2.In this Act:
(1)Appropriate
congressional committeesThe
term appropriate congressional committees means the Committee on
International Relations of the House of Representatives and the Committee on
Foreign Relations of the Senate.
(2)The term employee means an
individual who is employed in the general services, professional staff, or
senior management of the United Nations, including contractors and
consultants.
(3)The term
General Assembly means the General Assembly of the United
Nations.
(4)The term Member
State means a Member State of the United Nations. Such term is
synonymous with the term country.
(5)The term Secretary means the
Secretary of State.
(6)The term
Secretary General means the Secretary General of the United
Nations.
(7)The term
Security Council means the Security Council of the United
Nations.
(8)Specialized
agencies and specialized agencies of the United NationsThe terms specialized agencies
and specialized agencies of the United Nations mean—
(A)the Food and Agriculture Organization
(FAO);
(B)the International Atomic Energy Agency
(IAEA);
(C)the International Civil Aviation
Organization (ICAO);
(D)the International Fund for Agricultural
Development (IFAD);

3.Congress declares
that, in light of recent history, it is incumbent upon the United Nations to
enact significant reform measures if it is to restore the public trust and
confidence necessary for it to achieve the laudable goals set forth in its
Charter. To this end, the following Act seeks to reform the United
Nations.

Nations</header>

policy</header>
<paragraph commented="no" display-inline="no-display-inline" id="IDD0AA5BA6A1194FB4A4F510A0E2109F42"><enum>(1)</enum><header>In
general</header><text display-inline="yes-display-inline">It shall be the
policy of the United States to use its voice, vote, and influence at the United
Nations to—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="IDB2AFE8AC66CD4868801BE957ED980389"><enum>(A)</enum><text display-inline="yes-display-inline">pursue a streamlined, efficient, and
accountable regular assessed budget of the United Nations; and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6F20B91AB0534DC9824F09448AA1B784"><enum>(B)</enum><text display-inline="yes-display-inline">shift funding mechanisms of certain
organizational programs of the United Nations specified under paragraph (4)
from the regular assessed budget to voluntarily funded programs.</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2E7DD6871CD248B0A618DC1113B396C1"><enum>(2)</enum><header>United States
contributions</header><text display-inline="yes-display-inline">It shall be the
policy of the United States to—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="ID89807E1A0187476793755AD7BA9FA413"><enum>(A)</enum><text display-inline="yes-display-inline">redirect United States contributions to the
United Nations to achieve the policy objectives described in paragraph (1)(B);
and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9C40A3168538425996098BEC86D9CCB0"><enum>(B)</enum><text display-inline="yes-display-inline">redirect a portion of funds from the
following organizational programs to pursue the policy objectives described in
paragraph (1)(A):</text>

services.</text>
</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2DF488A6895946B6B555E6DEF4A2CDF2"><enum>(3)</enum><header>Future biennium
budgets</header><text display-inline="yes-display-inline">It shall be the
policy of the United States to use its voice, vote, and influence at the United
Nations to ensure that future biennial budgets of the United Nations, as agreed
to by the General Assembly, reflect the shift in funding mechanisms described
in paragraph (1)(B) and the redirection of funds described in paragraph
(2).</text>

organizational programs</header><text display-inline="yes-display-inline">The
organizational programs referred to in paragraph (1)(B) are the
following:</text>

developing countries and small island developing States.</text>

with respect to the regular assessed budget of the United Nations</header><text display-inline="yes-display-inline">Subject to the amendment made by subsection
(c), the Secretary of State is authorized to make contributions toward the
amount assessed to the United States by the United Nations for the purpose of
funding the regular assessed budget of the United Nations.</text>
</subsection><subsection commented="no" display-inline="no-display-inline" id="ID97D79E013B094FF49091252AD25D1FCC"><enum>(c)</enum><header>United States
financial contributions to the United Nations</header><text display-inline="yes-display-inline">Section 11 of the United Nations
Participation Act of 1945 (22 U.S.C. 287e–3) is amended to read as
follows:</text>

<subsection commented="no" display-inline="no-display-inline" id="IDD65B45315C604BB0804236F6615CA96C"><enum>(a)</enum><header>Policy of the
United States relating to the regular assessed budget of the United
Nations</header>
<paragraph commented="no" display-inline="no-display-inline" id="ID4F62382C288D4E719365A1AFC3180D76"><enum>(1)</enum><header>In
general</header><text display-inline="yes-display-inline">The President shall
direct the United States Permanent Representative to the United Nations to use
the voice, vote, and influence of the United States at the United Nations
to—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="ID8DCF20F347334E8598E4D19BD6485D19"><enum>(A)</enum><text display-inline="yes-display-inline">pursue a streamlined, efficient, and
accountable regular assessed budget of the United Nations; and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4E8734CF01014B1D8457D50DBD399190"><enum>(B)</enum><text display-inline="yes-display-inline">shift funding mechanisms of certain
organizational programs of the United Nations specified under paragraph (2) of
subsection (c) from the regular assessed budget to voluntarily funded
programs.</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC3C8AD23BFC04008BAE580002764D000"><enum>(2)</enum><header>United States
contributions</header><text display-inline="yes-display-inline">It shall be the
policy of the United States to—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="IDC403A78F8E8F44BC9E91CF265546C3BD"><enum>(A)</enum><text display-inline="yes-display-inline">redirect United States contributions to the
United Nations to achieve the policy objectives described in paragraph (1)(B);
and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID12AEE38FE5EC4705AC4D74468A4ECA81"><enum>(B)</enum><text display-inline="yes-display-inline">redirect a portion of funds from the
following organizational programs to pursue the policy objectives described in
paragraph (1)(A):</text>

</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7F062AD9E240498A92D529BF4752E206"><enum>(3)</enum><header>Future biennium
budgets</header><text display-inline="yes-display-inline">The President shall
direct the United States Permanent Representative to the United Nations to use
the voice, vote, and influence of the United States at the United Nations to
ensure that the shifting of funding mechanisms under paragraph (1)(B) and
redirecting of contributions under paragraph (2) be reflected in future
resolutions agreed to by the General Assembly for the regular assessed budget
of the United Nations for the period of a current biennium. To achieve the
policies described in paragraphs (1) and (2), the United States Permanent
Representative to the United Nations shall withhold the support of the United
States for a consensus for such budget until such time as such budget is
reflective of such policies.</text>
</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID503BA92BD200486E9DE99E0915BB50AD"><enum>(b)</enum><header>22 percent
limitation</header><text display-inline="yes-display-inline">In accordance with
section 601 of the United Nations Reform Act of 2005, the Secretary may not
make a contribution to a regularly assessed biennial budget of the United
Nations in an amount greater than 22 percent of the amount calculable under
subsection (c).</text>
</subsection><subsection commented="no" display-inline="no-display-inline" id="ID2871431A8ED0482D94E1869CA9532F1F"><enum>(c)</enum><header>Annual
dues</header>
<paragraph commented="no" display-inline="no-display-inline" id="ID60922ACE18C14715B0F3E401B3A59CD4"><enum>(1)</enum><header>In
general</header><text display-inline="yes-display-inline">For annual dues paid
by the United States to the United Nations each fiscal year, the percentage
specified in subsection (b) shall be multiplied by one-half of the amount of
the regularly assessed budget of the United Nations for a current biennial
period, as agreed to by resolution of the General Assembly.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE8460F90E3F74BFB8946D86ECB37DB01"><enum>(2)</enum><header>Calculation
with respect to certain organizational programs for redirection</header><text display-inline="yes-display-inline">The percentage specified in subsection (b)
shall be multiplied by one-half of the sum of amounts budgeted by resolution of
the General Assembly for a current biennial period for the following certain
organizational programs:</text>

funds</header><text display-inline="yes-display-inline">Of amounts appropriated
for contributions towards payment of regular assessed dues to the United
Nations for 2008 and each subsequent year, if the funding mechanisms of one or
more of the organizational programs of the United Nations specified in
paragraph (2) have not been shifted from the regular assessed budget to
voluntarily funded programs in accordance with subsection (a)(1), the Secretary
shall ensure that such amounts in each such fiscal year that are specified for
each such organizational program pursuant to the resolution agreed to by the
General Assembly for the regular assessed budget of the United Nations for the
period of a current biennium are redirected from payment of the assessed amount
for the regular assessed budget as follows:</text>
<subparagraph commented="no" display-inline="no-display-inline" id="ID995ED8B383534B38ABD5A2F817E66F92"><enum>(A)</enum><text display-inline="yes-display-inline">Subject to not less than 30 days prior
notification to Congress, the Secretary shall expend an amount, not to exceed
40 percent of the amount specified for each such organizational program
pursuant to the resolution agreed to by the General Assembly for the regular
assessed budget of the United Nations for the period of a current biennium, as
