				<header>Findings</header>

				<text display-inline="no-display-inline">Congress finds that—</text>

				<paragraph id="IDCBBCD9BBD7724A568AAD60C15FCDA783">

					<enum>(1)</enum>

					<text>violent crime and drug trafficking are pervasive problems at the

			 national, State, and local level;</text>

				</paragraph><paragraph id="ID6782C0A027A648D693C642AA982FB83C">

					<enum>(2)</enum>

					<text>the crime rate is exacerbated by the association of persons in

			 gangs to commit acts of violence and drug offenses;</text>

				</paragraph><paragraph id="IDFB7152776C5949AD8260842D30BB92FC">

					<enum>(3)</enum>

					<text>according to the most recent National Drug Threat Assessment,

			 criminal street gangs are responsible for the distribution of much of the

			 cocaine, methamphetamine, heroin, and other illegal drugs being distributed in

			 rural and urban communities throughout the United States;</text>

				</paragraph><paragraph id="ID50B10136F428445BA6A1FBE2B69BD321">

					<enum>(4)</enum>

					<text>gangs commit acts of violence or drug offenses for numerous

			 motives, such as membership in or loyalty to the gang, for protecting gang

			 territory, and for profit;</text>

				</paragraph><paragraph id="ID12128193D61D4F6C933A897873DC9FF2">

					<enum>(5)</enum>

					<text>gang presence has a pernicious effect on the free flow of

			 commerce in local businesses and directly affects the freedom and security of

			 communities plagued by gang activity;</text>

				</paragraph><paragraph id="ID4B7F5222B82B428CB4A882E54803482B">

					<enum>(6)</enum>

					<text>gangs often recruit and utilize minors to engage in acts of

			 violence and other serious offenses out of a belief that the criminal justice

			 systems are more lenient on juvenile offenders;</text>

				</paragraph><paragraph id="ID9D99A2EB3F4844DE8A6239A307C10CDF">

					<enum>(7)</enum>

					<text>gangs often intimidate and threaten witnesses to prevent

			 successful prosecutions;</text>

				</paragraph><paragraph id="IDC5F15E8FB2454319A884CAF7AC99F023">

					<enum>(8)</enum>

					<text>gang recruitment can be deterred through increased vigilance,

			 strong criminal penalties, equal partnerships with State and local law

			 enforcement, and proactive intervention efforts, particularly targeted at

			 juveniles, prior to gang involvement;</text>

				</paragraph><paragraph id="IDDFFDA20D2A834F1AA3ABF6339C465857">

					<enum>(9)</enum>

					<text>State and local prosecutors, in hearings before the Committee on

			 the Judiciary of the Senate, enlisted the help of Congress in the prevention,

			 investigation, and prosecution of gang crimes and in the protection of

			 witnesses and victims of gang crimes; and</text>

				</paragraph><paragraph id="ID90011346EA5641A680CBB11271CD33E1">

					<enum>(10)</enum>

					<text>because State and local prosecutors and law enforcement have the

			 expertise, experience, and connection to the community that is needed to combat

			 gang violence, consultation and coordination between Federal, State, and local

			 law enforcement is critical to the successful prosecutions of criminal street

			 gangs.</text>

				<enum>A</enum>

				<header>Criminal law reforms and enhanced penalties To deter and punish

			 illegal street gang activity</header>

					<enum>101.</enum>

					<header>Solicitation or recruitment of persons in criminal street gang

			 activity</header>

					<text display-inline="no-display-inline">Chapter 26 of title 18, United

			 States Code, is amended by adding at the end the following:</text>

							<enum>522.</enum>

							<header>Recruitment of persons to participate in a criminal street

				gang</header>

							<subsection id="ID7CDF73A22A814F689B98E7A009B1AE87">

								<enum>(a)</enum>

								<header>Prohibited acts</header>

								<text>It shall be unlawful for any person to recruit, employ,

				solicit, induce, command, or cause another person to be or remain as a member

				of a criminal street gang, or conspire to do so, with the intent to cause that

				person to participate in an offense described in section 521(a).</text>

							</subsection><subsection id="ID8676F9D69BC24D378DBD2B368476AFA5">

								<enum>(b)</enum>

								<header>Definition</header>

								<text>In this section:</text>

								<paragraph id="ID31B2246C1DCA4284B8CCB56B8516A8D8">

									<enum>(1)</enum>

									<header>Criminal street gang</header>

									<text>The term <term>criminal street gang</term> shall have the same

				meaning as in section 521(a) of this title.</text>

								</paragraph><paragraph id="IDAFF21EFAC6974B8A8834DA529D3D7515">

									<enum>(2)</enum>

									<header>Minor</header>

									<text>The term <term>minor</term> means a person who is less than 18

				years of age.</text>

								</paragraph></subsection><subsection id="ID9804E614D4644CF0A870E879F46DEC1A">

								<enum>(c)</enum>

								<header>Penalties</header>

								<text>Any person who violates subsection (a) shall—</text>

								<paragraph id="ID4264BF882560463493705EC99A14DCFE">

									<enum>(1)</enum>

									<text>be imprisoned not more than 5 years, fined under this title, or

				both; or</text>

								</paragraph><paragraph id="IDD4337A85DF1E42A3A6FC09A748C46148">

									<enum>(2)</enum>

									<text>if the person recruited, solicited, induced, commanded, or

				caused to participate or remain in a criminal street gang is under the age of

				18—</text>

									<subparagraph id="ID584124451E1B46699F380EDE7ED7A7F2">

										<enum>(A)</enum>

										<text>be imprisoned for not more than 10 years, fined under this

				title, or both; and</text>

									</subparagraph><subparagraph id="IDD3876CFCDEAA4C349FF5E4A769545AB2">

										<enum>(B)</enum>

										<text>at the discretion of the sentencing judge, be liable for any

				costs incurred by the Federal Government, or by any State or local government,

				for housing, maintaining, and treating the person until the person attains the

				age of 18 years.</text>

					<header>Criminal street gangs</header>

						<enum>(a)</enum>

						<header>Criminal street gang prosecutions</header>

						<text>Section 521 of title 18, United States Code, is amended to read

			 as follows:</text>

								<enum>521.</enum>

								<header>Criminal street gang prosecutions</header>

								<subsection id="ID773C66B3E5A84981BA780598F7FBAC4B">

									<enum>(a)</enum>

									<header>Definitions</header>

									<text>As used in this chapter:</text>

									<paragraph id="ID155138E282544DE5938F54B63A2A6AE8">

										<enum>(1)</enum>

										<header>Criminal street gang</header>

										<text>The term <term>criminal street gang</term> means a formal or

				informal group, club, organization, or association of 3 or more individuals,

				who individually, jointly, or in combination, have committed or attempted to

				commit for the direct or indirect benefit of, at the direction of, in

				furtherance of, or in association with the group, club organization, or

				association at least 2 separate acts, each of which is a predicate gang crime,

				1 of which occurs after the date of enactment of the Gang Prevention and

				Effective Deterrence Act of 2004 and the last of which occurs not later than 10

				years (excluding any period of imprisonment) after the commission of a prior

				predicate gang crime, and 1 predicate gang crime is a crime of violence or

				involves manufacturing, importing, distributing, possessing with intent to

				distribute, or otherwise dealing in a controlled substance or listed chemicals

				(as those terms are defined in section 102 of the <act-name parsable-cite="CSA">Controlled Substances Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>))

