		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Cooperative Hake Improvement and

			 Conservation Act</short-title></quote>.</text>

		</section><section commented="no" display-inline="no-display-inline" id="ID1ffcb830b8b34755bc9b1ff2bcc7960a" section-type="subsequent-section"><enum>2.</enum><header>Findings, sense of

			 Congress, purposes, and policy</header>

			<subsection commented="no" display-inline="no-display-inline" id="ID96e4fb424a32436c8344bcc70283f55f"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress makes the following

			 findings:</text>

				<paragraph commented="no" display-inline="no-display-inline" id="ID6befaaaa34144ff8b1895c1f54591745"><enum>(1)</enum><text display-inline="yes-display-inline">The United States has an obligation to

			 ensure that, to the extent practicable in accordance with applicable law,

			 stocks of Pacific whiting are conserved and managed in a sustainable manner so

			 as to prevent overfishing while providing economic opportunities for the United

			 States fishing industry, including commercial fishermen and seafood processors,

			 and coastal communities.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDed12f14d53444001ba9c3bbbf72f315c"><enum>(2)</enum><text display-inline="yes-display-inline">The Pacific whiting fishery is uniquely

			 suited to the establishment of a distinct market-based program due to the

			 relatively small and easily identifiable numbers of fishermen and processors

			 involved, and to the existence of a management system that clearly allocates

			 harvest among discrete sectors of the fishery.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id8A7F9D1900F149A192A7243FFE64DF23"><enum>(b)</enum><header>Sense of

			 Congress</header><text display-inline="yes-display-inline">It is the sense of

			 Congress that—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="id04549C3CC7BD49D28D66C8621685897A"><enum>(1)</enum><text display-inline="yes-display-inline">a regional program of market-based

			 incentives for management and conservation should be established in order to

			 meet the obligation described in subsection (a)(1); and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID666150a38eec4e7eb907a2b87431ff86"><enum>(2)</enum><text display-inline="yes-display-inline">as actions taken to reduce excess capacity

			 in fisheries may result in adverse impacts on fishermen, processors, and local

			 coastal communities, any such program should be designed, to the extent

			 practicable, to avoid such impacts.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDc5356b57e5f34df3ad179bec6e67a99b"><enum>(c)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purpose of this Act is to facilitate

			 the continued economic viability of the Pacific whiting fishery for the benefit

			 of the United States through the establishment of a market-based cooperative

			 system for the harvesting and processing of Pacific whiting.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDa82f4901d32c48dda4e3afdb16cc0c6a"><enum>(d)</enum><header>Policy</header><text display-inline="yes-display-inline">It is the policy of the United States to

			 demonstrate the conservation and economic benefits of a market-based

			 cooperative system by using the shore-based vessels and processors of the

			 Pacific whiting in a fishery management program without disrupting other

			 sectors of the whiting fishery or other fisheries.</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="IDdbdc00c01f6b45cd9412bd539798a69b" section-type="subsequent-section"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>

			<paragraph commented="no" display-inline="no-display-inline" id="ID2ffb3d25669b46398eecb91ab78db205"><enum>(1)</enum><header>Aggregate

			 catch</header><text display-inline="yes-display-inline">The term

			 <term>aggregate catch</term> means the total amount of Pacific whiting

			 harvested and delivered on shore in California, Oregon, and Washington without

			 further processing during the benchmark period during a year from 1994 through

			 2004, excluding any such Pacific whiting harvested pursuant to a treaty between

			 the United States and a treaty tribe.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5ad493fa55cc475e9349c744c5ece853"><enum>(2)</enum><header>Aggregate

			 landed catch</header><text display-inline="yes-display-inline">The term

			 <term>aggregate landed catch</term> means the total amount of Pacific whiting

			 processed on shore in California, Oregon, and Washington during the benchmark

			 period during a year from 1999 through 2004.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID292fc5ad1619432e851adf7bf130af77"><enum>(3)</enum><header>Benchmark

			 period</header><text display-inline="yes-display-inline">The term

			 <term>benchmark period</term> means for a year, the period from April 1 through

			 September 30 of such year.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd81778ea6ef24e7fa70a380f67330905"><enum>(4)</enum><header>Catch</header><text display-inline="yes-display-inline">The term <term>catch</term> means all

