		<official-title display="yes">To amend the Higher Education Act of 1965

		  to assist homeless students in obtaining postsecondary education, and for other

		  purposes.</official-title>

		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Improving Access to Education for

			 Students Who Are Homeless or in Foster Care Act</short-title></quote>.</text>

		</section><section commented="no" display-inline="no-display-inline" id="idB3E313AFD4424905AFE60E33E0D60DA6" section-type="subsequent-section"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>

			<paragraph commented="no" display-inline="no-display-inline" id="ID9507457fcce94034a500418a361440ea"><enum>(1)</enum><text display-inline="yes-display-inline">According to a study of foster care

			 children in the State of Washington, a child who enters foster care is likely

			 to have poorer academic outcomes than a child not in foster care, even after

			 controlling for a variety of factors such as poverty.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID753cd1485a2d426b917cdc3c098deb04"><enum>(2)</enum><text display-inline="yes-display-inline">Youth in foster care—</text>

				<subparagraph commented="no" display-inline="no-display-inline" id="idF13BE99390604620A47BFC98FEADD05F"><enum>(A)</enum><text display-inline="yes-display-inline">are less likely to be enrolled in college

			 preparatory classes than non-foster care youth; and</text>

				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id119BD0921E2245D6871BBC5C447BE2E5"><enum>(B)</enum><text display-inline="yes-display-inline">are more than twice as likely as non-foster

			 care youth (37 percent as compared to 16 percent) to have dropped out of

			 secondary school.</text>

				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3a9bff6451124e9d9edac6dfba591e72"><enum>(3)</enum><text display-inline="yes-display-inline">50 percent of foster youth in the United

			 States graduate from secondary school, compared with 85 percent of youth

			 overall.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDfa923ba9a8db4541abc3afc0042628ba"><enum>(4)</enum><text display-inline="yes-display-inline">70 percent of teens in foster care desire

			 to go to college.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDbedd02b75adb40f2a9bd2b65f6df6039"><enum>(5)</enum><text display-inline="yes-display-inline">A report from Casey Family Programs

			 indicated that, nationwide, less than 27 percent of foster youth who graduated

			 from secondary school went on to college, as compared to 52 percent of the

			 general population. Moreover, the college dropout rate among foster youth is

			 far higher than the rate among other students.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDba57cd8f3b8b4b589a036daa57bb6ad4"><enum>(6)</enum><text display-inline="yes-display-inline">A May 2002 report issued by the University

			 of California at Berkeley found that, of more than 3,200 foster care youth who

			 attended a community college from 1992 through 2000—</text>

				<subparagraph commented="no" display-inline="no-display-inline" id="id8F5ADB405AE3458ABFAC87F602991BE2"><enum>(A)</enum><text display-inline="yes-display-inline">39 percent earned between 1 and 17

			 credits;</text>

				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0A1000926CCD4627AFE748114374581C"><enum>(B)</enum><text display-inline="yes-display-inline">40 percent of the foster care youth earned

			 no credits; and</text>

				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDA2623794CA243F8BCDDCE96FD327599"><enum>(C)</enum><text display-inline="yes-display-inline">many of the foster care youth did not

			 attempt to take classes for credit, but rather were enrolled in remedial or

			 other non-credit classes.</text>

				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID17416a8e59c04da0a08cc3873e6640d9"><enum>(7)</enum><text display-inline="yes-display-inline">Unaccompanied youth experiencing

			 homelessness often have left home for their own survival.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd90327ed3aca4de398f83a0d1dea78e1"><enum>(8)</enum><text display-inline="yes-display-inline">Although children and youth who experience

			 homelessness represent the full range of academic talents and abilities,

			 homelessness creates serious barriers to school enrollment, attendance, and

			 success.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd6d5ba5ab1af4412872303b66f7d079d"><enum>(9)</enum><text display-inline="yes-display-inline">The McKinney-Vento Homeless Assistance Act

