		  conduct a pilot program under which up to 15 States may issue electronic

		  Federal migratory bird hunting stamps.</official-title>

		<section commented="no" display-inline="no-display-inline" id="idEF45B4DCFB934DB4BF744344A318A8E4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Electronic Duck Stamp Act of

			 2005</short-title></quote>.</text>

		</section><section commented="no" display-inline="no-display-inline" id="HD952F44D1EFA4F86A53F3D2469E2236C" section-type="subsequent-section"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>

			<paragraph commented="no" display-inline="no-display-inline" id="H19787DB187CF4EBDAD57B50235AA89E4"><enum>(1)</enum><text display-inline="yes-display-inline">on March 16, 1934, Congress passed and

			 President Roosevelt signed the Act of March 16, 1934 (16 U.S.C. 718a et seq.)

			 (popularly known as the <quote>Duck Stamp Act</quote>), which requires all

			 migratory waterfowl hunters 16 years of age or older to buy a Federal migratory

			 bird hunting and conservation stamp annually;</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2D22052C019F49D1B95BA002625CAC7F"><enum>(2)</enum><text display-inline="yes-display-inline">the Federal Duck Stamp program has become

			 one of the most popular and successful conservation programs ever

			 initiated;</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3A4AC0D752414F048AA005345848C9D9"><enum>(3)</enum><text display-inline="yes-display-inline">because of that program, the United States

			 again is teeming with migratory waterfowl and other wildlife that benefit from

			 wetland habitats;</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE4867CF212F549FCBB8D8D0050C08452"><enum>(4)</enum><text display-inline="yes-display-inline">as of the date of enactment of this Act,

			 1,700,000 migratory bird hunting and conservation stamps are sold each

			 year;</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id55A847D09D664086BEF9EDAF7AE69A64"><enum>(5)</enum><text display-inline="yes-display-inline">as of 2003, those stamps have generated

			 more than $600,000,000 in revenue that has been used to preserve more than

			 5,000,000 acres of migratory waterfowl habitat in the United States; and</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id48B20DEC7EEA452AAAF74570D3A9ADE9"><enum>(6)</enum><text display-inline="yes-display-inline">many of the more than 540 national wildlife

			 refuges have been paid for wholly or partially with that revenue.</text>

			</paragraph></section><section commented="no" display-inline="no-display-inline" id="HE6335C50C21941E58601314BE175DFCF" section-type="subsequent-section"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>

			<paragraph commented="no" display-inline="no-display-inline" id="H088E6D0D7A994C38AD56BDC3DDC509AE"><enum>(1)</enum><header>Actual

			 stamp</header><text display-inline="yes-display-inline">The term <term>actual

			 stamp</term> means a Federal migratory-bird hunting and conservation stamp

			 required under the Act of March 16, 1934 (16 U.S.C. 718a et seq.) (popularly

			 known as the <quote>Duck Stamp Act</quote>), that is printed on paper and sold

			 through a means in use immediately before the date of enactment of this

			 Act.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0BC46665D2354859B06DA4C35CFEF7BA"><enum>(2)</enum><header>Automated

			 licensing system</header>

				<subparagraph commented="no" display-inline="no-display-inline" id="idAB9F1F60626040FA9A874C7749B97BC9"><enum>(A)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The term

			 <term>automated licensing system</term> means an electronic, computerized

			 licensing system used by a State fish and wildlife agency to issue hunting,

			 fishing, and other associated licenses and products.</text>

				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H6F959FBB6AF34564928525387BBD9DD5"><enum>(B)</enum><header>Inclusion</header><text display-inline="yes-display-inline">The term <term>automated licensing

			 system</term> includes a point-of-sale, Internet, or telephonic system used for

			 a purpose described in subparagraph (A).</text>

				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFED47AB6483C43D28109F91B3ECFE200"><enum>(3)</enum><header>Electronic

			 stamp</header><text display-inline="yes-display-inline">The term

			 <term>electronic stamp</term> means an electronic version of an actual stamp

			 that—</text>

				<subparagraph commented="no" display-inline="no-display-inline" id="HCD7F63AF49784CC485375F6F1816AC37"><enum>(A)</enum><text display-inline="yes-display-inline">is a unique identifier for the individual

			 to whom it is issued;</text>

				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H805A79B9F0D0449DBA3F8C66284654BF"><enum>(B)</enum><text display-inline="yes-display-inline">can be printed on paper;</text>

