section-type="subsequent-section"><enum>101.<?LEXA-Enum 101.?></enum><header>Technical assistance for rural and small treatment works</header> <subsection commented="no" display-inline="no-display-inline" id="IDb22669bf08014de19c8e671b86ae9a57"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Title II of the Federal Water Pollution Control Act (33 U.S.C. 1281 et seq.) is amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id0733323FB00C488AAB1C2A0498248C07" style="OLC"> <section commented="no" display-inline="no-display-inline" id="ID8641782db93a4b0f9282d0dcf3cd2d03" section-type="subsequent-section"><enum>222.</enum><header>Technical assistance for rural and small treatment works</header> <subsection commented="no" display-inline="no-display-inline" id="ID6b0e3ae7b3124660913861453aaa963b"><enum>(a)</enum><header>Definition of qualified nonprofit technical assistance provider</header><text display-inline="yes-display-inline">In this section, the term <term>qualified nonprofit technical assistance provider</term> means a qualified nonprofit technical assistance provider of water and wastewater services to small rural communities that provide technical assistance to treatment works (including circuit rider programs and training and preliminary engineering evaluations) that—</text> <paragraph commented="no" display-inline="no-display-inline" id="IDcec5b219ed3e4a058a2892e424d8c6fc"><enum>(1)</enum><text display-inline="yes-display-inline">serve not more than 10,000 users; and</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID54e56aa5db50435eaf1c86732ee4e1f4"><enum>(2)</enum><text display-inline="yes-display-inline">may include a State agency.</text> </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID2b046e96b57547459534a9f46ae5a504"><enum>(b)</enum><header>Grant program</header> <paragraph commented="no" display-inline="no-display-inline" id="ID7c12f2299d9240769c322cb55e538024"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator may make grants to qualified nonprofit technical assistance providers that are qualified to provide assistance on a broad range of wastewater and stormwater approaches—</text> <subparagraph commented="no" display-inline="no-display-inline" id="IDe5730ed1c53c4bdf8f9a17e506c7a88e"><enum>(A)</enum><text display-inline="yes-display-inline">to assist small treatment works to plan, develop, and obtain financing for eligible projects described in section 603(c);</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID46113ab12c364df3861ac3fd35962d70"><enum>(B)</enum><text display-inline="yes-display-inline">to capitalize revolving loan funds to provide loans, in consultation with the State in which the assistance is provided, to rural and small municipalities for predevelopment costs (including costs for planning, design, associated preconstruction, and necessary activities for siting the facility and related elements) associated with wastewater infrastructure projects or short-term costs incurred for equipment replacement that is not part of regular operation and maintenance activities for existing wastewater systems, if—</text> <clause commented="no" display-inline="no-display-inline" id="IDc9be382f53624333b4afea740cebee39"><enum>(i)</enum><text display-inline="yes-display-inline">any loan from the fund is made at or below the market interest rate, for a term not to exceed 10 years;</text> </clause><clause commented="no" display-inline="no-display-inline" id="ID4b98e4abda3747b9a0bf385d6fb1fae3"><enum>(ii)</enum><text display-inline="yes-display-inline">the amount of any single loan does not exceed $100,000; and</text> </clause><clause commented="no" display-inline="no-display-inline" id="ID1606e47e18ee4aa59cb7828bfe0d2ebd"><enum>(iii)</enum><text display-inline="yes-display-inline">all loan repayments are credited to the fund;</text> </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDf91cdd936de44ac2a6adbb79b477bf0f"><enum>(C)</enum><text display-inline="yes-display-inline">to provide technical assistance and training for rural and small publicly owned treatment works and decentralized wastewater treatment systems to enable those treatment works and systems to protect water quality and achieve and maintain compliance with this Act; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID8474cc2813914ba29de48e77374a36fd"><enum>(D)</enum><text display-inline="yes-display-inline">to disseminate information to rural and small municipalities with respect to planning, design, construction, and operation of publicly owned treatment works and decentralized wastewater treatment systems.</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDe89d81417aa6412f9a76e9e8437a8848"><enum>(2)</enum><header>Distribution of grant</header><text display-inline="yes-display-inline">In carrying out this subsection, the Administrator shall ensure, to the maximum extent practicable, that technical assistance provided using funds from a grant under paragraph (1) is made available in each State.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID214ec5ed41bf49efa1041695d079b328"><enum>(3)</enum><header>Consultation</header><text display-inline="yes-display-inline">As a condition of receiving a grant under this subsection, a qualified nonprofit technical assistance provider shall consult with each State in which grant funds are to be expended or otherwise made available before the grant funds are expended or made available in the State.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1ef4d2d52912462689cff0f2a6b4dcec"><enum>(4)</enum><header>Annual report</header><text display-inline="yes-display-inline">For each fiscal year, a qualified nonprofit technical assistance provider that receives a grant under this subsection shall submit to the Administrator a report that—</text> <subparagraph commented="no" display-inline="no-display-inline" id="ID2343e08d5dd946e79f78aa782bc00ee2"><enum>(A)</enum><text display-inline="yes-display-inline">describes the activities of the qualified nonprofit technical assistance provider using grant funds received under this subsection for the fiscal year; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID8b04711825514d999107b197c8ad4c01"><enum>(B)</enum><text display-inline="yes-display-inline">specifies—</text> <clause commented="no" display-inline="no-display-inline" id="IDb20af5e6a5a3498bb26840c8902408b1"><enum>(i)</enum><text display-inline="yes-display-inline">the number of communities served;</text> </clause><clause commented="no" display-inline="no-display-inline" id="IDb9b6302a92254edfb217e9433eed5b4f"><enum>(ii)</enum><text display-inline="yes-display-inline">the sizes of those communities; and</text> </clause><clause commented="no" display-inline="no-display-inline" id="IDa20a3fa412884d1dac83fcac94e06c59"><enum>(iii)</enum><text display-inline="yes-display-inline">the type of financing provided by the qualified nonprofit technical assistance provider.</text> </clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDc98eae1d36de4eac8037a9b244f7c57e"><enum>(c)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out this section $25,000,000 for each of fiscal years 2006 through 2010.</text> </subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection><subsection commented="no" display-inline="no-display-inline" id="IDdff859b5f5934af3938f68495e2adbc0"><enum>(b)</enum><header>Guidance for small systems</header><text display-inline="yes-display-inline">Section 602 of the Federal Water Pollution Control Act (33 U.S.C. 1382) is amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id7670EBC1469B46FE8C569D06B35F1F6B" style="OLC"> <subsection commented="no" display-inline="no-display-inline" id="ID92c8c13391544fa39283689c90aa5d0f"><enum>(c)</enum><header>Guidance for small systems</header> <paragraph commented="no" display-inline="no-display-inline" id="id0B3E0993B14440BAA231A01E514A5ECE"><enum>(1)</enum><header>Definition of small system</header><text display-inline="yes-display-inline">In this subsection, the term <term>small system</term> means a system—</text> <subparagraph commented="no" display-inline="no-display-inline" id="idB072FC4616674ADE8B5E8818B16CD1E1"><enum>(A)</enum><text display-inline="yes-display-inline">for which a municipality or intermunicipal, interstate, or State agency seeks assistance under this title; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD364C03F585D4FC7AA8F72C0D8787566"><enum>(B)</enum><text display-inline="yes-display-inline">that serves a population of 10,000 or fewer households.</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID609fdb724b984ea680dff11f25ba9760"><enum>(2)</enum><header>Simplified procedures</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this subsection, the Administrator shall assist the States in establishing simplified procedures for small systems to obtain assistance under this title.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3d0160f5e3104f32bb036ca594cbc868"><enum>(3)</enum><header>Publication of manual</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this subsection, after providing notice and opportunity for public comment, the Administrator shall publish—</text> <subparagraph commented="no" display-inline="no-display-inline" id="ID92cc5f11089f48589b0afe7b93bb9172"><enum>(A)</enum><text display-inline="yes-display-inline">a manual to assist small systems in obtaining assistance under this title; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDe2f8eef2f94b4820836ebf9cb2d5d10c"><enum>(B)</enum><text display-inline="yes-display-inline">in the Federal Register, notice of the availability of the manual.</text> </subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection></section><section commented="no" display-inline="no-display-inline" id="IDF1E4035588114E6C9112FA1409931B95" section-type="subsequent-section"><enum>102.</enum><header>Projects eligible for assistance</header><text display-inline="no-display-inline">Section 603 of the <act-name parsable-cite="FWPCA">Federal Water Pollution Control Act</act-name> (33 U.S.C. 1383) is amended by striking subsection (c) and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="idFD77018E8C2044688CF10BB5CD8FA3EA" style="OLC"> <subsection commented="no" display-inline="no-display-inline" id="ID4E2F5E02D1DC47BF9B659BEFB6F2EA15"><enum>(c)</enum><header>Projects eligible for assistance</header><text display-inline="yes-display-inline">Funds in each State water pollution control revolving fund shall be used only for—</text> <paragraph commented="no" display-inline="no-display-inline" id="idA72CE402D7F043F0AF2679DA1F908163"><enum>(1)</enum><text display-inline="yes-display-inline">providing financial assistance to any municipality or an intermunicipal, interstate, or State agency that principally treats municipal wastewater or domestic sewage for construction (including planning, design, associated preconstruction, and activities relating to the siting of a facility) of a treatment works (as defined in section 212);</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE2CFC703F94249428576998346D44D5C"><enum>(2)</enum><text display-inline="yes-display-inline">implementation of a management program established under section 319;</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID480B15595E384E43A7F03EFD67F92804"><enum>(3)</enum><text display-inline="yes-display-inline">development and implementation of a conservation and management plan under section 320;</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC2E3D7B29D744634A4EDDB0B79C5F279"><enum>(4)</enum><text display-inline="yes-display-inline">providing financial assistance to a municipality or an intermunicipal, interstate, or State agency for projects to increase the security of wastewater treatment works (excluding any expenditure for operations or maintenance);</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC2730F779E7D42D9A603F4C37507D40D"><enum>(5)</enum><text display-inline="yes-display-inline">providing financial assistance to a municipality or an intermunicipal, interstate, or State agency for measures to control municipal stormwater, the primary purpose of which is the preservation, protection, or enhancement of water quality;</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID033e9669af1d41e7bcf200dd3d509ae9"><enum>(6)</enum><text display-inline="yes-display-inline">water conservation projects, the primary purpose of which is the protection, preservation, and enhancement of water quality; or</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0899bd4cda4d4d02ba0d34eab4cf460b"><enum>(7)</enum><text display-inline="yes-display-inline">reuse, reclamation, and recycling projects, the primary purpose of which is the protection, preservation, and enhancement of water quality.</text> </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </section><section commented="no" display-inline="no-display-inline" id="ID512DD8801B61406B8E05FED81AEA834F" section-type="subsequent-section"><enum>103.</enum><header>Water pollution control revolving loan funds</header><text display-inline="no-display-inline">Section 603(d) of the <act-name parsable-cite="FWPCA">Federal Water Pollution Control Act</act-name> (33 U.S.C. 1383(d)) is amended—</text> <paragraph commented="no" display-inline="no-display-inline" id="IDCA9DB878DB1F43B3BA09B353C37AD8B2"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (6), by striking <quote>and</quote> at the end;</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3D7422E7CB314E6EBC7477FC2A62B566"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (7), by striking the period at the end and inserting <quote>; and</quote>; and</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID54F006041DD843F8B76BFEFA2F993034"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="IDE845E55B3E9F40618718ADE534990829" style="OLC"> <paragraph commented="no" display-inline="no-display-inline" id="ID6692F4E346C04C99B9A41F501ADAE0AD"><enum>(8)</enum><text display-inline="yes-display-inline">to carry out a project under paragraph (2) or (3) of section 601(a), which may be—</text> <subparagraph commented="no" display-inline="no-display-inline" id="ID1D376AE2751D40BB9F204BC876782FEF"><enum>(A)</enum><text display-inline="yes-display-inline">operated by a municipal, intermunicipal, or interstate entity, State, public or private utility, corporation, partnership, association, or nonprofit agency; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDCD6495FAFAB64431949530656A35EF3F"><enum>(B)</enum><text display-inline="yes-display-inline">used to make loans that will be fully amortized not later than 30 years after the date of the completion of the project.</text> </subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section><section commented="no" display-inline="no-display-inline" id="ID0139455620E548BDA6F83EB6251ABAF2" section-type="subsequent-section"><enum>104.