				provided that the activities of the criminal street gang affect interstate or

				foreign commerce, or involve the use of any facility of, or travel in,

				interstate or foreign commerce.</text>

									</paragraph><paragraph id="IDACFD30FB8A084312943637D2B1433DD3">

										<enum>(2)</enum>

										<header>Predicate gang crime</header>

										<text>The term <term>predicate gang crime</term> means—</text>

										<subparagraph id="ID6C88C177833E4074A11899FABE455746">

											<enum>(A)</enum>

											<text>any act, threat, conspiracy, or attempted act, which is

				chargeable under Federal or State law and punishable by imprisonment for more

				than 1 year involving—</text>

												<enum>(i)</enum>

												<text>murder;</text>

												<enum>(ii)</enum>

												<text>manslaughter;</text>

												<enum>(iii)</enum>

												<text>maiming;</text>

												<enum>(iv)</enum>

												<text>assault with a dangerous weapon;</text>

												<enum>(v)</enum>

												<text>assault resulting in serious bodily injury;</text>

												<enum>(vi)</enum>

												<text>gambling;</text>

												<enum>(vii)</enum>

												<text>kidnapping;</text>

												<enum>(viii)</enum>

												<text>robbery;</text>

												<enum>(ix)</enum>

												<text>extortion;</text>

												<enum>(x)</enum>

												<text>arson;</text>

												<enum>(xi)</enum>

												<text>obstruction of justice;</text>

											</clause><clause id="IDF53B0F53153F436CABB99E52C955B6CF">

												<enum>(xii)</enum>

												<text>tampering with or retaliating against a witness, victim, or

				informant;</text>

											</clause><clause id="ID40345A9C6B564F9FA178A7271753CF04">

												<enum>(xiii)</enum>

												<text>burglary;</text>

											</clause><clause id="ID4488AE54E4FA4207B8B712F38C1453D9">

												<enum>(xiv)</enum>

												<text>sexual assault (which means any offense that involves conduct

				that would violate chapter 109A if the conduct occurred in the special maritime

				and territorial jurisdiction);</text>

											</clause><clause id="IDE2843780A20B4F04A99EC9E5C2555BDF">

												<enum>(xv)</enum>

												<text>carjacking; or</text>

											</clause><clause id="IDECA62A3F3B2A4E149978E49E8B232778">

												<enum>(xvi)</enum>

												<text>manufacturing, importing, distributing, possessing with intent

				to distribute, or otherwise dealing in a controlled substance or listed

				chemicals (as those terms are defined in section 102 of the

				<act-name parsable-cite="CSA">Controlled Substances Act</act-name>

				(<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C.

