			 <quote><short-title>Science Park Administration Act of

			 2005</short-title></quote>.</text>

		</section><section commented="no" display-inline="no-display-inline" id="IDC2498F8C7D9444678F6713DF4ECC8353" section-type="subsequent-section"><enum>2.</enum><header>Development of science

			 parks</header>

			<subsection commented="no" display-inline="no-display-inline" id="IDF4055883533E42F2BFE7ED257A9D898D"><enum>(a)</enum><header>Finding</header><text display-inline="yes-display-inline">Section 2 of the Stevenson-Wydler

			 Technology Innovation Act of 1980 (15 U.S.C. 3701) is amended by adding at the

			 end the following new paragraph:</text>

				<quoted-block display-inline="no-display-inline" id="ID344586B696A74A0990C0A32BEDC364A6" style="OLC">

					<paragraph commented="no" display-inline="no-display-inline" id="ID50934DF6C1864935BC3C9BD690AA8AFA"><enum>(12)</enum><text display-inline="yes-display-inline">It is in the best interests of the Nation

				to encourage the formation of science parks to promote the clustering of

				innovation through high technology

				activities.</text>

					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDDF88777ADAC045069B8843CCC60ACF4C"><enum>(b)</enum><header>Definition</header><text display-inline="yes-display-inline">Section 4 of such Act (15 U.S.C. 3703) is

			 amended by adding at the end the following new paragraphs:</text>

				<quoted-block display-inline="no-display-inline" id="ID9C944D21C3344D90A41DBC638E551CF1" style="OLC">

					<paragraph commented="no" display-inline="no-display-inline" id="IDBAADF0F248A04D23A4C1994C27A950FA"><enum>(14)</enum><text display-inline="yes-display-inline"><term>Science park</term> means a group of

				interrelated companies and institutions, including suppliers, service

				providers, institutions of higher education, start-up incubators, and trade

				associations that cooperate and compete and are located in a specific area

				whose administration promotes real estate development, technology transfer, and

				partnerships between such companies and institutions, and does not mean a

				business or industrial park.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id40BD632A5FB946E8B8DF5D9AE2A2229C"><enum>(15)</enum><text display-inline="yes-display-inline"><term>Business or industrial park</term>

				means primarily a for-profit real estate venture of businesses or industries

				which do not necessarily reinforce each other through supply chain or

				technology transfer mechanisms.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id935711E465C44923AB7A66D7CBA3450F"><enum>(16)</enum><text display-inline="yes-display-inline"><term>Science park infrastructure</term>

				means facilities that support the daily economic activity of a science

				park.</text>

					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID0E180D6BACBD4A83869B7294709FF9D5"><enum>(c)</enum><header>Promotion of

			 development of science parks</header><text display-inline="yes-display-inline">Section 5(c) of such Act (15 U.S.C.

			 3704(c)) is amended—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="IDD6CF8CDF0B38457D942CD41863641DA3"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (14), by striking

			 <quote>and</quote> at the end;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE94174FB9EC448F4B663915E78EEFBDD"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (15), by striking the period

			 at the end and inserting <quote>; and</quote>; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7CCEBBE792CD4AF89E1F0B421992B3AB"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following new

			 paragraph:</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID313C607074CE4811AB24E456C8689E99"><enum>(d)</enum><header>Science

			 parks</header><text display-inline="yes-display-inline">Such Act is further

			 amended by adding at the end the following new section:</text>

					<section commented="no" display-inline="no-display-inline" id="IDC87638FDF1D64442831284083042F71A" section-type="subsequent-section"><enum>24.</enum><header>Science

				parks</header>

						<subsection commented="no" display-inline="no-display-inline" id="IDB2AA80E238764141A94677B7BE80503F"><enum>(a)</enum><header>Development of

				plans for construction of science parks</header>

							<paragraph commented="no" display-inline="no-display-inline" id="ID919FA08EC85B414DB4051D9FBFEF1594"><enum>(1)</enum><header>In

				general</header><text display-inline="yes-display-inline">The Secretary shall

				award grants for the development of feasibility studies and plans for the

				construction of new or expansion of existing science parks.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1204818D8341470D929266DD301C7B25"><enum>(2)</enum><header>Limitation on

				amount of grants</header><text display-inline="yes-display-inline">The amount

				of a grant awarded under this subsection may not exceed $750,000.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE4505C9361064B468087758BCB512517"><enum>(3)</enum><header>Award</header>

								<subparagraph commented="no" display-inline="no-display-inline" id="ID7895F33D34DF4F03B456CDE7FE572E9E"><enum>(A)</enum><header>Competition

				required</header><text display-inline="yes-display-inline">The Secretary shall

				award any grant under this subsection pursuant to a full and open

				competition.</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID2A869B675C2E40598C2C49C8AAC104CB"><enum>(B)</enum><header>Advertising</header><text display-inline="yes-display-inline">The Secretary shall advertise any

				competition under this paragraph in the Commerce Business Daily.</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6F74232BC12C4FBF9895F701CD3D9DFE"><enum>(C)</enum><header>Selection

				criteria</header><text display-inline="yes-display-inline">The Secretary shall

				publish the criteria to be utilized in any competition under this paragraph for

				the selection of recipients of grants under this subsection. Such criteria

				shall include requirements relating to—</text>

									<clause commented="no" display-inline="no-display-inline" id="IDCD303BD8D4DA4D8D925808BB021F5656"><enum>(i)</enum><text display-inline="yes-display-inline">the number of jobs to be created at the

				science park each year for a period of 5 years;</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="IDBA282793AF9C41B4B0BECA37916A20B1"><enum>(ii)</enum><text display-inline="yes-display-inline">the funding to be required to construct or

				expand the science park over the first 5 years;</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="ID8DF46CAA9DD24A81AD8B878A65FA8BE3"><enum>(iii)</enum><text display-inline="yes-display-inline">the amount and type of cost matching by the

				applicant;</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="ID92EE6AE1D4674660A4C9AD2A0DE80A21"><enum>(iv)</enum><text display-inline="yes-display-inline">the types of businesses and research

				entities expected in the science park and surrounding community;</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="ID80E504792349453F8D108440EF395C7B"><enum>(v)</enum><text display-inline="yes-display-inline">letters of intent by businesses and

				research entities to locate in the science park;</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="ID6E55274A5BE14FDE88487F42F3C7A355"><enum>(vi)</enum><text display-inline="yes-display-inline">the capacity of the science park for

				expansion over a period of 25 years;</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="ID119C32EC316846D188735B98D227CBD0"><enum>(vii)</enum><text display-inline="yes-display-inline">the quality of life at the science park for

				employees at the science park;</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="IDC58D79EE8BC54715A8FF4CB31F111F37"><enum>(viii)</enum><text display-inline="yes-display-inline">the capability to attract a well trained

				workforce to the science park;</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="ID7E4B575FD5064D6DAEC2E60862D030EA"><enum>(ix)</enum><text display-inline="yes-display-inline">the management of the science park;</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="IDE30861BF175849B6B343BC3AC20E1993"><enum>(x)</enum><text display-inline="yes-display-inline">expected risks in the construction and

				operation of the science park;</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="IDB7D1ED7D51DA40CB878A1E142D9E1890"><enum>(xi)</enum><text display-inline="yes-display-inline">risk mitigation;</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="IDD9927B0776F64B3A9297872CF694CAFA"><enum>(xii)</enum><text display-inline="yes-display-inline">transportation and logistics;</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="ID493AE11700ED48FF9F73766843596D89"><enum>(xiii)</enum><text display-inline="yes-display-inline">physical infrastructure, including

				telecommunications; and</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="id6FFC9D9782B54F38A482ECB4178F9F5D"><enum>(xiv)</enum><text display-inline="yes-display-inline">ability to collaborate with other science

				parks throughout the world.</text>

									</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID791CE9A25B424FDD8E36CA8D9A5F875F"><enum>(4)</enum><header>Authorization

				of appropriations</header><text display-inline="yes-display-inline">There is

				authorized to be appropriated for each of fiscal years 2006 through 2011,

				$7,500,000 to carry out this subsection.</text>

							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID407C9677B74145ACAAA7967BF4E406FB"><enum>(b)</enum><header>Revolving loan

				Program for development of science park infrastructure</header>

							<paragraph commented="no" display-inline="no-display-inline" id="ID54D6F6669D204E54A2FB01C1638B731A"><enum>(1)</enum><header>In

				general</header><text display-inline="yes-display-inline">The Secretary shall

				make grants to six regional centers for the development of existing science

				park infrastructure through the operation of revolving loan funds by such

				centers.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5D949A390A9B412CB083FF6BBC98E33B"><enum>(2)</enum><header>Selection of

				centers</header>

								<subparagraph commented="no" display-inline="no-display-inline" id="IDA3700771305E466FA1AC7F2FCD424A36"><enum>(A)</enum><header>In

				general</header><text display-inline="yes-display-inline">The Secretary shall

				select the regional centers to be awarded grants under this subsection

				utilizing such criteria as the Secretary shall prescribe.</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDC720DBDD3E354D88ABDA912FD65E88B7"><enum>(B)</enum><header>Criteria</header><text display-inline="yes-display-inline">The criteria prescribed by the Secretary

				under this paragraph shall include criteria relating to revolving loan funds

				and revolving loan fund operators under paragraph (4), including—</text>

									<clause commented="no" display-inline="no-display-inline" id="ID8A3D54813C434AD0B84619FB5BCA4E18"><enum>(i)</enum><text display-inline="yes-display-inline">the qualifications of principal

				officers;</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="IDCD7F64E9309C42089A18D2735BBC5276"><enum>(ii)</enum><text display-inline="yes-display-inline">non-Federal cost matching requirements;

				and</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="ID0AE95C3AE6B545EE8F2A8B9A6BD94AF1"><enum>(iii)</enum><text display-inline="yes-display-inline">conditions for the termination of loan

				funds.</text>

									</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID13F1A96A86094E90B3F443E65628B898"><enum>(3)</enum><header>Limitation on

				loan amount</header><text display-inline="yes-display-inline">The amount of any

				loan for the development of existing science park infrastructure that is funded

				under this subsection may not exceed $3,000,000.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDF2964F07BA6D4B37930F92B1C8CF391A"><enum>(4)</enum><header>Revolving loan

				funds</header>

								<subparagraph commented="no" display-inline="no-display-inline" id="ID97C4867064B44872A90C98E942C04DBD"><enum>(A)</enum><header>In

				general</header><text display-inline="yes-display-inline">A regional center

				receiving a grant under this subsection shall fund the development of existing

				science park infrastructure through the utilization of a revolving loan

				fund.</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDA899310E3D79455290B9E5A168AF3B42"><enum>(B)</enum><header>Operation and

				integrity</header><text display-inline="yes-display-inline">The Secretary shall

				prescribe regulations to maintain the proper operation and financial integrity

				of revolving loan funds under this paragraph.</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDE747AFA8033A4BF0B6C5EB4F7A3E5375"><enum>(C)</enum><header>Efficient

