		<official-title display="yes">To amend title XVIII of the Social Security

		  Act to enhance the access of Medicare beneficiaries who live in medically

		  underserved areas to critical primary and preventive health care benefits at

		  Federally qualified health centers.</official-title>

		<section commented="no" display-inline="no-display-inline" id="idC7466E79865446FCBEC0236A6DAFEE0E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Medicare Payment Adjustment To

			 Community Health Centers (PATCH) Act of 2005</short-title></quote>.</text>

		</section><section commented="no" display-inline="no-display-inline" id="H6A3E56A584094171BDD0DCB47EE687F7" section-type="subsequent-section"><enum>2.</enum><header>Delivery of

			 medicare-covered primary and preventive services at Federally qualified health

			 centers</header>

			<subsection commented="no" display-inline="no-display-inline" id="HEBC26B7FEEBF43BCBE25A4DD3612F3FA"><enum>(a)</enum><header>Coverage of

			 medicare-Covered ambulatory services by FQHCs</header><text display-inline="yes-display-inline">Section 1861(aa)(3) of the

			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.

			 1395x(aa)(3)) is amended to read as follows:</text>

				<quoted-block act-name="Social" display-inline="no-display-inline" id="H64DEF2114FB243DF99D18CD8B5EE1FD2" style="OLC">

					<paragraph commented="no" display-inline="no-display-inline" id="HA425638B9A2546FDBF475623D18B53FC" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">The term <term>Federally qualified health

				center services</term> means—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="HDFAAB4949607492CA2B48950C1D3CF03"><enum>(A)</enum><text display-inline="yes-display-inline">services of the type described in

				subparagraphs (A) through (C) of paragraph (1), and such other services

				furnished by a Federally qualified health center for which payment may

				otherwise be made under this title if such services were furnished by a health

				care provider or health care professional other than a Federally qualified

				health center; and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H43D17381FC964344BEDB619CF757A2FE"><enum>(B)</enum><text display-inline="yes-display-inline">preventive primary health services that a

				center is required to provide under section 330 of the

				<act-name parsable-cite="PHSA">Public Health Service Act</act-name>,</text>

						</subparagraph></paragraph><quoted-block-continuation-text quoted-block-continuation-text-level="section">when

				furnished to an individual as a patient of a Federally qualified health center

				and such services when provided by a health care provider or health care

				professional employed by or under contract with a Federally qualified health

				center shall be treated as billable visits for purposes of payment to the

				Federally qualified health

				center.</quoted-block-continuation-text><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="H93D784A8C833407B92C4A0784009011"><enum>(b)</enum><header>Ensuring FQHC

			 reimbursement for patients of hospitals and critical access hospitals under the

			 hospital prospective payment system</header><text display-inline="yes-display-inline">Section 1862(a)(14) of the

			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.

			 1395y(a)) is amended by inserting <quote>Federally qualified health center

			 services,</quote> after <quote>qualified psychologist services,</quote>.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="H493460E5762A4149BC25DAE436516B8"><enum>(c)</enum><header>Technical

			 corrections</header><text display-inline="yes-display-inline">Clauses (i) and

			 (ii)(II) of section 1861(aa)(4)(A) of the <act-name parsable-cite="SSA">Social

			 Security Act</act-name> (42 U.S.C. 1395x(aa)(4)(A)) are each amended by

			 striking <quote>(other than subsection (h))</quote>.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="H40443CBA534F492396B5CB62523C00E9"><enum>(d)</enum><header>Effective

			 dates</header><text display-inline="yes-display-inline">The amendments

			 made—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="HC33F133F33874C0B9B9B29F5C82B401"><enum>(1)</enum><text display-inline="yes-display-inline">by subsections (a) and (b) shall apply to

			 services furnished on or after January 1, 2006; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H852892819A5C4921834D96DA7FB5565D"><enum>(2)</enum><text display-inline="yes-display-inline">by subsection (c) shall take effect as if

			 included in the enactment of the Health Centers Consolidation Act of 1996

			 (Public Law 104–299).</text>

				</paragraph></subsection></section></legis-body>