</enum><header>Affordability</header> <subsection commented="no" display-inline="no-display-inline" id="ID4E548B7CD401424B9DA3D9CA5FE8713B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 603 of the <act-name parsable-cite="FWPCA">Federal Water Pollution Control Act</act-name> (33 U.S.C. 1383) is amended—</text> <paragraph commented="no" display-inline="no-display-inline" id="ID0BB8872902EC42F3B2F2AFD5DE0D9634"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsections (e) through (h) as subsections (f) through (i), respectively; and</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD64DC28E7FBD4C0AA31AF5F6EF09A745"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after subsection (d) the following:</text> <quoted-block display-inline="no-display-inline" id="ID5347BA3A3956478593B5D609C47AD0F2" style="OLC"> <subsection commented="no" display-inline="no-display-inline" id="IDAF5A693CEFD14B2D994185418002BE89"><enum>(e)</enum><header>Types of assistance for disadvantaged communities</header> <paragraph commented="no" display-inline="no-display-inline" id="ID48868DAD4D40411EB92708B05ADF8DF5"><enum>(1)</enum><header>Definition of disadvantaged community</header><text display-inline="yes-display-inline">In this subsection, the term <term>disadvantaged community</term> means the service area, or portion of a service area, of a treatment works that meets affordability criteria established after public review and comment by the State in which the treatment works is located.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID27C0CD05B11E4A059A049A336789AE00"><enum>(2)</enum><header>Loan subsidy</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this section, in a case in which the State makes a loan from the water pollution control revolving loan fund in accordance with subsection (c) to a disadvantaged community or a community that the State expects to become a disadvantaged community as the result of a proposed project, the State may provide additional subsidization, including—</text> <subparagraph commented="no" display-inline="no-display-inline" id="idA19FDCF590234329B75C3E6ECA113231"><enum>(A)</enum><text display-inline="yes-display-inline">the forgiveness of the principal of the loan; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2D4F4D9CA44948DF8940011EA197A269"><enum>(B)</enum><text display-inline="yes-display-inline">an interest rate on the loan of zero percent.</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5CAD85AA39BC47A4A9463C49443C54C5"><enum>(3)</enum><header>Total amount of subsidies</header><text display-inline="yes-display-inline">For each fiscal year, the total amount of loan subsidies made by the State pursuant to this subsection may not exceed 30 percent of the amount of the capitalization grant received by the State for the fiscal year.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID10827AEC0BAA41DFAFF20486B548A6C3"><enum>(4)</enum><header>Extended term</header><text display-inline="yes-display-inline">A State may provide an extended term for a loan if the extended term—</text> <subparagraph commented="no" display-inline="no-display-inline" id="IDBE321D6693E0406191E7583EF5C8F53D"><enum>(A)</enum><text display-inline="yes-display-inline">terminates not later than the date that is 30 years after the date of completion of the project; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDF9A3023F0D83405A841707C78112BEED"><enum>(B)</enum><text display-inline="yes-display-inline">does not exceed the expected design life of the project.</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE1E725DEB90C48EBA74E3F26EA35FB28"><enum>(5)</enum><header>Information</header><text display-inline="yes-display-inline">The Administrator may publish information to assist States in establishing affordability criteria described in paragraph (1).</text> </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDA308CBC14D34442BA25E4E544ACE2B8F"><enum>(b)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Section 221(d) of the <act-name parsable-cite="FWPCA">Federal Water Pollution Control Act</act-name> (33 U.S.C. 1301(d)) is amended in the second sentence by striking <quote>603(h)</quote> and inserting <quote>603(i)</quote>.</text> </subsection></section><section commented="no" display-inline="no-display-inline" id="IDCAEE2659C3C7400FB07950109D38B741" section-type="subsequent-section"><enum>105.</enum><header>Transferability of funds</header><text display-inline="no-display-inline">Section 603 of the <act-name parsable-cite="FWPCA">Federal Water Pollution Control Act</act-name> (33 U.S.C. 1383) (as amended by section 104(a)(1)) is amended by adding at the end the following:</text> <quoted-block act-name="Federal Water Pollution Control Act" display-inline="no-display-inline" id="ID028C147C296F4A238E1F471D55350DF2" style="OLC"> <subsection commented="no" display-inline="no-display-inline" id="ID5B67A68449C74067B80CD80854D92126"><enum>(j)</enum><header>Transfer of funds</header> <paragraph commented="no" display-inline="no-display-inline" id="ID53B27E8C5C4C45F4AEAAD428B5157D58"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Governor of a State may—</text> <subparagraph commented="no" display-inline="no-display-inline" id="ID6D229B06CA4644D1A66537481758AC1B"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="ID66A5C90148D34B6F993663CB62F8C2A4"><enum>(i)</enum><text display-inline="yes-display-inline">reserve not more than 33 percent of a capitalization grant made under this title; and</text> </clause><clause commented="no" display-inline="no-display-inline" id="ID3C488045151F4D2084A21EFA0A31B4FC" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">add the funds reserved to any funds provided to the State under section 1452 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-12">42 U.S.C. 300j–12</external-xref>); and</text> </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9D8D81AD2A6644B2BD4A6F610F36B813"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="ID98DDE138859C43F2B72DE4F6D1FB624A"><enum>(i)</enum><text display-inline="yes-display-inline">reserve for any year an amount that does not exceed the amount that may be reserved under subparagraph (A) for that year from capitalization grants made under section 1452 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-12">42 U.S.C. 300j–12</external-xref>); and</text> </clause><clause commented="no" display-inline="no-display-inline" id="ID17DD050A7B314E2A82BDDE52B176740E" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">add the reserved funds to any funds provided to the State under this title.</text> </clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4CADBFE10F014E1AB4EFD94BE1A4FC9F" section-type="subsequent-section"><enum>106.</enum><header>Costs of administering water pollution control revolving loan funds</header><text display-inline="no-display-inline">Section 603(d)(7) of the <act-name parsable-cite="FWPCA">Federal Water Pollution Control Act</act-name> (33 U.S.C. 1383(d)(7)) is amended by striking <quote>4 percent</quote> and inserting <quote>6 percent</quote>.</text> </section><section commented="no" display-inline="no-display-inline" id="id811ACBB16A73490186DD0F91015C7039" section-type="subsequent-section"><enum>107.</enum><header>Water pollution control revolving loan funds</header><text display-inline="no-display-inline">Section 603 of the Federal Water Pollution Control Act (33 U.S.C. 1383) is amended by striking subsection (h) (as redesignated by section 104) and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="id48233EB36EDA4FC08E99532046BCB371" style="OLC"> <subsection commented="no" display-inline="no-display-inline" id="IDdcf7e9feb77041f4bf5af525b13c7b0d"><enum>(h)</enum><header>Priority system requirement</header> <paragraph commented="no" display-inline="no-display-inline" id="ID8f9e66c687c747fcaba2c600571a5cf0"><enum>(1)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection:</text> <subparagraph commented="no" display-inline="no-display-inline" id="ID5e1de72e1c52495ca3f7e6f3e048b24c"><enum>(A)</enum><header>Restructuring</header><text display-inline="yes-display-inline">The term <quote>restructuring</quote> means—</text> <clause commented="no" display-inline="no-display-inline" id="ID66bb9e2f501f419c8ab945eb041b6029"><enum>(i)</enum><text display-inline="yes-display-inline">the consolidation of management functions or ownership with another facility; or</text> </clause><clause commented="no" display-inline="no-display-inline" id="ID809b0874b3d4496e8ea6d4bed6120caf"><enum>(ii)</enum><text display-inline="yes-display-inline">the formation of cooperative partnerships.</text> </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDccd009b09aa64cb697f3e0bc9472dd40"><enum>(B)</enum><header>Traditional wastewater approach</header><text display-inline="yes-display-inline">The term <term>traditional wastewater approach</term> means a managed system used to collect and treat wastewater from an entire service area consisting of—</text> <clause commented="no" display-inline="no-display-inline" id="ID7afa95d6f0f945dd92e19ff2b41b4bcd"><enum>(i)</enum><text display-inline="yes-display-inline">collection sewers;</text> </clause><clause commented="no" display-inline="no-display-inline" id="ID5ee06f27c9334cac96eb29e3b7f06663"><enum>(ii)</enum><text display-inline="yes-display-inline">a centralized treatment plant using biological, physical, or chemical treatment processes; and</text> </clause><clause commented="no" display-inline="no-display-inline" id="ID2e3198b82db744c0b79cf1268e6c40e4"><enum>(iii)</enum><text display-inline="yes-display-inline">a direct point source discharge to surface water.</text> </clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID06ebe46477db4809bbee9c4279cdfba5"><enum>(2)</enum><header>Priority system</header><text display-inline="yes-display-inline">In providing financial assistance from the water pollution control revolving fund of the State, the State shall—</text> <subparagraph commented="no" display-inline="no-display-inline" id="ID6b60d4a1eb4f444a81cca368fc206f0e"><enum>(A)</enum><text display-inline="yes-display-inline">give greater weight to an application for assistance by a treatment works if the application includes such other information as the State determines to be appropriate and—</text> <clause commented="no" display-inline="no-display-inline" id="ID0160ad622e2a4d93b9d9a233189d4921"><enum>(i)</enum><text display-inline="yes-display-inline">an inventory of assets, including a description of the condition of those assets;</text> </clause><clause commented="no" display-inline="no-display-inline" id="ID79778cdea2e440679949067d13eb5761"><enum>(ii)</enum><text display-inline="yes-display-inline">a schedule for replacement of the assets;</text> </clause><clause commented="no" display-inline="no-display-inline" id="ID9f4a37e8426d49729f1fb7b288d421ae"><enum>(iii)</enum><text display-inline="yes-display-inline">a financing plan indicating sources of revenue from ratepayers, grants, bonds, other loans, and other sources;</text> </clause><clause commented="no" display-inline="no-display-inline" id="ID0e940f4651504348bb8cf17b6b1a1ab8"><enum>(iv)</enum><text display-inline="yes-display-inline">a review of options for restructuring the treatment works;</text> </clause><clause commented="no" display-inline="no-display-inline" id="ID0fc47a6a88344286a2c8313831d9c7ef"><enum>(v)</enum><text display-inline="yes-display-inline">a review of options for approaches other than a traditional wastewater approach that may include actions or projects that treat or minimize sewage or urban stormwater discharges using—</text> <subclause commented="no" display-inline="no-display-inline" id="ID6402eb6fc05f4b5ba0fbdd9061f501f3"><enum>(I)</enum><text display-inline="yes-display-inline">decentralized or distributed stormwater controls;</text> </subclause><subclause commented="no" display-inline="no-display-inline" id="ID070198526c794975aaa602eb009dd963"><enum>(II)</enum><text display-inline="yes-display-inline">decentralized wastewater treatment;</text> </subclause><subclause commented="no" display-inline="no-display-inline" id="IDc3bee64a94dd44ff8b8a9672606c81d1"><enum>(III)</enum><text display-inline="yes-display-inline">low impact development technologies;</text> </subclause><subclause commented="no" display-inline="no-display-inline" id="IDbeccfaefd6cf446ebc273741bda75bb5"><enum>(IV)</enum><text display-inline="yes-display-inline">stream buffers;</text> </subclause><subclause commented="no" display-inline="no-display-inline" id="ID9a32cf2a53514fd381ee19132cba2c0b"><enum>(V)</enum><text display-inline="yes-display-inline">wetland restoration; or</text> </subclause><subclause commented="no" display-inline="no-display-inline" id="ID907795b094d0492f977a491bbeb8d1e2"><enum>(VI)</enum><text display-inline="yes-display-inline">actions to minimize the quantity of and direct connections to impervious surfaces;</text> </subclause></clause><clause commented="no" display-inline="no-display-inline" id="idDA4D13034054427C932BA27BEE2AFF7E"><enum>(vi)</enum><text display-inline="yes-display-inline">demonstration of consistency with State, regional, and municipal watershed plans;</text> </clause><clause commented="no" display-inline="no-display-inline" id="id15B88A9410134FF892C49E5539CACC32"><enum>(vii)</enum><text display-inline="yes-display-inline">a review of options for urban waterfront development or brownfields revitalization to be completed in conjunction with the project; or</text> </clause><clause commented="no" display-inline="no-display-inline" id="idDBE91BFBD1304014A51411C3FA038F61"><enum>(viii)</enum><text display-inline="yes-display-inline">provides the applicant the flexibility through alternative means to carry out responsibilities under Federal regulations, that may include watershed permitting and other innovative management approaches, while achieving results that—</text> <subclause commented="no" display-inline="no-display-inline" id="id4DBE9897FF474E7BBBC0E57CC52D0EBA"><enum>(I)</enum><text display-inline="yes-display-inline">the State, with the delegated authority under section 402(a)(5), determines meet permit requirements for permits that have been issued in accordance with the national pollution discharge elimination system under section 402; or</text> </subclause><subclause commented="no" display-inline="no-display-inline" id="idB97E50314C3B42669B579BF5B21B5B43"><enum>(II)</enum><text display-inline="yes-display-inline">the Administrator determines are measurably superior when compared to regulatory standards;</text> </subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDd7e80742bd7747c0bd0c9a5b3a12899a"><enum>(B)</enum><text display-inline="yes-display-inline">take into consideration appropriate chemical, physical, and biological data that the State considers reasonably available and of sufficient quality;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDaf78ea83b29d40c98d125280e07344b3"><enum>(C)</enum><text display-inline="yes-display-inline">provide for public notice and opportunity to comment on the establishment of the system and the summary under subparagraph (D);</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDa64840904acd4dd7bb6832d35006c492"><enum>(D)</enum><text display-inline="yes-display-inline">publish not less than biennially in summary form a description of projects in the State that are eligible for assistance under this title that indicates—</text> <clause commented="no" display-inline="no-display-inline" id="ID1ce1514e72c04e82921741851c734f49"><enum>(i)</enum><text display-inline="yes-display-inline">the priority assigned to each project under the priority system of the State; and</text> </clause><clause commented="no" display-inline="no-display-inline" id="IDbd8ad35eba68467f90ddc49527bdf592"><enum>(ii)</enum><text display-inline="yes-display-inline">the funding schedule for each project, to that extent the information is available; and</text> </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDb8f361d0d2304311b73cb23f04d76e4b"><enum>(E)</enum><text display-inline="yes-display-inline">ensure that projects undertaken with assistance under this title are designed to achieve, as determined by the State, the optimum water quality management, consistent with the public health and water quality goals and requirements of this title.