				802</external-xref>));</text>

											</clause></subparagraph><subparagraph id="IDC8CF130E9DD24269B2F7E41561DE8EFD">

											<enum>(B)</enum>

											<text>any act punishable by imprisonment for more than 1 year

				under—</text>

												<enum>(i)</enum>

												<text>section 844 (relating to explosive materials);</text>

											</clause><clause id="ID294CD9EB00AD4C92B0801D91AE7C22BA">

												<enum>(ii)</enum>

												<text>section 922(g)(1) (where the underlying conviction is a violent

				felony (as defined in section 924(e)(2)(B) of this title) or is a serious drug

				offense (as defined in section 924(e)(2)(A) of this title));</text>

												<text>subsection (a)(2), (b), (c), (g), or (h) of section 924

				(relating to receipt, possession, and transfer of firearms);</text>

												<enum>(iv)</enum>

												<text>sections 1028 and 1029 (relating to fraud and related activity

				in connection with identification documents or access devices);</text>

												<text>section 1503 (relating to obstruction of justice);</text>

				informant), or section 1513 (relating to retaliating against a witness, victim,

				or informant);</text>

												<text>section 1708 (relating to theft of stolen mail matter);</text>

				or extortion);</text>

												<text>section 1957 (relating to engaging in monetary transactions in

				property derived from specified unlawful activity);</text>

												<text>section 1958 (relating to use of interstate commerce facilities

				in the commission of murder-for-hire); or</text>

												<enum>(xiv)</enum>

												<text>sections 2312 through 2315 (relating to interstate

				transportation of stolen motor vehicles or stolen property); or</text>

											</clause></subparagraph><subparagraph id="ID933B6BD5FBF6484CA04399A9FBDBA771">

											<enum>(C)</enum>

											<text>any act involving the <act-name parsable-cite="INA">Immigration

				and Nationality Act</act-name>, section 274 (relating to bringing in and

				harboring certain aliens), section 277 (relating to aiding or assisting certain

				aliens to enter the United States), or section 278 (relating to importation of

				alien for immoral purpose).</text>

										</subparagraph></paragraph><paragraph id="ID29079751B97A483882A61C3AE433C666">

										<enum>(3)</enum>

										<header>State</header>

										<text>The term <term>State</term> means each of the several States of

				the United States, the District of Columbia, and any commonwealth, territory,

				or possession of the United States.</text>

									</paragraph></subsection><subsection id="ID888E687978224484ABC70B7ADF560557">

									<enum>(b)</enum>

									<header>Participation in criminal street gangs</header>

									<text>It shall be unlawful—</text>

									<paragraph id="ID9D7E4F0673994ECAA7384D2C07147823">

										<enum>(1)</enum>

										<text>to commit, or conspire or attempt to commit a predicate

				crime—</text>

										<subparagraph id="ID56E533543B6F42AFB9DE5AB8ABDA2181">

											<enum>(A)</enum>

											<text>in furtherance or in aid of the activities of a criminal street

				gang;</text>

										</subparagraph><subparagraph id="ID78BA65E940EF4BFBA123EFA3593F3021">

											<enum>(B)</enum>

											<text>for the purpose of gaining entrance to or maintaining or

				increasing position in such a gang; or</text>

										</subparagraph><subparagraph id="ID2F00FC08053847AFAC45FA785E63D76F">

											<enum>(C)</enum>

											<text>for the direct or indirect benefit of the criminal street gang,

				or in association with the criminal street gang; or</text>

										</subparagraph></paragraph><paragraph id="ID539BF65E1D834AFBBE485417AFAE8600">

										<enum>(2)</enum>

										<text>to employ, use, command, counsel, persuade, induce, entice, or

				coerce any individual to commit, cause to commit, or facilitate the commission

				of, a predicate gang crime—</text>

										<subparagraph id="ID1C8BFCE87365405EBEAB48135E6A5302">

											<enum>(A)</enum>

											<text>in furtherance or in aid of the activities of a criminal street

				gang;</text>

										</subparagraph><subparagraph id="ID93BDD712AB6F4255B501EDEA45964B95">

											<enum>(B)</enum>

											<text>for the purpose of gaining entrance to or maintaining or

				increasing position in such a gang; or</text>

										</subparagraph><subparagraph id="IDE9CBD6255CB24F9385D9F701E3F0C6C7">

											<enum>(C)</enum>

											<text>for the direct or indirect benefit or the criminal street gang,

				or in association with the criminal street gang.</text>

									<text>Whoever violates paragraph (1) or (2) of subsection (b)—</text>

										<text>shall be fined under this title, imprisoned for not more than

				30 years, or both; and</text>

				the maximum penalty includes life imprisonment, shall be fined under this

									<header>Forfeiture</header>

										<text>The court, in imposing sentence on a person who is convicted of

				an offense under this section, shall order that the defendant forfeit to the

				United States—</text>

											<enum>(A)</enum>

											<text>any property, real or personal, constituting or traceable to

				gross proceeds obtained from such offense; and</text>

											<text>any property used or intended to be used, in any manner or

				part, to commit or to facilitate the commission of such violation.</text>

				commits any other crime of violence or threatens to commit a crime of violence

				against any individual, or attempts or conspires to do so, shall be punished,

				in addition and consecutive to the punishment provided for any other violation

							<text>The term <term>Governor</term> means a Governor of a State or the

			 Mayor of the District of Columbia.</text>

							<enum>(2)</enum>

							<header>High intensity interstate gang activity area</header>

							<text>The term <term>high intensity interstate gang activity

			 area</term> means an area within a State that is designated as a high intensity

			 interstate gang activity area under subsection (b)(1).</text>

							<enum>(3)</enum>

							<header>State</header>

							<text>The term <term>State</term> means a State of the United States,

			 the District of Columbia, and any commonwealth, territory, or possession of the

			 United States. The term <term>State</term> shall include an <quote>Indian

			 tribe</quote>, as defined by section 102 of the Federally Recognized Indian

			 Tribe List Act of 1994 (25 U.S.C. 479a).</text>

						<enum>(b)</enum>

						<header>High intensity interstate gang activity areas</header>

						<paragraph id="IDC9413DAF65844C79A12692B96F2E2E1D">

							<enum>(1)</enum>

							<header>Designation</header>

							<text>The Attorney General, after consultation with the Governors of

			 appropriate States, may designate as high intensity interstate gang activity

			 areas, specific areas that are located within 1 or more States. To the extent

			 that the goals of a high intensity interstate gang activity area (HIIGAA)

