			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Coffman Cove Administrative Site
			 Conveyance Act of 2005</short-title></quote>.</text>
		</section><section changed="deleted" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="id3699E25FDA11486CA6E05A6326379EBF" reported-display-style="strikethrough" section-type="subsequent-section"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="ID2332323561ef46d2b493f3693440db78"><enum>(1)</enum><text display-inline="yes-display-inline">the community of Coffman Cove, Alaska,
			 which originated as a logging camp in the 1960’s, was incorporated as a city in
			 1989;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD5F13DA9FB354CA282723723DD60F26A"><enum>(2)</enum><text display-inline="yes-display-inline">the Forest Service property located in the
			 center of the City was used by the Forest Service as a work center;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id76771D126F2344B3950AE02F4CEDE69B"><enum>(3)</enum><text display-inline="yes-display-inline">the Forest Service work facilities included
			 part of the logging camp, a log sort yard, and a log transfer site, all of
			 which supported the long-term timber sale operations and other subsequent
			 timber sales in the Tongass National Forest;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID53328fc7eb49468a8257384d20587ab3"><enum>(4)</enum><text display-inline="yes-display-inline">as the long-term timber sale operations
			 concluded, the need for the Forest Service to use the Forest Service site in
			 Coffman Cove diminished;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id73FA7BFA79C14EC69C7D67793BF96BE1"><enum>(5)</enum><text display-inline="yes-display-inline">the Forest Service work center facilities
			 that supported timber operations have been removed and the site has been
			 restored;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1cfeed4c28a540a6b8435893d27300cb"><enum>(6)</enum><text display-inline="yes-display-inline">the location of the administrative site
			 interferes with the ability of the City to further develop commercial
			 operations and tourism support facilities relating to a new ferry
			 terminal;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3060137645E24CCD8F98F680988F746F"><enum>(7)</enum><text display-inline="yes-display-inline">the City wants to acquire a portion of the
			 site to continue the transition of the City from a timber-dependent economy to
			 a more fully developed and diversified economy; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5DDB37FDB0A54BF393970D93D93636A8"><enum>(8)</enum><text display-inline="yes-display-inline">the Forest Service expects that only
			 approximately 3 acres of the administrative site will be used in the future for
			 National Forest System purposes.</text>
			</paragraph></section><section changed="deleted" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="idE40DB1DA55A9407183A24968AFD44E44" reported-display-style="strikethrough" section-type="subsequent-section"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph commented="no" display-inline="no-display-inline" id="idC269270E6A544E9C9D3F0584D3468859"><enum>(1)</enum><header>City</header><text display-inline="yes-display-inline">The term <quote>City</quote> means the city
			 of Coffman Cove, Alaska.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id39D774C36C554FEC91F99ED0B874B7EB"><enum>(2)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <quote>Secretary</quote> means the
			 Secretary of Agriculture.</text>

			<subsection changed="deleted" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="id019AB79025034EF8B50BD04C0FC1C091" reported-display-style="strikethrough"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Notwithstanding any
			 other provision of law, the Secretary shall convey to the City, without
			 consideration and without additional warrants or liability on behalf of the
			 United States, fee simple title to the parcel of Forest Service land described
			 in subsection (b).</text>
			</subsection><subsection changed="deleted" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="idCE5B09F34DC94346A4C1C6A955EDE1A6" reported-display-style="strikethrough"><enum>(b)</enum><header>Description of
			 land</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id506FAA949C5A482B8C1F40B5B6FACEFE"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The parcel of Forest
			 Service land referred to in subsection (a) is the approximately 12 acres of
			 land identified in U.S. Survey 10099, as depicted on the plat entitled
			 <quote>Subdivision of U.S. Survey No. 10099</quote> and recorded as Plat 2003–1
			 on January 21, 2003, Petersburg Recording District, Alaska.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0434356B89DE4AB894DCB5B70C5A6142"><enum>(2)</enum><header>Excluded
			 land</header><text display-inline="yes-display-inline">The parcel of Forest
			 Service land conveyed under subsection (a) does not include the portion of U.S.
			 Survey 10099 that is north of the right-of-way for Forest Development Road
			 3030–295 and southeast of Tract CC–8.</text>
				</paragraph></subsection><subsection changed="deleted" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="id4C5EBF50AA6749E395722336DBD45949" reported-display-style="strikethrough"><enum>(c)</enum><header>Right-of-Way</header><text display-inline="yes-display-inline">The United States may reserve a
			 right-of-way to provide access to the Forest Service land excluded from the