</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA4E2495404E84AAE995E6E4204D2E22B"><enum>(3)</enum><header>Savings clause</header><text display-inline="yes-display-inline">Nothing in paragraph (2)(A)(viii) affects the authority of the Administrator under section 402(a)(5).</text> </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </section><section commented="no" display-inline="no-display-inline" id="id5F2CC0CAEA244654817640BF04B6A734" section-type="subsequent-section"><enum>108.</enum><header>Noncompliance</header><text display-inline="no-display-inline">Section 603 of the Federal Water Pollution Control Act (33 U.S.C. 1383) (as amended by section 105) is amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="idAB1E43B0DC5946D299623D2D0924829D" style="OLC"> <subsection commented="no" display-inline="no-display-inline" id="idABD4FFA3FCFC4F4BB78FA71B40F26E52"><enum>(k)</enum><header>Noncompliance</header> <paragraph commented="no" display-inline="no-display-inline" id="id9064069DBEA84BBD94DA2CBE3B056084"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), no assistance (other than assistance that is to be used by a treatment works solely for planning, design, or security purposes) shall be provided under this title to a treatment works that has been in significant noncompliance with any requirement of this Act for any of the 4 quarters in the previous 8 quarters, unless the treatment works is in compliance with, or has entered into, an enforceable administrative order to effect compliance with the requirement.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd145977eb69f4f91be5beda1ed512dd4"><enum>(2)</enum><header>Exception</header><text display-inline="yes-display-inline">A treatment works that is determined under paragraph (1) to be in significant noncompliance with a requirement described in that paragraph may receive assistance under this title if the Administrator and the State providing the assistance determine that—</text> <subparagraph commented="no" display-inline="no-display-inline" id="ID57cf46bf3683439b8476222c7465ab80"><enum>(A)</enum><text display-inline="yes-display-inline">the entity conducting the enforcement action on which the determination of significant noncompliance is based has determined that the use of assistance would enable the treatment works to take corrective action toward resolving the violations; or</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID08b886ef4f7c40f29572235048e9a0c5"><enum>(B)</enum><text display-inline="yes-display-inline">the entity conducting the enforcement action on which the determination of significant noncompliance is based has determined that the assistance would be used on a portion of the treatment works that is not directly related to the cause of finding significant noncompliance.</text> </subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </section><section commented="no" display-inline="no-display-inline" id="id63204036A3EB4480BAF68F2772714C9D" section-type="subsequent-section"><enum>109.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">The Federal Water Pollution Control Act is amended by striking section 607 (33 U.S.C. 1387) and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="idC954DA859F254F218A094BEAE94FB0A7" style="OLC"> <section commented="no" display-inline="no-display-inline" id="id5C5BBE82BFE4474BBD4CBA13E2DC234B" section-type="subsequent-section"><enum>607.</enum><header>Authorization of appropriations</header> <subsection commented="no" display-inline="no-display-inline" id="id4AF3871C31EA43CD9E65AC3329806461"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">There are authorized to be appropriated to carry out this title—</text> <paragraph commented="no" display-inline="no-display-inline" id="id4C234F600E424229A615DC2B3E38EAC8"><enum>(1)</enum><text display-inline="yes-display-inline">$3,200,000,000 for each of fiscal years 2006 and 2007;</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6E7A77A9301144AF893C629135A1691C"><enum>(2)</enum><text display-inline="yes-display-inline">$3,600,000,000 for fiscal year 2008;</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id56879AFBDA8C49C3BDE1B215E24BF74E"><enum>(3)</enum><text display-inline="yes-display-inline">$4,000,000,000 for fiscal year 2009; and</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id73053BD46F754F1FA901CE71FC75D602"><enum>(4)</enum><text display-inline="yes-display-inline">$6,000,000,000 for fiscal year 2010.</text> </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id417DEF817CB7420D9638E8AB2B3D2ACE"><enum>(b)</enum><header>Availability</header><text display-inline="yes-display-inline">Amounts made available under this section shall remain available until expended.</text> </subsection><subsection commented="no" display-inline="no-display-inline" id="id9187407AAFEC493690CBB1ED8320E413"><enum>(c)</enum><header>Reservation for needs surveys</header><text display-inline="yes-display-inline">Of the amount made available under subsection (a) to carry out this title for a fiscal year, the Administrator may reserve not more than $1,000,000 per year to pay the costs of conducting needs surveys under section 516(2).</text> </subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </section><section commented="no" display-inline="no-display-inline" id="idEF5907E216754466B32DBFB2E05BBAB6" section-type="subsequent-section"><enum>110.</enum><header>Critical water infrastructure projects</header> <subsection commented="no" display-inline="no-display-inline" id="ID2fa90774eff54000b740c547d25da7f6"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Administrator shall establish a program under which grants are provided to eligible entities for use in carrying out projects and activities the primary purpose of which is watershed restoration through the protection or improvement of water quality.</text> </subsection><subsection commented="no" display-inline="no-display-inline" id="ID09e7dd99a39e4444adf621c701bc3423"><enum>(b)</enum><header>Project selection</header> <paragraph commented="no" display-inline="no-display-inline" id="ID935397f58c85472e916f3bfbde67867b"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator may provide funds under this section to an eligible entity to carry out an eligible project described in paragraph (2).</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id77EE40D8ADA84E589B02F0D52FDBAC87"><enum>(2)</enum><header>Equitable distribution</header><text display-inline="yes-display-inline">The Administrator shall ensure an equitable distribution of projects under this section, taking into account cost and number of requests for each category listed in paragraph (3).</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID543137e72f4548bfbeed02195eaaed92"><enum>(3)</enum><header>Eligible projects</header><text display-inline="yes-display-inline">A project that is eligible to be carried out using funds provided under this section may include projects that—</text> <subparagraph commented="no" display-inline="no-display-inline" id="IDf405d77575834cfba5fd89e6126de3ee"><enum>(A)</enum><text display-inline="yes-display-inline">are listed on the priority list of a State under section 216 of the Federal Water Pollution Control Act (33 U.S.C. 1296);</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID0c93734aefb2402eaa2769bc2f129c71"><enum>(B)</enum><text display-inline="yes-display-inline">mitigate wet weather flows, including combined sewer overflows, sanitary sewer overflows, and stormwater discharges;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDa338ce2e538b4828852ec92cf2c4f08e"><enum>(C)</enum><text display-inline="yes-display-inline">upgrade publicly owned treatment works with a permitted design capacity to treat an annual average of at least 500,000 gallons of wastewater per day, the upgrade of which would produce the greatest nutrient load reductions at points of discharge, or result in the greatest environmental benefits, with nutrient removal technologies that are designed to reduce total nitrogen in discharged wastewater to an average annual concentration of 3 milligrams per liter;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDab3e2de901d5416db3e22ba64363632e"><enum>(D)</enum><text display-inline="yes-display-inline">implement locally based watershed protection plans created by local nonprofit organizations that—</text> <clause commented="no" display-inline="no-display-inline" id="id203AE40F8F7C43CC88AB024D112E4CE6"><enum>(i)</enum><text display-inline="yes-display-inline">provide a coordinating framework for management that focuses public and private efforts to address the highest priority water-related problems within a geographic area, considering both ground and surface water flow; and</text> </clause><clause commented="no" display-inline="no-display-inline" id="id7E825315830942D8876373026D46C203"><enum>(ii)</enum><text display-inline="yes-display-inline">includes representatives from both point source and nonpoint source contributors;</text> </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDe69b2ca2bc0a498980d6f4d912353624"><enum>(E)</enum><text display-inline="yes-display-inline">are contained in a State plan developed in accordance with section 319 or 320 of the Federal Water Pollution Control Act (33 U.S.C. 1329, 1330); or</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDc3d07e825fe2445b91fa2b3e216f701d"><enum>(F)</enum><text display-inline="yes-display-inline">include means to develop alternative water supplies.</text> </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID85ff9f2b73d148228fafc8f12a2da03c"><enum>(c)</enum><header>Local participation</header><text display-inline="yes-display-inline">In prioritizing projects for implementation under this section, the Administrator shall consult with, and consider the priorities of—</text> <paragraph commented="no" display-inline="no-display-inline" id="idEB5AF35A28DA46029399980E91F7895F"><enum>(1)</enum><text display-inline="yes-display-inline">affected State and local governments; and</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDBF06DBAB43C40398A1B4C261D3E6EA7"><enum>(2)</enum><text display-inline="yes-display-inline">public and private entities that are active in watershed planning and restoration.</text> </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID13e6dea539754b9bb65f34ef5add0ec3"><enum>(d)</enum><header>Cost sharing</header><text display-inline="yes-display-inline">Before carrying out any project under this section, the Administrator shall enter into a binding agreement with 1 or more non-Federal interests that shall require the non-Federal interests—</text> <paragraph commented="no" display-inline="no-display-inline" id="IDffdd2102477340229ba9a1c5473e0331"><enum>(1)</enum><text display-inline="yes-display-inline">to pay 45 percent of the total costs of the project, which may include services, materials, supplies, or other in-kind contributions;</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDac476151e555421bbd774633c47eb8a9"><enum>(2)</enum><text display-inline="yes-display-inline">to provide any land, easements, rights-of-way, and relocations necessary to carry out the project; and</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID983017ee06f54099b4fb8c26ae619949"><enum>(3)</enum><text display-inline="yes-display-inline">to pay 100 percent of any operation, maintenance, repair, replacement, and rehabilitation costs associated with the project.</text> </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id05E4E74D73C1455CA61D21803DD841E4"><enum>(e)</enum><header>Waiver</header><text display-inline="yes-display-inline">The Administrator may waive the requirement to pay the non-Federal share of the cost of carrying out an eligible activity using funds from a grant provided under this section if the Administrator determines that an eligible entity is unable to pay, or would experience significant financial hardship if required to pay, the non-Federal share.</text> </subsection><subsection commented="no" display-inline="no-display-inline" id="ID40f26702c835423fa0eb3bd0b5167e0e"><enum>(f)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out this section $300,000,000 for each of fiscal years 2006 through 2010.</text> </subsection></section><enum>II</enum><header>Safe drinking water infrastructure</header> <section commented="no" display-inline="no-display-inline" id="ID3A47912F1C1B4F0784A386EB4CF8E9AF" section-type="subsequent-section"><enum>201.<?LEXA-Enum 201.?></enum><header>Preconstruction work</header><text display-inline="no-display-inline">Section 1452(a)(2) of the Safe Drinking Water Act (42 U.S.C. 300j–12(a)(2)) is amended in the second sentence—</text> <paragraph commented="no" display-inline="no-display-inline" id="ID11F936EF7F1445979934BD72A85049FA"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>(not</quote> and inserting <quote>(including expenditures for planning, design, and associated preconstruction and for recovery for siting of the facility and related elements but not</quote>; and</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID108C2B0E135446DB9F1612EA5421A35D"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting before the period at the end the following: <quote>or to replace or rehabilitate aging collection, treatment, storage (including reservoirs), or distribution facilities of public water systems or provide for capital projects to upgrade the security of public water systems</quote>.</text> </paragraph></section><section commented="no" display-inline="no-display-inline" id="IDF499198A3A4E4ADC9925942AC47EB69A" section-type="subsequent-section"><enum>202.</enum><header>Affordability</header><text display-inline="no-display-inline">Section 1452(d)(3) of the Safe Drinking Water Act (42 U.S.C. 300j–12(d)(3)) is amended in the first sentence by inserting <quote>, or portion of a service area,</quote> after <quote>service area</quote>.</text> </section><section commented="no" display-inline="no-display-inline" id="ID302B92FFFC7C42DB86BF239C6A5239D4" section-type="subsequent-section"><enum>203.</enum><header>Safe drinking water revolving loan funds</header><text display-inline="no-display-inline">Section 1452(g) of the Safe Drinking Water Act (42 U.S.C. 300j–12(g)) is amended—</text> <paragraph commented="no" display-inline="no-display-inline" id="ID5E713125557244A6B6525B657FFC6B83"><enum>(1)</enum><text display-inline="yes-display-inline">paragraph (2)—</text> <subparagraph commented="no" display-inline="no-display-inline" </subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID053146FCA9DF4C1AB43C3757DE525317"><enum>(B)</enum><header>State match</header><text display-inline="yes-display-inline">Funds reserved under this paragraph shall not be considered to be a State match of a capitalization grant required under this section or section 602(b) of the <act-name parsable-cite="FWPCA">Federal Water Pollution Control Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/33/1382(b)">33 U.S.C. 1382(b)</external-xref>).</text> </subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section><section changed="not-changed" commented="no" display-inline="no-display-inline" id="ID1E42DDDAEAA9499A886972FB94561B33" section-type="subsequent-section"><enum>204.