		  pornography and support law enforcement and other efforts to combat Internet

		  and pornography-related crimes against children.</official-title>

		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Internet Safety and Child Protection

			 Act of 2005</short-title></quote>.</text>

		</section><section commented="no" display-inline="no-display-inline" id="id4F805AAF1A264611B0F795A2CD4AE943" section-type="subsequent-section"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to—</text>

			<paragraph commented="no" display-inline="no-display-inline" id="idBCAEFCADCCD54773B2CDAAE4DB2F0964"><enum>(1)</enum><text display-inline="yes-display-inline">set tighter age verification standards to

			 block minors from entering Internet pornography sites; and</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idEC38F324F75E4E3591F7FFCE938AB047"><enum>(2)</enum><text display-inline="yes-display-inline">provide funding and support to law

			 enforcement efforts to combat Internet and pornography-related crimes against

			 children.</text>

			</paragraph></section><title commented="no" id="id14A4FBD3911049CAB3AC53E1E42AB5A9" style="OLC"><enum>I</enum><header>Child Protection Efforts</header>

			<section commented="no" display-inline="no-display-inline" id="id88DEB49A178A4E279D6A1F3768E3F6F9" section-type="subsequent-section"><enum>101.</enum><header>Age verification

			 requirement</header>

				<subsection commented="no" display-inline="no-display-inline" id="id61F868C8645A4212A414AEF53198C6CC"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">An operator of a

			 regulated pornographic Web site shall verify that any user attempting to access

			 their site is 18 years of age or older using software certified for that

			 purpose by the Commission.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="id32E02481EDEC4A34AF1FCB5EA4499C15"><enum>(b)</enum><header>Requirement</header><text display-inline="yes-display-inline">The age verification required by this

			 section shall take place prior to the display of any pornographic material,

			 including free content that may be available prior to the purchase of a

			 subscription or product.</text>

				</subsection></section><section commented="no" display-inline="no-display-inline" id="idBEBD2EEAF8A34AD9B81CA53098214459" section-type="subsequent-section"><enum>102.</enum><header>Credit card

			 requirement</header><text display-inline="no-display-inline">A bank, credit

			 card company, third-party merchant, Internet payment service provider, or

			 business that performs financial transactions for a regulated pornographic Web

			 site shall only process age-verified Internet pornography credit card

			 transactions for sales carried out in accordance with this title.</text>

			</section><section commented="no" display-inline="no-display-inline" id="idF114FB479004494DB2F48AEC874BE133" section-type="subsequent-section"><enum>103.</enum><header>Commission

			 requirement</header><text display-inline="no-display-inline">The Commission

			 shall—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="IDe1202a5b24e7424fa9223c990693f13f"><enum>(1)</enum><text display-inline="yes-display-inline">require each regulated pornographic Web

			 site to—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="ID3302308f29954c41bf10b50cb74a3802"><enum>(A)</enum><text display-inline="yes-display-inline">use appropriate age-screening software to

			 carry out this title; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID67c25920ebc64699b9f10b7038ec4555"><enum>(B)</enum><text display-inline="yes-display-inline">use that software correctly and

			 consistently through such means as conducting periodic tests trying to access

			 the Web site without appropriate age verifications; and</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID90fda90c80db4b958d7923d111ab734b"><enum>(2)</enum><text display-inline="yes-display-inline">in coordination with the Department of

			 Justice and other Federal agencies, maintain a list of regulated pornographic

			 Web sites that are not in compliance with section 101.</text>

				</paragraph></section><section commented="no" display-inline="no-display-inline" id="H49E07D4BF28B429D9C2FCB917BED9C46" section-type="subsequent-section"><enum>104.</enum><header>Enforcement by the