				Administration</header><text display-inline="yes-display-inline">The Secretary

				may—</text>

									<clause commented="no" display-inline="no-display-inline" id="ID923AF5381E8041EB8B834AD49AFB85B2"><enum>(i)</enum><text display-inline="yes-display-inline">at the request of a grantee, amend and

				consolidate grant agreements governing revolving loan funds to provide

				flexibility with respect to lending areas and borrower criteria;</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="ID7EDDEED2801A4EEA9E63E468EC0BB635"><enum>(ii)</enum><text display-inline="yes-display-inline">assign or transfer assets of a revolving

				loan fund to a third party for the purpose of liquidation, and a third party

				may retain assets of the fund to defray costs related to liquidation;

				and</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="ID20168F92E12C4095B78ECDA9C534F6B3"><enum>(iii)</enum><text display-inline="yes-display-inline">take such actions as are appropriate to

				enable revolving loan fund operators to sell or securitize loans (except that

				the actions may not include issuance of a Federal guaranty by the

				Secretary).</text>

									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID62F0CB5B014E4E25970D40FBAB717AFE"><enum>(D)</enum><header>Treatment of

				actions</header><text display-inline="yes-display-inline">An action taken by

				the Secretary under this paragraph with respect to a revolving loan fund shall

				not constitute a new obligation if all grant funds associated with the original

				grant award have been disbursed to the recipient.</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDAFCEB3D2F0C84A50BFE858B77AF07959"><enum>(E)</enum><header>Preservation of

				securities laws</header>

									<clause commented="no" display-inline="no-display-inline" id="ID58B81CA09C264899AAD47A885358F887"><enum>(i)</enum><header>Not treated as

				exempted securities</header><text display-inline="yes-display-inline">No

				securities issued pursuant to subparagraph (C)(iii) shall be treated as

				exempted securities for purposes of the <act-name parsable-cite="SA33">Securities Act of 1933</act-name> or the

				<act-name parsable-cite="SEA34">Securities Exchange Act of 1934</act-name>,

				unless exempted by rule or regulation of the Securities and Exchange

				Commission.</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="ID6E4CF73AFA4D499392DEB4F18A286F2C"><enum>(ii)</enum><header>Preservation</header><text display-inline="yes-display-inline">Except as provided in clause (i), no

				provision of this paragraph or any regulation issued by the Secretary under

				this paragraph shall supersede or otherwise affect the application of the

				securities laws (as such term is defined in section 2(a)(47) of the

				<act-name parsable-cite="SEA34">Securities Exchange Act of 1934</act-name>) or

				the rules, regulations, or orders of the Securities and Exchange Commission or

				a self-regulatory organization thereunder.</text>

									</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6A1A7B506BA243EBB5B440DC8D34D516"><enum>(5)</enum><header>Authorization

				of appropriations</header><text display-inline="yes-display-inline">There is

				authorized to be appropriated for each of fiscal years 2006 through 2011,

				$60,000,000 to carry out this subsection.</text>

							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID92F113D3B3D4462E845C4632B46870CF"><enum>(c)</enum><header>Loan guarantees

				for science park infrastructure</header>

							<paragraph commented="no" display-inline="no-display-inline" id="ID38BA3C092E8A407EBE0898535C9D3D52"><enum>(1)</enum><header>In

				general</header><text display-inline="yes-display-inline">The Secretary shall

				guarantee up to 80 percent of the loan amount for loans exceeding $10,000,000

				for projects for the construction of science park infrastructure.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDBA3110582E524D2EBDFD07180EF624D8"><enum>(2)</enum><header>Limitations on

				guarantee amounts</header><text display-inline="yes-display-inline">The maximum

				amount of loan principal guaranteed under this subsection may not

				exceed—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="ID308698B1A4104A51A23C70D64E8350C8"><enum>(A)</enum><text display-inline="yes-display-inline">$50,000,000 with respect to any single

				project; and</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID96B3DB45BC6D4194ACC65CD19C3F3657"><enum>(B)</enum><text display-inline="yes-display-inline">$500,000,000 with respect to all

				projects.</text>

								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID73E20B5793A2426ABB5BCFA16EAB7060"><enum>(3)</enum><header>Selection of

				guarantee recipients</header><text display-inline="yes-display-inline">The

				Secretary shall select recipients of loan guarantees under this subsection

				based upon the ability of the recipient to collateralize the loan amount

				through bonds, equity, property, and other such criteria as the Secretary shall

				prescribe.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID01890abdbf05438da01c1284a182f81a"><enum>(4)</enum><header>Terms and

				conditions for loan guarantees</header><text display-inline="yes-display-inline">For purposes of this section, the loans

				guaranteed shall be subject to such terms and conditions as the Secretary may

				prescribe, except that—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="IDfee31dff6a544888bd6c77941fe8198b"><enum>(A)</enum><text display-inline="yes-display-inline">the final maturity of such loans made or

				guaranteed shall not exceed (as determined by the Secretary) the lesser

				of—</text>

									<clause commented="no" display-inline="no-display-inline" id="id5582A3A856CE41FBADE6E3E717BD7E95"><enum>(i)</enum><text display-inline="yes-display-inline">30 years and 32 days, or</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="idD9A1D41CAF184F1FA04C3E683FBA3292"><enum>(ii)</enum><text display-inline="yes-display-inline">90 percent of the useful life of any

				physical asset to be financed by such loan;</text>

									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID324f6dadc4cc45f4868e2c3b173cb563"><enum>(B)</enum><text display-inline="yes-display-inline">no loan made or guaranteed may be

				subordinated to another debt contracted by the borrower or to any other claims

				against the borrowers in the case of default;</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID42f0794decbf47b1a28280c81e0df20c"><enum>(C)</enum><text display-inline="yes-display-inline">no loan may be guaranteed unless the

				Secretary determines that the lender is responsible and that adequate provision

				is made for servicing the loan on reasonable terms and protecting the financial

				interest of the United States;</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDdfcc159235ad4291a50c26c79dda2815"><enum>(D)</enum><text display-inline="yes-display-inline">no loan may be guaranteed if the income

				from such loan is excluded from gross income for purposes of chapter 1 of the

				Internal Revenue Code of 1986, or if the guarantee provides significant

				collateral or security, as determined by the Secretary, for other obligations

				the income from which is so excluded;</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDc86745b4429347a39a043e73bb46abef"><enum>(E)</enum><text display-inline="yes-display-inline">any guarantee shall be conclusive evidence

				that said guarantee has been properly obtained, that the underlying loan

				qualified for such guarantee, and that, but for fraud or material

				misrepresentation by the holder, such guarantee shall be presumed to be valid,

				legal, and enforceable;</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDbcd7bd8e15d34ea09191789a3bc930f3"><enum>(F)</enum><text display-inline="yes-display-inline">the Secretary shall prescribe explicit

				standards for use in periodically assessing the credit risk of new and existing

				direct loans or guaranteed loans;</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idFC7206BB18DD4C67BC2FEC1B8C157B5D"><enum>(G)</enum><text display-inline="yes-display-inline">the Secretary must find that there is a

				reasonable assurance of repayment before extending credit assistance;

				and</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4800d0d2717b4cc0b5cb10fffb61bb0a"><enum>(H)</enum><text display-inline="yes-display-inline">new loan guarantees may not be committed

				except to the extent that appropriations of budget authority to cover their

				costs are made in advance, as required in section 504 of the Federal Credit

				Reform Act of 1990.</text>

								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID45d71b864a94472da4d49d21c443f8d1"><enum>(5)</enum><header>Payment of

				losses</header><text display-inline="yes-display-inline">For purposes of this

				section—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="IDafae0da5472f44fb9fc42c56d57169bd"><enum>(A)</enum><header>In

				general</header><text display-inline="yes-display-inline">If, as a result of a

				default by a borrower under a guaranteed loan, after the holder thereof has

				made such further collection efforts and instituted such enforcement

				proceedings as the Secretary may require, the Secretary determines that the

				holder has suffered a loss, the Secretary shall pay to such holder the

				percentage of such loss (not more than 80 percent) specified in the guarantee

				contract. Upon making any such payment, the Secretary shall be subrogated to

				all the rights of the recipient of the payment. The Secretary shall be entitled

				to recover from the borrower the amount of any payments made pursuant to any

				guarantee entered into under this section.</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID02a198b13958458292843c2be3d2afb4"><enum>(B)</enum><header>Enforcement of

				rights</header><text display-inline="yes-display-inline">The Attorney General

				shall take such action as may be appropriate to enforce any right accruing to

				the United States as a result of the issuance of any guarantee under this

				section.</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID0df47d6cd9e244a8b7f45ac8f899f5e7"><enum>(C)</enum><header>Forbearance</header><text display-inline="yes-display-inline">Nothing in this section may be construed to

				preclude any forbearance for the benefit of the borrower which may be agreed

				upon by the parties to the guaranteed loan and approved by the Secretary, if

				budget authority for any resulting subsidy costs (as defined under the Federal

				Credit Reform Act of 1990) is available.</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDc1e18d0b418d4fc9835695064964ab24"><enum>(D)</enum><header>Management of

				property</header><text display-inline="yes-display-inline">Notwithstanding any

				other provision of law relating to the acquisition, handling, or disposal of

				property by the United States, the Secretary shall have the right in the

				Secretary's discretion to complete, recondition, reconstruct, renovate, repair,

				maintain, operate, or sell any property acquired by the Secretary pursuant to

				the provisions of this section.</text>

								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID954A2B5B6AAB4954A7E05FFB47EC51D6"><enum>(6)</enum><header>Review</header><text display-inline="yes-display-inline">The Comptroller General of the United