</enum><header>Other authorized activities</header><text display-inline="no-display-inline">Section 1452(k)(2)(D) of the Safe Drinking Water Act (42 U.S.C. 300j–12(k)(2)(D)) is amended by inserting before the period at the end the following: <quote>(including implementation of source water protection plans)</quote>.</text> </section><section commented="no" display-inline="no-display-inline" id="ID1a0c92e7eee74937b2277a3fa108204e" section-type="subsequent-section"><enum>205.</enum><header>Priority system requirements</header><text display-inline="no-display-inline">Section 1452(b)(3) of the Safe Drinking Water Act (42 U.S.C. 300j–12(b)(3)) is amended—</text> <paragraph commented="no" display-inline="no-display-inline" id="ID74ae4038d35f42619a040a5cbed09673"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subparagraph (B) as subparagraph (D);</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6558f65d16b2465ab14541f6bdad08c3"><enum>(2)</enum><text display-inline="yes-display-inline">by striking subparagraph (A) and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="idC867E087D3F14A5A881ED86DE741E7FD" style="OLC"> <subparagraph commented="no" display-inline="no-display-inline" id="IDe081c2527e9849c49b7a6190d0e9e12b"><enum>(A)</enum><header>Definition of restructuring</header><text display-inline="yes-display-inline">In this paragraph, the term <term>restructuring</term> means changes in operations (including ownership, accounting, rates, maintenance, consolidation, and alternative water supply).</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4d3667ca553a4e7ebfd51c18f6a9478f"><enum>(B)</enum><header>Priority system</header><text display-inline="yes-display-inline">An intended use plan shall provide, to the maximum extent practicable, that priority for the use of funds be given to projects that—</text> <clause commented="no" display-inline="no-display-inline" id="IDb6537ffad9d946a1b483fc71fd34968a"><enum>(i)</enum><text display-inline="yes-display-inline">address the most serious risk to human health;</text> </clause><clause commented="no" display-inline="no-display-inline" id="ID478faff8ab0b4f24b7847066ec94d1bb"><enum>(ii)</enum><text display-inline="yes-display-inline">are necessary to ensure compliance with this title (including requirements for filtration); and</text> </clause><clause commented="no" display-inline="no-display-inline" id="IDe7a65a7e7a144ff3bd51c5ca0c82fe1b"><enum>(iii)</enum><text display-inline="yes-display-inline">assist systems most in need on a per-household basis according to State affordability criteria.</text> </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID0ad2ebe10cbf4041a9e0eabe73487ae5"><enum>(C)</enum><header>Weight given to applications</header><text display-inline="yes-display-inline">After determining project priorities under subparagraph (B), an intended use plan shall further provide that the State shall give greater weight to an application for assistance by a community water system if the application includes such other information as the State determines to be necessary and—</text> <clause commented="no" display-inline="no-display-inline" id="IDc1653aa5c58440f58a5285ea05cfdbb0"><enum>(i)</enum><text display-inline="yes-display-inline">an inventory of assets, including a description of the condition of the assets;</text> </clause><clause commented="no" display-inline="no-display-inline" id="IDdfcb13b46c904079b33ad3644c5ccf26"><enum>(ii)</enum><text display-inline="yes-display-inline">a schedule for replacement of assets;</text> </clause><clause commented="no" display-inline="no-display-inline" id="ID4c7f380275d441f9b1a186a7e5329dff"><enum>(iii)</enum><text display-inline="yes-display-inline">a financing plan indicating sources of revenue from ratepayers, grants, bonds, other loans, and other sources;</text> </clause><clause commented="no" display-inline="no-display-inline" id="ID983b0018b0d74c268a4bf90c0826e294"><enum>(iv)</enum><text display-inline="yes-display-inline">a review of options for restructuring the public water system;</text> </clause><clause commented="no" display-inline="no-display-inline" id="idA119516FDAE444AB8F60A9675BA6EC70"><enum>(v)</enum><text display-inline="yes-display-inline">demonstration of consistency with State, regional, and municipal watershed plans; or</text> </clause><clause commented="no" display-inline="no-display-inline" id="idE4845ED546F24AAF875E37F9CDF0D66F"><enum>(vi)</enum><text display-inline="yes-display-inline">a review of options for urban waterfront development or brownfields revitalization to be completed in conjunction with the project;</text> </clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID420e9a2ffb9b4cc38dd0f8c78c06cc8b"><enum>(3)</enum><text display-inline="yes-display-inline">in subparagraph (D) (as redesignated by paragraph (1)), by striking <quote>periodically</quote> and inserting <quote>at least biennially</quote>.</text> </paragraph></section><section commented="no" display-inline="no-display-inline" id="idF7CA69E4F06145A89BF46A266D2A5FFB" section-type="subsequent-section"><enum>206.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">Section 1452 of the Safe Drinking Water Act (42 U.S.C. 300j–12) is amended by striking subsection (m) and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="idF3645E5B0431433981381FB1ED5C3228" style="OLC"> <subsection commented="no" display-inline="no-display-inline" id="ID639d934349474601b9fdfd0ac331c92a"><enum>(m)</enum><header>Authorization of appropriations</header> <paragraph commented="no" display-inline="no-display-inline" id="IDdfce70b49f7d4c92a470fbdae627890e"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">There are authorized to be appropriated to carry out this section—</text> <subparagraph commented="no" display-inline="no-display-inline" id="ID1fc44eaae4524f8798ea4e18620fc59d"><enum>(A)</enum><text display-inline="yes-display-inline">$1,500,000,000 for fiscal year 2006;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID0d811724062a4bbe86ffac950cd8fca0"><enum>(B)</enum><text display-inline="yes-display-inline">$2,000,000,000 for each of fiscal years 2007 and 2008;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDe20b5a02a2974c89b224d299e1add623"><enum>(C)</enum><text display-inline="yes-display-inline">$3,500,000,000 for fiscal year 2009; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1ba1e0c3272f47afa066964a97d29774"><enum>(D)</enum><text display-inline="yes-display-inline">$6,000,000,000 for fiscal year 2010.</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDa8eee46c44c04eacbfd69f2bd99e7df4"><enum>(2)</enum><header>Availability</header><text display-inline="yes-display-inline">Amounts made available under this subsection shall remain available until expended.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDeaa02748ac0640398b9c21469e059c17"><enum>(3)</enum><header>Reservation for needs surveys</header><text display-inline="yes-display-inline">Of the amount made available under paragraph (1) to carry out this section for a fiscal year, the Administrator may reserve not more than $1,000,000 per year to pay the costs of conducting needs surveys under subsection (h).</text> </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </section><section commented="no" display-inline="no-display-inline" id="IDe1a0d4fcfbf44c2f882b5a9c0a889142" section-type="subsequent-section"><enum>207.</enum><header>Critical drinking water infrastructure projects</header> <subsection commented="no" display-inline="no-display-inline" id="IDd47144d6726d4e2d9067ee5aa50af29b"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Administrator of the Environmental Protection Agency shall establish a program under which grants are provided to eligible entities for use in carrying out projects and activities the primary purpose of which is to assist community water systems in meeting the requirements of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300f">42 U.S.C. 300f</external-xref> et seq.).</text> </subsection><subsection commented="no" display-inline="no-display-inline" id="IDe9f7b510cc3b431780015ba4c59ae6a4"><enum>(b)</enum><header>Project selection</header><text display-inline="yes-display-inline">A project that is eligible to be carried out using funds provided under this section may include projects that—</text> <paragraph commented="no" display-inline="no-display-inline" id="IDa84187b82da149c2a445fe504931d08b"><enum>(1)</enum><text display-inline="yes-display-inline">develop alternative water sources;</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd977e8bd7ea042c3a26bc148752c57d5"><enum>(2)</enum><text display-inline="yes-display-inline">provide assistance to small systems; or</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDa629ed75818747649ff07a8f0216b3f5"><enum>(3)</enum><text display-inline="yes-display-inline">assist a community water system—</text> <subparagraph commented="no" display-inline="no-display-inline" id="idD4A502F8A20842FF9187C43C449337DA"><enum>(A)</enum><text display-inline="yes-display-inline">to comply with a national primary drinking water regulation; or</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id211F0FA96EFA4BF685050B48B7458277"><enum>(B)</enum><text display-inline="yes-display-inline">to mitigate groundwater contamination.</text> </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDc65768efe86945648f2a0d3a9efb2fcc"><enum>(c)</enum><header>Eligible entities</header><text display-inline="yes-display-inline">An entity eligible to receive a grant under this section is—</text> <paragraph commented="no" display-inline="no-display-inline" id="id7E79534C21A043A4A82F4F36F553DB26"><enum>(1)</enum><text display-inline="yes-display-inline">a community water system as defined in section 1401 of the Safe Drinking Water Act (42 U.S.C. 300f); or</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID39da0f79ee1f4d6daff10d02d01973cb"><enum>(2)</enum><text display-inline="yes-display-inline">a system that is located in an area governed by an Indian Tribe, as defined in section 1401 of the Safe Drinking Water Act (42 U.S.C. 300f);</text> </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID724ef9a7496840cea6804a581261ae94"><enum>(d)</enum><header>Priority</header><text display-inline="yes-display-inline">In prioritizing projects for implementation under this section, the Administrator shall give priority to community water systems that—</text> <paragraph commented="no" display-inline="no-display-inline" id="IDd612999e9ad34850adb7d36d2c430c69"><enum>(1)</enum><text display-inline="yes-display-inline">serve a community that, under affordability criteria established by the State under section 1452(d)(3) of the Safe Drinking Water Act (42 U.S.C. 300j-12), is determined by the State to be—</text> <subparagraph commented="no" display-inline="no-display-inline" id="IDa87ddfd5279f48e68d365af94ea9d84e"><enum>(A)</enum><text display-inline="yes-display-inline">a disadvantaged community; or</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDf1f3fad9248744a5aefc370a857d92e6"><enum>(B)</enum><text display-inline="yes-display-inline">a community that may become a disadvantaged community as a result of carrying out an eligible activity; or</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6a574b6c9eb145b9a841c4246d01b1dc"><enum>(2)</enum><text display-inline="yes-display-inline">serve a community with a population of less than 10,000 households.</text> </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID36d252615a60487886448459b5e62eba"><enum>(e)</enum><header>Local participation</header><text display-inline="yes-display-inline">In prioritizing projects for implementation under this section, the Administrator shall consult with, and consider the priorities of, affected States, Tribes, and local governments.</text> </subsection><subsection commented="no" display-inline="no-display-inline" id="ID1cc0da9c3df741e5b8a602568227453c"><enum>(f)</enum><header>Cost sharing</header><text display-inline="yes-display-inline">Before carrying out any project under this section, the Administrator shall enter into a binding agreement with 1 or more non-Federal interests that shall require the non-Federal interests—</text> <paragraph commented="no" display-inline="no-display-inline" id="ID427c0a40296a43d9aece67996b4a45f3"><enum>(1)</enum><text display-inline="yes-display-inline">to pay 45 percent of the total costs of the project, which may include services, materials, supplies, or other in-kind contributions;</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDb76f60c9cdae4e3cb1f7fa3d5ac51020"><enum>(2)</enum><text display-inline="yes-display-inline">to provide any land, easements, rights-of-way, and relocations necessary to carry out the project; and</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1be20d8e7efd49bd8437e611789bb42c"><enum>(3)</enum><text display-inline="yes-display-inline">to pay 100 percent of any operation, maintenance, repair, replacement, and rehabilitation costs associated with the project.</text> </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID815b4fe2b00642148c4d58d8894266db"><enum>(g)</enum><header>Waiver</header><text display-inline="yes-display-inline">The Administrator may waive the requirement to pay the non-Federal share of the cost of carrying out an eligible activity using funds from a grant provided under this section if the Administrator determines that an eligible entity is unable to pay, or would experience significant financial hardship if required to pay, the non-Federal share.</text> </subsection><subsection commented="no" display-inline="no-display-inline" id="ID8edf2ab1f3e045de98b5126df08b97b8"><enum>(h)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out this section $300,000,000 for each of fiscal years 2006 through 2010.</text> </subsection></section><section commented="no" display-inline="no-display-inline" id="ID257e20f1b96042b5be12a4a20b28c185" section-type="subsequent-section"><enum>208.</enum><header>Small system revolving loan funds</header><text display-inline="no-display-inline">Section 1442(e) of the Safe Drinking Water Act (42 U.S.C. 300j–1(e)) is amended—</text> <paragraph commented="no" display-inline="no-display-inline" id="ID55897ed8eede4f41baaa5d4556d51926"><enum>(1)</enum><text display-inline="yes-display-inline">in the first sentence, by striking <quote>The Administrator may provide</quote> and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="id5303141C735C4BB19E7AD267D55A6F27" style="OLC"> <paragraph commented="no" display-inline="no-display-inline" id="IDdbfa38a3c15a48489a9cedc110c118c5"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator may provide</text> </paragraph><after-quoted-block>; and</after-quoted-block></quoted-block> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3447e157ed04401080bd0d77d3bfd7cb"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id837B835E596549F9BEBF39B819C063F6" style="OLC"> <paragraph commented="no" display-inline="no-display-inline" id="ID1709043bfa864c3fb1ff6d047cf151ab"><enum>(2)</enum><header>Small system revolving loan fund</header> <subparagraph commented="no" display-inline="no-display-inline" id="ID65b8ce685cad4e018e826b37034faa50"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">In addition to amounts provided under this section, the Administrator may provide grants to qualified private, nonprofit entities to capitalize revolving funds to provide financing to eligible entities described in subparagraph (B) for—</text> <clause commented="no" display-inline="no-display-inline" id="ID9345d80ee8024a47abd8c01f37d02d5c"><enum>(i)</enum><text display-inline="yes-display-inline">predevelopment costs (including costs for planning, design, associated preconstruction, and necessary activities for siting the facility and related elements) associated with proposed water projects or with existing water systems; and</text> </clause><clause commented="no" display-inline="no-display-inline" id="IDaf5f9202043b44e9865cd3a916161481"><enum>(ii)</enum><text display-inline="yes-display-inline">short-term costs incurred for replacement equipment, small-scale extension services, or other small capital projects that are not part of the regular operations and maintenance activities of existing water systems.