			<section commented="no" display-inline="no-display-inline" id="idA0472C2BD7CC4FF890480C67BBC71918" section-type="subsequent-section"><enum>101.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="IDd0aa82fbfec4472c86a07d852f20a724"><enum>(1)</enum><text display-inline="yes-display-inline">Congress has appropriated tens of millions

			 of dollars for purposes of providing an historical accounting of funds held in

			 Individual Indian Money accounts;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID49e1a791c62040559cfc175716a9a8cf"><enum>(2)</enum><text display-inline="yes-display-inline">as of the date of enactment of this Act,

			 the efforts of the Federal Government in conducting historical accounting

			 activities have provided information regarding the feasibility and cost of

			 providing a complete historical accounting of IIM account funds;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID037da59acb9e41eb907356749e974e4a"><enum>(3)</enum><text display-inline="yes-display-inline">in the case of many IIM accounts, a

			 complete historical accounting—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="ID5bd84945de954a1aa8c624f12f896793"><enum>(A)</enum><text display-inline="yes-display-inline">may be impossible because necessary records

			 and accounting data are missing or destroyed;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID20814b228ab74c72b721126d91ec3b18"><enum>(B)</enum><text display-inline="yes-display-inline">may take several years to perform even if

			 necessary records are available;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID781c88bab9ca44729d00ef08243f15cf"><enum>(C)</enum><text display-inline="yes-display-inline">may cost the United States hundreds of

			 millions and possibly several billion dollars; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDaecd51f530334322b5a9d1ec98000bfd"><enum>(D)</enum><text display-inline="yes-display-inline">may be impossible to complete before the

			 deaths of many elderly IIM account beneficiaries;</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6B048ED9E65447AEAFD84AC8DFC2A500"><enum>(4)</enum><text display-inline="yes-display-inline">without a complete historical accounting,

			 it may be difficult or impossible to ascertain the extent of losses in an IIM

			 account as a result of accounting errors or mismanagement of funds, or the

			 correct amount of interest accrued or owned on the IIM account;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID22f0634c43624977a0e1b2aa3d3b6308"><enum>(5)</enum><text display-inline="yes-display-inline">the total cost to the United States of

			 providing a complete historical accounting of an IIM account may exceed—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="ID5bbef8bf35ae470b8dbcdc5c13da64f2"><enum>(A)</enum><text display-inline="yes-display-inline">the current balance of the IIM

			 account;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4411a9bbaea746409a89ca11cf9e2964"><enum>(B)</enum><text display-inline="yes-display-inline">the total sums of money that have passed

			 through the IIM account; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDe8285c5c901d4cb8b55263c8c77d8c5a"><enum>(C)</enum><text display-inline="yes-display-inline">the enforceable liability of the United

			 States for losses from, and interest in, the IIM account;</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1b0ffbffde6a46e2b914c014c235beff"><enum>(6)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id4B7FBAEB29FA4B71B23934781F81A283"><enum>(A)</enum><text display-inline="yes-display-inline">the delays in obtaining an accounting and

			 in pursuing accounting claims in the case styled Cobell v. Norton, Civil Action

			 No. 96–1285 (RCL) in the United States District Court for the District of

			 Columbia, have created a great hardship on IIM account beneficiaries;

			 and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id290F66DEB6C841E79C91B068E96AC7B4" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">many beneficiaries and their

			 representatives have indicated that they would rather receive monetary

			 compensation than experience the continued frustration and delay associated

			 with an accounting of transactions and funds in their IIM accounts;</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5f8a3cfdaca643d09a716e651caac89d"><enum>(7)</enum><text display-inline="yes-display-inline">it is appropriate for Congress, taking into

			 consideration the findings under paragraphs (1) through (6), to provide

			 benefits that are reasonably calculated to be fair and appropriate in lieu of

			 performing an accounting of an IIM account, or assuming liability for errors in

			 such an accounting, mismanagement of IIM account funds (including undetermined

			 amounts of interest in IIM accounts, losses in which may never be discovered or

			 quantified if a complete historical accounting cannot be performed), or breach

			 of fiduciary duties with respect to the administration of IIM accounts, in

			 order to transmute claims by the beneficiaries of IIM accounts for undetermined

			 or unquantified accounting losses and interest to a fixed amount to be

			 distributed to the beneficiaries of IIM accounts;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2c3778639ed64b0aa3f4ea1093680232"><enum>(8)</enum><text display-inline="yes-display-inline">in determining the amount of the payments

			 to be distributed as described in paragraph (7), Congress should take into

			 consideration, in addition to the factors described in paragraphs (1) through

			 (6)—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="ID0c6368bc2caa4a389d0502e53168848b"><enum>(A)</enum><text display-inline="yes-display-inline">the risks and costs to IIM account

			 beneficiaries, as well as any delay, associated with the litigation of claims

			 that will be resolved by this title; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID017a408f5bd64c5ca37f51ce161d00bd"><enum>(B)</enum><text display-inline="yes-display-inline">the benefits to IIM account beneficiaries

			 available under this title;</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9eb0908f69d348caa536bced57678454"><enum>(9)</enum><text display-inline="yes-display-inline">the situation of the Osage Nation is unique

			 because, among other things, income from the mineral estate of the Osage Nation

			 is distributed to individuals through headright interests that belong not only

			 to members of the Osage Nation, but also to members of other Indian tribes, and

			 to non-Indians; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2c7d82f6b999410f89688eb7483488ee"><enum>(10)</enum><text display-inline="yes-display-inline">due to the unique situation of the Osage

			 Nation, the Osage Nation, on its own behalf, has filed various actions in

			 Federal district court and the United States Court of Federal Claims seeking

			 accountings, money damages, and other legal and equitable relief</text>

				</paragraph></section><section commented="no" display-inline="no-display-inline" id="id11FC78A967B24C3092A1835A372C0512" section-type="subsequent-section"><enum>102.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>

				<paragraph commented="no" display-inline="no-display-inline" id="id73E54F2E727942AC86EE1A456024D6B2"><enum>(1)</enum><header>Accounting

			 claim</header><text display-inline="yes-display-inline">The term

			 <term>accounting claim</term> means any claim for an historical accounting of a

			 claimant against the United States under the Litigation.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2ADC2581EDC2404E9CF97511E547D6AE"><enum>(2)</enum><header>Claimant</header><text display-inline="yes-display-inline">The term <term>claimant</term> means any

			 beneficiary of an IIM account (including an heir of such a beneficiary) that

			 was living on the date of enactment of the American Indian Trust Fund

			 Management Reform Act of 1994 (25 U.S.C. 4001 et seq.).</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD1E818821548404CBD2FA230FAD8C4A1"><enum>(3)</enum><header>IIM

			 account</header><text display-inline="yes-display-inline">The term <term>IIM

			 account</term> means an Individual Indian Money account administered by the

			 Bureau of Indian Affairs.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id95F0A65529BD489D8EBB0B9BABC4B7BA"><enum>(4)</enum><header>Litigation</header><text display-inline="yes-display-inline">The term <term>Litigation</term> means the

			 case styled Cobell v. Norton, Civil Action No. 96–1285 (RCL) in the United

			 States District Court for the District of Columbia.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3856663677694CC78F295F9C34ACC9E7"><enum>(5)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the

			 Secretary of the Treasury.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id739C773183374A6A9796FA52623A6B8A"><enum>(6)</enum><header>Settlement

			 Fund</header><text display-inline="yes-display-inline">The term

			 <term>Settlement Fund</term> means the fund established by section

			 103(a).</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id72E5941320DE4D1B9CE1DCE67F270922"><enum>(7)</enum><header>Special

			 Master</header><text display-inline="yes-display-inline">The term <term>Special

			 Master</term> means the special master appointed by the Secretary under section

			 103(b) to administer the Settlement Fund.</text>

				</paragraph></section><section commented="no" display-inline="no-display-inline" id="idDFD5CF654D484B75975BCA81A3AAAAD4" section-type="subsequent-section"><enum>103.</enum><header>Individual Indian

			 Accounting Claim Settlement Fund</header>

				<subsection commented="no" display-inline="no-display-inline" id="id708D841984FE43F09FA43F7789C8E90C"><enum>(a)</enum><header>Establishment</header>

					<paragraph commented="no" display-inline="no-display-inline" id="id3799E7733BF44B949FCA9019D041B5FA"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">There is established

			 in the general fund of the Treasury a fund, to be known as the

			 <quote>Individual Indian Accounting Claim Settlement Fund</quote>.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id43E91B556C2D42EAB8B6A7880DDE3CE6"><enum>(2)</enum><header>Initial

			 deposit</header><text display-inline="yes-display-inline">The Secretary shall

			 deposit into the Settlement Fund to carry out this title not less than

			 $<inline-comment>__</inline-comment>,000,000,000 from funds appropriated under

			 section 1304 of title 31, United States Code.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id2285B5EF524F4EA5855CA359692FCA08"><enum>(b)</enum><header>Special

			 Master</header><text display-inline="yes-display-inline">As soon as practicable

			 after the date of enactment of this Act, the Secretary shall appoint a Special

			 Master to administer the Settlement Fund in accordance with this title.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="id26E6C789491E4FC38DE28F5FC12B4A21"><enum>(c)</enum><header>Distribution</header>

					<paragraph commented="no" display-inline="no-display-inline" id="id93FBDA3BE11A4C13B98CBC9463325BAC"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Special Master

			 shall use not less than 80 percent of amounts in the Settlement Fund to make

			 payments to claimants in accordance with section 104.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id558E46BE70714D9BAF84B200154EF895"><enum>(2)</enum><header>Method of

			 valuation and constitutional claims</header><text display-inline="yes-display-inline">The Special Master may use not to exceed 12

			 percent of amounts in the Settlement Fund to make payments to claimants

			 described in—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="idF711E695F4084FCF9F0C1E3A54BAFAA5"><enum>(A)</enum><text display-inline="yes-display-inline">section 106; or</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5D2B67EDC6C3452F8B99F3E73FB6EDEA"><enum>(B)</enum><text display-inline="yes-display-inline">section 107.</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5DA3419EF9454680A1CFA6483834ACE7"><enum>(3)</enum><header>Attorneys'

			 fees</header><text display-inline="yes-display-inline">The Special Master may

			 use not to exceed <inline-comment>__</inline-comment> percent of amounts in the

			 Settlement Fund to make payments to claimants for attorneys' fees in accordance

			 with section 108.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idA40CC9ED89F944618033A90315F793E9"><enum>(d)</enum><header>Costs of

			 administration</header><text display-inline="yes-display-inline">The Secretary

			 may use not more than <inline-comment>__</inline-comment> percent of amounts in

			 the Settlement Fund to pay the costs of—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="idD540A2AA21464E199F99638958D32ABB"><enum>(1)</enum><text display-inline="yes-display-inline">administering the Settlement Fund;

			 and</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id53F2DC0CA73245B6AA89924D9B1FB963"><enum>(2)</enum><text display-inline="yes-display-inline">otherwise carrying out this title.</text>

					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id8CA9BC67620442F581CAB24A501E202E" section-type="subsequent-section"><enum>104.</enum><header>General

			 distribution</header>

				<subsection commented="no" display-inline="no-display-inline" id="id1404ACF9C20449E0B24485D367D4D0A8"><enum>(a)</enum><header>Payments to

			 claimants</header>

					<paragraph commented="no" display-inline="no-display-inline" id="id18F70562AF9F431EBE8099444074DDE1"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Not later than 1 year

			 after the date on which the Secretary publishes in the Federal Register the

			 regulations described in subsection (d), the Special Master shall distribute to

			 each claimant from the Settlement Fund an amount equal to the sum of—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="idD6AAB74EF57348709ACF1F4C19FDA545"><enum>(A)</enum><text display-inline="yes-display-inline">the per capita share of the claimant of

			 $<inline-comment>__</inline-comment>,000,000,000 of the amounts described in

			 section 103(c)(1); and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE1096F901E4643E9BBB813BD0754AEA4"><enum>(B)</enum><text display-inline="yes-display-inline">of

			 $<inline-comment>__</inline-comment>,000,000,000 of the amounts described in

			 section 103(c)(1), the additional share of the claimant, to be determined in

			 accordance with a formula established by the Secretary under subsection

			 (d)(1).</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id85186591E4414B2AB4A79A0876113E10"><enum>(2)</enum><header>Heirs of

			 claimants</header>

						<subparagraph commented="no" display-inline="no-display-inline" id="idF79C07D5B09D415B9EFF1C5F0AD7CD3E"><enum>(A)</enum><header>In

			 general</header><text display-inline="yes-display-inline">An heir of a claimant

			 shall receive the entire amount distributed to the claimant under paragraphs

			 (1) and (3).</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF47285C546034646B1EF97BA077B7597"><enum>(B)</enum><header>Multiple

			 heirs</header><text display-inline="yes-display-inline">If a claimant has more

			 than 1 heir, the amount distributed to the claimant under paragraphs (1) and

			 (3) shall be divided equally among the heirs of the claimant.</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3AE34B8B0A264833BF8DD1CCB4EED5C1"><enum>(3)</enum><header>Residual

			 amounts</header><text display-inline="yes-display-inline">After making each

			 distribution required under sections 106, 107, and 108, the Special Master

			 shall distribute to claimants the remainder of the amounts described in

			 paragraphs (2) and (3) of section 103(c), in accordance with paragraph

			 (1)(B).</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idBE4671E54F7B4C349FDE8D2A7C494C52"><enum>(b)</enum><header>Requirement for

			 distribution</header><text display-inline="yes-display-inline">The Special

			 Master shall not make a distribution to a claimant under subsection (a) until

			 the claimant executes a waiver and release of accounting claims against the

			 United States in accordance with section 109.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="id18F1C4B8575F41B3859B7DB461283F6C"><enum>(c)</enum><header>Location of

			 claimants</header>

					<paragraph commented="no" display-inline="no-display-inline" id="id2309C7C2D98447E2B2B3990EA504C94E"><enum>(1)</enum><header>Responsibility

			 of Secretary of the Interior</header><text display-inline="yes-display-inline">The Secretary of the Interior shall provide

			 to the Special Master any information, including IIM account information, that

			 the Special Master determines to be necessary to—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="idB8F22D369D40434182132C6909EE3A9D"><enum>(A)</enum><text display-inline="yes-display-inline">identify any claimant under this title;

			 or</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3B81E53F96454B098B7AA354B528A28E"><enum>(B)</enum><text display-inline="yes-display-inline">apply a formula established by the

			 Secretary under subsection (d).</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id04DDD61EBFE14757A221A411A58F2F17"><enum>(2)</enum><header>Claimants of

			 unknown location</header>

						<subparagraph commented="no" display-inline="no-display-inline" id="idBAFDFA38F6C74918951BB6075BBA611D"><enum>(A)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Special Master

			 shall deposit in an account, for future distribution, amounts under this title

			 for each claimant who—</text>

							<clause commented="no" display-inline="no-display-inline" id="idCE26759E7019462EB9BB507AFFC323DD"><enum>(i)</enum><text display-inline="yes-display-inline">is entitled to receive a distribution under

			 this title, as determined by the Special Master; and</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="id8E1CE6FAADA840B09962FE3A2F0CAA3D"><enum>(ii)</enum><text display-inline="yes-display-inline">has not been located by the Special Master

			 as of the date on which a distribution is required under subsection

			 (a)(1).</text>

							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id259C27AAEB494235BCE46477F8093ACB"><enum>(B)</enum><header>Location of

			 claimants</header>

							<clause commented="no" display-inline="no-display-inline" id="idFD538D6061ED456ABDC5E8FF3B812FF5"><enum>(i)</enum><header>Responsibility

			 of Secretary of the Interior</header><text display-inline="yes-display-inline">The Secretary of the Interior shall provide

			 to the Special Master any information and assistance necessary to locate a

			 claimant described in subparagraph (A)(ii).</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="id9D1018A6D5074D01924B272D29B1A09F"><enum>(ii)</enum><header>Contracts</header><text display-inline="yes-display-inline">The Special Master may enter into contracts

			 with an Indian tribe or an organization representing individual Indians in

			 order to locate a claimant described in subparagraph (A)(ii).</text>

							</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id68D6B27C33154314B8C367033A5870CC"><enum>(d)</enum><header>Regulations</header>

