarding grants under section 611(a)(2) of such Act is less than

			 $14,648,647,143, then the amount should be reduced by the difference between

			 $14,648,647,143 and the maximum amount available for awarding grants under

			 section 611(a)(2) of such Act;</text>

					</paragraph><paragraph id="IDb96eb6cff16042ab89835c4c8c5fb791"><enum>(2)</enum><text>$16,938,917,714

			 or the maximum amount available for awarding grants under section 611(a)(2) of

			 the Individuals with Disabilities Education Act, whichever is lower, for fiscal

			 year 2007, and there should be appropriated $6,349,171,890 for fiscal year

			 2007, which should become available for obligation on July 1, 2007, and should

			 remain available through September 30, 2008, except that if the maximum amount

			 available for awarding grants under section 611(a)(2) of such Act is less than

			 $16,938,917,714, then the amount should be reduced by the difference between

			 $16,938,917,714 and the maximum amount available for awarding grants under

			 section 611(a)(2) of such Act;</text>

					</paragraph><paragraph id="ID85fd7cf245e94bd6a43d4a00ee8680f9"><enum>(3)</enum><text>$19,229,188,286

			 or the maximum amount available for awarding grants under section 611(a)(2) of

			 the Individuals with Disabilities Education Act, whichever is lower, for fiscal

			 year 2008, and there should be appropriated $8,639,442,462 for fiscal year

			 2008, which should become available for obligation on July 1, 2008, and should

			 remain available through September 30, 2009, except that if the maximum amount

			 available for awarding grants under section 611(a)(2) of such Act is less than

			 $19,229,188,286, then the amount should be reduced by the difference between

			 $19,229,188,286 and the maximum amount available for awarding grants under

			 section 611(a)(2) of such Act;</text>

					</paragraph><paragraph id="ID8b9909b1e22a40dc8dcc453e0b6fd037"><enum>(4)</enum><text>$21,519,458,857

			 or the maximum amount available for awarding grants under section 611(a)(2) of

			 the Individuals with Disabilities Education Act, whichever is lower, for fiscal

			 year 2009, and there should be appropriated $10,929,713,033 for fiscal year

			 2009, which should become available for obligation on July 1, 2009, and should

			 remain available through September 30, 2010, except that if the maximum amount

			 available for awarding grants under section 611(a)(2) of such Act is less than

			 $21,519,458,857, then the amount should be reduced by the difference between

			 $21,519,458,857 and the maximum amount available for awarding grants under

			 section 611(a)(2) of such Act;</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA24E898F331B4C7D86B2BACAB3EA63B6"><enum>(5)</enum><text>$23,809,729,429

			 or the maximum amount available for awarding grants under section 611(a)(2) of

			 the Individuals with Disabilities Education Act, whichever is lower, for fiscal

			 year 2010, and there should be appropriated $13,219,983,605 for fiscal year

			 2010, which should become available for obligation on July 1, 2010, and should

			 remain available through September 30, 2011, except that if the maximum amount

			 available for awarding grants under section 611(a)(2) of such Act is less than

			 $23,809,729,429, then the amount should be reduced by the difference between

			 $23,809,729,429 and the maximum amount available for awarding grants under

			 section 611(a)(2) of such Act;</text>

					</paragraph><paragraph id="id28AE0E083A4349F8A3FF21B841676B51"><enum>(6)</enum><text>$26,100,000,000

			 or the maximum amount available for awarding grants under section 611(a)(2) of

			 the Individuals with Disabilities Education Act, whichever is lower, for fiscal

			 year 2011, and there should be appropriated $15,510,254,176 for fiscal year

			 2011, which should become available for obligation on July 1, 2011, and should

			 remain available through September 30, 2012, except that if the maximum amount

			 available for awarding grants under section 611(a)(2) of such Act is less than

			 $26,100,000,000, then the amount should be reduced by the difference between

			 $26,100,000,000 and the maximum amount available for awarding grants under

			 section 611(a)(2) of such Act; and</text>

					</paragraph><paragraph id="IDd0031347092a48949b05a00e8be9e5ff"><enum>(7)</enum><text>the maximum

			 amount available for awarding grants under section 611(a)(2) of the Individuals

			 with Disabilities Education Act for fiscal year 2012 and each succeeding fiscal

			 year, and there should be appropriated for each such year an amount equal to

			 the maximum amount available for awarding grants under section 611(a)(2) of

			 such Act for the fiscal year for which the determination is made minus

			 $10,589,745,824, which should become available for obligation on July 1 of the

			 fiscal year for which the determination is made and should remain available

			 through September 30 of the succeeding fiscal year.</text>

			 elementary and secondary education</header>

										<enum>(b)</enum>

										<header>Application</header>

										<text>Each local educational agency desiring a grant under this

				section shall submit an application to the Secretary at such time, in such

				manner, and accompanied by such additional information as the Secretary may

				require.</text>

									</subsection><subsection id="ID39D08C6A710542F0B6D9B5B089E5BBC3">

										<enum>(c)</enum>

										<header>Priority</header>

										<text>In awarding grants under this section, the Secretary shall give

				priority to local educational agencies—</text>

										<paragraph id="IDC7298C77F25146DC85BA885D939423CE">

											<enum>(1)</enum>

											<text>who have documented difficulties in meeting the public school

				choice requirements of paragraph (1)(E), (5)(A), (7)(C)(i), or (8)(A)(i) of

				section 1116(b), or section 1116(c)(10)(C)(vii); and</text>

										</paragraph><paragraph id="IDB63129E3B66E48239888A2BC2E1AC247">

											<enum>(2)</enum>

											<text>with the highest number of schools at or above capacity.</text>

										</paragraph></subsection><subsection id="ID25C877412D5F49F18D7950563FF8FDB1">

										<enum>(d)</enum>

										<header>Award basis</header>

										<text>From funds remaining after awarding grants under subsection

				(c), the Secretary shall award grants to local educational agencies that are

				experiencing overcrowding in the schools served by the local educational

				agencies.</text>

									</subsection><subsection id="ID834354449DAC4323A4F871958F0ABB14">

										<enum>(e)</enum>

										<header>Prevailing wages</header>

										<text>Any laborer or mechanic employed by any contractor or

				subcontractor in the performance of work on any construction funded by a grant

				awarded under this section will be paid wages at rates not less than those

				prevailing on similar construction in the locality as determined by the

				Secretary of Labor under subchapter IV of chapter 31 of title 40, United States

				Code (commonly referred to as the <act-name parsable-cite="DBA">Davis-Bacon

				Act</act-name>).</text>

									</subsection><subsection id="IDE20533B130C74ADBBA8298E6722D192A">

										<enum>(f)</enum>

										<header>Definitions</header>

										<text>In this section:</text>

										<paragraph id="ID124A25108AF0421BA971375FC2CD504D">

											<enum>(1)</enum>

											<header>At or above capacity</header>

											<text>The term <term>at or above capacity</term>, in reference to a

				school, means a school in which 1 additional student would increase the average

				class size of the school above the average class size of all schools in the

				State in which the school is located.</text>

											<enum>(2)</enum>

											<header>Healthy, high-performance school building</header>

											<text>The term <term>healthy, high-performance school building</term>

				has the meaning given such term in section 5586.</text>

										<enum>(g)</enum>

										<header>Authorization of appropriations</header>

										<text>There are authorized to be appropriated to carry out this

				section $250,000,000 for fiscal year 2006, and such sums as may be necessary

						</paragraph></subsection><subsection id="id7FF68F1C918D4C02B1DDB0753D291C72"><enum>(c)</enum><header>Ensuring highly

			 qualified teachers</header>

						<paragraph id="idC5B564ADA1914DE19ABFD15F3174C9B6"><enum>(1)</enum><header>Requirement</header><text>The