</text> </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID25b4f593b3394ed982b26ff08531a714"><enum>(B)</enum><header>Eligible entities</header><text display-inline="yes-display-inline">To be eligible for assistance under this paragraph, an entity shall be a small water system (as described in section 1412(b)(4)(E)(ii)).</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID91a4a58ccd964829baa44b3109c77faf"><enum>(C)</enum><header>Maximum amount of loans</header><text display-inline="yes-display-inline">The amount of financing made to an eligible entity under this paragraph shall not exceed—</text> <clause commented="no" display-inline="no-display-inline" id="ID89ac7bf967c94645af92f442176b7d51"><enum>(i)</enum><text display-inline="yes-display-inline">$100,000 for costs described in subparagraph (A)(i); and</text> </clause><clause commented="no" display-inline="no-display-inline" id="ID3487b567fa6e4cdbaeacd3a2803f67da"><enum>(ii)</enum><text display-inline="yes-display-inline">$100,000 for costs described in subparagraph (A)(ii).</text> </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID5fde28f7eb10485898a354ccea50200e"><enum>(D)</enum><header>Term</header><text display-inline="yes-display-inline">The term of a loan made to an eligible entity under this paragraph shall not exceed 10 years.</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDad2f9920597a47fb8750fc2298c2bbd6"><enum>(E)</enum><header>Annual report</header><text display-inline="yes-display-inline">For each fiscal year, a qualified private, nonprofit entity that receives a grant under subparagraph (A) shall submit to the Administrator a report that—</text> <clause commented="no" display-inline="no-display-inline" id="ID1693010efce64a37b5ae89d38c0da82a"><enum>(i)</enum><text display-inline="yes-display-inline">describes the activities of the qualified private, nonprofit entity under this paragraph for the fiscal year; and</text> </clause><clause commented="no" display-inline="no-display-inline" id="ID0ba8b7562e9f4b7ba6f52430c7f316fd"><enum>(ii)</enum><text display-inline="yes-display-inline">specifies—</text> <subclause commented="no" display-inline="no-display-inline" id="IDa3880bee4b374dad945d28a2b403cd5f"><enum>(I)</enum><text display-inline="yes-display-inline">the number of communities served;</text> </subclause><subclause commented="no" display-inline="no-display-inline" id="IDdae38a594dce48418c802b460227c3a9"><enum>(II)</enum><text display-inline="yes-display-inline">the sizes of those communities; and</text> </subclause><subclause commented="no" display-inline="no-display-inline" id="ID00aca2069b0648029f16194e7e77a83c"><enum>(III)</enum><text display-inline="yes-display-inline">the type of financing provided by the qualified private, nonprofit entity.</text> </subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDaa7fe3d0b31f492a83d1d789c3f19a72"><enum>(F)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out this subsection $25,000,000 for each of fiscal years 2006 through 2010.</text> </subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section><section commented="no" display-inline="no-display-inline" id="id9B59072B77254EA79DF9202E9C20C064" section-type="subsequent-section"><enum>209.</enum><header>Study on lead contamination in drinking water</header> <subsection commented="no" display-inline="no-display-inline" id="IDabbe7880e5284d1b8f38c8342cb035a8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">As soon as practicable after the date of enactment of this Act, the Administrator of the Environmental Protection Agency shall enter into a cooperative agreement with the National Academy of Sciences to carry out a study to analyze existing market conditions for plumbing components, including pipes, faucets, water meters, valves, household valves, and any other plumbing components that come into contact with water commonly used for human consumption.</text> </subsection><subsection commented="no" display-inline="no-display-inline" id="ID8e96881364e844daa0c2d1f09467743c"><enum>(b)</enum><header>Components</header><text display-inline="yes-display-inline">In conducting the study under subsection (a), the National Academy of Sciences shall evaluate for each category of plumbing components described in subsection (a)—</text> <paragraph commented="no" display-inline="no-display-inline" id="ID0f2edea4056247c095bf2c5f13154262"><enum>(1)</enum><text display-inline="yes-display-inline">the availability of plumbing components in each category with lead content below 8 percent, including those between 0 percent and 4 percent and those between 4 percent and 8 percent;</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID48cc5a4aaee64fc3b2d2f253a56d3327"><enum>(2)</enum><text display-inline="yes-display-inline">the relative market share of the plumbing components;</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID657c94ab39a34c99840d126ea4156a27"><enum>(3)</enum><text display-inline="yes-display-inline">the relative cost of the plumbing components;</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDed2494330fb943869a341e89053835b5"><enum>(4)</enum><text display-inline="yes-display-inline">the issues surrounding transition from current market to plumbing components with not more than 0.2 percent lead;</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4E125702EA0A4C3193B835E77752C393"><enum>(5)</enum><text display-inline="yes-display-inline">the feasibility of manufacturing plumbing components with lead levels below 8 percent; and</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9BB6B1B17CFF4FA3AF86C7C2AADD47B1"><enum>(6)</enum><text display-inline="yes-display-inline">the use of lead alternatives in plumbing components with lead levels below 8 percent.</text> </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID1d48e4be60dc4fbb9a436c659e458f7f"><enum>(c)</enum><header>Report</header><text display-inline="yes-display-inline">Not late than 1 year after the date of enactment of this Act, the National Academy of Sciences shall submit to the Committee on Environment and Public Works of the Senate and the Committee on Energy and Commerce of the House of Representatives a report describing the findings of the study under this section.</text> </subsection><subsection commented="no" display-inline="no-display-inline" id="ID3bccbe91a5c3462b9e0bb2006d17d0e5"><enum>(d)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out this section $500,000.</text> </subsection></section><section commented="no" display-inline="no-display-inline" id="IDba04f90f5c6b4a3ea371bc582d276ff2" section-type="subsequent-section"><enum>210.</enum><header>District of Columbia lead service line replacement</header> <subsection commented="no" display-inline="no-display-inline" id="ID58d4e481f6f34c8d84f6417b79f3926f"><enum>(a)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out lead service line replacement in the District of Columbia $30,000,000 for each of fiscal years 2007 through 2011.</text> </subsection><subsection commented="no" display-inline="no-display-inline" id="IDe496f55513e742c48d38f32b42a067c3"><enum>(b)</enum><header>Lead service line replacement assistance fund</header> <paragraph commented="no" display-inline="no-display-inline" id="id11DDB2C400034B138CB78CC657CCB0B7"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Of the funds provided under subsection (a), not more than $2,000,000 per year may be allocated for water service line replacement grants to provide assistance to low-income residents to replace the privately-owned portion of lead service lines.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID41450231bf0a4543b678ce8b5ea9bc6f"><enum>(2)</enum><header>Limitation</header><text display-inline="yes-display-inline">Individual grants shall be limited to not more than $5,000.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDa49934b30005404996314b3c0f224055"><enum>(3)</enum><header>Definition of low income</header><text display-inline="yes-display-inline">For the purpose of this subsection, the term <quote>low-income</quote> shall be defined by the District of Columbia.</text> </paragraph></subsection></section><enum>III</enum><header>Miscellaneous</header> <section commented="no" display-inline="no-display-inline" id="id0B58951CE9C846038C05F2B74074169A" section-type="subsequent-section"><enum>301.<?LEXA-Enum 301.?></enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text> <paragraph commented="no" display-inline="no-display-inline" id="idC04CEB694EBD434491A3EE701F397A4C"><enum>(1)</enum><header>Administrator</header><text display-inline="yes-display-inline">The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id704F725B73CC4DD9973FC4C6337FD2E0"><enum>(2)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of the Interior, acting through the Director of the United States Geological Survey.</text> </paragraph></section><section commented="no" display-inline="no-display-inline" id="ID23F7200A0F534D5D9CE34DDBE1F79833" section-type="subsequent-section"><enum>302.</enum><header>Demonstration grant program for water quality enhancement and management</header> <subsection commented="no" display-inline="no-display-inline" id="IDEDD891CDD173454A9AB2ED710415E01A"><enum>(a)</enum><header>Establishment</header> <paragraph commented="no" display-inline="no-display-inline" id="ID87CA4CF44594479B937DA4105A244FF1"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">As soon as practicable after the date of enactment of this Act, the Administrator shall establish a nationwide demonstration grant program to—</text> <subparagraph commented="no" display-inline="no-display-inline" id="IDF229212C2E264CD7BD85A12BD312872D"><enum>(A)</enum><text display-inline="yes-display-inline">promote innovations in technology and alternative approaches to water quality management or water supply; or</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID827E5901183D4F498FD078516B51F888"><enum>(B)</enum><text display-inline="yes-display-inline">reduce costs to municipalities incurred in complying with—</text> <clause commented="no" display-inline="no-display-inline" id="ID04380B0F95FB45149310B844A710A832"><enum>(i)</enum><text display-inline="yes-display-inline">the <act-name parsable-cite="FWPCA">Federal Water Pollution Control Act</act-name> (33 U.S.C. 1251 et seq.); and</text> </clause><clause commented="no" display-inline="no-display-inline" id="ID9E253A2A46914A7A90F6A1BD5109B5C5"><enum>(ii)</enum><text display-inline="yes-display-inline">the Safe Drinking Water Act (42 U.S.C. 300f et seq.).</text> </clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID611D1BCABE66433BAC0BEC62F57A093C"><enum>(2)</enum><header>Scope</header><text display-inline="yes-display-inline">The demonstration grant program shall consist of 10 projects each year, to be carried out in municipalities selected by the Administrator under subsection (b).</text> </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID39749A16EBD44E4292F9C2963DEFCF6D"><enum>(b)</enum><header>Selection of municipalities</header> <paragraph commented="no" display-inline="no-display-inline" id="IDCF5C51A6505F4F54AA07329BA594C737"><enum>(1)</enum><header>Application</header><text display-inline="yes-display-inline">A municipality that seeks to participate in the demonstration grant program shall submit to the Administrator a plan that—</text> <subparagraph commented="no" display-inline="no-display-inline" id="IDBFB5EF30A50843D09B8A98583ACF54DA"><enum>(A)</enum><text display-inline="yes-display-inline">is developed in coordination with—</text> <clause commented="no" display-inline="no-display-inline" id="ID732E5A531C484BFAA2845E48A5F66A07"><enum>(i)</enum><text display-inline="yes-display-inline">the agency of the State having jurisdiction over water quality or water supply matters; and</text> </clause><clause commented="no" display-inline="no-display-inline" id="IDAD2BE68A0F234378B5DCF2FA4427E0F9"><enum>(ii)</enum><text display-inline="yes-display-inline">interested stakeholders;</text> </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID05C2E3333318478AAD373028D3DAE59C"><enum>(B)</enum><text display-inline="yes-display-inline">describes water impacts specific to urban or rural areas;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3F3A029B64644CC3A8F2982695BC95A0"><enum>(C)</enum><text display-inline="yes-display-inline">includes a strategy under which the municipality, through participation in the demonstration grant program, could effectively—</text> <clause commented="no" display-inline="no-display-inline" id="ID4F28D5EA427A49D68634CE4E85CE0D00"><enum>(i)</enum><text display-inline="yes-display-inline">address water quality or water supply problems; and</text> </clause><clause commented="no" display-inline="no-display-inline" id="ID880D5DD9A65B4149BF0AEF36FE440264"><enum>(ii)</enum><text display-inline="yes-display-inline">achieve the water quality goals that—</text> <subclause commented="no" display-inline="no-display-inline" id="ID4D6770FD363845CB825AF32FDD3BD8E8"><enum>(I)</enum><text display-inline="yes-display-inline">could be achieved using more traditional methods; and</text> </subclause><subclause commented="no" display-inline="no-display-inline" id="IDA5949DFC01FD4ACF9EE7BA7E916B279A"><enum>(II)</enum><text display-inline="yes-display-inline">are required under—</text> <item commented="no" display-inline="no-display-inline" id="ID4344C6A8915642768579590A6E731F90"><enum>(aa)</enum><text display-inline="yes-display-inline">the <act-name parsable-cite="FWPCA">Federal Water Pollution Control Act</act-name> (33 U.S.C. 1251 et seq.); or</text> </item><item commented="no" display-inline="no-display-inline" id="IDB6B8A15BDC564BD0BDAAD770E4765D48"><enum>(bb)</enum><text display-inline="yes-display-inline">the Safe Drinking Water Act (42 U.S.C. 300f et seq.); and</text> </item></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID600EF5EDA0664E959E4221B42654C884"><enum>(D)</enum><text display-inline="yes-display-inline">includes a schedule for achieving the water quality or water supply goals of the municipality.