		<official-title display="yes">To amend the Elementary and Secondary

		  Education Act of 1965 to establish a pilot program to make grants to eligible

		  institutions to develop, demonstrate, or disseminate information on practices,

		  methods, or techniques relating to environmental education and training in the

		  Chesapeake Bay watershed.</official-title>

		<section commented="no" display-inline="no-display-inline" id="IDFCC88508599E48048564E90020845129" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Chesapeake Bay Environmental Education

			 Pilot Program Act</short-title></quote>.</text>

		</section><section commented="no" display-inline="no-display-inline" id="IDC2982FD854114803B1F31CC6F02637DC" section-type="subsequent-section"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>

			<paragraph commented="no" display-inline="no-display-inline" id="IDD8773E99892B447EB7B8D717C3865469"><enum>(1)</enum><text display-inline="yes-display-inline">increasing public environmental awareness

			 and understanding through formal environmental education and meaningful bay or

			 stream field experiences are vital parts of the effort to protect and restore

			 the Chesapeake Bay ecosystem;</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0F7962BE64304E49AECCE400812D5C19"><enum>(2)</enum><text display-inline="yes-display-inline">using the Chesapeake Bay watershed as an

			 integrating context for learning can help—</text>

				<subparagraph commented="no" display-inline="no-display-inline" id="IDE0D19BB69A9645CE8B55AB64CC40B43B"><enum>(A)</enum><text display-inline="yes-display-inline">advance student learning skills;</text>

				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID8EA89D61DD9E47068D7F97B57D836D1B"><enum>(B)</enum><text display-inline="yes-display-inline">improve academic achievement in core

			 academic subjects; and</text>

				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID7F2FDA178FA642B2B15676CD130686CE"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="ID4522C4B998024AD78991259E57ED6221"><enum>(i)</enum><text display-inline="yes-display-inline">encourage positive behavior of students in

			 school; and</text>

					</clause><clause commented="no" display-inline="no-display-inline" id="ID58AE52F891694E1300DA83AD65D52128" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">encourage environmental stewardship in

			 school and in the community; and</text>

					</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID85E0AD60C9894EC60098EF18CB4646CF"><enum>(3)</enum><text display-inline="yes-display-inline">the Federal Government, acting through the

			 Secretary of Education, should work with the Under Secretary for Oceans and

			 Atmosphere, the Chesapeake Executive Council, State educational agencies,

			 elementary schools and secondary schools, and nonprofit educational and

			 environmental organizations to support development of curricula, teacher

			 training, special projects, and other activities, to increase understanding of

			 the Chesapeake Bay watershed and to improve awareness of environmental

			 problems.</text>

			</paragraph></section><section commented="no" display-inline="no-display-inline" id="IDDC739C5CC6774966817866F4EA14CC73" section-type="subsequent-section"><enum>3.</enum><header>Chesapeake Bay

			 Environmental Education and Training Grant Pilot Program</header><text display-inline="no-display-inline">Title IV of the

			 <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of

			 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/7101">20

			 U.S.C. 7101</external-xref> et seq.) is amended by adding at the end the

			 following:</text>

				<part commented="no" id="ID92CDE91110824A7C9216C24D880986F5"><enum>D</enum><header>Chesapeake Bay

				Environmental Education and Training Grant Pilot Program</header>

					<section commented="no" display-inline="no-display-inline" id="ID73A8FB3B84F54F04ACD9589C6B026984" section-type="subsequent-section"><enum>4401.</enum><header>Definitions</header><text display-inline="no-display-inline">In this part:</text>

						<paragraph commented="no" display-inline="no-display-inline" id="ID2E967CB3B0AD47CE8C34CC9BEE6F1C95"><enum>(1)</enum><header>Bay Watershed

