		  for alternative means of certifying workers for adjustment assistance on an

		  industry-wide basis.</official-title>

		<section commented="no" display-inline="no-display-inline" id="ID6896241F4641468CBD2536D6C402C7DC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Trade Adjustment Assistance for

			 Industries Act of 2005</short-title></quote>.</text>

		</section><section commented="no" display-inline="no-display-inline" id="IDBA8F76AF2FE446338D30399F132098FE" section-type="subsequent-section"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following

			 findings:</text>

			<paragraph commented="no" display-inline="no-display-inline" id="ID9EF3DA85FAFC4772AFAFF16F96AC1F9E"><enum>(1)</enum><text display-inline="yes-display-inline">Trade Adjustment Assistance assists workers

			 and agricultural commodity producers who lose their jobs for trade-related

			 reasons to retrain, gain new skills, and find new jobs in growing sectors of

			 the economy.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE2A915C9919443E9A50C60C454D0375F"><enum>(2)</enum><text display-inline="yes-display-inline">The total cost of providing adjustment

			 assistance represents a tiny fraction of the gains to the United States economy

			 as a whole that economists attribute to trade liberalization.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9092FD1E856B4BB499174DD45B765E67"><enum>(3)</enum><text display-inline="yes-display-inline">In circumstances where, due to changes in

			 market conditions caused by the implementation of bilateral or multilateral

			 free trade agreements, unfair trade practices, unforeseen import surges, and

			 other reasons, import competition creates industry-wide effects on domestic

			 workers or agricultural commodity producers, the current process of assessing

			 eligibility for trade adjustment assistance on a plant-by-plant basis is

			 inefficient and can lead to unfair and inconsistent results.</text>

			</paragraph></section><section commented="no" display-inline="no-display-inline" id="ID31CBBF5A6B094CDC89179820A89826A1" section-type="subsequent-section"><enum>3.</enum><header>Other methods of

			 requesting investigation</header><text display-inline="no-display-inline">Section 221 of the

			 <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/19/2271">19 U.S.C. 2271</external-xref>) is

			 amended—</text>

			<paragraph commented="no" display-inline="no-display-inline" id="ID94243D9EE83A4498B7FA9E54326CDC99"><enum>(1)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>

				<quoted-block display-inline="no-display-inline" id="ID34094AD3DCD244F3AD2084BA3C6CBDBC" style="OLC">

					<subsection commented="no" display-inline="no-display-inline" id="IDAB1513291DE7478D9C4FF943B6EAD3BA"><enum>(c)</enum><header>Other methods

				of initiating a petition</header><text display-inline="yes-display-inline">Upon

				the request of the President or the United States Trade Representative, or the

				resolution of either the Committee on Ways and Means of the House of

				Representatives or the Committee on Finance of the Senate, the Secretary shall

				promptly initiate an investigation under this chapter to determine the

				eligibility for adjustment assistance of—</text>

						<paragraph commented="no" display-inline="no-display-inline" id="id12359329D9194D40ABE97AA4DED3AE74"><enum>(1)</enum><text display-inline="yes-display-inline">a group of workers (which may include

				workers from more than one facility or employer); or</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3BBAE3AC56E34555A538523265C974FA"><enum>(2)</enum><text display-inline="yes-display-inline">all workers in an occupation as that

				occupation is defined in the Bureau of Labor Statistics Standard Occupational

				Classification

				System.</text>

						</paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE3FAE93FBB51439D9D28776930823CC8"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (a)(2), by inserting

			 <quote>or a request or resolution filed under subsection (c),</quote> after

			 <quote>paragraph (1),</quote>; and</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDF0444633D28E48AB8DB6A5805BE96AB7"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (a)(3), by inserting <quote>,

			 request, or resolution</quote> after <quote>petition</quote> each place it

			 appears.</text>

			</paragraph></section><section commented="no" display-inline="no-display-inline" id="ID185A1A0B52F54CC39079BAD61A4A6F59" section-type="subsequent-section"><enum>4.</enum><header>Notification</header><text display-inline="no-display-inline">Section 224 of the