</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2C83AFB4A6654E5AB037E0B2FE9222E2"><enum>(2)</enum><header>Types of projects</header><text display-inline="yes-display-inline">In carrying out the demonstration grant program, the Administrator shall provide grants for projects relating to water supply or water quality matters such as—</text> <subparagraph commented="no" display-inline="no-display-inline" id="IDE2730C492C484450A1634AA306FA8C29"><enum>(A)</enum><text display-inline="yes-display-inline">excessive nutrient growth;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDC849EA53390C485E9CAEBF7D3B61B0F4"><enum>(B)</enum><text display-inline="yes-display-inline">urban or rural population pressure;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID72016DFA64F14BFD9C13E23BD1C5CC6B"><enum>(C)</enum><text display-inline="yes-display-inline">lack of an alternative water supply;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDD8B7DCC090994DBA8C79BECFC39198A7"><enum>(D)</enum><text display-inline="yes-display-inline">difficulties in water conservation and efficiency;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDDE8DA0FADBC348D7A865585D99CA27A0"><enum>(E)</enum><text display-inline="yes-display-inline">lack of support tools and technologies to rehabilitate and replace water supplies;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6327DB00BEBB4C709932BF70E98D06C8"><enum>(F)</enum><text display-inline="yes-display-inline">lack of monitoring and data analysis for water distribution systems;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDD2354265B7174FA8AD83441F348D107F"><enum>(G)</enum><text display-inline="yes-display-inline">nonpoint source water pollution (including stormwater);</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID601D475F51684159876B510FFA6B3BE5"><enum>(H)</enum><text display-inline="yes-display-inline">sanitary overflows;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4F8FD53662904CB8B24B43C8A7C4F52C"><enum>(I)</enum><text display-inline="yes-display-inline">combined sewer overflows;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDF96BEAC8677443B592A8D50A784E4D3A"><enum>(J)</enum><text display-inline="yes-display-inline">problems with naturally occurring constituents of concern;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID5382C28825EC402697FD4C2D008E54F9"><enum>(K)</enum><text display-inline="yes-display-inline">problems with erosion and excess sediment;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDFC752249382C47C4A5DC1F83C94BD68C"><enum>(L)</enum><text display-inline="yes-display-inline">new approaches to water treatment, distribution, and collection systems; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3FA8487D99FF4D3B898217EE9B89CA9A"><enum>(M)</enum><text display-inline="yes-display-inline">new methods for collecting and treating wastewater (including system design and nonstructural alternatives).</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID837DFD417D994A9BAD425CBF8F9DDA04"><enum>(3)</enum><header>Responsibilities of Administrator</header><text display-inline="yes-display-inline">In providing grants for projects under this subsection, the Administrator shall—</text> <subparagraph commented="no" display-inline="no-display-inline" id="IDC0DD36ADEDBF44DAAF92DF790DFA153E"><enum>(A)</enum><text display-inline="yes-display-inline">ensure, to the maximum extent practicable, that—</text> <clause commented="no" display-inline="no-display-inline" id="ID163549ACDDA8470992C80C294BB4E0D3"><enum>(i)</enum><text display-inline="yes-display-inline">the demonstration program includes a variety of projects with respect to—</text> <subclause commented="no" display-inline="no-display-inline" id="ID73A36F86107B4C59B3CF938688721037"><enum>(I)</enum><text display-inline="yes-display-inline">geographic distribution;</text> </subclause><subclause commented="no" display-inline="no-display-inline" id="IDA163AE3392A340389F94B9C6EE7A7AAC"><enum>(II)</enum><text display-inline="yes-display-inline">innovative technologies used for the projects; and</text> </subclause><subclause commented="no" display-inline="no-display-inline" id="IDC52E67C8E97E4634973377696D8A158E"><enum>(III)</enum><text display-inline="yes-display-inline">nontraditional approaches (including low-impact development technologies) used for the projects; and</text> </subclause></clause><clause commented="no" display-inline="no-display-inline" id="ID01693C284FD743D489A29D31A485CDBB"><enum>(ii)</enum><text display-inline="yes-display-inline">each category of project described in paragraph (2) is adequately represented;</text> </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3FDBD44F7B1B400C9837AAA4300D8DD2"><enum>(B)</enum><text display-inline="yes-display-inline">give higher priority to projects that—</text> <clause commented="no" display-inline="no-display-inline" id="ID11F45FFACC95442BB3DC1B3666BB09BD"><enum>(i)</enum><text display-inline="yes-display-inline">address multiple problems; and</text> </clause><clause commented="no" display-inline="no-display-inline" id="IDEC75B286ABEB4D7193EC40670AAE7BF0"><enum>(ii)</enum><text display-inline="yes-display-inline">are regionally applicable;</text> </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDC462C756528042B9B054EDA8148BA152"><enum>(C)</enum><text display-inline="yes-display-inline">ensure, to the maximum extent practicable, that at least 1 community having a population of 10,000 or fewer individuals receives a grant for each fiscal year; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDEF087ED65199473BBCEECEFDB7C89C6D"><enum>(D)</enum><text display-inline="yes-display-inline">ensure that, for each fiscal year, no municipality receives more than 25 percent of the total amount of funds made available for the fiscal year to provide grants under this section.</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID29D2570851C84F0B85A7E828C51012C4"><enum>(4)</enum><header>Cost sharing</header> <subparagraph commented="no" display-inline="no-display-inline" id="ID51D84E0DC2304938961047BEC67AA1FB"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subparagraph (B), the non-Federal share of the total cost of a project funded by a grant under this section shall be not less than 20 percent.</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID89FB8C346B0C40429FB956DBC2A7991D"><enum>(B)</enum><header>Waiver</header><text display-inline="yes-display-inline">The Administrator may reduce or eliminate the non-Federal share of the cost of a project for reasons of affordability.</text> </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDC5EB08B3129946BC95BB72032551F764"><enum>(c)</enum><header>Reports</header> <paragraph commented="no" display-inline="no-display-inline" id="ID3A90262B1BB34760BB7DDDF9F9B01790"><enum>(1)</enum><header>Reports from grant recipients</header><text display-inline="yes-display-inline">A recipient of a grant under this section shall submit to the Administrator, on the date of completion of a project of the recipient and on each of the dates that is 1, 2, and 3 years after that date, a report that describes the effectiveness of the project.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDA2E91ABAB3AB452A81200CB4640D95E0"><enum>(2)</enum><header>Reports to Congress</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this Act, and every 2 years thereafter, the Administrator shall submit to the Committee on Environment and Public Works of the Senate and the Committee on Transportation and Infrastructure and the Committee on Energy and Commerce of the House of Representatives a report that describes the status and results of the demonstration program.</text> </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDCF652FA0C9CF45EB987FD7668C1C4089"><enum>(d)</enum><header>Incorporation of results and information</header><text display-inline="yes-display-inline">To the maximum extent practicable, the Administrator shall incorporate the results of, and information obtained from, successful projects under this section into programs administered by the Administrator.</text> </subsection><subsection commented="no" display-inline="no-display-inline" id="ID5271CFF605D0439E85089FBDB72A53CB"><enum>(e)</enum><header>Research and development</header> <paragraph commented="no" display-inline="no-display-inline" id="IDDF2D93F393C345869A2F564D1ABE1781"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">As soon as practicable after the date of enactment of this Act, the Administrator shall, through a competitive process, award grants and enter into contracts and cooperative agreements with research institutions, educational institutions, and other appropriate entities (including consortia of such institutions and entities) for research and development on the use of innovative and alternative technologies to improve water quality or drinking water supply.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE9322260AB2C4610800DD0E92E06FC86"><enum>(2)</enum><header>Types of projects</header><text display-inline="yes-display-inline">In carrying out this subsection, the Administrator may select projects relating to such matters as innovative or alternative technologies, approaches, practices, or methods—</text> <subparagraph commented="no" display-inline="no-display-inline" id="ID3A5B7779254D47BD9CAC6D9581F02C0F"><enum>(A)</enum><text display-inline="yes-display-inline">to increase the effectiveness and efficiency of public water supply systems, including—</text> <clause commented="no" display-inline="no-display-inline" id="ID970ECEA90DAD425E8A77EA0E6E4D81B6"><enum>(i)</enum><text display-inline="yes-display-inline">source water protection;</text> </clause><clause commented="no" display-inline="no-display-inline" id="IDA870C932208E4E94887ABC0CFB4F116F"><enum>(ii)</enum><text display-inline="yes-display-inline">water use reduction;</text> </clause><clause commented="no" display-inline="no-display-inline" id="ID8D4ECCBF42B34DA5904B5B7CCC52B32C"><enum>(iii)</enum><text display-inline="yes-display-inline">water reuse;</text> </clause><clause commented="no" display-inline="no-display-inline" id="ID8A85F59C76724484AA232E40287EB4EC"><enum>(iv)</enum><text display-inline="yes-display-inline">water treatment;</text> </clause><clause commented="no" display-inline="no-display-inline" id="ID8CC9265D6D01472AB0A3C7D4139E9581"><enum>(v)</enum><text display-inline="yes-display-inline">water distribution and collection systems; and</text> </clause><clause commented="no" display-inline="no-display-inline" id="IDD5502C6C2F734530B0CC8CA79779459D"><enum>(vi)</enum><text display-inline="yes-display-inline">water security;</text> </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9BEAACD4010C409D9655E93BAB9C755E"><enum>(B)</enum><text display-inline="yes-display-inline">to encourage the use of innovative or alternative technologies or approaches relating to water supply or availability;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID884F1C0DF9C5426B9E8F4126B4D87810"><enum>(C)</enum><text display-inline="yes-display-inline">to increase the effectiveness and efficiency of new and existing treatment works, including—</text> <clause commented="no" display-inline="no-display-inline" id="ID5CC2FAED2EB04A3194B4B2F96E335A2D"><enum>(i)</enum><text display-inline="yes-display-inline">methods of collecting, treating, dispersing, reusing, reclaiming, and recycling wastewater;</text> </clause><clause commented="no" display-inline="no-display-inline" id="ID6662F9662E024DB696C54883F104555D"><enum>(ii)</enum><text display-inline="yes-display-inline">system design;</text> </clause><clause commented="no" display-inline="no-display-inline" id="ID207F77CD785B4F5599C3DA49C879F957"><enum>(iii)</enum><text display-inline="yes-display-inline">nonstructural alternatives;</text> </clause><clause commented="no" display-inline="no-display-inline" id="ID618B1AB5F1A24FEABC2BF13CAC733ECB"><enum>(iv)</enum><text display-inline="yes-display-inline">decentralized approaches;</text> </clause><clause commented="no" display-inline="no-display-inline" id="ID3AB6BDAB33D143A3AD99178CB5179DAF"><enum>(v)</enum><text display-inline="yes-display-inline">assessment;</text> </clause><clause commented="no" display-inline="no-display-inline" id="IDEE95453C7129427189BC121B526B7B1B"><enum>(vi)</enum><text display-inline="yes-display-inline">water efficiency; and</text> </clause><clause commented="no" display-inline="no-display-inline" id="ID0B9D54CBB7C4485A862E7E31F6D42EB1"><enum>(vii)</enum><text display-inline="yes-display-inline">wastewater security;</text> </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF64E80F690794D95ACBEDC7E83260276"><enum>(D)</enum><text display-inline="yes-display-inline">to increase the effectiveness and efficiency of municipal separate storm sewer systems;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id46B713D799294E959B4C5A42F408B18C"><enum>(E)</enum><text display-inline="yes-display-inline">to promote new water treatment technologies, including commercialization and dissemination strategies for adoption of innovative or alternative low impact development technologies in the homebuilding industry; or</text> to be appropriated to carry out this subsection $20,000,000 for each of fiscal years 2006 through 2010.</text> </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDAE7A4BD004DB42679610ED1D6F7E07A6"><enum>(f)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out this section (other than subsection (e)) $20,000,000 for each of fiscal years 2006 through 2010.</text> </subsection></section><section commented="no" display-inline="no-display-inline" id="idD66AB8E8AEF3458CAA6C1FA13549D6B6" section-type="subsequent-section"><enum>303.</enum><header>Agricultural pollution control technology grant program</header> <subsection commented="no" display-inline="no-display-inline" id="id2F4FA616F6A64FFAAB4256B810E44DEB"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph commented="no" display-inline="no-display-inline" id="id66DA53091107400FAEE3A34207684FA8"><enum>(1)</enum><header>Administrator</header><text display-inline="yes-display-inline">The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idAF8AEE20D71A437391634B7D3E726A9C"><enum>(2)</enum><header>Agricultural commodity</header><text display-inline="yes-display-inline">The term <term>agricultural commodity</term> means—</text> <subparagraph commented="no" display-inline="no-display-inline" id="ID0582cc3edfd347ec86a4f6edf9142824"><enum>(A)</enum><text display-inline="yes-display-inline">agricultural, horticultural, viticultural, and dairy products;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDa0bb4443863b46bebf4dbc3a27f55623"><enum>(B)</enum><text display-inline="yes-display-inline">livestock and the products of livestock;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDaf9a183909c34c2cb0ee62d4b200f1d1"><enum>(C)</enum><text display-inline="yes-display-inline">the products of poultry and bee raising;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDda6e68bbc428486995b4618f69453c8b"><enum>(D)</enum><text display-inline="yes-display-inline">the products of forestry;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDb67c4a1ee2f340a69717edb18ddf4b0c"><enum>(E)</enum><text display-inline="yes-display-inline">other commodities raised or produced on agricultural sites, as determined to be appropriate by the Secretary; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDb5e4aa2c0e054065aa8db4072da9afbe"><enum>(F)</enum><text display-inline="yes-display-inline">products processed or manufactured from products specified in subparagraphs (A) through (E), as determined by the Secretary.</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE4595E24CF3A4B8A8F67ED82A5A09C59"><enum>(3)</enum><header>Agricultural project</header><text display-inline="yes-display-inline">The term <term>agricultural project</term> means an agricultural pollution control technology project that, as determined by the Administrator—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id10721344DC84427F9A5ECBB597774DEF"><enum>(A)</enum><text display-inline="yes-display-inline">is carried out at an agricultural site; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idCE1F434C372B4FE08020DC6C08D5030E"><enum>(B)</enum><text display-inline="yes-display-inline">achieves demonstrable reductions in air and water pollution.