					<paragraph commented="no" display-inline="no-display-inline" id="id9E4F259186FB4CBA9F17846038B8F217"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Secretary shall

			 promulgate any regulations that the Secretary determines to be necessary to

			 carry out this title, including regulations establishing a formula to determine

			 the share of each claimant of payments under subsection (a)(1).</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9020A0C21E224F74B0D840B42524CB76"><enum>(2)</enum><header>Factors for

			 consideration</header><text display-inline="yes-display-inline">In developing

			 the formula described in paragraph (1), the Secretary shall take into

			 consideration the amount of funds that have passed through the IIM account of

			 each claimant during the period beginning on January 1, 1980, and ending on

			 December 31, 2005, or another period, as the Secretary determines to be

			 appropriate.</text>

					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idC4E483BB76924585AF9F49843D846F78" section-type="subsequent-section"><enum>105.</enum><header>Claims relating to

			 share determination</header>

				<subsection commented="no" display-inline="no-display-inline" id="id6B59C08C1C3E4764A808E0BE4CA56ECA"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Subject to subsection

			 (b), any claimant may seek judicial review of the determination of the Special

			 Master with respect to the amount of a share payment of a claimant under

			 section 104(a)(1).</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="idC35E0296CBEC4179BADC861127C8823D"><enum>(b)</enum><header>Requirements</header><text display-inline="yes-display-inline">A claimant shall file a claim under

			 subsection (a)—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="id268FBC9D75044F539CB421F8D5615B40"><enum>(1)</enum><text display-inline="yes-display-inline">not later than 180 days after the date of

			 receipt of a notice by the claimant under subsection (c); and</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1143B5A1B35645EFA41C00D24AE9F868"><enum>(2)</enum><text display-inline="yes-display-inline">in the United States district court for the

			 district in which the claimant resides.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id2AD61B73F01147BAAE5569817B1B5D58"><enum>(c)</enum><header>Notice</header><text display-inline="yes-display-inline">The Secretary shall provide to each

			 claimant a notice of the right of any claimant to seek judicial review of a

			 determination of the Special Master with respect to the amount of the share

			 payment of the claimant under section 105.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="id0B17C354E8DD4B7B972C39F64A739D94"><enum>(d)</enum><header>Subsequent

			 appeals</header><text display-inline="yes-display-inline">A claim relating to a

			 determination of a United States district court relating to an appeal under

			 subsection (a) shall be filed only in the United States Court of Appeals for

			 the District of Columbia.</text>

				</subsection></section><section commented="no" display-inline="no-display-inline" id="id91F26DA14801491184E5B48C4835DF60" section-type="subsequent-section"><enum>106.</enum><header>Claims relating to

			 method of valuation</header>

				<subsection commented="no" display-inline="no-display-inline" id="idD97E62D8948D4528AEF55156CC9ADC8B"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Not later than 1 year

			 after the date of enactment of this Act, a claimant may seek judicial review of

			 the method of distribution of a payment to the claimant under section

			 104(a).</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="idDA88633EFF0B453EA7466EDFFD29CC25"><enum>(b)</enum><header>Requirements</header><text display-inline="yes-display-inline">A claim under subsection (a)—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="id97BDFA10B1004316A56F9F4450A8E6DB"><enum>(1)</enum><text display-inline="yes-display-inline">shall not be filed as part of a class

			 action claim against any party; and</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3D883CA006334A979B0F4A5A327B8FA0"><enum>(2)</enum><text display-inline="yes-display-inline">shall be filed only in the United States

			 Court of Federal Claims.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idE7DD966CA9794414A382D06EB49A3E68"><enum>(c)</enum><header>Available

			 amounts</header>

					<paragraph commented="no" display-inline="no-display-inline" id="id8987A7C8A6EF48DBADE674B882170E66"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Special Master

			 shall use only amounts described in section 103(c)(2)(A) to satisfy an award

			 under a claim under this section.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id84306845D2804B61ABD38FC2170A51A4"><enum>(2)</enum><header>Payments to

			 claimants</header><text display-inline="yes-display-inline">A claimant that

			 files a claim under this subsection shall not be eligible to receive a

			 distribution under section 104(a).</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id799503305D9E4FEBB639B71F8B8D086A"><enum>(d)</enum><header>Effect of

			 claim</header><text display-inline="yes-display-inline">The filing of a claim

			 under this section shall be considered to be a waiver by the claimant of any

			 right to an award under section 104.</text>

				</subsection></section><section commented="no" display-inline="no-display-inline" id="idB1D62FD526684D6AB309FB608BB8B4F3" section-type="subsequent-section"><enum>107.</enum><header>Claims relating to

			 constitutionality</header>

				<subsection commented="no" display-inline="no-display-inline" id="id4296074EC91C45B49DCB27E034504565"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Any claimant may seek

			 judicial review in the United States District Court for the District of

			 Columbia of the constitutionality of the application of this title to an

			 individual claimant.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="id8C3AAC4A0DA147419583C4F8A0621C58"><enum>(b)</enum><header>Procedure</header>

					<paragraph commented="no" display-inline="no-display-inline" id="idC7B36986C3E547B5971B7A4AD146EFEC"><enum>(1)</enum><header>Judicial

			 panel</header><text display-inline="yes-display-inline">A claim under this

			 section shall be determined by a panel of 3 judges, to be appointed by the

			 chief judge of the United States District Court for the District of

			 Columbia.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD8D7F025E4AF4D71A297037888533828"><enum>(2)</enum><header>Consolidation

			 of claims</header>

						<subparagraph commented="no" display-inline="no-display-inline" id="id3449FFB94FC248D2841103718C908467"><enum>(A)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The judicial panel

			 may consolidate claims under this section, as the judicial panel determines to

			 be appropriate.</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF538E9CBFC2E4A15836406275A782718"><enum>(B)</enum><header>Prohibition of

			 class action cases</header><text display-inline="yes-display-inline">A claim

			 under this section shall not be filed as part of a class action claim against

			 any party.</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCA3F7F489F704A5F9DD09400382E5AD6"><enum>(3)</enum><header>Determination</header><text display-inline="yes-display-inline">The judicial panel may award a claimant

			 such relief as the judicial panel determines to be appropriate, including

			 monetary compensation.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idC0E9AFD17A9A476D9988F0167BE0245C"><enum>(c)</enum><header>Available

			 amounts</header>

					<paragraph commented="no" display-inline="no-display-inline" id="idB7D15984715A4B69B9F4DDFE88922AF0"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Special Master

			 shall use only amounts described in section 103(c)(2)(B) to satisfy an award

			 under a claim under this section.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDF7A7524AA2244BA884F35CCBD8195BE"><enum>(2)</enum><header>Payments to

			 claimants</header><text display-inline="yes-display-inline">A claimant that

			 files a claim under this subsection shall not be eligible to receive a

			 distribution under section 104(a).</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idD8557792741243BCA6167CCCC5BC2686"><enum>(d)</enum><header>Effect of

			 claim</header><text display-inline="yes-display-inline">The filing of a claim

			 under this section shall be considered to be a waiver by the claimant of any

			 right to an award under section 104.</text>

				</subsection></section><section commented="no" display-inline="no-display-inline" id="id8B4445BDB73C4E67B3A37D1922857557" section-type="subsequent-section"><enum>108.</enum><header>Attorneys'

			 fees</header>

				<subsection commented="no" display-inline="no-display-inline" id="id02EADADFC53E44268218F99F602F4827"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Special Master

			 may use amounts described in section 103(c)(3) to make payments to claimants

			 for costs and attorneys' fees incurred under the Litigation before the date of

			 enactment of this Act, or in connection with a claim under section 104, at a

			 rate not to exceed $<inline-comment>__</inline-comment> per hour.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="id0137D0EC85BD447CA5204D7EA786E3F8"><enum>(b)</enum><header>Requirements</header>

					<paragraph commented="no" display-inline="no-display-inline" id="id842D1F16F0344166BD59182E49F09E83"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Special Master

			 may make a payment under subsection (a) only if, as of the date on which the

			 Special Master makes the payment, the applicable costs and attorneys' fees have

			 not been paid by the United States pursuant to a court order.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC744BC6430D84D45A249C23B2A6BBC56"><enum>(2)</enum><header>Action by

			 attorneys</header><text display-inline="yes-display-inline">To receive a

			 payment under subsection (a), an attorney of the claimant shall submit to the

			 Special Master a written claim for costs or fees under the Litigation.</text>

					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id75B9E579F8F040F0A3D665D2A0D5B0B6" section-type="subsequent-section"><enum>109.</enum><header>Waiver and release

			 of claims</header>

				<subsection commented="no" display-inline="no-display-inline" id="id96C13B264DBD4490BC965F11F08695F6"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">In order to receive

			 an award under this title, a claimant shall execute and submit to the Special

			 Master a waiver and release of claims under this section.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="id5651D0D25ED64D77A463264F439138F4"><enum>(b)</enum><header>Contents</header><text display-inline="yes-display-inline">A waiver and release under subsection (a)

			 shall contain a statement that the claimant waives and releases the United

			 States (including any officer, official, employee, or contractor of the United

			 States) from any legal or equitable claim under Federal, State, or other law

			 (including common law) relating to any accounting of funds in the IIM account

			 of the claimant on or before the date of enactment of this Act.</text>

				</subsection></section><section commented="no" display-inline="no-display-inline" id="id2C9255891C564D9FA7B7528079894749" section-type="subsequent-section"><enum>110.</enum><header>Effect of

			 title</header>

				<subsection commented="no" display-inline="no-display-inline" id="IDe703d37d58734a1c90b0c29fc39593b8"><enum>(a)</enum><header>Substitution of

			 benefits</header>

					<paragraph commented="no" display-inline="no-display-inline" id="idC3531295760345BFA31B1F08377C1E90"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The benefits provided

			 under this title shall be considered to be provided in lieu of any claims under

			 Federal, State, or other law originating before the date of enactment of this

			 Act for—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="idFCA24916F767455A8F427BDBD70938EA"><enum>(A)</enum><text display-inline="yes-display-inline">losses as a result of accounting errors

			 relating to funds in an IIM account;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA6A56EE262C546C4BFB0D5D1ED54B723"><enum>(B)</enum><text display-inline="yes-display-inline">mismanagement of funds in an IIM account;

			 or</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id61D9A0A3654F43E3BFC534F2C6FC2826"><enum>(C)</enum><text display-inline="yes-display-inline">interest accrued or owed in connection with

			 funds in an IIM account.</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA7EB2F21333B4056B229F71AAB6CEF97"><enum>(2)</enum><header>Limitation of

			 claims</header><text display-inline="yes-display-inline">Except as provided in

			 this title, and notwithstanding any other provision of law, a claimant shall

			 not maintain an action in any Federal, State, or other court for an accounting

			 claim originating before the date of enactment of this Act.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id99625E8CD814484DB8B9F2AAA6DE48F8"><enum>(3)</enum><header>Jurisdiction of

			 courts</header>

						<subparagraph commented="no" display-inline="no-display-inline" id="id7050B5E7FF7C43EFAAEFBBE134C51E4A"><enum>(A)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Except as otherwise

			 provided in this title, no court shall have jurisdiction over a claim filed by

			 an individual or group for the historical accounting of funds in an IIM account

			 on or before the date of enactment of this Act, including any such claim that

			 is pending on the date of enactment of this Act.</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB6B9CA61CF8B4B0989C89759451F2F0B"><enum>(B)</enum><header>Limitation</header><text display-inline="yes-display-inline">This paragraph does not prevent a court

			 from ordering an accounting in connection with an action relating to the

			 mismanagement of trust resources that are not funds in an IIM account on or

			 before the date of enactment of this Act.</text>

						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id386A2BC32EA842C298DC7C1F5A2D40A6"><enum>(b)</enum><header>Acceptance as

			 waiver</header><text display-inline="yes-display-inline">The acceptance by a

			 claimant of a benefit under this title shall be considered to be a waiver by

			 the claimant of any accounting claim that the claimant has or may have relating

			 to the IIM account of the claimant.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="id0BA7071877A646779D27C90D6D3EFD5E"><enum>(c)</enum><header>Receipt of

			 payments have no impact on benefits under other Federal programs</header><text display-inline="yes-display-inline">The receipt of a payment by a claimant

			 under this title shall not be—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="id7183323EBD54417EAEEC73AC9CE307A8"><enum>(1)</enum><text display-inline="yes-display-inline">subject to Federal or State income tax;

			 or</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF4BD1E88C1894E35A3A8C0CBBB43439A"><enum>(2)</enum><text display-inline="yes-display-inline">treated as benefits or otherwise taken into

			 account in determining the eligibility of the claimant for, or the amount of

			 benefits under, any other Federal program, including the social security

			 program, the medicare program, the medicaid program, the State children's

			 health insurance program, the food stamp program, or the Temporary Assistance

			 for Needy Families program.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDc3253bb12cc545aaa473305378a29765"><enum>(d)</enum><header>Certain

			 claims</header><text display-inline="yes-display-inline">Nothing in this title

			 precludes any court from granting any legal or equitable relief in an action by

			 an Indian tribe or Indian nation against the United States, or an officer of

			 the United States, filed or pending on or before the date of enactment of this

			 Act, seeking an accounting, money damages, or any other relief relating to a

			 tribal trust account or trust asset or resource.</text>

				</subsection></section></title><title commented="no" id="idADB4893C4DBB4A79B00F46C05935573E" style="OLC"><enum>II</enum><header>Indian trust asset management policy review

			 commission</header>

			<section commented="no" display-inline="no-display-inline" id="ID14c5ba3829da46fcad9d306edd1c8218" section-type="subsequent-section"><enum>201.</enum><header>Establishment</header>

				<subsection commented="no" display-inline="no-display-inline" id="IDe58889077486423fa317abcefdbd27b9"><enum></enum><text display-inline="yes-display-inline">There is established a commission, to be

			 known as the <quote>Indian Trust Asset Management Policy Review

			 Commission,</quote> (referred to in this title as the

			 <quote>Commission</quote>), for the purposes of—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="idCA07C524602E4C9CB7E432EA0D466611"><enum>(1)</enum><text display-inline="yes-display-inline">reviewing trust asset management laws

			 (including regulations) in existence on the date of enactment of this Act

			 governing the management and administration of individual Indian and Indian

			 tribal trust assets;</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6AAC50B7CDF5490F8CAFCAA3116E3CBE"><enum>(2)</enum><text display-inline="yes-display-inline">reviewing the management and administration

			 practices of the Department of the Interior with respect to individual Indian

			 and Indian tribal trust assets; and</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA610B140692F46D486502A16401335DC"><enum>(3)</enum><text display-inline="yes-display-inline">making recommendations to the Secretary of

			 the Interior and Congress for improving those laws and practices.</text>

					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID6dd68ebc4ebc4f33af89150211ee0164" section-type="subsequent-section"><enum>202.</enum><header>Membership</header>