			 overlap with the goals of a high intensity drug trafficking area (HIDTA), the

			 Attorney General may merge the 2 areas to serve as a dual-purpose entity. The

			 Attorney General may not make the final designation of a high intensity

			 interstate gang activity area without first consulting with and receiving

			 comment from local elected officials representing communities within the State

			 of the proposed designation.</text>

						</paragraph><paragraph id="ID1098EA0D311645B0B83280B82E4BF002">

							<enum>(2)</enum>

							<header>Assistance</header>

							<text>In order to provide Federal assistance to high intensity

			 interstate gang activity areas, the Attorney General shall—</text>

							<subparagraph id="ID32DDDE97F4CB44A7BD051AEA70E14725">

								<enum>(A)</enum>

								<text>establish criminal street gang enforcement teams, consisting of

			 Federal, State, and local law enforcement authorities, for the coordinated

			 investigation, disruption, apprehension, and prosecution of criminal street

			 gangs and offenders in each high intensity interstate gang activity

			 area;</text>

							</subparagraph><subparagraph id="IDE906DEDF6EC0444C80DAAF05D826E9C8">

								<enum>(B)</enum>

								<text>direct the reassignment or detailing from any Federal department

			 or agency (subject to the approval of the head of that department or agency, in

			 the case of a department or agency other than the Department of Justice) of

			 personnel to each criminal street gang enforcement team; and</text>

							</subparagraph><subparagraph id="ID839973F27572441CA66F727B80D0F0FA">

								<enum>(C)</enum>

								<text>provide all necessary funding for the operation of the criminal

			 street gang enforcement team in each high intensity interstate gang activity

			 area.</text>

							</subparagraph></paragraph><paragraph id="IDF5C8DC89BCFC4C49B7DEEA55608107B7">

							<enum>(3)</enum>

							<header>Composition of criminal street gang enforcement team</header>

							<text>The team established pursuant to paragraph (2)(A) shall consist

			 of agents and officers, where feasible, from—</text>

								<text>the Bureau of Alcohol, Tobacco, Firearms, and Explosives;</text>

								<text>Federal, State and local prosecutors.</text>

							<header>Criteria for designation</header>

							<text>In considering an area for designation as a high intensity

			 interstate gang activity area under this section, the Attorney General shall

			 consider—</text>

							<subparagraph id="ID7F5038A0127348878187CEEFC2BE1451">

								<enum>(A)</enum>

								<text>the current and predicted levels of gang crime activity in the

			 area;</text>

							</subparagraph><subparagraph id="IDCE46F0DD3E7D441E8B8375A66EEA0061">

								<enum>(B)</enum>

								<text>the extent to which violent crime in the area appears to be

			 related to criminal street gang activity, such as drug trafficking, murder,

			 robbery, assaults, carjacking, arson, kidnapping, extortion, and other criminal

			 activity;</text>

							</subparagraph><subparagraph id="ID9A9EBF62216B4110BAA74F71AA581039">

								<enum>(C)</enum>

								<text>the extent to which State and local law enforcement agencies have

			 committed resources to—</text>

								<clause id="ID15D8EE5CF38D40588ACCF255EA22A9E3">

									<enum>(i)</enum>

									<text>respond to the gang crime problem; and</text>

								</clause><clause id="IDE4DCEA691C544C1489F37477BD29CECC">

									<enum>(ii)</enum>

									<text>participate in a gang enforcement team;</text>

								</clause></subparagraph><subparagraph id="ID98724F73F57C408C8224E2769F7AD2CA">

								<enum>(D)</enum>

								<text>the extent to which a significant increase in the allocation of

			 Federal resources would enhance local response to the gang crime activities in

			 the area; and</text>

							</subparagraph><subparagraph id="IDB44AD0067B924364BCF5D2BC57D23514">

								<enum>(E)</enum>

								<text>any other criteria that the Attorney General considers to be

			 appropriate.</text>

						<header>Authorization of appropriations</header>

							<text>There are authorized to be appropriated $100,000,000 for each of

			 the fiscal years 2005 to 2009 to carry out this section.</text>

							<header>Reporting requirements</header>

							<text>By February 1st of each year, the Attorney General shall provide

			 a report to Congress which describes, for each designated high intensity

			 interstate gang activity area—</text>

							<subparagraph id="ID6FBE0FB9CB7F42B097D4C06A6E031028">

								<enum>(A)</enum>

								<text>the specific long-term and short-term goals and

			 objectives;</text>

							</subparagraph><subparagraph id="ID3ECC36F6321E427693046A87B91D2AEF">

								<enum>(B)</enum>

								<text>the measurements used to evaluate the performance of the high

			 intensity interstate gang activity area in achieving the long-term and

			 short-term goals;</text>

							</subparagraph><subparagraph id="IDB9528184CE4742D78B5908D6099C204A">

								<enum>(C)</enum>

								<text>the age, composition, and membership of

			 <quote>gangs</quote>;</text>

							</subparagraph><subparagraph id="IDDDEB5BE6F4AD412F86C43F56BB755D13">

								<enum>(D)</enum>

								<text>the number and nature of crimes committed by

			 <quote>gangs</quote>; and</text>

						<text>While maintaining the focus of Project Safe Neighborhoods as a

			 comprehensive, strategic approach to reducing gun violence in America, the

			 Attorney General is authorized to expand the Project Safe Neighborhoods program

			 to require each United States attorney to—</text>

							<text>identify, investigate, and prosecute significant criminal street

							<text>coordinate and establish criminal street gang enforcement teams,

			 established under section 110(b), in high intensity interstate gang activity

				commerce with the intent to commit one or more murders in violation of the laws

				of any State or the United States, and thereafter commits one or more murders

				in violation of the laws of any State or the United States in furtherance of a

				common scheme or purpose, or who conspires to do so—</text>

							<paragraph id="ID2CCECA946ECB4D32AA44F2EB97C7216C">

								<enum>(1)</enum>

								<text>shall be fined under this title, imprisoned for not more than

				30 years, or both, for each murder; and</text>

							</paragraph><paragraph id="IDFC180E0AC0EE44F3893561BF530CA970">

								<enum>(2)</enum>

								<text>if death results, may be fined not more than $250,000 under

				this title, and shall be punished by death or imprisoned for any term of years

				or for life for each murder.</text>

			 and punish such offenses;</text>

					</paragraph><paragraph id="ID2A6AB00D4E5344BE99B977DDF26E746F">

						<enum>(3)</enum>

						<text>consider the extent to which the guidelines and policy statements

			 adequately address—</text>

						<subparagraph id="IDCB9E2573465149F2A0C6E5904BF34646">

							<enum>(A)</enum>

							<text>whether the guideline offense levels and enhancements for gang

			 and violent crimes—</text>

							<clause id="ID9BC1665FEB43424A9FF363BCFB07047C">

								<enum>(i)</enum>

								<text>are sufficient to deter and punish such offenses; and</text>

							</clause><clause id="ID6DC7838A6F874E4AB044768A586302CB">

								<enum>(ii)</enum>

								<text>are adequate in view of the statutory increases in penalties

			 contained in the Act; and</text>

							</clause></subparagraph><subparagraph id="IDE3D622E6F6B24CEB9EDE7AB1A6FEE20B">

							<enum>(B)</enum>

							<text>whether any existing or new specific offense characteristics

			 should be added to reflect congressional intent to increase gang and violent

			 crime penalties, punish offenders, and deter gang and violent crime;</text>

						<enum>(4)</enum>

						<text>assure reasonable consistency with other relevant directives and

			 with other sentencing guidelines;</text>

						<text>account for any additional aggravating or mitigating

			 circumstances that might justify exceptions to the generally applicable

			 sentencing ranges;</text>

						<text>make any necessary conforming changes to the sentencing

			 guidelines; and</text>

									<text>in the case of 1 such prior conviction, where a period of not

				more than 10 years has elapsed since the date of conviction or release of the

								</subparagraph><subparagraph id="ID02CF31D92C4F4668B70A3E7642AF31DA" indent="up1">

									<enum>(B)</enum>

									<text>in the case of 2 such prior convictions, committed on occasions

				different from one another, and where a period of not more than 10 years has

				elapsed since the date of conviction or release of the person from imprisonment

				for that conviction, be subject to imprisonment for not more than 20 years, a

				fine under this title, or both; and</text>

								</subparagraph><subparagraph id="ID51A249FB4BEF4F8A93171D0A53BDB1CA" indent="up1">

									<enum>(C)</enum>

									<text>in the case of 3 such prior convictions, committed on occasions

				different from one another, be subject to imprisonment for not less than 15

				years, a fine under this title, or both, and notwithstanding any other

				provision of law, the court shall not suspend the sentence of, or grant a

				probationary sentence to, such person with respect to the conviction under

				section 922(g).</text>

				Substances Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/801">21 U.S.C. 801</external-xref> et seq.), the

				Controlled Substances Import and Export Act (<external-xref legal-doc="usc" parsable-cite="usc/21/951">21 U.S.C. 951</external-xref> et seq.), or the

				Maritime Drug Law Enforcement Act (<external-xref legal-doc="usc" parsable-cite="usc/46/App">46 U.S.C. App</external-xref>. 1901

				et seq.), punishable by a maximum term of imprisonment of not less than 10

				years; or</text>

									</clause><clause id="ID9C14E34D52FC4429AD18E4EEB08C99F9">

										<enum>(ii)</enum>

										<text>an offense under State law, involving manufacturing,

				distributing, or possessing with intent to manufacture or distribute, a

				controlled substance (as defined in section 102 of the

				<act-name parsable-cite="CSA">Controlled Substances Act</act-name>

				(<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C.

