		<section commented="no" display-inline="no-display-inline" id="idEEFB41F4303A49D9B84C05051146A885" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Preserving Patient Access to Inpatient

			 Rehabilitation Hospitals Act of 2005</short-title></quote>.</text>

		</section><section commented="no" display-inline="no-display-inline" id="ID61f232f079104408b817fcb3131bfca3" section-type="subsequent-section"><enum>2.</enum><header>Effect on enforcement

			 of regulations</header>

			<subsection commented="no" display-inline="no-display-inline" id="idF4A805BF886D49CE9725DE28F96D65CA"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Notwithstanding

			 section 412.23(b)(2) of title 42, Code of Federal Regulations, during the

			 period beginning on July 1, 2005, and ending on the date that is 2 years after

			 the date of enactment of this Act, the Secretary of Health and Human Services

			 (referred to in this Act as the <quote>Secretary</quote>) shall not—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="IDb8808146df494b5286b8aceff5a139e2"><enum>(1)</enum><text display-inline="yes-display-inline">require a compliance rate, pursuant to the

			 criterion (commonly known as the <quote>75 percent rule</quote>) that is used

			 to determine whether a hospital or unit of a hospital is an inpatient

			 rehabilitation facility (as defined in the rule published in the Federal

			 Register on May 7, 2004, entitled <quote>Medicare Program; Final Rule; Changes

			 to the Criteria for Being Classified as an Inpatient Rehabilitation

			 Facility</quote> (69 Fed. Reg. 25752)), that is greater than the 50 percent

			 compliance threshold that became effective on July 1, 2004;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDc81432d3412b4e97af8a3ffc2416727f"><enum>(2)</enum><text display-inline="yes-display-inline">change the designation of an inpatient

			 rehabilitation facility in compliance with the 50 percent threshold; or</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5bfc8903b98045f8a609b5315656a887"><enum>(3)</enum><text display-inline="yes-display-inline">conduct medical necessity review of

			 inpatient rehabilitation facilities using any guidelines, such as fiscal

			 intermediary Local Coverage Determinations, other than the national criteria

			 established in chapter 1, section 110 of the Medicare Benefits Policy

			 Manual.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idBE9CD81124204A68A0F8780C62F283C1"><enum>(b)</enum><header>Retroactive

			 status as an inpatient rehabilitation facility; payments; expedited

			 review</header><text display-inline="yes-display-inline">The Secretary shall

			 establish procedures for—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="idA723BFF72EAD4C0EB89CC401EC16AFDB"><enum>(1)</enum><text display-inline="yes-display-inline">making any necessary retroactive adjustment

			 to restore the status of a facility as an inpatient rehabilitation facility as

			 a result of subsection (a);</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDD9DCED35EF24FE182C3A95F51828A18"><enum>(2)</enum><text display-inline="yes-display-inline">making any necessary payments to inpatient

			 rehabilitation facilities based on such adjustment for discharges occurring on

			 or after July 1, 2005, and before the date of enactment of this Act; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id441343CE52F24B58ACCE8E21F5E74BAF"><enum>(3)</enum><text display-inline="yes-display-inline">developing and implementing an appeals

			 process that provides for expedited review of any adjustment to the status of a

			 facility as an inpatient rehabilitation facility made during the period

			 beginning on July 1, 2005, and ending on the date that is 2 years after the

			 date of enactment of this Act.</text>

				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID46d4acf2380448ce9c1919200f52a4da" section-type="subsequent-section"><enum>3.</enum><header>National advisory

			 council on medical rehabilitation</header>

			<subsection commented="no" display-inline="no-display-inline" id="IDca2f31cb70394642a62e5d0dc125290b"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>

				<paragraph commented="no" display-inline="no-display-inline" id="id46894FF891B34A0AB7E8A3868B7DC977"><enum>(1)</enum><header>Advisory

			 Council</header><text display-inline="yes-display-inline">The term

			 <quote>Advisory Council</quote> means the National Advisory Council on Medical

			 Rehabilitation established under subsection (b).</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id026A70797456493EA17FD7D524EB2ED1"><enum>(2)</enum><header>Appropriate

			 Federal agencies</header><text display-inline="yes-display-inline">The term

			 <quote>appropriate Federal agencies</quote> means—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="id2222CF41BB1D43E79BCA7CB5AC534C4D"><enum>(A)</enum><text display-inline="yes-display-inline">the Agency for Healthcare Research and

			 Quality;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id673AFBB2CC4C4950A0759E9A42571A0F"><enum>(B)</enum><text display-inline="yes-display-inline">the Centers for Medicare &amp; Medicaid

			 Services;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0E43FD3A19FF4B17BD456A87324FE637"><enum>(C)</enum><text display-inline="yes-display-inline">the National Institute on Disability and

