			 Lobbying Disclosure Act of 1995 (2 U.S.C. 1605) is further amended—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="HC9B8DCF353A049E9BB24CA788EFAEE40"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (7), by striking

			 <quote>and</quote> at the end;</text>

				sortable, and downloadable manner, an electronic database that—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="H17A4E23D032448F7AD87F22193955200"><enum>(A)</enum><text display-inline="yes-display-inline">includes the information contained in

				registrations and reports filed under this Act;</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H01B92A39B47840D5953D22B5D7CEE100"><enum>(B)</enum><text display-inline="yes-display-inline">directly links the information it contains

				to the information disclosed in reports filed with the Federal Election

				Commission under section 304 of the Federal Election Campaign Act of 1971 (2

				U.S.C. 434); and</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFF786EDD4832493CA7FCA357DFDD327"><enum>(C)</enum><text display-inline="yes-display-inline">is searchable and sortable, at a minimum,

				by each of the categories of information described in section 4(b) or

				5(b).</text>

								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H0B7A96E4B8B6460690A93CB07C515B3E"><enum>(b)</enum><header>Availability of

			 reports</header><text display-inline="yes-display-inline">Section 6 of such Act

			 is further amended in paragraph (4) by inserting before the semicolon at the

			 end the following: <quote>and, in the case of a report filed in electronic form

			 pursuant to section 5(d), shall make such report available for public

			 inspection over the Internet not more than 48 hours after the report is so

			 filed</quote>.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="HD35E8F4B16024CF0ABA3F5A7333B70A4"><enum>(c)</enum><header>Authorization of

			 appropriations</header><text display-inline="yes-display-inline">There are

			 authorized to be appropriated such sums as may be necessary to carry out

			 paragraph (9) of section 6 of such Act, as added by subsection (a).</text>

			 officials with whom lobbying contacts are made</header><text display-inline="no-display-inline">Section 5 of the Lobbying Disclosure Act of

			 1995 (2 U.S.C. 1604) is further amended in subsection (b)(2)—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="H1BB7DFFE872C4AAAB5BAE05FDAEF5BA"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subparagraphs (B) through

			 (D) as subparagraphs (C) through (E), respectively; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HABB128DFF0C242A2B09BA847BD32C407"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after subparagraph (A) the

			 following new subparagraph:</text>

			 registered lobbyists of all past executive and congressional

			 employment</header><text display-inline="no-display-inline">Section 4 of the

			 Lobbying Disclosure Act of 1995 (2 U.S.C. 1603) is further amended in

			 subsection (b)(6) by striking <quote>or a covered legislative branch

			 official</quote> and all that follows through <quote>as a lobbyist on behalf of

			 the client,</quote> and inserting <quote>or a covered legislative branch

			 official,</quote>.</text>

			 grassroots activities</header><text display-inline="yes-display-inline">Section

			 3 of the Lobbying Disclosure Act of 1995 (2 U.S.C. 1602) is further amended by

			 adding at the end the following new paragraph:</text>

						<paragraph commented="no" display-inline="no-display-inline" id="H2704D66A5EDE4066BAD6A6BF3F00CA62"><enum>(17)</enum><header>Grassroots

				lobbying communication</header><text display-inline="yes-display-inline">The

				term <quote>grassroots lobbying communication</quote> means an attempt to

				influence legislation or executive action through the use of mass

				communications directed to the general public and designed to encourage

				recipients to take specific action with respect to legislation or executive

				action, except that such term does not include any communications by an entity

				directed to its members, employees, officers, or shareholders. For purposes of

				this paragraph, a communication is designed to encourage a recipient if any of

				the following applies:</text>

				should contact a legislator, or should contact an officer or employee of an

				executive agency.</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF24E9F3726964EB88C829733E6E12016"><enum>(B)</enum><text display-inline="yes-display-inline">The communication provides the address,

				phone number, and contact information of a legislator or of an officer or

				employee of an executive agency.</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H680F9C4B20794B22A9F9B5B2172B6857"><enum>(C)</enum><text display-inline="yes-display-inline">The communication provides a petition,