				802</external-xref>)), punishable by a maximum term of imprisonment of not less

				than 10 years;</text>

									</clause></subparagraph><subparagraph id="ID112F000590FF43CF8773FA1B165B24A8">

									<enum>(B)</enum>

									<text>the term <term>violent felony</term> means any crime punishable

				by a term of imprisonment exceeding 1 year, or any act of juvenile delinquency

				involving the use or carrying of a firearm, knife, or destructive device that

				would be punishable by a maximum term of imprisonment for such term if

				committed by an adult, that—</text>

										<enum>(i)</enum>

										<text>has, as an element of the crime or act, the use, attempted use,

				or threatened use of physical force against the person of another; or</text>

										<text>is burglary, arson, or extortion, involves the use of

				explosives, or otherwise involves conduct that presents a serious potential

				risk of physical injury to another; and</text>

									<enum>(C)</enum>

									<text>the term <term>conviction</term> includes a finding that a

				person has committed an act of juvenile delinquency involving a violent

				felony.</text>

				section 1002(a), 1003, 1005, 1009, or 1010(b) (1), (2), or (3) of the

				Controlled Substances Import and Export Act (<external-xref legal-doc="usc" parsable-cite="usc/21/952(a)">21 U.S.C. 952(a)</external-xref>, 953, 955, 959,

				960(b) (1), (2), (3)), section 922(x), or section 924 (b), (g), or (h) of this

				title, and there is a substantial Federal interest in the case or the offense

				to warrant the exercise of Federal jurisdiction.</text>

									</subparagraph></paragraph><paragraph id="IDE1D2FF2B74634479BE3191447F793577">

									<enum>(2)</enum>

									<header>Failure to certify</header>

									<text>If the Attorney General does not certify under paragraph (1),

				the juvenile shall be surrendered to the appropriate legal authorities of such

				State.</text>

								</paragraph><paragraph id="ID0AAD279C9C2146D89A0FEF00387284C9">

									<enum>(3)</enum>

									<header>Federal proceedings</header>

									<text>If an alleged juvenile delinquent is not surrendered to the

				authorities of a State pursuant to this section, any proceedings against him

				shall be in an appropriate district court of the United States. For such

				purposes, the court may be convened at any time and place within the district,

				in chambers or otherwise. The Attorney General shall proceed by information or

				as authorized under section 3401(g) of this title, and no criminal prosecution

				shall be instituted for the alleged act of juvenile delinquency except as

				provided below.</text>

								</paragraph></subsection><subsection id="ID7C5CE797C9FF4BA895DCA09F18920D94">

								<enum>(b)</enum>

								<header>Transfer for Federal criminal prosecution</header>

								<paragraph id="IDEF91FAEDE6FE47C5BC8F844019A2961C">

									<enum>(1)</enum>

									<header>In general</header>

									<text>A juvenile who is alleged to have committed an act of juvenile

				delinquency and who is not surrendered to State authorities shall be proceeded

				against under this chapter unless—</text>

									<subparagraph id="ID6638B4A5EF7441D0B032FD4F49CA46E6">

										<enum>(A)</enum>

										<text>the juvenile has requested in writing upon advice of counsel to

				be proceeded against as an adult;</text>

									</subparagraph><subparagraph id="IDF968A9BDA30647FBB7000B7AC2B5356A">

										<enum>(B)</enum>

										<text>with respect to a juvenile 15 years and older alleged to have

				committed an act after his fifteenth birthday which if committed by an adult

				would be a felony that is a crime of violence or an offense described in

				section 401 of the <act-name parsable-cite="CSA">Controlled Substances

				Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/841">21

				U.S.C. 841</external-xref>), or section 1002(a), 1005, or 1009 of the

				Controlled Substances Import and Export Act (<external-xref legal-doc="usc" parsable-cite="usc/21/952(a)">21 U.S.C. 952(a)</external-xref>, 955, 959), or

				section 922(x) of this title, or in section 924 (b), (g), or (h) of this title,

				the Attorney General makes a motion to transfer the criminal prosecution on the

				basis of the alleged act in the appropriate district court of the United States

				and the court finds, after hearing, such transfer would be in the interest of

				justice as provided in paragraph (2); or</text>

									</subparagraph><subparagraph id="IDA915923BB22D44B68DED644250013569">

										<enum>(C)</enum>

										<text>with respect to a juvenile 13 years and older alleged to have

				committed an act after his thirteenth birthday which if committed by an adult

				would be a felony that is the crime of violence under section 113 (a), (b),

				(c), 1111, 1113, or, if the juvenile possessed a firearm during the offense, an

				offense under section 2111, 2113, 2241(a), or 2241(c), the Attorney General

				makes a motion to transfer the criminal prosecution on the basis of the alleged

				act in the appropriate district court of the United States and the court finds,

				after hearing, such transfer would be in the interest of justice as provided in

				paragraph (2).</text>

									</subparagraph><continuation-text continuation-text-level="paragraph">Notwithstanding sections 1152 and

				1153, no person subject to the criminal jurisdiction of an Indian tribal

				government shall be subject to subparagraph (C) for any offense the Federal

				jurisdiction for which is predicated solely on Indian country (as defined in

				section 1151), and which has occurred within the boundaries of such Indian

				country, unless the governing body of the tribe has elected that the preceding

				sentence have effect over land and persons subject to its criminal

				jurisdiction.</continuation-text></paragraph><paragraph id="ID7BD58114C7834BD2A41EC54606BB2E27">