a contribution to an eligible organizational program specified in paragraph
(4).</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID819354E58C4E421780B4441EFC4DC455"><enum>(B)</enum><text display-inline="yes-display-inline">Subject to not less than 30 days prior
notification to Congress, the Secretary shall expend the remaining amounts
under this paragraph to voluntarily funded United Nations specialized agencies,
funds, or programs.</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID019962EC292344819557A30F0925DDD8"><enum>(4)</enum><header>Eligible
organizational programs</header><text display-inline="yes-display-inline">The
eligible organizational programs referred to in paragraph (3)(A) for
redirection of funds under such paragraph are the following:</text>
<subparagraph commented="no" display-inline="no-display-inline" id="IDF8E885242C4D41519219A1A266A3A4FA"><enum>(A)</enum><text display-inline="yes-display-inline">Internal oversight.</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDC85A383D05444637B3B2EE7951B01402"><enum>(B)</enum><text display-inline="yes-display-inline">Human rights.</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID41921A595CE541E2BEB1DC785F81C9DB"><enum>(C)</enum><text display-inline="yes-display-inline">Humanitarian assistance.</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID47A6327A622E408F9B9021BCBE6DC681"><enum>(D)</enum><text display-inline="yes-display-inline">An organizational program specified in
subparagraphs (A) through (P) of paragraph (2), subject to paragraph
(5).</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4DFF28D3BC06400A8B5BB5F5309697EA"><enum>(5)</enum><header>Expenditure of
remaining amounts to certain organization programs</header>
<subparagraph commented="no" display-inline="no-display-inline" id="ID74F5FFB9F23F4C10BFC8C3B6D02A2429"><enum>(A)</enum><header>Voluntary
contribution</header><text display-inline="yes-display-inline">Subject to not
less than 30 days prior notification to Congress and the limitation specified
under subparagraph (B), the Secretary is authorized to make a voluntary
contribution to an organizational program of the United Nations specified in
subparagraphs (A) through (P) of paragraph (2) of any amounts not contributed
in a fiscal year to an eligible organizational program specified in
subparagraphs (A) through (C) of paragraph (4).</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID849F2A2CD62E427AB8901D2F7863BF43"><enum>(B)</enum><header>10 percent
limitation</header><text display-inline="yes-display-inline">A voluntary
contribution under subparagraph (A) to an organizational program of the United
Nations specified in subparagraphs (A) through (P) of paragraph (2) may not
exceed 10 percent of the total contribution made under paragraph (3)(A).</text>
</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID04A88A8BFA8542D0B4E640399571042B"><enum>(d)</enum><header>Further
calculation with respect to budgets for Public Information and General Assembly
affairs and conference services</header>
<paragraph commented="no" display-inline="no-display-inline" id="IDE966079B0E704DA49657CC216608FF6C"><enum>(1)</enum><header>22 percent
limitation</header><text display-inline="yes-display-inline">The Secretary may
not make a contribution to a regularly assessed biennial budget of the United
Nations in an amount greater than 22 percent of the amount calculable under
paragraph (2).</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDF6B674E029074828856B150338C2E7B3"><enum>(2)</enum><header>Annual dues
each fiscal year</header>
<subparagraph commented="no" display-inline="no-display-inline" id="IDB86870B39FD24A75A01EBC2ED84D60C2"><enum>(A)</enum><header>In
general</header><text display-inline="yes-display-inline">For annual dues paid
by the United States to the United Nations each fiscal year, the percentage
specified in paragraph (1) shall be multiplied by one-half of the amount of the
regularly assessed budget of the United Nations for a current biennial period,
as agreed to by resolution of the General Assembly.</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDE464EA1F34CF47C5A7CBACB72022E1AD"><enum>(B)</enum><header>Calculation
with respect to Public Information and General Assembly affairs and conference
services</header><text display-inline="yes-display-inline">With respect to such
United States annual dues, the percentage specified in paragraph (1) shall be
multiplied by one-half of the sum of amounts budgeted by resolution of the
General Assembly for the 2004–2005 biennial period for the following
organizational programs:</text>

</clause><clause commented="no" display-inline="no-display-inline" id="IDC756146FFD0241A79AF2CCB5DDB9330E"><enum>(ii)</enum><text display-inline="yes-display-inline">General Assembly affairs and conferences
services.</text>
</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID69D08DC788A54D0A8AC9A157B0E4CA41"><enum>(C)</enum><header>Redirection of
funds</header>
<clause commented="no" display-inline="no-display-inline" id="ID7EEC79E58FF248169B99C91824229465"><enum>(i)</enum><header>In
general</header><text display-inline="yes-display-inline">The President shall
direct the United States Permanent Representative to the United Nations to make
every effort, including the withholding of United States support for a
consensus budget of the United Nations, to reduce the budgets of the
organizational programs specified in subparagraph (B) for 2007 by ten percent
against the budgets of such organizational programs for the 2004–2005 biennial
period. If the budgets of such organizational programs are not so reduced, 20
percent the amount determined under subparagraph (B) for contributions towards
payment of regular assessed dues for 2007 shall be redirected from payment for
the amount assessed for United States annual contributions to the regular
assessed budget of the United Nations.</text>
</clause><clause commented="no" display-inline="no-display-inline" id="ID87E58A286E8745DF9FFA52F24F7E95EE"><enum>(ii)</enum><header>Specific
amounts</header><text display-inline="yes-display-inline">The Secretary shall
make the amount determined under clause (i) available as a contribution to an
eligible organizational program specified in subparagraphs (A) through (C) of
paragraph (4) of subsection (c).</text>
</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDDDB98DB454064FAEAE56E856080D189A"><enum>(3)</enum><header>Policy with
respect to 2008–2009 biennial period and subsequent biennial periods</header>
<subparagraph commented="no" display-inline="no-display-inline" id="ID375506EF46994149B7E42383EA3A6BD7"><enum>(A)</enum><header>In
general</header><text display-inline="yes-display-inline">The President shall
direct the United States Permanent Representative to the United Nations to make
every effort, including the withholding of United States support for a
consensus budget of the United Nations, to reduce the budgets of the
organizational programs specified in subparagraph (B) of paragraph (2) for the
2008–2009 biennial period and each subsequent biennial period by 20 percent
against the budgets of such organizational programs for the 2004–2005 biennial
period.</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID329C281D943E4BE7923D50059E611CB5"><enum>(B)</enum><header>Certification</header><text display-inline="yes-display-inline">In accordance with section 601, a
certification shall be required that certifies that the reduction in budgets
described in subparagraph (A) has been
implemented.</text>
</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
</subsection><subsection commented="no" display-inline="no-display-inline" id="ID84C1FA28CD7C4B6A8DAF193B995169C6"><enum>(d)</enum><header>Effective
date</header><text display-inline="yes-display-inline">The amendment made by
subsection (c) shall take effect and apply beginning on October 1, 2006.</text>
</subsection><subsection commented="no" display-inline="no-display-inline" id="ID8B58A8F24AAB4F0588E6F52ABA18DC98"><enum>(e)</enum><header>Limitation on
United States contributions to UNRWA</header><text display-inline="yes-display-inline">The Secretary of State may not make a
contribution to the United Nations Relief and Works Agency for Palestine
Refugees in the Near East (UNRWA) in an amount greater than the highest
contribution to UNRWA made by an Arab country, but may not exceed 22 percent of
the total budget of UNRWA. For purposes of this subsection, an Arab country
includes the following: Algeria, Bahrain, Comoros, Dijibouti, Egypt, Iran,
Jordan, Kuwait, Lebanon, Libya, Mauritania, Morocco, Oman, Qatar, Saudi Arabia,
Somalia, Sudan, Syria, Tunisia, the United Arab Emirates, Iraq, and
Yemen.</text>
</subsection><subsection commented="no" display-inline="no-display-inline" id="ID33601F8931854332AC32F45B6CB1FE5D"><enum>(f)</enum><header>Policy relating
to zero nominal growth</header><text display-inline="yes-display-inline">It
shall be the policy of the United States to use the voice, vote, and influence
of the United States at the United Nations to make every effort to enforce zero
nominal growth in all assessed dues to the regular budget of the United
Nations, its specialized agencies, and its funds and programs.</text>
</subsection><subsection commented="no" display-inline="no-display-inline" id="ID2312F7914CB84E6CA618D046F3991DD1"><enum>(g)</enum><header>5.6
Rule</header><text display-inline="yes-display-inline">It shall be the policy
of the United States to use the voice, vote, and influence of the United States
at the United Nations to actively enforce the 5.6 rule at the United Nations,
requiring the Secretariat to identify low-priority activities in the budget
proposal. The United Nations should strengthen the 5.6 rule by requiring that
managers identify the lowest priority activities equivalent to 15 percent of
their budget request or face an across the board reduction of such
amount.</text>
</subsection><subsection commented="no" display-inline="no-display-inline" id="ID8AE7A9104E184A82B74C53EF7E5AE0EF"><enum>(h)</enum><header>Annual
publication</header><text display-inline="yes-display-inline">It shall be the
policy of the United States to use the voice, vote, and influence of the United
States at the United Nations to ensure the United Nations is annually
publishing a list of all subsidiary bodies and their functions, budgets, and
staff.</text>
</subsection><subsection commented="no" display-inline="no-display-inline" id="ID3EB59C21F5F849E38C3C8646A7003477"><enum>(i)</enum><header>Scale of