				tear-off postcard, or similar material for the recipient to send to a

				legislator or to an officer or employee of an executive agency.</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HDF3DD8C27A0142F8BB00342468F67955"><enum>(D)</enum><clause commented="no" display-inline="yes-display-inline" id="H85D13C0C7E2B477DAB674C324D67CABA"><enum>(i)</enum><text display-inline="yes-display-inline">Subject to clause (ii), the communication

				specifically identifies an individual who—</text>

									<subclause commented="no" display-inline="no-display-inline" id="H983D9AB75D764B1FAA9FBEBEBCE42E13" indent="up1"><enum>(I)</enum><text display-inline="yes-display-inline">is in a position to consider or vote on the

				legislation;</text>

									</subclause><subclause commented="no" display-inline="no-display-inline" id="HEAEEE4ADF35A4046BB73911753FABBCF" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">represents the recipient in Congress;

				or</text>

									</subclause><subclause commented="no" display-inline="no-display-inline" id="H486EE9A71B19494C89E754D0965E640" indent="up1"><enum>(III)</enum><text display-inline="yes-display-inline">is an officer or employee of the executive

				agency to which the legislation or executive action relates.</text>

									</subclause></clause><clause commented="no" display-inline="no-display-inline" id="HE05094B3B13A48D7BC4616E000C30915" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">A communication described in clause (i) is

				a grassroots lobbying communication only if it is a communication that cannot

				meet the <quote>full and fair exposition</quote> test as nonpartisan analysis,

				study, or

				research.</text>

								</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="HC340AE5B7FAB4E9AAB094363ACF3BEE6"><enum>(b)</enum><header>Separate

			 itemization of grassroots expenses</header><text display-inline="yes-display-inline">Section 5 of the Lobbying Disclosure Act of

			 1995 (2 U.S.C. 1604) is further amended in subsection (b)—</text>

			 general</header><text display-inline="yes-display-inline">Paragraph (2) of

			 section 3 of the Lobbying Disclosure Act of 1995 (2 U.S.C. 1602) is amended to

			 read as follows:</text>

				<term>client</term> means any person or entity that employs or retains another

				person for financial or other compensation to conduct lobbying activities on

				behalf of that person or entity. A person or entity whose employees act as

				lobbyists on its own behalf is both a client and an employer of such

				employees.</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBE6D3F28558E40F09EF6672C1E91FD5"><enum>(B)</enum><header>Treatment of

				coalitions and associations</header>

								<clause commented="no" display-inline="no-display-inline" id="H905F2D9AE82540B89DC7C117BB8946DA"><enum>(i)</enum><header>In

				general</header><text display-inline="yes-display-inline">Except as provided in

				clause (ii), in the case of a coalition or association that employs or retains

				persons to conduct lobbying activities, each person, other than an individual

				who is a member of the coalition or association, whose total contribution to

				the coalition or association in connection with the lobbying activities exceeds

				the $10,000 registration threshold described in section 4(a)(3)(A)(ii) of this

				Act, is the client along with the coalition or association.</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="H8301B714C68D40E2925DC24DB80000"><enum>(ii)</enum><header>Exception for

				certain tax-exempt associations</header><text display-inline="yes-display-inline">In case of an association—</text>

									<subclause commented="no" display-inline="no-display-inline" id="H8C1C6695A4064BC4AC90769DA10076A1"><enum>(I)</enum><text display-inline="yes-display-inline">which is described in paragraph (3) of

				section 501(c) of the Internal Revenue Code of 1986 and exempt from tax under

				association and its members, which would otherwise be treated as a client,

				shall not avoid the registration and reporting requirements of this Act by

				employing or retaining another coalition or association to conduct lobbying

				activities.</text>

								</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="HD0E248DCB7224FF29650EF38EA91557"><enum>(b)</enum><header>Effective

			 date</header>

					<paragraph commented="no" display-inline="no-display-inline" id="H098BB4891716499E91B5083333EE9EB1"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The amendments made

			 by this section shall apply to—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="HB091497EB1774704BD9614D1570A7B8"><enum>(A)</enum><text display-inline="yes-display-inline">coalitions and associations listed on

			 registration statements filed under section 4 of the Lobbying Disclosure Act of

			 1995 (2 U.S.C. 1603) after the date of the enactment of this Act, and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H97FCFF41676449CB00D089E400EE1F47"><enum>(B)</enum><text display-inline="yes-display-inline">coalitions and associations for whom any