			 fishery removals from the offshore whiting resource, including landings,

			 discards, and bycatch in fisheries other than the Pacific whiting

			 fishery.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDc9dc2f1cdee244a1b9693bd4f3f06682"><enum>(5)</enum><header>Cooperative

			 share</header><text display-inline="yes-display-inline">The term

			 <term>cooperative share</term> means the percentage of allowable Pacific

			 whiting harvest assigned to each qualified fisherman or qualified processor

			 based on the formula established in section 4.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5feb015861424b5e8805a07401fcc617"><enum>(6)</enum><header>Council</header><text display-inline="yes-display-inline">The term <term>Council</term> means the

			 Pacific Fishery Management Council established under section 302(a)(1)(F) of

			 the Magnuson-Stevens Act (16 U.S.C. 1852(a)(1)(F)).</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9f4f4b28967942f6b0949064c1bd75c8"><enum>(7)</enum><header>Magnuson-Stevens

			 act</header><text display-inline="yes-display-inline">The term

			 <term>Magnuson-Stevens Act</term> means the Magnuson-Stevens Fishery

			 Conservation and Management Act (16 U.S.C. 1801 et seq.).</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3e92d4a1eca942dfbd881a03799077f6"><enum>(8)</enum><header>Offshore

			 whiting resource</header><text display-inline="yes-display-inline">The term

			 <term>offshore whiting resource</term> means the transboundary stock of fish of

			 the species Merluccius productus that—</text>

				<subparagraph commented="no" display-inline="no-display-inline" id="idCE62E9C5773D407A9963EA165D490DFE"><enum>(A)</enum><text display-inline="yes-display-inline">is located in the offshore waters of the

			 United States and Canada; and</text>

				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3E902F1A009740CDA5421219D14B88C9"><enum>(B)</enum><text display-inline="yes-display-inline">does not include any fish of that species

			 located in Puget Sound or the Strait of Georgia.</text>

				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2904741b006649c2b4482e1e14147835"><enum>(9)</enum><header>On-shore

			 allocation</header><text display-inline="yes-display-inline">The term

			 <quote>on-shore allocation</quote> means that amount of the United States catch

			 level required under a Plan to be delivered to processors located on shore in

			 the States of California, Oregon, or Washington.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6BD6B1D9A8A4447FADD6A55828FB79FE"><enum>(10)</enum><header>Pacific Coast

			 Groundfish Fishery Management Plan</header><text display-inline="yes-display-inline">The term <term>Pacific Coast Groundfish

			 Fishery Management Plan</term> means the Pacific Coast Groundfish Fishery

			 Management Plan and Environmental Impact Statement for the California, Oregon,

			 and Washington groundfish fishery approved by the Secretary on January 4, 1982,

			 and all subsequent approved amendments to that plan.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF59A4C88E9804E59A11B08A87A6847D0"><enum>(11)</enum><header>Pacific

			 groundfish</header><text display-inline="yes-display-inline">The term

			 <term>Pacific groundfish</term> means all species of fish included in the

			 Pacific Coast Groundfish Fishery Management Plan.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1f8ec8e9ad164ecf90f414cad41effff"><enum>(12)</enum><header>Pacific

			 whiting</header><text display-inline="yes-display-inline">The term

			 <quote>Pacific whiting</quote> means that portion of the harvest of the

			 offshore whiting resource that is under the jurisdiction of the United

			 States.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd6f333eba4af43378717192695093c5e"><enum>(13)</enum><header>Plan</header><text display-inline="yes-display-inline">The term <quote>Plan</quote> means a

			 fishery management plan prepared by the Council and approved by the Secretary

			 under the Magnuson-Stevens Act.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDcd4eb9fcf839495c9d0a2131de1fc8fb"><enum>(14)</enum><header>Person</header><text display-inline="yes-display-inline">The term <quote>person</quote> means any