			 Federal Trade Commission</header>

				<subsection commented="no" display-inline="no-display-inline" id="HA9919F9B57874EC8A6E8CD99C2275FA"><enum>(a)</enum><header>Unfair or

			 deceptive acts or practices</header><text display-inline="yes-display-inline">A

			 violation of section 101 shall be treated as a violation of section 18 of the

			 <act-name parsable-cite="FTCA">Federal Trade Commission Act</act-name> (15

			 U.S.C. 57a) regarding unfair or deceptive acts or practices.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="HD17B6CE1D51F42D69B002D33BF8817F"><enum>(b)</enum><header>Powers of

			 Commission</header><text display-inline="yes-display-inline">The Commission

			 shall issue and enforce the regulations for the enforcement of section 101 in

			 the same manner, by the same means, and with the same jurisdiction, powers, and

			 duties as though all applicable terms and provisions of the

			 <act-name parsable-cite="FTCA">Federal Trade Commission Act</act-name> (15

			 U.S.C. 41 et seq.) were incorporated into and made a part of this title. Any

			 person who violates such regulations shall be subject to the penalties provided

			 in that title.</text>

				</subsection></section><section commented="no" display-inline="no-display-inline" id="idA4FE0DA8B2E04B7384B0EBBAE7B24E94" section-type="subsequent-section"><enum>105.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>

				<paragraph commented="no" display-inline="no-display-inline" id="id1A96FC958A354C24B70183BACC8EBBA8"><enum>(1)</enum><header>Commission</header><text display-inline="yes-display-inline">The term <term>Commission</term> means the

			 Federal Trade Commission.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id663B9939E2224983A6D9E86BBAEBE766"><enum>(2)</enum><header>Regulated

			 pornographic web site</header><text display-inline="yes-display-inline">The

			 term <term>regulated pornographic Web site</term> means a person required to

			 maintain documents verifying the age of persons engaged in sexually explicit

			 conduct pursuant to section 2257(a) of title 18, United States Code.</text>

				</paragraph></section></title><title commented="no" id="id66B5A0C74F4C48A7983B5C7CDDD9E4E0" style="OLC"><enum>II</enum><header>Funding for Child Protection</header>

			<subtitle commented="no" id="id726BF30BEC064D4C933EE857BB86E033" style="OLC"><enum>A</enum><header>Excise Tax</header>

				<section commented="no" display-inline="no-display-inline" id="id2EB4597BF68B480FAAC9F8EC37726AB8" section-type="subsequent-section"><enum>201.</enum><header>Excise tax on

			 Internet display or distribution of pornography</header>

					<subsection commented="no" display-inline="no-display-inline" id="id0BE82E77417D4C26A089BB0BD402CE08"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Chapter 33 of the

			 Internal Revenue Code of 1986 (relating to facilities and services) is amended

			 by inserting after subchapter C the following new subchapter:</text>

							<subchapter commented="no" id="idBCD7B0BB047A49509F22300B1FC8FE32"><enum>D</enum><header>Internet display

				or distribution of pornography</header>

								<toc>

									<toc-entry bold="off" level="section">Sec. 4285. Internet display

				  or distribution of pornography.</toc-entry>

								</toc>

								<section commented="no" display-inline="no-display-inline" id="idBEFA4F2AB2C64E359D1C1DACEAED4551" section-type="subsequent-section"><enum>4285.</enum><header>Internet display or

				distribution of pornography</header>

									<subsection commented="no" display-inline="no-display-inline" id="idBEA0A90D0326455595A772F49C8CAD7F"><enum>(a)</enum><header>Imposition of

				tax</header><text display-inline="yes-display-inline">There is imposed on

				amounts charged by a regulated pornographic Web site for individuals to receive

				the display or distribution of pornography through the Internet a tax equal to

				25 percent of the amounts so charged.</text>

									</subsection><subsection commented="no" display-inline="no-display-inline" id="idAC437B24F61F49BF8ED393990B0B0571"><enum>(b)</enum><header>Payment of

				tax</header><text display-inline="yes-display-inline">The tax imposed by this

				section shall be paid by the operator of the regulated pornographic Web site

				receiving payment for the display or distribution taxed under subsection

				(a).</text>

									</subsection><subsection commented="no" display-inline="no-display-inline" id="id1F38857633F24D46A3594CF1A2268D3C"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>