				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H48EC87D3387E4DE1B5CC84A78FDD50B4"><enum>(C)</enum><text display-inline="yes-display-inline">is issued through a State automated

			 licensing system that is authorized, under State law and by the Secretary under

			 this Act, to issue electronic stamps;</text>

				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HDF30BBE447444FB8AF7931AB8D495BDE"><enum>(D)</enum><text display-inline="yes-display-inline">is compatible with the hunting licensing

			 system of the State that issues the electronic stamp; and</text>

				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE64CC045A30642F3005B746B4886FF58"><enum>(E)</enum><text display-inline="yes-display-inline">is described in the State application

			 approved by the Secretary under section 4(b).</text>

				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idBCD50898F31D4D39A6EA3216C8A10B84"><enum>(4)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the

			 Secretary of the Interior.</text>

			</paragraph></section><section commented="no" display-inline="no-display-inline" id="H48D5402914A6477D954C975D51DF568E" section-type="subsequent-section"><enum>4.</enum><header>Electronic duck stamp

			 pilot program</header>

			<subsection commented="no" display-inline="no-display-inline" id="H3A3040B1BA5F46DDBFA7E93BAF97C200"><enum>(a)</enum><header>Requirement To

			 conduct program</header><text display-inline="yes-display-inline">The Secretary

			 shall conduct a 3-year pilot program under which up to 15 States authorized by

			 the Secretary may issue electronic stamps.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="H4A46DA50956A406AA2F1F4B438E7397"><enum>(b)</enum><header>Commencement and

			 duration of program</header><text display-inline="yes-display-inline">The

			 Secretary shall—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="H9C772664BCA14F439F004BF025638BA6"><enum>(1)</enum><text display-inline="yes-display-inline">use all means necessary to expeditiously

			 implement this section by the date that is 1 year after the beginning of the

			 first full Federal migratory waterfowl hunting season after the date of

			 enactment of this Act; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFE026EDA4A054634BCB9EA7F891402E9"><enum>(2)</enum><text display-inline="yes-display-inline">carry out the pilot program for 3 Federal

			 migratory waterfowl hunting seasons.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H2F9EC60DFCE343D09874D0A617B4B592"><enum>(c)</enum><header>Consultation</header><text display-inline="yes-display-inline">The Secretary shall carry out the program

			 in consultation with State management agencies.</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="H651ADDC5E81E4EFFA4BDEBA539A48498" section-type="subsequent-section"><enum>5.</enum><header>State

			 application</header>

			<subsection commented="no" display-inline="no-display-inline" id="H563EB7599F37426FAF0157A57C4EFBEF"><enum>(a)</enum><header>Approval of

			 application required</header><text display-inline="yes-display-inline">A State

			 may not participate in the pilot program under this Act unless the Secretary

			 has received and approved an application submitted by the State in accordance

			 with this section.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="HB5D39223A4294BCFA2D43000AC00C814"><enum>(b)</enum><header>Contents of

			 application</header><text display-inline="yes-display-inline">The Secretary may

			 not approve a State application unless the application contains—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="HF6FF9B40E2A341B48217526EAE2473B"><enum>(1)</enum><text display-inline="yes-display-inline">a description of the format of the

			 electronic stamp that the State will issue under the pilot program, including

			 identifying features of the licensee that will be specified on the

			 stamp;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCD5B24A602A64483BEF639B15002E1F"><enum>(2)</enum><text display-inline="yes-display-inline">a description of any fee the State will

			 charge for issuance of an electronic stamp;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H245F5BC2C6784E4282CB2031BFAC003F"><enum>(3)</enum><text display-inline="yes-display-inline">a description of the process the State will

			 use to account for and transfer to the Secretary the amounts collected by the

			 State that are required to be transferred to the Secretary under the

			 program;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC6A5684A1A814368B1C207B0EC162E9B"><enum>(4)</enum><text display-inline="yes-display-inline">the manner by which the State will transmit

			 electronic stamp customer data to the Secretary;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3CCD576D1D794228B4C6A46B20051776"><enum>(5)</enum><text display-inline="yes-display-inline">the manner by which actual stamps will be

			 delivered;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF305E3E573DC48F1ACD24E320000D552"><enum>(6)</enum><text display-inline="yes-display-inline">the policies and procedures under which the