			 Secretary of Education shall improve coordination among the teacher quality

			 programs authorized under the Elementary and Secondary Education Act of 1965

			 (20 U.S.C. 6301 et seq.), the Individuals with Disabilities Education Act (20

			 U.S.C. 1400 et seq.), the Higher Education Act of 1965 (20 U.S.C. 1001 et

			 seq.), and the Carl D. Perkins Vocational and Technical Education Act of 1998

			 (20 U.S.C. 2301 et seq.), to provide a unified effort in strengthening the

			 American teaching workforce and ensuring highly qualified teachers.</text>

						</paragraph><paragraph id="id3C283520C467442A8A225A9BACDDDFA5"><enum>(2)</enum><header>Report</header><text>Not

			 later than 6 months after the date of enactment of this Act, the Secretary of

			 Education shall submit a report to the relevant committees of Congress, that

			 shall be made available on the website of the Department of Education, on

			 efforts to coordinate programs pursuant to paragraph (1).</text>

						</paragraph></subsection></section></subtitle><subtitle id="id04A1083BC51946E6B95156EB09E2CD8D"><enum>B</enum><header>Adequate yearly

			 progress determinations</header>

				<section id="ID2A72319012F244C0B655256707A61F5E">

					<enum>421.</enum>

					<header>Review of adequate yearly progress determinations for schools

			 for the 2002–2003 school year</header>

					<subsection id="IDEC89FEF3B7C7439F9A99765ED5391B83">

						<enum>(a)</enum>

						<header>In general</header>

						<text>The Secretary shall require each local educational agency to

			 provide each school served by the agency with an opportunity to request a

			 review of a determination by the agency that the school did not make adequate

			 yearly progress for the 2002–2003 school year.</text>

					</subsection><subsection id="ID7ABC56C588244D9599ECD576B3C4EA6C">

						<enum>(b)</enum>

						<header>Final determination</header>

						<text>Not later than 30 days after receipt of a request by a school for

			 a review under this section, a local educational agency shall issue and make

			 publicly available a final determination on whether the school made adequate

			 yearly progress for the 2002–2003 school year.</text>

					</subsection><subsection id="IDBD0630291F11401FB1BDDF97878E081B">

						<enum>(c)</enum>

						<header>Evidence</header>

						<text>In conducting a review under this section, a local educational

			 agency shall—</text>

						<paragraph id="ID890AA710A3B2430FBB81AC38E2077CA0">

							<enum>(1)</enum>

							<text>allow the principal of the school involved to submit evidence on

			 whether the school made adequate yearly progress for the 2002–2003 school year;

			 and</text>

						</paragraph><paragraph id="IDA3D3ED51C3BA4F0FA18F443269CAC4A5">

							<enum>(2)</enum>

							<text>consider that evidence before making a final determination under

			 subsection (b).</text>

						</paragraph></subsection><subsection id="ID7B1E289CBF4742E1A37382447742DE29">

						<enum>(d)</enum>

						<header>Standard of review</header>

						<text>In conducting a review under this section, a local educational

			 agency shall revise, consistent with the applicable State plan under

			 <external-xref legal-doc="act" parsable-cite="ESEA/1111">section

			 1111</external-xref> of the <act-name parsable-cite="ESEA">Elementary and

			 Secondary Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311</external-xref>), the local

			 educational agency’s original determination that a school did not make adequate

			 yearly progress for the 2002–2003 school year if the agency finds that the

			 school made such progress, taking into consideration—</text>

						<paragraph id="ID0556F66E3EA64FFFAD0B04F8E6A19C10">

							<enum>(1)</enum>

							<text>the amendments made to part 200 of title 34, Code of Federal

			 Regulations (68 Fed. Reg. 68698) (relating to accountability for the academic

			 achievement of students with the most significant cognitive disabilities);

			 or</text>

						</paragraph><paragraph id="IDCD588CA42112470FB2963CCF7C4DB9C4">

							<enum>(2)</enum>

							<text>any regulation or guidance that, subsequent to the date of such

			 original determination, was issued by the Secretary relating to—</text>

							<subparagraph id="ID8172EFB872A642839DE48C90695DF1B4">

								<enum>(A)</enum>

								<text>the assessment of limited English proficient children;</text>

							</subparagraph><subparagraph id="IDE3F30F72D9274004953CCE6F8195AEB2">

								<enum>(B)</enum>

								<text>the inclusion of limited English proficient children as part of

			 the subgroup described in

			 <external-xref legal-doc="act" parsable-cite="ESEA/1111(b)(2)(C)(v)(II)(dd)">section

			 1111(b)(2)(C)(v)(II)(dd)</external-xref> of the <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of 1965</act-name>

			 (<external-xref legal-doc="usc" parsable-cite="usc/20/6311(b)(2)(C)(v)(II)(dd)">20 U.S.C.

			 6311(b)(2)(C)(v)(II)(dd)</external-xref>) after such children have obtained

			 English proficiency; or</text>

							</subparagraph><subparagraph id="ID9A990A85E93545FE92E0DEF3FD0A20F0">

								<enum>(C)</enum>

			 <external-xref legal-doc="act" parsable-cite="ESEA/1111(b)(2)(I)(ii)">section

							</subparagraph></paragraph></subsection><subsection id="IDB868F9862D744F21B2CA6A2E5E483B3E">

						<enum>(e)</enum>

						<header>Effect of revised determination</header>

						<paragraph id="IDD480F96E692F4F96A6BCF62B50D6C6FE">

							<enum>(1)</enum>

							<header>In general</header>

							<text>If pursuant to a review under this section a local educational

			 agency determines that a school made adequate yearly progress for the 2002–2003

			 school year, upon such determination—</text>

							<subparagraph id="IDCC95D99FF56649D18E523B65FE24A9FD">

								<enum>(A)</enum>

								<text>any action by the Secretary, the State educational agency, or the

			 local educational agency that was taken because of a prior determination that

			 the school did not make such progress shall be terminated; and</text>

							</subparagraph><subparagraph id="IDABF016B1C51847BB997C5828B71B605D">

								<enum>(B)</enum>

								<text>any obligations or actions required of the local educational

			 agency or the school because of the prior determination shall cease to be

			 required.</text>

							</subparagraph></paragraph><paragraph id="IDF814CAE00E3A430CBFBC37851188EFF7">

							<enum>(2)</enum>

							<header>Exceptions</header>

							<text>Notwithstanding paragraph (1), a determination under this section

			 shall not affect any obligation or action required of a local educational

			 agency or school under the following:</text>

							<subparagraph id="IDB78C431018D84489881EFE4CC14BABB9">

								<enum>(A)</enum>

								<text><external-xref legal-doc="act" parsable-cite="ESEA/1116(b)(13)">Section 1116(b)(13)</external-xref> of the

			 <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of

			 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/6316(b)(13)">20 U.S.C. 6316(b)(13)</external-xref>)

			 (requiring a local educational agency to continue to permit a child who

			 transferred to another school under such section to remain in that school until

			 completion of the highest grade in the school).</text>

							</subparagraph><subparagraph id="ID1F007CE0FBFF49928C3B4189B519D071">

								<enum>(B)</enum>

								<text><external-xref legal-doc="act" parsable-cite="ESEA/1116(e)(9)">Section 1116(e)(9)</external-xref> of the

			 <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of

			 1965</act-name> (as redesignated by section 402(3)) (<external-xref legal-doc="usc" parsable-cite="usc/20/6316(e)(9)">20 U.S.C.