			 <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/19/2274">19 U.S.C. 2274</external-xref>) is

			 amended to read as follows:</text>

				regarding affirmative determinations and safeguards</header>

					<subsection commented="no" display-inline="no-display-inline" id="ID4561179767464F21828FB1F404274BC5"><enum>(a)</enum><header>Notifications

				regarding chapter <enum-in-header>1</enum-in-header> investigations and

				determinations</header><text display-inline="yes-display-inline">Whenever the

				International Trade Commission makes a report under section 202(f) containing

				an affirmative finding regarding serious injury, or the threat thereof, to a

				domestic industry, the Commission shall immediately—</text>

						<paragraph commented="no" display-inline="no-display-inline" id="id6FB70202FAA245278189E4C8BA14BA89"><enum>(1)</enum><text display-inline="yes-display-inline">notify the Secretary of Labor of that

				finding; and</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id44DB978D03624322B156DF20A3C6C9C5"><enum>(2)</enum><text display-inline="yes-display-inline">in the case of a finding with respect to an

				agricultural commodity, as defined in section 291, notify the Secretary of

				Agriculture of that finding.</text>

						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID57FE8A0A4A21494598D8B09F87FC70CD"><enum>(b)</enum><header>Notification

				regarding bilateral safeguards</header><text display-inline="yes-display-inline">The International Trade Commission shall

				immediately notify the Secretary of Labor and, in an investigation with respect

				to an agricultural commodity, the Secretary of Agriculture, whenever the

				Commission makes an affirmative determination pursuant to one of the following

				provisions:</text>

						<paragraph commented="no" display-inline="no-display-inline" id="ID34E8A3F91CDF4E27B467B344E0BE1E4B"><enum>(1)</enum><text display-inline="yes-display-inline">Section 421 of the

				<act-name parsable-cite="TA74">Trade Act of 1974</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/19/2451">19 U.S.C.

				1671d</external-xref> or 1673d), the Commission shall immediately notify the

				Secretary of Labor and, in the case of an agricultural commodity, the Secretary

				of Agriculture, of that

				determination.</text>

					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

		</section><section commented="no" display-inline="no-display-inline" id="ID2D45F09B365B4484B6439FD716274F5A" section-type="subsequent-section"><enum>5.</enum><header>Industry-Wide

			 determination</header><text display-inline="no-display-inline">Section 223 of

			 the <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/19/2273">19 U.S.C. 2273</external-xref>) is

			 amended by adding at the end the following:</text>

			<quoted-block act-name="Trade Act of 1974" display-inline="no-display-inline" id="IDC837976023614A408A99DA502A38A025" style="OLC">

				<subsection commented="no" display-inline="no-display-inline" id="IDA4E08532C08143689980B5510E490B46"><enum>(e)</enum><header>Investigation

				regarding Industry-Wide certification</header><text display-inline="yes-display-inline">If the Secretary receives a request or a

				resolution under section 221(c) on behalf of workers in a domestic industry or

				occupation (described in section 221(c)(2)) or receives 3 or more petitions

				under section 221(a) within a 180-day period on behalf of groups of workers in

				a domestic industry or occupation, the Secretary shall make an industry-wide

				determination under subsection (a) of this section with respect to the domestic

				industry or occupation in which the workers are or were employed. If the

				Secretary does not make certification under the preceding sentence, the

				Secretary shall make a determination of eligibility under subsection (a) with

				respect to each group of workers in that domestic industry or occupation from

				which a petition was

				received.</text>

			 other trade provisions</header>

			 certification based on global safeguards</header>

				<paragraph commented="no" display-inline="no-display-inline" id="ID7CC4A5926CBF4AB091369BBE5809E81A"><enum>(1)</enum><header>Recommendations

			 by itc</header>

					<subparagraph commented="no" display-inline="no-display-inline" id="IDEC7CF207E51C4109983B977B4BF6D049"><enum>(A)</enum><text display-inline="yes-display-inline"><external-xref legal-doc="act" parsable-cite="TA74/202(e)(2)(D)">Section 202(e)(2)(D)</external-xref> of the

			 <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/19/2253(a)(3)(D)">19 U.S.C.