			 State will issue duplicate electronic stamps; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H43D550E7647745C7BF2E610455573FEA"><enum>(7)</enum><text display-inline="yes-display-inline">such other policies, procedures, and

			 information as may be reasonably required by the Secretary.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HAE61936356E2469CA1799E5E415C4F95"><enum>(c)</enum><header>Publication of

			 deadlines, eligibility requirements, and selection criteria</header><text display-inline="yes-display-inline">Not later than 30 days before the date on

			 which the Secretary begins accepting applications for participation in the

			 pilot program, the Secretary shall publish—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="HAAF17844B7414CB3929D3F8750CE00E7"><enum>(1)</enum><text display-inline="yes-display-inline">deadlines for submission of applications to

			 participate in the program;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HEC7F1E37049E41C5BFB5717537274BC5"><enum>(2)</enum><text display-inline="yes-display-inline">eligibility requirements for participation

			 in the program; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA937DA4F306A406F8029362BE2AFBDA5"><enum>(3)</enum><text display-inline="yes-display-inline">criteria for selecting States to

			 participate in the program.</text>

				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="HA659AC765B854CAD00B207A59D001595" section-type="subsequent-section"><enum>6.</enum><header>State obligations and

			 authorities</header>

			<subsection commented="no" display-inline="no-display-inline" id="HFF6CA0C6E0EA4D17813456B0A3053BCF"><enum>(a)</enum><header>Delivery of

			 actual stamp</header><text display-inline="yes-display-inline">The Secretary

			 shall require that each individual to whom a State sells an electronic stamp

			 under the pilot program shall receive an actual stamp—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="id1F2ABFA3BBEC49E2A31F5895694694A2"><enum>(1)</enum><text display-inline="yes-display-inline">by not later than the date on which the

			 electronic stamp expires under section 7(c); and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD17733343DD649E58F9D62E985C9194C"><enum>(2)</enum><text display-inline="yes-display-inline">in a manner agreed upon by the State and

			 Secretary.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H78D1F0EBFD964310A0EC4B00FAFC8C74"><enum>(b)</enum><header>Collection and

			 transfer of electronic stamp revenue and customer information</header>

				<paragraph commented="no" display-inline="no-display-inline" id="H32AD00649E914ADAAEDCFA5F2F26A77C"><enum>(1)</enum><header>Requirement to

			 transmit</header><text display-inline="yes-display-inline">The Secretary shall

			 require each State participating in the pilot program to collect and submit to

			 the Secretary in accordance with this section—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="HD28605664D924158ADA2C953A668C79C"><enum>(A)</enum><text display-inline="yes-display-inline">the first name, last name, and complete

			 mailing address of each individual that purchases an electronic stamp from the

			 State;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H71F8C7AAC293410A9F37082FC5FC3F40"><enum>(B)</enum><text display-inline="yes-display-inline">the face value amount of each electronic

			 stamp sold by the State; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD2EF96EEE97B4D2D8B91DB84C55D9FB7"><enum>(C)</enum><text display-inline="yes-display-inline">the amount of the Federal portion of any

			 fee required by the agreement for each stamp sold.</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5E8325CCC0D944799D3E3DF64E73AC36"><enum>(2)</enum><header>Time of

			 transmittal</header><text display-inline="yes-display-inline">The Secretary

			 shall require the submission under paragraph (1) to be made with respect to

			 sales of electronic stamps by a State occurring in a month—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="HD04F6EFADE0A40C1BBD54EEA1DC4EB47"><enum>(A)</enum><text display-inline="yes-display-inline">by not later than the 15th day of the

			 subsequent month; or</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE1DD9B2101DC4644B342759F21128460"><enum>(B)</enum><text display-inline="yes-display-inline">as otherwise specified in the application

			 of the State approved by the Secretary under section 5.</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H07A4E9192E5B48A08BE5007547AC77F2"><enum>(3)</enum><header>Additional fees

			 not affected</header><text display-inline="yes-display-inline">This section

			 shall not apply to the State portion of any fee collected by a State under

			 subsection (c).</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H9E4E7FF7F25F487B9385626B162CA7FE"><enum>(c)</enum><header>Electronic stamp

			 issuance fee</header><text display-inline="yes-display-inline">A State

			 participating in the pilot program may charge a reasonable fee to cover costs

			 incurred by the State and the Department of the Interior in issuing electronic

			 stamps under the program, including costs of delivery of actual stamps.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="HE7FDE8DC6BA44333B93C00E3E88B5EE"><enum>(d)</enum><header>Duplicate

			 electronic stamps</header><text display-inline="yes-display-inline">A State

			 participating in the pilot program may issue a duplicate electronic stamp to

			 replace an electronic stamp issued by the State that is lost or damaged.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="H2C80B0BC4296439D8E0085FC3B9462CB"><enum>(e)</enum><header>Limitation on

			 authority To require purchase of state license</header><text display-inline="yes-display-inline">A State may not require that an individual

			 purchase a State hunting license as a condition of issuing an electronic stamp

			 under the pilot program.</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="H8127AEE91E544FD79458A77464710141" section-type="subsequent-section"><enum>7.</enum><header>Electronic stamp

			 requirements; recognition of electronic stamp</header>

			<subsection commented="no" display-inline="no-display-inline" id="H411677461A7748C59D60FC1FAF21809"><enum>(a)</enum><header>Stamp