			 individual (whether or not a citizen or national of the United States), any

			 corporation, partnership, association, or other entity (whether or not

			 organized or existing under the laws of any State).</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDba3941832c22411b8077dc4cb25f39b5"><enum>(15)</enum><header>Processing</header><text display-inline="yes-display-inline">The term <quote>processing</quote> means

			 the preparation or packaging of Pacific whiting to render it suitable for human

			 consumption, retail sale, industrial uses, or long-term storage by cooking,

			 filleting, freezing, conversion to fish protein compounds, mincing, or heading

			 and gutting.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDdf4e4526095e4f2e9cb27d330dbf5030"><enum>(16)</enum><header>Processor</header><text display-inline="yes-display-inline">The term <quote>processor</quote> means a

			 person that engages in processing of Pacific whiting harvested as part of an

			 on-shore allocation.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDf92bbc9f8f704b66853aa77f20e8f54a"><enum>(17)</enum><header>Qualified

			 fisherman</header><text display-inline="yes-display-inline">The term

			 <quote>qualified fisherman</quote> means the current owner of a trawl-endorsed

			 Pacific groundfish limited entry permit issued under regulations implementing

			 the Pacific Coast Groundfish Fishery Management Plan which during any two years

			 from 1994 through 2004 delivered not less than of 500 metric tons of Pacific

			 whiting during each such year to a processor during the benchmark

			 period.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDdd66d777f0d048579a969987cefd176a"><enum>(18)</enum><header>Qualified

			 processor</header><text display-inline="yes-display-inline">The term

			 <quote>qualified processor</quote> means—</text>

				<subparagraph commented="no" display-inline="no-display-inline" id="id00EDECF8894C4B4D866C1D420CCB7E7B"><enum>(A)</enum><text display-inline="yes-display-inline">a processor that operated in any year from

			 1999 through 2004, and processed at least 1,000,000 pounds of whiting during

			 such year; or</text>

				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF1C4DD68D8384BDEB631CE0E1F9E5634"><enum>(B)</enum><text display-inline="yes-display-inline">a successor in ownership of a processor

			 described in subparagraph (A).</text>

				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1e58edceb9ef4da7a1276478744e933c"><enum>(19)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <quote>Secretary</quote> means the

			 Secretary of Commerce.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7313fb42be1f4083bbaa6c932c94ad56"><enum>(20)</enum><header>Share-holder</header><text display-inline="yes-display-inline">The term <quote>share-holder</quote> means

			 the current owner of cooperative shares.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9b6f5005264b414b8a6d00693c7420fd"><enum>(21)</enum><header>Treaty

			 tribe</header><text display-inline="yes-display-inline">The term <quote>treaty

			 tribe</quote> means any Indian tribe determined by the United States courts to

			 have rights to harvest Pacific whiting within specified areas.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID86114ec63eca43ec9787c5a82af7b648"><enum>(22)</enum><header>United states

			 catch level</header><text display-inline="yes-display-inline">The term

			 <quote>United States catch level</quote> means that portion of the offshore

			 whiting resource which may be harvested by persons subject to the jurisdiction

			 of the United States.</text>

			</paragraph></section><section commented="no" display-inline="no-display-inline" id="ID39012785b36e48bd93a97cdb28332b8c" section-type="subsequent-section"><enum>4.</enum><header>Rationalization of the

			 Pacific whiting fishery</header>

			<subsection commented="no" display-inline="no-display-inline" id="ID8ff7abdb1e12451cb610450f41ff9235"><enum>(a)</enum><header>Identification

			 of qualified participants</header>

				<paragraph commented="no" display-inline="no-display-inline" id="id3F83BA0FFAF34277A4EF0A84FB29BE6E"><enum>(1)</enum><header>Requirement for

			 permits</header><text display-inline="yes-display-inline">The Secretary shall

			 issue a permit to—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="id6E35FAAD0D0142F7B416E42A844796A5"><enum>(A)</enum><text display-inline="yes-display-inline">any person who demonstrates by appropriate

			 records that such person is a qualified fisherman; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID036e9d8daa8141a5a832f5acc72841e5"><enum>(B)</enum><text display-inline="yes-display-inline">any person who demonstrates by appropriate