			 <quote><short-title>Coffman Cove Administrative Site
			 Conveyance Act of 2006</short-title></quote>.</text>
		</section><section changed="added" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="id0D136C5C4F4640F799A959B1692BA713" reported-display-style="italic"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph commented="no" display-inline="no-display-inline" id="id2F3CA78121B94666840E2DA34D06C089"><enum>(1)</enum><header>City</header><text>The
			 term <quote>City</quote> means the city of Coffman Cove, Alaska.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA3DDA468020A4C25A097398B689EDD4B"><enum>(2)</enum><header>Secretary</header><text>The
			 term <quote>Secretary</quote> means the Secretary of Agriculture.</text>
			</paragraph></section><section changed="added" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="idAEFE712580474B448F5F4461DBB233E5" reported-display-style="italic"><enum>3.</enum><header>Conveyance</header>
			<subsection changed="added" committee-id="SSEG00" id="ID0ae8f44b68f5417283f47b4aac89c414" reported-display-style="italic"><enum>(a)</enum><header>In
			 General</header><text>Subject to valid existing rights, the Secretary shall
			 convey to the City, without consideration and by quitclaim deed all right,
			 title, and interest of the United States, except as provided in subsections (c)
			 and (d), in and to the parcel of National Forest System land described in
			 subsection (b).</text>
			</subsection><subsection changed="added" committee-id="SSEG00" id="ID9e820b3236c249bfb0e599b08adf8a07" reported-display-style="italic"><enum>(b)</enum><header>Description of
			 Land</header>
				<paragraph id="IDa548d16740e94cd38140aeb18d0c9c8a"><enum>(1)</enum><header>In
			 general</header><text>The parcel of National Forest System land referred to in
			 subsection (a) is the approximately 12 acres of land identified in U.S. Survey
			 10099, as depicted on the plat entitled <quote>Subdivision of U.S. Survey No.
			 10099</quote> and recorded as Plat 2003–1 on January 21, 2003, Petersburg
			 Recording District, Alaska.</text>
				</paragraph><paragraph id="IDd4742a0ec12f4e6992c5122667721455"><enum>(2)</enum><header>Excluded
			 land</header><text>The parcel of National Forest System land conveyed under
			 subsection (a) does not include the portion of U.S. Survey 10099 that is north
			 of the right-of-way for Forest Development Road 3030–295 and southeast of Tract

				</paragraph></subsection><subsection changed="added" committee-id="SSEG00" id="ID8614a24ad7d64abf93cdbc29389079d4" reported-display-style="italic"><enum>(c)</enum><header>Right-of-way</header><text>The
			 United States may reserve a right-of-way to provide access to the National
			 Forest System land excluded from the conveyance to the City under subsection
			 (b)(2).</text>
			</subsection><subsection changed="added" committee-id="SSEG00" id="ID5670191b6d3d4f25a7ffe49e1a856326" reported-display-style="italic"><enum>(d)</enum><header>Reversion</header><text>If
			 any portion of the land conveyed under subsection (a) (other than a portion of
			 land sold under subsection (e)) ceases to be used for public purposes, the land
			 shall, at the option of the Secretary, revert to the United States.</text>
			</subsection><subsection changed="added" committee-id="SSEG00" id="ID7c0fbec02d10469a8baaa34458c1c973" reported-display-style="italic"><enum>(e)</enum><header>Conditions on
			 subsequent conveyances</header><text>If the City sells any portion of the land
			 conveyed to the City under subsection (a)—</text>
				<paragraph id="IDf3ad8d1b809547ee9eedc0986bb598a7"><enum>(1)</enum><text>the amount of
			 consideration for the sale shall reflect fair market value, as determined by an
			 appraisal; and</text>
				</paragraph><paragraph id="ID58fb076b453e447c8d225031dc9b0919"><enum>(2)</enum><text>the City shall pay to the
			 Secretary an amount equal to the gross proceeds of the sale, which shall be
			 available, without further appropriation, for the Tongass National
			 Forest.</text>
				</paragraph></subsection></section></legis-body>