assessments</header><text display-inline="yes-display-inline">The President
shall direct the United States Permanent Representative to the United Nations
to use the voice, vote, and influence of the United States at the United
Nations to make every effort to ensure that the assessment for each of the five
permanent members of the Security Council is not less than 20 percent of the
assessment for each other permanent member of the Security Council.</text>
</subsection><subsection commented="no" display-inline="no-display-inline" id="ID20412CCCAAA74F38859C97659B55FB04"><enum>(j)</enum><header>Denial of use
of veto</header><text display-inline="yes-display-inline">If the Secretary of
State determines that the assessment for a permanent member of the Security
Council with veto power is less than 20 percent of the assessment for any other
permanent member of the Security Council, the President shall direct the United
States Permanent Representative to the United Nations to use the voice, vote,
and influence of the United States at the United Nations to make every effort
to deny to such lower paying permanent member the use of the veto power of such
permanent member until such time as the assessment for such permanent member is
at least 20 percent of the assessment for each other permanent member of the
Security Council.</text>
</subsection></section><section commented="no" display-inline="no-display-inline" id="ID3E5103D8E44E43EAAE4AD72D98D04F0C" section-type="subsequent-section"><enum>102.</enum><header>Weighted
voting</header><text display-inline="no-display-inline">It shall be the policy
of the United States to actively pursue weighted voting with respect to all
budgetary and financial matters in the Administrative and Budgetary Committee
and in the General Assembly in accordance with the level of the financial
contribution of a Member State to the regular assessed budget of the United
Nations.</text>
</section><section commented="no" display-inline="no-display-inline" id="IDAA8D1589C31F4CFBBF543196BCDCEBE0" section-type="subsequent-section"><enum>103.</enum><header>Budget certification
requirements</header>
<subsection commented="no" display-inline="no-display-inline" id="IDF4CA85A0F0F5413C8F1FA99B2BF3FD9E"><enum>(a)</enum><header>Certification</header><text display-inline="yes-display-inline">In accordance with section 601, a
certification shall be required that certifies that the conditions described in
subsection (b) have been satisfied.</text>
</subsection><subsection commented="no" display-inline="no-display-inline" id="IDBCB52D9E565442EB8A35CAE2F2408803"><enum>(b)</enum><header>Conditions</header><text display-inline="yes-display-inline">The conditions under this subsection are
the following:</text>
<paragraph commented="no" display-inline="no-display-inline" id="ID1D5FD3A515F947C78F1D2E8F09178FF2"><enum>(1)</enum><header>New budget
practices for the United Nations</header><text display-inline="yes-display-inline">The United Nations is implementing budget
practices that—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="ID8EF30F2E003C46C88408E6AB5A82B079"><enum>(A)</enum><text display-inline="yes-display-inline">require the maintenance of a budget not in
excess of the level agreed to by the General Assembly at the beginning of each
United Nations budgetary biennium, unless increases are agreed to by consensus
and do not exceed ten percent; and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID86FA6FD8C87542E684B6A6BC21053EB3"><enum>(B)</enum><text display-inline="yes-display-inline">require the identification of expenditures
by the United Nations by functional categories such as personnel, travel, and
equipment.</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID41B445AD0BEA406F83E2D394055A501B"><enum>(2)</enum><header>Program
evaluation</header>
<subparagraph commented="no" display-inline="no-display-inline" id="ID201D1DF2D7C340D886248B9638E76EBD"><enum>(A)</enum><header>Existing
authority</header><text display-inline="yes-display-inline">The Secretary
General and the Director General of each specialized agency have used their
existing authorities to require program managers within the United Nations
Secretariat and the Secretariats of the specialized agencies to conduct
evaluations in accordance with the standardized methodology referred to in
subparagraph (B) of—</text>
<clause commented="no" display-inline="no-display-inline" id="IDA312F32F2D7045D0A49F528A1D77BAF0"><enum>(i)</enum><text display-inline="yes-display-inline">United Nations programs approved by the
General Assembly; and</text>
</clause><clause commented="no" display-inline="no-display-inline" id="ID9DDF04A4A3D0413E92FC9C1937254966"><enum>(ii)</enum><text display-inline="yes-display-inline">programs of the specialized
agencies.</text>
</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID530DAD17AB6345A8B5EDB4F91BBDFEEA"><enum>(B)</enum><header>Development of
evaluation criteria</header>
<clause commented="no" display-inline="no-display-inline" id="ID180CC5948E1D42DAB31532B3E0F2A0D3"><enum>(i)</enum><header>United
Nations</header><text display-inline="yes-display-inline">The Office of
Internal Oversight Services has developed a standardized methodology for the
evaluation of United Nations programs approved by the General Assembly,
including specific criteria for determining the continuing relevance and
effectiveness of the programs.</text>
</clause><clause commented="no" display-inline="no-display-inline" id="IDE60A68CA7E0F4B98991C62058E89DD27"><enum>(ii)</enum><header>Specialized
agencies</header><text display-inline="yes-display-inline">Patterned on the
work of the Office of Internal Oversight Services of the United Nations, each
specialized agency has developed a standardized methodology for the evaluation
of the programs of the agency, including specific criteria for determining the
continuing relevance and effectiveness of the programs.</text>
</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID414616BAC7D24664886405BBA4152F07"><enum>(C)</enum><header>Report</header><text display-inline="yes-display-inline">The Secretary General is assessing budget
requests and, on the basis of evaluations conducted under subparagraph (B) for
the relevant preceding year, submits to the General Assembly a report
containing the results of such evaluations, identifying programs that have
satisfied the criteria for continuing relevance and effectiveness, and an
identification of programs that have not satisfied such criteria and should be
terminated.</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDF6841DFA0A014A44B43C5D3AE9C9C953"><enum>(D)</enum><header>Sunset of
programs</header><text display-inline="yes-display-inline">Consistent with the
July 16, 1997, recommendations of the Secretary General regarding a sunset
policy and results-based budgeting for United Nations programs, the United
Nations and each specialized agency has established and is implementing
procedures to require all new programs approved by the General Assembly to have
a specific sunset date.</text>
</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID140BF463A9B14451B822A710C5FA2F3E" section-type="subsequent-section"><enum>104.</enum><header>Accountability</header>
<subsection commented="no" display-inline="no-display-inline" id="ID11A5D234CC6C4454BD61FBDE36E051F7"><enum>(a)</enum><header>Certification
of creation of independent oversight Board</header><text display-inline="yes-display-inline">In accordance with section 601, a
certification shall be required that certifies that the following reforms
related to the establishment of an Independent Oversight Board (IOB) have been
adopted by the United Nations:</text>
<paragraph commented="no" display-inline="no-display-inline" id="ID1A3AF34EB454458EA20A05C20A561EB0"><enum>(1)</enum><text display-inline="yes-display-inline">An IOB is established from existing United
Nations budgetary and personnel resources. Except as provided in this
subsection, the IOB shall be an independent entity within the United Nations
and shall not be subject to budget authority or organizational authority of any
entity within the United Nations.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDCED5B410E0484CD895F09172A26BEA1F"><enum>(2)</enum><text display-inline="yes-display-inline">The head of the IOB shall be a Director,
who shall be nominated by the Secretary General and who shall be subject to
Security Council approval by a majority vote. The IOB shall also consist of
four other board members who shall be nominated by the Secretary General and
subject to Security Council approval by a majority vote. The IOB shall be
responsible to the Security Council and the Director and board members shall
each serve terms of 6 years, except that the terms of the initial board shall
be staggered so that no more than two board members’ terms will expire in any
one year. No board member may serve more than two terms. An IOB board member
may be removed for cause by a majority vote of the Security Council. The
Director shall appoint a professional staff headed by a Chief of Staff and may
employ contract staff as needed.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID402E494A5DE74EE7B92505519327B5AE"><enum>(3)</enum><text display-inline="yes-display-inline">The IOB shall receive operational and
budgetary funding through appropriations by the General Assembly from existing
levels of United Nations budgetary and personnel resources, and shall not be
dependent upon any other entity, bureau, division, department, or specialized
agency of the United Nations for such funding.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0E44D8A7F1AD4920879658BA3D5A6763"><enum>(4)</enum><text display-inline="yes-display-inline">While the IOB shall have the authority to
evaluate all operations of the United Nations, the primary mission of the IOB
is to oversee the Office of Internal Oversight Services and the Board of
External Auditors. The IOB may direct the Office of Internal Oversight Services
or the Board of External Auditors to initiate, abandon, or modify the scope of
an investigation. Every three months or more frequently when appropriate, the
IOB shall submit, as appropriate, to the Secretary General, the Security
Council, the General Assembly, or the Economic and Social Council a report on
its activities, relevant observations, and recommendations relating to its
audit operations, including information relating to the inventory and status of