				States shall, within 2 years of the date of enactment of this section, conduct

				a review of the subsidy estimates for the loan guarantees under this

				subsection, and shall submit to Congress a report on the review conducted under

				this paragraph.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID322B2A38930143EFA4F0E0AA13C35CC0"><enum>(7)</enum><header>Termination</header><text display-inline="yes-display-inline">No loan may be guaranteed under this

				subsection after September 30, 2011.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDEF4970A2DD314BDBA9F094E8473FAF81"><enum>(8)</enum><header>Authorization

				of appropriations</header><text display-inline="yes-display-inline">There is

				authorized to be appropriated—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="idADB09097B9FC42BFBD3355E2A6D2E6BD"><enum>(A)</enum><text display-inline="yes-display-inline">such sums as may be necessary for the cost,

				as defined in section 502(5) of the <act-name parsable-cite="FCRA90">Federal

				Credit Reform Act of 1990</act-name>, of guaranteeing $500,000,000 of loans

				under this subsection, and</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDA91DC8A49C043E9A23B840D8A84B18E"><enum>(B)</enum><text display-inline="yes-display-inline">$6,000,000 for administrative expenses for

				fiscal year 2006 and such sums as necessary thereafter for administrative

				expenses in subsequent years.</text>

								</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDD9EE82C87F774429B95A5F53224BC757"><enum>(d)</enum><header>National

				Academy of Sciences evaluation</header>

							<paragraph commented="no" display-inline="no-display-inline" id="ID185639A69D5D48059BC76120BC1EAEE2"><enum>(1)</enum><header>In

				general</header><text display-inline="yes-display-inline">The Secretary shall

				enter into an agreement with the National Academy of Sciences under which the

				Academy shall evaluate, on a tri-annual basis, the activities under this

				section.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6B99D60E82CF4362903326B8D5950E33"><enum>(2)</enum><header>Tri-annual

				report</header><text display-inline="yes-display-inline">Under the agreement

				under paragraph (1), the Academy shall submit to the Secretary a report on its

				evaluation of science park development under that paragraph. Each report may

				include such recommendations as the Academy considers appropriate for

				additional activities to promote and facilitate the development of science

				parks in the United States.</text>

							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID2D711B98ADA347208B04166FA794DCE7"><enum>(e)</enum><header>Tri-Annual

				report</header><text display-inline="yes-display-inline">Not later than March

				31 of every third year, the Secretary shall submit to Congress a report on the

				activities under this section during the preceding 3 years, including any

				recommendations made by the National Academy of Sciences under subsection

				(d)(2) during such period. Each report may include such recommendations for

				legislative or administrative action as the Secretary considers appropriate to

				further promote and facilitate the development of science parks in the United

				States.</text>

						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID657BCC26318546B69CCEA89F8DF7C038"><enum>(f)</enum><header>Regulations</header>

							<paragraph commented="no" display-inline="no-display-inline" id="ID9F7F86903B1F453FB5FDBDA7E5D91B4E"><enum>(1)</enum><header>Regulations</header><text display-inline="yes-display-inline">Consistent with Office of Management and

				Budget Circular A–129, <quote>Policies for Federal Credit Programs and Non-Tax

				Receivables</quote>, the Secretary shall prescribe regulations to carry out

				this section.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8C55924105744DD8B4215FC459B96CED"><enum>(2)</enum><header>Deadline</header><text display-inline="yes-display-inline">The Secretary shall prescribe such

				regulations not later than one year after the date of enactment of this

				section.</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="ID1D1D2DAD878049EDB7A2CF6C2DAD04EF" section-type="subsequent-section"><enum>3.</enum><header>Science park venture

			 capital fund pilot Program</header><text display-inline="no-display-inline">Title III of the

			 <act-name parsable-cite="SBIA">Small Business Investment Act of 1958</act-name>

			 (15 U.S.C. 681 et seq.) is amended by adding at the end the following:</text>

				venture capital fund pilot Program</header>

					<section commented="no" display-inline="no-display-inline" id="ID353230273BCA4BE49FB854295ECB0770" section-type="subsequent-section"><enum>1.</enum><header>Definitions</header><text display-inline="no-display-inline">As used in this part, the following

				definitions shall apply:</text>

						<paragraph commented="no" display-inline="no-display-inline" id="id5B333149565C494E8265E9DD82E44851"><enum>(1)</enum><header>Business or

				industrial park</header><text display-inline="yes-display-inline">The term

				<term>Business or industrial park</term> means primarily a for-profit real

				estate venture of businesses or industries which do not necessarily reinforce

				each other through supply chain or technology transfer mechanisms.</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1FFA858075BD42AF8A517502A988D39D"><enum>(2)</enum><header>Equity

				capital</header><text display-inline="yes-display-inline">The term <term>equity

				capital</term> means common or preferred stock or a similar instrument,

				including subordinated debt with equity features.</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDAB66438134454F02A76552BA3F67FBD5"><enum>(3)</enum><header>High-technology</header><text display-inline="yes-display-inline">The term <term>high-technology</term> means

				any of the high technology industries in the North American Industrial

				Classification System, as listed in table 8–25 of the National Science Board

				publication entitled <quote>Science and Engineering Indicators 2004</quote>, or

				as listed in any succeeding editions of such publication.</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDCACB40A93F094CEA9658255875A38934"><enum>(4)</enum><header>Leverage</header><text display-inline="yes-display-inline">The term <term>leverage</term>

				includes—</text>

							<subparagraph commented="no" display-inline="no-display-inline" id="IDA5B205535084447F9724C3C3DCAE685C"><enum>(A)</enum><text display-inline="yes-display-inline">debentures purchased or guaranteed by the

				Administrator;</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID20073083F731458CABFE9B7F5FABB113"><enum>(B)</enum><text display-inline="yes-display-inline">participating securities purchased or

				guaranteed by the Administrator; and</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDDA667B35FCFC49C98230A68BAD94D47C"><enum>(C)</enum><text display-inline="yes-display-inline">preferred securities outstanding as of the

				date of enactment of this part.</text>

							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3A6ACAB036D54455A26072B28F4C6AFE"><enum>(5)</enum><header>Mezzanine

				financing</header><text display-inline="yes-display-inline">The term

				<term>mezzanine financing</term> means late-stage venture capital usually

				associated with the final round of financing prior to an initial public

				offering.</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDBB939F558B3F44D29ABEC39CEEBBDC51"><enum>(6)</enum><header>Operational

				assistance</header><text display-inline="yes-display-inline">The term

				<term>operational assistance</term> means management, marketing, and other

				technical assistance that assists high-technology start-up companies with

				business development.</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDFF1CEFE2D95E42579E0B843BE2E9392C"><enum>(7)</enum><header>Participation

				agreement</header><text display-inline="yes-display-inline">The term

				<term>participation agreement</term> means an agreement, between the

				Administrator and a company granted final approval by the Administrator under

				section 374(e), that—</text>

							<subparagraph commented="no" display-inline="no-display-inline" id="ID3067581108D84E58A2F5134041A3295F"><enum>(A)</enum><text display-inline="yes-display-inline">details the operating plan and investment

				criteria of the company; and</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDE5B1643ABEE3447192E873F18CC8EF0B"><enum>(B)</enum><text display-inline="yes-display-inline">requires the company to make investments in

				high-technology start-up companies within a science park.</text>

							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDB1CEE9B47DE84E94B98B86B37369023D"><enum>(8)</enum><header>Private

				capital</header><text display-inline="yes-display-inline">The term

				<term>private capital</term>—</text>

							<subparagraph commented="no" display-inline="no-display-inline" id="ID5AACD26FE8D6436F9590A77E5C4726C7"><enum>(A)</enum><text display-inline="yes-display-inline">means the total of—</text>