									<enum>(2)</enum>

									<header>Factors</header>

									<subparagraph id="IDBA005B36474E45048817062AB0D2730F">

										<enum>(A)</enum>

										<header>In general</header>

										<text>Evidence of the following factors shall be considered, and

				findings with regard to each factor shall be made in the record, in assessing

				whether a transfer under subparagraph (B) or (C) of paragraph (1), and

				paragraph (4) of subsection (d), would be in the interest of justice:</text>

										<clause id="IDC8CAC20F0E2E4FC0AE9F62D482B53B6C">

											<enum>(i)</enum>

											<text>The age and social background of the juvenile.</text>

										</clause><clause id="ID718FD3705D474D70B3753A559A8C8AAE">

											<enum>(ii)</enum>

											<text>The nature of the alleged offense, including the extent to

				which the juvenile played a leadership role in an organization, or otherwise

				influenced other persons to take part in criminal activities.</text>

										</clause><clause id="ID8AD4D0AE772B4906A98AAED7EB1EB921">

											<enum>(iii)</enum>

											<text>Whether prosecution of the juvenile as an adult would protect

				public safety.</text>

										</clause><clause id="IDE5457965E3424462857638C3F71E201D">

											<enum>(iv)</enum>

											<text>The extent and nature of the juvenile’s prior delinquency

				record.</text>

										</clause><clause id="IDA41AD55254D64653B9F9843D73C5BFEF">

											<enum>(v)</enum>

											<text>The juvenile’s present intellectual development and

				psychological maturity.</text>

										</clause><clause id="ID59C8925B90C345CC940B392C55F39F4E">

											<enum>(vi)</enum>

											<text>The nature of past treatment efforts and the juvenile’s

				response to such efforts.</text>

										</clause><clause id="IDF8BB608F2ADB464782AA7452F61F1A41">

											<enum>(vii)</enum>

											<text>The availability of programs designed to treat the juvenile’s

				behavioral problems.</text>

										</clause></subparagraph><subparagraph id="IDFD2FC9C0455D48CBA8D64B392E61EC29">

										<enum>(B)</enum>

										<header>Nature of the offense</header>

										<text>In considering the nature of the offense, as required by this

				paragraph, the court shall consider the extent to which the juvenile played a

				leadership role in an organization, or otherwise influenced other persons to

				take part in criminal activities, involving the use or distribution of

				controlled substances or firearms. Such a factor, if found to exist, shall

				weigh in favor of a transfer to adult status, but the absence of this factor

				shall not preclude such a transfer.</text>

									</subparagraph><subparagraph id="IDBC5BBE362BF248049DE0ED35C05BBCAD">

										<enum>(C)</enum>

										<header>Notice</header>

										<text>Reasonable notice of the transfer hearing under subparagraph

				(B) or (C) of paragraph (1) shall be given to the juvenile, the juvenile’s

				parents, guardian, or custodian and to the juvenile’s counsel. The juvenile

				shall be assisted by counsel during the transfer hearing, and at every other

				critical stage of the proceedings.</text>

									</subparagraph></paragraph></subsection><subsection id="IDD3FD5D2BFD5B4BA2AEEE5F7ED0267629">

								<enum>(c)</enum>

								<header>Mandatory transfer of juvenile 16 or older</header>

								<text>A juvenile who is alleged to have committed an act on or after

				his sixteenth birthday, which if committed by an adult would be a felony

				offense, that has an element thereof the use, attempted use, or threatened use

				of physical force against the person of another, or that, by its very nature,

				involves a substantial risk that physical force against the person of another,

				may be used in committing the offense or would be an offense described in

				section 32, 81, or 2275 or subsection (d), (e), (f), (h), or (i) of section 844

				of this title, subsection (d) or (e) or subparagraphs (A), (B), (C), (D), or

				(E) of subsection (b)(1) of section 401 of the <act-name parsable-cite="CSA">Controlled Substances Act</act-name>, or section 1002(a),

				1003, or 1009, or paragraphs (1), (2), or (3) of section 1010(b) of the

				Controlled Substances Import and Export Act (<external-xref legal-doc="usc" parsable-cite="usc/21/952(a)">21 U.S.C. 952(a)</external-xref>, 953, 959,