</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id219DA83A581342A4A19B0F05E4D598FD"><enum>(4)</enum><header>Agricultural site</header><text display-inline="yes-display-inline">The term <term>agricultural site</term> means a farming or ranching operation of a producer.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0ca88fc5b5e74968ac1036f2c737b508"><enum>(5)</enum><header>Producer</header><text display-inline="yes-display-inline">The term <term>producer</term> means any person who is engaged in the production and sale of an agricultural commodity in the United States and who owns, or shares the ownership and risk of loss of, the agricultural commodity.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4388347E5067427A81FAC1AD43348E10"><enum>(6)</enum><header>Revolving fund</header><text display-inline="yes-display-inline">The term <term>revolving fund</term> means an agricultural pollution control technology State revolving fund established by a State using amounts provided under subsection (b)(1).</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7140D5F6FB954EDD934B60E56F32F590"><enum>(7)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of Agriculture.</text> </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id4C75626EA3CD4571BB41F958821372CF"><enum>(b)</enum><header>Grants for Agricultural State Revolving Funds</header> <paragraph commented="no" display-inline="no-display-inline" id="id2C35FE049C58459295989229DF8FF998"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">As soon as practicable after the date of enactment of this section, the Administrator shall provide to each eligible State described in paragraph (2) 1 or more capitalization grants, that cumulatively equal no more than $1,000,000 per State, for use in establishing, within an agency of the State having jurisdiction over agriculture or environmental quality, an agricultural pollution control technology State revolving fund.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD4203BAFE84B4623A95C62F6C15C582F"><enum>(2)</enum><header>Eligible states</header><text display-inline="yes-display-inline">An eligible State referred to in paragraph (1) is a State that agrees, prior to receipt of a capitalization grant under paragraph (1)—</text> <subparagraph commented="no" display-inline="no-display-inline" id="idF26F7A5E6A484BF0A4640B998E5F2BC6"><enum>(A)</enum><text display-inline="yes-display-inline">to establish, and deposit the funds from the grant in, a revolving fund;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id142B023A02BA4673A6712F92F58B6FDD"><enum>(B)</enum><text display-inline="yes-display-inline">to provide, at a minimum, a State share in an amount equal to 20 percent of the capitalization grant;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD7E6FF635C1D465CBB4CE0692FFF3B9A"><enum>(C)</enum><text display-inline="yes-display-inline">to use amounts in the revolving fund to make loans to producers in accordance with subsection (c); and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id846FAD3249DD4294B5A346F0398596F9"><enum>(D)</enum><text display-inline="yes-display-inline">to return amounts in the revolving fund if no loan applications are granted within 2 years of the receipt of the initial capitalization grant.</text> </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id12D900C0865A47DC870B153E80E8C8CA"><enum>(c)</enum><header>Loans to producers</header> <paragraph commented="no" display-inline="no-display-inline" id="id005EE5C7863F42009BE90BAF3CDE7D30"><enum>(1)</enum><header>Use of funds</header><text display-inline="yes-display-inline">A State that establishes a revolving fund under subsection (b)(2) shall use amounts in the revolving fund to provide loans to producers for use in designing and constructing agricultural projects.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id33AD2D0B82404D9C8E4A347469AF9277"><enum>(2)</enum><header>Maximum amount of loan</header><text display-inline="yes-display-inline">The amount of a loan made to a producer using funds from a revolving fund shall not exceed $250,000, in the aggregate, for all agricultural projects serving an agricultural site of the producer.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4E9FE9DBCB0A4F28A5433B38AD5792BA"><enum>(3)</enum><header>Conditions on loans</header><text display-inline="yes-display-inline">A loan made to a producer using funds from a revolving fund shall—</text> <subparagraph commented="no" display-inline="no-display-inline" id="idD9F03DFBCB6C453F933FC495F232BF0B"><enum>(A)</enum><text display-inline="yes-display-inline">have an interest rate that is not more than the market interest rate, including an interest-free loan; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id57A08C9FDA8E44FEBCF483D10DE511C8"><enum>(B)</enum><text display-inline="yes-display-inline">be repaid to the revolving fund not later than 10 years after the date on which the loan is made.</text> </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id24922CAEF9934F698D59464C71439E22"><enum>(d)</enum><header>Requirements for producers</header> <paragraph commented="no" display-inline="no-display-inline" id="id8AFD24EE30A940B791347C2494A7C532"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A producer that seeks to receive a loan from a revolving fund shall—</text> <subparagraph commented="no" display-inline="no-display-inline" id="idE79CD5407D0D44358C0F6DACF445AA1F"><enum>(A)</enum><text display-inline="yes-display-inline">submit to the State in which the agricultural site of the producer is located an application that—</text> <clause commented="no" display-inline="no-display-inline" id="id2FEE8F6FAEDD4E82BD2B277468FC7697"><enum>(i)</enum><text display-inline="yes-display-inline">contains such information as the State may require; and</text> </clause><clause commented="no" display-inline="no-display-inline" id="id56E163B2399A47EABD025BC3D5ABDEFB"><enum>(ii)</enum><text display-inline="yes-display-inline">demonstrates, to the satisfaction of the State, that each project proposed to be carried out with funds from the loan is an agricultural project; and</text> </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idEE0F13B448A74B67818B297044B124AD"><enum>(B)</enum><text display-inline="yes-display-inline">agree to expend all funds from a loan in an expeditious and timely manner, as determined by the State.</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA82115ACBA0B4570A265E597AEBA3F42"><enum>(2)</enum><header>Maximum percentage of agricultural project cost</header><text display-inline="yes-display-inline">Subject to subsection (c)(2), a producer that receives a loan from a revolving fund may use funds from the loan to pay up to 100 percent of the cost of carrying out an agricultural project.</text> </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id22666732E24644328B329D27DD078C82"><enum>(e)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out this section $50,000,000.</text> </subsection></section><section commented="no" display-inline="no-display-inline" id="ID8E33747FD368441AA90CDD895A9C99D8" section-type="subsequent-section"><enum>304.</enum><header>State revolving fund review process</header><text display-inline="no-display-inline">As soon as practicable after the date of enactment of this Act, the Administrator shall—</text> <paragraph commented="no" display-inline="no-display-inline" id="IDBEF3CBDD04D8414497EC1DCEF4C123D6"><enum>(1)</enum><text display-inline="yes-display-inline">consult with States, utilities, and other Federal agencies providing financial assistance to identify ways to expedite and improve the application and review process for the provision of assistance from—</text> <subparagraph commented="no" display-inline="no-display-inline" id="ID787EDEE61E1D435F97968A109A793664"><enum>(A)</enum><text display-inline="yes-display-inline">the State water pollution control revolving funds established under title VI of the <act-name parsable-cite="FWPCA">Federal Water Pollution Control Act</act-name> (33 U.S.C. 1381 et seq.); and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4E94A546C695431EBC5008114D8B59D9"><enum>(B)</enum><text display-inline="yes-display-inline">the State drinking water treatment revolving loan funds established under section 1452 of the Safe Drinking Water Act (42 U.S.C. 300j–12);</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDB1155AA3DE784C4397AD7F5F0FF6298E"><enum>(2)</enum><text display-inline="yes-display-inline">take such administrative action as is necessary to expedite and improve the process as the Administrator has authority to take under existing law;</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC84AAA5C4BF04F2E9BDFB94A620BAC05"><enum>(3)</enum><text display-inline="yes-display-inline">collect information relating to innovative approaches taken by any State to simplify the application process of the State, and provide the information to each State; and</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDFD0C434842FB450187D7A0645C514974"><enum>(4)</enum><text display-inline="yes-display-inline">submit to Congress a report that, based on the information identified under paragraph (1), contains recommendations for legislation to facilitate further streamlining and improvement of the process.</text> </paragraph></section><section commented="no" display-inline="no-display-inline" id="ID8275407332414D7A978F44364CA637A3" section-type="subsequent-section"><enum>305.</enum><header>Cost of service study</header> <subsection commented="no" display-inline="no-display-inline" id="ID99645BAC983543C0993DAC055DEE8BE1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this Act, the Administrator shall enter into a contract with the National Academy of Sciences for, and the National Academy of Sciences shall complete and provide to the Administrator the results of, a study of the means by which public water systems and treatment works selected by the Academy in accordance with subsection (c) meet the costs associated with operations, maintenance, capital replacement, and regulatory requirements.</text> </subsection><subsection commented="no" display-inline="no-display-inline" id="IDED063FA8C8A548639763DCACF9FB961C"><enum>(b)</enum><header>Required elements</header> <paragraph commented="no" display-inline="no-display-inline" id="ID50166433F612467394E379C6ABD45B3F"><enum>(1)</enum><header>Affordability</header><text display-inline="yes-display-inline">The study shall, at a minimum—</text> <subparagraph commented="no" display-inline="no-display-inline" id="ID76086cba3fe94cffba3d3bb4aad2f75b"><enum>(A)</enum><text display-inline="yes-display-inline">determine whether the rates at public water systems and treatment works for communities included in the study were established using a full-cost pricing model;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDb1b02c6978804e898aacc6106055399f"><enum>(B)</enum><text display-inline="yes-display-inline">if a full-cost pricing model was not used, identify any incentive rate systems that have been successful in significantly reducing—</text> <clause commented="no" display-inline="no-display-inline" id="id372C0DA37F944028A5ED0C7C8ED2584B"><enum>(i)</enum><text display-inline="yes-display-inline">per capita water demand;</text> </clause><clause commented="no" display-inline="no-display-inline" id="IDe59fb629ce2d4a8ebc6f35881de3baa4"><enum>(ii)</enum><text display-inline="yes-display-inline">the volume of wastewater flows;</text> </clause><clause commented="no" display-inline="no-display-inline" id="ID98ea46115db04220abff36ece1fdd18c"><enum>(iii)</enum><text display-inline="yes-display-inline">the volume of stormwater runoff; or</text> </clause><clause commented="no" display-inline="no-display-inline" id="ID308e60b7a69542909c7c76af061fe679"><enum>(iv)</enum><text display-inline="yes-display-inline">the quantity of pollution generated by stormwater;</text> </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID582280bb53624b54a927cec09836ba4a"><enum>(C)</enum><text display-inline="yes-display-inline">identify a set of best industry practices that public water systems and treatment works may use in establishing a rate structure that—</text> <clause commented="no" display-inline="no-display-inline" id="ID85062e1fdd2d43a9900142df0e4138e4"><enum>(i)</enum><text display-inline="yes-display-inline">adequately addresses the true cost of services provided to consumers by public water systems and treatment works, including infrastructure replacement;</text> </clause><clause commented="no" display-inline="no-display-inline" id="IDb3abd3f5ea6c40f4841bbe8657793e06"><enum>(ii)</enum><text display-inline="yes-display-inline">encourages water conservation; and</text> </clause><clause commented="no" display-inline="no-display-inline" id="ID8566e70822e24e33ae79075cba5a0d37"><enum>(iii)</enum><text display-inline="yes-display-inline">takes into consideration the needs of disadvantaged individuals and communities, as identified by the Administrator;</text> </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDF5D6426086674A1CBFAE8061C8464ADA"><enum>(D)</enum><text display-inline="yes-display-inline">identify existing standards for affordability;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID965352C912EC4B0EA1807643040165E3"><enum>(E)</enum><text display-inline="yes-display-inline">determine the manner in which those standards are determined and defined;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID5D88A6765FFD48A9AF7D159D2031B491"><enum>(F)</enum><text display-inline="yes-display-inline">determine the manner in which affordability varies with respect to communities of different sizes and in different regions; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDA49A2106B00643EF90C632A51D67A45F"><enum>(G)</enum><text display-inline="yes-display-inline">determine the extent to which affordability affects the decision of a community to increase public water system and treatment works rates (including the decision relating to the percentage by which those rates should be increased).</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID813263657AAD4EC28731E3794410C648"><enum>(2)</enum><header>Disadvantaged communities</header><text display-inline="yes-display-inline">The study shall, at a minimum—</text> <subparagraph commented="no" display-inline="no-display-inline" id="ID482FEA5C94B84933BF7D7E5F3D3E0A6F"><enum>(A)</enum><text display-inline="yes-display-inline">survey a cross-section of States representing different sizes, demographics, and geographical regions;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID7E89017A01CD4D898C8FF5132E7AF1C9"><enum>(B)</enum><text display-inline="yes-display-inline">describe, for each State described in subparagraph (A), the definition of <quote>disadvantaged community</quote> used in the State in carrying out projects and activities under the Safe Drinking Water Act (42 U.S.C. 300f et seq.);</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID69D9BCFC4FB14F35BC842C7E22621E03"><enum>(C)</enum><text display-inline="yes-display-inline">review other means of identifying the meaning of the term <term>disadvantaged</term>, as that term applies to communities;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDCAA6AB08463746418D72031B257A6991"><enum>(D)</enum><text display-inline="yes-display-inline">determine which factors and characteristics are required for a community to be considered <quote>disadvantaged</quote>; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDC52914806E8A407A9D53FE75933DE4C1"><enum>(E)</enum><text display-inline="yes-display-inline">evaluate the degree to which factors such as a reduction in the tax base over a period of time, a reduction in population, the loss of an industrial base, and the existence of areas of concentrated poverty are taken into account in determining whether a community is a disadvantaged community.