								<clause commented="no" display-inline="no-display-inline" id="ID16C5203800F14CA182F3712A8F5B294D"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="ID79FF1E93108740069E6AC88F0E897A64"><enum>(I)</enum><text display-inline="yes-display-inline">the paid-in capital and paid-in surplus of

				a corporate science park venture capital company;</text>

									</subclause><subclause commented="no" display-inline="no-display-inline" id="IDB4ABBC6C9AF1486782F4DAF0E1406622" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">the contributed capital of the partners of

				a partnership science park venture capital company; or</text>

									</subclause><subclause commented="no" display-inline="no-display-inline" id="IDED76615D29E34579AA6B726876569016" indent="up1"><enum>(III)</enum><text display-inline="yes-display-inline">the equity investment of the members of a

				limited liability company science park venture capital company; and</text>

									</subclause></clause><clause commented="no" display-inline="no-display-inline" id="ID23A8D128799346838D9E68B16640EB4D"><enum>(ii)</enum><text display-inline="yes-display-inline">unfunded binding commitments from investors

				that meet criteria established by the Administrator to contribute capital to

				the science park venture capital company, except that—</text>

									<subclause commented="no" display-inline="no-display-inline" id="ID155F2F83CD38418783E2D437FFC8807A"><enum>(I)</enum><text display-inline="yes-display-inline">unfunded commitments may be counted as

				private capital for purposes of approval by the Administrator of any request

				for leverage; and</text>

									</subclause><subclause commented="no" display-inline="no-display-inline" id="IDEDA301537A09413EB518D8089140D82A"><enum>(II)</enum><text display-inline="yes-display-inline">leverage shall not be funded based on the

				commitments; and</text>

									</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID883DCD3C39AA4F4D8642F955A9450AF4"><enum>(B)</enum><text display-inline="yes-display-inline">does not include—</text>

								<clause commented="no" display-inline="no-display-inline" id="ID17A24B477BA94FAD90F607DD277DD52A"><enum>(i)</enum><text display-inline="yes-display-inline">any funds borrowed by a science park

				venture capital company from any source;</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="ID10FEB992B69E456BBF4067E8BF59738C"><enum>(ii)</enum><text display-inline="yes-display-inline">any funds obtained through the issuance of

				leverage; or</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="ID4B6E777DF6EE480A9913DA7CD2BE6AB7"><enum>(iii)</enum><text display-inline="yes-display-inline">any funds obtained directly or indirectly

				from Federal, State, or local government, except for—</text>

									<subclause commented="no" display-inline="no-display-inline" id="IDF488C30F5E6D4B75B3FF380820A6E000"><enum>(I)</enum><text display-inline="yes-display-inline">funds obtained from the business revenues

				of any federally chartered or government-sponsored enterprise established

				before the date of enactment of this part;</text>

									</subclause><subclause commented="no" display-inline="no-display-inline" id="IDC2AFD5D8466846B7B53C0D08C41F3B4B"><enum>(II)</enum><text display-inline="yes-display-inline">funds invested by an employee welfare

				benefit plan or pension plan; and</text>

									</subclause><subclause commented="no" display-inline="no-display-inline" id="ID6370E1EB39F9411393ED7ECFF6CA0617"><enum>(III)</enum><text display-inline="yes-display-inline">any qualified nonprivate funds, if the

				investors of such funds do not directly or indirectly control the management,

				board of directors, general partners, or members of the science park venture

				capital company.</text>

									</subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDDE481655165E448C8CBA69D3C006FE24"><enum>(9)</enum><header>Program</header><text display-inline="yes-display-inline">The term <term>Program</term> means the

				Science Park Venture Capital Program established under section 372.</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID90A22EDDC005472D9FA80CCFCE664475"><enum>(10)</enum><header>Qualified

				nonprivate funds</header><text display-inline="yes-display-inline">The term

				<term>qualified nonprivate funds</term> means—</text>

							<subparagraph commented="no" display-inline="no-display-inline" id="ID2F4615D9CA3F44FCA41E9C8262E0A1E3"><enum>(A)</enum><text display-inline="yes-display-inline">any funds directly or indirectly invested

				in any applicant or science park venture capital company on or before the date

				of enactment of this part, by any Federal agency other than the Administration,

				under a law explicitly mandating the inclusion of those funds in the definition

				of the term private capital; and</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID55985DF972C949C58966ACEBA37B02AB"><enum>(B)</enum><text display-inline="yes-display-inline">any funds invested in any applicant or

				science park venture capital company by 1 or more entities of any State,

				including any guarantee extended by any such entity, in an aggregate amount not

				to exceed 33 percent of the private capital of the applicant or science park

				venture capital company.</text>

							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID41E67826560342D8AA9ED1353EE7CA7E"><enum>(11)</enum><header>Science

				park</header><text display-inline="yes-display-inline">The term <term>science

				park</term> means a group of interrelated companies and institutions, including

				suppliers, service providers, institutions of higher education, start-up

				incubators, and trade associations that cooperate and compete and are located

				in a specific area whose administration promotes real estate development,

				technology transfer, and partnerships between such companies and institutions,

				and does not mean a business or industrial park.</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID155EB4AA65824BA8929D011FD5DFD27F"><enum>(12)</enum><header>Science park

				venture capital</header><text display-inline="yes-display-inline">The term

				<term>science park venture capital</term> means equity capital investments in

				high-technology start-up businesses located in science parks to foster economic

				development and technological innovation.</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID222919429E324E3898BF0250BDB44499"><enum>(13)</enum><header>Science park

				venture capital company</header><text display-inline="yes-display-inline">The

				term <term>science park venture capital company</term> means a company

				that—</text>

							<subparagraph commented="no" display-inline="no-display-inline" id="IDA3A0DA763BB643BB9D77E7474C203F3A"><enum>(A)</enum><text display-inline="yes-display-inline">meets the requirements under section

				373;</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID04D06DB16E5548848EC8FED5AACCF3D0"><enum>(B)</enum><text display-inline="yes-display-inline">has been granted final approval by the

				Administrator under section 374(e); and</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1520842564DB4152A0CE4D32B4DCBA7A"><enum>(C)</enum><text display-inline="yes-display-inline">has entered into a participation agreement

				with the Administrator.</text>

							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID11888F15CCB9410284C5D133560DCDF3"><enum>(14)</enum><header>Start-up

				company</header><text display-inline="yes-display-inline">The term

				<term>start-up company</term> means a company that has developed intellectual

				property protection of research and development, but has not reached the stage

				associated with equity or securitized investments typical of venture capital or

				mezzanine financing.</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID08820ECE85A24F79804E31CD503EC8D0"><enum>(15)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> means each of

				the several States of the United States, the District of Columbia, the

				Commonwealth of Puerto Rico, the Virgin Islands, Guam, American Samoa, the

				Commonwealth of the Northern Mariana Islands, and any other commonwealth,

				territory, or possession of the United States.</text>

						</paragraph></section><section commented="no" display-inline="no-display-inline" id="IDA913BADAEFC643A987E5CF663F15FF5D" section-type="subsequent-section"><enum>2.</enum><header>Establishment</header><text display-inline="no-display-inline">There is established a Science Park Venture

				Capital Program, under which the Administrator may—</text>

						<paragraph commented="no" display-inline="no-display-inline" id="ID4BD1B747A95F49518E24A4EF5929B5FB"><enum>(1)</enum><text display-inline="yes-display-inline">enter into participation agreements with

				companies granted final approval under section 374(e);</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0DADC9CB75EB45B6AF1BBC28B987D1C2"><enum>(2)</enum><text display-inline="yes-display-inline">guarantee the debentures issued by science

				park venture capital companies under section 375; and</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1EC2C1EFEA904088A943AC18D74275B7"><enum>(3)</enum><text display-inline="yes-display-inline">award grants to science park venture

				capital companies under section 377.</text>

						</paragraph></section><section commented="no" display-inline="no-display-inline" id="IDC46A543647A3478FB161395FFFA55ED8" section-type="subsequent-section"><enum>3.</enum><header>Requirements for

				science park venture capital companies</header>

						<subsection commented="no" display-inline="no-display-inline" id="IDE2A5036E966843EE828EF4F1BCADC206"><enum>(a)</enum><header>Organization</header><text display-inline="yes-display-inline">For purposes of this part, a science park

				venture capital company—</text>

							<paragraph commented="no" display-inline="no-display-inline" id="IDD2095CAA13B74CD398538F6C110DDC73"><enum>(1)</enum><text display-inline="yes-display-inline">shall be an incorporated body, a limited

				liability company, or a limited partnership organized and chartered, or

				otherwise existing under State law solely for the purpose of performing the

				functions and conducting the activities authorized by this part;</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDCF0C6023C3E5450ABD2781BA86378334"><enum>(2)</enum><text display-inline="yes-display-inline">if incorporated, shall have succession for

				a period of not less than 30 years unless earlier dissolved by the shareholders

				of the company;</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6AA1EE9732F74CB38B631C5CFDE7FB38"><enum>(3)</enum><text display-inline="yes-display-inline">if a limited partnership or a limited

				liability company, shall have succession for a period of not less than 10

				years; and</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDFB6A0136D73B49EEBC94E538C860E099"><enum>(4)</enum><text display-inline="yes-display-inline">shall possess the powers reasonably

				necessary to perform the functions and conduct the activities.</text>

							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID044957A0FCC64854BB4F81104A8534F1"><enum>(b)</enum><header>Articles</header><text display-inline="yes-display-inline">The articles of any science park venture

				capital company—</text>

							<paragraph commented="no" display-inline="no-display-inline" id="IDA2681D8C62EF49A087A8B11084838424"><enum>(1)</enum><text display-inline="yes-display-inline">shall specify in general terms—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="ID01605E5B277B4282B054726AF64288D6"><enum>(A)</enum><text display-inline="yes-display-inline">the purposes for which the company is

				formed;</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9C40331FC21D4418887A3BEC57F79C72"><enum>(B)</enum><text display-inline="yes-display-inline">the name of the company;</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID228744F7DCDA4534A1F82ACAB418353F"><enum>(C)</enum><text display-inline="yes-display-inline">the area or areas in which the operations

				of the company are to be carried out;</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDD5725C1068E84AE7AB7AFCD21187DFED"><enum>(D)</enum><text display-inline="yes-display-inline">the place where the principal office of the

				company is to be located; and</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4BE0BF37621743C081EF02A9D12FEF91"><enum>(E)</enum><text display-inline="yes-display-inline">the amount and classes of the shares of

				capital stock of the company;</text>

								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID29432B4DCBEB48E0B661DE34698B6B7D"><enum>(2)</enum><text display-inline="yes-display-inline">may contain any other provisions consistent

				with this part that the science park venture capital company may determine to

				be appropriate to adopt for the regulation of the business of the company and

				the conduct of the affairs of the company; and</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDAD7675BAF4144E56AFF502079E247845"><enum>(3)</enum><text display-inline="yes-display-inline">shall be subject to the approval of the