				State</header><text display-inline="yes-display-inline">The term <term>Bay

				Watershed State</term> means each of the States of Delaware, Maryland, New

				York, Pennsylvania, Virginia, and West Virginia, and the District of

				Columbia.</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID36522F1BEB1B4010A0A0186472EC08DF"><enum>(2)</enum><header>Chesapeake

				Executive Council</header><text display-inline="yes-display-inline">The term

				<term>Chesapeake Executive Council</term> has the meaning given the term in

				section 307(d) of the National Oceanic and Atmospheric Administration

				Authorization Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/15/1511d(e)">15 U.S.C. 1511d(d)</external-xref>).</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID40E35743F6A2476492B3053DBEFA336F"><enum>(3)</enum><header>Eligible

				institution</header><text display-inline="yes-display-inline">The term

				<term>eligible institution</term> means—</text>

							<subparagraph commented="no" display-inline="no-display-inline" id="IDAAB06575F58A44CCB836431DEEE7BFE3"><enum>(A)</enum><text display-inline="yes-display-inline">a public elementary school or secondary

				school located in a Bay Watershed State; and</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDE30E853F5EA945BFA4FEA171457E32D1"><enum>(B)</enum><text display-inline="yes-display-inline">a nonprofit environmental or educational

				organization located in a Bay Watershed State.</text>

							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID731AC5D16FB947A5A186CA7CC74BDBBE"><enum>(4)</enum><header>Program</header><text display-inline="yes-display-inline">The term <term>Program</term> means the

				Chesapeake Bay Environmental Education and Training Grant Pilot Program

				established under section 4402.</text>

						</paragraph></section><section commented="no" display-inline="no-display-inline" id="IDF11876B4B52A4C32B52B848471C988C2" section-type="subsequent-section"><enum>4402.</enum><header>Chesapeake Bay

				Environmental Education and Training Grant Pilot Program</header>

						<subsection commented="no" display-inline="no-display-inline" id="IDD6527E0E2DF040D5B11DD24482701C86"><enum>(a)</enum><header>In

				general</header><text display-inline="yes-display-inline">The Secretary shall

				establish a grant program, to be known as the <quote>Chesapeake Bay

				Environmental Education and Training Grant Pilot Program</quote>, to make

				grants to eligible institutions to pay the Federal share of the cost of

				developing, demonstrating, or disseminating information on practices, methods,

				or techniques relating to environmental education and training in the

				Chesapeake Bay watershed.</text>

						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID8207F69596684DF59E47E8ACA7E664C6"><enum>(b)</enum><header>Federal

				share</header><text display-inline="yes-display-inline">The Federal share

				referred to in subsection (a) shall be 50 percent.</text>

						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID5B1B1E606570433CAEE5CA6000AF6E87"><enum>(c)</enum><header>Administration</header><text display-inline="yes-display-inline">The Secretary may offer to enter into a

				cooperative agreement or contract with the National Fish and Wildlife

				Foundation established by the National Fish and Wildlife Foundation

				Establishment Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3701">16 U.S.C. 3701</external-xref> et seq.), the Under

				Secretary for Oceans and Atmosphere, a State educational agency, or a nonprofit

				organization that carries out environmental education and training programs,

				for administration of the Program.</text>

						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID8B1A9480AF3341CAA303E6D5721F7DB8"><enum>(d)</enum><header>Use of

				funds</header><text display-inline="yes-display-inline">An eligible institution

				that receives a grant under the Program shall use the funds made available

				through the grant to carry out a project consisting of—</text>

							<paragraph commented="no" display-inline="no-display-inline" id="IDA7EC85A808184C619200551750AE9ED7"><enum>(1)</enum><text display-inline="yes-display-inline">design, demonstration, or dissemination of

				environmental curricula, including development of educational tools or

				materials;</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5F6401D6900744D8A2C499BC98C028BC"><enum>(2)</enum><text display-inline="yes-display-inline">design or demonstration of field practices,

