		  within the Rocky Mountain National Park in the State of

		<section commented="no" display-inline="no-display-inline" id="H9FBFE0430F884C43B375C0FA1DF78B8E" section-type="section-one"><enum>1.</enum><header>Short title and

			 purpose</header>

			<subsection commented="no" display-inline="no-display-inline" id="H13FE8E49376A4BF1A6DF07B993D52B91"><enum>(a)</enum><header>Short

			 title</header><text display-inline="yes-display-inline">This Act may be cited

			 as the <quote><short-title>Rocky Mountain National Park

			 Wilderness Act</short-title></quote>.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="H9F8E074E510E45BA8F0481C68C9F8D9"><enum>(b)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purpose of this Act is to include in

			 the National Wilderness Preservation System certain lands within the Rocky

			 Mountain National Park, Colorado, in order to protect the enduring scenic and

			 historic wilderness character and unique wildlife values of the lands as well

			 as the scientific, educational, inspirational, and recreational resources,

			 values, and opportunities of the lands.</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="H2E179A94E9F848FA9613E406D8A6C1A" section-type="subsequent-section"><enum>2.</enum><header>Designation of Rocky

			 Mountain National Park Wilderness</header>

			<subsection commented="no" display-inline="no-display-inline" id="HBCD4E35F05C24F829C147452BEDE00C0"><enum>(a)</enum><header>Designation</header><text display-inline="yes-display-inline">In furtherance of the purposes of the

			 Wilderness Act (16 U.S.C. 1131 et seq.), certain lands within the Rocky

			 Mountain National Park, Colorado, which comprise approximately ____ acres, as

			 generally depicted on the map titled <quote>Rocky Mountain National Park,

			 Colorado Wilderness Boundaries</quote> and dated June 2005, are hereby

			 designated as wilderness and, therefore, as a component of the National

			 Wilderness Preservation System. The designated lands shall be known as the

			 Rocky Mountain National Park Wilderness.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="H758BCD9A31EC44A3BF1100904BD3D5F0"><enum>(b)</enum><header>Map and

			 description</header>

				<paragraph commented="no" display-inline="no-display-inline" id="H2ED207AF3BBF4AF2A8F3636C5D2E73F2"><enum>(1)</enum><header>Preparation and

			 submission</header><text display-inline="yes-display-inline">As soon as

			 practicable after the date of the enactment of this Act, the Secretary of the

			 Interior shall prepare a map and a boundary description of the Rocky Mountain

			 National Park Wilderness designated by subsection (a) and file the map and

			 boundary description with the Committee on Resources of the House of

			 Representatives and the Committee on Energy and Natural Resources of the

			 Senate. The map and boundary description shall be on file and available for

			 public inspection in the office of the Director of the National Park Service,

			 Department of the Interior.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE2938B732293424BACD426DB8CCA7736"><enum>(2)</enum><header>Treatment</header><text display-inline="yes-display-inline">The map and boundary description prepared

			 under paragraph (1) shall have the same force and effect as if included in this

			 Act. The Secretary of the Interior may correct clerical and typographical

			 errors in the map and description.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H4FB7C83014944C59AA7F2EFD72AEE7AF"><enum>(c)</enum><header>Potential

			 wilderness lands</header>

				<paragraph commented="no" display-inline="no-display-inline" id="HCB981A939274458087F5F3AA9201E0FE"><enum>(1)</enum><header>Definition</header><text display-inline="yes-display-inline">In this section, the term <term>potential

			 wilderness lands</term> means—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="H1DA9B933F2CB4E639FD387E41B48D288"><enum>(A)</enum><text display-inline="yes-display-inline">lands identified as potential wilderness on

			 the map referred to in subsection (a); and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE05245FDB1484ABAA3625575AF46FD95"><enum>(B)</enum><text display-inline="yes-display-inline">lands and interests therein acquired by the

			 United States on or after the date of the enactment of this Act that are

			 located within the boundaries of the Rocky Mountain National Park and are

			 contiguous with lands designated as wilderness by this Act.</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE290C715F9354640B973F658043EE711"><enum>(2)</enum><header>Inclusion in

			 wilderness</header><text display-inline="yes-display-inline">Upon publication

			 in the Federal Register of a notice by the Secretary of the Interior that all

			 uses of a parcel of potential wilderness lands inconsistent with the Wilderness

			 Act have ceased, the parcel shall be included in the Rocky Mountain National

			 Park Wilderness designated by subsection (a) and managed as provided in section

			 3. The Secretary of the Interior shall modify the map and boundary description

			 prepared under subsection (b) to reflect the inclusion of the parcel in the

			 Rocky Mountain National Park Wilderness.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H2A5CC6D717384DB8B3B8AEB375FDACE3"><enum>(d)</enum><header>Exclusion of

			 certain lands</header><text display-inline="yes-display-inline">The boundaries

			 of the Rocky Mountain National Park Wilderness and the potential wilderness

			 lands specifically exclude the following:</text>

				<paragraph commented="no" display-inline="no-display-inline" id="H70AFB9E500DE4830BD78738B81CE2D6F"><enum>(1)</enum><text display-inline="yes-display-inline">The Grand Ditch (including both the main

			 canal of the Grand Ditch and a branch thereof known as the specimen Ditch) and

			 its right-of-way as well as associated appurtenances, structures, buildings,

			 camps, and work sites in existence as of June 1, 1998.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7681B368416E4D67AC1715A82FFC48AD"><enum>(2)</enum><text display-inline="yes-display-inline">Lands owned by the St. Vrain &amp; Left