			 lobbying contact is made after the date of the enactment of this Act.</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9A78BBC9B1F04678B89C6E20A8C87B4F"><enum>(2)</enum><header>Special

			 rule</header><text display-inline="yes-display-inline">In the case of any

			 coalition or association to which the amendments made by this Act apply by

			 reason of paragraph (1)(B), the person required by such section 4 to file a

			 registration statement with respect to such coalition or association shall file

			 a new registration statement within 30 days after the date of the enactment of

			 this Act.</text>

					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H145E3F09545C4214AE1F37CAAE2398B5" section-type="subsequent-section"><enum>108.</enum><header>Increased penalty

				connection with any matter on which such former employee seeks action by a

				Member, officer, or employee of either House of Congress, in his or her

				official capacity, shall be punished as provided in section 216 of this

				title.</text>

			 Official Conduct set forth in rule XXIII of the Rules of the House of

			 Representatives is amended by redesignating clause 14 as clause 15 and by

			 inserting after clause 13 the following new clause:</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="HA247488F298348A5AE7994B422F6EEE5"><enum>(b)</enum><header>Senate</header><text display-inline="yes-display-inline">Rule XXXVII of the Standing Rules of the

			 Senate is amended by adding at the end the following:</text>

				disclose the fact that he or she is negotiating or has any arrangement

				concerning prospective employment if a conflict of interest or the appearance

				of a conflict of interest may exist. Such disclosure shall be made within 3

				days after the commencement of such negotiation or

				arrangement.</text>

						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

				</subsection></section><section commented="no" display-inline="no-display-inline" id="HC0DA393D438248AF837DE412A2ED34AC" section-type="subsequent-section"><enum>204.</enum><header>Wrongfully

			 influencing, on a partisan basis, an entity’s employment decisions or

			 practices</header><text display-inline="no-display-inline">Whoever, being a

			 Senator or Representative in, or a Delegate or Resident Commissioner to, the

			 Congress or an employee of either House of Congress, with the intent to

			 influence on the basis of political party affiliation an employment decision or

			 employment practice of any private or public entity (except for the

			 Congress)—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="H4DAE8EC85E744C9E89920090B949AD41"><enum>(1)</enum><text display-inline="yes-display-inline">takes or withholds, or offers or threatens

			 to take or withhold, an official act; or</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H06E6D96103AE4287909CBDE1D04500D"><enum>(2)</enum><text display-inline="yes-display-inline">influences, or offers or threatens to

				</paragraph><continuation-text commented="no" continuation-text-level="section">shall be fined under title 18, United

			 States Code, or imprisoned for not more than 15 years, or both, and may be

			 disqualified from holding any office of honor, trust, or profit under the

			 United States.</continuation-text></section><section commented="no" display-inline="no-display-inline" id="HBF5B686EFBEE4D9F9BB9F0609D4FCB63" section-type="subsequent-section"><enum>205.</enum><header>Amendment to Code of

			 Official Conduct to prohibit favoritism</header>

			 Representatives</header><text display-inline="yes-display-inline">Rule XXIII of

			 Conduct) is amended by redesignating clause 14 as clause 15 and by inserting

			 privileges and other perks for former Member lobbyists</header><text display-inline="no-display-inline">Notwithstanding any other rule of the House

			 of Representatives or Senate, any benefit or privilege granted by the House of

			 Representatives or the Senate to all former Members of that body, including

			 floor privileges, may not be received or exercised by a former Member who is a

			 registered lobbyist.</text>

			</section></title><title commented="no" id="H049A58F4DA004DA58723CEAB16BCBF53" style="OLC"><enum>III</enum><header>Curbing excesses in privately funded travel

			 and lobbyist gifts</header>

			<section commented="no" display-inline="no-display-inline" id="H99993901691C4F68A3CCF1FC81BE645C" section-type="subsequent-section"><enum>301.</enum><header>Required

			 certification that congressional travel meets certain conditions</header>

				<subsection commented="no" display-inline="no-display-inline" id="H72BD9DB5EB43480B8B59E972470163FE"><enum>(a)</enum><header>House of