			 6316(e)(9)</external-xref>) (requiring a local educational agency to continue

			 to provide supplemental educational services under such section until the end

			 of the school year).</text>

							</subparagraph></paragraph><paragraph id="ID2E0DDD17A38147BCA7C4821D577945C4">

							<enum>(3)</enum>

							<header>Subsequent determinations</header>

							<text>In determining whether a school is subject to school improvement,

			 corrective action, or restructuring as a result of not making adequate yearly

			 progress, the Secretary, a State educational agency, or a local educational

			 agency may not take into account a determination that the school did not make

			 adequate yearly progress for the 2002–2003 school year if such determination

			 was revised under this section and the school received a final determination of

			 having made adequate yearly progress for the 2002–2003 school year.</text>

						</paragraph></subsection><subsection id="ID0DCB81C041F749F488F698A704664D19">

						<enum>(f)</enum>

						<header>Notification</header>

						<text>The Secretary—</text>

						<paragraph id="IDA43B3721501B4D3B9614F51F88CC3DC7">

							<enum>(1)</enum>

							<text>shall require each State educational agency to notify each school

			 served by the agency of the school’s ability to request a review under this

			 section; and</text>

						</paragraph><paragraph id="ID54C4EAEF09B94258A85B1E3A5D81E218">

							<enum>(2)</enum>

							<text>not later than 30 days after the date of the enactment of this

			 section, shall notify the public by means of the Department of Education’s

			 website of the review process established under this section.</text>

						</paragraph></subsection></section><section id="ID94C62557A55E4F75A0DE250E28D06F79">

					<enum>422.</enum>

					<header>Review of adequate yearly progress determinations for local

			 educational agencies for the 2002–2003 school year</header>

					<subsection id="ID8B40B220A8D241FEBFB533B9430CD125">

						<enum>(a)</enum>

						<header>In general</header>

						<text>The Secretary shall require each State educational agency to

			 provide each local educational agency in the State with an opportunity to

			 request a review of a determination by the State educational agency that the

			 local educational agency did not make adequate yearly progress for the

			 2002–2003 school year.</text>

					</subsection><subsection id="IDFA7DF32EC2C24843A859763F2DCA38CF">

						<enum>(b)</enum>

						<header>Application of certain provisions</header>

						<text>Except as inconsistent with, or inapplicable to, this section,

			 the provisions of section 421 shall apply to review by a State educational

			 agency of a determination described in subsection (a) in the same manner and to

			 the same extent as such provisions apply to review by a local educational

			 agency of a determination described in section 421(a).</text>

					<enum>423.</enum>

					<header>Definitions</header>

			 given to that term in

						<text>The term <term>local educational agency</term> means a local

			 educational agency (as that term is defined in

			 Secondary Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>)) receiving funds

			 under part A of title I of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311</external-xref> et seq.).</text>

						<enum>(3)</enum>

						<text>The term <term>Secretary</term> means the Secretary of

			 Education.</text>

						<text>The term <term>school</term> means an elementary school or a

			 secondary school (as those terms are defined in

			 <external-xref legal-doc="act" parsable-cite="ESEA/9101">section

			 increasing data capacity for purposes of assessment and accountability</header>

				<subsection id="ID641ef114610949179364efa40c0bedf6"><enum>(a)</enum><header>Program

			 authorized</header><text>From funds appropriated for a fiscal year, the

			 Secretary may award grants, on a competitive basis, to State educational

			 agencies—</text>

					<paragraph id="IDccb172134b10495291209a61f73bd283"><enum>(1)</enum><text>to enable the

			 State educational agencies to develop or increase the capacity of data systems

			 for assessment and accountability purposes, including the collection of

			 graduation rates; and</text>

					</paragraph><paragraph id="IDb551cdd61ec84db286b60807a5399117"><enum>(2)</enum><text>to award

			 subgrants to increase the capacity of local educational agencies to upgrade,

			 create, or manage longitudinal data systems for the purpose of measuring

			 student academic progress and achievement.</text>

					</paragraph></subsection><subsection id="ID22b0e19f3c4c443185e74322633729e2"><enum>(b)</enum><header>State

			 application</header><text>Each State educational agency desiring a grant under

			 this section shall submit an application to the Secretary at such time, in such

			 manner, and containing such information as the Secretary may require.</text>

				</subsection><subsection id="ID19e0293bc30143fb969d629a71f4e497"><enum>(c)</enum><header>State use of

			 funds</header><text>Each State educational agency that receives a grant under

			 this section shall use—</text>

					<paragraph id="ID835bebf1e7c045faa92daec82272cae7"><enum>(1)</enum><text>not more than 20

			 percent of the grant funds for the purpose of—</text>

						<subparagraph id="ID19510ae9d9644590a2cf1e1be1014b15"><enum>(A)</enum><text>increasing the

			 capacity of, or creating, State databases to collect, disaggregate, and report

			 information related to student achievement, enrollment, and graduation rates

			 for assessment and accountability purposes; and</text>

						</subparagraph><subparagraph id="ID425820171a7547159d02cc3a431d0102"><enum>(B)</enum><text>reporting, on an

			 annual basis, for the elementary schools and secondary schools within the

			 State, on—</text>

							<clause id="IDcac13859d0d64c6e8d762ea04e76e3be"><enum>(i)</enum><text>the

			 enrollment data from the beginning of the academic year;</text>

							</clause><clause id="ID6cb7a8207e764ee28898c6f30d9d5e6d"><enum>(ii)</enum><text>the enrollment

			 data from the end of the academic year; and</text>

							</clause><clause id="IDe12e88ac79ec44f3b3b6003b04f5e6b5"><enum>(iii)</enum><text>the twelfth

			 grade graduation rates; and</text>

							</clause></subparagraph></paragraph><paragraph id="ID66cd1e57dd334553a2781b814083e74e"><enum>(2)</enum><text>not less than 80

			 percent of the grant funds to award subgrants to local educational agencies

			 within the State to enable the local educational agencies to carry out the

			 authorized activities described in subsection (e).</text>

					</paragraph></subsection><subsection id="ID1e2b58b045ec4e08996df04cb6c0f7bd"><enum>(d)</enum><header>Local

			 application</header><text>Each local educational agency desiring a subgrant

			 under this section shall submit an application to the State educational agency

			 at such time, in such manner, and containing such information as the State

			 educational agency may require. Each such application shall include, at a

			 minimum, a demonstration of the local educational agency's ability to put a

			 longitudinal data system in place.</text>

				</subsection><subsection id="ID8d41e02582944990884b1d4fe65f58f8"><enum>(e)</enum><header>Local

			 authorized activities</header><text>Each local educational agency that receives

			 a subgrant under this section shall use the subgrant funds to increase the

			 capacity of the local educational agency to upgrade or manage longitudinal data

			 systems consistent with the uses in subsection (c)(1), by—</text>

					<paragraph id="IDc0ab17b234c447128d071637fc3cfdc5"><enum>(1)</enum><text>purchasing

			 database software or hardware;</text>

					</paragraph><paragraph id="ID04a7b732cf70489bad28735aa831676e"><enum>(2)</enum><text>hiring additional