investigations by the Office of Internal Oversight Services.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID88328E62C3374B61ADAD6525B15C6B51"><enum>(5)</enum><text display-inline="yes-display-inline">In extraordinary circumstances and with the
concurrence of the Secretary General or the Security Council by majority vote,
the IOB may augment the Office of Internal Oversight Services with a special
investigator and staff consisting of individuals who are not employees of the
United Nations, to investigate matters involving senior officials of the United
Nations or of its specialized agencies when allegations of serious misconduct
have been made and such a special investigation is necessary to maintain public
confidence in the integrity of the investigation. A special investigator and
staff shall comply with all United Nations financial disclosure and conflict of
interest rules, including the filing of an individual Annual Financial
Disclosure Form in accordance with subsection (c).</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDFF559B01D12E4B78B4B9898F887B6B45"><enum>(6)</enum><text display-inline="yes-display-inline">The IOB shall recommend annual budgets for
the Office of Internal Oversight Services and the Board of External
Auditors.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDA89125B851EF4C179A1B32FB7132F869"><enum>(7)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="ID596198E49AED4A3992A7B8397F74421C"><enum>(A)</enum><text display-inline="yes-display-inline">The IOB shall review the Final Report of
the Independent Inquiry Committee (IIC) into the United Nations Oil for Food
Program (OFF). The IOB’s review should focus on the adequacy of the IIC’s Final
Report or any subsequent reports of the IIC or of any possible successor to the
IIC. The IOB’s review of the IIC’s Final Report should address the Final
Report’s treatment of and adequacy in the following areas—</text>
<clause commented="no" display-inline="no-display-inline" id="ID7FBC465912BF4A3EAE480B3A4B92A7AC" indent="up1"><enum>(i)</enum><text display-inline="yes-display-inline">OFF’s operations from inception through the
transfer of power from the Coalition Provisional Authority to the interim Iraqi
government;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="ID7842755244034B8B8C9636FBE2FE0E95" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">claims of oil smuggling, illegal surcharges
on oil and commissions on commodity contracts, illegal kick-backs, use of oil
allocations to influence foreign government officials and international people
of influence, and use of funds for military purposes;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="ID2ECE8520F2BC47C59FBC7FE9B6B1C58D" indent="up1"><enum>(iii)</enum><text display-inline="yes-display-inline">the involvement, directly or indirectly, of
any entity, bureau, division, department, specialized agency, or employee
(including the Secretary General) of the United Nations, including any employee
of the specialized agencies of the United Nations or any employee or officer of
the Secretariat;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="IDC0182BBA7CD740C8B4FFBC0E6206119F" indent="up1"><enum>(iv)</enum><text display-inline="yes-display-inline">the IIC’s findings, discovery and use of
evidence, and investigation practices; and</text>
</clause><clause commented="no" display-inline="no-display-inline" id="ID8AD50CFC71034E1383D4C0DB6F3D9EFD" indent="up1"><enum>(v)</enum><text display-inline="yes-display-inline">the extent of cooperation by the United
Nations with requests by Congress for testimony, interviews, documents,
correspondence, reports, memoranda, books, papers, accounts, or records related
to the Oil for Food Program.</text>
</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3CADFDA8BC7A4EE4AB650F3CCE99F93B" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">Subsequent to the IOB’s review, the IOB
shall determine in a written report whether the IIC investigation is incomplete
or inadequate in any respects and whether any additional investigation is
justified. If the IOB determines that additional investigation is warranted, it
shall appoint, in accordance with paragraph (5), a special investigator and
staff consisting of individuals who are not employees of the United Nations and
to identify specific areas within the OFF to investigate.</text>
</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDE06E45DE0E584841BE76F05E671B5DE8"><enum>(b)</enum><header>Certification
of United Nations reforms of the Office of Internal Oversight
Services</header><text display-inline="yes-display-inline">In accordance with
section 601, a certification shall be required that certifies that the
following reforms related to the Office of Internal Oversight Services (OIOS)
have been adopted by the United Nations:</text>
<paragraph commented="no" display-inline="no-display-inline" id="ID4DD3332047E5484B840F4374880C3A5C"><enum>(1)</enum><text display-inline="yes-display-inline">The OIOS is designated as an independent
entity within the United Nations. The OIOS shall not be subject to budget
authority or organizational authority of any entity within the United Nations
except as provided in this section.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC46F1427BED2486E93C22E1A890F077A"><enum>(2)</enum><text display-inline="yes-display-inline">The regular assessed budget of the United
Nations shall fully fund the Internal Oversight Budget from existing levels of
United Nations budgetary and personnel resources and shall not be dependent
upon any other entity, bureau, division, department, or specialized agency of
the United Nations for such funding.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDB019769F58114D2F82465C3E2F17020A"><enum>(3)</enum><text display-inline="yes-display-inline">All United Nations officials, including
officials from any entity, bureau, division, department, or specialized agency
of the United Nations, may—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="IDF267A58BBAE9448BA561F1C258D02DB5"><enum>(A)</enum><text display-inline="yes-display-inline">make a recommendation to the OIOS to
initiate an investigation of any aspect of the United Nations; or</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDAD8C4E6A7C274A58AC54FEF842F5506C"><enum>(B)</enum><text display-inline="yes-display-inline">report to the OIOS information or
allegations of misconduct or inefficiencies within the United Nations.</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2F8069DB5D654D8F9B74194C8371C263"><enum>(4)</enum><text display-inline="yes-display-inline">The OIOS may, sua sponte, initiate and
conduct an investigation or audit of any entity, bureau, division, department,
specialized agency, employee (including the Secretary General) of the United
Nations, including any employee of the specialized agencies of the United
Nations, or contractor or consultant for the United Nations or its specialized
agencies.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDA6FA31EB705F4DE3AD99F28A836531D5"><enum>(5)</enum><text display-inline="yes-display-inline">At least every three months and more
frequently when appropriate, the OIOS shall submit to the IOB a report
containing an inventory and status of its investigations.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7A24798D1B1242F9840036CA1AC42C33"><enum>(6)</enum><text display-inline="yes-display-inline">The OIOS shall establish procedures for
providing <quote>whistle-blower</quote> status and employment protections for
all employees of the United Nations, including employees of the specialized
agencies of the United Nations, who provide informational leads and testimony
related to allegations of wrongdoing. Such procedures shall be adopted
throughout the United Nations. Such status and protection may not be conferred
on the Secretary General.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2020117E39DF4B5BBFDCE0CE5F809716"><enum>(7)</enum><text display-inline="yes-display-inline">The OIOS shall annually publish a public
report determining the proper number, distribution, and expertise of auditors
within the OIOS necessary to carry out present and future duties of the OIOS,
including assessing the staffing requirements needed to audit United Nations
contracting activities throughout the contract cycle from the bid process to
contract performance.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3EA8DFB373A94381AACF6796C6501E62"><enum>(8)</enum><text display-inline="yes-display-inline">Not later than 6 months after the date of
the enactment of this Act, the Director shall establish a position of Associate
Director of OIOS for Specialized Agencies and Funds and Programs who shall be
responsible for supervising the OIOS liaison or oversight duties for each of
the specialized agencies and funds and programs of the United Nations. With the
concurrence of the Director, the Associate Director of OIOS for Specialized
Agencies and Funds and Programs may, from existing levels of United Nations
budgetary and personnel resources, hire and appoint necessary OIOS staff,
including staff serving within and located at specialized agencies and funds
and programs permanently or as needed to liaison with existing audit functions
within each specialized agency and fund and program.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1836CC2956FF4302B3851D293F67144A"><enum>(9)</enum><text display-inline="yes-display-inline">Not later than 6 months after the date of
the enactment of this Act, the Director shall establish a position of Associate
Director of OIOS for Peacekeeping Operations, who shall be responsible for the
oversight and auditing of the field offices attached to United Nations
peacekeeping operations. The Associate Director of OIOS for Peacekeeping
Operations shall receive informational leads and testimony from any person
regarding allegations of wrongdoing by United Nations officials or peacekeeping
troops or regarding inefficiencies associated with United Nations peacekeeping
operations. The Associate Director of OIOS for Peacekeeping Operations shall be
responsible for initiating, conducting, and overseeing investigations within
peacekeeping operations.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4F0FBA6D5D6B4BBDB69D8B96A7F1399B"><enum>(10)</enum><text display-inline="yes-display-inline">Not later than 6 months after the date of
the enactment of this Act, the Director shall establish a position of Associate
Director of OIOS for Procurement and Contract Integrity, who shall be
responsible for auditing and inspecting procurement and contracting win the