			 Representatives</header><text display-inline="yes-display-inline">Clause 5 of

			 rule XXV of the Rules of the House of Representatives is amended by

			 redesignating paragraphs (e) and (f) as paragraphs (f) and (g), respectively,

			 and by inserting after paragraph (d) the following new paragraph:</text>

					<quoted-block display-inline="no-display-inline" id="HBB89E247B6654FD200ADFEBDB6DD9EF" style="traditional">

				House may accept a gift of transportation or lodging otherwise permissible

				under this clause from any person, such Member, Delegate, Resident

				Commissioner, officer, or employee of the House, as applicable, shall obtain a

				written certification from such person (and provide a copy of such

				certification to the Clerk) that—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="H5223469FE9AB4AB6A30102CB266273D" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">the trip was not planned, organized,

				arranged, or financed by a registered lobbyist or foreign agent and was not

				organized at the request of a registered lobbyist or foreign agent; and</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H1CCA9F357C0C421CACD1E300ADDCA40" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">the person did not accept, from any source,

				funds specifically earmarked for the purpose of financing the travel

				expenses.</text>

								</subparagraph><continuation-text commented="no" continuation-text-level="paragraph">The Clerk shall make public

				information received under this subparagraph as soon as possible after it is

				received.</continuation-text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H90D300978D4B469D9E792BAB18505CDB" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">A

				Member, Delegate, or Resident Commissioner is not required to obtain a written

				certification for a gift or transportation or lodging described in subdivision

				(A), (B), (C), (D), (F), or (G) of paragraph

				(a)(1).</text>

							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="id10B64E97D64A41348BA686919BAF4964"><enum>(b)</enum><header>Senate</header><text display-inline="yes-display-inline">Paragraph 1 of rule XXXV of the Standing

			 Rules of the Senate is amended by adding at the end the following:</text>

				organized at the request of a registered lobbyist or foreign agent;</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idAADDA36A58BF49989B41371B555E0FFF"><enum>(2)</enum><text display-inline="yes-display-inline">registered lobbyists will not participate

				in or attend the trip; and</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2DC43F352DBB448BBAA871B63C1DCCAB"><enum>(3)</enum><text display-inline="yes-display-inline">the person did not accept, from any source,

				funds specifically earmarked for the purpose of financing the travel

				expenses.</text>

							</paragraph><continuation-text commented="no" continuation-text-level="subsection">The Select Committee on Ethics shall

				make public information received under this subparagraph as soon as possible

								</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id03A418E206104019AB28864EE13BCC4C"><enum>(2)</enum><header>Disclosure</header><text display-inline="yes-display-inline">Paragraph 1 of rule XXXV of the Standing

			 Rules of the Senate is amended by adding at the end the following:</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idBB19BDC23961499EB4E2349A27AC9A0D"><enum>(2)</enum><text display-inline="yes-display-inline">the destination of the flight;</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF6E97494A1E7424EA4AFB1585D32063F"><enum>(3)</enum><text display-inline="yes-display-inline">who else was on the flight, other than

				those operating the plane;</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id21D1FB147F064456A3C8ADC182538715"><enum>(4)</enum><text display-inline="yes-display-inline">the purpose of the trip; and</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id91522F870CA54CCBBD7FE7B29DAAA506"><enum>(5)</enum><text display-inline="yes-display-inline">the reason that a commercial airline was

				not

				used.</text>

								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idC8C6AE5C3D0744BE915A9AE2B76778A1"><enum>(c)</enum><header>Candidates</header><text display-inline="yes-display-inline">Subparagraph (B) of section 301(8) of the

			 Federal Election Campaign Act of 1971 (42 U.S.C. 431(8)(B)) is amended by

			 striking <quote>and</quote> at the end of clause (xiii), by striking the period

			 at the end of clause (xiv) and inserting <quote>; and</quote>, and by adding at

			 the end the following new clause:</text>

						<clause commented="no" display-inline="no-display-inline" id="idF3C63781D78045588F71E434B6A70DC8"><enum>(xv)</enum><text display-inline="yes-display-inline">any travel expense for a flight on an