			 staff for the purpose of managing such data;</text>

					</paragraph><paragraph id="ID587d97b059f14d7c928e1dcab881dcb4"><enum>(3)</enum><text>providing

			 professional development or additional training for such staff; and</text>

					</paragraph><paragraph id="IDc8e420827438466597da27b8d33e461d"><enum>(4)</enum><text>providing

			 professional development or training for principals and teachers on how to

			 effectively use such data to implement instructional strategies to improve

			 student achievement and graduation rates.</text>

					</paragraph></subsection><subsection id="ID07a760f271294ba4848704a36ccddb40"><enum>(f)</enum><header>Definitions</header><text>In

			 this section:</text>

					<paragraph id="ID4655d7a13a174450ad4ffb9361ac59a1"><enum>(1)</enum><header>Graduation

			 rate</header><text>The term <term>graduation rate</term> means the percentage

			 that—</text>

						<subparagraph id="IDea7dae19959e4f13a5c9cc06eff51d95"><enum>(A)</enum><text>the total number

			 of students who—</text>

							<clause id="ID0bf5d1b9739a4797ac2628ca7aae56d8"><enum>(i)</enum><text>graduate from a

			 secondary school with a regular diploma (which shall not include the recognized

			 equivalent of a secondary school diploma or an alternative degree) in an

			 academic year; and</text>

							</clause><clause id="ID3a21d1a8712447368f543c9d8cea4ded"><enum>(ii)</enum><text>graduated on

			 time by progressing 1 grade per academic year; represents of</text>

							</clause></subparagraph><subparagraph id="ID3cde23065129401c9de94f3e6438be38"><enum>(B)</enum><text>the total number

			 of students who entered the secondary school in the entry level academic year

			 applicable to the graduating students.</text>

						</subparagraph></paragraph><paragraph id="ID0c1c43e2b08a497aae3dcedbd1292347"><enum>(2)</enum><header>Secretary</header><text>The

			 term <term>Secretary</term> means the Secretary of Education.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2732a720480b4b4491526179bdc3a26a"><enum>(3)</enum><header>State

			 educational agency and local educational agency</header><text display-inline="yes-display-inline">The terms <term>State educational

			 agency</term> and <term>local educational agency</term> have the meanings given

			 such terms in section 9101 of the Elementary and Secondary Education Act of

			 1965 (20 U.S.C. 7801).</text>

					</paragraph></subsection><subsection id="ID12be43ca376748d7a62504aae77618e4"><enum>(g)</enum><header>Authorization

			 of appropriations</header><text>There are authorized to be appropriated to

			 carry out this section $100,000,000 for fiscal year 2006, and such sums as may

			 be necessary for each of the 2 succeeding fiscal years.</text>

				</subsection></section><section id="ID8585aa8c651740b1a11e51370869ac21"><enum>502.</enum><header>Grants for

			 assessment of children with disabilities and children who are limited English

			 proficient</header>

				<subsection id="ID54619ddd470b44d0b6d2b71d8bdc7144"><enum>(a)</enum><header>Grants for

			 assessment of children with disabilities and children who are limited English

			 proficient</header><text>Part E of title I of the Elementary and Secondary

			 Education Act of 1965 (20 U.S.C. 6491 et seq.) is amended by adding at the end

			 the following:</text>

					<quoted-block display-inline="no-display-inline" id="id641CD9E73B18461893EC32A685A060B0" style="OLC">

						<section id="ID20a28a201a814de483738f560e17053b"><enum>1505.</enum><header>Grants for

				assessment of children with disabilities and children who are limited English

				proficient</header>

							<subsection id="ID721893844eb94179ad6a058ec9619fee"><enum>(a)</enum><header>Grants

				authorized</header><text>From amounts authorized to be appropriated under

				subsection (e) for a fiscal year, the Secretary shall award grants, on a

				competitive basis, to State educational agencies, or to consortia of State

				educational agencies, to enable the State educational agencies or consortia to

				collaborate with institutions of higher education, research institutions, or

				other organizations—</text>

								<paragraph id="IDfdaa6a1507a54aadbfd61408231e9fba"><enum>(1)</enum><text>to design and

				improve State academic assessments for students who are limited English

				proficient and students with disabilities; and</text>

								</paragraph><paragraph id="IDb169ef3ea91a4732bc667f05c1f169f3"><enum>(2)</enum><text>to ensure the

				most accurate, valid, and reliable means to assess academic content standards

				and student academic achievement standards for students who are limited English

				proficient and students with disabilities.</text>

								</paragraph></subsection><subsection id="IDd7b2f52b9f4345c3a87a4d1338528f37"><enum>(b)</enum><header>Authorized

				activities</header><text>A State educational agency or consortium that receives

				a grant under this section shall use the grant funds to carry out 1 or more of

				the following activities:</text>

								<paragraph id="ID1dacea785f054f61a08052945d630683"><enum>(1)</enum><text>Developing

				alternate assessments for students with disabilities, consistent with section

				1111 and the amendments made on December 9, 2003, to part 200 of title 34, Code

				of Federal Regulations (68 Fed. Reg. 68698) (relating to accountability for the

				academic achievement of students with the most significant cognitive

				disabilities), including—</text>

									<subparagraph id="ID7901ac4887b94c95b20382b50b886db4"><enum>(A)</enum><text>the alignment of

				such assessments, as appropriate and consistent with such amendments,

				with—</text>

										<clause id="IDca435f8c8b5147d191af221bf0fcf4ed"><enum>(i)</enum><text>State student

				academic achievement standards and State academic content standards for all

				students; or</text>

										</clause><clause id="IDa7c629c35f3a49eabafa45cd16997ed3"><enum>(ii)</enum><text>alternate State

				student academic achievement standards that reflect the intended instructional

				construct for students with disabilities;</text>

										</clause></subparagraph><subparagraph id="ID667d22bde3724684bd345a6ad7a76135"><enum>(B)</enum><text>activities to

				ensure that such assessments do not reflect the disabilities, or associated

				characteristics, of the students that are extraneous to the intent of the

				measurement;</text>

									</subparagraph><subparagraph id="ID1f633313b7e14b1480955db0697a6abb"><enum>(C)</enum><text>the development

				of an implementation plan for pilot tests for such assessments, in order to

				determine the level of appropriateness and feasibility of full-scale

				administration; and</text>

									</subparagraph><subparagraph id="ID4ee6022ba2bb4eb692de60e6fb49354d"><enum>(D)</enum><text>activities that

				provide for the retention of all feasible standardized features in the

				alternate assessments.</text>

									</subparagraph></paragraph><paragraph id="ID538e0ec14ec84e0dbe2510b633b36cfb"><enum>(2)</enum><text>Developing

				alternate assessments that meet the requirements of section 1111 for students

				who are limited English proficient, including—</text>

									<subparagraph id="ID2e95573fcdd14a73b7f650fbee77fc1c"><enum>(A)</enum><text>the alignment of

				such assessments with State student academic achievement standards and State

				academic content standards for all students;</text>

									</subparagraph><subparagraph id="IDdcfb966e9b8d4951bf3567da5a06a3b7"><enum>(B)</enum><text>the development

				of parallel native language assessments or linguistically modified assessments

				for limited English proficient students that meet the requirements of section

				1111(b)(3)(C)(ix)(III);</text>

									</subparagraph><subparagraph id="ID7cc687a99e384a408187d1a476c29ea0"><enum>(C)</enum><text>the development