			 2253(a)(3)(D)</external-xref>) is amended by striking <quote>, including the

			 provision of trade adjustment assistance under chapter 2</quote>.</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID50CE8074B2664DB1A135DDEB3102E698"><enum>(2)</enum><header>Assistance for

			 workers</header><text display-inline="yes-display-inline"><external-xref legal-doc="act" parsable-cite="TA74/203(a)(1)(A)">Section

			 203(a)(1)(A)</external-xref> of the <act-name parsable-cite="TA74">Trade Act of

			 1974</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/19/2253(a)(1)(A)">19 U.S.C. 2253(a)(1)(A)</external-xref>)

			 is amended to read as follows:</text>

					<quoted-block display-inline="no-display-inline" id="id2DEFEBB7BB6C4BB3B1B0BDB8947AA621" style="OLC">

						<subparagraph commented="no" display-inline="no-display-inline" id="ID33A74291785E46CB94CC5E7BDFD63091"><enum>(A)</enum><text display-inline="yes-display-inline">After receiving a report under section

				202(f) containing an affirmative finding regarding serious injury, or the

				threat thereof, to a domestic industry—</text>

							<clause commented="no" display-inline="no-display-inline" id="ID1BAE0CDC6226466F826E6A4B8921E2B5"><enum>(i)</enum><text display-inline="yes-display-inline">the President shall take all appropriate

				and feasible action within his power; and</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="IDf237eb0e87b9451d93b3f48f8af18028"><enum>(ii)(I)</enum><text display-inline="yes-display-inline">the Secretary of Labor shall certify as

				eligible to apply for adjustment assistance under section 223 workers employed

				in the domestic industry defined by the Commission if such workers become

				totally or partially separated, or are threatened to become totally or

				partially separated, not earlier than 1 year before, or not later than 1 year

				after, the date on which the Commission made its report to the President under

				section 202(f); and</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="ID9339f7fb355c463d8e8a74f3608f84c7"><enum>(II)</enum><text display-inline="yes-display-inline">in the case of a finding with respect to an

				agricultural commodity as defined in section 291, the Secretary of Agriculture

				shall certify as eligible to apply for adjustment assistance under section 293

				agricultural commodity producers employed in the domestic production of the

				agricultural commodity that is the subject of the finding during the most

				recent marketing

				year.</text>

							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDA7683326594C43F28E82955241417340"><enum>(b)</enum><header>Industry-Wide

			 certification based on bilateral safeguard provisions or antidumping or

			 countervailing duty orders</header>

				<paragraph commented="no" display-inline="no-display-inline" id="IDB9E7BC1646374795A773AAF4D7651B27"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Subchapter A of

			 chapter 1 of title II of the <act-name parsable-cite="TA74">Trade Act of

			 1974</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/19/2271">19

			 U.S.C. 2271</external-xref> et seq.) is amended by inserting after section 224

			 the following new section:</text>

						<section commented="no" display-inline="no-display-inline" id="ID1F5225E2C43241099814EA40D5559869" section-type="subsequent-section"><enum>224A.</enum><header>Industry-Wide

				certification where bilateral safeguard provisions invoked or antidumping or

				countervailing duties imposed</header>

							<subsection commented="no" display-inline="no-display-inline" id="ID0D70B320D5AF4213975070A814C74DE4"><enum>(a)</enum><header>In

				general</header>

								<paragraph commented="no" display-inline="no-display-inline" id="IDD807AD9F3DB641FE8B3F00C605B6CD2F"><enum>(1)</enum><header>Mandatory