				airplane that is not licensed by the Federal Aviation Administration to operate

				for compensation or hire, but only if the candidate or the candidate's

				authorized committee or other political committee pays within 7 days after the

				date of the flight to the owner, lessee, or other person who provides the use

				of the airplane an amount not less than the normal and usual charter fare or

				rental charge for a comparable commercial airplane of appropriate

				size.</text>

						</clause><after-quoted-block>.</after-quoted-block></quoted-block>

				</subsection></section><section commented="no" display-inline="no-display-inline" id="HD07BCA7713114C438E38F6278EDB86E" section-type="subsequent-section"><enum>303.</enum><header>False certification

			 in connection with congressional travel</header>

				<subsection commented="no" display-inline="no-display-inline" id="HAEA3EAB795DB49CD87C660A6C8D1BEA"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Whoever makes a false

			 certification in connection with the travel of a Member, officer, or employee

			 of either House of Congress (within the meaning given those terms in section

			 207 of title 18, United States Code) shall, upon proof of such offense by a

			 preponderance of the evidence, be subject to a civil fine depending on the

			 extent and gravity of the violation.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="H298B9F2342414FBAB2C040683FB4C1E0"><enum>(b)</enum><header>Maximum

			 fine</header><text display-inline="yes-display-inline">The maximum fine per

			 offense under this section depends on the number of separate trips in

			 connection with which the person committed an offense under this section, as

			 follows:</text>

					<paragraph commented="no" display-inline="no-display-inline" id="H50931A91F0C84456A1C6C624F4243B83"><enum>(1)</enum><header>First

			 trip</header><text display-inline="yes-display-inline">For each offense

			 committed in connection with the first such trip, the amount of the fine shall

			 be not more than $100,000 per offense.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC4092769FAD1437E87029923CF09D8E"><enum>(2)</enum><header>Second

			 trip</header><text display-inline="yes-display-inline">For each offense

			 committed in connection with the second such trip, the amount of the fine shall

			 be not more than $300,000 per offense.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8D5293AB73E64D58B77664004EA291E4"><enum>(3)</enum><header>Any other

			 trips</header><text display-inline="yes-display-inline">For each offense

			 committed in connection with any such trip after the second, the amount of the

			 fine shall be not more than $500,000 per offense.</text>

					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H899AD41560B0401E91CFC00054930861" section-type="subsequent-section"><enum>304.</enum><header>Increased disclosure

			 of travel by Members</header>

				<subsection commented="no" display-inline="no-display-inline" id="id7CED8C7D1552456EA2D0AEE83CF985E5"><enum>(a)</enum><header>House of

			 representatives</header><text display-inline="yes-display-inline">Clause

			 5(b)(1)(A)(ii) of rule XXV of the Rules of the House of Representatives is

			 amended by—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="HEAD804EDEFB2465DB9E3C28B5C65D54D"><enum>(1)</enum><text display-inline="yes-display-inline">inserting <quote>a detailed description of

			 each of</quote> before <quote>the expenses</quote>; and</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idFCA0FADEB56B4F0495E7988E9E701685"><enum>(b)</enum><header>Senate</header><text display-inline="yes-display-inline">Paragraph 2(c) of rule XXXV of the Standing

			 Rules of the Senate is amended—</text>

			 respecting travel expenses</header>

				<subsection commented="no" display-inline="no-display-inline" id="idCF8EEF4FE2A04C1A809947B04454DA56"><enum>(a)</enum><header>House of

			 representatives</header><text display-inline="yes-display-inline">Clause 5(f)

			 of rule XXV of the Rules of the House of Representatives is amended by

			 inserting <quote>(1)</quote> after <quote>(f)</quote> and by adding at the end

			 the following new subparagraph:</text>

					<quoted-block display-inline="no-display-inline" id="HEADC34308E404FA893947130DB4DCCF" style="traditional">

						<paragraph commented="no" display-inline="no-display-inline" id="HA23DE4A8974447E8B014E1EE989D9C8" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Within 90 days after the date of adoption

				of this subparagraph and at annual intervals thereafter, the Committee on

				Standards of official Conduct shall develop and revise, as necessary,

				guidelines on what constitutes <quote>reasonable expenses</quote> or

				<quote>reasonable expenditures</quote> for purposes of paragraph (b)(4). In

				developing and revising the guidelines, the committee shall take into account

				the maximum per diem rates for official Government travel published annually by

				the General Services Administration, the Department of State, and the

				Department of

				Defense.</text>

						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="id020573EB0EC044FE965A0C60E0E65A12"><enum>(b)</enum><header>Senate</header><text display-inline="yes-display-inline">Rule XXXV of the Standing Rules of the