				methods, or techniques, including—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="ID5114080FAA324E99B01CDC2869ECF243"><enum>(A)</enum><text display-inline="yes-display-inline">assessments of environmental or ecological

				conditions; and</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID5839BDE5F1CE436EACFF9216AF5CF6BD"><enum>(B)</enum><text display-inline="yes-display-inline">analyses of environmental pollution or

				other natural resource problems;</text>

								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1FF6FDDAB5024DAD8ECA926DC683F731"><enum>(3)</enum><text display-inline="yes-display-inline">understanding and assessment of a specific

				environmental issue or a specific environmental problem;</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7332E94B3A194709A92EC713FD647B5F"><enum>(4)</enum><text display-inline="yes-display-inline">provision of training or related education

				for teachers or other educational personnel, including provision of programs or

				curricula to meet the needs of students in various age groups or at various

				grade levels;</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDF547123C47214C19ACEA033E7483FCB8"><enum>(5)</enum><text display-inline="yes-display-inline">provision of an environmental education

				seminar, teleconference, or workshop for environmental education professionals

				or environmental education students, or provision of a computer network for

				such professionals and students;</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD22C9EBB87DD46339BF4D33176422778"><enum>(6)</enum><text display-inline="yes-display-inline">provision of on-the-ground activities

				involving students and teachers, such as—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="IDE26A0759D6A6436DA446162CF473A0F4"><enum>(A)</enum><text display-inline="yes-display-inline">riparian forest buffer restoration;

				and</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDAB2BC67BF4A54BC898443C57D71D9345"><enum>(B)</enum><text display-inline="yes-display-inline">volunteer water quality monitoring at

				schools;</text>

								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDBCCF4D4E91E74ADAA7045832C9296440"><enum>(7)</enum><text display-inline="yes-display-inline">provision of a Chesapeake Bay or stream

				outdoor educational experience; or</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC9440F13A3FC4307A73CCE12567D4C55"><enum>(8)</enum><text display-inline="yes-display-inline">development of distance learning or other

				courses or workshops that are acceptable in all Bay Watershed States and apply

				throughout the Chesapeake Bay watershed.</text>

							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID500D3E6136534629B57E9B602D90A758"><enum>(e)</enum><header>Required

				elements of Program</header><text display-inline="yes-display-inline">In

				carrying out the Program, the Secretary shall—</text>

							<paragraph commented="no" display-inline="no-display-inline" id="ID2ABA7B89D33C4ACD901C061C95181D6E"><enum>(1)</enum><text display-inline="yes-display-inline">solicit applications for projects;</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7FEDC1695FF94A0A9B9626AE76F56692"><enum>(2)</enum><text display-inline="yes-display-inline">select suitable projects from among the

				projects proposed;</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2C427D87E8E34974BC6EF38B5CE9ECEE"><enum>(3)</enum><text display-inline="yes-display-inline">supervise projects;</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8AF8B6EA35514D6299F17B090728598E"><enum>(4)</enum><text display-inline="yes-display-inline">evaluate the results of projects;

				and</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID32524FD18ED1483282BAD78E4BA65726"><enum>(5)</enum><text display-inline="yes-display-inline">disseminate information on the

				effectiveness and feasibility of the practices, methods, and techniques

				addressed by the projects.</text>

							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID05AE2DC519694BD387BAD408C2BB1B9D"><enum>(f)</enum><header>Solicitation of

				applications</header><text display-inline="yes-display-inline">Not later than

				90 days after the date on which amounts are first made available to carry out

				this part, and each year thereafter, the Secretary shall publish a notice of

				solicitation for applications for grants under the Program that specifies the

				information to be included in each application.</text>

						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID427BE02D303E42C0B9D900DA6858C9FD"><enum>(g)</enum><header>Applications</header><text display-inline="yes-display-inline">To be eligible to receive a grant under the

