		<official-title display="yes">To amend the Carl D. Perkins Vocational and

		  Technical Education Act of 1998 to modify the definition of <quote>Indian

		  student count</quote>.</official-title>

		<section commented="no" display-inline="no-display-inline" id="id57C3E6F9AAC645ADBFA2F7669665CA7C" section-type="section-one"><enum>1.</enum><header>Definition of Indian student

			 count</header><text display-inline="no-display-inline">Section 117(h) of the

			 Carl D. Perkins Vocational and Technical Education Act of 1998 (20 U.S.C.

			 2327(h)) is amended by striking paragraph (2) and inserting the

			 following:</text>

				<paragraph commented="no" display-inline="no-display-inline" id="ID07E76B72475C4A989068A266E6E03733"><enum>(2)</enum><header>Indian student

				count</header>

					<subparagraph commented="no" display-inline="no-display-inline" id="ID095CA43F2F8C4D77BA8894DBDB312AA5"><enum>(A)</enum><header>In

				general</header><text display-inline="yes-display-inline">The term <term>Indian

				student count</term> means a number equal to the total number of Indian

				students enrolled in each tribally-controlled postsecondary vocational and

				technical institution, as determined in accordance with subparagraph

				(B).</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID8D7AF245A3314A1BBDCAF38F7CD62B83"><enum>(B)</enum><header>Determination</header>

						<clause commented="no" display-inline="no-display-inline" id="IDCD0E0D9735894013B603F070317D193C"><enum>(i)</enum><header>Enrollment</header><text display-inline="yes-display-inline">For each academic year, the Indian student

				count shall be determined on the basis of the enrollments of Indian students as

				in effect at the conclusion of—</text>

							<subclause commented="no" display-inline="no-display-inline" id="ID2BAB3C09CDE646288FDFD65FC0D9E0DA"><enum>(I)</enum><text display-inline="yes-display-inline">in the case of the fall term, the third

				week of the fall term; and</text>

							</subclause><subclause commented="no" display-inline="no-display-inline" id="ID10179398BC5D4D8EA4C6DB1D9058A1DF"><enum>(II)</enum><text display-inline="yes-display-inline">in the case of the spring term, the third

				week of the spring term.</text>

							</subclause></clause><clause commented="no" display-inline="no-display-inline" id="IDE6FF81F2B08C440EB9D14EE48CD8BD60"><enum>(ii)</enum><header>Calculation</header><text display-inline="yes-display-inline">For each academic year, the Indian student

				count for a tribally-controlled postsecondary vocational and technical

				institution shall be the quotient obtained by dividing—</text>

							<subclause commented="no" display-inline="no-display-inline" id="ID39053DC8A04C43469D74825D0DCE1F65"><enum>(I)</enum><text display-inline="yes-display-inline">the sum of the credit-hours of all Indian

				students enrolled in the tribally-controlled postsecondary vocational and

				technical institution (as determined under clause (i)); by</text>

							</subclause><subclause commented="no" display-inline="no-display-inline" id="ID1A9C4D8819A54696AF8B971F1B5E13E7"><enum>(II)</enum><text display-inline="yes-display-inline">12.</text>

							</subclause></clause><clause commented="no" display-inline="no-display-inline" id="ID7F8A74D8DC314CCC90CF743ED7C47171"><enum>(iii)</enum><header>Summer

				term</header><text display-inline="yes-display-inline">Any credit earned in a

				class offered during a summer term shall be counted in the determination of the

				Indian student count for the succeeding fall term.</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="ID4BACF2EA225846F6AD1D9EA7D5BFD76B"><enum>(iv)</enum><header>Students

				without secondary school degrees</header>

							<subclause commented="no" display-inline="no-display-inline" id="IDC1C42B3FA9F34B30BB039FD6B1C795A8"><enum>(I)</enum><header>In

				general</header><text display-inline="yes-display-inline">A credit earned at a

				tribally-controlled postsecondary vocational and technical institution by any

				Indian student that has not obtained a secondary school degree (or the

				recognized equivalent of such a degree) shall be counted toward the

				determination of the Indian student count if the institution at which the

				student is enrolled has established criteria for the admission of the student

				on the basis of the ability of the student to benefit from the education or

				training of the institution.</text>

							</subclause><subclause commented="no" display-inline="no-display-inline" id="ID7394DA8F36A44F3D99B199342B2F7D40"><enum>(II)</enum><header>Presumption</header><text display-inline="yes-display-inline">The institution shall be presumed to have

				established the criteria described in subclause (I) if the admission procedures

				for the institution include counseling or testing that measures the aptitude of

				a student to successfully complete a course in which the student is

				enrolled.</text>

							</subclause><subclause commented="no" display-inline="no-display-inline" id="IDACECB45F09244AD68EAC3624A19B335F"><enum>(III)</enum><header>Credits

				toward secondary school degree</header><text display-inline="yes-display-inline">No credit earned by an Indian student for

				the purpose of obtaining a secondary school degree (or the recognized

				equivalent of such a degree) shall be counted toward the determination of the

				Indian student count under this clause.</text>

							</subclause></clause><clause commented="no" display-inline="no-display-inline" id="ID73BD5E1A2EB84BA096CDBD260F4D5BAB"><enum>(v)</enum><header>Continuing

				education programs</header><text display-inline="yes-display-inline">Any credit

				earned by an Indian student in a continuing education program of a

				tribally-controlled postsecondary vocational and technical institution shall be

				included in the determination of the sum of all credit hours of the student if

				the credit is converted to a credit-hour basis in accordance with the system of

				the institution for providing credit for participation in the

				program.</text>

						</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