			 Senate is amended by adding at the end the following:</text>

					<quoted-block display-inline="no-display-inline" id="idB382DCC1C8EB4AFB8AA9E6CE2F44DBF4" style="OLC">

						<paragraph commented="no" display-inline="no-display-inline" id="idC92ABA386BE34385A85BF52B87F04468"><enum>(7)</enum><text display-inline="yes-display-inline">Not later than 90 days after the date of

				adoption of this paragraph and at annual intervals thereafter, the Select

				Committee on Ethics shall develop and revise, as necessary, guidelines on what

				constitutes <quote>reasonable expenses</quote> or <quote>reasonable

				expenditures</quote> for purposes of this rule. In developing and revising the

				</subsection></section><section commented="no" display-inline="no-display-inline" id="HC1CD4086905143F796F88635C1AECB1D" section-type="subsequent-section"><enum>306.</enum><header>Prohibition on gifts

			 by registered lobbyists to Members of Congress and to congressional

			 employees</header>

				<subsection commented="no" display-inline="no-display-inline" id="H1F3D034B31EC4DCEA1C55ECE2D71BA99"><enum>(a)</enum><header>Prohibition</header>

					<paragraph commented="no" display-inline="no-display-inline" id="H6F8E2629411B41A494BA45D0B992433E"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">A registered lobbyist

			 may not knowingly make a gift to a Member, Delegate, Resident Commissioner,

			 officer, or employee of Congress except as provided in this section.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H68C778EC539A4A669B964931307143F0"><enum>(2)</enum><header>Gift

			 defined</header><text display-inline="yes-display-inline">In this section, the

			 term <quote>gift</quote> means a gratuity, favor, discount, entertainment,

			 hospitality, loan, forbearance, or other item having monetary value. The term

			 includes gifts of services, training, transportation, lodging, and meals,

			 whether provided in kind, by purchase of a ticket, payment in advance, or

			 reimbursement after the expense has been incurred.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0D83C4C55ECD47D9BF805DB0FAA907EC"><enum>(3)</enum><header>Registered

			 lobbyist defined</header><text display-inline="yes-display-inline">In this

			 section, the term <term>registered lobbyist</term> means—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="id878542C831AA44BDA80BD8627B51DD4C"><enum>(A)</enum><text display-inline="yes-display-inline">a lobbyist registered under the Lobbying

			 Disclosure Act of 1995 (2 U.S.C. 1601 et seq.);</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE4E127F131AE44D680B930A203558671"><enum>(B)</enum><text display-inline="yes-display-inline">a lobbyist who, as an employee of an

			 organization, is covered by the registration of that organization under that

			 Act; and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id26D085FC7A2D4C8A8B7DA5512403A604"><enum>(C)</enum><text display-inline="yes-display-inline">an organization registered under that

			 Act.</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3247DCBFC09D4262973F8F5349C58D99"><enum>(4)</enum><header>Gifts to family

			 members and other individuals</header><text display-inline="yes-display-inline">For the purposes of this section, a gift to

			 a family member of a Member, Delegate, Resident Commissioner, officer, or

			 employee of Congress, or a gift to any other individual based on that

			 individual's relationship with the Member, Delegate, Resident Commissioner,

			 officer, or employee, shall be considered a gift to the Member, Delegate,

			 Resident Commissioner, officer, or employee if the gift was given because of

			 the official position of the Member, Delegate, Resident Commissioner, officer,

			 or employee.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H84A4F458331840D59C99F347F668D504"><enum>(5)</enum><header>Exceptions</header><text display-inline="yes-display-inline">The restrictions in paragraph (1) do not

			 apply to the following:</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="HC2CF5B60687A406E89D4CEEDF2AB47"><enum>(A)</enum><header>Certain lawful

			 political fundraising activities</header><text display-inline="yes-display-inline">A contribution, as defined in section