										<paragraph commented="no" display-inline="no-display-inline" id="id3CBB641B1AD7430FBEE63556B4260364"><enum>(1)</enum><header>Pornography</header><text display-inline="yes-display-inline">The term <term>pornography</term> has the

				same meaning as defined in section 2256(2) of title 18, United States

				Code.</text>

										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idAD739D4CB0744DD183974D9023CF27FB"><enum>(2)</enum><header>Regulated

				pornographic web site</header><text display-inline="yes-display-inline">The

				term <term>regulated pornographic Web site</term> has the same meaning as

				defined in section 105 of the Internet Safety and Child Protection Act of

				2005.</text>

										</paragraph></subsection></section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block>

					</subsection><subsection commented="no" display-inline="no-display-inline" id="idB16CFC9183704AE8B62E2F591C5873D1"><enum>(b)</enum><header>Conforming

			 Amendment</header><text display-inline="yes-display-inline">The table of

			 subchapters for chapter 33 of the Internal Revenue Code of 1986 is amended by

			 adding at the end the following new item:</text>

							</toc>

					</subsection><subsection commented="no" display-inline="no-display-inline" id="id75013DDEC71D4177A3646267D9E7460B"><enum>(c)</enum><header>Effective

			 date</header><text display-inline="yes-display-inline">The amendments made by

			 this section shall take effect on January 1, 2006.</text>

					</subsection></section></subtitle><subtitle commented="no" id="id948E1925C84C4D0693BFCE812F8A7083" style="OLC"><enum>B</enum><header>Child Protection Programs</header>

				<section commented="no" display-inline="no-display-inline" id="id7C22558F662E46F09CE98DC93538A23A" section-type="subsequent-section"><enum>211.</enum><header>Trust fund</header>

					<subsection commented="no" display-inline="no-display-inline" id="id7A4942DFEBCA4D7CA531D61EFB4B27ED"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">There is established

			 in the Treasury the Internet Safety and Child Protection Trust Fund (referred

			 to in this subtitle as the <quote>trust fund</quote>) into which shall be

			 deposited all taxes collected under section 4285 of the Internal Revenue Code

			 of 1986.</text>

					</subsection><subsection commented="no" display-inline="no-display-inline" id="idFE293DF4328348D59787104A09984701"><enum>(b)</enum><header>Availability of

			 amounts</header><text display-inline="yes-display-inline">Amounts deposited

			 into the trust fund shall be available to carry out the programs provided in

			 section 212, subject to annual appropriations.</text>

					</subsection></section><section commented="no" display-inline="no-display-inline" id="id652ED490AE3F412F84B892E7D8B8D6BD" section-type="subsequent-section"><enum>212.</enum><header>Funding for Child

			 Internet Safety and protection programs</header>

					<subsection commented="no" display-inline="no-display-inline" id="idDEFF1C968B014DBFA866CCA520DDEC74"><enum>(a)</enum><header>Priorities</header><text display-inline="yes-display-inline">Amounts available in the trust fund shall

			 be allocated on a priority basis as follows:</text>

						<paragraph commented="no" display-inline="no-display-inline" id="id149B34D448A84EAFBF95387F5FD9FC68"><enum>(1)</enum><header>Enforcement of

			 this Act</header><text display-inline="yes-display-inline">The first priority

			 for the use of amounts in the trust fund shall be to provide funding for the

			 appropriate Federal agencies to carry out the enforcement of sections 103, 104,

			 and 201 of this Act. Funding may also be used to promote the development of

			 technology that would facilitate the enforcement of this Act.</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDde8d9effcbb74e8fab4953c45a4efe95"><enum>(2)</enum><header>Department of

