		<official-title display="yes">To maintain the free flow of information to

		  the public by providing conditions for the federally compelled disclosure of

		  information by certain persons connected with the news media. </official-title>

	<legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC">

		<section commented="no" display-inline="no-display-inline" id="idCBA4D939E0294EBAB44A09315D023C3A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Free Flow of Information Act of

			 2005</short-title></quote>.</text>

		</section><section commented="no" display-inline="no-display-inline" id="id23DC651730DD4AA198FB0B0CB112BDED" section-type="subsequent-section"><enum>2.</enum><header>Conditions for

			 compelled disclosure</header>

			<subsection commented="no" display-inline="no-display-inline" id="id59801F0044074166A13BF15275A71B4D"><enum>(a)</enum><header>Conditions for

			 compelled disclosure</header><text display-inline="yes-display-inline">A

			 Federal entity may not compel a covered person to testify or produce any

			 document in any proceeding or in connection with any issue arising under

			 Federal law unless a court determines by clear and convincing evidence, after

			 providing notice and an opportunity to be heard to the covered person—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="idDD0CACD07CC944E0866FE7FAC1F91810"><enum>(1)</enum><text display-inline="yes-display-inline">that the party seeking to compel production

			 of such testimony or document has unsuccessfully attempted to obtain such

			 testimony or document from all persons from which such testimony or document

			 could reasonably be obtained other than a covered person;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB463FCBEB1A04031B7D32D63EF465682"><enum>(2)</enum><text display-inline="yes-display-inline">that—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="id7CEB82ECB52A4D689784FC8843A05684"><enum>(A)</enum><text display-inline="yes-display-inline">in a criminal investigation or prosecution,

			 based on information obtained from a person other than a covered person—</text>

						<clause commented="no" display-inline="no-display-inline" id="id05E3C1F25E90480B90860D6FDB234B7F"><enum>(i)</enum><text display-inline="yes-display-inline">there are reasonable grounds to believe

			 that a crime has occurred; and</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="id2FC6B32974C145BD912803D377A49F11"><enum>(ii)</enum><text display-inline="yes-display-inline">the testimony or document sought is

			 essential to the investigation, prosecution, or defense; or</text>

						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id42B0B9529BF045B191271F1DD585892B"><enum>(B)</enum><text display-inline="yes-display-inline">in a matter other than a criminal

			 investigation or prosecution, based on information obtained from a person other

			 than a covered person, the testimony or document sought is essential to a

			 dispositive issue of substantial importance to that matter; and</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC8D57815C3AA45CF97A1B78BF7914D90"><enum>(3)</enum><text display-inline="yes-display-inline">in any matter in which the testimony or

			 document sought could reveal the identity of a source of information or include

			 any information that could reasonably be expected to lead to the discovery of

			 the identity of such a source, that—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="id7848C546C8384BF489C1E3168F42D1C0"><enum>(A)</enum><text display-inline="yes-display-inline">disclosure of the identity of such a source

			 is necessary to prevent imminent and actual harm to national security;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5EF83753FE314E2A8C1114068BFAFBDB"><enum>(B)</enum><text display-inline="yes-display-inline">compelled disclosure of the identity of

			 such a source would prevent such harm; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB80F4A98B6F04FBEBD2352A0B2985741"><enum>(C)</enum><text display-inline="yes-display-inline">the harm sought to be redressed by

			 requiring disclosure clearly outweighs the public interest in protecting the

			 free flow of information.</text>

					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idFDB5C52F1F0B42FA803FB7A21C843859"><enum>(b)</enum><header>Limitations on

			 content of information</header><text display-inline="yes-display-inline">The

			 content of any testimony or document that is compelled under subsection (a)

			 shall, to the extent possible—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="id4EB1962F555C4E1F80BBF5BCDB65064B"><enum>(1)</enum><text display-inline="yes-display-inline">be limited to the purpose of verifying

			 published information or describing any surrounding circumstances relevant to

			 the accuracy of such published information; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9E2AA1CDF06E455F80D8037CA68B1BA2"><enum>(2)</enum><text display-inline="yes-display-inline">be narrowly tailored in subject matter and

			 period of time covered.</text>

				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id00AFDB1146484309B2ABC298EB67E7CB" section-type="subsequent-section"><enum>3.</enum><header>Compelled disclosure

			 permitted</header>

			<subsection commented="no" display-inline="no-display-inline" id="id61C88E2D65B5467DAEF85EB017522CEC"><enum></enum><text display-inline="yes-display-inline">Notwithstanding any provision of section 2,

			 in any proceeding or in connection with any issue arising under Federal law, a

			 Federal entity may compel a covered person to produce any testimony or document

			 that consists only of commercial or financial information that is not related

			 to news gathering or the dissemination of news and information by the covered

			 person.</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="idBDF982FACD9141869297102AD1BDC4E7" section-type="subsequent-section"><enum>4.</enum><header>Compelled disclosure

			 from third parties</header>

			<subsection commented="no" display-inline="no-display-inline" id="id60B2E0653B7F4F16856BC1C6B09F2C35"><enum>(a)</enum><header>Conditions for