United Nations, including within the specialized agencies. The Associate
Director of OIOS for Procurement and Contract Integrity shall receive
informational leads and testimony from any person regarding allegations of
wrongdoing by United Nations officials or regarding inefficiencies associated
with United Nations procurement or contracting activities. The Associate
Director of OIOS for Procurement and Contract Integrity shall be responsible
for initiating, conducting, and overseeing investigations of procurement and
contract activities. Not later than 12 months after the establishment of the
position of Associate Director of OIOS for Procurement and Contract Integrity,
the Director, with the assistance of the Associate Director of OIOS for
Procurement and Contract Integrity, shall undertake a review of contract
procedures to ensure that practices and policies are in place to ensure
that—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="ID7A440C3ADF0947369859BA69F27F5A69"><enum>(A)</enum><text display-inline="yes-display-inline">the United Nations has ceased issuing
single bid contracts except for such contracts issued during an emergency
situation that is justified by the Under Secretary General for
Management;</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDF038105681394045B83B36C7193A3274"><enum>(B)</enum><text display-inline="yes-display-inline">the United Nations has established
effective controls to prevent conflicts of interest in the award of contracts;
and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDA5F67C95F9214819B2107B336A3FD8D7"><enum>(C)</enum><text display-inline="yes-display-inline">the United Nations has established
effective procedures and policies to ensure effective and comprehensive
oversight and monitoring of United Nations contract performance.</text>
</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDC9639E89749C4164BEFB3E4E88343282"><enum>(c)</enum><header>Certification
of establishment of United Nations Office of Ethics</header><text display-inline="yes-display-inline">In accordance with section 601, a
certification shall be required that certifies that the following reforms
related to the establishment of a United Nations Office of Ethics have been
adopted by the United Nations:</text>
<paragraph commented="no" display-inline="no-display-inline" id="ID22A9E29A2E5F4B1C95E8BF8B6EE739EE"><enum>(1)</enum><text display-inline="yes-display-inline">A United Nations Office of Ethics (UNOE) is
established. The UNOE shall be an independent entity within the United Nations
and shall not be subject to budget authority or organizational authority of any
entity within the United Nations. The UNEO shall be responsible for
establishing, managing, and enforcing a code of ethics for all employees of
United Nations and its specialized agencies. The UNEO shall also be responsible
for providing such employees with annual training related to such code. The
head of the UNEO shall be a Director who shall be nominated by the Secretary
General and who shall be subject to Security Council approval by majority vote.
The UNOE shall promulgate ethics rules, including the following:</text>
<subparagraph commented="no" display-inline="no-display-inline" id="IDD1AA276F797F4CD9A62616D68080C857"><enum>(A)</enum><text display-inline="yes-display-inline">No employee of any United Nations entity,
bureau, division, department, or specialized agency may be compensated while
participating in the domestic politics of the country of such employee, except
for voting or acting as part of a Security Council, General Assembly, or
legitimately authorized United Nations mission or assignment.</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDA560CA6457134295B90AC3F2D364F5BB"><enum>(B)</enum><text display-inline="yes-display-inline">No United Nations entity, bureau, division,
department, or specialized agency may hire an individual convicted in a
generally recognized court of a democratically-elected government with an
independent judiciary and an extradition treaty with the United States and the
European Union for any crime or crimes involving financial misfeasance,
malfeasance, fraud, or perjury.</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID78A0E42FC03C46A1BA4ACAD4CDA65A26"><enum>(C)</enum><text display-inline="yes-display-inline">The employment of an employee of any United
Nations entity, bureau, division, department, or specialized agency who is
convicted in a generally recognized court of a democratically-elected
government with an independent judiciary and an extradition treaty with the
United States and the European Union of any crime or crimes involving financial
misfeasance, malfeasance, fraud, or perjury shall be subject to
termination.</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID97F8555C056E415DAC2288C619F7FFB8"><enum>(D)</enum><text display-inline="yes-display-inline">If an employee of any United Nations
entity, bureau, division, department, or specialized agency has contact
regarding the disposition of ongoing internal United Nations operations or
decisions with an individual who is not an employee or official of the
government of a Member State (or a similarly situated individual), with an
individual who is not officially employed by any United Nations entity, bureau,
division, department, or specialized agency, or with an individual who is not a
working member of the media, a memorandum of such contact shall be prepared by
such employee and, upon request, be made available to Member States.</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDFACFBBEB238840B0A6390F2324E6F58A"><enum>(2)</enum><text display-inline="yes-display-inline">The UNEO shall receive operational and
budgetary funding through appropriations by the General Assembly from existing
levels of United Nations budgetary and personnel resources and shall not be
dependent upon any other entity, bureau, division, department, or specialized
agency of the United Nations for such funding.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID98458503ABAC42E3A4223C8C5E4A39D9"><enum>(3)</enum><text display-inline="yes-display-inline">The Director of the UNEO shall, not later
than 6 months after the date of its establishment, publish a report containing
proposals for implementing a system for the filing and review of individual
Annual Financial Disclosure Forms by each employee of the United Nations,
including by each employee of its specialized agencies, at the P–5 level and
above and by all contractors and consultants compensated at any salary level.
Such system shall be in place and operational not later than 6 months after the
date of the publication of the report. Such completed forms shall be made
available to the Office of Internal Oversight Services at the request of the
Director of the Office of Internal Oversight Services. Such system shall seek
to identify and prevent conflicts of interest by United Nations employees and
shall be comparable to the system used for such purposes by the United States
Government. Such report shall also address broader reforms of the ethics
program for the United Nations, including—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="ID35FAF80190094C81AABA1BB617053030"><enum>(A)</enum><text display-inline="yes-display-inline">the effect of the establishment of ethics
officers throughout all organizations within the United Nations;</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID5F1A445A7CB24110AA147A8732DE50DB"><enum>(B)</enum><text display-inline="yes-display-inline">the effect of retention by the UNEO of
Annual Financial Disclosure Forms;</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDDE419746CE78447C830D90F1C835715B"><enum>(C)</enum><text display-inline="yes-display-inline">proposals for making completed Annual
Financial Disclosure Forms available to the public on request through their
Member State’s mission to the United Nations;</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDABD7D45510094BF6A6FDE22FED38407C"><enum>(D)</enum><text display-inline="yes-display-inline">proposals for annual disclosure to the
public of information related to the annual salaries and payments, including
pension payments and buyouts, of employees of the United Nations, including
employees of its specialized agencies, and of consultants;</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID965F75F364474FA8BEBE7ECBF5D3D236"><enum>(E)</enum><text display-inline="yes-display-inline">proposals for annual disclosure to the
public of information related to per diem rates for all bureaus, divisions,
departments, or specialized agencies within the United Nations;</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDD7BC6DF08FC44B6F816B9A3E4A75AC5D"><enum>(F)</enum><text display-inline="yes-display-inline">proposals for disclosure upon request by
the Ambassador of a Member State of information related to travel and per diem
payments made from United Nations funds to any person; and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID7AF163BDCC6244B09B00C190983BCC76"><enum>(G)</enum><text display-inline="yes-display-inline">proposals for annual disclosure to the
public of information related to travel and per diem rates and payments made
from United Nations funds to any person.</text>
</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID3EA467AB8D1E43569F3C233AC4B1FABD"><enum>(d)</enum><header>Certification
of United Nations establishment of position of Chief Operating
Officer</header><text display-inline="yes-display-inline">In accordance with
section 601, a certification shall be required that certifies that the
following reforms related to the establishment of the position of a Chief
Operating Officer have been adopted by the United Nations:</text>
<paragraph commented="no" display-inline="no-display-inline" id="IDDBEEB3C7B8474E33B487B4ABF3DA6B7C"><enum>(1)</enum><text display-inline="yes-display-inline">There is established the position of Chief
Operating Officer (COO). The COO shall report to the Secretary General.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDBE57E2DFFBBD4A6495392FBFC84388BE"><enum>(2)</enum><text display-inline="yes-display-inline">The COO shall be responsible for
formulating general policies and programs for the United Nations in
coordination with the Secretary General and in consultation with the Security
Council and the General Assembly. The COO shall be responsible for the daily
administration, operation and supervision, and the direction and control of the