				of an implementation plan for pilot tests for such assessments, in order to

				determine the level of appropriateness and feasibility of full-scale

				administration; and</text>

									</subparagraph><subparagraph id="ID982b6473e3b440a5aefd42cef87228e4"><enum>(D)</enum><text>activities that

				provide for the retention of all feasible standardized features in the

				alternate assessments.</text>

									</subparagraph></paragraph><paragraph id="IDa37c41e5f7b84f53a12c29eafad97783"><enum>(3)</enum><text>Developing,

				modifying, or revising State policies and criteria for appropriate

				accommodations to ensure the full participation of students who are limited

				English proficient and students with disabilities in State academic

				assessments, including—</text>

									<subparagraph id="IDa3616de543034714afb578ea792df809"><enum>(A)</enum><text>developing a plan

				to ensure that assessments provided with accommodations are fully included and

				integrated into the accountability system, for the purpose of making the

				determinations of adequate yearly progress required under section 1116;</text>

									</subparagraph><subparagraph id="ID6fc6181340844fcabfd02316f1e41fa0"><enum>(B)</enum><text>ensuring the

				validity, reliability, and appropriateness of such accommodations, such

				as—</text>

										<clause id="IDf1c43603488e476db09164fb5db9ad03"><enum>(i)</enum><text>a

				modification to the presentation or format of the assessment;</text>

										</clause><clause id="ID412a725e16dc47b4b308602d9d779d8d"><enum>(ii)</enum><text>the use of

				assistive devices;</text>

										</clause><clause id="IDfdac7fec288e4b6988cffe689d1b9b62"><enum>(iii)</enum><text>an extension of

				the time allowed for testing;</text>

										</clause><clause id="ID4f57ad64fc8e4854b920bd92544ac67f"><enum>(iv)</enum><text>an alteration of

				the test setting or procedures;</text>

										</clause><clause id="IDf8cc1343f5164c39a3b2f9cda1ea0704"><enum>(v)</enum><text>the

				administration of portions of the test in a method appropriate for the level of

				language proficiency of the test taker;</text>

										</clause><clause id="ID8f3a13ebc7e94c82b7cfe435f3b99a26"><enum>(vi)</enum><text>the use of a

				glossary or dictionary; and</text>

										</clause><clause id="IDc719ad1cf77a4f46a32639f6717829d7"><enum>(vii)</enum><text>the use of a

				linguistically modified assessment;</text>

										</clause></subparagraph><subparagraph id="ID30f7558286ee4b4ab49cfb01143dbb77"><enum>(C)</enum><text>ensuring that

				State policies and criteria for appropriate accommodations take into account

				the form or program of instruction provided to students, including the level of

				difficulty, reliability, cultural difference, and content equivalence of such

				form or program;</text>

									</subparagraph><subparagraph id="IDdfafa949118f4c728d310599779296a7"><enum>(D)</enum><text>ensuring that

				such policies are consistent with the standards prepared by the Joint Committee

				on Standards for Educational and Psychological Testing of the American

				Educational Research Association, the American Psychological Association, and

				the National Council on Measurement in Education; and</text>

									</subparagraph><subparagraph id="ID55de807c110945a385374c57eef50b32"><enum>(E)</enum><text>developing a plan

				for providing training on the use of accommodations to school instructional

				staff, families, students, and other appropriate parties.</text>

									</subparagraph></paragraph><paragraph id="IDade5bc46b2dd487abb8d93ba229e82fd"><enum>(4)</enum><text>Developing

				universally designed assessments that can be accessible to all students,

				including—</text>

									<subparagraph id="ID867dc6a17d664ef2a2f459e1da310ed6"><enum>(A)</enum><text>examining test

				item or test performance for students with disabilities and students who are

				limited English proficient, to determine the extent to which the test item or

				test is universally designed;</text>

									</subparagraph><subparagraph id="ID1b02adb4c35c49508c72c5677e57dbaa"><enum>(B)</enum><text>using think aloud

				and cognitive laboratory procedures, as well as item statistics, to identify

				test items that may pose particular problems for students with disabilities or

				students who are limited English proficient;</text>

									</subparagraph><subparagraph id="ID7095031a3d214f6e989599907d103df8"><enum>(C)</enum><text>developing and

				implementing a plan to ensure that developers and reviewers of test items are

				trained in the principles of universal design; and</text>

									</subparagraph><subparagraph id="ID70a29a9692034994b18328bfd332e91a"><enum>(D)</enum><text>developing

				computer-based applications of universal design principles.</text>

									</subparagraph></paragraph></subsection><subsection id="IDc285083fd56443ecb32d61acc715e882"><enum>(c)</enum><header>Application</header><text>Each

				State educational agency, or consortium of State educational agencies, desiring

				to apply for a grant under this section shall submit an application to the

				Secretary at such time, in such manner, and containing such information as the

				Secretary may require, including—</text>

								<paragraph id="ID5dd1b8e5d6c746f682286150045fa96d"><enum>(1)</enum><text>information

				regarding the institutions of higher education, research institutions, or other

				organizations that are collaborating with the State educational agency or

				consortium, in accordance with subsection (a);</text>

								</paragraph><paragraph id="IDcb1c849f664d439f881cb8598fb8e1ad"><enum>(2)</enum><text>in the case of a

				consortium of State educational agencies, the designation of 1 State

				educational agency as the fiscal agent for the receipt of grant funds;</text>

								</paragraph><paragraph id="IDad874847c2ca41ffb349d8a9ac4601c9"><enum>(3)</enum><text>a description of

				the process and criteria by which the State educational agency will identify

				students that are unable to participate in general State content assessments

				and are eligible to take alternate assessments, consistent with the amendments

				made to part 200 of title 34, Code of Federal Regulations (68 Fed. Reg.

				68698);</text>

								</paragraph><paragraph id="IDd81794f126b44221b66a96db858e43c4"><enum>(4)</enum><text>in the case of a

				State educational agency or consortium carrying out the activity described in

				subsection (b)(1)(A), a description of how the State educational agency plans

				to fulfill the requirement of subsection (b)(1)(A);</text>

								</paragraph><paragraph id="ID43cddf2ff9c345be925c644c125312d0"><enum>(5)</enum><text>in the case of a

				State educational agency or consortium carrying out the activities described in

				paragraphs (1), (2), and (4) of subsection (b), information regarding the

				proposed techniques for the development of alternate assessments, including a

				description of the technical adequacy of, technical aspects of, and scoring for

				such assessments;</text>

								</paragraph><paragraph id="IDc16c7a6fdaa1486d919379979569510d"><enum>(6)</enum><text>a plan for

				providing training for school instructional staff, families, students, and

				other appropriate parties on the use of alternate assessments; and</text>

								</paragraph><paragraph id="ID83be9ee36f614e619b5b30faacc057ce"><enum>(7)</enum><text>information on

				how the scores of students participating in alternate assessments will be

				reported to the public and to parents.</text>

								</paragraph></subsection><subsection id="ID792a3e8fcf3a45c283fd549b2ec490c0"><enum>(d)</enum><header>Evaluation and

				reporting requirements</header><text>Each State educational agency receiving a

				grant under this section shall submit an annual report to the Secretary

				describing the activities carried out under the grant and the result of such

				activities, including—</text>

								<paragraph id="ID8b86fdea846d42d498ab6111c364f7d9"><enum>(1)</enum><text>details on the

				effectiveness of the activities supported under this section in helping

				students with disabilities, or students who are limited English proficient,

				better participate in State assessment programs; and</text>

								</paragraph><paragraph id="IDc229ee0e8d2549e3b94aa83f5dc2de0f"><enum>(2)</enum><text>information on

				the change in achievement, if any, of students with disabilities and students

				who are limited English proficient, as a result of a more accurate assessment

				of such students.</text>

								</paragraph></subsection><subsection id="ID4108b6f0b161488989c7a36323fb2800"><enum>(e)</enum><header>Authorization

				of appropriations</header><text>There are authorized to be appropriated to

				carry out this section $50,000,000 for fiscal year 2006, and such sums as may

				be necessary for each of the 2 succeeding fiscal years.</text>

			 subsections (a) and (b) as subsections (b) and (c), respectively; and</text>

			 before subsection (b) (as redesignated by paragraph (1)) the following:</text>

			 Senate</header>

				<subsection id="ID8f94b98d0c53474e882760e2589befb5"><enum>(a)</enum><header>Findings</header><text>The