				<subsection commented="no" display-inline="no-display-inline" id="ID7d547db61dc54142b961d6163d5df411"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Commission shall

			 be composed of 12 members, of whom—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="ID230863feb6db4c92aa27e2102eeff1a7"><enum>(1)</enum><text display-inline="yes-display-inline">4 shall be appointed by the

			 President;</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDbc6eb600ffeb4e288037cb4c345ab56e"><enum>(2)</enum><text display-inline="yes-display-inline">2 shall be appointed by the Majority Leader

			 of the Senate;</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID94e445b813b74595a38732d7ba3d7319"><enum>(3)</enum><text display-inline="yes-display-inline">2 shall be appointed by the Minority Leader

			 of the Senate;</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDb8e31a45a49c4c90bcbf41812993dc32"><enum>(4)</enum><text display-inline="yes-display-inline">2 shall be appointed by the Speaker of the

			 House of Representatives; and</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID25638ff241d846ae91420278249228a5"><enum>(5)</enum><text display-inline="yes-display-inline">2 shall be appointed by the Minority Leader

			 of the House of Representatives.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID6d10d32fe741434baab764f49c73c761"><enum>(b)</enum><header>Qualifications</header><text display-inline="yes-display-inline">The membership of the Commission shall

			 include—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="ID9e59e7d2d4d44d548eda41d05cff16d9"><enum>(1)</enum><text display-inline="yes-display-inline">at least 6 members who are representatives

			 of federally recognized Indian tribes with reservation land or other trust land

			 that is managed for—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="idDBAB822821164C10852E49D8830FF724"><enum>(A)</enum><text display-inline="yes-display-inline">grazing;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9A240175A384417DB7D9166896C8D60E"><enum>(B)</enum><text display-inline="yes-display-inline">fishing; or</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id976D9FF6CA4D45E7A9DBC11887BB84AF"><enum>(C)</enum><text display-inline="yes-display-inline">crop, timber, mineral, or other resource

			 production purposes;</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8860727070a64e6c8821c43248c945f4"><enum>(2)</enum><text display-inline="yes-display-inline">at least 1 member (including any member

			 described in paragraph (1)) who is or has been the beneficial owner of an

			 individual Indian monies account; and</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1516f28759dd41a3b086fa745118dbe4"><enum>(3)</enum><text display-inline="yes-display-inline">at least 4 members who have experience

			 in—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="ID3e1328931291466eb2133a3083532503"><enum>(A)</enum><text display-inline="yes-display-inline">Indian trust resource (excluding a

			 financial resource) management;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDca5df8ba8b484ffebe336c43fbf1eaad"><enum>(B)</enum><text display-inline="yes-display-inline">fiduciary investment management;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDab50ed93a0e94365887150949576fcfa"><enum>(C)</enum><text display-inline="yes-display-inline">financial asset management; and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID0279b29e5f5f4ff18319a168982b18fe"><enum>(D)</enum><text display-inline="yes-display-inline">Federal law and policy relating to

			 Indians.</text>

						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDe7c848f8462a45599ecd7caf6edc1b73"><enum>(c)</enum><header>Date of

			 appointments</header>

					<paragraph commented="no" display-inline="no-display-inline" id="id49A75E4DA69D4AE1A1C85EF0D38D500A"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The appointment of a

			 member of the Commission shall be made not later than 90 days after the date of

			 enactment of this Act.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF5097DE02A6C44E290202FBF3D013754"><enum>(2)</enum><header>Failures to

			 appoint</header><text display-inline="yes-display-inline">A failure to make an

			 appointment in accordance with paragraph (1) shall not affect the powers or

			 duties of the Commission if sufficient members are appointed to establish a

			 quorum.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID4961a311fe574ef48ed164e2212bafd5"><enum>(d)</enum><header>Term;

			 vacancies</header>

					<paragraph commented="no" display-inline="no-display-inline" id="ID3ec078ea8c504ff7bcd6a116c2e80262"><enum>(1)</enum><header>Term</header><text display-inline="yes-display-inline">A member shall be appointed for the life of

			 the Commission.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID24d22261479c49d289fc25d401f7fc39"><enum>(2)</enum><header>Vacancies</header><text display-inline="yes-display-inline">A vacancy on the Commission—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="ID4ce8495a2f5e41b7bd85f70756a5ce2e"><enum>(A)</enum><text display-inline="yes-display-inline">shall not affect the powers or duties of

			 the Commission; and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDf332a9bca3e5479095cebb706565827c"><enum>(B)</enum><text display-inline="yes-display-inline">shall be filled in the same manner as the

			 original appointment was made.</text>

						</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="IDade5a069d46a49f1a5934749e2df9d88" section-type="subsequent-section"><enum>203.</enum><header>Meetings and

			 procedures</header>

				<subsection commented="no" display-inline="no-display-inline" id="IDc69acfd6d24340a48ae0c3c886e95da6"><enum>(a)</enum><header>Initial

			 meeting</header><text display-inline="yes-display-inline">Not later than 150

			 days after the date of enactment of this Act, the Commission shall hold the

			 initial meeting of the Commission to—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="ID15db02fb4efb4c8582ac8205e1122ec3"><enum>(1)</enum><text display-inline="yes-display-inline">elect a Chairperson; and</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID98e3691f89d34303ac8736dae4cd1dc9"><enum>(2)</enum><text display-inline="yes-display-inline">establish procedures for the conduct of

			 business of the Commission, including public hearings.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id82248AD54EE54264A693C7BF0FA93D79"><enum>(b)</enum><header>Subsequent

			 meetings</header><text display-inline="yes-display-inline">The Commission shall

			 meet at the call of the Chairperson.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID9538441ec4594ad49ea2c3fdf40354e6"><enum>(c)</enum><header>Quorum</header><text display-inline="yes-display-inline">7 members of the Commission shall

			 constitute a quorum, but a lesser number of members may hold hearings.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="IDdf561a85bc2e4963a4d99b05f85d704a"><enum>(d)</enum><header>Chairperson</header><text display-inline="yes-display-inline">The Commission shall elect a Chairperson

			 from among the members of the Commission.</text>

				</subsection></section><section commented="no" display-inline="no-display-inline" id="IDc066dc59a03a418b8450d05760b127a0" section-type="subsequent-section"><enum>204.</enum><header>Duties</header>

				<subsection commented="no" display-inline="no-display-inline" id="IDb4f229be843044cca26f1ba66777c4a1"><enum>(a)</enum><header>Reviews and

			 assessments</header><text display-inline="yes-display-inline">The Commission

			 shall review and assess—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="idA1A3DB697C794E039CEAC3F5FBA7A0F4"><enum>(1)</enum><text display-inline="yes-display-inline">Federal laws (including regulations)

			 applicable or relating to the management and administration of Indian trust

			 assets; and</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5C05B544C7624303BDA8B2DB313A3EB6"><enum>(2)</enum><text display-inline="yes-display-inline">the practices of the Department of the

			 Interior relating to the management and administration of Indian trust

			 assets.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID4d4c0615381648b48ac913eb25528b80"><enum>(b)</enum><header>Consultation</header><text display-inline="yes-display-inline">In conducting the reviews and assessments

			 under subsection (a), the Commission shall consult with—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="id44C73D0666C847F092243E5018C91BF9"><enum>(1)</enum><text display-inline="yes-display-inline">the Secretary of the Interior;</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id61113F3BA9FB4533916F0761006BCFBA"><enum>(2)</enum><text display-inline="yes-display-inline">federally recognized Indian tribes;

			 and</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6CF4955DFB1B4D8E82076AD9296F9616"><enum>(3)</enum><text display-inline="yes-display-inline">organizations that represent the interests

			 of individual owners of Indian trust assets.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDc7ba194725da4b15b45221f210cd234a"><enum>(c)</enum><header>Recommendations</header><text display-inline="yes-display-inline">After conducting the reviews and

			 assessments under subsection (a), the Commission shall develop recommendations

			 with respect to—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="IDf30fc8e63c4043dfb3f82bc540308f3d"><enum>(1)</enum><text display-inline="yes-display-inline">changes to Federal law that would improve

			 the management and administration of Indian trust assets by the Secretary of

			 the Interior;</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDecc20e36a6444b628ec4a51681e1b319"><enum>(2)</enum><text display-inline="yes-display-inline">changes to Indian trust asset management

			 and administration practices that would—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="idE6F06ECDBF324ABFA46E11FDC17AA95C"><enum>(A)</enum><text display-inline="yes-display-inline">better protect and conserve Indian trust

			 assets;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id264A3BE49FED4437A10EE356B5F3887C"><enum>(B)</enum><text display-inline="yes-display-inline">improve the return on those assets to

			 individual Indian and Indian tribal beneficiaries; or</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE7F6A3C79C914EEB84AFCB198CA6F45D"><enum>(C)</enum><text display-inline="yes-display-inline">improve the level of security of individual

			 Indian and Indian tribal money account data and assets; and</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDe1f69220ff244934b513041301ddd2b4"><enum>(3)</enum><text display-inline="yes-display-inline">proposed Indian trust asset management

			 standards that are consistent with any Federal law that is otherwise applicable

			 to the management and administration of the assets.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID0f575c2ddee94a7eb278c8f198a70d05"><enum>(d)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 2 years after the date on

			 which the Commission holds the initial meeting, the Commission shall submit to

			 the Committee on Indian Affairs of the Senate, the Committee on Resources of

			 the House of Representatives, and the Secretary of the Interior a report that

			 includes—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="ID881e1d6f6aa1480698dabb1610b29a5c"><enum>(1)</enum><text display-inline="yes-display-inline">an overview and the results of the reviews

			 and assessments under subsection (a); and</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID23a2fb3f8e2548ca90a99c1807e0a184"><enum>(2)</enum><text display-inline="yes-display-inline">any recommendations of the Commission under

			 subsection (c).</text>

					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID9cd33c453e9a4e2eb628f4d7f1985759" section-type="subsequent-section"><enum>205.</enum><header>Powers</header>

				<subsection commented="no" display-inline="no-display-inline" id="ID1c273e43068c408f915610a02aec0966"><enum>(a)</enum><header>Hearings</header><text display-inline="yes-display-inline">The Commission may hold such hearings, meet

			 and act at such times and places, take such testimony, and receive such

			 evidence as the Chairperson determines to be appropriate to carry out this

			 title.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID1c8e1132af6a4e4c86713e70789974c8"><enum>(b)</enum><header>Information

			 from Federal agencies</header>

					<paragraph commented="no" display-inline="no-display-inline" id="ID1501e5108b9b47bea4dd500cac67b2fa"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Commission may

			 secure directly from a Federal agency such information as the Chairperson

			 determines to be necessary to carry out this title.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8f3422c76dba45089636ab3f45fa621b"><enum>(2)</enum><header>Provision of

			 information</header><text display-inline="yes-display-inline">On request of the

			 Chairperson, the head of a Federal agency shall provide information to the

			 Commission.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID30340d4042c74c9fb28a509423e8cdbb"><enum>(c)</enum><header>Access to

			 personnel</header><text display-inline="yes-display-inline">For purposes of

			 carrying out this title, the Commission shall have reasonable access to staff

			 responsible for Indian trust asset management and administration of—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="id9D2E08598E1E4CD9B42EC3FA6BA5AA6F"><enum>(1)</enum><text display-inline="yes-display-inline">the Department of the Interior;</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE98E86791F0548F7BCEB5BD51EFEC735"><enum>(2)</enum><text display-inline="yes-display-inline">the Department of the Treasury; and</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id475E549B6EDA44F7892C37F99E715A10"><enum>(3)</enum><text display-inline="yes-display-inline">the Department of Justice.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID953a31683bdb45edad23616705577750"><enum>(d)</enum><header>Postal

			 services</header><text display-inline="yes-display-inline">The Commission may

			 use the United States mail in the same manner and under the same conditions as

			 other Federal agencies.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="IDda6fc784d9cb409aba0eb36359f3314a"><enum>(e)</enum><header>Gifts</header><text display-inline="yes-display-inline">The Commission may accept, use, and dispose

			 of gifts or donations of services or property to the same extent and under the

			 same conditions as other Federal agencies.</text>

				</subsection></section><section commented="no" display-inline="no-display-inline" id="ID301b4fcfbed24848a000cd5b56a240cf" section-type="subsequent-section"><enum>206.</enum><header>Commission personnel

			 matters</header>

				<subsection commented="no" display-inline="no-display-inline" id="ID9aea155866e54501833a6ed2482bad69"><enum>(a)</enum><header>Compensation of

			 members</header>

					<paragraph commented="no" display-inline="no-display-inline" id="ID06003dc122874a9abe64762d7993eee1"><enum>(1)</enum><header>Non-Federal

			 employees</header><text display-inline="yes-display-inline">A member of the

			 Commission who is not an officer or employee of the Federal Government shall be

			 compensated at a rate equal to the daily equivalent of the annual rate of basic

			 pay prescribed for level IV of the Executive Schedule under section 5315 of

			 title 5, United States Code, for each day (including travel time) during which

			 the member is engaged in the performance of the duties of the

			 Commission.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDdd3a89e591cc42838fc25447c4f53e59"><enum>(2)</enum><header>Federal

			 employees</header><text display-inline="yes-display-inline">A member of the

			 Commission who is an officer or employee of the Federal Government shall serve

			 without compensation in addition to the compensation received for the services

			 of the member as an officer or employee of the Federal Government.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDcef91203cb6d4149b8af616dc6354980"><enum>(b)</enum><header>Travel

			 expenses</header><text display-inline="yes-display-inline">A member of the

			 Commission shall be allowed travel expenses, including per diem in lieu of

			 subsistence, at rates authorized for an employee of an agency under subchapter

			 I of chapter 57 of title 5, United States Code, while away from home or regular

			 place of business of the member in the performance of the duties of the

			 Commission.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID23d4c5bffaf54e6bb795f7f1cb935031"><enum>(c)</enum><header>Staff</header>

					<paragraph commented="no" display-inline="no-display-inline" id="ID08ded197216046488526be684cb6c450"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Chairperson may,

			 without regard to the civil services laws (including regulations), appoint and

			 terminate an executive director and such other additional personnel as are

			 necessary to enable the Commission to perform the duties of the

			 Commission.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0cc9ec3da1a64097afa9b2e504056428"><enum>(2)</enum><header>Confirmation of

			 executive director</header><text display-inline="yes-display-inline">The

			 employment of an executive director shall be subject to confirmation by the

			 Commission.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDbcf00437c5a645d3b4eaad59c231c8e3"><enum>(3)</enum><header>Compensation</header>

						<subparagraph commented="no" display-inline="no-display-inline" id="ID537d5ad8997143e4ba370ecc7110859d"><enum>(A)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Except as provided in

			 subparagraph (B), the Chairperson may fix the compensation of the executive

			 director and other personnel without regard to the provisions of chapter 51 and

			 subchapter III of title 5, United States Code, relating to classification of

			 positions and General Schedule pay rates.</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4df24ed2b6374538ad753eeecb2841a3"><enum>(B)</enum><header>Maximum rate of

			 pay</header><text display-inline="yes-display-inline">The rate of pay for the

			 executive director and other personnel shall not exceed the rate payable for

			 level V of the Executive Schedule under section 5316 of title 5, United States

			 Code.</text>

						</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="IDb76f6494242449a8a5d43a08079a1210" section-type="subsequent-section"><enum>207.</enum><header>Exemption from