				960(b) (1), (2), and (3)), and who has previously been found guilty of an act

				which if committed by an adult would have been one of the offenses set forth in

				this subsection or subsection (b), or an offense in violation of a State felony

				statute that would have been such an offense if a circumstance giving rise to

				Federal jurisdiction had existed, shall be transferred, upon notification by

				the United States, to the appropriate district court of the United States for

				criminal prosecution.</text>

							</subsection><subsection id="IDF9582254467846739340CC9C31619B13">

								<enum>(d)</enum>

								<header>Sixteen and seventeen year olds charged with the most serious

				violent felonies</header>

								<paragraph id="ID65683194ED8143CFA235A8F90EED90DF">

									<enum>(1)</enum>

									<header>In general</header>

									<text>Notwithstanding any other provision of law, a juvenile may be

				prosecuted as an adult if the juvenile is alleged to have committed, conspired,

				solicited or attempted to commit, on or after the day the juvenile attains the

				age of 16 any offense involving—</text>

									<subparagraph id="IDE507572462244EFB9276467D311C071E">

										<enum>(A)</enum>

										<text>murder;</text>

									</subparagraph><subparagraph id="ID4CC3B9C2C0E74C02A9149CFB23B1038F">

										<enum>(B)</enum>

										<text>manslaughter;</text>

									</subparagraph><subparagraph id="ID4721D4627AC34D7B95079C94F85AC27D">

										<enum>(C)</enum>

										<text>assault with intent to commit murder;</text>

									</subparagraph><subparagraph id="ID722342DC53674F46A6D4F36C5C519751">

										<enum>(D)</enum>

										<text>sexual assault (which means any offense that involves conduct

				that would violate chapter 109A if the conduct occurred in the special maritime

				and territorial jurisdiction);</text>

									</subparagraph><subparagraph id="IDD0DB9117C0B84B9794B8273387679360">

										<enum>(E)</enum>

										<text>robbery (as described in section 2111, 2113, or 2118);</text>

									</subparagraph><subparagraph id="ID1FF42D7AA1E9442F95E551D3CE4E97BB">

										<enum>(F)</enum>

										<text>carjacking with a dangerous weapon;</text>

									</subparagraph><subparagraph id="IDD906B8510BCC4183ADFF937BB34E31AB">

										<enum>(G)</enum>

										<text>extortion;</text>

									</subparagraph><subparagraph id="IDC13BEC74A61041A89F754E67754F8958">

										<enum>(H)</enum>

										<text>arson;</text>

									</subparagraph><subparagraph id="ID64FD5E7533B141BE91A7026E2EFBBCC3">

										<enum>(I)</enum>

										<text>firearms use;</text>

									</subparagraph><subparagraph id="IDC66C767450754F0AB810DF6E1EE123CF">

										<enum>(J)</enum>

										<text>firearms possession (as described in section 924(c);</text>

									</subparagraph><subparagraph id="ID4A2269C338E74A909FBB17BAA2EF969F">

										<enum>(K)</enum>

										<text>drive-by shooting;</text>

									</subparagraph><subparagraph id="IDFE97208B390A4E7F9EB874ABF96A596E">

										<enum>(L)</enum>

										<text>kidnapping;</text>

									</subparagraph><subparagraph id="ID81A534C41504490FA9DE5D276A9BBF00">

										<enum>(M)</enum>

										<text>maiming;</text>

									</subparagraph><subparagraph id="ID1718E6DEC8924E47A157536939A1B029">

										<enum>(N)</enum>

										<text>assault resulting in serious bodily injury; or</text>

									</subparagraph><subparagraph id="IDC6EB60778DF845879991D00F834C2FAF">

										<enum>(O)</enum>

										<text>obstruction of justice (as described in 1512(a)(1)) on or after

				the day the juvenile attains the age of 16.</text>

									</subparagraph></paragraph><paragraph id="ID31144E7FBA504A72BF7129AC8EB7216A">

									<enum>(2)</enum>

									<header>Other offenses</header>

									<text>In a prosecution under this subsection the juvenile may be

				prosecuted and convicted as an adult for any other offense which is properly

				joined under the Federal Rules of Criminal Procedure, and may also be convicted

				as an adult of a lesser included offense.</text>

								</paragraph><paragraph id="ID22D4CAC4692F49DD94E155C989706C25">

									<enum>(3)</enum>

									<header>Reviewability</header>

									<text>Except as otherwise provided by this subsection, a

				determination to approve or not to approve, or to institute or not to

				institute, a prosecution under this subsection shall not be reviewable in any

				court.</text>

								</paragraph><paragraph id="IDB0CFC3545F2C465B833699F4608307C2">

									<enum>(4)</enum>

									<header>Prosecution</header>

									<subparagraph commented="no" display-inline="yes-display-inline" id="ID5C2D44B1ED5443B4AC57B5021A095629"><enum>(A)</enum>

										<text>In any prosecution of a juvenile under this subsection, upon

				motion of the defendant, the court in which the criminal charges have been

				filed shall after a hearing determine whether to issue an order that the

				defendant should be transferred to juvenile status.</text>

									</subparagraph><subparagraph id="IDA88A14CF50CB4E3C98DC0DF93F80F2AC" indent="up1">

										<enum>(B)</enum>

										<text>A motion by a defendant under this paragraph shall not be

				considered unless filed no later than 30 days after the date on which the

				defendant initially appears through counsel or expressly waives the right to

				counsel and elects to proceed pro se.</text>

									</subparagraph><subparagraph id="ID2D6E9A238EA6490882040359E9B2D856" indent="up1">

										<enum>(C)</enum>

										<text>The court shall not order the transfer of a defendant to

				juvenile status under this paragraph unless the defendant establishes by clear

				and convincing evidence that removal to juvenile status would be in the

				interest of justice. In making a determination under this paragraph, the court

				shall consider the factors specified in subsection (b)(2) of this

				section.</text>

									</subparagraph></paragraph><paragraph id="IDEFB7EDE100BD40F5ACCA1E42253D6EE6">

									<enum>(5)</enum>

									<header>Order</header>

									<text>An order of the court made in ruling on a motion by a defendant

				to transfer a defendant to juvenile status under this subsection shall not be a

				final order for the purpose of enabling an appeal, except that an appeal by the

				United States shall lie to a court of appeals pursuant to section 3731 of this

				title from an order of a district court removing a defendant to juvenile

				status. Upon receipt of a notice of appeal of an order under this paragraph, a

				court of appeals shall hear and determine the appeal on an expedited basis. The

				court of appeals shall give due regard to the opportunity of the district court

				to judge the credibility of the witnesses, and shall accept the findings of

				fact of the district court unless they are clearly erroneous, and the court of

				appeals shall review de novo the district court’s application of the law to the

				facts.</text>

								</paragraph></subsection><subsection id="IDF92791ECBAA7440294B55F6224B832A6">

								<enum>(e)</enum>

								<header>Sixteen and seventeen year olds charged with other serious

				violent felonies</header>

								<paragraph id="IDDE46508547A1403B8C13EA0B2B1391A6">

									<enum>(1)</enum>

									<header>In general</header>

									<text>Except as provided by subsection (d), a juvenile may be

				prosecuted as an adult if the juvenile is alleged to have committed an act on

				or after the day the juvenile attains the age of 16 which is committed by an

				adult would be a serious violent felony as described in paragraphs (2) and (3)