			 Senate finds the following:</text>

					<paragraph id="IDf6d514aac00047eca2af9a521c2df07f"><enum>(1)</enum><text>Congress enacted,

			 with bipartisan support, and the President signed into law the No Child Left

			 Behind Act of 2001 (Public Law 107–210; 115 Stat. 1425), that reauthorized the

			 Elementary and Secondary Education Act of 1965 (20 U.S.C. 6301 et seq.). The

			 new law required States to set high standards for learning and required schools

			 to implement reforms to help improve student achievement. In return, Congress

			 and the President pledged to make sure schools would have resources to carry

			 out the reforms as called for in the new law.</text>

					</paragraph><paragraph id="ID4855c95148cf408fbf58d4f431a74c45"><enum>(2)</enum><text>$22,750,000,000

			 is needed to fund part A of title I of the Elementary and Secondary Education

			 Act of 1965 (20 U.S.C. 6311 et seq.) in fiscal year 2006, as promised pursuant

			 to the No Child Left Behind Act of 2001 (Public Law 107–210; 115 Stat.

			 1425).</text>

			 roadmap for first generation college for students</header>

			<section id="ID5ceb6b8c991848b2a92f2cb6cc46d526"><enum>701.</enum><header>Expansion of

			 TRIO and GEARUP</header><text display-inline="no-display-inline">The Higher

			 Education Act of 1965 (20 U.S.C. 1001 et seq.) is amended—</text>

				<paragraph id="idDF60305690E3493C9138CCDE2B5B94E8"><enum>(1)</enum><text>in section

			 402A(f), by striking <quote>$700,000,000 for fiscal year 1999</quote> and

			 inserting <quote>$1,000,000,000 for fiscal year 2006</quote>; and</text>

			 section 404H and inserting the following:</text>

			 tuition relief for students and their families through Pell Grants</header>

			<section id="id703B998ED9234ECF96A3DA8BB130DBFD"><enum>801.</enum><header>Pell Grants

			 tax tables hold harmless</header>

				<subsection id="ID663090ea90424b4e8e82d4b239c39860"><enum></enum><text>Notwithstanding

			 any other provision of law, the annual updates to the allowance for State and

			 other taxes in the tables used in the Federal Need Analysis Methodology to

			 determine a student's expected family contribution for the award year 2005–2006

			 under part F of title IV of the Higher Education Act of 1965 (20 U.S.C. 1087kk

			 et seq.), published in the Federal Register on Thursday, December 23, 2004 (69

			 Fed. Reg. 76926), shall not apply to a student to the extent the updates will

			 reduce the amount of Federal student assistance for which the student is

			 eligible.</text>

				</subsection></section><section id="ID0994b88ad11e45759563f7b3a9ecbc17"><enum>802.</enum><header>Sense of the

			 Senate regarding increasing the maximum Pell Grant</header>

				<subsection id="ID408ac6aec63f41808496bb47b7e7cee9"><enum>(a)</enum><header>Findings</header><text>The

			 Senate makes the following findings:</text>

					<paragraph id="ID0d0acbdf3e7947458cbf368d072c1be6"><enum>(1)</enum><text>Increasing the

			 percentage of individuals who obtain a postsecondary education has become

			 increasingly important, not just to the individual beneficiary, but to the

			 Nation as a whole. The growth and continued expansion of the Nation's economy

			 is heavily dependent on an educated and highly skilled workforce.</text>

					</paragraph><paragraph id="ID3720b9a8649f499a9469bdd22aa1652b"><enum>(2)</enum><text>The opportunity

			 to gain a postsecondary education also is important to the Nation as a means to

			 help advance the American ideals of progress and equality.</text>

					</paragraph><paragraph id="ID71d2aad457c94373a6228659b6c3da47"><enum>(3)</enum><text>The Federal

			 Government plays an invaluable role in making student financial aid available

			 to ensure that qualified students are able to attend college, regardless of

			 their financial means. Since the inception of the Pell Grant program in 1973,

			 nearly 80,000,000 grants have helped low- and middle-income students go to

			 college, enrich their lives, and become productive members of society.</text>

					</paragraph><paragraph id="ID08a75896239145e688f89d437180be3a"><enum>(4)</enum><text>Nationwide,

			 almost 63 percent of secondary school graduates continue on to higher education

			 immediately after completing secondary school. This degree of college

			 participation would not exist without the Federal investment in student aid,

			 especially the Pell Grant program. More than 4,000,000 low- and middle-income

			 students receive Pell Grants; 95 percent of whom have a family income of not

			 more than $40,000.</text>

					</paragraph><paragraph id="IDce164188b75c4ea6a680a536fdb2ae13"><enum>(5)</enum><text>In the next 10

			 years, the number of undergraduate students enrolled in the Nation's colleges

			 and universities will increase by 15 percent to more than 15,000,000 students.

			 Many of these students will be the first in their families to attend college.

			 The continued investment in the Pell Grant program is essential if college is

			 to remain an achievable part of the American dream.</text>

					</paragraph><paragraph id="ID8fe1f2ad38f0460592d26803b00238db"><enum>(6)</enum><text>Increasing the

			 maximum Pell Grant to $5,100 would allow more than 430,000 additional students

			 to benefit from the program.</text>

					</paragraph><paragraph id="ID8c340421d7e042a0b2de05ed4ae3d4b5"><enum>(7)</enum><text>Increasing the

			 maximum Pell Grant to $5,100 would result in 200,000 new Pell Grant

			 recipients.</text>

					</paragraph><paragraph id="ID85ea5ce1e70d491a9d42cbaa2382ccd6"><enum>(8)</enum><text>Pell Grant

			 recipients are more likely to graduate with student loan debt and to amass more

			 debt than other student borrowers. Increasing the maximum Pell Grant to $5,100

			 will help remedy this disparity.</text>

					</paragraph></subsection><subsection id="id44590E5C67474A219E78A5815AE3A55A"><enum>(b)</enum><header>Sense of the

			 Senate</header><text>It is the sense of the Senate that—</text>

					<paragraph id="ID365ba8a74e314ad381d6c69a8703695e"><enum>(1)</enum><text>the maximum Pell

			 Grant should be increased to $5,100 during award year 2006–2007; and</text>

					</paragraph><paragraph id="ID8811090f704945d1b7d587828a2ea513"><enum>(2)</enum><text>the maximum Pell