				Administrator.</text>

							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID1BF4F179B52B4B84AD395CE28D9C6B8D"><enum>(c)</enum><header>Capital

				requirements</header>

							<paragraph commented="no" display-inline="no-display-inline" id="IDBA8FA4B73C60404CB3BC0BC3C3D8530C"><enum>(1)</enum><header>In

				general</header><text display-inline="yes-display-inline">Except as provided in

				paragraph (2), the private capital of each science park venture capital company

				shall be not less than—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="ID63DB892714D24E0E9743B910F50C78CF"><enum>(A)</enum><text display-inline="yes-display-inline">$5,000,000; or</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID7549A1592E6547F4918D3D9FB1601B21"><enum>(B)</enum><text display-inline="yes-display-inline">$10,000,000, with respect to each science

				park venture capital company authorized or seeking authority to issue

				participating securities to be purchased or guaranteed by the Administrator

				under this part.</text>

								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0626B8E7B8734783B84844816FD16813"><enum>(2)</enum><header>Exception</header><text display-inline="yes-display-inline">The Secretary may, in the discretion of the

				Administrator, and based on a showing of special circumstances and good cause,

				permit the private capital of science park venture capital company described in

				paragraph (1)(B) to be less than $10,000,000, but not less than $5,000,000, if

				the Administrator determines that the action would not create or otherwise

				contribute to an unreasonable risk of default or loss to the Federal

				Government.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDFAF71930A46C4F03BBFB51E7CD608308"><enum>(3)</enum><header>Adequacy</header><text display-inline="yes-display-inline">In addition to the requirements under

				paragraph (1), the Administrator shall—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="ID1CB94CF2BDEF419480100D3AAA09BA93"><enum>(A)</enum><text display-inline="yes-display-inline">determine whether the private capital of

				each science park venture capital company is adequate to ensure a reasonable

				prospect that the company will be operated soundly and profitably, and managed

				actively and prudently in accordance with the articles of the company;</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID2747A8FF48224522AF9E48A6B55D6C6E"><enum>(B)</enum><text display-inline="yes-display-inline">determine that the science park venture

				capital company will be able to comply with the requirements of this part;

				and</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDBB051164D72B437CABFB20674519B06B"><enum>(C)</enum><text display-inline="yes-display-inline">ensure that the science park venture

				capital company is designed primarily to meet equity capital needs of the

				businesses in which the company invests and not to compete with traditional

				financing by commercial lenders of high-technology startup businesses.</text>

								</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDBEC6BC37B3254BA0868AC59CB1F9D217"><enum>(d)</enum><header>Diversification

				of ownership</header><text display-inline="yes-display-inline">The

				Administrator shall ensure that the management of each science park venture

				capital company licensed after the date of enactment of this part is

				sufficiently diversified from, and unaffiliated with, the ownership of the

				company so as to ensure independence and objectivity in the financial

				management and oversight of the investments and operations of the

				company.</text>

						</subsection></section><section commented="no" display-inline="no-display-inline" id="ID6D62EE213D9341AAA72C78BB58B3724C" section-type="subsequent-section"><enum>4.</enum><header>Selection of science

				park venture capital companies</header>

						<subsection commented="no" display-inline="no-display-inline" id="IDECF1705171DA457593E4AF04CC36F059"><enum>(a)</enum><header>Eligibility</header><text display-inline="yes-display-inline">A company is eligible to participate as a

				science park venture capital company in the Program if the company—</text>

							<paragraph commented="no" display-inline="no-display-inline" id="ID6B0FE48190204D81AFC9C469D6018B03"><enum>(1)</enum><text display-inline="yes-display-inline">is a newly formed for-profit entity or a

				newly formed for-profit subsidiary of an existing entity;</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4A58AB409527480E9685896DFF2ACD5F"><enum>(2)</enum><text display-inline="yes-display-inline">has a management team in the science park

				with experience in development financing or relevant venture capital

				financing;</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID72A3AF7118B84829999F4C531A4AA472"><enum>(3)</enum><text display-inline="yes-display-inline">has a primary objective of economic

				development of the science park and its surrounding geographic area; and</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0E683DD133FD438C9318AE03B0758022"><enum>(4)</enum><text display-inline="yes-display-inline">promotes innovation of science and

				technology in the science park.</text>

							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID3389559DB54F407791507352DF42386D"><enum>(b)</enum><header>Application</header><text display-inline="yes-display-inline">Any eligible company that desires to

				participate as a science park venture capital company in the Program shall

				submit an application to the Administrator, which shall include—</text>

							<paragraph commented="no" display-inline="no-display-inline" id="IDAF6BD985990D473585FBE6424A12E446"><enum>(1)</enum><text display-inline="yes-display-inline">a business plan describing how the company

				intends to make successful venture capital investments in start up companies

				within the science park;</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDF253D646972E4876AFBFD8F62B53FE64"><enum>(2)</enum><text display-inline="yes-display-inline">a description of the qualifications and

				general reputation of the management of the company;</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID52257A6862FD4EE6989750FBFE6E54C1"><enum>(3)</enum><text display-inline="yes-display-inline">an estimate of the ratio of cash to in-kind

				contributions of binding commitments to be made to the company under the

				Program;</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE65F4FC79BE34281ABDFF2C64DFC039D"><enum>(4)</enum><text display-inline="yes-display-inline">a description of the criteria to be used to

				evaluate whether, and to what extent, the company meets the objectives of the

				Program;</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8D62F475246543D48D455D3C3DBDD1AC"><enum>(5)</enum><text display-inline="yes-display-inline">information regarding the management and

				financial strength of any parent firm, affiliated firm, or other firm essential

				to the success of the business plan of the company; and</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID080E5E0B553A496482704500393F3A21"><enum>(6)</enum><text display-inline="yes-display-inline">such other information as the Administrator

				may require.</text>

							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDBF152AB0F76F450AB7C232EA3E1213B0"><enum>(c)</enum><header>Status</header><text display-inline="yes-display-inline">Not later than 90 days after the initial

				receipt by the Administrator of an application under this section, the

				Administrator shall provide to the applicant a written report that describes

				the status of the applicants and any requirements remaining for completion of

				the application.</text>

						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID379191CC638D4F19B5418C1D4CCB0622"><enum>(d)</enum><header>Matters

				considered</header><text display-inline="yes-display-inline">In reviewing and

				processing any application under this section, the Administrator—</text>

							<paragraph commented="no" display-inline="no-display-inline" id="ID8DB3BE0DC8EA442BA4CDA98B18765978"><enum>(1)</enum><text display-inline="yes-display-inline">shall determine if—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="ID6CF4739DAA1A4F0EA34503217B149F19"><enum>(A)</enum><text display-inline="yes-display-inline">the applicant meets the requirements under

				subsection (e); and</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID99D88E1379994C2BAB06DEB9F937AAE7"><enum>(B)</enum><text display-inline="yes-display-inline">the management of the applicant is

				qualified and has the knowledge, experience, and capability necessary to comply

				with this part;</text>

								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDB0D8A2A92E8844F09356BA0F42A828C4"><enum>(2)</enum><text display-inline="yes-display-inline">shall take into consideration—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="ID072BCFA6A7124933B63D7950072174D7"><enum>(A)</enum><text display-inline="yes-display-inline">the need for and availability of financing

				for high-technology start-up companies in the science park in which the

				applicant is to commence business;</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID84C94D8D606149B1A72E0E7564D8EC3B"><enum>(B)</enum><text display-inline="yes-display-inline">the general business reputation of the

				owners and management of the applicant; and</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID86029EE1EDD94F93A268F8C4F50995AF"><enum>(C)</enum><text display-inline="yes-display-inline">the probability of successful operations of

				the applicant, including adequate profitability and financial soundness;</text>

								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6133215E56EB4A1094D62CE142787E18"><enum>(3)</enum><text display-inline="yes-display-inline">shall not take into consideration any

				projected shortage or unavailability of grant funds or leverage; and</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC403856D8711449EA743419833D723F3"><enum>(4)</enum><text display-inline="yes-display-inline">shall emphasize the promotion of regional

				science park venture capital companies to serve multiple research parks in

				order to avoid geographic dilution of management and capital.</text>

							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID5005DEF548B4481ABF4B5389B43D005E"><enum>(e)</enum><header>Approval;

				license</header><text display-inline="yes-display-inline">The Administrator may

				approve an applicant to operate as a science park venture capital company under

				this part and license the applicant as a science park venture capital company,

				if—</text>

							<paragraph commented="no" display-inline="no-display-inline" id="ID543B11737C124F43BBCCC4BA3FF6CC45"><enum>(1)</enum><text display-inline="yes-display-inline">the Administrator determines that the

				application satisfies the requirements under subsection (b);</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID944C14C964EE41DBA7EBE548A82A0E69"><enum>(2)</enum><text display-inline="yes-display-inline">the Administrator approves—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="ID2BA6E091E6C14C309E55965B64FC4B98"><enum>(A)</enum><text display-inline="yes-display-inline">the area in which the science park venture

				capital company is to conduct its operations; and</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDF9F50FCB8AF6402FAB06C6E88117E891"><enum>(B)</enum><text display-inline="yes-display-inline">the establishment of branch offices or

				agencies (if authorized by the articles); and</text>

								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0EE1D378198B49579ABDD774F860A704"><enum>(3)</enum><text display-inline="yes-display-inline">the applicant enters into a participation

				agreement with the Administrator.</text>

							</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID812660E48AF74BD09137EE29A35649EF" section-type="subsequent-section"><enum>5.</enum><header>Debentures</header>