			 301(8) of the Federal Election Campaign Act of 1971 (2 U.S.C. 431) that is

			 lawfully made under that Act, a lawful contribution for election to a State or

			 local government office, or attendance at a fundraising event sponsored by a

			 political organization described in section 527(e) of the Internal Revenue Code

			 of 1986.</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9A74CA180DDF457D93FDF48DC8BD3600"><enum>(B)</enum><header>Gift from a

			 relative</header><text display-inline="yes-display-inline">A gift from a

			 relative as described in section 109(16) of title I of the Ethics in Government

			 Act of 1978 (2 U.S.C. App. 109(16)).</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD26010B7582C44F7B7A2A702200E82E"><enum>(C)</enum><header>Employee

			 benefits</header><text display-inline="yes-display-inline">Pension and other

			 benefits resulting from continued participation in an employee welfare and

			 benefits plan maintained by a former employer.</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7F04DA640D0C42229E9F00D65C3892F3"><enum>(D)</enum><header>Informational

			 materials</header><text display-inline="yes-display-inline">Informational

			 materials that are sent to the office of the Member, Delegate, Resident

			 Commissioner, officer, or employee in the form of books, articles, periodicals,

			 other written materials, audiotapes, videotapes, or other forms of

			 communication.</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5D9BA3FD9574490291CAC64AB04A8EB"><enum>(E)</enum><header>Items of nominal

			 value</header><text display-inline="yes-display-inline">An item of nominal

			 value such as a greeting card, baseball cap, or a T-shirt.</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H1DBD6EF42CFA4DE49994959908005DA"><enum>(F)</enum><header>Personal

			 friendship</header>

							<clause commented="no" display-inline="no-display-inline" id="H9EB9C70492A7442293DDF5438575DBB5"><enum>(i)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Anything provided by

			 an individual on the basis of a personal friendship unless the gift was given

			 because of the official position of the Member, Delegate, Resident

			 Commissioner, officer, or employee.</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="H42600997E38F47499D08466146C82EAA"><enum>(ii)</enum><header>Circumstances</header><text display-inline="yes-display-inline">In determining whether a gift is provided

			 on the basis of personal friendship, the following shall be considered:</text>

								<subclause commented="no" display-inline="no-display-inline" id="HB9F1D4B4048645CF906CACBF9837274E"><enum>(I)</enum><text display-inline="yes-display-inline">The history of the relationship between the

			 Member, Delegate, Resident Commissioner, officer, or employer and the

			 individual giving the gift, including any previous exchange of gifts between

			 them.</text>

								</subclause><subclause commented="no" display-inline="no-display-inline" id="H05233955207E4396927D1EFCCA9AFEC"><enum>(II)</enum><text display-inline="yes-display-inline">Whether the individual who gave the gift

			 personally paid for the gift or sought a tax deduction or business

			 reimbursement for the gift.</text>

								</subclause><subclause commented="no" display-inline="no-display-inline" id="H7F907C7016FA4E3E8CE54ECCBAF83DBE"><enum>(III)</enum><text display-inline="yes-display-inline">Whether the individual who gave the gift

			 also gave the same or similar gifts to other Members, Delegates, the Resident

			 Commissioners, officers, or employees of Congress.</text>

								</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7DA2B39D04854E6BA670B10343D62C3E"><enum>(G)</enum><header>Certain outside

			 business or employment activities provided to spouse</header><text display-inline="yes-display-inline">Food, refreshments, lodging,

			 transportation, and other benefits provided to the spouse of the Member,

			 Delegate, Resident Commissioner, officer, or employee, resulting from the

			 outside business or employment activities of the spouse or in connection with

			 bona fide employment discussions with respect to the spouse, if such benefits

			 have not been offered or enhanced because of the official position of the

			 Member, Delegate, Resident Commissioner, officer, or employee and are

			 customarily provided to others in similar circumstances.</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFCDA0F68EEAB496095E96C6E60A0DFDD"><enum>(H)</enum><header>Opportunities

			 and benefits unrelated to congressional employment</header><text display-inline="yes-display-inline">Opportunities

			 and benefits that are offered to members of a group or class in which

			 membership is unrelated to congressional employment.</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5AFE941E8E244981BFE9C46784DC0797"><enum>(I)</enum><header>Certain foods or