			 Rehabilitation Research; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id53C43F2621BD4881A2444538C7631092"><enum>(D)</enum><text display-inline="yes-display-inline">the National Center for Medical

			 Rehabilitation Research.</text>

					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id469821337F0C490DBFCEA7F84C1563EC"><enum>(b)</enum><header>Establishment</header><text display-inline="yes-display-inline">Pursuant to section 222 of the Public

			 Health Service Act (42 U.S.C. 217a), the Secretary shall establish an advisory

			 panel to be known as the <quote>National Advisory Council on Medical

			 Rehabilitation</quote>.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDfe37ab0085144752b5d0f63091fd27e5"><enum>(c)</enum><header>Membership</header>

				<paragraph commented="no" display-inline="no-display-inline" id="idFB3AF7C7AB4F418EAF0CBCB8920F7E2C"><enum>(1)</enum><header>Appointment</header><text display-inline="yes-display-inline">The Advisory Council shall be composed of

			 17 members, of whom—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="ID055a6fc16f3040f7937c43484ff757ba"><enum>(A)</enum><text display-inline="yes-display-inline">9 members shall be appointed by the

			 Secretary, in consultation with the medical rehabilitation community, from a

			 diversity of backgrounds, including—</text>

						<clause commented="no" display-inline="no-display-inline" id="id2FD6E5ADCF1C43638C11F002B9125A15"><enum>(i)</enum><text display-inline="yes-display-inline">physicians;</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="idE806BC6F7E32451297F95BDD10A7EF59"><enum>(ii)</enum><text display-inline="yes-display-inline">medicare beneficiaries;</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="idA6F6A2022F9344FA85EFAEF66A4FFDC1"><enum>(iii)</enum><text display-inline="yes-display-inline">representatives of inpatient rehabilitation

			 facilities; and</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="id938AB1AFD6264F05A549E41DFDE1EE62"><enum>(iv)</enum><text display-inline="yes-display-inline">other practitioners experienced in

			 rehabilitative care; and</text>

						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID2baa12001db94fbfbcde1decdb438479"><enum>(B)</enum><text display-inline="yes-display-inline">8 members, not more than 4 of whom are

			 members of the same political party, shall be appointed jointly by—</text>

						<clause commented="no" display-inline="no-display-inline" id="id324B5DF7197146AEB216420D73292C10"><enum>(i)</enum><text display-inline="yes-display-inline">the majority leader of the Senate;</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="id483125848AFB4C7ABBB0881CA01581B2"><enum>(ii)</enum><text display-inline="yes-display-inline">the minority leader of the Senate;</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="id6675688A89C045C2BD6CA2F8E216270E"><enum>(iii)</enum><text display-inline="yes-display-inline">the Speaker of the House of

			 Representatives;</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="id7CE57A2B561945AA84F8A97A0AF70B02"><enum>(iv)</enum><text display-inline="yes-display-inline">the minority leader of the House of

			 Representatives;</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="id853BC126C44448A7946C80CB87FA1EA2"><enum>(v)</enum><text display-inline="yes-display-inline">the Chairman and the Ranking Member of the

			 Committee on Finance of the Senate; and</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="id6479AD0106374E8388C85BF547A8B272"><enum>(vi)</enum><text display-inline="yes-display-inline">the Chairman and the Ranking Member of the

			 Committee on Ways and Means of the House of Representatives.</text>

						</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDc18be306b2ab4335bea96d6822cc9b0f"><enum>(2)</enum><header>Date</header><text display-inline="yes-display-inline">Members of the Advisory Council shall be

			 appointed not later than 30 days after the date of enactment of this

			 Act.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8090CDEFE1FB42D28AC86D74B9EF9A0E"><enum>(3)</enum><header>Period of

			 appointment; Vacancies</header><text display-inline="yes-display-inline">Members shall be appointed for the life of

			 the Council. A vacancy on the Advisory Council shall be filled not later than

			 30 days after the date on which the Advisory Council is given notice of the

			 vacancy, in the same manner as the original appointment.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id658A07ED15DF4D67BC3979DFEB08FA44"><enum>(4)</enum><header>Meetings</header>