			 Justice cyber tip-line</header><text display-inline="yes-display-inline">The

			 second priority for the use of amounts in the trust fund shall be to provide

			 funds to the Office of Juvenile Justice and Delinquency Prevention to ensure

			 that the congressionally-mandated cyber tip line is fully operational and

			 staffed 24 hours a day.</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID226e26da96ed44c1889dc257d8406b99"><enum>(3)</enum><header>Internet crimes

			 against children task force</header><text display-inline="yes-display-inline">The third priority for the use of amounts

			 in the trust fund shall be to provide funds to States to support 1 Internet

			 Crimes Against Children Task Force center per 5,000,000 State residents, with

			 each State receiving sufficient funding to support at least 1 center and no

			 State receiving funding for more than 7 centers.</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd07b3e511a974c9ebdd52c5cbab05733"><enum>(4)</enum><header>Research and

			 development grants</header>

							<subparagraph commented="no" display-inline="no-display-inline" id="id44A19B6EA6DE474295E6E8029F0F45C4"><enum>(A)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The fourth priority

			 for the use of amounts in the trust fund is to establish a competitive grant

			 process for companies and other organizations who work in the technology field

			 to support the research and development into new filtering technologies that

			 will help parents control children’s access to inappropriate content via

			 wireless and other emerging technologies.</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3E1C677676944DC1A14D2162B00F4213"><enum>(B)</enum><header>Set

			 aside</header><text display-inline="yes-display-inline">The Attorney General

			 shall allocate up to 10 percent of annual trust fund revenues to award a

			 minimum of 15 research and development grants under this paragraph.</text>

							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3c083322c79b4f03a3f30bbda3f438e7"><enum>(5)</enum><header>Educational

			 training</header>

							<subparagraph commented="no" display-inline="no-display-inline" id="id7BA6B0329C06434080470016F0357430"><enum>(A)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The fifth priority

			 for the use of amounts in the trust fund shall be to provide relevant State

			 agencies with funds to support educational training contributing to greater

			 child Internet safety and reductions in sex trafficking and sex crimes against

			 children.</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1922F8083F8A4F6DA71889D7FAF4A862"><enum>(B)</enum><header>Conditions</header><text display-inline="yes-display-inline">The program authorized by this paragraph

			 shall be carried out subject to the following conditions:</text>

								<clause commented="no" display-inline="no-display-inline" id="IDff247bd6b1b344c9b9c972374de5d60c"><enum>(i)</enum><text display-inline="yes-display-inline">States shall receive funding amounting to

			 $1 for every resident, with a minimum of $1,000,000 for each State.</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="IDe60149da39f24521986c6f71401b2106"><enum>(ii)</enum><text display-inline="yes-display-inline">25 percent of each State’s funding shall go

			 to the State education agency to support State and local programs providing

			 child Internet safety training to teachers.</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="IDdfad2eefd24f42149d5ba63438d3df9c"><enum>(iii)</enum><text display-inline="yes-display-inline">30 percent of each State’s funding shall go

			 to the State Attorneys’ General office to support child Internet safety

			 training for law enforcement, as well as training that enhances the capacity of

			 law enforcement to combat sex trafficking and sex crimes against

			 children.</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="IDb268c8cb47a247edb65ea7062c1afca1"><enum>(iv)</enum><text display-inline="yes-display-inline">10 percent of each State’s funding shall be

			 allocated to the Governor's office to develop and implement a coordinated State

			 child internet safety strategy.</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="ID977866b04b204e0e916767fa9da14223"><enum>(v)</enum><text display-inline="yes-display-inline">35 percent of the State funding shall go to

			 the relevant State agency to support Public Service Announcements promoting

			 child Internet safety.</text>

								</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID31a6457e395749398d9f44b632877086"><enum>(6)</enum><header>Remaining

			 amounts</header><text display-inline="yes-display-inline">After fully funding

			 the priorities established in paragraphs (1) through (5) for a fiscal year any

			 remaining amounts shall be allocated as follows:</text>

							<subparagraph commented="no" display-inline="no-display-inline" id="idD86706C553144AF1A8BFA0AAB6E35150"><enum>(A)</enum><header>Federal agency