business of the United Nations. The Chief Operating Officer shall also perform
such other duties and may exercise such other powers as from time to time may
be assigned to the COO by the Secretary General.</text>
</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID099A52EFAE4F472BBAB5B577F34BAE1D"><enum>(e)</enum><header>Certification
of access by Member States to reports and audits by Board of External
Auditors</header><text display-inline="yes-display-inline">In accordance with
section 601, a certification shall be required that certifies that Member
States may, upon request, have access to all reports and audits completed by
the Board of External Auditors.</text>
</subsection><subsection commented="no" display-inline="no-display-inline" id="ID6C4A4FBBAFEE4ED885709E125165B7DB"><enum>(f)</enum><header>Waiver of
immunity</header><text display-inline="yes-display-inline">The President shall
direct the United States Permanent Representative to the United Nations to use
the voice, vote, and influence of the United States at the United Nations to
ensure that the Secretary General exercises the right and duty of the Secretary
General under section 20 of the Convention on the Privileges and Immunities of
the United Nations to waive the immunity of any United Nations official in any
case in which such immunity would impede the course of justice. In exercising
such waiver, the Secretary General is urged to interpret the interests of the
United Nations as favoring the investigation or prosecution of a United Nations
official who is credibly under investigation for having committed a serious
criminal offense or who is credibly charged with a serious criminal
offense.</text>
</subsection><subsection commented="no" display-inline="no-display-inline" id="IDEEB2679601FE446392640ABC45B584DE"><enum>(g)</enum><header>Certification
of United Nations cooperation relating to Oil-for-Food program</header>
<paragraph commented="no" display-inline="no-display-inline" id="ID38F664BF0B19449B9051AAD3F90F716E"><enum>(1)</enum><header>Actions</header><text display-inline="yes-display-inline">In accordance with section 601, a
certification shall be required that certifies that the following actions
relating to the oil-for-food program have been taken by the United
Nations:</text>
<subparagraph commented="no" display-inline="no-display-inline" id="IDA3065F9FC54245869EDFA31003CAD4DC"><enum>(A)</enum><text display-inline="yes-display-inline">The United Nations Secretary General has
authorized the release to a law enforcement authority of any Member State (upon
request by the permanent representative to the United Nations of such Member
State on behalf of such law enforcement authority) or to a national legislative
authority authentic copies of any document in the possession of the United
Nations, including any document in the possession of a person who was engaged
on a contract basis to provide goods or services to the United Nations, that in
the judgment of such requesting law enforcement authority or national
legislative authority directly or indirectly concerns the oil-for-food program
or a sanction imposed on Iraq related to the oil-for-food program.</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDDC72585260A04A5196BAD9AF47E976C3"><enum>(B)</enum><text display-inline="yes-display-inline">The United Nations has waived any immunity
enjoyed by any United Nations official from the judicial process in the United
States for any civil or criminal acts or omissions under Federal or State law
that may have transpired within the jurisdiction of the United States in
connection with the oil-for-food program.</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDFE7DB5A6F23F4CA3A41A939289C8FF2F"><enum>(2)</enum><header>Definition</header><text display-inline="yes-display-inline">As used in this subsection, the term
<term>oil-for-food program</term> means the program established and
administered pursuant to United Nations Security Council Resolution 986 (April
14, 1995) and subsequent United Nations resolutions to permit the sale of
petroleum products exported from Iraq and to use the revenue generated from
such sale for humanitarian assistance.</text>
</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID8807D4E24CC147709B597B9CF0AD32AE" section-type="subsequent-section"><enum>105.</enum><header>Terrorism and the
United Nations</header><text display-inline="no-display-inline">The President
shall direct the United States Permanent Representative to the United Nations
to use the voice, vote, and influence of the United States at the United
Nations to work toward adoption by the General Assembly of—</text>
<paragraph commented="no" display-inline="no-display-inline" id="ID9EC6114269FB48DF9F90FBE695D26E14"><enum>(1)</enum><text display-inline="yes-display-inline">a definition of terrorism that builds upon
the recommendations of the Secretary General’s High-Level Panel on Threats,
Challenges, and Change, and includes as an essential component of such
definition any action that is intended to cause death or serious bodily harm to
civilians with the purpose of intimidating a population or compelling a
government or an international organization to do, or abstain from doing, any
act; and</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID88311D40655049DEADDFE1A045F8B60B"><enum>(2)</enum><text display-inline="yes-display-inline">a comprehensive convention on terrorism
that includes the definition described in paragraph (1).</text>
</paragraph></section><section commented="no" display-inline="no-display-inline" id="IDDBC32CF413E24BB69092F957A99DC1E5" section-type="subsequent-section"><enum>106.</enum><header>United Nations
treaty bodies</header><text display-inline="no-display-inline">The United
States shall withhold from United States contributions to the regular assessed
budget of the United Nations for a biennial period amounts that are
proportional to the percentage of such budget that are expended with respect to
a United Nations human rights treaty monitoring body or committee that was
established by—</text>
<paragraph commented="no" display-inline="no-display-inline" id="IDFED9DC9648604AB5B1BD715F2E119248"><enum>(1)</enum><text display-inline="yes-display-inline">a convention (without any protocols) or an
international covenant (without any protocols) to which the United States is
not party; or</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID350BE0A3FD8946BB9D79474DF50DB11D"><enum>(2)</enum><text display-inline="yes-display-inline">a convention, with a subsequent protocol,
if the United States is a party to neither.</text>
</paragraph></section><section commented="no" display-inline="no-display-inline" id="ID818BCF8C577E4CCE9734C160C1189735" section-type="subsequent-section"><enum>107.</enum><header>Equality at the
United Nations</header>
<subsection commented="no" display-inline="no-display-inline" id="IDF8FD2CC0DC3F40F4B289EE5E24E12F9F"><enum>(a)</enum><header>Inclusion of
Israel in WEOG</header>
<paragraph commented="no" display-inline="no-display-inline" id="ID41ED7748FC2B456CA86DCB2952E0FC13"><enum>(1)</enum><header>In
general</header><text display-inline="yes-display-inline">The President shall
direct the United States Permanent Representative to the United Nations to use
the voice, vote, and influence of the United States to expand the Western
European and Others Group (WEOG) in the United Nations to include Israel as a
permanent member with full rights and privileges.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6FEA2FA04ADB4A94AAE280481946A191"><enum>(2)</enum><header>Notification to
Congress</header><text display-inline="yes-display-inline">Not later than 6
months after the date of the enactment of this Act and every 6 months
thereafter for the next 2 years, the Secretary of State shall notify the
appropriate congressional committees concerning the treatment of Israel in the
United Nations and the expansion of WEOG to include Israel as a permanent
member.</text>
</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDED8F9805AA2E4DF3A853B68517383A5F"><enum>(b)</enum><header>Department of
State review and report</header>
<paragraph commented="no" display-inline="no-display-inline" id="ID8649D50CEC764AB7830FF905DE4142AC"><enum>(1)</enum><header>In
general</header><text display-inline="yes-display-inline">To avoid duplicative
efforts and funding with respect to Palestinian interests and to ensure balance
in the approach to Israeli–Palestinian issues, the Secretary shall, not later
than 60 days after the date of the enactment of this Act—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="ID50337A8CA345442CA19B45F8200B1EDD"><enum>(A)</enum><text display-inline="yes-display-inline">conduct an audit of the functions of the
entities listed in paragraph (2); and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID09B55C304DD54749BC3F77AC75B542FC"><enum>(B)</enum><text display-inline="yes-display-inline">submit to the appropriate congressional
committees a report containing recommendations for the elimination of such
duplicative entities and efforts.</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD96E873F01A940BCBDA3F6FDD229DD3F"><enum>(2)</enum><header>Entities</header><text display-inline="yes-display-inline">The entities referred to in paragraph (1)
are the following:</text>
<subparagraph commented="no" display-inline="no-display-inline" id="ID030025587B3C440B9EDD3821657FAA6A"><enum>(A)</enum><text display-inline="yes-display-inline">The United Nations Division for Palestinian
Rights.</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID7AC59CBD9653441D9E9F40C6342DA71D"><enum>(B)</enum><text display-inline="yes-display-inline">The Committee on the Exercise of the
Inalienable Rights of the Palestinian People.</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID762D74F9EB084C3EA32BEBA965040DE0"><enum>(C)</enum><text display-inline="yes-display-inline">The United Nations Special Coordinator for
the Middle East Peace Process and Personal Representative to the Palestine
Liberation Organization and the Palestinian Authority.</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDF34B87AD334D48868665C6B899A32FE4"><enum>(D)</enum><text display-inline="yes-display-inline">The NGO Network on the Question of
Palestine.</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDD0EA861EEFAA448CA264A7C1741692EB"><enum>(E)</enum><text display-inline="yes-display-inline">The Special Committee to Investigate
Israeli Practices Affecting the Human Rights of the Palestinian People and