			 records that such person is a qualified processor.</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8e4f0ee827724d7e8ad1d88ed0fb0484"><enum>(2)</enum><header>Limitations</header><text display-inline="yes-display-inline">Permits issued under this subsection will

			 be clearly designated as qualified fisherman or qualified processor permits,

			 are not interchangeable, and shall not confer ownership in any stock of fish

			 over which the United States exercises sovereign jurisdiction.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDc72f9b40b43547fd8eee4b09fa002fa5"><enum>(3)</enum><header>Transfer of

			 permits</header><text display-inline="yes-display-inline">Permits may be

			 transferred through sale, lease, barter, gift, inheritance, or any other legal

			 means. A permit which is transferred may not be redesignated and may only be

			 used in accordance with this Act and any regulations issued pursuant to this

			 Act.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4fa6c9b59a3045d6aa11e13942ad03cd"><enum>(4)</enum><header>Fee</header><text display-inline="yes-display-inline">The Secretary may charge a fee to issue a

			 permit under this subsection which shall not exceed the administrative costs

			 incurred in issuing the permit.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8a8f0340f70a467286d14ccac8dac08e"><enum>(5)</enum><header>Endorsement</header><text display-inline="yes-display-inline">For the purposes of paragraph (1)(A), the

			 permit issued by the Secretary shall be an appropriate permanent endorsement of

			 a Pacific groundfish trawl limited entry permit issued under the Pacific Coast

			 Groundfish Fishery Management Plan.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID32f0290f8d3e40d9b475d3f1b1de33e9"><enum>(b)</enum><header>Allocation of

			 resource</header><text display-inline="yes-display-inline">Prior to March 1 of

			 the calendar year following the issuance of final regulations as required by

			 section 6, the Secretary shall make an initial allocation of cooperative shares

			 as follows:</text>

				<paragraph commented="no" display-inline="no-display-inline" id="IDa9324af3e0914d3bb6806aca35fbe8ab"><enum>(1)</enum><text display-inline="yes-display-inline">Each qualified fisherman who currently owns

			 a Pacific groundfish trawl limited entry permit issued under the Pacific Coast

			 Groundfish Fishery Management Plan that has been endorsed under subsection (a)

			 shall be assigned a percentage of cooperative share using the following

			 formula:</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="IDdcfbb4d45ef24e9ba4ded83722bfe540"><enum>(A)</enum><text display-inline="yes-display-inline">For each permit, the amount of Pacific

			 whiting harvested by any vessel to which the permit was assigned during the

			 benchmark period in each of the years from 1994 through 2004 shall be divided

			 by the aggregate catch for each of those years.</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9DF03FD6336E4A35B5C92FA8FD90BEAD"><enum>(B)</enum><text display-inline="yes-display-inline">The 9 highest percentages shall be averaged

			 and the result shall be considered the permit’s catch history.</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id46024861969C4FBBBF37898ACF45FB62"><enum>(C)</enum><text display-inline="yes-display-inline">Each permit’s catch history shall be

			 divided by the sum of all catch histories to determine the qualified

			 fisherman’s cooperative share.</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8e30095b770744839542f5d37d79e013"><enum>(2)</enum><text display-inline="yes-display-inline">Each qualified processor who has been

			 issued a permit under subsection (a) shall be assigned a percentage of

			 cooperative share using the following formula:</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="ID998d9035335646aaae571c2b7d38b241"><enum>(A)</enum><text display-inline="yes-display-inline">For each qualified processor, the amount of

			 Pacific whiting purchased by that processor during the benchmark period in each

			 of the years from 1999 through 2004 shall be divided by the aggregate landed

			 catch for each of those years.</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id302C10CE74684E529EA1EC3BC0182651"><enum>(B)</enum><text display-inline="yes-display-inline">The 4 highest percentages shall be averaged

			 and the result shall be considered the qualified processor’s processing

			 history.</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idBD2E37257867413BA3A1B5CFB1C4499D"><enum>(C)</enum><text display-inline="yes-display-inline">Each qualified processor’s processing

			 history shall be divided by the sum of all processing histories to determine

			 the qualified processor’s cooperative share.</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID02161a5ebeb44f91ab9176143423e738"><enum>(3)</enum><text display-inline="yes-display-inline">The percentages assigned to qualifying