			 support</header><text display-inline="yes-display-inline">50 percent of

			 remaining amounts shall be used to provide funding to support child Internet

			 safety activities, as well as activities combating sex trafficking and sex

			 crimes against children, on the part of the following Federal agencies:</text>

								<clause commented="no" display-inline="no-display-inline" id="IDe7e456e2f4194c2b872086c495133731"><enum>(i)</enum><text display-inline="yes-display-inline">Department of Justice.</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="ID34ff40f18d154c1dae12091f98542f84"><enum>(ii)</enum><text display-inline="yes-display-inline">Department of Commerce.</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="ID1d9aee8d206b4cb1970e5bcb7710829f"><enum>(iii)</enum><text display-inline="yes-display-inline">Department of Defense.</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="IDb8c51cea1d1340498320a92962d1f8f4"><enum>(iv)</enum><text display-inline="yes-display-inline">Department of Education.</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="ID762666534636444ab5388489b941f487"><enum>(v)</enum><text display-inline="yes-display-inline">Department of Health and Human

			 Services.</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="ID246f38a5186d49478c32019b1277372a"><enum>(vi)</enum><text display-inline="yes-display-inline">Department of State.</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="IDf78dd8e11d6e42fdba5ae8b8c8e7a62d"><enum>(vii)</enum><text display-inline="yes-display-inline">Department of Homeland Security.</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="ID57f4c11311d843909fec3dc5a2a7072c"><enum>(viii)</enum><text display-inline="yes-display-inline">Department of Treasury.</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="IDb974d2f01db14e309a8d88c3d48fd232"><enum>(ix)</enum><text display-inline="yes-display-inline">Department of Agriculture.</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="IDb37b90b288564fddbd0c54056310d077"><enum>(x)</enum><text display-inline="yes-display-inline">United States Postal Service.</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="ID76d09e447c6243c2b92276b53d8ba3b4"><enum>(xi)</enum><text display-inline="yes-display-inline">Federal Trade Commission.</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="ID43edbbb39c4946de90232f3f31a2fbe2"><enum>(xii)</enum><text display-inline="yes-display-inline">Federal Communications Commission.</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="IDa543e61a7bfc4604882e4b8305d49a38"><enum>(xiii)</enum><text display-inline="yes-display-inline">National Aeronautics and Space

			 Administration.</text>

								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDd2bf8ecc075e42ee9ee76d0c081791c8"><enum>(B)</enum><header>Private

			 entities</header>

								<clause commented="no" display-inline="no-display-inline" id="idC9A3055D6BE14B50A81BBAC0F596D7D2"><enum>(i)</enum><header>In

			 general</header><text display-inline="yes-display-inline">50 percent of

			 remaining amounts shall be allocated through a competitive grant process to

			 international and domestic nongovernmental organizations and not-for-profits,

			 to support work promoting child Internet safety and combating sex trafficking

			 and sex crimes against children.</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="id277A0584381C4B22A338A08E04C2E474"><enum>(ii)</enum><header>Details</header><text display-inline="yes-display-inline">The Attorney General shall—</text>

									<subclause commented="no" display-inline="no-display-inline" id="id14AAE2586E57480EA4E2764578EC35EE"><enum>(I)</enum><text display-inline="yes-display-inline">publish guidance in the Federal Register

			 describing the variety and scope of organizational work to be funded under this

			 subparagraph in a fiscal year and soliciting grant proposals under this

			 subparagraph; and</text>

									</subclause><subclause commented="no" display-inline="no-display-inline" id="id8933AE12453F41CE8CE73B9038AF9C59"><enum>(II)</enum><text display-inline="yes-display-inline">allocate funds on the basis of a

			 competitive grant process.</text>

									</subclause></clause><clause commented="no" display-inline="no-display-inline" id="idD3564D1992EE42DB9D6EF4585EA5E177"><enum>(iii)</enum><header>Funding

			 limit</header><text display-inline="yes-display-inline">For every $1 allocated

			 for international work under this subparagraph, the Attorney General shall