			 (42 U.S.C. 11301 et seq.) requires State educational agencies and local

			 educational agencies to ensure that homeless children and youth receive a free

			 and appropriate public education, but these provisions do not reach beyond

			 secondary education.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFC9CAD8D5FF74216BD08A69BE1A12A18"><enum>(10)</enum><text display-inline="yes-display-inline">The barriers created by homelessness to

			 kindergarten through grade 12 education (extreme poverty, residential

			 instability, lack of documentation, and lack of awareness of programs and

			 resources) often are also barriers to postsecondary education.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDfe2ccc1733aa4776a795a44ac1073122"><enum>(11)</enum><text display-inline="yes-display-inline">Higher education offers students

			 experiencing homelessness the best hope for escaping poverty and homelessness

			 as adults.</text>

			</paragraph></section><title commented="no" id="id038494E72A4246B4BE25BEAD3614F380" style="OLC"><enum>I</enum><header>Financial assistance for students who are

			 homeless or in foster care</header>

			<section commented="no" display-inline="no-display-inline" id="id9481884BFC1342D5881AA0A9A120B195" section-type="subsequent-section"><enum>101.</enum><header>Need

			 analysis</header>

				<subsection commented="no" display-inline="no-display-inline" id="id19622D10821A422F9C3E63564C69223C"><enum>(a)</enum><header>Special

			 circumstances</header><text display-inline="yes-display-inline">Section 479A(a)

			 of the Higher Education Act of 1965 (20 U.S.C. 1087tt(a)) is amended, in the

			 third sentence, by inserting <quote>a change in housing status that results in

			 homelessness,</quote> before <quote>or other changes</quote>.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="id44E0E3AC77AA40D1B624388DDC7FBC1E"><enum>(b)</enum><header>Independent

			 student</header><text display-inline="yes-display-inline">Section 480(d) of the

			 Higher Education Act of 1965 (20 U.S.C. 1087vv(d)) is amended to read as

			 follows:</text>

					<quoted-block act-name="Higher Education Act of 1965" display-inline="no-display-inline" id="ID5355C52FC7694757B20FFDDE8C1924F7" style="OLC">

						<subsection commented="no" display-inline="no-display-inline" id="ID305C544060CD48DFAF5D1550B84C0825"><enum>(d)</enum><header>Independent

				student</header>

							<paragraph commented="no" display-inline="no-display-inline" id="IDDA722CD0099C4118AB243A0922980F07"><enum>(1)</enum><header>Definition</header><text display-inline="yes-display-inline">The term <term>independent</term>, when

				used with respect to a student, means any individual who—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="ID27C4335A26604D158C62281E8B47B76A"><enum>(A)</enum><text display-inline="yes-display-inline">is 24 years of age or older by December 31

				of the award year;</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDD997696D12FC4FBC8AFC2E395E9C920A"><enum>(B)</enum><text display-inline="yes-display-inline">is an orphan, in foster care, or a ward of

				the court, or was in foster care or a ward of the court until the individual

				reached the age of 18;</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID211A634F61DF4A9A82BE3945DA3D475A"><enum>(C)</enum><text display-inline="yes-display-inline">is an emancipated youth, as defined by the

				student's State of legal residence;</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idBFE9E737C0494811A3DE0355C4754BA4"><enum>(D)</enum><text display-inline="yes-display-inline">is in legal guardianship, as defined in

				section 475 of the <act-name parsable-cite="SSA">Social Security Act</act-name>

				(42 U.S.C. 675);</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID72CADC0D99414E6BBD3DB36CB59D6763"><enum>(E)</enum><text display-inline="yes-display-inline">is a veteran of the Armed Forces of the