					<subparagraph commented="no" display-inline="no-display-inline" id="id06AED22A690C4BD988B982ED3F831F40"><enum>(A)</enum><header>Initial

			 meeting</header><text display-inline="yes-display-inline">The Advisory Council

			 shall conduct an initial meeting not later than 120 days after the date of

			 enactment of this Act.</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB7E2D871D21F4EAAB7B82028D3A78018"><enum>(B)</enum><header>Meetings</header><text display-inline="yes-display-inline">The Advisory Council shall conduct such

			 meetings as the Council determines to be necessary to carry out its duties but

			 shall meet not less frequently than 2 times during each calendar year.</text>

					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID3c251b7a1be647409e9a0e7ac7f21b1d"><enum>(d)</enum><header>Duties</header><text display-inline="yes-display-inline">The duties of the Advisory Council shall

			 include the following:</text>

				<paragraph commented="no" display-inline="no-display-inline" id="idF18F1B22A9DE42E988D3916860CCA5C3"><enum>(1)</enum><header>Advice and

			 recommendations</header><text display-inline="yes-display-inline">Providing

			 advice and recommendations to—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="id666C7F1832144CACA3201EAD6426F55B"><enum>(A)</enum><text display-inline="yes-display-inline">Congress and the Secretary concerning the

			 coverage of rehabilitation services under the medicare program,

			 including—</text>

						<clause commented="no" display-inline="no-display-inline" id="ID28208f2bb4e6445ab0345078f02bd7d7"><enum>(i)</enum><text display-inline="yes-display-inline">policy issues related to rehabilitative

			 treatment and reimbursement for rehabilitative care, such as issues relating to

			 any rulemaking relating to, or impacting, rehabilitation hospitals and

			 units;</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="IDcc3f7e1dbbb64b89ba9d8da4834e5fcb"><enum>(ii)</enum><text display-inline="yes-display-inline">the appropriate criteria for—</text>

							<subclause commented="no" display-inline="no-display-inline" id="id977048A0EA5A42E4931F04E1FBDBF4BE"><enum>(I)</enum><text display-inline="yes-display-inline">determining clinical appropriateness of

			 inpatient rehabilitation facility admissions; and</text>

							</subclause><subclause commented="no" display-inline="no-display-inline" id="ID03b6517f3ab44c6d8e1852e6d50515d0"><enum>(II)</enum><text display-inline="yes-display-inline">distinguishing an inpatient rehabilitation

			 facility from an acute care hospital and other providers of intensive medical

			 rehabilitation;</text>

							</subclause></clause><clause commented="no" display-inline="no-display-inline" id="ID143a5823f7374145b8fc442a39ce88f4"><enum>(iii)</enum><text display-inline="yes-display-inline">the efficacy of inpatient rehabilitation

			 services, as opposed to other post-acute inpatient settings, through a

			 comparison of quality and cost, controlling for patient characteristics (such

			 as medical severity and motor and cognitive function) and discharge

			 destination;</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="ID18d82e0d695043a8a976d841ac4c66e9"><enum>(iv)</enum><text display-inline="yes-display-inline">the effect of any medicare regulations on

			 access to inpatient rehabilitation care by medicare beneficiaries and the

			 clinical effectiveness of care available to such beneficiaries in other health

			 care settings; and</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="idC387180138BF4955B58A83293406E731"><enum>(v)</enum><text display-inline="yes-display-inline">any other topic or issue that the Secretary

			 or Congress requests the Advisory Council to provide advice and recommendations

			 on; and</text>

						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDd2301ac4f37545f89e6eb6f429b8d3b6"><enum>(B)</enum><text display-inline="yes-display-inline">appropriate Federal agencies (as defined in

			 subsection (a)(3)) on how to best utilize available research funds and

			 authorities focused on medical rehabilitation research, including post-acute

			 care site of service and outcomes research.</text>

					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID6649a72fcb0f439db6a0c95b19b51fe7"><enum>(e)</enum><header>Periodic

			 reports</header><text display-inline="yes-display-inline">The Advisory Council

			 shall provide the Secretary with periodic reports that summarize—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="id6DEDEF2CA4E243B7A8937A12A4EFAE8B"><enum>(1)</enum><text display-inline="yes-display-inline">the Council’s activities; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idBD644A62DAF74381A322A2A990A04067"><enum>(2)</enum><text display-inline="yes-display-inline">any recommendations for legislation or

			 administrative action the Council considers to be appropriate.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID2b56e4cf48ef4db69a2c4797c7a8fcc4"><enum>(f)</enum><header>Termination</header><text display-inline="yes-display-inline">The Advisory Council shall terminate on

			 September 30, 2010.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID3b7299416f6b499b81383fd4b8c434db"><enum>(g)</enum><header>Authorization

			 of appropriations</header><text display-inline="yes-display-inline">There are

			 authorized to be appropriated such sums as may be necessary to carry out the

			 purposes of this section.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="id315CEA32333740C1B4F3985C862764CA"><enum>(h)</enum><header>Effective

			 date</header><text display-inline="yes-display-inline">This section shall take

			 effect on the date of enactment of this Act.</text>

			</subsection></section></legis-body>