</text> </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID2CA5381AE0DD4866B405639C94605615"><enum>(c)</enum><header>Selection of communities</header><text display-inline="yes-display-inline">The National Academy of Sciences shall select communities, the public water system and treatment works rate structures of which are to be studied under this section, that include a cross-section of communities representing various populations, income levels, demographics, and geographical regions.</text> </subsection><subsection commented="no" display-inline="no-display-inline" id="ID2CA13E8A131644DABFD16872278B815B"><enum>(d)</enum><header>Use of results of study</header><text display-inline="yes-display-inline">On receipt of the results of the study, the Administrator shall—</text> <paragraph commented="no" display-inline="no-display-inline" id="IDD9338B5C9D9448F8BDAA6E5EE012696D"><enum>(1)</enum><text display-inline="yes-display-inline">submit to Congress a report that describes the results of the study; and</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5812789634D44E83A3D467275861C830"><enum>(2)</enum><text display-inline="yes-display-inline">make the results available to treatment works and public water systems for use by the publicly owned treatment works and public water systems, on a voluntary basis, in determining whether 1 or more new approaches may be implemented at facilities of the publicly owned treatment works and public water systems.</text> </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID6A8076C21EBE48BEA045AE0335ED83B8"><enum>(e)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out this section $1,000,000 for each of fiscal years 2006 and 2007.</text> </subsection></section><section commented="no" display-inline="no-display-inline" id="ID83149db43045451c8291309b3156b236" section-type="subsequent-section"><enum>306.</enum><header>Water resources study</header> <subsection commented="no" display-inline="no-display-inline" id="ID719f3653223e4d43a468212a133254ed"><enum>(a)</enum><header>Assessment</header> <paragraph commented="no" display-inline="no-display-inline" id="IDd8d7dcc2b9a9492e8faf6d437bf84ab6"><enum>(1)</enum><header>In General</header><text display-inline="yes-display-inline">The Secretary shall—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id3C8FFC44D6AB481992C2DFCB73A69280"><enum>(A)</enum><text display-inline="yes-display-inline">not later than 2 years after the date of enactment of this Act, conduct an assessment of water resources in the United States; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idAC6DDACF426847BE91755553B38C63CB"><enum>(B)</enum><text display-inline="yes-display-inline">update the assessment every 2 years thereafter.</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID63695f3a2251429193602cdf4639eeab"><enum>(2)</enum><header>Components</header><text display-inline="yes-display-inline">The assessment shall, at a minimum—</text> <subparagraph commented="no" display-inline="no-display-inline" id="IDc5e3d3d655d948858a6de98f2dd18093"><enum>(A)</enum><text display-inline="yes-display-inline">measure the status and trends of—</text> <clause commented="no" display-inline="no-display-inline" id="ID0296e07048744cdab7114221cf49f110"><enum>(i)</enum><text display-inline="yes-display-inline">fresh water in rivers and reservoirs;</text> </clause><clause commented="no" display-inline="no-display-inline" id="ID3a0b60d0e51b40d9ad013bf382ff0d96"><enum>(ii)</enum><text display-inline="yes-display-inline">groundwater levels and volume of useable fresh water stored in aquifers; and</text> </clause><clause commented="no" display-inline="no-display-inline" id="IDb8b1731109b54fcf98aaba05a621ffb1"><enum>(iii)</enum><text display-inline="yes-display-inline">fresh water withdrawn from streams and aquifers in the United States; and</text> </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1d40490bc80246e98c497ce3e0ab9b8a"><enum>(B)</enum><text display-inline="yes-display-inline">provide those measurements for—</text> <clause commented="no" display-inline="no-display-inline" id="IDd1d0cb0a7b3149d1afd7207b751d42c2"><enum>(i)</enum><text display-inline="yes-display-inline">watersheds defined by the 352 hydrologic accounting units of the United States; and</text> </clause><clause commented="no" display-inline="no-display-inline" id="ID07c52741fa1443e2acd2c8d80d0fcf49"><enum>(ii)</enum><text display-inline="yes-display-inline">major aquifers of the United States, as identified by the Secretary.</text> </clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDaa920e7067054f0486f13a23b1f1e7ce"><enum>(3)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of completion of the assessment and every 2 years thereafter, the Secretary shall submit to Congress a report—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id87C2470FA2374191AB662455426DC129"><enum>(A)</enum><text display-inline="yes-display-inline">describing the results of the assessment; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idFE0F39103C434CA78760F61C0720EA5D"><enum>(B)</enum><text display-inline="yes-display-inline">containing any recommendations of the Secretary relating to the assessment that—</text> <clause commented="no" display-inline="no-display-inline" id="idD800D94C95FA4885B678EB28083FDAAC"><enum>(i)</enum><text display-inline="yes-display-inline">are consistent with existing laws, treaties, decrees, and interstate compacts; and</text> </clause><clause commented="no" display-inline="no-display-inline" id="id82913654605F49FC9441C2C948946DFA"><enum>(ii)</enum><text display-inline="yes-display-inline">respect the primary role of States in adjudicating, administering, and regulating water rights and uses.</text> </clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID47298becc5364387874e81322b5f6594"><enum>(b)</enum><header>Water Resource Research Priorities</header> <paragraph commented="no" display-inline="no-display-inline" id="IDb4c10cff479b461cbb6bd2a9ace4bc03"><enum>(1)</enum><header>In General</header><text display-inline="yes-display-inline">The Secretary shall coordinate a process among Federal agencies and appropriate State agencies to develop and publish, not later than 1 year after the date of enactment of this Act, a list of water resource research priorities that focuses on—</text> <subparagraph commented="no" display-inline="no-display-inline" id="IDdfd0afbd3a374aadaa7cc7b965724d4e"><enum>(A)</enum><text display-inline="yes-display-inline">water supply monitoring;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDc116b9da6fcc4633a329a92c732df93a"><enum>(B)</enum><text display-inline="yes-display-inline">means of capturing excess water and flood water for conservation and use in the event of a drought;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3cd3679f339d468a89829f455e9e8c70"><enum>(C)</enum><text display-inline="yes-display-inline">strategies to conserve existing water supplies, including recommendations for repairing aging infrastructure;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID83cd5aa0109445b4ad380bc43343cfe0"><enum>(D)</enum><text display-inline="yes-display-inline">identifying incentives to ensure an adequate and dependable supply of water;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID845e7e75404e4e25a887f0d35f37a467"><enum>(E)</enum><text display-inline="yes-display-inline">identifying available technologies and other methods to optimize water supply reliability, availability, and quality, while safeguarding the environment; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID11de5a6d94974eaab673c9075238e42b"><enum>(F)</enum><text display-inline="yes-display-inline">improving the quality of water resource information available to State, tribal, and local water resource managers.</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0141142df33443d6aacd21bf75f5356a"><enum>(2)</enum><header>Use of List</header><text display-inline="yes-display-inline">The list published under paragraph (1) shall be used by Federal agencies as a guide in making decisions on the allocation of water research funding.</text> </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID208911af2cfd4741930d5f9d58d7034a"><enum>(c)</enum><header>Information Delivery System</header> <paragraph commented="no" display-inline="no-display-inline" id="ID6dc51efb3e494b40a90d4a87cc4e38b1"><enum>(1)</enum><header>In General</header><text display-inline="yes-display-inline">The Secretary shall coordinate a process to develop an effective information delivery system to communicate information described in paragraph (2) to—</text> <subparagraph commented="no" display-inline="no-display-inline" id="IDd6c444f6bff44d79b013113b59ca36db"><enum>(A)</enum><text display-inline="yes-display-inline">decisionmakers at the Federal, regional, State, tribal, and local levels;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDb8112e0ff0034caeb9f62c3c002d8d4e"><enum>(B)</enum><text display-inline="yes-display-inline">the private sector; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDb7f598cc8d4a4cd2ad21714801cb3d4b"><enum>(C)</enum><text display-inline="yes-display-inline">the general public.</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6ae7f253f7a04518876e1b23d79088f2"><enum>(2)</enum><header>Types of Information</header><text display-inline="yes-display-inline">The information referred to in paragraph (1) may include—</text> <subparagraph commented="no" display-inline="no-display-inline" id="IDd0db4c743f34400685b0abe5d89e7421"><enum>(A)</enum><text display-inline="yes-display-inline">the results of the national water resource assessments under subsection (a);</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDe0536432ed1c4c03b728b51bf6362a89"><enum>(B)</enum><text display-inline="yes-display-inline">a summary of the Federal water research priorities developed under subsection (b);</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID30d9a316f0734209b8e54ad19575fcd1"><enum>(C)</enum><text display-inline="yes-display-inline">near real-time data and other information on water shortages and surpluses;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID271be7a6466241b4b45094d6e4339c67"><enum>(D)</enum><text display-inline="yes-display-inline">planning models for water shortages or surpluses (at various levels including State, river basin, and watershed levels);</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID862a56e7a16c4683ad39df7cd839e1a8"><enum>(E)</enum><text display-inline="yes-display-inline">streamlined procedures for States and localities to interact with and obtain assistance from Federal agencies that perform water resource functions; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID696b25da6df245e4ba3bab7a9a34b2ab"><enum>(F)</enum><text display-inline="yes-display-inline">other water resource materials, as the Secretary determine appropriate.</text> </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idFE1F41BFBC924C168930E6DE0DA69A97"><enum>(d)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this Act, and every 2 years thereafter through fiscal year 2009, the Secretary shall submit to Congress a report on the implementation of this section.</text> </subsection><subsection commented="no" display-inline="no-display-inline" id="id834B59C326A74C30ACC92945FA439307"><enum>(e)</enum><header>Savings clause</header><text display-inline="yes-display-inline">Nothing in this section—</text> <paragraph commented="no" display-inline="no-display-inline" id="ID62dfe6b4003548a6a6f646cdc82f7cb1"><enum>(1)</enum><text display-inline="yes-display-inline">modifies, supercedes, abrogates, impairs, or otherwise affects in any way—</text> <subparagraph commented="no" display-inline="no-display-inline" id="idCC54B30F30E446A0B2857D7DC79A55C4"><enum>(A)</enum><text display-inline="yes-display-inline">any right or jurisdiction of any State with respect to the water (including boundary water) of the State;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDe24332942bab4a2c84c279517365b10e"><enum>(B)</enum><text display-inline="yes-display-inline">the authority of any State to allocate quantities of water within areas under the jurisdiction of the State; or</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDe7f2f2c65c8946a58adc1215c32b8755"><enum>(C)</enum><text display-inline="yes-display-inline">any right or claim to any quantity or use of water that has been adjudicated, allocated, or claimed—</text> <clause commented="no" display-inline="no-display-inline" id="ID716e91cace6345a598d0c4f18eec95ce"><enum>(i)</enum><text display-inline="yes-display-inline">in accordance with State law;</text> </clause><clause commented="no" display-inline="no-display-inline" id="ID968945bd36364f75acbd87b6dff4a4c9"><enum>(ii)</enum><text display-inline="yes-display-inline">in accordance with subsections (a) through (c) of section 208 of the Department of Justice Appropriation Act, 1953 (43 U.S.C. 666);</text> </clause><clause commented="no" display-inline="no-display-inline" id="IDbb1af660d33e4618adbad7618f66c1d7"><enum>(iii)</enum><text display-inline="yes-display-inline">by or pursuant to an interstate compact; or</text> </clause><clause commented="no" display-inline="no-display-inline" id="ID1a8f8b334d5242fb92481652e47f7496"><enum>(iv)</enum><text display-inline="yes-display-inline">by a decision of the United States Supreme Court;</text> </clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID885a2fd8c0204d61ac2a8ee29526b99b"><enum>(2)</enum><text display-inline="yes-display-inline">requires a change in the nature of use or the transfer of any right to use water or creates a limitation on the exercise of any right to use water; or</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDb9465dbab0424c5981a118bd0a6dfc40"><enum>(3)</enum><text display-inline="yes-display-inline">requires modifying the delivery, diversion, non-diversion, allocation, storage, or release from storage of any water to be delivered by contract.</text> </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDc18c1855ebd743009c12d084dc897f3b"><enum>(f)</enum><header>Authorization of Appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated—</text> <paragraph commented="no" display-inline="no-display-inline" id="id38F4B96E26AA4B649F7F8905C2877DEF"><enum>(1)</enum><text display-inline="yes-display-inline">to carry out the report authorized by this section, $3,000,000, to remain available until expended; and</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idBCADCBAB92A54F7292F1B3C0DE9136F6"><enum>(2)</enum><text display-inline="yes-display-inline">to carry out the updates authorized by subsection (a)(1)(B), such sums as are necessary.</text> </paragraph></subsection></section>