			 Grant amount set by Congress should be the amount eligible students

			 receive.</text>

					</paragraph></subsection></section><section id="ID9882d283e190418082583376bf2c0094"><enum>803.</enum><header>Establishment

			 of a Pell demonstration program</header>

				<subsection id="ID1a51cc9aa65e4d94a26b5517949d141d"><enum>(a)</enum><header>Findings</header><text>Congress

			 finds that:</text>

					<paragraph id="ID7713bef6eb1c4c5b81915bd0e528d046"><enum>(1)</enum><text>A student remains

			 eligible to receive a Federal Pell Grant as long as the student is

			 income-eligible and has not received a bachelor's degree.</text>

					</paragraph><paragraph id="ID4955207fba8f43c9a2846cc46cc52ae6"><enum>(2)</enum><text>By encouraging

			 persistence and degree acquisition in a timely manner, the Federal Government,

			 in effect, saves money—</text>

						<subparagraph id="id22949ED8E24940258AEDBDC7D624A0A8"><enum>(A)</enum><text>by reducing the

			 courses that do not lead to a degree; and</text>

						</subparagraph><subparagraph id="id3A7EF35C99DA4FB58C2D0C45D2E8D026"><enum>(B)</enum><text>by helping

			 students get the financial benefits of a college degree as soon as

			 possible.</text>

						</subparagraph></paragraph></subsection><subsection id="ID04b1ee96952648119e5eb2efef50112f"><enum>(b)</enum><header>Pell

			 demonstration program</header>

					<paragraph id="idBDFA4B378B3C450EA0B48D59488B3DB3"><enum>(1)</enum><header>Authorization</header><text>The

			 Secretary of Education shall establish a demonstration program to facilitate

			 the ability of low-income students to complete the students' degree within 150

			 percent of the time expected to complete such degree.</text>

					</paragraph><paragraph id="id50FEB93AA584428CB4422024ABD690C2"><enum>(2)</enum><header>Grants</header><text>The

			 Secretary of Education shall award competitive grants to institutions of higher

			 education to enable students who are eligible to receive Federal Pell Grants

			 under subpart 1 of part A of title IV of the Higher Education Act of 1965 (20

			 U.S.C. 1070a et seq.) to enroll in courses in the summer at such institutions

			 to expedite the students' graduation from the institutions.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id35459B4D24EC4C2B91C03867B4E6F700"><enum>(3)</enum><header>Authorization

			 of appropriations</header><text>There is authorized to be appropriated to carry

			 out this subsection $500,000,000 for the period of fiscal years 2006 through

			 2008.</text>

			 college for mathematics, science, and special education teachers</header>

						<text>Any funds available to the Secretary of Education as a result of

			 reduced expenditures under

			 <external-xref legal-doc="act" parsable-cite="HEA65/438">section

			 438</external-xref> of the <act-name parsable-cite="HEA65">Higher Education Act

			 of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/1087-1">20 U.S.C. 1087–1</external-xref>) secured by the

			 enactment of subsection (a) shall first be used by the Secretary for loan

			 cancellation and loan forgiveness for teachers under sections 428J and 460 of

			 the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name>

			 (<external-xref legal-doc="usc" parsable-cite="usc/20/1078-10">20 U.S.C.

							<enum>(B)</enum>

							<header>Definition of nonprofit lender</header>

							<text>In this paragraph the term <term>nonprofit lender</term> means an

			 eligible lender (as defined in

			 <external-xref legal-doc="act" parsable-cite="HEA65/435(d)">section

			 435(d)</external-xref> of the <act-name parsable-cite="HEA65">Higher Education

			 Act of 1965</act-name> (20 U.S.C.1085(d)) that—</text>

							<clause id="IDA0F3D85B382E4D119E8EF8CC6AB2475B">

								<enum>(i)</enum>

								<text>is an organization described in section 501(c)(3) of the Internal

			 Revenue Code of 1986;</text>

							</clause><clause id="ID3091C04F5EB344EC994DA0448861B8F3">

								<enum>(ii)</enum>

								<text>is a nonprofit entity as defined by applicable State law;

			 and</text>

							</clause><clause id="ID106AAA385F9B4354A9AD8B6E5729B2B0">

								<enum>(iii)</enum>

								<text>meets the following requirements:</text>

								<subclause id="IDE4C94220D8E149DCBF5555C8E3E6711A">

									<enum>(I)</enum>

									<text>The nonprofit lender does not confer a salary or benefits to any

			 employee of the nonprofit lender in an amount that is in excess of the salary

			 and benefits provided to the Secretary of Education by the Department of

			 Education.</text>

								</subclause><subclause id="IDDAB472639AEB416FAA740D9A0715A90A">

									<enum>(II)</enum>

									<text>The nonprofit lender does not maintain an ongoing relationship

			 whereby the nonprofit lender passes on revenue directly or indirectly through

			 lease, securitization, resale, or any other financial instrument to a

			 for-profit entity or to shareholders.</text>

								</subclause><subclause id="IDA771533940184848B569665E385E0BBE">

									<enum>(III)</enum>

									<text>The nonprofit lender does not offer benefits to a borrower in a

			 manner directly or indirectly predicated on such borrower’s

			 participation—</text>

										<text>in a program under part B or D of title IV of the

			 <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name>

			 1071</external-xref> et seq., 1087a et seq.); or</text>

									</item><item id="ID5CA7DB90925A48BF999ADF2BC885EC2D">

										<enum>(bb)</enum>

										<text>with any particular lender.</text>

									</item></subclause><subclause id="ID3DDA1669B6DB4ACBB8BE60BA9A8C50E6">

									<enum>(IV)</enum>

									<text>The nonprofit lender certifies that the nonprofit lender uses the

			 payment received pursuant to subparagraph (A) to confer grant or scholarship

			 benefits to students who are eligible to receive Federal Pell Grants under

			 subpart 1 of part A of title IV of the <act-name parsable-cite="HEA65">Higher

			 Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/1070a">20 U.S.C. 1070a</external-xref> et seq.).</text>

								</subclause><subclause id="IDD08795B1991D49E39D3FA0A273FF3AFB">

									<enum>(V)</enum>

									<text>The nonprofit lender is subject to public oversight through

			 either a State charter, or through not less than 50 percent of the nonprofit

			 lender’s board of directors consisting of State appointed

			 representatives.</text>

								</subclause><subclause commented="no" display-inline="no-display-inline" id="ID1ED5630F4EEB4254BE9A3E6F4C166D4B"><enum>(VI)</enum><text>The nonprofit

			 lender does not engage in the marketing of the relative value of programs under

			 part B of title IV of the <act-name parsable-cite="HEA65">Higher Education Act

			 of 1965</act-name> as compared to programs under part D of title IV of the

			 <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name>, nor

			 does the nonprofit lender engage in the marketing of loans or programs offered

			 by for-profit lenders. This subclause shall not be construed to prohibit the

			 nonprofit lender from conferring basic information on lenders under part B of

			 title IV of the <act-name parsable-cite="HEA65">Higher Education Act of

			 1965</act-name> and the related benefits offered by such nonprofit

			 lenders.</text>

			 Code of 1986 (relating to deduction for qualified tuition and related expenses)

				any amount as adjusted under clause (i) is not a multiple of $50, such amount

				shall be rounded to the nearest multiple of $50.</text>

									</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

				</subsection><subsection id="IDab3b4ad0dc1946048acc6931bf44b733"><enum>(b)</enum><header>Qualified