			 FACA</header>

				<subsection commented="no" display-inline="no-display-inline" id="idB8FF1C3307E64CDC844D89C084B0AD33"><enum></enum><text display-inline="yes-display-inline">The Federal Advisory Committee Act (5

			 U.S.C. App.) shall not apply to the Commission if all hearings of the

			 Commission are held open to the public.</text>

				</subsection></section><section commented="no" display-inline="no-display-inline" id="ID9611b75cd98b46848e80affa24d94a10" section-type="subsequent-section"><enum>208.</enum><header>Authorization of

			 appropriations</header>

				<subsection commented="no" display-inline="no-display-inline" id="idE315674CC7F74650AABD677589086236"><enum></enum><text display-inline="yes-display-inline">There are authorized to be appropriated

			 such sums as are necessary to carry out this title.</text>

				</subsection></section><section commented="no" display-inline="no-display-inline" id="ID4ee37182e1d149d096560a46eab1de8f" section-type="subsequent-section"><enum>209.</enum><header>Termination of

			 commission</header>

				<subsection commented="no" display-inline="no-display-inline" id="idA32E0EDC62C24141BA4E453ACB2E5833"><enum></enum><text display-inline="yes-display-inline">The Commission and the authority of the

			 Commission under this title shall terminate on the date that is 3 years after

			 the date on which the Commission holds the initial meeting of the

			 Commission.</text>

				</subsection></section></title><title commented="no" id="id880162DEB75B4C5F8C8364B57DEF3425" style="OLC"><enum>III</enum><header>Indian Trust Asset Management Demonstration

			 Project Act</header>

			<section commented="no" display-inline="no-display-inline" id="idB6F81A53426F40B59B0A28937C8C4BE9" section-type="subsequent-section"><enum>301.</enum><header>Short title</header>

				<subsection commented="no" display-inline="no-display-inline" id="IDd7e0ba23dc7d4b808f45f92a73fc132a"><enum></enum><text display-inline="yes-display-inline">This title may be cited as the

			 <quote><short-title>Indian Trust Asset Management

			 Demonstration Project Act of 2005</short-title></quote>.</text>

				</subsection></section><section commented="no" display-inline="no-display-inline" id="idF413C2CBBFA248BF9DC6DB19CC62C2DA" section-type="subsequent-section"><enum>302.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>

				<paragraph commented="no" display-inline="no-display-inline" id="idBE1F6894FF144E598D8833CB120C891C"><enum>(1)</enum><header>Project</header><text display-inline="yes-display-inline">The term <term>Project</term> means the

			 Indian trust asset management demonstration project established under section

			 303(a).</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id12AC92A3978542F48FA6615C5BC586A9"><enum>(2)</enum><header>Other Indian

			 tribe</header><text display-inline="yes-display-inline">The term <term>other

			 Indian tribe</term> means an Indian tribe that—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="id66F245500A7B431ABCDE198C179B8454"><enum>(A)</enum><text display-inline="yes-display-inline">is federally recognized;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3BD5BD68C1654E718C317FBA33DAA6AA"><enum>(B)</enum><text display-inline="yes-display-inline">is not a section 131 Indian tribe;

			 and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF14488145C9845BDAEC43D883197F8EB"><enum>(C)</enum><text display-inline="yes-display-inline">submits an application under section

			 303(c).</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id250F5C24BD1D4DFCB7D78F5C3CE213B5"><enum>(3)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the

			 Secretary of the Interior.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id63BD5C4BF1284FE3B815800D14A7B484"><enum>(4)</enum><header>Section 131

			 Indian tribe</header><text display-inline="yes-display-inline">The term

			 <term>section 131 Indian tribe</term> means any Indian tribe that is

			 participating in the demonstration project under section 131 of title III,

			 division E of the Consolidated Appropriations Act, 2005 (Public Law 108–447;

			 118 Stat. 2809).</text>

				</paragraph></section><section commented="no" display-inline="no-display-inline" id="IDdd0a3798dc2f46babc847bd30722a51f" section-type="subsequent-section"><enum>303.</enum><header>Establishment of

			 demonstration project; selection of participating Indian tribes</header>

				<subsection commented="no" display-inline="no-display-inline" id="ID3adfc7432f924effbef4269b2d37a80b"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Secretary shall

			 establish and carry out an Indian trust asset management demonstration project,

			 in accordance with this title.</text>

			 participating Indian tribes</header>

					<paragraph commented="no" display-inline="no-display-inline" id="ID0c872a679f8e40c896304d9927ab43ba"><enum>(1)</enum><header>Section 131

			 Indian tribes</header><text display-inline="yes-display-inline">A section 131

			 Indian tribe shall be eligible to participate in the Project if the section 131

			 Indian tribe submits to the Secretary an application under subsection

			 (c).</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDbe7096fa8ca44c34bc9b0d17b65d2f0c"><enum>(2)</enum><header>Other

			 tribes</header>

						<subparagraph commented="no" display-inline="no-display-inline" id="id5AFDA6D3012B494CB013EF65F4389B58"><enum>(A)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Any other Indian

			 tribe shall be eligible to participate in the Project if—</text>

							<clause commented="no" display-inline="no-display-inline" id="idF2D9FE965F8944EABBBB96112B3BF48F"><enum>(i)</enum><text display-inline="yes-display-inline">the other Indian tribe submits to the

			 Secretary an application under subsection (c); and</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="idF7860DB1FCF5428696177259B826B279"><enum>(ii)</enum><text display-inline="yes-display-inline">the Secretary approves the application of

			 the other Indian tribe.</text>

							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB35A22E2AFFA4BC0B9E24E3E34362179"><enum>(B)</enum><header>Limitation</header>

							<clause commented="no" display-inline="no-display-inline" id="idFD2BE9BFBE784537825B52C656CB8EBC"><enum>(i)</enum><header>30 or fewer

			 applicants</header><text display-inline="yes-display-inline">If 30 or fewer

			 other Indian tribes submit applications under subsection (c), each of the other

			 Indian tribes shall be eligible to participate in the Project.</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="idD5E2D7BED0954C90BA0D4A7298347AF8"><enum>(ii)</enum><header>More than 30

			 applicants</header>

								<subclause commented="no" display-inline="no-display-inline" id="id2428D96BC9664C3387E003D24C7815D7"><enum>(I)</enum><header>In

			 general</header><text display-inline="yes-display-inline">If more than 30 other

			 Indian tribes submit applications under subsection (c), the Secretary shall

			 select 30 other Indian tribes to participate in the Project.</text>

								</subclause><subclause commented="no" display-inline="no-display-inline" id="idE8EB3DE6B76E43A180FBB9FE06F8715B"><enum>(II)</enum><header>Preference</header><text display-inline="yes-display-inline">In selecting other Indian tribes under

			 subclause (I), the Secretary shall give preference to other Indian tribes the

			 applications of which were first received by the Secretary.</text>

								</subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8d824483bdbf4acf993d20206fd8949f"><enum>(3)</enum><header>Notice</header>

						<subparagraph commented="no" display-inline="no-display-inline" id="id162EB6B172AC41E7B0A838CFFCAD64E2"><enum>(A)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Secretary shall

			 provide a written notice to each Indian tribe selected to participate in the

			 Project.</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id11B09E45B0E4448BA9AA0BA67BB26F78"><enum>(B)</enum><header>Contents</header><text display-inline="yes-display-inline">A notice under subparagraph (A) shall

			 include—</text>

							<clause commented="no" display-inline="no-display-inline" id="id839ACA02C92348189701262D51C558F5"><enum>(i)</enum><text display-inline="yes-display-inline">a statement that the application of the

			 Indian tribe has been approved by the Secretary; and</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="idC68FBE385F56483C9747EE835C3C3483"><enum>(ii)</enum><text display-inline="yes-display-inline">a requirement that the Indian tribe shall

			 submit to the Secretary a proposed Indian trust asset management plan in

			 accordance with section 304.</text>

							</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID11379cf8e00540e487f498ebc8ffadb0"><enum>(c)</enum><header>Application</header>

					<paragraph commented="no" display-inline="no-display-inline" id="IDc049350499bc4efaab0aeae2fd8be229"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">To be eligible to

			 participate in the Project, an Indian tribe shall submit to the Secretary a

			 written application in accordance with paragraph (2).</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDe102b0c92d224a6cab108e9d0a3cd401"><enum>(2)</enum><header>Requirements</header><text display-inline="yes-display-inline">The Secretary shall take into consideration

			 an application under this subsection only if the application—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="ID96483d91813c48068ba7cd99d48ed09c"><enum>(A)</enum><text display-inline="yes-display-inline">includes a copy of a resolution or other

			 appropriate action by the governing body of the Indian tribe, as determined by

			 the Secretary, in support of or authorizing the application;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDffc1066d003a40ce97b1f1f58b8569e9"><enum>(B)</enum><text display-inline="yes-display-inline">is received by the Secretary by the date

			 that is 180 days after the date of enactment of this Act; and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID86ab40fb3f2a4c91a87fcc64e51f48b3"><enum>(C)</enum><text display-inline="yes-display-inline">states that the Indian tribe is requesting

			 to participate in the Project.</text>

						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID2d60b54a165f4966b804db3b5683cfaf"><enum>(d)</enum><header>Duration</header><text display-inline="yes-display-inline">The Project shall remain in effect for a

			 period of 8 years after the date of enactment of this Act.</text>

				</subsection></section><section commented="no" display-inline="no-display-inline" id="ID77cfe379c45c41e799e07938cb635065" section-type="subsequent-section"><enum>304.</enum><header>Indian trust asset

			 management plan</header>

				<subsection commented="no" display-inline="no-display-inline" id="ID8db34720265e41818826f98463d906f7"><enum>(a)</enum><header>Proposed

			 plan</header>

					<paragraph commented="no" display-inline="no-display-inline" id="ID4dcdbf5522e347fe9aceb0a1ac5b470a"><enum>(1)</enum><header>Submission</header>

						<subparagraph commented="no" display-inline="no-display-inline" id="idD366266657244243B3EC94184B2C65D4"><enum>(A)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Not later than 120

			 days after the date on which an Indian tribe receives a notice from the

			 Secretary under section 303(b)(3), the Indian tribe shall submit to the

			 Secretary a proposed Indian trust asset management plan in accordance with

			 paragraph (2).</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB2220B96CBC24C87ADDA23EE09634309"><enum>(B)</enum><header>Time

			 limitations</header>

							<clause commented="no" display-inline="no-display-inline" id="idF0DFF38A48A14EB88AB382B35553A81A"><enum>(i)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Except as provided in

			 clause (ii), any Indian tribe that fails to submit the Indian trust asset

			 management plan of the Indian tribe by the date specified in subparagraph (A)

			 shall no longer be eligible to participate in the Project.</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="id858E3413D0FE410097EF132D0BCF53FC"><enum>(ii)</enum><header>Extension</header><text display-inline="yes-display-inline">The Secretary shall grant an extension of

			 not more than 60 days to an Indian tribe if the Indian tribe submits a written

			 request for such an extension before the date described in subparagraph

			 (A).</text>

							</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID078ef1207d324a9fabc4f69daf228b29"><enum>(2)</enum><header>Contents</header><text display-inline="yes-display-inline">A proposed Indian trust asset management

			 plan shall include provisions that—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="IDe67a2800885741328f94e25533c3331f"><enum>(A)</enum><text display-inline="yes-display-inline">identify the trust assets that will be

			 subject to the plan, including financial and nonfinancial trust assets;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDa9fe17df37f64a15aec6a312746fe3a7"><enum>(B)</enum><text display-inline="yes-display-inline">establish trust asset management objectives

			 and priorities for Indian trust assets that are located within the reservation,

			 or otherwise subject to the jurisdiction, of the Indian tribe;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID50b0154443ac4a6eb4823a17170347fb"><enum>(C)</enum><text display-inline="yes-display-inline">allocate trust asset management funding

			 that is available for the Indian trust assets subject to the plan in order to

			 meet the trust asset management objectives and priorities;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDd3f2c70e6de54c02ad7098d031195743"><enum>(D)</enum><text display-inline="yes-display-inline">if the Indian tribe has contracted or

			 compacted functions or activities under the Indian Self-Determination and

			 Education Assistance Act (25 U.S.C. 450 et seq.) relating to the management of

			 trust assets—</text>

							<clause commented="no" display-inline="no-display-inline" id="ID9b6b833ad00e49cfa84b095897db03ed"><enum>(i)</enum><text display-inline="yes-display-inline">identify the functions or activities that

			 are being performed by the Indian tribe under the contracts or compacts;

			 and</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="ID727191c4bdf147cfb3710012aa724f48"><enum>(ii)</enum><text display-inline="yes-display-inline">describe the proposed management systems,

			 practices, and procedures that the Indian tribe will follow; and</text>

							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID82a85e6c34f9462d8ca8b8b0fd43763f"><enum>(E)</enum><text display-inline="yes-display-inline">establish procedures for nonbinding

			 mediation or resolution of any dispute between the Indian tribe and the United

			 States relating to the trust asset management plan.</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC6AFAC8D73A94E55A52D939C280338D0"><enum>(3)</enum><header>Authority of

			 Indian tribes to develop systems, practices, and procedures</header><text display-inline="yes-display-inline">For purposes of preparing and carrying out

			 a management plan under this section, an Indian tribe that has compacted or

			 contracted activities or functions under the Indian Self-Determination and

			 Education Assistance Act (25 U.S.C. 450 et seq.), for purposes of carrying out

			 the activities or functions, may develop and carry out trust asset management

			 systems, practices, and procedures that differ from any such systems,

			 practices, and procedures used by the Secretary in managing the trust assets if

			 the systems, practices, and procedures of the Indian tribe meet the

			 requirements of the laws, standards, and responsibilities described in

			 subsection (c).</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID49a2da30923a48108e5a5a7968e6bae8"><enum>(4)</enum><header>Technical

			 assistance and information</header><text display-inline="yes-display-inline">The Secretary shall provide to an Indian

			 tribe any technical assistance and information, including budgetary

			 information, that the Indian tribe determines to be necessary for preparation

			 of a proposed plan on receipt of a written request from the Indian

			 tribe.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID9d685da0d6084dbea5c79d3ac5fa4ef8"><enum>(b)</enum><header>Approval and

			 disapproval of proposed plans</header>

					<paragraph commented="no" display-inline="no-display-inline" id="ID3ff212d3e5cb416b9073a1c5a85bbc43"><enum>(1)</enum><header>Approval</header>