				United States (as defined in subsection (c)(1));</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDED0F05B966AB4E668ADB45FAC578A596"><enum>(F)</enum><text display-inline="yes-display-inline">is a graduate or professional

				student;</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID5F4D843E6ACA4B849AAF0949DEF21891"><enum>(G)</enum><text display-inline="yes-display-inline">is a married individual;</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9AC7AAA176DA4B348B5BE8DB3D2F7C8F"><enum>(H)</enum><text display-inline="yes-display-inline">has legal dependents other than a

				spouse;</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7271F33FD8C44BC399B1286F44DEE552"><enum>(I)</enum><text display-inline="yes-display-inline">has been verified as both a homeless child

				or youth and an unaccompanied youth, as such terms are defined in section 725

				of the McKinney-Vento Homeless Assistance Act (42 U.S.C. 11434a), during the

				school year in which the application for financial assistance is submitted,

				by—</text>

									<clause commented="no" display-inline="no-display-inline" id="idEA330167F7DB43AD8B6BA9C6320A530E"><enum>(i)</enum><text display-inline="yes-display-inline">a local educational agency liaison for

				homeless children and youths, as designated under section 722(g)(1)(J)(ii) of

				the McKinney-Vento Homeless Assistance Act (42 U.S.C.

				11432(g)(1)(J)(ii));</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="idCDD72065D8DC423CA470549644C15F6B"><enum>(ii)</enum><text display-inline="yes-display-inline">a director of a homeless shelter,

				transitional shelter, or independent living program; or</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="id6D4D971187B84615A67EE8A03CF5DD7B"><enum>(iii)</enum><text display-inline="yes-display-inline">a financial aid administrator; or</text>

									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID690F11B6E09241A084EE8C8B35687754"><enum>(J)</enum><text display-inline="yes-display-inline">is a student for whom a financial aid

				administrator makes a documented determination of independence by reason of

				other unusual circumstances.</text>

								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4203F82BF42E430F8E709CA31A9FAAB6"><enum>(2)</enum><header>Simplifying the

				dependency override process</header><text display-inline="yes-display-inline">Nothing in this subsection shall be

				construed to prohibit a financial aid administrator from making a determination

				of independence under paragraph (1)(J) based upon a documented determination of

				independence under such paragraph that was previously made by another financial

				aid administrator in the same application

				year.</text>

							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="IDADBDE23AD10C4ED5B6FDB3003CE27996"><enum>(c)</enum><header>Tailoring

			 electronic applications for students with special circumstances</header><text display-inline="yes-display-inline">Section 483(a) of the Higher Education Act

			 of 1965 (20 U.S.C. 1090(a)) is amended by adding at the end the

			 following:</text>

					<quoted-block display-inline="no-display-inline" id="IDF14781C595B0482096FE357EF33D8E97" style="OLC">

						<paragraph commented="no" display-inline="no-display-inline" id="ID2A866D353A5F45BC8FB5A61CD5CCE4C7"><enum>(8)</enum><header>Applications

				for students seeking a documented determination of independence</header><text display-inline="yes-display-inline">In the case of a student seeking a

				documented determination of independence by a financial aid administrator, as

				described in section 480(d)(1)(J), nothing in this section shall prohibit the

				Secretary from—</text>

							<subparagraph commented="no" display-inline="no-display-inline" id="IDEB8990575BAC4E59B779B3AAB5B7E519"><enum>(A)</enum><text display-inline="yes-display-inline">allowing such student to indicate the

				student's special circumstance on the electronic version of a form developed

				under paragraph (5);</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID727D42E45EB64A8B98A44D8864D9897A"><enum>(B)</enum><text display-inline="yes-display-inline">collecting and processing, on a preliminary

				basis, data provided by such student using the electronic version of the form;

				or</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID15CB29B24C7240208844D2EE81B2A40C"><enum>(C)</enum><text display-inline="yes-display-inline">distributing such data to States,