Other Arabs of the Occupied Territories.</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDDF6CC5655A7144D585C0EEF0AABC21B6"><enum>(F)</enum><text display-inline="yes-display-inline">Any other entity the Secretary determines
results in duplicative efforts or funding or fails to ensure balance in the
approach to Israeli-Palestinian issues.</text>
</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID9A1251A3120949019DD9425FA82674E3"><enum>(c)</enum><header>Implementation
by permanent representative</header>
<paragraph commented="no" display-inline="no-display-inline" id="IDF0B91753DC174E15A4E4D82706D34EBF"><enum>(1)</enum><header>In
general</header><text display-inline="yes-display-inline">The President shall
direct the United States Permanent Representative to the United Nations to use
the voice, vote, and influence of the United States at the United Nations to
seek the implementation of the recommendations contained in the report required
under subsection (b)(1).</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDA2F19477176E472DA05989AF58763153"><enum>(2)</enum><header>Withholding of
funds</header><text display-inline="yes-display-inline">Until such
recommendations have been implemented, the United States shall withhold from
United States contributions to the regular assessed budget of the United
Nations for a biennial period amounts that are proportional to the percentage
of such budget that are expended for such entities.</text>
</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID2398A72A9E34413B886578BF92CB9072"><enum>(d)</enum><header>GAO
audit</header><text display-inline="yes-display-inline">The Comptroller General
of the United States of the Government Accountability Office shall conduct an
audit of—</text>
<paragraph commented="no" display-inline="no-display-inline" id="ID7AD23CFE8C6A42D4BFA93BE34859CBE4"><enum>(1)</enum><text display-inline="yes-display-inline">the status of the implementation of the
recommendations contained in the report required under subsection (b)(1);
and</text>

</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="IDDCE9736067A74847829F9CAF04FF5C03" section-type="subsequent-section"><enum>108.</enum><header>Report on United
Nations reform</header>
<subsection commented="no" display-inline="no-display-inline" id="ID54182548241740ED87DCC799D4EACB7E"><enum>(a)</enum><header>In
general</header><text display-inline="yes-display-inline">Not later than 180
days after the date of the enactment of this Act, and 1 year thereafter, the
Secretary shall submit to the appropriate congressional committees a report on
United Nations reform since 1990.</text>
</subsection><subsection commented="no" display-inline="no-display-inline" id="ID6C67757F86224F2EB1676AB5B25DBD84"><enum>(b)</enum><header>Contents</header><text display-inline="yes-display-inline">The report required under paragraph (1)
shall describe—</text>
<paragraph commented="no" display-inline="no-display-inline" id="ID126185CC223F43B0A937838C3FD829EF"><enum>(1)</enum><text display-inline="yes-display-inline">the status of the implementation of
management reforms within the United Nations and its specialized
agencies;</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2EAA3BA3B54B47E691082850DE1525EF"><enum>(2)</enum><text display-inline="yes-display-inline">the number of outputs, reports, or other
items generated by General Assembly resolutions that have been
eliminated;</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC45EE91D57284981836F286733738329"><enum>(3)</enum><text display-inline="yes-display-inline">the progress of the General Assembly to
modernize and streamline the committee structure and its specific
recommendations on oversight and committee outputs, consistent with the March
2005 report of the Secretary General entitled <quote>In larger freedom: towards
development, security and human rights for all</quote>;</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4C3ED46ADCF34C669B9CEF9AC4C11C92"><enum>(4)</enum><text display-inline="yes-display-inline">the status of the review by the General
Assembly of all mandates older than 5 years and how resources have been
redirected to new challenges, consistent with such March 2005 report of the
Secretary General;</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE7207509678D46EDA46B46D690DEBC4F"><enum>(5)</enum><text display-inline="yes-display-inline">the continued utility and relevance of the
Economic and Financial Committee and the Social, Humanitarian, and Cultural
Committee, in light of the duplicative agendas of those committees and the
Economic and Social Council; and</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5711F099AC2B4FD8A2603E1C6048F9A0"><enum>(6)</enum><text display-inline="yes-display-inline">whether the United Nations or any of its
specialized agencies has contracted with any party included on the Lists of
Parties Excluded from Federal Procurement and Nonprocurement Programs.</text>
</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID301FEACD7A7A4C74820DD0C56EE28B3F" section-type="subsequent-section"><enum>109.</enum><header>Report on United
Nations personnel</header>
<subsection commented="no" display-inline="no-display-inline" id="ID61B375C757B949AE8304341555F0C8E0"><enum>(a)</enum><header>In
general</header><text display-inline="yes-display-inline">Not later than 1 year
after the date of the enactment of this Act, the Secretary of State shall
submit to the appropriate congressional committees a report—</text>
<paragraph commented="no" display-inline="no-display-inline" id="IDA51AD35195124D929F4C5C14E5FA5C3E"><enum>(1)</enum><text display-inline="yes-display-inline">concerning the progress of the General
Assembly to modernize human resource practices, consistent with the March 2005
report of the Secretary General entitled <quote>In larger freedom: towards
development, security and human rights for all</quote>; and</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDB21097E5ACBA4FF3B818D06C717C984D"><enum>(2)</enum><text display-inline="yes-display-inline">containing the information described in
subsection (b).</text>
</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDFD6341F471474D6EB5D19CD248422F1B"><enum>(b)</enum><header>Contents</header><text display-inline="yes-display-inline">The report shall include—</text>
<paragraph commented="no" display-inline="no-display-inline" id="ID4F68621A2E574D3A9CA25C716F5EBB59"><enum>(1)</enum><text display-inline="yes-display-inline">a comprehensive evaluation of human
resources reforms at the United Nations, including an evaluation of—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="IDD5F34B47AD2B4C67B904A90C80C66317"><enum>(A)</enum><text display-inline="yes-display-inline">tenure;</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDE35A4E4081014163BB3FF4B3F7E2D7BF"><enum>(B)</enum><text display-inline="yes-display-inline">performance reviews;</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID94185718248C4A9CA3A71E29BCD0623C"><enum>(C)</enum><text display-inline="yes-display-inline">the promotion system;</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID0A4591D3FFDF413B933EB3E65EDE2477"><enum>(D)</enum><text display-inline="yes-display-inline">a merit-based hiring system and enhanced
regulations concerning termination of employment of employees; and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID0D7284D5B32845E4BD8F923E547C6E54"><enum>(E)</enum><text display-inline="yes-display-inline">the implementation of a code of conduct and
ethics training;</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9589F014262F461B98EB86AA6A12B695"><enum>(2)</enum><text display-inline="yes-display-inline">the implementation of a system of
procedures for filing complaints and protective measures for work-place
harassment, including sexual harassment;</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE8DF68BA6F37485895EE15A3CE289BB0"><enum>(3)</enum><text display-inline="yes-display-inline">policy recommendations relating to the
establishment of a rotation requirement for nonadministrative positions;</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID780FBF11B6B94D61BEEFF19F170C2DB1"><enum>(4)</enum><text display-inline="yes-display-inline">policy recommendations relating to the
establishment of a prohibition preventing personnel and officials assigned to
the mission of a Member State to the United Nations from transferring to a
position within the United Nations Secretariat that is compensated at the P–5
level and above;</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9C2254827C0E49AE9B4A6ED927AF2702"><enum>(5)</enum><text display-inline="yes-display-inline">policy recommendations relating to a
reduction in travel allowances and attendant oversight with respect to
accommodations and airline flights; and</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDB31C4CE28C3D42F8978C082F03CA28B8"><enum>(6)</enum><text display-inline="yes-display-inline">an evaluation of the recommendations of the
Secretary General relating to greater flexibility for the Secretary General in
staffing decisions to accommodate changing priorities.</text>
</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID1F02E7BC273E42C28C2BBE49C67B5E42" section-type="subsequent-section"><enum>110.</enum><header>Report on United
States contributions to the United Nations</header><text display-inline="no-display-inline">Not later than 12 months after the date of
the enactment of this Act, the Director of the Office of Management and Budget
shall submit to the Committee on International Relations of the House of
Representatives, the Committee on Foreign Relations of the Senate, the
Committee on Appropriations of the House of Representatives, and the Committee
on Appropriations of the Senate a report on United States contributions to the
United Nations. Such report shall examine assessed, voluntary, in-kind, and all
other United States contributions.</text>
</section><section commented="no" display-inline="no-display-inline" id="ID5FCB524E694A402D90AC991FAA5D1798" section-type="subsequent-section"><enum>111.</enum><header>United Nations
Security Council and Lebanon</header>
<subsection commented="no" display-inline="no-display-inline" id="ID74012E2559214F278DAD0CAD41EC81AC"><enum>(a)</enum><header>Resolution
1559</header><text display-inline="yes-display-inline">The President shall
direct the United States Permanent Representative to the United Nations to use
the voice, vote, and influence of the United States at the United Nations to