						<subparagraph commented="no" display-inline="no-display-inline" id="idA8E106E92C0E4BD58FFE1BF254050549"><enum>(A)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Not later than 120

			 days after the date on which an Indian tribe submits a proposed Indian trust

			 asset management plan under subsection (a), Secretary shall approve or

			 disapprove the proposed plan.</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8C473F65B73C4F9CB45D78B394D81AD0"><enum>(B)</enum><header>Requirements

			 for disapproval</header><text display-inline="yes-display-inline">The Secretary

			 shall approve a proposed plan unless the Secretary determines that—</text>

							<clause commented="no" display-inline="no-display-inline" id="ID9f674c3f43ce432ebd7ffb4911a7db02"><enum>(i)</enum><text display-inline="yes-display-inline">the proposed plan fails to address a

			 requirement under subsection (a)(2);</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="ID1621afac06394e808ef844d48043f691"><enum>(ii)</enum><text display-inline="yes-display-inline">the proposed plan includes 1 or more

			 provisions that are inconsistent with subsection (c); or</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="ID78497087227e46d6abf024220051d7a7"><enum>(iii)</enum><text display-inline="yes-display-inline">the cost of implementing the proposed plan

			 exceeds the amount of funding available for the management of trust assets that

			 would be subject to the proposed plan.</text>

							</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDe0821eebfbe34f6fb6cffe851503b5ae"><enum>(2)</enum><header>Action on

			 disapproval</header>

						<subparagraph commented="no" display-inline="no-display-inline" id="id5CA99A1807BC408DB962D356C9ECC3B8"><enum>(A)</enum><header>Notice</header><text display-inline="yes-display-inline">If the Secretary disapproves a proposed

			 plan under paragraph (1)(B), the Secretary shall provide to the Indian tribe a

			 written notice of the disapproval, including any reason why the proposed plan

			 was disapproved.</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD5D67C7974FA4C59AC18382E7CECE0A9"><enum>(B)</enum><header>Action by

			 tribes</header><text display-inline="yes-display-inline">An Indian tribe the

			 proposed plan of which is disapproved under paragraph (1)(B) may resubmit an

			 amended proposed plan not later than 90 days after the date on which the Indian

			 tribe receives the notice under subparagraph (A).</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDed96612d5cb14e669b2eac7a0b0b05fe"><enum>(3)</enum><header>Failure to

			 approve or disapprove</header><text display-inline="yes-display-inline">If the

			 Secretary fails to approve or disapprove a proposed plan in accordance with

			 paragraph (1), the plan shall be considered to be disapproved under clauses (i)

			 and (ii) of paragraph (1)(B).</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd456f8b7b1cb4eeebc3ac4cb26ad9545"><enum>(4)</enum><header>Judicial

			 review</header><text display-inline="yes-display-inline">An Indian tribe may

			 seek judicial review of the determination of the Secretary in accordance with

			 subchapter II of chapter 5, and chapter 7, of title 5, United States Code

			 (commonly known as the <quote>Administrative Procedure Act</quote>) if—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="id93682FF6CB454CABA22637ECA510B31B"><enum>(A)</enum><text display-inline="yes-display-inline">the Secretary disapproves the proposed plan

			 of the Indian tribe under paragraph (1) or (3); and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idBC00787B9B3C41E7BCFCCDFAEF15A271"><enum>(B)</enum><text display-inline="yes-display-inline">the Indian tribe has exhausted any other

			 administrative remedy available to the Indian tribe.</text>

						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID96a5cb5af5844bbbbcda281225cf9abf"><enum>(c)</enum><header>Applicable

			 laws; standards; trust responsibility</header>

					<paragraph commented="no" display-inline="no-display-inline" id="ID0b9391aed0aa4b56a1ec4614e6d079e6"><enum>(1)</enum><header>Applicable

			 laws</header><text display-inline="yes-display-inline">An Indian trust asset

			 management plan, and any activity carried out under the plan, shall not be

			 approved unless the proposed plan is consistent with—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="ID26ee554b51c34bf99fd2a851d00a597a"><enum>(A)</enum><text display-inline="yes-display-inline">all Federal treaties, statutes,

			 regulations, Executive orders, and court decisions that are applicable to the

			 trust assets, or the management of the trust assets, identified in the plan;

			 and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3329411e893d438eb7b3f0dbcfa7e913"><enum>(B)</enum><text display-inline="yes-display-inline">all tribal laws that are applicable to the

			 trust assets, or the management of trust assets, identified in the plan, except

			 to the extent that the laws are inconsistent with the treaties, statutes,

			 regulations, Executive orders, and court decisions referred to in subparagraph

			 (A).</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID558fd87062694151b9e68c871e243eb4"><enum>(2)</enum><header>Standards</header><text display-inline="yes-display-inline">Subject to the laws referred to in

			 paragraph (1)(A), an Indian trust asset management plan shall not be approved

			 unless the Secretary determines that the plan will—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="IDed7cf89ecf0f4e05ba6295923771ac2b"><enum>(A)</enum><text display-inline="yes-display-inline">protect trust assets from loss, waste, and

			 unlawful alienation;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID86fb2ddcba1948c3b39cfa101491d283"><enum>(B)</enum><text display-inline="yes-display-inline">promote the interests of the beneficial

			 owner of the trust asset;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6cb05cd3794c4b7b96fd8b52d92273f5"><enum>(C)</enum><text display-inline="yes-display-inline">conform, to the maximum extent practicable,

			 to the preferred use of the trust asset by the beneficial owner, unless the use

			 is inconsistent with a treaty, statute, regulation, Executive order, or court

			 decision referred to in paragraph (1)(A);</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID842683153be04b71a7c5d52196020c78"><enum>(D)</enum><text display-inline="yes-display-inline">protect any applicable treaty-based

			 fishing, hunting and gathering, and similar rights relating to the use, access,

			 or enjoyment of a trust asset; and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDff2c4c68842b4eac92ba5da02dbb4609"><enum>(E)</enum><text display-inline="yes-display-inline">require that any activity carried out under

			 the plan be carried out in good faith and with loyalty to the beneficial owner

			 of the trust asset.</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDF9F1B93AC074967A4CAFADCF262A3C8"><enum>(3)</enum><header>Trust

			 responsibility</header><text display-inline="yes-display-inline">An Indian

			 trust asset management plan shall not be approved unless the Secretary

			 determines that the plan is consistent with the trust responsibility of the

			 United States to the Indian tribe and individual Indians.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id41B537218D0E4EEB97C0B2694FA8EC28"><enum>(d)</enum><header>Termination of

			 plan</header>

					<paragraph commented="no" display-inline="no-display-inline" id="id9DF3366BD24144A296F71A1AECC71399"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">An Indian tribe may

			 terminate an Indian trust asset management plan on any date after the date on

			 which a proposed Indian trust asset management plan is approved by providing to

			 the Secretary—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="id169AD8AE34B04197A8F975DEBDA4020C"><enum>(A)</enum><text display-inline="yes-display-inline">a notice of the intent of the Indian tribe

			 to terminate the plan; and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id62A6D4D3B07A4262B99A4460A0687BCC"><enum>(B)</enum><text display-inline="yes-display-inline">a resolution of the governing body of the

			 Indian tribe authorizing the termination of the plan.</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id55E2ACDA895D4DC0A782D7503169D166"><enum>(2)</enum><header>Effective

			 date</header><text display-inline="yes-display-inline">A termination of an

			 Indian trust asset management plan under paragraph (1) takes effect on October

			 1 of the first fiscal year following the date on which a notice is provided to

			 the Secretary under paragraph (1)(A).</text>

					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID393206f5dde54e159dc13546a2174d1e" section-type="subsequent-section"><enum>305.</enum><header>Effect of

			 title</header>

				<subsection commented="no" display-inline="no-display-inline" id="idFB17A2DEEA71428F9B25D31363BFF3F2"><enum>(a)</enum><header>Liability</header><text display-inline="yes-display-inline">Nothing in this title, or a trust asset

			 management plan approved under section 304, shall independently diminish,

			 increase, create, or otherwise affect the liability of the United States or an

			 Indian tribe participating in the Project for any loss resulting from the

			 management of an Indian trust asset under an Indian trust asset management

			 plan.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="IDbcfe40f4daf24b38a9d02b404b66d087"><enum>(b)</enum><header>Effect on other

			 laws</header><text display-inline="yes-display-inline">Nothing in this title

			 amends or otherwise affects the application of any treaty, statute, regulation,

			 Executive order, or court decision that is applicable to Indian trust assets or

			 the management or administration of Indian trust assets, including the Indian

			 Self-Determination and Education Assistance Act (25 U.S.C. 450 et seq.).</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="id2D76BA78D5C24BAEB45F68CFB47E4C71"><enum>(c)</enum><header>Trust

			 responsibility</header><text display-inline="yes-display-inline">Nothing in

			 this title diminishes or otherwise affects the trust responsibility of the

			 United States to Indian tribes and individual Indians.</text>

				</subsection></section></title><title commented="no" id="idE62CB74B2A924211935C766B0327D6DF" style="OLC"><enum>IV</enum><header>Fractional interest purchase and

			 consolidation program</header>

			<section commented="no" display-inline="no-display-inline" id="id0195D4F1C03D45418CC62232BFDCAD73" section-type="subsequent-section"><enum>401.</enum><header>Fractional interest

			 program</header><text display-inline="no-display-inline">Section 213 of the

			 Indian Land Consolidation Act (25 U.S.C. 2212) is amended—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="idFAE1184926F44149A14A81F8627C27B2"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsection (d) as

			 subsection (h); and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id653022744FB948639769DD84EC9C5581"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after subsection (c) the

			 following:</text>

						<subsection commented="no" display-inline="no-display-inline" id="ID556c64d59d6e4ad0a58e775a95a3c353"><enum>(d)</enum><header>Purchase of

				interests in fractionated Indian land</header>

							<paragraph commented="no" display-inline="no-display-inline" id="ID8d16b0969a9f43caac6167aa568996af"><enum>(1)</enum><header>Incentives</header><text display-inline="yes-display-inline">In acquiring an interest under this section

				in any parcel of land that includes undivided trust or restricted interests

				owned by not less than 20 separate individuals, as determined by the Secretary,

				the Secretary may include in the offered purchase price for the interest, in

				addition to fair market value, an amount not less than $100 and not to exceed

				$350, as an incentive for the owner to sell the interest to the

				Secretary.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDeba05eb75d1c42a0b72ae75c21402126"><enum>(2)</enum><header>Sale of all

				trust or restricted interests</header><text display-inline="yes-display-inline">If an individual agrees to sell to the

				Secretary all trust or restricted interests owned by the individual, the

				Secretary may include in the offered purchase price, in addition to fair market

				value and the incentive described in paragraph (1), an amount not to exceed

				$2,000, as the Secretary determines to be appropriate, taking into

				consideration the avoided costs to the United States of probating the estate of

				the individual or an heir of the individual.</text>

							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID7ef5711fba0e4e9d81c4b82a2eb06611"><enum>(e)</enum><header>Certain parcels

				of highly fractionated Indian land</header>

							<paragraph commented="no" display-inline="no-display-inline" id="ID732439d2f7d34269a9b5d6b7f0aa9f1d"><enum>(1)</enum><header>Definition of

				offeree</header><text display-inline="yes-display-inline">In this subsection,

				the term <term>offeree</term> does not include the Indian tribe that has

				jurisdiction over a parcel of land for which an offer is made.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id215BAAF6B6CE4C50B6BB4C5A4368CC99"><enum>(2)</enum><header>Offer to

				purchase</header>

								<subparagraph commented="no" display-inline="no-display-inline" id="id34594A1DA91547E8AE7D5C7190836E5E"><enum>(A)</enum><header>In

				general</header><text display-inline="yes-display-inline">If the Secretary

				determines that a tract of land consists of not less than 200 separate

				undivided trust or restricted interests, the Secretary may offer to purchase

				the interests in the tract, in accordance with this subsection, for an amount

				equal to the sum of—</text>

									<clause commented="no" display-inline="no-display-inline" id="id50645C8F6626458498D7B59E7A39FC35"><enum>(i)</enum><text display-inline="yes-display-inline">the fair market value of the interests;

				and</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="id8EAB7DFED3F34465AC86F56CD07848E8"><enum>(ii)</enum><text display-inline="yes-display-inline">an additional amount, to be determined by

				the Secretary, not less than triple the fair market value of the

				interest.</text>

									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA01EEA3E34AA44678986F5619052FEDD"><enum>(B)</enum><header>Requirement</header><text display-inline="yes-display-inline">The Secretary shall make an offer under

				subparagraph (A) not later than 3 days before the date on which the Secretary

				mails a notice of the offer to the offeree under paragraph (3).</text>

								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID57d5de6c1a764c128c70092a5664689e"><enum>(3)</enum><header>Notice of

				offer</header>

								<subparagraph commented="no" display-inline="no-display-inline" id="id6DCE1473CA934C46BA5CC96C3A593559"><enum>(A)</enum><header>In

				general</header><text display-inline="yes-display-inline">The Secretary shall

				provide to an offeree, by certified mail to the last known address of the

				offeree, a notice of any offer to purchase land under this subsection.</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7927CCEC709E4E12B661BF302CB63760"><enum>(B)</enum><header>Inclusions</header><text display-inline="yes-display-inline">A notice under subparagraph (A) shall

				include in plain language, as determined by the Secretary—</text>

									<clause commented="no" display-inline="no-display-inline" id="IDc58f4eb28bf8418c940b84534ab51a39"><enum>(i)</enum><text display-inline="yes-display-inline">the date on which the offer was

				made;</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="IDdda53d439a5d45b4b489e315326bbd68"><enum>(ii)</enum><text display-inline="yes-display-inline">the name of the offeree;</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="ID9678543fa01241dfa9b0f04f0ccda7dc"><enum>(iii)</enum><text display-inline="yes-display-inline">the location of the tract of land

				containing the interest that is the subject of the offer;</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="ID730b069000fa4dbf9fdaa56833a8bdf6"><enum>(iv)</enum><text display-inline="yes-display-inline">the size of the interest of the offeree,

				expressed in terms of a fraction or a percentage of the tract of land described

				in clause (iii);</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="ID945f6a75c8c24167ad7a5dd95672c76c"><enum>(v)</enum><text display-inline="yes-display-inline">the fair market value of the tract of land

				described in clause (iii);</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="IDed99e67983b242acb3ee27d7f89d0e70"><enum>(vi)</enum><text display-inline="yes-display-inline">the fair market value of the interest of

				the offeree;</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="IDf0381f9aae724f77b7a4e7b2be8cfcdb"><enum>(vii)</enum><text display-inline="yes-display-inline">the amount offered for the interest in

				addition to fair market value under paragraph (2)(A)(ii);</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="ID3936655c13dd476f9bab34b8f6363a1c"><enum>(viii)</enum><text display-inline="yes-display-inline">a statement that the offeree shall be

				considered to have accepted the offer for the amount stated in the notice

				unless a notice of rejection form is deposited in the United States mail not

				later than 90 days after the date on which the offer is received; and</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="idBAE6569E75E94E97A18C39F062D03F09"><enum>(ix)</enum><text display-inline="yes-display-inline">a self-addressed, postage pre-paid notice

				of rejection form.</text>

									</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDad332429fc7649c6bbf85c77833346c8"><enum>(4)</enum><header>Treatment of

				offer</header>

								<subparagraph commented="no" display-inline="no-display-inline" id="ID7970da0123d54214a69dc961581cc11a"><enum>(A)</enum><header>In

				general</header><text display-inline="yes-display-inline">An offer made under

				this subsection shall be considered to be accepted by the offeree if—</text>

									<clause commented="no" display-inline="no-display-inline" id="id29E0761A3A854ADEAF739BC0BEF0584B"><enum>(i)</enum><text display-inline="yes-display-inline">the certified mail receipt for the offer is

				signed by the offeree; and</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="id5C5F57294A3743A79E4DAF231EC0D93B"><enum>(ii)</enum><text display-inline="yes-display-inline">the notice of rejection form described in

				paragraph (3)(B)(ix) is not deposited in the United States mail by the date

				that is 90 days after the date on which the offer is received.</text>

									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0DB188C43B40439BA6D98A7323FFF467"><enum>(B)</enum><header>Rejection</header><text display-inline="yes-display-inline">An offer made under this subsection shall

				be considered to be rejected by the offeree if—</text>

									<clause commented="no" display-inline="no-display-inline" id="ID1f9dd8b7da034ea9893efc1510752213"><enum>(i)</enum><text display-inline="yes-display-inline">the notice of rejection form described in

