		<official-title display="yes">To amend the Federal Water Pollution

		  Control Act to provide assistance for nutrient removal technologies to States

		  in the Chesapeake Bay watershed.</official-title>

		<section commented="no" display-inline="no-display-inline" id="ID017DED27120E4A0DA789C2FF6100E888" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Chesapeake Bay Watershed Nutrient

			 Removal Assistance Act</short-title></quote>.</text>

		</section><section commented="no" display-inline="no-display-inline" id="IDCEE99A00F830468900529565309B2D8D" section-type="subsequent-section"><enum>2.</enum><header>Findings and

			 purposes</header>

			<subsection commented="no" display-inline="no-display-inline" id="IDA583ED29CDB64B40982D43201615F5C8"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds that—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="IDBD326964FD214463B18C4C3291240386"><enum>(1)</enum><text display-inline="yes-display-inline">nutrient pollution from point sources and

			 nonpoint sources continues to be the most significant water quality problem in

			 the Chesapeake Bay watershed;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID377375D02F5742F29FDF71D4ACB61511"><enum>(2)</enum><text display-inline="yes-display-inline">a key commitment of the Chesapeake 2000

			 agreement, an interstate agreement among the Administrator, the Chesapeake Bay

			 Commission, the District of Columbia, and the States of Maryland, Virginia, and

			 Pennsylvania, is to achieve the goal of correcting the nutrient-related

			 problems in the Chesapeake Bay by 2010;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC3204576B8684A9C8DF77685EB0481ED"><enum>(3)</enum><text display-inline="yes-display-inline">by correcting those problems, the

			 Chesapeake Bay and its tidal tributaries may be removed from the list of

			 impaired bodies of water designated by the Administrator of the Environmental

			 Protection Agency under

			 <external-xref legal-doc="act" parsable-cite="FWPCA/303(d)">section

			 303(d)</external-xref> of the <act-name parsable-cite="FWPCA">Federal Water

			 Pollution Control Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/33/1313(d)">33 U.S.C. 1313(d)</external-xref>);</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD3BEB0A00C7E4DC48C32516C47C34FB6"><enum>(4)</enum><text display-inline="yes-display-inline">more than 300 major sewage treatment plants

			 located in the Chesapeake Bay watershed annually discharge approximately

			 60,000,000 pounds of nitrogen, or the equivalent of 20 percent of the total

			 nitrogen load, into the Chesapeake Bay; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3DDFD99308FF41959C2E40EE885BD000"><enum>(5)</enum><text display-inline="yes-display-inline">nutrient removal technology is 1 of the

			 most reliable, cost-effective, and direct methods for reducing the flow of

			 nitrogen from point sources into the Chesapeake Bay.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID7AF1D2099B4E41DD8005A0734025A558"><enum>(b)</enum><header>Purposes</header><text display-inline="yes-display-inline">The purposes of this Act are—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="ID723DA1E1F447465500D5425C9E6B13AF"><enum>(1)</enum><text display-inline="yes-display-inline">to authorize the Administrator of the

			 Environmental Protection Agency to provide financial assistance to States and

			 municipalities for use in upgrading publicly-owned wastewater treatment plants

			 in the Chesapeake Bay watershed with nutrient removal technologies; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDA3D02331715447848CA9AAFE9BFBCFC2"><enum>(2)</enum><text display-inline="yes-display-inline">to further the goal of restoring the water

			 quality of the Chesapeake Bay to conditions that are protective of human health

			 and aquatic living resources.</text>

				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="IDA92A08A56142407E9E06CE1B5842EF91" section-type="subsequent-section"><enum>3.</enum><header>Sewage control

			 technology grant program</header><text display-inline="no-display-inline">The

			 <act-name parsable-cite="FWPCA">Federal Water Pollution Control Act</act-name>

			 (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C.

			 1251</external-xref> et seq.) is amended by adding at the end the

			 following:</text>

				<title commented="no" id="IDA76088F5C9684C19BBBFA26416E2C289" style="OLC"><enum>VII</enum><header>Miscellaneous</header>

					<section commented="no" display-inline="no-display-inline" id="ID0CC31F5836B74829B9045FC61E07F8CE" section-type="subsequent-section"><enum>701.</enum><header>Sewage control

				technology grant program</header>

						<subsection commented="no" display-inline="no-display-inline" id="ID3C79FF24A5BE48C485844E6FDEB22481"><enum>(a)</enum><header>Definition of

				eligible facility</header><text display-inline="yes-display-inline">In this

				section, the term <term>eligible facility</term> means a municipal wastewater

				treatment plant that—</text>

							<paragraph commented="no" display-inline="no-display-inline" id="ID8211C8D242A5489EB7EE582354591755"><enum>(1)</enum><text display-inline="yes-display-inline">as of the date of enactment of this title,

				has a permitted design capacity to treat an annual average of at least 500,000

				gallons of wastewater per day; and</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD041EDA464A04179A458D6DD47EC633E"><enum>(2)</enum><text display-inline="yes-display-inline">is located within the Chesapeake Bay