				certification</header><text display-inline="yes-display-inline">Not later than

				10 days after the date on which the Secretary of Labor receives a notification

				with respect to the imposition of a trade remedy, safeguard determination, or

				antidumping or countervailing duty determination under section 224 (a), (b),

				(c), (d), or (e), the Secretary shall certify as eligible for trade adjustment

				assistance under section 223(a) workers employed in the domestic production of

				the article that is the subject of the trade remedy, safeguard determination,

				or antidumping or countervailing duty determination, as the case may be, if

				such workers become totally or partially separated, or are threatened to become

				totally or partially separated not more than 1 year before or not more than 1

				year after the applicable date.</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8AE3DA7625304A11ABE154E0B3F2FA8F"><enum>(2)</enum><header>Applicable

				date</header><text display-inline="yes-display-inline">In this section, the

				term <term>applicable date</term> means—</text>

									<subparagraph commented="no" display-inline="no-display-inline" id="ID77E5E161CAB048E5B4FBD4A3B1F6185D"><enum>(A)</enum><text display-inline="yes-display-inline">the date on which the affirmative or

				positive determination or finding is made in the case of a notification under

				section 224 (a), (b), or (d);</text>

									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID93FBEB17B2104CCE96A9C4C31282806E"><enum>(B)</enum><text display-inline="yes-display-inline">the date on which a final determination is

				made in the case of a notification under section 224(e); or</text>

									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID781B950786C74BC2B6F09428545777A5"><enum>(C)</enum><text display-inline="yes-display-inline">the date on which additional duties are

				assessed in the case of a notification under section 224(c).</text>

									</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDD036E492656B42CF9CA19DFDBE682172"><enum>(b)</enum><header>Qualifying

				requirements for workers</header><text display-inline="yes-display-inline">The

				provisions of subchapter B shall apply in the case of a worker covered by a

				certification under this section or section 223(e), except as follows:</text>

								<paragraph commented="no" display-inline="no-display-inline" id="ID6D251C1B6BD04BB481B4FF1A94D05097"><enum>(1)</enum><text display-inline="yes-display-inline">Section 231(a)(5)(A)(ii) shall be

				applied—</text>

									<subparagraph commented="no" display-inline="no-display-inline" id="ID3C1BF8EDC6EA43E3883B361656AAD518"><enum>(A)</enum><text display-inline="yes-display-inline">by substituting <quote>30th week</quote>

				for <quote>16th week</quote> in subclause (I); and</text>

									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDB55367A6D7A14748889848FE304070BF"><enum>(B)</enum><text display-inline="yes-display-inline">by substituting <quote>26th week</quote>

				for <quote>8th week</quote> in subclause (II).</text>

									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1849B470A9B2494F961D4884D3DA97A5"><enum>(2)</enum><text display-inline="yes-display-inline">The provisions of section 236(a)(1) (A) and

				(B) shall not

				apply.</text>

			 2401</external-xref> et seq.) is amended by striking section 294 and inserting

				days after the date on which the Secretary of Agriculture receives a

				notification with respect to the imposition of a trade remedy, safeguard

				determination, or antidumping or countervailing duty determination under

				section 224 (b), (c), or (e), the Secretary shall certify as eligible for trade

				adjustment assistance under section 293(a) agricultural commodity producers

				employed in the domestic production of the agricultural commodity that is the

				subject of the trade remedy, safeguard determination, or antidumping or

				countervailing duty determination, as the case may be, during the most recent

				marketing year.</text>

							</subsection><subsection commented="no" display-inline="no-display-inline" id="ID2393D46DCA444907AE5E4998A89BE337"><enum>(b)</enum><header>Applicable

				date</header><text display-inline="yes-display-inline">In this section, the

				term <term>applicable date</term> means—</text>

								<paragraph commented="no" display-inline="no-display-inline" id="ID1E98F8E093714946986F37351A8723C4"><enum>(1)</enum><text display-inline="yes-display-inline">the date on which the affirmative or