						<subsection commented="no" display-inline="no-display-inline" id="IDEC36DBB7A1E4457AA8DE8557257E7155"><enum>(a)</enum><header>Guarantees</header><text display-inline="yes-display-inline">The Administrator may guarantee the timely

				payment of principal and interest, as scheduled, on debentures issued by any

				science park venture capital company.</text>

						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID4C54F4698FD04E3A98400C3FADBED9F0"><enum>(b)</enum><header>Terms and

				conditions</header><text display-inline="yes-display-inline">The Administrator

				may make guarantees under this section on such terms and conditions as the

				Administrator determines to be appropriate, except that the term of any

				debenture guaranteed under this section shall not exceed 15 years.</text>

						</subsection><subsection commented="no" display-inline="no-display-inline" id="IDD534992027444A198401048821C4C8B3"><enum>(c)</enum><header>Full faith and

				credit of the United States</header><text display-inline="yes-display-inline">The full faith and credit of the United

				States is pledged to pay all amounts that may be required to be paid under any

				guarantee under this part.</text>

						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID980A3B6817CA4435B31B3651FEEE6809"><enum>(d)</enum><header>Maximum

				guarantee</header><text display-inline="yes-display-inline">The Administrator

				may—</text>

							<paragraph commented="no" display-inline="no-display-inline" id="IDD7598295A6644961B4D7D505229D921D"><enum>(1)</enum><text display-inline="yes-display-inline">guarantee the debentures issued by a

				science park venture capital company only to the extent that the total face

				amount of outstanding guaranteed debentures of such company does not exceed the

				lesser of—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="IDD4908E2E51024C4E98D8C7942A9349BA"><enum>(A)</enum><text display-inline="yes-display-inline">300 percent of the private capital of the

				company, or</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID7B51FE95D7DF472B826A3D15464A6347"><enum>(B)</enum><text display-inline="yes-display-inline">$100,000,000; and</text>

								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID88005C29FD734986ACA19007B5692912"><enum>(2)</enum><text display-inline="yes-display-inline">provide for the use of discounted

				debentures.</text>

							</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="IDF5454CBCBF3E4197BE67D74DA9282A43" section-type="subsequent-section"><enum>6.</enum><header>Issuance and guarantee

				of trust certificates</header>

						<subsection commented="no" display-inline="no-display-inline" id="ID39CB0BA2F1624BAE832FDCAB76544DFF"><enum>(a)</enum><header>Issuance</header><text display-inline="yes-display-inline">The Administrator may issue trust

				certificates representing ownership of all or a part of debentures issued by a

				science park venture capital company and guaranteed by the Administrator under

				this part, if such certificates are based on and backed by a trust or pool

				approved by the Administrator and composed solely of guaranteed

				debentures.</text>

						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID5350B4C7F9CC4772990C8E4466E7D5DD"><enum>(b)</enum><header>Guarantee</header>

							<paragraph commented="no" display-inline="no-display-inline" id="IDF6430405121A48E8AE8DA4F6AEADEC42"><enum>(1)</enum><header>In

				general</header><text display-inline="yes-display-inline">The Administrator

				may, under such terms and conditions as it deems appropriate, guarantee the

				timely payment of the principal of and interest on trust certificates issued by

				the Administrator or its agents for purposes of this section.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE512DABB6E144E1EA54B907738830C9C"><enum>(2)</enum><header>Limitation</header><text display-inline="yes-display-inline">Each guarantee under this subsection shall

				be limited to the extent of principal and interest on the guaranteed debentures

				that compose the trust or pool.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD2141359036A406AB880C1E82AF85B43"><enum>(3)</enum><header>Prepayment or

				default</header>

								<subparagraph commented="no" display-inline="no-display-inline" id="ID87EA7A10F8DA4FE5816C55FDB0DBE64D"><enum>(A)</enum><header>In

				general</header><text display-inline="yes-display-inline">In the event that a

				debenture in a trust or pool is prepaid, or in the event of default of such a

				debenture, the guarantee of timely payment of principal and interest on the

				trust certificates shall be reduced in proportion to the amount of principal

				and interest such prepaid debenture represents in the trust or pool.</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9088505B9A6E4B3F8EC26DD90A4F469A"><enum>(B)</enum><header>Interest</header><text display-inline="yes-display-inline">Interest on prepaid or defaulted debentures

				shall accrue and be guaranteed by the Administrator only through the date of

				payment of the guarantee.</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDF1AE686A665D4F7EA706065BF3B686C4"><enum>(C)</enum><header>Redemption</header><text display-inline="yes-display-inline">At any time during its term, a trust

				certificate may be called for redemption due to prepayment or default of all

				debentures.</text>

								</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID54BF9D4F94A9497A992F650B957CB3BA"><enum>(c)</enum><header>Full faith and

				credit</header><text display-inline="yes-display-inline">The full faith and

				credit of the United States is pledged to pay all amounts that may be required

				to be paid under any guarantee of a trust certificate issued by the

				Administrator or its agents under this section.</text>

						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID0B35E435E0064D58BF86B47329CE0F2B"><enum>(d)</enum><header>Subrogation and

				ownership rights</header>

							<paragraph commented="no" display-inline="no-display-inline" id="ID80ED5023B7DA465C90C41F5BD454F3FC"><enum>(1)</enum><header>Subrogation</header><text display-inline="yes-display-inline">If the Administrator pays a claim under a

				guarantee issued under this section, it shall be subrogated fully to the rights

				satisfied by such payment.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID789DD33CEA684218A37C0DB2881F02EC"><enum>(2)</enum><header>Ownership

				rights</header><text display-inline="yes-display-inline">No provision of

				Federal, State, or local law shall preclude or limit the exercise by the

				Administrator of its ownership rights in the debentures residing in a trust or

				pool against which 1 or more trust certificates are issued under this

				section.</text>

							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDFE9E8B298A5B42EF9D82F0FF3A702E88"><enum>(e)</enum><header>Management and

				Administration</header>

							<paragraph commented="no" display-inline="no-display-inline" id="IDDB0DF73576B74AFFBF1AC8DC6597D98B"><enum>(1)</enum><header>Registration</header><text display-inline="yes-display-inline">The Administrator may provide for a central

				registration of all trust certificates issued under this section.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDA5865F897E5F4D8CA2B6AAA0EBB2A343"><enum>(2)</enum><header>Contracting of

				functions</header>

								<subparagraph commented="no" display-inline="no-display-inline" id="IDA40927724A984235ABC789EDB7F7A055"><enum>(A)</enum><header>In

				general</header><text display-inline="yes-display-inline">Notwithstanding any

				other provision of law, the Administrator may contract with an agent or agents

				to carry out on behalf of the Administrator the pooling and the central

				registration functions provided for in this section, including—</text>

									<clause commented="no" display-inline="no-display-inline" id="ID6FB56D1C5A28408E98DE9813D08094DE"><enum>(i)</enum><text display-inline="yes-display-inline">maintenance, on behalf of and under the

				direction of the Administrator, of such commercial bank accounts or investments

				in obligations of the United States as may be necessary to facilitate the

				creation of trusts or pools backed by debentures guaranteed under this part;

				and</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="IDA93C5D0D42CD4860B085314DB703A8AE"><enum>(ii)</enum><text display-inline="yes-display-inline">the issuance of trust certificates to

				facilitate the creation of such trusts or pools.</text>

									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID2B75C8537D284F69898E43EF8B35A346"><enum>(B)</enum><header>Fidelity bond

				or insurance requirement</header><text display-inline="yes-display-inline">Any

				agent performing functions on behalf of the Administrator under this paragraph

				shall provide a fidelity bond or insurance in such amounts as the Administrator

				determines necessary to fully protect the interests of the United

				States.</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6A56C18F82E04F4D822AC1357FE3BD74"><enum>(C)</enum><header>Regulation of

				brokers and dealers</header><text display-inline="yes-display-inline">The

				Administrator may regulate brokers and dealers in trust certificates issued

				under this section.</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDF69CAE6E27AE4F25A369D039936035F6"><enum>(D)</enum><header>Electronic

				registration</header><text display-inline="yes-display-inline">Nothing in this

				subsection may be construed to prohibit the use of a book entry or other

				electronic form of registration for trust certificates issued under this

				section.</text>

								</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID55AB5C99F18E45E8BF1539D2F406ACBE" section-type="subsequent-section"><enum>7.</enum><header>Operational assistance

				grants</header>

						<subsection commented="no" display-inline="no-display-inline" id="ID1B8307B468384CFE92D7C9E6FB016A3A"><enum>(a)</enum><header>In

				general</header>

							<paragraph commented="no" display-inline="no-display-inline" id="ID1E45385F34AA466D8A0DFCBF22A7F0C9"><enum>(1)</enum><header>Grants

				authorized</header><text display-inline="yes-display-inline">The Administrator

				may award grants to science park venture capital companies and other entities

				to provide operational assistance to high-technology start-up companies

				financed, or expected to be financed, by such companies.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4B64AB1547204AE28C86595E6675F1C9"><enum>(2)</enum><header>Terms</header><text display-inline="yes-display-inline">Grants under this subsection shall be made

				over a period not to exceed 10 years, under such other terms as the

				Administrator may require.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDAB3DC66958BB4D868FB5F407F5506483"><enum>(3)</enum><header>Grant

				amount</header><text display-inline="yes-display-inline">Each grant awarded

				under this subsection shall be equal to the lesser of—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="ID4529E0A4349842BB90E2D475317B79E0"><enum>(A)</enum><text display-inline="yes-display-inline">10 percent of the private capital raised by

				the science park venture capital company; or</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID7D581B1BA47D4C0B91E252B13A091C07"><enum>(B)</enum><text display-inline="yes-display-inline">$1,000,000.</text>