				watershed in any of the States of Delaware, Maryland, New York, Pennsylvania,

				Virginia, or West Virginia or in the District of Columbia.</text>

							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID01211BB26C8045CEAF3190FADCCE50EF"><enum>(b)</enum><header>Grant

				program</header>

							<paragraph commented="no" display-inline="no-display-inline" id="ID0236FE8B216A43F186FC7E398B3203F9"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 1 year after the date of

				enactment of this title, the Administrator shall establish a program within the

				Environmental Protection Agency to provide grants to States and municipalities

				to upgrade eligible facilities with nutrient removal technologies.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID33515EFD0322412DBC60E1293E2865CE"><enum>(2)</enum><header>Priority</header><text display-inline="yes-display-inline">In providing a grant under paragraph (1),

				the Administrator shall—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="ID910C87F725244A4CBA5FD816E9741400"><enum>(A)</enum><text display-inline="yes-display-inline">consult with the Chesapeake Bay Program

				Office;</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID813F62A9495C46EB89AABB2BA084A68D"><enum>(B)</enum><text display-inline="yes-display-inline">give priority to eligible facilities at

				which nutrient removal upgrades would—</text>

									<clause commented="no" display-inline="no-display-inline" id="ID71B5EB5075FE4761A2A8665238D18628"><enum>(i)</enum><text display-inline="yes-display-inline">produce the greatest nutrient load

				reductions at points of discharge; or</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="IDAECAB72A3A924B7B974659A074C6DDAB"><enum>(ii)</enum><text display-inline="yes-display-inline">result in the greatest environmental

				benefits to local bodies of water surrounding, and the main stem of, the

				Chesapeake Bay; and</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="IDF47E1E1AE61A43CCBBF5F6AFDA3F97F2"><enum>(iii)</enum><text display-inline="yes-display-inline">take into consideration the geographic

				distribution of the grants.</text>

									</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7CA3ABC6F8DF47D3A29D7FAB001E52ED"><enum>(3)</enum><header>Application</header>

								<subparagraph commented="no" display-inline="no-display-inline" id="ID6D136FA2CD364750A363CAA5003072BB"><enum>(A)</enum><header>In

				general</header><text display-inline="yes-display-inline">On receipt of an

				application from a State or municipality for a grant under this section, if the

				Administrator approves the request, the Administrator shall transfer to the

				State or municipality the amount of assistance requested.</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDE6F045CC315A4092AFCE1F03D69833ED"><enum>(B)</enum><header>Form</header><text display-inline="yes-display-inline">An application submitted by a State or

				municipality under subparagraph (A) shall be in such form and shall include

				such information as the Administrator may prescribe.</text>

								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDED30BC4B21EA4A91BF0006D1317487D3"><enum>(4)</enum><header>Use of

				funds</header><text display-inline="yes-display-inline">A State or municipality

				that receives a grant under this section shall use the grant to upgrade

				eligible facilities with nutrient removal technologies that are designed to

				reduce total nitrogen in discharged wastewater to an average annual

				concentration of 3 milligrams per liter.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID040104F1C9C44CFDB8B2CCDC17005462"><enum>(5)</enum><header>Cost

				sharing</header>

								<subparagraph commented="no" display-inline="no-display-inline" id="IDC9998DADB4A549B8BFEFC782DA5D0000"><enum>(A)</enum><header>Federal

				share</header><text display-inline="yes-display-inline">The Federal share of

				the cost of upgrading any eligible facility as described in paragraph (1) using

				funds provided under this section shall not exceed 55 percent.</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDA8D338FE32ED47D500AC4EC82FF2E5A5"><enum>(B)</enum><header>Non-federal

				share</header><text display-inline="yes-display-inline">The non-Federal share

				of the costs of upgrading any eligible facility as described in paragraph (1)

				using funds provided under this section may be provided in the form of funds

				made available to a State or municipality under—</text>

									<clause commented="no" display-inline="no-display-inline" id="ID8DEC8E3D87A84BEB00B81B00925E65A8"><enum>(i)</enum><text display-inline="yes-display-inline">any provision of this Act other than this

				section (including funds made available from a State revolving fund established

				under title VI); or</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="ID9F71469CFDC24F748FCC14887367EA35"><enum>(ii)</enum><text display-inline="yes-display-inline">any other Federal or State law.</text>

									</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDC8D6ADDA67B947D4AFD562B979B4EC22"><enum>(c)</enum><header>Authorization

				of appropriations</header>

							<paragraph commented="no" display-inline="no-display-inline" id="ID2DA337BAA4D7447A909F877B019F3C80"><enum>(1)</enum><header>In

				general</header><text display-inline="yes-display-inline">There is authorized

				to be appropriated to carry out this section $132,000,000 for each of fiscal

				years 2006 through 2010, to remain available until expended.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0511ED67590142D094B81EDF5780BC9F"><enum>(2)</enum><header>Administrative

				costs</header><text display-inline="yes-display-inline">The Administrator may

				use not to exceed 4 percent of any amount made available under paragraph (1) to

				pay administrative costs incurred in carrying out this

				section.</text>