				institutions of higher education, and guaranty agencies for the purposes of

				processing loan applications and determining need and eligibility for

				institutional and State financial aid awards for such student on a preliminary

				basis, pending a documented determination of independence by a financial aid

				administrator.</text>

							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

				</subsection></section></title><title commented="no" id="id732D894DB6E14F2AB0FE9404F2FEE9E0" style="OLC"><enum>II</enum><header>Federal early outreach and student services

			 programs for students who are homeless or in foster care</header>

				<section commented="no" display-inline="no-display-inline" id="id29A299849CEA454FA3968546EE985E5E" section-type="subsequent-section"><enum>211.</enum><header>Definition of

			 homeless children and youths</header><text display-inline="no-display-inline">Section 402A(g) of the Higher Education Act

			 of 1965 (20 U.S.C. 1070a–11(g)) is amended—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="id2DC5C6A337BB484DA37E2FB8F10DE3AD"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (2) and (3) as

			 services</header><text display-inline="no-display-inline">Section 402D of the

			 Higher Education Act of 1965 (20 U.S.C. 1070a–14) is amended—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="idB16856A0B6634B3087E1ECD28C7CCD0E"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(3)—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="idB1E8CA10B02E4EBEA9C535B7E83B91B3"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>students and</quote> and

			 inserting <quote>students,</quote>; and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idBBE656BFF8894C96889F8B47309B000F"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting <quote>, students who are

				aging out of the foster care system;

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA057CFBE8DF64752B1CFD61C3C03465A"><enum>(C)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>

			 gaining early awareness and readiness for undergraduate programs</header><text display-inline="no-display-inline">Section 404B(c)(2) of the Higher Education

			 Act of 1965 (20 U.S.C. 1070a–22(c)(2)) is amended by striking

			 <quote>programs.</quote> and inserting <quote>programs, including programs

			 under subtitle B of title VII of the McKinney-Vento Homeless Assistance Act (42

			 U.S.C. 11431 et seq.).</quote>.</text>

			 the foster care system</quote> before the period.</text>

				</section></subtitle></title><title commented="no" id="id89A9C7FDF8CD49C59E2E3DBE77132583" style="OLC"><enum>III</enum><header>Demonstration projects to increase

			 enrollment and success of highly mobile students in postsecondary

			 education</header>

			<section commented="no" display-inline="no-display-inline" id="IDb6ecbf3f5df9415aa8b47be7304ef626" section-type="subsequent-section"><enum>301.</enum><header>Purpose</header><text display-inline="no-display-inline">It is the purpose of this title to support

			 demonstration projects in order to—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="idBB1CB79A0803494B98B65B3AD48AC0F3"><enum>(1)</enum><text display-inline="yes-display-inline">increase the secondary school graduation

			 rates of highly mobile students;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1E6C821D645D4C388D0AE0EA79D25CDF"><enum>(2)</enum><text display-inline="yes-display-inline">increase the academic success of highly

			 mobile students in secondary school; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id36E2B161DA68402693E5CFF30DACE234"><enum>(3)</enum><text display-inline="yes-display-inline">increase the enrollment and success of

			 highly mobile students in higher education.</text>

				</paragraph></section><section commented="no" display-inline="no-display-inline" id="ID9b3aaca54e2148b3aaa81926a986ea76" section-type="subsequent-section"><enum>302.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>

				<paragraph commented="no" display-inline="no-display-inline" id="idF33EF30C806F4849B48818BB72D7B3D5"><enum>(1)</enum><header>Highly mobile

			 students</header><text display-inline="yes-display-inline">The term

			 <term>highly mobile students</term> means students who are—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="id5BC09F3CCF9B4F8B99C36BC66CBF6F72"><enum>(A)</enum><text display-inline="yes-display-inline">homeless children and youths, as such term

			 is defined in section 725 of the McKinney-Vento Homeless Assistance Act (42

			 U.S.C. 11434a); or</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDc6bd5a4128884e81933dc8c980ce4f72"><enum>(B)</enum><text display-inline="yes-display-inline">wards of the State.</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD8A46B4ADA3E4ED8BD703252D2CE9E2A"><enum>(2)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <quote>Secretary</quote> means the