				paragraph (3)(B)(ix) is deposited in the United States mail by the date that is

				90 days after the date on which the offer is received; or</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="ID336bdfa3551743ca8f709e5514491f1d"><enum>(ii)</enum><text display-inline="yes-display-inline">the certified mail receipt for the offer is

				returned to the Secretary unsigned by the offeree.</text>

									</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDe5c51c950c694f4da9b386df00c8f71c"><enum>(5)</enum><header>Withdrawal of

				acceptance; notice</header>

								<subparagraph commented="no" display-inline="no-display-inline" id="IDe25804b5bf21467cb258e95b6549199b"><enum>(A)</enum><header>Withdrawal of

				acceptance</header><text display-inline="yes-display-inline">A person that is

				considered to have accepted an offer under paragraph (4)(A) may withdraw the

				acceptance by depositing in the United States mail a notice of withdrawal of

				acceptance form by the date that is 30 days after the date of receipt of the

				notice under subparagraph (B).</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3E4A44A7AF8E4523B7AE8906B7B98CFE"><enum>(B)</enum><header>Notice</header><text display-inline="yes-display-inline">The Secretary shall provide to any person

				that is considered to have accepted an offer under paragraph (4)(A), by

				certified mail, restricted delivery, to the last known address of the person, a

				preaddressed, postage prepaid withdrawal of acceptance form and a notice

				stating that—</text>

									<clause commented="no" display-inline="no-display-inline" id="idD1E82C56AFE64944AB5A8C48FA094C5A"><enum>(i)</enum><text display-inline="yes-display-inline">the offer made to the person is considered

				to be accepted; and</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="id1ADAD0D47E6F4DB98F57EC9ED4B55A4D"><enum>(ii)</enum><text display-inline="yes-display-inline">the person has the right to withdraw the

				acceptance by depositing in the United States mail the notice of withdrawal of

				acceptance form by the date that is 30 days after the date on which the notice

				was delivered to the person.</text>

									</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDe0d9d4679a2b47abba658b4904490de3"><enum>(6)</enum><header>Notice of

				acceptance and right to appeal</header><text display-inline="yes-display-inline">The Secretary shall provide to any person

				that has been served with a notice under paragraph (5)(B) and fails to withdraw

				the acceptance of the offer in accordance with paragraph (5)(A), by first class

				mail to the last known address of the person, a notice stating that—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="ID34f8c5e92d204f23a94435c57b912586"><enum>(A)</enum><text display-inline="yes-display-inline">the offer made to the person is considered

				to be accepted and not timely withdrawn; and</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID95fe24082210434093bea659d92eb68d"><enum>(B)</enum><text display-inline="yes-display-inline">after exhausting all administrative

				remedies, the person may appeal any determination of the Secretary in

				accordance with paragraph (7).</text>

								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID280a1f85e01646afb50e70f1c9e40c5b"><enum>(7)</enum><header>Judicial

				review</header><text display-inline="yes-display-inline">A person described in

				paragraph (6) may appeal any determination of the Secretary with respect

				to—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="ID977c57c480164167bd0abf3c6cf696a0"><enum>(A)</enum><text display-inline="yes-display-inline">the number of owners of undivided interests

				in a tract of land required under paragraph (2);</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDcccc9973bf2e4a0f9dcf065a3eb58ce7"><enum>(B)</enum><text display-inline="yes-display-inline">the fair market value of a tract of land or

				interest in land;</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID5f6b7dde3af543359095a62d4cf61825"><enum>(C)</enum><text display-inline="yes-display-inline">the date on which a notice of rejection

				form was deposited in the United States mail under paragraph (4)(B)(i);

				or</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3ab7046682bd4ed88fe8114ac457667c"><enum>(D)</enum><text display-inline="yes-display-inline">the date on which a notice of withdrawal of

				acceptance form was deposited in the United States mail under paragraph

				(5)(A).</text>

								</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID78542456571c409f8ddd3f21c36edf13"><enum>(f)</enum><header>Offer to settle

				claims against the United States</header>

							<paragraph commented="no" display-inline="no-display-inline" id="IDd3aabb8377694a6f8af8322177f39c34"><enum>(1)</enum><header>In

				general</header><text display-inline="yes-display-inline">The Secretary may

				make an offer to any individual owner (not including an Indian tribe) of a

				trust or restricted interest in a tract of land to settle any claim that the

				owner may have against the United States relating to the specific tract of land

				of which the interest is a part (not including a claim for an accounting

				described in title I of the <short-title>Indian Trust

				Reform Act of 2005</short-title>).</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID60525fa24fe343d091aec3e55db22ea8"><enum>(2)</enum><header>Requirements</header><text display-inline="yes-display-inline">An offer to settle claims under this

				subsection shall—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="ID8dd3fce88d1a4770a83e4dd5aa519eda"><enum>(A)</enum><text display-inline="yes-display-inline">be in writing;</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDcbec06a2ec3c4775b6c33480fda62f8c"><enum>(B)</enum><text display-inline="yes-display-inline">be delivered to an individual owner by the

				Secretary in person or through first class mail; and</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID765134c5150b482d83c16ccfd73d4d92"><enum>(C)</enum><text display-inline="yes-display-inline">include—</text>

									<clause commented="no" display-inline="no-display-inline" id="ID329197e14833468497af41e59c240df7"><enum>(i)</enum><text display-inline="yes-display-inline">the name of the individual owner;</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="IDc75b250a70554a6b968326478e7821fa"><enum>(ii)</enum><text display-inline="yes-display-inline">a description of the tract of land to which

				the offer relates;</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="ID394e801ca1d844f3af87d61d5448552e"><enum>(iii)</enum><text display-inline="yes-display-inline">the amount offered to settle a claim of the

				individual owner;</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="ID6ca4ca2bdbea45cb8d4f08d4d1a7471f"><enum>(iv)</enum><text display-inline="yes-display-inline">the manner and date by which the individual

				owner shall accept the offer;</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="ID9a81546961f84aeca6d299254d8b39ce"><enum>(v)</enum><text display-inline="yes-display-inline">a statement that the individual owner is

				under no obligation to accept the offer;</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="IDda3f3157ddbb48079ed9639d12441975"><enum>(vi)</enum><text display-inline="yes-display-inline">a statement that the individual owner has

				the right to consult an attorney or other advisor before accepting the

				offer;</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="ID38fe206c75754a4586a4b968b5c297e4"><enum>(vii)</enum><text display-inline="yes-display-inline">a statement that acceptance of the offer by

				the individual owner will result in a full and final settlement of all claims,

				known and unknown, of the individual owner (including the heirs and assigns of

				the individual owner) against the United States relating to the tract of land

				identified in the offer; and</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="IDacbb3341f3694c4e974fc77dcaaedf8b"><enum>(viii)</enum><text display-inline="yes-display-inline">a statement that the settlement proposed by

				the offer does not cover any claim for an accounting described in title I of

				the <short-title>Indian Trust Reform Act of

				2005</short-title>.</text>

									</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDf724ee6978494c91b87acabc6174d2cf"><enum>(3)</enum><header>Acceptance</header><text display-inline="yes-display-inline">No acceptance of an offer under this

				subsection shall be valid or binding on the individual owner unless the

				acceptance—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="IDb2b6693520e3417eb016e13101b89088"><enum>(A)</enum><text display-inline="yes-display-inline">is in writing;</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDa9edcf5fb84f42eb9c2dc7887158c579"><enum>(B)</enum><text display-inline="yes-display-inline">is signed by the individual owner;</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id918D8CF33AE14350B1B5B5196DBC2621"><enum>(C)</enum><text display-inline="yes-display-inline">is notarized; and</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID930184547afd40df9877579ca725de13"><enum>(D)</enum><text display-inline="yes-display-inline">is attached to a copy of, or contains all

				material terms of, the offer to which the acceptance corresponds.</text>

								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9f3e916e6c9e4f01a0c38ce4458d9388"><enum>(4)</enum><header>Limitation</header><text display-inline="yes-display-inline">No offer to purchase an interest under this

				section or any other provision of law shall be conditioned on the acceptance of

				an offer to settle a claim under this subsection.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDa99257e42ec2439394c8cce511c5f7d0"><enum>(5)</enum><header>Other

				laws</header><text display-inline="yes-display-inline">The authority of the

				Secretary to settle claims under this subsection shall be in addition to, and

				not in lieu of, the authority of the Secretary to settle claims under any other

				provision of Federal law.</text>

							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idC45B955A2C57471A96C8D7026142C607"><enum>(g)</enum><header>Borrowing from

				Treasury</header>

							<paragraph commented="no" display-inline="no-display-inline" id="ID92ca656c3fb445d4a029969dc72e6b13"><enum>(1)</enum><header>Issuance of

				obligations</header>

								<subparagraph commented="no" display-inline="no-display-inline" id="idDCD310B6B5454792B6FC53FB7909B7BE"><enum>(A)</enum><header>In

				general</header><text display-inline="yes-display-inline">To the extent

				approved in annual appropriations Acts, the Secretary may issue to the

				Secretary of the Treasury obligations in such amounts as the Secretary

				determines to be necessary to acquire interests under this Act, subject to

				approval of the Secretary of the Treasury, and bearing interest at a rate to be

				determined by the Secretary of the Treasury, taking into consideration current

				market yields on outstanding marketable obligations of the United States of

				comparable maturities to the obligations.</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id32F15A8741304B29B2A1E6E63FB4366F"><enum>(B)</enum><header>Limitation</header><text display-inline="yes-display-inline">The aggregate amount of obligations under

				subparagraph (A) outstanding at any time shall not exceed

				$<inline-comment>______</inline-comment>.</text>

								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID359ca4ddce9a4ae5b6c9194f4ff236fc"><enum>(2)</enum><header>Forms and

				denominations</header><text display-inline="yes-display-inline">The obligations

				issued under paragraph (1) shall be in such forms and denominations, and

				subject to such other terms and conditions, as the Secretary of the Treasury

				may prescribe.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3292fe53bf6d4bef93c005e17a824cf3"><enum>(3)</enum><header>Repayment</header>

								<subparagraph commented="no" display-inline="no-display-inline" id="id76FE04F47D8F4083B211DBDD03A82573"><enum>(A)</enum><header>In

				general</header><text display-inline="yes-display-inline">Revenues derived from

				land restored to the Tribe under this Act shall be used by the Secretary to pay

				the principal and interest on the obligations issued under paragraph

				(1).</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idAF34F3DDF50F4F4CB77DED190DFED5A2"><enum>(B)</enum><header>Assurance of

				repayment</header><text display-inline="yes-display-inline">The Secretary shall

				ensure, to the maximum extent possible, that the revenues described in

				subparagraph (A) provide reasonable assurance of repayment of the obligations

				issued under paragraph (1).</text>

								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID41420e39a2444236ad622a581e3d951e"><enum>(4)</enum><header>Authorization

				of appropriations</header><text display-inline="yes-display-inline">There are

				authorized to be appropriated to the Secretary for each fiscal year beginning

				after the date of enactment of this subsection such sums as are necessary to

				cover any difference between—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="id8A90FDCF258A44B89555D8B00163B551"><enum>(A)</enum><text display-inline="yes-display-inline">the total amount of repayments of principal

				and interest on obligations issued to the Secretary of the Treasury under

				paragraph (1) during the previous fiscal year; and</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE1769137FF6746D1B37C499125576A72"><enum>(B)</enum><text display-inline="yes-display-inline">the total amount of repayments described in

				subparagraph (A) that were contractually required to be made to the Secretary

				of the Treasury during that fiscal year.</text>

								</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idBC8B1D7669C147CABA445CD30C6785A5"><enum>(h)</enum><header>Receipt of

				payments have no impact on benefits under other Federal programs</header><text display-inline="yes-display-inline">The receipt of a payment by an offeree

				under this title shall not be—</text>

							<paragraph commented="no" display-inline="no-display-inline" id="idCE5596C2BABE42ABB1BBA46E94261249"><enum>(1)</enum><text display-inline="yes-display-inline">subject to Federal or State income tax;

				or</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id94F3B67252F94735B2C760B291D9D474"><enum>(2)</enum><text display-inline="yes-display-inline">treated as benefits or otherwise taken into

				account in determining the eligibility of the offeree for, or the amount of

				benefits under, any other Federal program, including the social security

				program, the medicare program, the medicaid program, the State children's

				health insurance program, the food stamp program, or the Temporary Assistance

				for Needy Families

				program.</text>

							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph></section></title><title commented="no" id="id7D6C9870386F428F8DAC646486262D0A" style="OLC"><enum>V</enum><header>Restructuring Bureau of Indian Affairs and

			 Office of Special Trustee</header>

			<section commented="no" display-inline="no-display-inline" id="id0FDA3D4AF02542D48F815CE15AB57698" section-type="subsequent-section"><enum>501.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this title is to ensure a

			 more effective and accountable administration of duties of the Secretary of the

			 Interior with respect to providing services and programs to Indians and Indian

			 tribes, including the management of Indian trust resources.</text>

			</section><section commented="no" display-inline="no-display-inline" id="id649A25DB64054E14AA95FB606A53EB0C" section-type="subsequent-section"><enum>502.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>

			 Office of Trust Reform Implementation and Oversight referred to in section

			 503(c).</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2E418B1DD85E464ABB31227D6994C0B3"><enum>(3)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the

			 Secretary of the Interior.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDEEE6F5BEBF74A41854BE721B2D05B05"><enum>(4)</enum><header>Under

			 Secretary</header><text display-inline="yes-display-inline">The term

			 <term>Under Secretary</term> means the individual appointed to the position of

			 Under Secretary for Indian Affairs, established by section 503(a).</text>

				</paragraph></section><section commented="no" display-inline="no-display-inline" id="id0EDFF3BF38A545DEB4D11372EB74A2CA" section-type="subsequent-section"><enum>503.</enum><header>Under secretary for

			 Indian affairs</header>

				<subsection commented="no" display-inline="no-display-inline" id="id9DD7803D999D4E58834B45502A249AF7"><enum>(a)</enum><header>Establishment

			 of position</header><text display-inline="yes-display-inline">There is

			 established in the Department of the Interior the position of Under Secretary

			 for Indian Affairs, who shall report directly to the Secretary.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="idDC58FF5FAF094DCBB0235763798CFFC7"><enum>(b)</enum><header>Appointment</header>

					<paragraph commented="no" display-inline="no-display-inline" id="idA9807CC98F174361B53453CBB091C3B6"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Except as provided in

			 paragraph (2), the Under Secretary shall be appointed by the President, by and

			 with the advice and consent of the Senate.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA38BCDB8E19542E7907911510F19F7E6"><enum>(2)</enum><header>Exception</header><text display-inline="yes-display-inline">The officer serving as the Assistant

			 Secretary for Indian Affairs on the date of enactment of this Act may assume

			 the position of Under Secretary without appointment under paragraph (1)

			 if—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="id7DB2BA1675104286846B4901945B1A33"><enum>(A)</enum><text display-inline="yes-display-inline">the officer was appointed as Assistant