				Program, an eligible institution shall submit an application to the Secretary

				at such time, in such form, and containing such information as the Secretary

				may require.</text>

						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID3BCFD60CF65E442BA46E20C3A356A3D0"><enum>(h)</enum><header>Priority in

				selection of projects</header><text display-inline="yes-display-inline">In

				making grants under the Program, the Secretary shall give priority to an

				applicant that proposes a project that will develop—</text>

							<paragraph commented="no" display-inline="no-display-inline" id="ID6C73178CA457447A9DB1581858577523"><enum>(1)</enum><text display-inline="yes-display-inline">a new or significantly improved

				environmental education practice, method, or technique, in multiple

				disciplines, or a program that assists appropriate entities and individuals in

				meeting Federal or State academic standards relating to environmental

				education;</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2DB35C8D18344D1AB06E04A69198C7A6"><enum>(2)</enum><text display-inline="yes-display-inline">an environmental education practice,

				method, or technique that may have wide application; and</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD314D854F6DF434B891B0915E8350144"><enum>(3)</enum><text display-inline="yes-display-inline">an environmental education practice,

				method, or technique that addresses a skill or scientific field identified as a

				priority by the Chesapeake Executive Council.</text>

							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID25BE4BAA30A048E6A3F19824E261E0C2"><enum>(i)</enum><header>Maximum amount

				of grants</header><text display-inline="yes-display-inline">Under the Program,

				the maximum amount of a grant shall be $50,000.</text>

						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID2BFD87BEB3304B1EA5B9238D7FFDA988"><enum>(j)</enum><header>Notification</header><text display-inline="yes-display-inline">Not later than 3 days before making a grant

				under this part, the Secretary shall provide notification of the grant to the

				appropriate committees of Congress.</text>

						</subsection><subsection commented="no" display-inline="no-display-inline" id="IDDBD2E2F52E714499918D20B1763E4D98"><enum>(k)</enum><header>Regulations</header><text display-inline="yes-display-inline">Not later than 1 year after the date of

				enactment of the Chesapeake Bay Environmental Education Pilot Program Act, the

				Secretary shall promulgate regulations concerning implementation of the

				Program.</text>

						</subsection></section><section commented="no" display-inline="no-display-inline" id="IDD483E33725C740A586EC64DD34E80091" section-type="subsequent-section"><enum>4403.</enum><header>Evaluation and

				report</header>

						<subsection commented="no" display-inline="no-display-inline" id="ID09A56C0BC2584FDCBEBC2B23E925A192"><enum>(a)</enum><header>Evaluation</header><text display-inline="yes-display-inline">Not later than December 31, 2009, the

				Secretary shall enter into a contract with an entity that is not the recipient

				of a grant under this part to conduct a detailed evaluation of the Program. In

				conducting the evaluation, the Secretary shall determine whether the quality of

				content, delivery, and outcome of the Program warrant continued support of the

				Program.</text>

						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID631E5F8E55644500A02CD7EF07870432"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than December 31, 2010, the

				Secretary shall submit a report to the appropriate committees of Congress

				containing the results of the evaluation.</text>

						</subsection></section><section commented="no" display-inline="no-display-inline" id="ID306230B0D5D64132923F2E780053B681" section-type="subsequent-section"><enum>4404.</enum><header>Authorization of

				appropriations</header>

						<subsection commented="no" display-inline="no-display-inline" id="ID1188EE1467C64B90BD1CBA861B4FFB03"><enum>(a)</enum><header>In

				general</header><text display-inline="yes-display-inline">There is authorized

				to be appropriated to carry out this part $6,000,000 for each of fiscal years

				2006 through 2009.</text>

						</subsection><subsection commented="no" display-inline="no-display-inline" id="IDC71B23DE53334CDDAB84F701B12E1953"><enum>(b)</enum><header>Administrative

				expenses</header><text display-inline="yes-display-inline">Of the amounts made

				available under subsection (a) for each fiscal year, not more than 10 percent

				may be used for administrative

				expenses.</text>