								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC9482FEB3E5D48F7B0D2CC0B3AFE5602"><enum>(4)</enum><header>Other

				entities</header><text display-inline="yes-display-inline">The amount of a

				grant made under this subsection to any entity other than a science park

				venture capital company shall be equal to the resources (in cash or in kind)

				raised by the entity in accordance with the requirements applicable to science

				park venture capital companies under this part.</text>

							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID5FCB0FBDE9D849A387ED498485D83EE3"><enum>(b)</enum><header>Supplemental

				grants</header>

							<paragraph commented="no" display-inline="no-display-inline" id="IDC5101649145E4AC88B0C1BFCF598781E"><enum>(1)</enum><header>In

				general</header><text display-inline="yes-display-inline">The Administrator may

				award supplemental grants to science park venture capital companies and other

				entities, under such terms as the Administrator may require, to provide

				additional operational assistance to start-up companies financed, or expected

				to be financed, by such companies or entities.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1A10E48F1D1144F0A2EBB90B4EF28EEF"><enum>(2)</enum><header>Matching

				requirement</header><text display-inline="yes-display-inline">The Administrator

				may require, as a condition of any supplemental grant made under this

				subsection, that the company or entity receiving the grant provide a matching

				contribution equal to 50 percent of the amount of the supplemental grant from

				non-Federal cash or in-kind resources.</text>

							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID03D2197144E2411FA0EC3BCF95877AC5"><enum>(c)</enum><header>Limitation</header><text display-inline="yes-display-inline">None of the assistance made available under

				this section may be used for any overhead or general and administrative expense

				of a science park venture capital company or other entity.</text>

						</subsection></section><section commented="no" display-inline="no-display-inline" id="IDC9C7CB87E87C45C78B07F9C74F6CC8C6" section-type="subsequent-section"><enum>8.</enum><header>Reporting

				requirements</header>

						<subsection commented="no" display-inline="no-display-inline" id="IDFB630402230349598D3CDF9DBA5F8D0D"><enum>(a)</enum><header>Science park

				venture capital companies</header><text display-inline="yes-display-inline">Each science park venture capital company

				shall provide the Administrator with such information as the Administrator may

				require, including information relating to the criteria described in section

				374(b)(4).</text>

						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID6790CB9387214859BD1C3F7CFFFE91AA"><enum>(b)</enum><header>Public

				reports</header>

							<paragraph commented="no" display-inline="no-display-inline" id="ID12506DAA40A049BCBC77B396D760AADA"><enum>(1)</enum><header>In

				general</header><text display-inline="yes-display-inline">The Administrator

				shall prepare and make available to the public an annual report on the Program,

				which shall include detailed information on—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="ID61A253EE2139415EA1C7E786A6E9D5B3"><enum>(A)</enum><text display-inline="yes-display-inline">the number of science park venture capital

				companies licensed by the Administrator during the previous fiscal year;</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID28551B28FA0142BA9C22F8A72025DCC7"><enum>(B)</enum><text display-inline="yes-display-inline">the aggregate amount of leverage that

				science park venture capital companies have received from the Federal

				Government during the previous fiscal year;</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1E7AE6EC9F874BB3928318D76BA694F5"><enum>(C)</enum><text display-inline="yes-display-inline">the aggregate number of each type of

				leveraged instruments used by science park venture capital companies during the

				previous fiscal year, and how each such number compares to the number in

				previous fiscal years;</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9CA995F8D7B8451DBD80F3D23249C0F5"><enum>(D)</enum><text display-inline="yes-display-inline">for the previous fiscal year, the number

				of—</text>

									<clause commented="no" display-inline="no-display-inline" id="ID224748BB1BFF40C184E803AF8E6ED802"><enum>(i)</enum><text display-inline="yes-display-inline">science park venture capital company

				licenses surrendered; and</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="ID15F1418B76574563AF7355105B607319"><enum>(ii)</enum><text display-inline="yes-display-inline">the number of science park venture capital

				companies placed in liquidation;</text>

									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID72F49B6C76B44C0C99FD832A2565316A"><enum>(E)</enum><text display-inline="yes-display-inline">the amount and type of leverage each such

				company has received from the Federal Government;</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1BD39BB9735941A6A4E7AACCA037AA82"><enum>(F)</enum><text display-inline="yes-display-inline">the amount of losses sustained by the

				Federal Government as a result of operations under this part during the

				previous fiscal year and an estimate of the total losses that the Federal

				Government can reasonably expect to incur as a result of the operations during

				the current fiscal year;</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID931F171AC3B9467484D31512D1BF756F"><enum>(G)</enum><text display-inline="yes-display-inline">actions taken by the Administrator to

				maximize recoupment of funds of the Federal Government expended to implement

				and administer the Program during the previous fiscal year and to ensure

				compliance with the requirements of this part, including implementing

				regulations;</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID88A4B9894C194950AAF1EF1B15B761D2"><enum>(H)</enum><text display-inline="yes-display-inline">the amount of Federal Government leverage

				that each licensee received in the previous fiscal year and the types of

				leverage instruments used by each licensee;</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4CB9BE44C0E44C55860E790ADC17823F"><enum>(I)</enum><text display-inline="yes-display-inline">for each type of financing instrument, the

				sizes, types of geographic locations, and other characteristics of the small

				business investment companies using the instrument during the previous fiscal

				year, including the extent to which the investment companies have used the

				leverage from each instrument to make loans or equity investments in science

				parks; and</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID061DC6CEC85548909A82F68F344B491C"><enum>(J)</enum><text display-inline="yes-display-inline">the actions of the Administrator to carry

				out this part.</text>

								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDFDD7C1221C5E46518F2F78073B1B0274"><enum>(2)</enum><header>Prohibition</header><text display-inline="yes-display-inline">In compiling the report required under

				paragraph (1), the Administrator may not—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="ID795DA3C812D7409CB7EE366D4E8C1F7D"><enum>(A)</enum><text display-inline="yes-display-inline">compile the report in a manner that permits

				identification of any particular type of investment by an individual science

				park venture capital company in which a science park venture capital company

				invests; or</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID5363FFD23F024EBB9D1FB97B9E394F73"><enum>(B)</enum><text display-inline="yes-display-inline">release any information that is prohibited

				under section 1905 of title 18, United States Code.</text>

								</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID20EBDE411EF4448FA871018531AB9085" section-type="subsequent-section"><enum>9.</enum><header>Examinations</header>

						<subsection commented="no" display-inline="no-display-inline" id="IDDD65B6DB30DC42798DCCB0CC586239BC"><enum>(a)</enum><header>In

				general</header><text display-inline="yes-display-inline">Each science park

				venture capital company that participates in the Program shall be subject to

				examinations made at the direction of the Administrator, in accordance with

				this section.</text>

						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID0161434C872842CB978D25D03A06DFD3"><enum>(b)</enum><header>Assistance of

				private sector entities</header><text display-inline="yes-display-inline">An

				examination under this section may be conducted with the assistance of a

				private sector entity that has the qualifications and expertise necessary to

				conduct such an examination.</text>

						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID0950943006084863AB96896075A414B5"><enum>(c)</enum><header>Costs</header>

							<paragraph commented="no" display-inline="no-display-inline" id="ID87742A731B5C40E4B9911E7FBBFBF9D4"><enum>(1)</enum><header>In

				general</header><text display-inline="yes-display-inline">The Administrator may

				assess the cost of an examination under this section, including compensation of

				the examiners, against the science park venture capital company

				examined.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDF2A339F7C3064C6298190ECB04970CC0"><enum>(2)</enum><header>Payment</header><text display-inline="yes-display-inline">Any science park venture capital company

				against which the Administrator assesses costs under this subsection shall pay

				the costs assessed.</text>

							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDCC994C9E10C041AC972BE5C3F67E2897"><enum>(d)</enum><header>Deposit of

				funds</header><text display-inline="yes-display-inline">Funds collected under

				this section—</text>

							<paragraph commented="no" display-inline="no-display-inline" id="ID25A02B0AA7654735976A3DF236450ED4"><enum>(1)</enum><text display-inline="yes-display-inline">shall be deposited in the account that

				incurred the costs for carrying out this section;</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD595119D887D45C8A6AD7028EA41F6CF"><enum>(2)</enum><text display-inline="yes-display-inline">shall be made available to the