			 requirements</header><text display-inline="yes-display-inline">The Secretary

			 shall require an electronic stamp issued by a State under the pilot

			 program—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="HBB0DC0CB58634595857C18E45E749363"><enum>(1)</enum><text display-inline="yes-display-inline">to have the same format as any other

			 license, validation, or privilege the State issues under the automated

			 licensing system of the State; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF86A8D045B60422F977DE61FF8F02128"><enum>(2)</enum><text display-inline="yes-display-inline">to specify identifying features of the

			 licensee that are adequate to enable Federal, State, and other law enforcement

			 officers to identify the holder.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H54721336807F4D3EA87F00814FFAFB1C"><enum>(b)</enum><header>Recognition of

			 electronic stamp</header><text display-inline="yes-display-inline">Any

			 electronic stamp issued by a State under the pilot program shall, during the

			 effective period of the electronic stamp—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="H10EDC936AB2A4C68B27CDD64B71789F"><enum>(1)</enum><text display-inline="yes-display-inline">bestow upon the licensee the same

			 privileges as are bestowed by an actual stamp;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H58895EAFE8DF4078943765F35D743541"><enum>(2)</enum><text display-inline="yes-display-inline">be recognized nationally as a valid Federal

			 migratory bird hunting and conservation stamp; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD6A81768495D466096A0FB1E1F9B2008"><enum>(3)</enum><text display-inline="yes-display-inline">authorize the licensee to hunt migratory

			 waterfowl in any other State, in accordance with the laws of the other State

			 governing that hunting.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H34051923685E4DCB9B6BCAD80456FA"><enum>(c)</enum><header>Duration</header><text display-inline="yes-display-inline">An electronic stamp issued by a State under

			 the pilot program shall be valid for a period agreed to by the State and the

			 Secretary, which shall not exceed 45 days.</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="H1DA3D56C42554ED5B08CD324B8BDA2E2" section-type="subsequent-section"><enum>8.</enum><header>Termination of State

			 participation</header><text display-inline="no-display-inline">Participation by

			 a State in the pilot program may be terminated—</text>

			<paragraph commented="no" display-inline="no-display-inline" id="H437326FB798C458284B6A68C20DA3FC3"><enum>(1)</enum><text display-inline="yes-display-inline">by the Secretary, if the Secretary—</text>

				<subparagraph commented="no" display-inline="no-display-inline" id="H087E9BB905BF4010AE3E9D9BE161D55"><enum>(A)</enum><text display-inline="yes-display-inline">finds that the State has violated any of

			 the terms of the application of the State approved by the Secretary under

			 section 5; and</text>

				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9946AABE111F465B851722676948A100"><enum>(B)</enum><text display-inline="yes-display-inline">provides to the State written notice of the

			 termination by not later than the date that is 30 days before the date of

			 termination; or</text>

				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA1EAAB0F7A8F43F69E769EA5A0CEEB8E"><enum>(2)</enum><text display-inline="yes-display-inline">by the State, by providing written notice

			 to the Secretary by not later than the date that is 30 days before the

			 termination date.</text>

			</paragraph></section><section commented="no" display-inline="no-display-inline" id="H6529F635763F493697E71D4227DF53E4" section-type="subsequent-section"><enum>9.</enum><header>Evaluation</header>

			<subsection commented="no" display-inline="no-display-inline" id="H2A7D6A93A88C4D83A3008E11516618A1"><enum>(a)</enum><header>Evaluation</header><text display-inline="yes-display-inline">The Secretary, in consultation with State

			 fish and wildlife management agencies and appropriate stakeholders with

			 expertise specific to the duck stamp program, shall evaluate the pilot program

			 and determine whether the pilot program has provided a cost-effective and

			 convenient means for issuing migratory-bird hunting and conservation stamps,

			 including whether the program has—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="H7E2084B82E8844EBAA87F3BA7DBD280"><enum>(1)</enum><text display-inline="yes-display-inline">increased the availability of those

			 stamps;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1CBC4F1E91224D5EB9176724CAC15239"><enum>(2)</enum><text display-inline="yes-display-inline">assisted States in meeting the customer

			 service objectives of the States with respect to those stamps;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H66A056451AD94751AE20678FF1E347B5"><enum>(3)</enum><text display-inline="yes-display-inline">maintained actual stamps as an effective

			 and viable conservation tool; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id561DDACDD22343EBAE57008673DB4D15"><enum>(4)</enum><text display-inline="yes-display-inline">maintained adequate retail availability of

			 the traditional paper stamp.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H6189823A16A5497482A46CF5EFB375DD"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">The Secretary shall submit to Congress a