			 compelled disclosure</header><text display-inline="yes-display-inline">Section

			 2 shall apply to any testimony or document that a third party or a Federal

			 entity seeks from a communications service provider if such testimony or

			 document consists of any record, information, or other communication that

			 relates to a business transaction between a communications service provider and

			 a covered person.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="id3A7467E398F042988D37E24D11394555"><enum>(b)</enum><header>Notice and

			 opportunity provided to covered persons</header><text display-inline="yes-display-inline">A court may compel the testimony or

			 disclosure of a document under this section only after the party seeking such a

			 document provides the covered person who is a party to the business transaction

			 described in subsection (a)—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="id20A14E9617F046498002082338D8923F"><enum>(1)</enum><text display-inline="yes-display-inline">notice of the subpoena or other compulsory

			 request for such testimony or disclosure from the communications service

			 provider not later than the time at which such subpoena or request is issued to

			 the communications service provider; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3F61A72F61B044E5B463F89B947AF789"><enum>(2)</enum><text display-inline="yes-display-inline">an opportunity to be heard before the court

			 before the time at which the testimony or disclosure is compelled.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id0EDDF51827AB4DE08FCE286C87463C77"><enum>(c)</enum><header>Exception to

			 notice requirement</header><text display-inline="yes-display-inline">Notice

			 under subsection (b)(1) may be delayed only if the court determines by clear

			 and convincing evidence that such notice would pose a substantial threat to the

			 integrity of a criminal investigation.</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="idB9DF9E0FC3304FC7A83F5870925670B7" section-type="subsequent-section"><enum>5.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>

			<paragraph commented="no" display-inline="no-display-inline" id="idC05D4834D5B04F42BB3B4C8E0B8B2A2A"><enum>(1)</enum><header>Communications

			 service provider</header><text display-inline="yes-display-inline">The term

			 <term>communications service provider</term>—</text>

				<subparagraph commented="no" display-inline="no-display-inline" id="idCA4C97142B89413BA9F5A8554373BFDB"><enum>(A)</enum><text display-inline="yes-display-inline">means any person that transmits information

			 of the customer's choosing by electronic means; and</text>

				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id19CC0DD8B618416EBFEBA8944232E7CA"><enum>(B)</enum><text display-inline="yes-display-inline">includes a telecommunications carrier, an

			 information service provider, an interactive computer service provider, and an

			 information content provider (as such terms are defined in the sections 3 and

			 230 of the Communications Act of 1934 (47 U.S.C. 153, 230)).</text>

				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id33029357A868433BAEBBB0BC06AB957C"><enum>(2)</enum><header>Covered

			 person</header><text display-inline="yes-display-inline">The term <term>covered

			 person</term> means—</text>

				<subparagraph commented="no" display-inline="no-display-inline" id="idC76A023BCC4541D69B454B795FB77882"><enum>(A)</enum><text display-inline="yes-display-inline">an entity that disseminates information by

			 print, broadcast, cable, satellite, mechanical, photographic, electronic, or

			 other means and that—</text>

					<clause commented="no" display-inline="no-display-inline" id="id16E0D1F697E942C5A34EA2D919FE5333"><enum>(i)</enum><text display-inline="yes-display-inline">publishes a newspaper, book, magazine, or

			 other periodical in print or electronic form;</text>

					</clause><clause commented="no" display-inline="no-display-inline" id="id66CFB5D198054893AC3A6416D09403DD"><enum>(ii)</enum><text display-inline="yes-display-inline">operates a radio or television broadcast

			 station (or network of such stations), cable system, or satellite carrier, or a

			 channel or programming service for any such station, network, system, or

			 carrier; or</text>

					</clause><clause commented="no" display-inline="no-display-inline" id="idED88F5BF93104CC89C7F34A5EAEF116E"><enum>(iii)</enum><text display-inline="yes-display-inline">operates a news agency or wire

			 service;</text>

					</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idCBD2200A268F4AD5AE3592674B6A9962"><enum>(B)</enum><text display-inline="yes-display-inline">a parent, subsidiary, or affiliate of such

			 an entity to the extent that such parent, subsidiary, or affiliate is engaged

			 in news gathering or the dissemination of news and information; or</text>

				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDCE9C49EDBA84A68ADC1C679C4E02339"><enum>(C)</enum><text display-inline="yes-display-inline">an employee, contractor, or other person

			 who gathers, edits, photographs, records, prepares, or disseminates news or

			 information for such an entity.</text>

				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3F05072BC71A4610817E85119C3FA103"><enum>(3)</enum><header>Document</header><text display-inline="yes-display-inline">The term <term>document</term> means

			 writings, recordings, and photographs, as those terms are defined by Federal

			 Rule of Evidence 1001 (28 U.S.C. App.).</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA1ECED30871A4A4D8FCDD56047E23B5E"><enum>(4)</enum><header>Federal

			 entity</header><text display-inline="yes-display-inline">The term <term>Federal

			 entity</term> means an entity or employee of the judicial or executive branch

			 or an administrative agency of the Federal Government with the power to issue a

			 subpoena or provide other compulsory process.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id731325E7EE734025A54F1B245F2F4976"><enum>(5)</enum><header>Third

			 party</header><text display-inline="yes-display-inline">The term <term>third

			 party</term> means a person other than a covered person.</text>