			 Secretary for Indian Affairs by the President by and with the advice and

			 consent of the Senate; and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id94C8C55875C644DAB7F5C170A0F7CC0B"><enum>(B)</enum><text display-inline="yes-display-inline">not later than 180 days after the date of

			 enactment of this Act, the Secretary approves the assumption.</text>

						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id2C4101F59F4C4CBDB5DA9F84AD1B173B"><enum>(c)</enum><header>Duties</header><text display-inline="yes-display-inline">In addition to the duties transferred to

			 the Under Secretary under sections 504 and 505, the Under Secretary, acting

			 through an Office of Trust Reform Implementation and Oversight, shall—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="id4514E6B9C88B448DAC5507F85AD64CBD"><enum>(1)</enum><text display-inline="yes-display-inline">carry out any activity relating to trust

			 fund accounts and trust resource management of the Bureau (except any activity

			 carried out under the Office of the Special Trustee for American Indians before

			 the date on which the Office of the Special Trustee is abolished), in

			 accordance with the American Indian Trust Fund Management Reform Act of 1994

			 (25 U.S.C. 4001 et seq.);</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id14ED9E31017E471099B7F2763BB1ED92"><enum>(2)</enum><text display-inline="yes-display-inline">develop and maintain an inventory of Indian

			 trust assets and resources;</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7A4725EA222F4BC0BB195D3666F42C9A"><enum>(3)</enum><text display-inline="yes-display-inline">coordinate with the Special Trustee for

			 American Indians to ensure an orderly transition of the functions of the

			 Special Trustee under section 505;</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDDF3EA91E4D1466DA6D7D604E445090B"><enum>(4)</enum><text display-inline="yes-display-inline">supervise any activity carried out by the

			 Department of the Interior, including—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="id131B0BD24E164D19BEC0AF2E11755B46"><enum>(A)</enum><text display-inline="yes-display-inline">to the extent that the activities relate to

			 Indian affairs, activities carried out by—</text>

							<clause commented="no" display-inline="no-display-inline" id="id2A28FD9C1578476986D2478EA5E12FB9"><enum>(i)</enum><text display-inline="yes-display-inline">the Commissioner of Reclamation;</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="id911E8F4E83DC4995BBFF871FD52D0CE3"><enum>(ii)</enum><text display-inline="yes-display-inline">the Director of the Bureau of Land

			 Management; and</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="idCD8C8644E72847518D96FC221653553B"><enum>(iii)</enum><text display-inline="yes-display-inline">the Director of the Minerals Management

			 Service; and</text>

							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB0BDE2EFADB147249572F1AE85B98B93"><enum>(B)</enum><text display-inline="yes-display-inline">intergovernmental relations between the

			 Bureau and Indian tribal governments;</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA4DFE33B46CE4020BAEF2FD05F720AE1"><enum>(5)</enum><text display-inline="yes-display-inline">to the maximum extent practicable,

			 coordinate activities and policies of the Bureau with activities and policies

			 of—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="id6481DDBACFBC44DABA015FD57353AA77"><enum>(A)</enum><text display-inline="yes-display-inline">the Bureau of Reclamation;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4876FD3C835E4D419DF3FD0977956175"><enum>(B)</enum><text display-inline="yes-display-inline">the Bureau of Land Management; and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id987AC53FC5D04CE995B73485DDCA7453"><enum>(C)</enum><text display-inline="yes-display-inline">the Minerals Management Service;</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0D1CB31C5DFF45D4AA94FED120A51AAC"><enum>(6)</enum><text display-inline="yes-display-inline">provide for regular consultation with

			 Indians and Indian tribes that own interests in trust resources and trust fund

			 accounts;</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB5F2E48E7A1B44319118D415637C92E4"><enum>(7)</enum><text display-inline="yes-display-inline">manage and administer Indian trust

			 resources in accordance with any applicable Federal law;</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD0072AA800644F68B61328BAAD2AD5FE"><enum>(8)</enum><text display-inline="yes-display-inline">take steps to protect the security of data

			 relating to individual Indian and Indian tribal trust accounts; and</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id53A819DD75E14CB9ADE83C924DA20C05"><enum>(9)</enum><text display-inline="yes-display-inline">take any other measure the Under Secretary

			 determines to be necessary with respect to Indian affairs.</text>

					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idF78CE8490ED248CC9A02FAD2555C5794" section-type="subsequent-section"><enum>504.</enum><header>Transfer of

			 functions of Assistant Secretary for Indian Affairs</header>

				<subsection commented="no" display-inline="no-display-inline" id="IDD885B6C69EFD4EB8B6365E3A138EE4E8"><enum>(a)</enum><header>Transfer of

			 functions</header><text display-inline="yes-display-inline">There is

			 transferred to the Under Secretary any function of the Assistant Secretary for

			 Indian Affairs that has not been carried out by the Assistant Secretary as of

			 the date of enactment of this Act.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="IDD346E83A577D429FA10B9229A54E0812"><enum>(b)</enum><header>Determinations

			 of certain functions by the Office of Management and Budget</header><text display-inline="yes-display-inline">If necessary, the Office of Management and

			 Budget shall make any determination relating to the functions transferred under

			 subsection (a).</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID80BC27F2984645479357B64A3BDDDD0E"><enum>(c)</enum><header>Personnel

			 provisions</header>

					<paragraph commented="no" display-inline="no-display-inline" id="ID35D0164A637941F5BCD623C9921E7A4B"><enum>(1)</enum><header>Appointments</header><text display-inline="yes-display-inline">The Under Secretary may appoint and fix the

			 compensation of such officers and employees as the Under Secretary determines

			 to be necessary to carry out any function transferred under this

			 section.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID725786E200A443CC979298C1C12170D5"><enum>(2)</enum><header>Requirements</header><text display-inline="yes-display-inline">Except as otherwise provided by law—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="IDEEDC88CFD38846E9BECFF01935F82A8A"><enum>(A)</enum><text display-inline="yes-display-inline">an officer or employee described in

			 paragraph (1) shall be appointed in accordance with the civil service laws;

			 and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDFF387AF2F0984F329F9EBC68A92FF065"><enum>(B)</enum><text display-inline="yes-display-inline">the compensation of the officer or employee

			 shall be fixed in accordance with title 5, United States Code.</text>

						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDD1C2A6EFE15749AE8B3ED86D77ED241F"><enum>(d)</enum><header>Delegation and

			 assignment</header>

					<paragraph commented="no" display-inline="no-display-inline" id="IDF3488C446E844114A6962AD3CDABA6EF"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Except as otherwise

			 expressly prohibited by law or otherwise provided by this section, the Under

			 Secretary may—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="id376553F2BE2C44F1B0E35B9F39C49962"><enum>(A)</enum><text display-inline="yes-display-inline">delegate any of the functions transferred

			 to the Under Secretary by this section and any function transferred or granted

			 to the Under Secretary after the date of enactment of this Act to such officers

			 and employees of the Office as the Under Secretary may designate; and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4DA7760ABC234F7EA9FA6CD50E9A38D4"><enum>(B)</enum><text display-inline="yes-display-inline">authorize successive redelegations of such

			 functions as the Under Secretary determines to be necessary or

			 appropriate.</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID284094CC48FF41FC9BA45B965F2FC8FF"><enum>(2)</enum><header>Delegation</header><text display-inline="yes-display-inline">No delegation of functions by the Under

			 Secretary under this section shall relieve the Under Secretary of

			 responsibility for the administration of the functions.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDF0B1014B4EFB4FA8B69F3F4AF8BAB1C0"><enum>(e)</enum><header>Reorganization</header><text display-inline="yes-display-inline">The Under Secretary may allocate or

			 reallocate any function transferred under this section among the officers of

			 the Office, and establish, consolidate, alter, or discontinue such

			 organizational entities in the Office, as the Under Secretary determines to be

			 necessary or appropriate.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="IDFAD1303B4C0649BEBFFB1BE443989E29"><enum>(f)</enum><header>Rules</header><text display-inline="yes-display-inline">The Under Secretary may prescribe, in

			 accordance with the provisions of chapters 5 and 6 of title 5, United States

			 Code, such rules and regulations as the Under Secretary determines to be

			 necessary or appropriate to administer and manage the functions of the

			 Office.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="IDCEBD94CAEC5546CCB8BEC26251241DD7"><enum>(g)</enum><header>Transfer and

			 allocations of appropriations and personnel</header>

					<paragraph commented="no" display-inline="no-display-inline" id="IDDDF8D28DE3F4494CA2D9EC2A794C615C"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Except as otherwise

			 provided in this section, the personnel employed in connection with, and the

			 assets, liabilities, contracts, property, records, and unexpended balances of

			 appropriations, authorizations, allocations, and other funds employed, used,

			 held, arising from, available to, or to be made available in connection with,

			 the functions transferred by this section, subject to section 1531 of title 31,

			 United States Code, shall be transferred to the Office.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5B028367DA17473F88B18AF0722E0F41"><enum>(2)</enum><header>Unexpended

			 funds</header><text display-inline="yes-display-inline">Unexpended funds

			 transferred pursuant to this subsection shall be used only for the purposes for

			 which the funds were originally authorized and appropriated.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID8162EDDC878E453185109CD92B9806CE"><enum>(h)</enum><header>Incidental

			 transfers</header>

					<paragraph commented="no" display-inline="no-display-inline" id="IDD97B270F07DF4A11AE02793086141365"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Director of the

			 Office of Management and Budget, at any time the Director may provide, may make

			 such determinations as are necessary with regard to the functions transferred

			 by this section, and make such additional incidental dispositions of personnel,

			 assets, liabilities, grants, contracts, property, records, and unexpended

			 balances of appropriations, authorizations, allocations, and other funds held,

			 used, arising from, available to, or to be made available in connection with

			 such functions, as are necessary, to carry out this section.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDCA4CA12EA17C43C1839F600560FB5290"><enum>(2)</enum><header>Termination of

			 affairs</header><text display-inline="yes-display-inline">The Director of the

			 Office of Management and Budget shall provide for the termination of the

			 affairs of all entities terminated by this section and for any further measures

			 and dispositions as are necessary to effectuate the purposes of this

			 section.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID4DFB0A4FAEC342EE8F8826B17FD62956"><enum>(i)</enum><header>Effect on

			 personnel</header>

					<paragraph commented="no" display-inline="no-display-inline" id="ID088336BA10154792A625CC71BAA389E6"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Except as otherwise

			 provided by this section, the transfer pursuant to this section of full-time

			 personnel (except special Government employees) and part-time personnel holding

			 permanent positions shall not cause any such employee to be separated or

			 reduced in grade or compensation for a period of at least 1 year after the date

			 of transfer of the employee under this section.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDA9E82A615CC248B0A179DE656EB83C4D"><enum>(2)</enum><header>Executive

			 Schedule positions</header><text display-inline="yes-display-inline">Except as

			 otherwise provided in this section, any person who, on the day preceding the

			 date of enactment of this Act, held a position compensated in accordance with

			 the Executive Schedule prescribed in chapter 53 of title 5, United States Code,

			 and who, without a break in service, is appointed to a position in the Office

			 having duties comparable to the duties performed immediately preceding such

			 appointment shall continue to be compensated in the new position at not less

			 than the rate provided for the previous position, for the duration of the

			 service of the person in the new position.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD82AE9F348FB491589B2ED2BEAC30CC8"><enum>(3)</enum><header>Termination of

			 certain positions</header><text display-inline="yes-display-inline">Positions

			 whose incumbents are appointed by the President, by and with the advice and

			 consent of the Senate, the functions of which are transferred by this title,

			 shall terminate on the date of enactment of this Act.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDE353DE2A75CC4069BC3CCA30E550BADE"><enum>(j)</enum><header>Separability</header><text display-inline="yes-display-inline">If a provision of this section or the

			 application of this section to any person or circumstance is held invalid,

			 neither the remainder of this section nor the application of the provision to

			 other persons or circumstances shall be affected.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="IDEE77461E1FBA41B594CD59D0713E3EDD"><enum>(k)</enum><header>Transition</header><text display-inline="yes-display-inline">The Under Secretary may use—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="ID567109E1FE50408C88EB7E0DE47F66AE"><enum>(1)</enum><text display-inline="yes-display-inline">the services of the officers, employees,

			 and other personnel of the Assistant Secretary for Indian Affairs relating to

			 functions transferred to the Office by this section; and</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID77140E87AEE3498F892AAA3BC6A3AE10"><enum>(2)</enum><text display-inline="yes-display-inline">funds appropriated to the functions for

			 such period of time as may reasonably be needed to facilitate the orderly

			 implementation of this section.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID9442231E3B3549A0ABB4584A89F41EF5"><enum>(l)</enum><header>References</header><text display-inline="yes-display-inline">Any reference in a Federal law, Executive

			 order, rule, regulation, delegation of authority, or document relating to the

			 Assistant Secretary for Indian Affairs, with respect to functions transferred

			 under this section, shall be deemed to be a reference to the Under

			 Secretary.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID36DE55DB44D24D51AA54FF28B777A608"><enum>(m)</enum><header>Recommended

			 legislation</header><text display-inline="yes-display-inline">Not later than

			 180 days after the effective date of this title, the Under Secretary, in

			 consultation with the appropriate committees of Congress and the Director of

			 the Office of Management and Budget, shall submit to Congress any

			 recommendations relating to additional technical and conforming amendments to

			 Federal law to reflect the changes made by this section.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="IDE9CFA8E7057E4BE5BF81B2095B7A751D"><enum>(n)</enum><header>Effect of

			 section</header>

					<paragraph commented="no" display-inline="no-display-inline" id="IDE5791FA9DDBB440AA11AE8883AECDC28"><enum>(1)</enum><header>Continuing

			 effect of legal documents</header><text display-inline="yes-display-inline">Any

			 legal document relating to a function transferred by this section that is in

			 effect on the date of enactment of this Act shall continue in effect in

			 accordance with the terms of the document until the document is modified or

			 terminated by—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="IDDC99827074564475A190E5A06EA3D1B5"><enum>(A)</enum><text display-inline="yes-display-inline">the President;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDB9DAA84E73F0465DBACA7F510515100E"><enum>(B)</enum><text display-inline="yes-display-inline">the Under Secretary;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDF0F2165C19C147A2B5ACF95DF513AB2A"><enum>(C)</enum><text display-inline="yes-display-inline">a court of competent jurisdiction;

			 or</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6BBEF7ECAB284FEAB33175EA3980EE59"><enum>(D)</enum><text display-inline="yes-display-inline">operation of Federal or State law.</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID274285F0FA384D7E957E45355A40E362"><enum>(2)</enum><header>Proceedings not

			 affected</header><text display-inline="yes-display-inline">This section shall

			 not affect any proceeding (including a notice of proposed rulemaking, an

			 administrative proceeding, and an application for a license, permit,

			 certificate, or financial assistance) relating to a function transferred under

			 this section that is pending before the Assistant Secretary on the date of

			 enactment of this Act.</text>

					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idFFF6FC0694A84DCAAF544D3FEDEC1EBA" section-type="subsequent-section"><enum>505.</enum><header>Office of Special

			 Trustee for American Indians</header>

				<subsection commented="no" display-inline="no-display-inline" id="id10FCAE89205E4818B7CE9041DFF36E90"><enum>(a)</enum><header>Termination</header><text display-inline="yes-display-inline">Notwithstanding sections 302 and 303 of the

			 American Indian Trust Fund Management Reform Act of 1994 (25 U.S.C. 4042;

			 4043), the Office of Special Trustee for American Indians shall terminate on

			 the effective date of this section.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="idBDF1F093AB9443618B73379ADB3F1707"><enum>(b)</enum><header>Transfer of

			 functions</header><text display-inline="yes-display-inline">There is

			 transferred to the Under Secretary any function of the Special Trustee for

			 American Indians that has not been carried out by the Special Trustee as of the

			 effective date of this section.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="idB4D16C055AF04B29A3934E68191F7ED6"><enum>(c)</enum><header>Determinations

			 of certain functions by the Office of Management and Budget</header><text display-inline="yes-display-inline">If necessary, the Office of Management and