			 fishermen shall be designated fishermen’s cooperative share and the percentages

			 assigned to qualifying processors shall be designated processors’ cooperative

			 share. Except as provided in subsection (d), cooperative shares may be

			 transferred, in whole or in part, through sale, lease, barter, gift,

			 inheritance or any other legal means but will retain their original

			 designation.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID8842c0bba8ff486f835e0edc627999f4"><enum>(c)</enum><header>Cooperative

			 harvest of pacific whiting</header>

				<paragraph commented="no" display-inline="no-display-inline" id="idB54042243FBC4BF099D2285F2C65BDE8"><enum>(1)</enum><text display-inline="yes-display-inline">In each calendar year, the on-shore

			 allocation shall be divided so that—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="ID15e9dfd43c2341909277e91d0673182d"><enum>(A)</enum><text display-inline="yes-display-inline">an amount sufficient to account for the

			 incidental commercial or recreational catch of Pacific whiting in fisheries

			 other than the Pacific whiting fishery, but not to exceed 1 percent of the

			 on-shore allocation, shall be available for harvest by any person legally

			 eligible to harvest Pacific whiting; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3cf5a08bc8e148c98578331a4395d449"><enum>(B)</enum><text display-inline="yes-display-inline">after subtracting the amounts described in

			 subparagraph (A), 50 percent of the remainder shall be available for harvest

			 using fishermen’s cooperative shares and 50 percent of the remainder shall be

			 available for harvest using processors’ cooperative shares.</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDbda4d44cacc7465b9c530eae81328bce"><enum>(2)</enum><text display-inline="yes-display-inline">At any time during a calendar year, a

			 holder of fisherman’s cooperative shares may enter into one or more agreements

			 with holders of processor’s cooperative shares to use all or a portion of those

			 processors’ cooperative shares. No Pacific whiting may be harvested using

			 fishermen’s cooperative shares or processors’ cooperative shares without a

			 registered agreement. Such an agreement shall not be valid if—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="IDab041908bdf14487be6504e33d8d222a"><enum>(A)</enum><text display-inline="yes-display-inline">it does not require the use of an equal

			 amount of fishermen’s cooperative shares and processors’ cooperative shares;

			 or</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6d9ab48d4d554efda1815e0a37d16bc6"><enum>(B)</enum><text display-inline="yes-display-inline">it is not registered with the Secretary

			 prior to the time the cooperative shares covered by the agreement are used to

			 harvest Pacific whiting.</text>

					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDe4f7ba7f2fe34e5387ae136afc62deb8"><enum>(d)</enum><header>Restrictions on

			 transfer</header><text display-inline="yes-display-inline">Fishermen’s

			 cooperative shares may only be transferred to a person holding a Pacific

			 groundfish trawl limited entry permit issued under the Pacific Coast Groundfish

			 Fishery Management Plan.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID4d166899cafa447aa675b722dffbf063"><enum>(e)</enum><header>Contribution to

			 research and management</header>

				<paragraph commented="no" display-inline="no-display-inline" id="idB4CB8BF9FFC94D008DB63361C5C74BDC"><enum>(1)</enum><header>Fee</header><text display-inline="yes-display-inline">In addition to any fee which may be

			 collected under subsection (a), the Secretary is authorized and shall collect a

			 fee equally from share-holders to recover the costs of carrying out this

			 section (including costs associated with carrying out activities under section

			 5) and of conducting scientific research on the offshore whiting

			 resource.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4a6903eb34774ded800028c9173e3aed"><enum>(2)</enum><header>Determination

			 of fee</header>

					<subparagraph commented="no" display-inline="no-display-inline" id="id8C5BAE8BB1A44547B763EBABC47BB3F1"><enum>(A)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Each share-holder

			 will be liable for a fee up to 3 percent of the ex-vessel value of the Pacific

			 whiting that was harvested in a calendar year using fishermen’s cooperative

			 shares owned by that share-holder and up to 3 percent of the ex-vessel value of

			 the Pacific whiting that was harvested in a calendar year using processors’