			 Secretary of Education.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id11C164A5F40A46DE930FA378C00D13C0"><enum>(3)</enum><header>Ward of the

			 state</header><text display-inline="yes-display-inline">The term <term>ward of

			 the State</term> means a child who—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="ID7e4c6766772f43d0b8fa4b2fe629af8c"><enum>(A)</enum><text display-inline="yes-display-inline">is a ward of the State, as determined by

			 the State where the child resides; or</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDbec0b9b0d7724887a3ded97938f349c7"><enum>(B)</enum><text display-inline="yes-display-inline">is in the custody of a public child welfare

			 agency, including situations where the child is residing—</text>

						<clause commented="no" display-inline="no-display-inline" id="IDdc9ca614261e47008c0f83cdcfd3cfa8"><enum>(i)</enum><text display-inline="yes-display-inline">in a foster family home, group home, or

			 other alternative residential setting; or</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="ID34f343440d304e15bc958e6ac43263c6"><enum>(ii)</enum><text display-inline="yes-display-inline">at home under protective

			 supervision.</text>

						</clause></subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="ID140bef5643434fd6bbeed483dc89d4db" section-type="subsequent-section"><enum>303.</enum><header>Grants

			 authorized</header>

				<subsection commented="no" display-inline="no-display-inline" id="IDd3ab4bdfe8864de6b4d66d72918e1ca3"><enum>(a)</enum><header>Competitive

			 grants authorized</header><text display-inline="yes-display-inline">The

			 Secretary may award grants, contracts, and cooperative agreements, on a

			 competitive basis, to—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="IDb3629eafce1d4b3cbfbed6895bcfc597"><enum>(1)</enum><text display-inline="yes-display-inline">partnerships consisting of—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="ID7183c88608264526979113bc123030c1"><enum>(A)</enum><text display-inline="yes-display-inline">a State educational agency;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDa8e58ae12edf4fc19015d78161a1ba10"><enum>(B)</enum><text display-inline="yes-display-inline">a State department serving abused and

			 neglected children;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDe724cc1a7526492289b7365834606f12"><enum>(C)</enum><text display-inline="yes-display-inline">a State department serving runaway,

			 homeless, or at-risk youth;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9983573c5cc84b508e6893b5b9b9adb4"><enum>(D)</enum><text display-inline="yes-display-inline">a State department serving homeless

			 families or youth; and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID90cf4c358a994c43830351d4cffb23e0"><enum>(E)</enum><text display-inline="yes-display-inline">1 or more degree-granting institutions of

			 higher education; and</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDe991085ccdf542acb95c79d3daaabc20"><enum>(2)</enum><text display-inline="yes-display-inline">partnerships consisting of—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="ID45091f25e0a642feb9c2d61bb5bd8047"><enum>(A)</enum><text display-inline="yes-display-inline">1 or more local educational

			 agencies;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDeaad1d41acfc427688aba009ab3b8939"><enum>(B)</enum><text display-inline="yes-display-inline">1 or more degree-granting institutions of

			 higher education;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID8adc3274a70c49ee9d39480cfdb6885c"><enum>(C)</enum><text display-inline="yes-display-inline">a recipient of a grant under subtitle B of

			 title IV of the McKinney-Vento Homeless Assistance Act (42 U.S.C. 11371 et

			 seq.); and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID37e22f925b904dcd9c8ecfe606e5eeb1"><enum>(D)</enum><text display-inline="yes-display-inline">2 or more community organizations or

			 entities, such as businesses, community-based organizations, faith-based

			 organizations, State agencies, or other public or private agencies or

			 organizations.</text>

						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID45503616715245d3a5c6496ab1fe85a8"><enum>(b)</enum><header>Duration</header><text display-inline="yes-display-inline">Grants contracts, and cooperative