			 refreshments</header><text display-inline="yes-display-inline">Food or

			 refreshments of a nominal value offered other than as a part of a meal.</text>

						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H8D52C39D493D4A6484676656C8D1FF94"><enum>(b)</enum><header>Penalty</header><text display-inline="yes-display-inline">Any registered lobbyist who violates this

			 section shall be subject to a civil fine of not more than $50,000, depending on

			 the extent and gravity of the violation.</text>

				</subsection></section><section commented="no" display-inline="no-display-inline" id="idA4D38328985B4E588FD7081595FE9C9B" section-type="subsequent-section"><enum>307.</enum><header>Prohibition on

			 members accepting gifts from lobbyists</header>

				<subsection commented="no" display-inline="no-display-inline" id="id909730719ABD4C1C9786892CB30A6D2B"><enum>(a)</enum><header>House of

			 Representatives</header><text display-inline="yes-display-inline">Clause

			 5(a)(1)(A) of rule XXV of the Rules of the House of Representatives is amended

			 by adding at the end the following new sentence: <quote>Notwithstanding any

			 other provision of this clause, in no event may a Member, Delegate, or Resident

			 Commissioner accept a gift from a registered lobbyist prohibited by section 306

			 of the Lobbying and Ethics Reform Act of 2005.</quote>.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="id50DDD03705134CFC8337FB08CFC0BB92"><enum>(b)</enum><header>Senate</header><text display-inline="yes-display-inline">Paragraph 1 of rule XXXV of the Standing

			 Rules of the Senate is amended by adding at the end the following:</text>

					<quoted-block display-inline="no-display-inline" id="idF7B387E4F971408494714FF6D59DB800" style="OLC">

						<subsection commented="no" display-inline="no-display-inline" id="id67A3F1C0FF1149EAA5CC4C263E3A5F63"><enum>(g)</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of this

				rule, in no event may a Member accept a gift from a registered lobbyist

				prohibited by section 306 of the Lobbying and Ethics Reform Act of

				2005.</text>

						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>

				</subsection></section></title><title commented="no" id="H3174DA6BA84B488EB2A13528DDBDC959" style="OLC"><enum>IV</enum><header>Oversight of ethics and lobbying</header>

			<section commented="no" display-inline="no-display-inline" id="HFD6F1978D00242B2B4A06B8900125996" section-type="subsequent-section"><enum>401.</enum><header>Comptroller General

			 review and semiannual report on activities carried out by Clerk of the House

			 and Secretary of the Senate under Lobbying Disclosure Act of 1995</header>

				<subsection commented="no" display-inline="no-display-inline" id="HA039B489352C4B9181E00046FF005516"><enum>(a)</enum><header>Ongoing review

			 required</header><text display-inline="yes-display-inline">The Comptroller

			 General shall review on an ongoing basis the activities carried out by the

			 Clerk of the House of Representatives and the Secretary of the Senate under

			 section 6 of the Lobbying Disclosure Act of 1995 (2 U.S.C. 1605). The review

			 shall emphasize—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="HB83F62B474974F0CBEAF8B7440AF8632"><enum>(1)</enum><text display-inline="yes-display-inline">the effectiveness of those activities in

			 securing the compliance by lobbyists with the requirements of that Act;

			 and</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1E435866C3A54E099CE9C88A400E98B"><enum>(2)</enum><text display-inline="yes-display-inline">whether the Clerk and the Secretary have

			 the resources and authorities needed for effective oversight and enforcement of

			 that Act.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HA68C29A10E324FF9BF80209EE94CF769"><enum>(b)</enum><header>Semiannual

			 reports</header><text display-inline="yes-display-inline">Twice yearly, not

			 later than January 1 and not later than July 1 of each year, the Comptroller

			 General shall submit to Congress a report on the review required by subsection

			 (a). The report shall include the Comptroller General’s assessment of the

			 matters required to be emphasized by that subsection and any recommendations of

			 the Comptroller General to—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="H7241E03F8BD04EB980E7A5FF714EB303"><enum>(1)</enum><text display-inline="yes-display-inline">improve the compliance by lobbyists with

			 the requirements of that Act; and</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF20D99663BB84494902B91F3F7E649D"><enum>(2)</enum><text display-inline="yes-display-inline">provide the Clerk and the Secretary with

			 the resources and authorities needed for effective oversight and enforcement of

			 that Act.</text>