			 cooperative shares owned by that share-holder.</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF1AEAF3A45704868B742283C7FD84A4E"><enum>(B)</enum><header>Schedule of

			 payment</header><text display-inline="yes-display-inline">The fee referred to

			 in subparagraph (A) shall be payable not later than 30 days after the end of

			 the calendar year during which the Pacific whiting on which the fee is imposed

			 was harvested.</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDefdeebe2b79347a6a2105e70fc091ed7"><enum>(3)</enum><header>Availability of

			 fees</header><text display-inline="yes-display-inline">Fees collected under

			 this subsection shall be available to the Secretary without fiscal year

			 limitation and may only be used to carry out the Secretary’s obligations under

			 this Act, except as provided in paragraph (4).</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID302cee45897b491bb20dcc40215ffbb7"><enum>(4)</enum><header>Use by

			 states</header><text display-inline="yes-display-inline">Upon application from

			 the States of Washington, Oregon, or California, the Secretary may transfer up

			 to 33 percent of the fees collected under this subsection in any calendar year

			 to 1 or more of such States to offset costs incurred by such States in the

			 conservation and management of Pacific whiting.</text>

				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="IDa39b2d4d8e894a00a35df030503d2ff3" section-type="subsequent-section"><enum>5.</enum><header>Conservation of

			 Pacific whiting</header>

			<subsection commented="no" display-inline="no-display-inline" id="ID3b5b2a94d9f04654a0f902196c767b44"><enum>(a)</enum><header>Limits on

			 incidental catch</header>

				<paragraph commented="no" display-inline="no-display-inline" id="id945C49A3813B4259B3B169F7C00C4113"><enum>(1)</enum><header>Recommendation

			 of incidental catch limitations</header><text display-inline="yes-display-inline">The Council may recommend to the Secretary

			 appropriate amounts of any species of Pacific groundfish, other than Pacific

			 whiting, that may be harvested incidentally to the harvest of Pacific whiting

			 under this Act and any other Act.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDb4a86cf11a724164a0d2a673fd4af9eb"><enum>(2)</enum><header>Schedule for

			 recommendations</header><text display-inline="yes-display-inline">The Council

			 may make recommendations annually or in such other time increment that

			 facilitates conservation and management of the Pacific groundfish

			 fishery.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDcd00c759c5214594b6c427060992ebe3"><enum>(3)</enum><header>Recommendations</header>

					<subparagraph commented="no" display-inline="no-display-inline" id="id7F28F67F23C24E86BADA5F127FD5F425"><enum>(A)</enum><header>Basis for

			 recommendations</header><text display-inline="yes-display-inline">Such

			 recommendations shall be—</text>

						<clause commented="no" display-inline="no-display-inline" id="id51753CD7C1E648FDA171AA2B1EBEFE18"><enum>(i)</enum><text display-inline="yes-display-inline">based on the best scientific information

			 available;</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="id0320830340994A249F8482FA383CEABB"><enum>(ii)</enum><text display-inline="yes-display-inline">reasonably calculated to promote

			 conservation;</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="id681E31AF610046D1A37D1C766643118B"><enum>(iii)</enum><text display-inline="yes-display-inline">fair and equitable to holders of

			 cooperative shares and others who harvest Pacific groundfish; and</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="id4B8B39F6B464450680B07B269521A81F"><enum>(iv)</enum><text display-inline="yes-display-inline">to the extent practicable, designed to

			 minimize the discard of Pacific whiting and other species of Pacific

			 groundfish.</text>

						</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id099A0D89529D4439A564F2D353C84495"><enum>(4)</enum><header>Considerations</header><text display-inline="yes-display-inline">The Council shall, in making such

			 recommendations, consider the percentage of Pacific whiting available for

			 harvest by holders of cooperative shares relative to the percentage of Pacific

			 whiting available for harvest by others.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDc7e9fdfd078f4c89bf1554cb437fa538"><enum>(5)</enum><header>Use of