			 Budget shall make any determination relating to the functions transferred under

			 subsection (b).</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="id2EF86E2A5C6041238B0E688C8D9BAD4B"><enum>(d)</enum><header>Personnel

			 provisions</header>

					<paragraph commented="no" display-inline="no-display-inline" id="idD59AC621973D453595680FF0480AD89C"><enum>(1)</enum><header>Appointments</header><text display-inline="yes-display-inline">The Under Secretary may appoint and fix the

			 compensation of such officers and employees as the Under Secretary determines

			 to be necessary to carry out any function transferred under this

			 section.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE9A2C5E4DA7F473C8029FEEEA3838A6E"><enum>(2)</enum><header>Requirements</header><text display-inline="yes-display-inline">Except as otherwise provided by law—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="idA8EE7E00AAD54FB181FCD10B2EBA5951"><enum>(A)</enum><text display-inline="yes-display-inline">any officer or employee described in

			 paragraph (1) shall be appointed in accordance with the civil service laws;

			 and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3B3BA0BEC2A84F60BDAAED61CCB5A24F"><enum>(B)</enum><text display-inline="yes-display-inline">the compensation of such an officer or

			 employee shall be fixed in accordance with title 5, United States Code.</text>

						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idA43A8E4527284C969DAF950C7A72BC26"><enum>(e)</enum><header>Delegation and

			 assignment</header>

					<paragraph commented="no" display-inline="no-display-inline" id="id172D6196A68A4AC38CBC43B529C3DE67"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Except as otherwise

			 expressly prohibited by law or otherwise provided by this section, the Under

			 Secretary may—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="id40305CE01F684DE997655C5880E5CED6"><enum>(A)</enum><text display-inline="yes-display-inline">delegate any of the functions transferred

			 to the Under Secretary under this section and any function transferred or

			 granted to the Under Secretary after the effective date of this section to such

			 officers and employees of the Office as the Under Secretary may designate;

			 and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC2797DFA775B400CBB2A183E299487E2"><enum>(B)</enum><text display-inline="yes-display-inline">authorize successive redelegations of the

			 functions as are necessary or appropriate.</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6C0EB7B87ED644E58E2F99CB725EC018"><enum>(2)</enum><header>Delegation</header><text display-inline="yes-display-inline">No delegation of functions by the Under

			 Secretary under this section shall relieve the Under Secretary of

			 responsibility for the administration of the functions.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idF96556FF4B3C4B81BC3FB418E28357C0"><enum>(f)</enum><header>Reorganization</header><text display-inline="yes-display-inline">The Under Secretary may allocate or

			 reallocate any function transferred under subsection (b) among the officers of

			 the Office, and establish, consolidate, alter, or discontinue such

			 organizational entities in the Office as the Under Secretary determines to be

			 necessary or appropriate.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="id32B62F2362604EFEB996E7E29A5FD8C3"><enum>(g)</enum><header>Rules</header><text display-inline="yes-display-inline">The Under Secretary may prescribe, in

			 accordance with the provisions of chapters 5 and 6 of title 5, United States

			 Code, such rules and regulations as the Under Secretary determines to be

			 necessary or appropriate to administer and manage the functions of the

			 Office.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="idAB47C6B3802D4FCBBE08AA982D624F4C"><enum>(h)</enum><header>Transfer and

			 allocations of appropriations and personnel</header>

					<paragraph commented="no" display-inline="no-display-inline" id="idA003C9B52FC543ADBF8A46D6367B0EE4"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Except as otherwise

			 provided in this section, the personnel employed in connection with, and the

			 assets, liabilities, contracts, property, records, and unexpended balances of

			 appropriations, authorizations, allocations, and other funds employed, used,

			 held, arising from, available to, or to be made available in connection with

			 the functions transferred by this section, subject to section 1531 of title 31,

			 United States Code, shall be transferred to the Office.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4C0FBC3A76F7406AB9D30A41C0DC1F3F"><enum>(2)</enum><header>Unexpended

			 funds</header><text display-inline="yes-display-inline">Unexpended funds

			 transferred pursuant to this subsection shall be used only for the purposes for

			 which the funds were originally authorized and appropriated.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id5A345D2EB95B48CA874DF200688775E1"><enum>(i)</enum><header>Incidental

			 transfers</header>

					<paragraph commented="no" display-inline="no-display-inline" id="idF6AA81DD5A844B0BBBEEF3E7EB063DDD"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Director of the

			 Office of Management and Budget, at any time the Director may provide, may make

			 such determinations as are necessary with regard to the functions transferred

			 by this section, and make such additional incidental dispositions of personnel,

			 assets, liabilities, grants, contracts, property, records, and unexpended

			 balances of appropriations, authorizations, allocations, and other funds held,

			 used, arising from, available to, or to be made available in connection with

			 such functions, as are necessary, to carry out this section.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFFD207E4867148FF9116847877A9F479"><enum>(2)</enum><header>Termination of

			 affairs</header><text display-inline="yes-display-inline">The Director of the

			 Office of Management and Budget shall provide for the termination of the

			 affairs of all entities terminated by this section and for any further measures

			 and dispositions as are necessary to effectuate the purposes of this

			 section.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id34F012B1BAE147CDB07BAD8530B08473"><enum>(j)</enum><header>Effect on

			 personnel</header>

					<paragraph commented="no" display-inline="no-display-inline" id="idDB21581FA3DC47A6B9D5398C24DB9558"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Except as otherwise

			 provided by this section, the transfer pursuant to this section of full-time

			 personnel (except special Government employees) and part-time personnel holding

			 permanent positions shall not cause any such employee to be separated or

			 reduced in grade or compensation for a period of at least 1 year after the date

			 of transfer of the employee under this section.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3A20A5CDD7084B3DB45DE3DC9AE687F0"><enum>(2)</enum><header>Executive

			 Schedule positions</header><text display-inline="yes-display-inline">Except as

			 otherwise provided in this section, any person who, on the day preceding the

			 effective date of this section, held a position compensated in accordance with

			 the Executive Schedule prescribed in chapter 53 of title 5, United States Code,

			 and who, without a break in service, is appointed to a position in the Office

			 having duties comparable to the duties performed immediately preceding such

			 appointment, shall continue to be compensated in the new position at not less

			 than the rate provided for the previous position, for the duration of the

			 service of the person in the new position.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB0B0B29EAD5F45AEBA87EF47EE502BB8"><enum>(3)</enum><header>Termination of

			 certain positions</header><text display-inline="yes-display-inline">Positions

			 the incumbents of which are appointed by the President, by and with the advice

			 and consent of the Senate, and the functions of which are transferred by this

			 title, shall terminate on the effective date of this section.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id422BCF543C69405BBCD58F9EC570995D"><enum>(k)</enum><header>Separability</header><text display-inline="yes-display-inline">If a provision of this section or the

			 application of this section to any person or circumstance is held invalid,

			 neither the remainder of this section nor the application of the provision to

			 other persons or circumstances shall be affected.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="idE52AF826AB6B48A39D11F1651F6CA837"><enum>(l)</enum><header>Transition</header><text display-inline="yes-display-inline">The Under Secretary may use—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="idDCCF312CABCC4CD5968A55B6185A859E"><enum>(1)</enum><text display-inline="yes-display-inline">the services of the officers, employees,

			 and other personnel of the Special Trustee relating to functions transferred to

			 the Office by this section; and</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id147CA3F78C824583AD896AA1D17C6D2B"><enum>(2)</enum><text display-inline="yes-display-inline">funds appropriated to those functions for

			 such period of time as may reasonably be needed to facilitate the orderly

			 implementation of this section.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id0C9E408486214FCBAA45E99A78242063"><enum>(m)</enum><header>References</header><text display-inline="yes-display-inline">Any reference in a Federal law, Executive

			 order, rule, regulation, delegation of authority, or document relating to the

			 Special Trustee, with respect to functions transferred under this section,

			 shall be deemed to be a reference to the Under Secretary.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="id9AFAF6CFD45440F1BCBCA45AED2AB8D0"><enum>(n)</enum><header>Recommended

			 legislation</header><text display-inline="yes-display-inline">Not later than

			 180 days after the effective date of this title, the Under Secretary, in

			 consultation with the appropriate committees of Congress and the Director of

			 the Office of Management and Budget, shall submit to Congress any

			 recommendations relating to additional technical and conforming amendments to

			 Federal law to reflect the changes made by this section.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="idE27C9722BFC94C3F8E44B1DCA4BD015F"><enum>(o)</enum><header>Effect of

			 section</header>

					<paragraph commented="no" display-inline="no-display-inline" id="idA6DA017B2D59443F844F2D64657CFF41"><enum>(1)</enum><header>Continuing

			 effect of legal documents</header><text display-inline="yes-display-inline">Any

			 legal document relating to a function transferred by this section that is in

			 effect on the effective date of this section shall continue in effect in

			 accordance with the terms of the document until the document is modified or

			 terminated by—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="idF747D80736284685A0DB63442778AC2C"><enum>(A)</enum><text display-inline="yes-display-inline">the President;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id186A157297E243ADAF071281E075753D"><enum>(B)</enum><text display-inline="yes-display-inline">the Under Secretary;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB4370058ACC04F8FB3D724264C3871D8"><enum>(C)</enum><text display-inline="yes-display-inline">a court of competent jurisdiction;

			 or</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id81021DA4E0C44D2B8318A2701D30298A"><enum>(D)</enum><text display-inline="yes-display-inline">operation of Federal or State law.</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFD1C2A86A92F4F5C921F27913DF75A7D"><enum>(2)</enum><header>Proceedings not

			 affected</header><text display-inline="yes-display-inline">This section shall

			 not affect any proceeding (including a notice of proposed rulemaking, an

			 administrative proceeding, and an application for a license, permit,

			 certificate, or financial assistance) relating to a function transferred under

			 this section that is pending before the Special Trustee on the effective date

			 of this section.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id57CCEDEF84D64B8391001DF7ADDFB99B"><enum>(p)</enum><header>Effective

			 date</header><text display-inline="yes-display-inline">This section shall take

			 effect on December 31, 2008.</text>

				</subsection></section><section commented="no" display-inline="no-display-inline" id="idEB12CE30FB3347C9AA9663E9CD552A05" section-type="subsequent-section"><enum>506.</enum><header>Hiring

			 preference</header><text display-inline="no-display-inline">In appointing or

			 otherwise hiring any employee to the Office, the Under Secretary shall give

			 preference to Indians in accordance with section 12 of the Act of June 8, 1934

			 (25 U.S.C. 472).</text>

			</section><section commented="no" display-inline="no-display-inline" id="id9174DAC4555F4CB4BA3FDA0215EC0A12" section-type="subsequent-section"><enum>507.</enum><header>Authorization of

			 appropriations</header><text display-inline="no-display-inline">There are

			 authorized to be appropriated such sums as are necessary to carry out this

			 title.</text>

			<section commented="no" display-inline="no-display-inline" id="id305EBD1E34C144A3A47053C685F75094" section-type="subsequent-section"><enum>601.</enum><header>Audits and

			 reports</header>

				<subsection commented="no" display-inline="no-display-inline" id="id61FCD15278454BD69FCA7C6AF06D943A"><enum>(a)</enum><header>Financial

			 statements and internal control report</header>

					<paragraph commented="no" display-inline="no-display-inline" id="idACFD8836642A4BDFA6D4668BC30EBA95"><enum>(1)</enum><header>Financial

			 statements</header><text display-inline="yes-display-inline">For each fiscal

			 year beginning after the enactment of this Act, the Secretary of Interior shall

			 prepare financial statements for individual Indian, Indian tribal, and other

			 Indian trust accounts in accordance with generally accepted accounting

			 principles of the Federal Government.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF96FAA2C10324E949ED42CFADD67E067"><enum>(2)</enum><header>Internal

			 control report</header><text display-inline="yes-display-inline">Concurrently

			 with the financial statements under by paragraph (1), the Secretary shall

			 prepare an internal control report that—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="id79CE6B6390144A2EB1829ED15C3D8E0C"><enum>(A)</enum><text display-inline="yes-display-inline">establishes the responsibility of the

			 Secretary for establishing and maintaining an adequate internal control

			 structure and procedures for financial reporting under this Act; and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6D122D8A31A940A0A0E0ACBAFCC90190"><enum>(B)</enum><text display-inline="yes-display-inline">assesses the effectiveness of the internal

			 control structure and procedures for financial reporting under subparagraph (A)

			 during the preceding fiscal year.</text>

						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id068A0A017184407EBFF6BEE60089FE35"><enum>(b)</enum><header>Independent

			 external auditor</header>

					<paragraph commented="no" display-inline="no-display-inline" id="id5F7F80FAC9DE422CA0A5CDE985E8A033"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Comptroller

			 General of the United States shall enter into a contract with an independent

			 external auditor to conduct an audit and prepare a report in accordance with

			 this subparagraph.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id59F22CDED6244582948CB9B77838F6CF"><enum>(2)</enum><header>Audit

			 report</header><text display-inline="yes-display-inline">An independent

			 external auditor shall submit to the Committee on Indian Affairs of the Senate,

			 and make available to the public, an audit of the financial statements under

			 subsection (a)(1) in accordance with—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="idC66940FCBB364F8D8A53831B0CA1EDC8"><enum>(A)</enum><text display-inline="yes-display-inline">generally accepted auditing standards of

			 the Federal Government; and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2FC0B364974D4895A393740DA36AAD02"><enum>(B)</enum><text display-inline="yes-display-inline">the financial audit manual jointly issued

			 by the Government Accountability Office and the Council on Integrity and

			 Efficiency of the President.</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCB0B435B8CA143D58B6404F20E540E06"><enum>(3)</enum><header>Attestation and

			 report</header><text display-inline="yes-display-inline">In conducting the

			 audit under paragraph (2), the independent external auditor shall attest to,

			 and report on, the assessment of internal controls made by the Secretary under

			 subsection (a)(2)(B).</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idEB83407824B54D85B6CEDA678C8530F1"><enum>(4)</enum><header>Payment for

			 audit and report</header>

						<subparagraph commented="no" display-inline="no-display-inline" id="ID3ff3113406684ab081733d6cca1abc40"><enum>(A)</enum><header>Transfer of

			 funds</header><text display-inline="yes-display-inline">On request of the

			 Comptroller General, the Secretary shall transfer to the Government

			 Accountability Office from funds made available for administrative expenses of

			 the Department of Interior the amount requested by the Comptroller General to

			 pay for an annual audit and report.</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0C6E47AAA43E4D5C8B5C16857B48A0C8"><enum>(B)</enum><header>Credit to

			 account</header>

							<clause commented="no" display-inline="no-display-inline" id="id93272E756EFD44B58AD6033FF5E26A2C"><enum>(i)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Controller

			 General shall credit the amount of any funds transferred under subparagraph (A)

			 to the account established for salaries and expenses of the Government

			 Accountability Office.</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="idC97B137A165140D3A361DDD9908A0CEC"><enum>(ii)</enum><header>Availability</header><text display-inline="yes-display-inline">Any amount credited under clause (i) shall

			 be made available on receipt, without fiscal year limitation, to cover the full

			 costs of the audit and report.</text>

							</clause></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id76FCF51CDFAD4B7291C46E9E231CB3F1" section-type="subsequent-section"><enum>602.</enum><header>Authorization of

			 appropriations</header><text display-inline="no-display-inline">There are

			 authorized to be appropriated such sums as are necessary to carry out this