			 tuition and related expenses of eligible students</header>

					<paragraph id="ID2702aa6c75d34b01ac57fb0f664288fd"><enum>(1)</enum><header>In

			 general</header><text>Section 222(a) of the Internal Revenue Code of 1986

			 (relating to allowance of deduction) is amended by inserting <quote>of eligible

			 students</quote> after <quote>expenses</quote>.</text>

					</paragraph><paragraph id="ID03f2b82c0acc4f4ba35cd619627841f2"><enum>(2)</enum><header>Definition of

			 eligible student</header><text>Section 222(d) of such Code (relating to

			 definitions and special rules) is amended by redesignating paragraphs (2)

			 through (6) as paragraphs (3) through (7), respectively, and by inserting after

			 paragraph (1) the following new paragraph:</text>

			 permanent</header><text>Title IX of the Economic Growth and Tax Relief

			 Reconciliation Act of 2001 (relating to sunset of provisions of such Act) shall

			 not apply to the amendments made by section 431 of such Act.</text>

				</subsection><subsection id="ID720fc35ce7f94aea956357828dab9797"><enum>(d)</enum><header>Effective

			 date</header><text>The amendments made by this section shall apply to payments

			 made in taxable years beginning after December 31, 2004.</text>

				</subsection></section><section id="ID7085719c56004e969d3742430b1b7127"><enum>1002.</enum><header>Credit for

			 interest on higher education loans</header>

				<subsection id="IDf0d0425aecd241d08c4ebe06ae1749f7"><enum>(a)</enum><header>In

			 general</header><text>Subpart A of part IV of subchapter A of chapter 1 of the

			 Internal Revenue Code of 1986 (relating to nonrefundable personal credits) is

			 amended by inserting after section 25B the following new section:</text>

					<quoted-block display-inline="no-display-inline" id="id09E578CF27EB4B7599B724614DCFCBE1" style="OLC">

						<section id="IDdc20378e05994a969b7c9837ca01e449"><enum>25C.<?LEXA-Enum 25C.?></enum><header>Interest on higher education loans</header>

							<subsection id="ID0ef962694a3f4b0c89b9a377ee8048d6"><enum>(a)</enum><header>Allowance of

				credit</header><text>In the case of an individual, there shall be allowed as a

				credit against the tax imposed by this chapter for the taxable year an amount

				equal to the interest paid by the taxpayer during the taxable year on any

				qualified education loan.</text>

							</subsection><subsection id="ID3094bf375104488e8f27b862afd38e40"><enum>(b)</enum><header>Maximum

				credit</header>

								<paragraph id="ID4e4fb1e4dffd4ffd8e72359f231ebba5"><enum>(1)</enum><header>In

				general</header><text>Except as provided in paragraph (2), the credit allowed

				by subsection (a) for the taxable year shall not exceed $1,500.</text>

								</paragraph><paragraph id="ID52bc9fa1ee214ac697be364b00a402a9"><enum>(2)</enum><header>Limitation

				based on modified adjusted gross income</header>

									<subparagraph id="ID9db6c1a2e19746469edbc27815ffd3ce"><enum>(A)</enum><header>In

				general</header><text>If the modified adjusted gross income of the taxpayer for

				the taxable year exceeds $50,000 ($100,000 in the case of a joint return), the

				amount which would (but for this paragraph) be allowable as a credit under this

				section shall be reduced (but not below zero) by the amount which bears the

				same ratio to the amount which would be so allowable as such excess bears to

				$20,000 ($40,000 in the case of a joint return).</text>

									</subparagraph><subparagraph id="ID4150dd2392614bffb0b63faded7fe644"><enum>(B)</enum><header>Modified

				adjusted gross income</header><text>The term <term>modified adjusted gross

				income</term> means adjusted gross income determined without regard to sections

				199, 222, 911, 931, and 933.</text>

									</subparagraph><subparagraph id="ID4811b8f4eee24e3ba14332095ae6e894"><enum>(C)</enum><header>Inflation

				adjustment</header><text>In the case of any taxable year beginning after 2005,

				the $50,000 and $100,000 amounts referred to in subparagraph (A) shall be

				increased by an amount equal to—</text>

										<clause id="IDd048c4f11e3443e1adf28e6f4cdd7fbd"><enum>(i)</enum><text>such dollar

				amount, multiplied by</text>

										</clause><clause id="ID522fe52f8bc949c19e6c7d9756768df9"><enum>(ii)</enum><text>the

				cost-of-living adjustment determined under section 1(f)(3) for the calendar

				year in which the taxable year begins, by substituting <quote>2004</quote> for

				<quote>1992</quote>.</text>

										</clause></subparagraph><subparagraph id="ID1b82a5f9ba5c4bcc9be26668ac699a8d"><enum>(D)</enum><header>Rounding</header><text>If

				any amount as adjusted under subparagraph (C) is not a multiple of $50, such

				amount shall be rounded to the nearest multiple of $50.</text>

									</subparagraph></paragraph></subsection><subsection id="IDa08caa0f956a469cb51127d222a5a75f"><enum>(c)</enum><header>Dependents not

				eligible for credit</header><text>No credit shall be allowed by this section to

				an individual for the taxable year if a deduction under section 151 with

				respect to such individual is allowed to another taxpayer for the taxable year

				beginning in the calendar year in which such individual's taxable year

				begins.</text>

							</subsection><subsection id="ID6329b7021d5f46c2a47b13711fa966e6"><enum>(d)</enum><header>Limit on period

				credit allowed</header><text>A credit shall be allowed under this section only

				with respect to interest paid on any qualified education loan during the first

				60 months (whether or not consecutive) in which interest payments are required.

				For purposes of this paragraph, any loan and all refinancings of such loan

				shall be treated as 1 loan.</text>

							</subsection><subsection id="IDb7115dc2f4f64b8bbb9fe573a32245a7"><enum>(e)</enum><header>Definitions</header><text>For

				purposes of this section—</text>

								<paragraph id="ID18334b2fa5b34502aff5b3900a42fb4c"><enum>(1)</enum><header>Qualified

				education loan</header><text>The term <term>qualified education loan</term> has

				the meaning given such term by section 221(d)(1).</text>

								</paragraph><paragraph id="ID4574a62b805e4bd493a106b4982d52e5"><enum>(2)</enum><header>Dependent</header><text>The

				term <term>dependent</term> has the meaning given such term by section

				152.</text>

								</paragraph></subsection><subsection id="IDec3dec3eb0ae4b8ea2092c6e9c76561e"><enum>(f)</enum><header>Special

				rules</header>

								<paragraph id="ID944245bd89034beb8f3b44fa50c25106"><enum>(1)</enum><header>Denial of

				double benefit</header><text>No credit shall be allowed under this section for

				any amount taken into account for any deduction under any other provision of

				this chapter.</text>

								</paragraph><paragraph id="IDad2bedd8ebc74fa0abde2fa9872e1fa5"><enum>(2)</enum><header>Married couples

				must file joint return</header><text>If the taxpayer is married at the close of

				the taxable year, the credit shall be allowed under subsection (a) only if the

				taxpayer and the taxpayer's spouse file a joint return for the taxable

				year.</text>

								</paragraph><paragraph id="ID82cd11dc1d28417b87b7e4ace924ea2b"><enum>(3)</enum><header>Marital

				status</header><text>Marital status shall be determined in accordance with

				section 7703.</text>

			 amendment</header><text>The table of sections for subpart A of part IV of

			 the date of the enactment of this Act, but only with respect to any loan

			 interest payment due after December 31, 2004.</text>