			 funds</header><text display-inline="yes-display-inline">The amounts recommended

			 under paragraph (1) shall include specific subamounts by species or species

			 group which shall be available only to holders of cooperative shares and which

			 may be transferred among holders of cooperative shares who are harvesting

			 Pacific whiting under a valid agreement under section 4.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDaab5c599cf5645e1902e7c2bda2be805"><enum>(6)</enum><header>Publication</header><text display-inline="yes-display-inline">Not later than 45 days after receiving the

			 recommendations of the Council, the Secretary shall publish a proposed rule

			 which applies the aggregate limits to the Pacific whiting fishery and allow 30

			 days for public comment before publishing a final rule.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDa80e42f1ca734dbe9117557146509824"><enum>(b)</enum><header>Monitoring</header><text display-inline="yes-display-inline">The Secretary shall issue regulations

			 providing for the statistically reliable monitoring of harvesting and

			 processing of Pacific whiting to determine compliance with this Act and to

			 collect necessary biological samples for the conservation and management of the

			 Pacific whiting fishery and the offshore whiting resource.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDc4a3bedd8ac745a391f03543030ca61e"><enum>(c)</enum><header>Action by the

			 council</header>

				<paragraph commented="no" display-inline="no-display-inline" id="idC87EF7B490E2408BB59028ED7E6B9714"><enum>(1)</enum><header>Recommendations

			 of other incidental catch limitations</header><text display-inline="yes-display-inline">The Council may recommend amendments to the

			 Pacific Coast Groundfish Fishery Management Plan which provide for limits on

			 incidental catch of species other than Pacific whiting, monitoring of the

			 Pacific whiting fishery, and a system allowing transfer of incidental catch

			 amounts among persons harvesting Pacific whiting under a valid agreement under

			 section 4. Amendments recommended under this paragraph shall meet the

			 requirements of subsection (a)(3).</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID36accd748524482197a209391bcaff2b"><enum>(2)</enum><header>Additional

			 regulations</header><text display-inline="yes-display-inline">Regulations

			 issued by the Secretary under subsections (a) or (b) shall be superseded by any

			 regulations issued by the Secretary to implement Plan amendments recommended

			 under paragraph (1).</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID7c244809f30c4f21abd3f9789344c381"><enum>(d)</enum><header>Compliance with

			 environmental standards</header><text display-inline="yes-display-inline">Amendments to the Pacific Coast Groundfish

			 Fishery Management Plan and regulations implementing those amendments which are

			 prepared in accordance with applicable provisions of the Magnuson-Stevens Act

			 and regulations implementing this Act are deemed to have been prepared in

			 compliance with the requirements of section 102(2)(C) of the National

			 Environmental Policy Act of 1969 (42 U.S.C. 4332(2)(C)).</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="ID5b3cb18724a445c5ad2386ca30d1dce3" section-type="subsequent-section"><enum>6.</enum><header>Program

			 implementation</header>

			<subsection commented="no" display-inline="no-display-inline" id="IDc67fb6fdaa3d4deb9e4198737ea0a283"><enum>(a)</enum><header>Requirement</header><text display-inline="yes-display-inline">Not later than 6 months after the date of

			 enactment of this Act, the Secretary shall issue final regulations to implement

			 the program for Pacific whiting conservation and management described in this

			 Act. In developing such regulations, the Secretary shall allow the Council the

			 opportunity to propose draft regulations.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID8d4b8e273d7a4e2b9e0fd671bc5290d7"><enum>(b)</enum><header>Plan

			 amendment</header><text display-inline="yes-display-inline">The Council may

			 amend the appropriate Plan to conform with this Act or regulations issued under

			 this Act. Failure of the Council to amend a Plan shall not delay the

			 obligations of the Secretary under subsection (a).</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="ID923f71233c4e4c2d85dbc69a2b018194" section-type="subsequent-section"><enum>7.</enum><header>Enforcement and

			 penalties</header>

			<subsection commented="no" display-inline="no-display-inline" id="ID9c4ca14bb8e642078f1d05b9aa836acf"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">It is unlawful for

			 any person to violate any provision of this Act or any regulation issued under

			 this Act.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDa2d0f10f73cc45f39034bc5393bbcb4b"><enum>(b)</enum><header>Unlawful