				Administrator to carry out this section, without further appropriation;

				and</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8260CC7D9F834070A87E6F82C11C1023"><enum>(3)</enum><text display-inline="yes-display-inline">shall remain available until

				expended.</text>

							</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID8305887CF783432EBBDC2435869EFC62" section-type="subsequent-section"><enum>10.</enum><header>Bank

				participation</header>

						<subsection commented="no" display-inline="no-display-inline" id="IDED7A54FF36E84A16A79D0A1F1957D33B"><enum>(a)</enum><header>In

				general</header><text display-inline="yes-display-inline">Except as provided

				under subsection (b), any national bank, any member bank of the Federal Reserve

				System, and, to the extent permitted under applicable State law, any insured

				bank that is not a member of such system, may invest in—</text>

							<paragraph commented="no" display-inline="no-display-inline" id="IDAA4DCA5BBB9A4CAF97CAEC0CD0007AD7"><enum>(1)</enum><text display-inline="yes-display-inline">any science park venture capital company;

				or</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDBFE7DFD45DE147C1863A802F16CB2ADA"><enum>(2)</enum><text display-inline="yes-display-inline">any entity established to invest solely in

				science park venture capital companies.</text>

							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDFA430FB69A0943F2AEB03A6AE65FE7AD"><enum>(b)</enum><header>Limitation</header><text display-inline="yes-display-inline">No bank described in subsection (a) may

				make investments described in that subsection that are greater than 5 percent

				of the capital and surplus of the bank.</text>

						</subsection></section><section commented="no" display-inline="no-display-inline" id="IDF521BAD35DB5490FAE3443ADEA9BB6D1" section-type="subsequent-section"><enum>11.</enum><header>Fees</header>

						<subsection commented="no" display-inline="no-display-inline" id="IDED52A92ACCDD47EC8F6A41D36527854F"><enum>(a)</enum><header>In

				general</header><text display-inline="yes-display-inline">Except as provided

				under subsection (b), the Administrator may charge such fees as it determines

				to be appropriate with respect to any guarantee or grant issued under this

				part.</text>

						</subsection><subsection commented="no" display-inline="no-display-inline" id="IDCD79886B2F524A9FBF48D83FF39968F6"><enum>(b)</enum><header>Exception</header><text display-inline="yes-display-inline">The Administrator shall not collect a fee

				for any guarantee of a trust certificate under this section. Any agent of the

				Administrator may collect a fee, upon the approval of the Administrator, for

				the functions described in section 376(e)(2).</text>

						</subsection></section><section commented="no" display-inline="no-display-inline" id="ID68BEBE309C954A00812A17981414A61B" section-type="subsequent-section"><enum>12.</enum><header>Applicable

				law</header>

						<subsection commented="no" display-inline="no-display-inline" id="IDBD4E25CC32DB41EC89A2F3E5F59919E3"><enum>(a)</enum><header>In

				general</header><text display-inline="yes-display-inline">The provisions

				relating to New Market Venture Capital companies under sections 361 through

				section 366 shall apply to science park venture capital companies.</text>

						</subsection><subsection commented="no" display-inline="no-display-inline" id="IDF9C77C1E8EF1472C94EDB769791A3FA3"><enum>(b)</enum><header>Purchase of

				guaranteed obligations</header><text display-inline="yes-display-inline">Section 318 shall not apply to any

				debenture issued by a science park venture capital company under this

				part.</text>

						</subsection></section><section commented="no" display-inline="no-display-inline" id="IDBE73CF13AB5E4E4E8961281B7F887483" section-type="subsequent-section"><enum>13.</enum><header>Regulations</header><text display-inline="no-display-inline">Not later than 12 months after the date of

				enactment of this part, the Administrator shall issue such regulations as it

				determines necessary to carry out this part.</text>

					</section><section commented="no" display-inline="no-display-inline" id="ID2163C69570364852B8E2CE149D56DC1C" section-type="subsequent-section"><enum>14.</enum><header>Authorizations of

				appropriations</header>

						<subsection commented="no" display-inline="no-display-inline" id="ID12BDBB725EA64E0F8F09006A0B87DF30"><enum>(a)</enum><header>In

				general</header><text display-inline="yes-display-inline">There are authorized

				to be appropriated to the Administration for each of the fiscal years 2006

				through 2011, to remain available until expended—</text>

							<paragraph commented="no" display-inline="no-display-inline" id="ID0AFDBCC87A3C42CF8BEFF0DEBC354D25"><enum>(1)</enum><text display-inline="yes-display-inline">such sums as may be necessary for the cost,

				as defined in section 502(5) of the Federal Credit Reform Act of 1990, of

				guaranteeing $500,000,000 of debentures under this part; and</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD5272CC32D9A44E4B69140F21D7DCA32"><enum>(2)</enum><text display-inline="yes-display-inline">$50,000,000 to make grants under this

				part.</text>

							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID2347F74DB0284340A029846620E71915"><enum>(b)</enum><header>Funds collected

				for examinations</header><text display-inline="yes-display-inline">Funds

				deposited pursuant to section 362(d) may only be used for—</text>

							<paragraph commented="no" display-inline="no-display-inline" id="IDD6DC62D526DF486EA2810BDF2AF53E0E"><enum>(1)</enum><text display-inline="yes-display-inline">examinations under section 362; and</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID474083D33D914E22949BA034213C0BD3"><enum>(2)</enum><text display-inline="yes-display-inline">other oversight activities of the

				Program.</text>

							</paragraph></subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block>

		</section><section commented="no" display-inline="no-display-inline" id="ID2393A67047494B9D848C42FF80FB293F" section-type="subsequent-section"><enum>4.</enum><header>Tax incentives for

			 investment in science parks</header>

			<subsection commented="no" display-inline="no-display-inline" id="IDA0AAEA835A30423C917D6FA8A966316A"><enum>(a)</enum><header>Expensing</header>

				<paragraph commented="no" display-inline="no-display-inline" id="ID301B4B7937D044EC99895DEE13C78DCC"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Section 179(d) of the

			 Internal Revenue Code of 1986 (relating to definitions and special rules) is

			 amended by adding at the end the following new paragraph:</text>

				section to property placed in service in science parks</header>

							<subparagraph commented="no" display-inline="no-display-inline" id="ID6FB98CE2F9A54AB28907E99E6449C141"><enum>(A)</enum><header>In

				general</header><text display-inline="yes-display-inline">In the case of any

				section 179 property placed in service in any science park, this section shall

				be applied without regard to paragraphs (1) and (2) of subsection (b).</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0B67C1920F344A6DA0B40CFB34183A95"><enum>(B)</enum><header>Science

				park</header>

								<clause commented="no" display-inline="no-display-inline" id="id374E9BE242CB42C3B6780D3BDEC446F1"><enum>(i)</enum><header>In

				general</header><text display-inline="yes-display-inline">The term

				<term>science park</term> means a group of interrelated companies and

				institutions, including suppliers, service providers, institutions of higher

				education, start-up incubators, and trade associations that cooperate and

				compete and are located in a specific area whose administration promotes real

				estate development, technology transfer, and partnerships between such

				companies and institutions, and does not mean a business or industrial

				park.</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="id51CD5958CD1549DCA29332D147E1EE2C"><enum>(ii)</enum><header>Business or

				industrial park</header><text display-inline="yes-display-inline">The term

				<term>business or industrial park</term> means primarily a for-profit real

				estate venture of businesses or industries which do not necessarily reinforce

				each other through supply chain or technology transfer

				mechanisms.</text>

								</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID98D87CC257AB47DCB070AEEEFD4A7CC6"><enum>(2)</enum><header>Effective

			 date</header><text display-inline="yes-display-inline">The amendment made by

			 this subsection shall apply with respect to property placed in service after

			 the date of the enactment of this Act.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID8315987A363049348A8E964134DB5D3D"><enum>(b)</enum><header>Tax credit for

			 research activities</header>

				<paragraph commented="no" display-inline="no-display-inline" id="ID3FAC1701BD094E779100F9EDD5C0B285"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Section 41(a) of the

			 Internal Revenue Code of 1986 (relating to credit for increasing research

			 activities) is amended by striking <quote>and</quote> at the end of paragraph

			 (1)(B), by striking the period at the end of paragraph (2) and inserting

			 <quote>, and</quote>, and by adding at the end the following new

			 paragraph:</text>

					<quoted-block display-inline="no-display-inline" id="ID8B882745792B4C0192F414F56491A365" style="OLC">

						<paragraph commented="no" display-inline="no-display-inline" id="ID77606CAE57F645C1B0DC7836A04E7275"><enum>(3)</enum><text display-inline="yes-display-inline">20 percent of the qualified research

				expenses paid or incurred by the taxpayer during the taxable year in carrying

				on any trade or business located in a science

				park.</text>

						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDB0253D0050874780B14EE39A4F153BA6"><enum>(2)</enum><header>Science

			 park</header><text display-inline="yes-display-inline">Section 41(f) of such

			 Code (relating to special rules) is amended by adding at the end the following

			 new paragraph:</text>

			 this subsection shall apply to taxable years beginning after the date of the

			 enactment of this Act.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id9808FC7CFAC846A78FE6CAC46B37CF46"><enum>(c)</enum><header>Private

			 business use of a bond-Financed facility does not include performance of

			 research using Federal Government funding in such facility</header>

				<paragraph commented="no" display-inline="no-display-inline" id="id9D07CE7458F34DFB991A18A6849DAD9C"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Subparagraph (A) of

			 section 141(b)(6) of the Internal Revenue Code of 1986 (defining private

			 business use) is amended by inserting <quote>or use in the performance of

			 research using, in whole or in part, funds of the United States or any agency

			 or instrumentality thereof</quote> before <quote>shall not be taken into

			 account</quote>.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id706B300B456E4485845BC1E884E5A41D"><enum>(2)</enum><header>Effective

			 date</header>

					<subparagraph commented="no" display-inline="no-display-inline" id="idADC66571DC6943478DD3B840237FDB4E"><enum>(A)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The amendment made by

			 this subsection shall apply to any use on or after the date of the enactment of

			 this Act.</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDABB6DA3095CA442DAD5F14969C2DE3BD"><enum>(B)</enum><header>No

			 inference</header><text display-inline="yes-display-inline">Nothing in the

			 amendment made by this subsection shall be construed to create any inference

			 with respect to the use of tax-exempt bond financed facilities before the

			 effective date of such amendment.</text>