			 Hand Water Conservancy District, including Copeland Reservoir and the Inlet

			 Ditch to such reservoir from the North St. Vrain Creek, amounting to

			 approximately 35.38 acres.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC841A0325DA74F38BAE3A3A6B1375753"><enum>(3)</enum><text display-inline="yes-display-inline">Lands owned by the Wincentsen-Harms Trust,

			 amounting to approximately 2.75 acres.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HE0E40B5BD06E4A09AAF65D57952C64DE"><enum>(e)</enum><header>Relation to

			 lands outside wilderness</header><text display-inline="yes-display-inline">Nothing in this Act shall affect the

			 management or use of any lands not included within the boundaries of the Rocky

			 Mountain National Park Wilderness or the potential wilderness lands.</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="HE5AEBCF734454D38AC26AA441C156269" section-type="subsequent-section"><enum>3.</enum><header>Management of Rocky

			 Mountain National Park Wilderness</header>

			<subsection commented="no" display-inline="no-display-inline" id="H7ACBC8DF7A1A49D890E38FD9A114307E"><enum>(a)</enum><header>Management

			 generally</header><text display-inline="yes-display-inline">Subject to valid

			 existing rights, lands designated as wilderness by section 2(a) or subsequently

			 included in the Rocky Mountain National Park Wilderness by section 2(c) shall

			 be managed by the Secretary of the Interior in accordance with the Wilderness

			 Act (16 U.S.C. 1131 et seq.) and this Act. With respect to the lands designated

			 as wilderness by section 2(a), any reference in the Wilderness Act to the

			 effective date of the Wilderness Act shall be deemed to be a reference to the

			 date of the enactment of this Act. With respect to the lands subsequently

			 included in the Rocky Mountain National Park Wilderness by section 2(c), any

			 reference in the Wilderness Act to the effective date of the Wilderness Act

			 shall be deemed to be a reference to the date on which the lands were included

			 in the wilderness area.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="H771C3D2FBD9D49DC00547616F7E60A1"><enum>(b)</enum><header>Water

			 rights</header>

				<paragraph commented="no" display-inline="no-display-inline" id="H8D320129FA0E4AC0ACC5A757B819A0CB"><enum>(1)</enum><header>Findings</header><text display-inline="yes-display-inline">The Congress finds the following:</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="H2E6D684D127C4400A7A2ECE400F903BE"><enum>(A)</enum><text display-inline="yes-display-inline">According to decisions of the courts of the

			 State of Colorado, the United States has existing rights to water within the

			 Rocky Mountain National Park.</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H214EEF0FF6ED4C668C4E000000717926"><enum>(B)</enum><text display-inline="yes-display-inline">Those rights are sufficient for the

			 purposes of the Rocky Mountain National Park Wilderness as designated by

			 section 2.</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9DB70F972165498CB4658E7D177E7895"><enum>(C)</enum><text display-inline="yes-display-inline">In light of the findings in subparagraphs

			 (A) and (B), there is no need for this Act to effect a reservation by the

			 United States of any additional water rights to fulfill the purposes for which

			 the Rocky Mountain National Park Wilderness is designated.</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8C783A71CE0448F9934E7F671B69BF4"><enum>(2)</enum><header>No

			 reservation</header><text display-inline="yes-display-inline">Nothing in this

			 Act or any action taken pursuant to this Act shall constitute either an express

			 or implied reservation of water or water rights for any purpose.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H0CE5A14E15C243F0B6E52848116E12E4"><enum>(c)</enum><header>Colorado-Big

			 Thompson Project</header>

				<paragraph commented="no" display-inline="no-display-inline" id="HA8883BBA7A9A4A8CB953EC51C42148A5"><enum>(1)</enum><header>Current

			 activities</header><text display-inline="yes-display-inline">Activities on,

			 under, or affecting the lands designated as wilderness by section 2 relating to

			 the monitoring, operation, maintenance, repair, replacement, and use of the

			 Colorado-Big Thompson Project and its facilities which were allowed as of June

			 1, 1998, shall be allowed to continue and shall not be affected by the

			 designation of the lands as wilderness.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD599417421F24508A6DFBF906533B43C"><enum>(2)</enum><header>New

			 activities</header><text display-inline="yes-display-inline">In addition to the

			 activities described in paragraph (1), any other activities on, under, or

			 affecting the lands designated as wilderness by section 2 that because of

			 emergencies or catastrophic events become necessary for the operation,

			 maintenance, repair, replacement, and continued use of the Colorado-Big

			 Thompson Project and its facilities shall be allowed, subject only to

			 reasonable restrictions which are established by the Secretary of the Interior

			 to protect the wilderness values of the lands. In implementing this paragraph,

			 the Secretary shall not establish any restrictions on the activities that would

			 prevent the occurrence of such necessary activities or that would reduce the

			 water supply provided by the Colorado-Big Thompson Project or the Windy Gap

			 Project.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7D7251FE74944E67A987B2304BBD0031"><enum>(3)</enum><header>Relation to

			 authority in Act establishing park</header><text display-inline="yes-display-inline">Nothing in the first section of the Act of

			 January 26, 1915 (16 U.S.C. 191), shall be construed to allow development

			 within the lands designated as wilderness by section 2 of any reclamation

			 project not in existence as of the date of the enactment of this Act.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HF4ADDB42BD7D4066A722D7936BB6ACA7"><enum>(d)</enum><header>No buffer

			 zones</header><text display-inline="yes-display-inline">Congress does not

			 intend that the designation by this Act of the Rocky Mountain National Park

			 Wilderness creates or implies the creation of protective perimeters or buffer

			 zones around the wilderness area. The fact that nonwilderness activities or

			 uses can be seen or heard from within the wilderness area shall not, of itself,

			 preclude such activities or uses up to the boundary of the wilderness

			 area.</text>

			</subsection></section></legis-body>