			 harvest</header><text display-inline="yes-display-inline">It is unlawful for

			 any person to harvest Pacific whiting using cooperative shares without having a

			 valid agreement registered with the Secretary under section 4(c)(2).</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDf4708b28a5614470a6f7a5672b760a5a"><enum>(c)</enum><header>Penalty</header><text display-inline="yes-display-inline">Any person who commits an action that is

			 unlawful under subsection (a) or (b) may be liable for a civil penalty under

			 subsection (a) of section 308 of the Magnuson-Stevens Act (16 U.S.C. 1858) or

			 permit sanction imposed by subsection (g) of such section 308, as if such

			 person had committed an act prohibited by section 307 of such Act (16 U.S.C.

			 1857).</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="id64A827FB35334142AE541F65DB25F9DB"><enum>(d)</enum><header>Review</header><text display-inline="yes-display-inline">Any person against whom a civil penalty is

			 assessed or against whom a permit sanction is imposed as described in

			 subsection (c) may obtain review thereof as described in subsection (b) of

			 section 308 of the Magnuson-Stevens Act.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID43b669c8d81d4bd7b59dedda4654a214"><enum>(e)</enum><header>Sherman

			 Act</header><text display-inline="yes-display-inline">No person may own or

			 control cooperative shares in an amount or manner that violates the Sherman Act

			 (15 U.S.C. 1 et seq.).</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="IDd087814d125044d5a6cd2031ef3e3a7e" section-type="subsequent-section"><enum>8.</enum><header>Reports to

			 Congress</header>

			<subsection commented="no" display-inline="no-display-inline" id="ID99eae9515c344a4cac6fef8bdcc57c0a"><enum>(a)</enum><header>Requirement</header><text display-inline="yes-display-inline">Not later than 5 years after the issuance

			 of final regulations under section 6(a), and during each 5-year period

			 thereafter, the Secretary, after consultation with the Council, shall submit to

			 Congress a report on the implementation of this Act.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="id6737E90D396440579F8C7CAE348E6B20"><enum>(b)</enum><header>Contents</header><text display-inline="yes-display-inline">Such reports shall include—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="id14ECA96E1EBF4780B28F1CDD5D8AE4E1"><enum>(1)</enum><text display-inline="yes-display-inline">a description of the conservation and

			 management actions carried out for the Pacific whiting fishery, including the

			 extent to which bycatch (including discard) of Pacific groundfish has been

			 minimized;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB0FF3BCC49B34F95A8B457B5F8B9B1A2"><enum>(2)</enum><text display-inline="yes-display-inline">the number of active fishing vessels and

			 processing facilities remaining in such fishery;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD8392D05945645B89158AC5C2676E23D"><enum>(3)</enum><text display-inline="yes-display-inline">the economic impact of such fishery on

			 local coastal communities;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3F3554571A3B4642B52EE74B800A490D"><enum>(4)</enum><text display-inline="yes-display-inline">whether the amounts specified in section

			 4(c)(1)(A) continue to be appropriate; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3a92309bf2cc42dea98ed31522ed91a2"><enum>(5)</enum><text display-inline="yes-display-inline">any recommendations of the Secretary for

			 changes to this Act, along with a justification for such

			 recommendations.</text>

				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="IDc17c70b4217348568e34152accc310cb" section-type="subsequent-section"><enum>9.</enum><header>Construction</header><text display-inline="no-display-inline">The provisions of this Act shall be deemed

			 not to violate section 804 of the Departments of Commerce, Justice, and State,

			 the Judiciary, and Related Agencies Appropriations Act, 2004 (division B of

			 Public Law 108–199; 118 Stat. 111) or any provision of the Magnuson-Stevens Act

			 and may not be construed to have any effect on the application of such section

			 804.</text>

		</section><section commented="no" display-inline="no-display-inline" id="IDb9375ffc1ee44b31a312949c237b84d4" section-type="subsequent-section"><enum>10.</enum><header>Authorizations</header><text display-inline="no-display-inline">There is authorized to be appropriated to

			 the Secretary $750,000 for each of fiscal years 2006 and 2007 to carry out the

			 provisions of this Act, of which $250,000 may be made available to the Council

			 each fiscal year.</text>