				of section 3559(a).</text>

								</paragraph><paragraph id="ID7D5DDBAE074F4C68BC9FD01084D0CCEF">

									<enum>(2)</enum>

									<header>Other offenses</header>

									<text>In a prosecution under this subsection the juvenile may be

				prosecuted and convicted as an adult for any other offense which is properly

				joined under the Federal Rules of Criminal Procedure, and may also be convicted

				as an adult of a lesser included offense.</text>

								</paragraph><paragraph id="IDA7EDB97174AF41E4A132062AC112E1EB">

									<enum>(3)</enum>

									<header>Reviewability</header>

									<text>Except as otherwise provided by this subsection, a

				determination to approve or not to approve, or to institute or not to

				institute, a prosecution under this subsection shall not be reviewable in any

				court.</text>

								</paragraph><paragraph id="ID09F6F1185C79424CA8A1E55EEA9DAFC0">

									<enum>(4)</enum>

				section.</text>

									</subparagraph></paragraph><paragraph id="ID483E227261624EFAB76FD8A3809D20B3">

									<enum>(5)</enum>

									<header>Order</header>

									<text>An order of the court made in ruling on a motion by a defendant

				to transfer a defendant to juvenile status under this subsection shall be a

				final order for the purpose of enabling an appeal. Upon receipt of a notice of

				appeal of an order under this paragraph, a court of appeals shall hear and

				determine the appeal on an expedited basis. The court of appeals shall give due

				regard to the opportunity of the district court to judge the credibility of the

				witnesses, and shall accept the findings of fact of the district court unless

				they are clearly erroneous, and the court of appeals shall review de novo the

								</paragraph></subsection><subsection id="IDDD575A1BBF4C4A47ACD45DAB3ABAB8B7">

								<enum>(f)</enum>

								<header>Proceedings</header>

								<paragraph id="ID6E8696F707FE42A6AB339B3B5A1896F9">

									<enum>(1)</enum>

									<header>Subsequent proceeding barred</header>

									<text>Once a juvenile has entered a plea of guilty or the proceeding

				has reached the stage that evidence has begun to be taken with respect to a

				crime or an alleged act of juvenile delinquency subsequent criminal prosecution

				or juvenile proceedings based upon such alleged act of delinquency shall be

				barred.</text>

								</paragraph><paragraph id="ID1519D20A372C406E99D6F87F995D79A8">

									<enum>(2)</enum>

									<header>Statements</header>

									<text>Statements made by a juvenile prior to or during a transfer

				hearing under this section shall not be admissible at subsequent criminal

				prosecutions except for impeachment purposes or in a prosecution for perjury or

				making a false statement.</text>

								</paragraph><paragraph id="IDB714D9842E9A4506A82DDDC0D9661707">

									<enum>(3)</enum>

									<header>Further proceedings</header>

									<text>Whenever a juvenile transferred to district court under

				subsection (b) or (c) is not convicted of the crime upon which the transfer was

				based or another crime which would have warranted transfer had the juvenile

				been initially charged with that crime, further proceedings concerning the

				juvenile shall be conducted pursuant to the provisions of this chapter.</text>

								</paragraph><paragraph id="ID9E1EEBB9CECD4934BD02B5DA573FE051">

									<enum>(4)</enum>

									<header>Receipt of records</header>

									<text>A juvenile shall not be transferred to adult prosecution under

				subsection (b) nor shall a hearing be held under section 5037 (disposition

				after a finding of juvenile delinquency) until any prior juvenile court records

				of such juvenile have been received by the court, or the clerk of the juvenile

				court has certified in writing that the juvenile has no prior record, or that

				the juvenile’s record is unavailable and why it is unavailable.</text>

								</paragraph><paragraph id="IDF9822338A4F94583AFBD5CA88F28AA66">

									<enum>(5)</enum>

									<header>Specific acts described</header>

									<text>Whenever a juvenile is adjudged delinquent pursuant to the

				provisions of this chapter, the specific acts which the juvenile has been found

				to have committed shall be described as part of the official record of the

				proceedings and part of the juvenile’s official record.</text>

								</paragraph></subsection><subsection id="IDCE76FAC561B14F329D07B3EF5A0E1F50">

								<enum>(g)</enum>

								<header>State</header>

								<text>For purposes of this section, the term <term>State</term>

				includes a State of the United States, the District of Columbia, and any

				commonwealth, territory, or possession of the United States.</text>

								<header>Release of certain juveniles</header>

									<enum>(1)</enum>

									<header>In general</header>

									<text>A juvenile, who is to be tried as an adult under section 5032,

				shall be released pending trial in accordance with the applicable provisions of

				chapter 207.</text>

								</paragraph><paragraph id="ID6B9ADA1F186D4F08B2FEFEAC7344A666">

									<enum>(2)</enum>

									<header>Conditions</header>

									<text>A release under paragraph (1) shall be conducted in the same

				manner, and shall be subject to the same terms, conditions, and sanctions for

				violation of a release condition, as provided for an adult under chapter

				207.</text>

								</paragraph></subsection><subsection id="ID2918BCDB73324E1AB152EA3CD81EF559">

								<enum>(d)</enum>

								<header>Penalty for an offense committed while on release</header>

								<paragraph id="ID99044EB6CDB04C329BD862BC66B90B35">

									<enum>(1)</enum>

									<header>In general</header>

									<text>A juvenile alleged to have committed, while on release under

				this section, an offense that, if committed by an adult, would be a Federal

				criminal offense, shall be subject to prosecution under section 5032.</text>

								</paragraph><paragraph id="IDDB683C1A64AA42239800801F5D70E3F5">

									<enum>(2)</enum>

									<header>Applicability of certain penalties</header>

									<text>Section 3147 shall apply to a juvenile who is to be tried as an

				adult under section 5032 for an offense committed while on release under this

				section.</text>

					</paragraph></subsection><subsection id="ID368FE954DA4D49AEA5917AE11D918ADC">

					<enum>(b)</enum>

					<header>Detention prior to disposition</header>

					<text>Section 5035 of title 18, United States Code, is amended—</text>

						<enum>(1)</enum>

						<text>by striking <quote>A juvenile</quote> and inserting the

			 following:</text>

				<header>Speedy trial</header>

			 United States Code, is amended to read as follows:</text>

							<text>If an alleged delinquent, who is to be proceeded against as a

				juvenile pursuant to section 5032 and who is in detention pending trial, is not

				brought to trial within 70 days from the date upon which such detention began,

				the information shall be dismissed on motion of the alleged delinquent or at

				the direction of the court.</text>

							<enum>(b)</enum>

							<header>Periods of exclusion</header>

							<text>The periods of exclusion under section 3161(h) shall apply to

				this section.</text>

						</subsection><subsection id="ID84C80530AB7C4134B2859B7862055824">

							<enum>(c)</enum>

							<header>Judicial considerations</header>

							<text>In determining whether an information should be dismissed with

				or without prejudice, the court shall consider—</text>

							<paragraph id="IDA31EE887618F4BD7AEEAA6DA5CF34717">

								<enum>(1)</enum>

								<text>the seriousness of the alleged act of juvenile

				delinquency;</text>

							</paragraph><paragraph id="ID6BB5B929B1B141F784A4463083183FBF">

								<enum>(2)</enum>

								<text>the facts and circumstances of the case that led to the

				dismissal; and</text>

							</paragraph><paragraph id="ID0D0EAE179D5D424990170421FA6B99FB">

								<enum>(3)</enum>

								<text>the impact of a reprosecution on the administration of

				justice.</text>

				<header>Federal Sentencing Guidelines</header>

					<header>Application of guidelines to certain juvenile

			 defendants</header>

					<text>Section 994(h) of title 28, United States Code, is amended by

			 inserting <quote>, or in which the defendant is a juvenile who is tried as an

			 adult,</quote> after <quote>old or older</quote>.</text>

					<enum>(b)</enum>

					<header>Guidelines for juvenile cases</header>

					<text>Section 994 of title 28, United States Code, is amended by adding

			 at the end the following:</text>

							<header>Guidelines for juvenile cases</header>

							<text>Not later than May 1, 2006, the Commission, pursuant to its

				rules and regulations and consistent with all pertinent provisions of any

				Federal statute, shall promulgate and distribute, to all courts of the United

				States and to the United States Probation System, guidelines, as described in

				this section, for use by a sentencing court in determining the sentence to be

				imposed in a criminal case if the defendant committed the offense as a

				juvenile, and is tried as an adult pursuant to section 5032 of title 18.</text>