			 agreements under this title shall be awarded for a period of not more than 3

			 years.</text>

				</subsection></section><section commented="no" display-inline="no-display-inline" id="ID3b9bafbe5abb4fb3845159b75cac516c" section-type="subsequent-section"><enum>304.</enum><header>Applications</header><text display-inline="no-display-inline">Each partnership desiring to receive a

			 grant, contract, or cooperative agreement under this title shall submit an

			 application to the Secretary at such time, in such manner, and accompanied by

			 such information as the Secretary may require. Each application shall

			 include—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="ID2a82210a1d66409895258849b9aa4323"><enum>(1)</enum><text display-inline="yes-display-inline">a description of how the partnership plans

			 to carry out the activities required under this title;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2d8d52f9ffda4943aa6ae3d4303760d4"><enum>(2)</enum><text display-inline="yes-display-inline">a description of how the partnership will

			 coordinate and collaborate with transportation, education, housing, social

			 services, and child welfare agencies to prevent and reduce school

			 mobility;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID966ad758cb22450482de9667ee53ee90"><enum>(3)</enum><text display-inline="yes-display-inline">an assurance that all State and local

			 educational agency members of the partnership will comply with the applicable

			 grant recipient requirements of subtitle B of title VII of the McKinney-Vento

			 Homeless Assistance Act (42 U.S.C. 11431 et seq.) and section 1113(c)(3)(A) of

			 the Elementary and Secondary Education Act of 1965 (20 U.S.C. 6313(c)(3)(A));

			 and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2c1e3fb7f6144587a21807cc9acb8195"><enum>(4)</enum><text display-inline="yes-display-inline">an assurance that the partnership will

			 demonstrate that, to the maximum extent practicable, the partnership is—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="idD9F8507E964044F1A99C994D664D3441"><enum>(A)</enum><text display-inline="yes-display-inline">utilizing other resources (including

			 Federal, State, and local funds, public transportation, and other community

			 resources) to transport highly mobile students; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8AA03A8DFDCE4AC386CFDB3584EB5997"><enum>(B)</enum><text display-inline="yes-display-inline">collaborating with local housing, social

			 services, and child welfare agencies to minimize the need for such

			 transportation.</text>

					</subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="ID25e3a59a89934a659523f78f5801fcaf" section-type="subsequent-section"><enum>305.</enum><header>Award

			 considerations</header><text display-inline="no-display-inline">In awarding

			 grants, contracts, or cooperative agreements under this title, the Secretary

			 shall consider the following:</text>

				<paragraph commented="no" display-inline="no-display-inline" id="ID71c2125d15694180a5d037eae44872dd"><enum>(1)</enum><text display-inline="yes-display-inline">The number of highly mobile students

			 identified in the area proposed to be served by the partnership.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDe8884f25f60648139dc476001d4c93be"><enum>(2)</enum><text display-inline="yes-display-inline">The extent to which each local educational

			 agency member of the partnership has reserved appropriate funds under section

			 1113(c)(3)(A) of the Elementary and Secondary Education Act of 1965 (20 U.S.C.

			 6313(c)(3)(A)) to serve homeless children.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9aab844f0e494dd5b379bdea87b2be02"><enum>(3)</enum><text display-inline="yes-display-inline">The extent to which the partnership has

			 demonstrated interagency collaboration among transportation, education,

			 housing, social services, and child welfare agencies.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDaed77eee7d3045a48c33d65d4069cd32"><enum>(4)</enum><text display-inline="yes-display-inline">Evidence of past successful operation of

			 programs for highly mobile students.</text>

				</paragraph></section><section commented="no" display-inline="no-display-inline" id="IDb503fa5484f842779a3cb69327af92b0" section-type="subsequent-section"><enum>306.</enum><header>Authorized

			 activities</header><text display-inline="no-display-inline">Grants, contracts,

			 and cooperative agreements under this title shall be used to carry out 1 or

			 more of the following activities:</text>

				<paragraph commented="no" display-inline="no-display-inline" id="ID30881fcf716746aab5e7def2533253f9"><enum>(1)</enum><text display-inline="yes-display-inline">Services designed to assist highly mobile

			 students in the completion of secondary school and in increasing academic

			 success, such as—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="idC74B7829C88048A4A840D970161F2EFC"><enum>(A)</enum><text display-inline="yes-display-inline">after-school and summer tutoring;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id69359222360D43E09A6F123F87070005"><enum>(B)</enum><text display-inline="yes-display-inline">academic counseling;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC061C5FC7B56419BAAEE9D35558179F0"><enum>(C)</enum><text display-inline="yes-display-inline">skills assessment;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD115174E22F547118E474F6EE8E579D7"><enum>(D)</enum><text display-inline="yes-display-inline">mentoring programs; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC4FCB84306CD429D9C79B7201180E9A1"><enum>(E)</enum><text display-inline="yes-display-inline">exposure to cultural events, academic

			 programs, and other activities not usually available to highly mobile

			 students.</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDf4dd69e4809148f9918c9ba3b3975393"><enum>(2)</enum><text display-inline="yes-display-inline">Services designed to assist highly mobile

			 students with matriculation in an institution of higher education, such

			 as—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="idA536CDB38BDC418D8238CEC29EB900CF"><enum>(A)</enum><text display-inline="yes-display-inline">academic advice and assistance in course

			 selection;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id80A3346833C143079D3B5325C2C9FDC6"><enum>(B)</enum><text display-inline="yes-display-inline">assistance in completing college admission

			 and financial aid applications;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA7ADBDDAD4A440B0A3E3F50798D4540A"><enum>(C)</enum><text display-inline="yes-display-inline">assistance in preparing for college

			 entrance examinations;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6039C43E9D6348B28F08025D1F158305"><enum>(D)</enum><text display-inline="yes-display-inline">personal counseling; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDAC0290DBE1549CEA0D99EF72DE279A9"><enum>(E)</enum><text display-inline="yes-display-inline">career workshops and counseling.</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDbf948d6cc483483c81095bca0b718cda"><enum>(3)</enum><text display-inline="yes-display-inline">Services and strategies to prevent and

			 reduce the mobility of highly mobile students, such as—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="IDe70bf7e27d194c43aee9c57d8cddc04c"><enum>(A)</enum><text display-inline="yes-display-inline">defraying the excess cost of transporting

			 highly mobile students to their schools of origin, as required under paragraphs

			 (1)(J)(iii) and (3)(A) of section 722(g) of the McKinney-Vento Homeless

			 Assistance Act (42 U.S.C. 11432(g)(1)(J)(iii) and (3)(A)), except that a grant

			 recipient may not use more than 25 percent of the total grant award received

			 under this title for this use;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID29273ec9c3fb4d88bf33a1ead94a25a2"><enum>(B)</enum><text display-inline="yes-display-inline">interagency coordination of services and

			 policies, including transportation, education, housing, social services, and

			 child welfare agencies;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6452c41aa01a4591b22e7042c547e7e4"><enum>(C)</enum><text display-inline="yes-display-inline">family counseling, home visits, staff

			 development, outreach, and supportive services; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID5b6aad310db34a41be01be55c6ca2581"><enum>(D)</enum><text display-inline="yes-display-inline">evaluation and dissemination of data,

			 information, and promising practices.</text>

					</subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="ID3c248846442847dbb314ad2e9e9d198c" section-type="subsequent-section"><enum>307.</enum><header>Authorization of

			 appropriations</header><text display-inline="no-display-inline">There are

			 authorized to be appropriated to carry out this title $20,000,000 for fiscal

			 year 2006 and such sums as may be necessary for each of the 5 succeeding fiscal

			 years.</text>