make every effort to ensure that the Security Council is undertaking the
necessary steps to secure the implementation of Security Council Resolution
1559, including—</text>
<paragraph commented="no" display-inline="no-display-inline" id="IDED6FFAB194A446A9828931AD6C09507D"><enum>(1)</enum><text display-inline="yes-display-inline">deploying United Nations inspectors to
verify and certify to the Security Council that—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="ID58F275773DE44B3FB553305201CA9958"><enum>(A)</enum><text display-inline="yes-display-inline">all foreign forces, including intelligence,
security, and policing forces, have been withdrawn from Lebanon; and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID872A362C6CDD459EB20503F8F8E9E3B2"><enum>(B)</enum><text display-inline="yes-display-inline">all militias in Lebanon have been
permanently disarmed and dismantled and their weapons have been decommissioned;
and</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0523ED67A108483D8D8AB82AD1403076"><enum>(2)</enum><text display-inline="yes-display-inline">continuing the presence of United Nations
elections monitoring teams in Lebanon to verify and certify to the Security
Council that—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="IDA6CFC7D43ABE45CE91BD4C7C06FDE527"><enum>(A)</enum><text display-inline="yes-display-inline">citizens of Lebanon are not being targeted
for assassination by foreign forces, in particular by foreign forces of Syria,
or by their proxies, as a means of intimidation and coercion in an effort to
manipulate the political process in Lebanon;</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID703DDB3706E847BFB2B464423B123E5B"><enum>(B)</enum><text display-inline="yes-display-inline">elections in Lebanon are being conducted in
a fair and transparent manner and are free of foreign interference; and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID8D585FB7C6A34277AB7ECE94353C65AD"><enum>(C)</enum><text display-inline="yes-display-inline">that such foreign forces, or their proxies,
are not seeking to infringe upon the territorial integrity or political
sovereignty of Lebanon.</text>
</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID66DBD794233640DB9FC378FE7273443D"><enum>(b)</enum><header>United States
action</header><text display-inline="yes-display-inline">If the steps described
in paragraphs (1) and (2) of subsection (a) have not been verified and
certified to the Security Council by July 31, 2005, or by the date that is not
later than 30 days after the date of the enactment of this Act, whichever is
sooner, the President shall direct the United States Permanent Representative
to the United Nations to use the voice, vote, and influence of the United
States at the United Nations to secure the adoption of a resolution in the
Security Council imposing punitive measures on the governments of countries
whose forces remain in Lebanon in violation of Security Council Resolution 1559
and who directly, or through proxies, are infringing upon the territorial
integrity or political sovereignty of Lebanon.</text>
</subsection></section><section commented="no" display-inline="no-display-inline" id="IDEB51AB14D80A437295C6C84A5849E0BC" section-type="subsequent-section"><enum>112.</enum><header>Policy with respect
to expansion of the Security Council</header><text display-inline="no-display-inline">It shall be the policy of the United States
to use the voice, vote, and influence of the United States at the United
Nations to oppose any proposals on expansion of the Security Council if such
expansion would—</text>
<paragraph commented="no" display-inline="no-display-inline" id="IDE8140145AFC74133A37D200E4A77CF96"><enum>(1)</enum><text display-inline="yes-display-inline">diminish the influence of the United States
on the Security Council;</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD9272B1F2BFC48E2A1858B4AE92BB2A6"><enum>(2)</enum><text display-inline="yes-display-inline">include veto rights for any new members of
the Security Council; or</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID85BED603B1DB422E84C2AAF01B1C6479"><enum>(3)</enum><text display-inline="yes-display-inline">undermine the effectiveness of the Security
Council.</text>
</paragraph></section><section commented="no" display-inline="no-display-inline" id="ID1E8E4E1254CB48F9A985A6E72DC30F5C" section-type="subsequent-section"><enum>113.</enum><header>Genocide and the
United Nations</header>
<subsection commented="no" display-inline="no-display-inline" id="ID51A2E678883B41E0952F9957986107C4"><enum>(a)</enum><header>United States
action</header><text display-inline="yes-display-inline">The President shall
direct the United States Permanent Representative to the United Nations to use
the voice, vote, and influence of the United States at the United Nations to
make every effort to ensure the formal adoption and implementation of
mechanisms to—</text>
<paragraph commented="no" display-inline="no-display-inline" id="ID0DA61C7A65674C9AA1FB0F0258F13F09"><enum>(1)</enum><text display-inline="yes-display-inline">suspend the membership of a Member State if
it is determined that the government of such Member State is engaged in or
complicit in, either by commission or omission, acts of genocide, ethnic
cleansing, or crimes against humanity;</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID59558A898BB8420493C6DEA37CF0C5F0"><enum>(2)</enum><text display-inline="yes-display-inline">impose an arms and trade embargo and travel
restrictions on, and freeze the assets of, all groups and individuals
responsible for committing or allowing such acts of genocide, ethnic cleansing,
or crimes against humanity to occur;</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8B39497836A14D3D9114D903E7881ABE"><enum>(3)</enum><text display-inline="yes-display-inline">deploy a United Nations peacekeeping
operation or authorize and support the deployment of a peacekeeping operation
from an international or regional organization to the Member State with a
mandate to stop such acts of genocide, ethnic cleansing, or crimes against
humanity;</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE090C0A6A68642D894E4BEF59ED60866"><enum>(4)</enum><text display-inline="yes-display-inline">deploy monitors from the United Nations
High Commissioner for Refugees to the area in the Member State where such acts
of genocide, ethnic cleansing, or crimes against humanity are occurring;
and</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDAB2DEEC84C354A709394497E1DFD7BF8"><enum>(5)</enum><text display-inline="yes-display-inline">authorize the establishment of an
international commission of inquiry into such acts of genocide, ethnic
cleansing, or crimes against humanity.</text>
</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDB121CBC07C9C47EB96A46EA8610D04CD"><enum>(b)</enum><header>Certification</header><text display-inline="yes-display-inline">In accordance with section 601, a
certification shall be required that certifies that the mechanisms described in
subsection (a) have been adopted and implemented.</text>
</subsection></section><section commented="no" display-inline="no-display-inline" id="ID13E8A73B3CD445CF8BE756DCF9F797FE" section-type="subsequent-section"><enum>114.</enum><header>Anti-semitism and
the United Nations</header>
<subsection commented="no" display-inline="no-display-inline" id="ID4B6E4796CB1B4FA49A6483032B910FBB"><enum>(a)</enum><header>In
general</header><text display-inline="yes-display-inline">The President shall
direct the United States Permanent Representative to the United Nations to use
the voice, vote, and influence of the United States at the United Nations to
make every effort to—</text>
<paragraph commented="no" display-inline="no-display-inline" id="ID0364D61233494A229E07CAB15E5E20BE"><enum>(1)</enum><text display-inline="yes-display-inline">ensure the issuance and implementation of a
directive by the Secretary General or the Secretariat, as appropriate,
that—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="ID7BDD4B36225949F386468FDCCBF2D24F"><enum>(A)</enum><text display-inline="yes-display-inline">requires all employees of the United
Nations and its specialized agencies to officially and publicly condemn
anti-Semitic statements made at any session of the United Nations or its
specialized agencies, or at any other session sponsored by the United
Nations;</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDEC0B585EC5E647FD95C14C4426434B28"><enum>(B)</enum><text display-inline="yes-display-inline">requires employees of the United Nations
and its specialized agencies to be subject to punitive action, including
immediate dismissal, for making anti-Semitic statements or references;</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDC58D702FACB646399CE4E827C1FA6BD7"><enum>(C)</enum><text display-inline="yes-display-inline">proposes specific recommendations to the
General Assembly for the establishment of mechanisms to hold accountable
employees and officials of the United Nations and its specialized agencies, or
Member States, that make such anti-Semitic statements or references in any
forum of the United Nations or of its specialized agencies; and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDCDCCA4AA5F554306ABC4C853561E231C"><enum>(D)</enum><text display-inline="yes-display-inline">develops and implements education awareness
programs about the Holocaust and anti-Semitism throughout the world, as part of
an effort to combat intolerance and hatred;</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7EAEAC6923004A0B8757BA9CC7CF004E"><enum>(2)</enum><text display-inline="yes-display-inline">work to secure the adoption of a resolution
by the General Assembly that establishes the mechanisms described in paragraph
(1)(C); and</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID85FD001DFF9D4801A4C6077B09394C04"><enum>(3)</enum><text display-inline="yes-display-inline">continue working toward further reduction
of anti-Semitic language and anti-Israel resolutions in the United Nations and
its specialized agencies.</text>
</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID89991A5F3C4F460583F8C27F09A7879C"><enum>(b)</enum><header>Certification</header><text display-inline="yes-display-inline">In accordance with section 601, a
certification shall be required that certifies that the requirements described
in subsection (a) have been satisfied.</text>
</subsection></section><enum>II</enum><header>Human Rights and the Economic and Social
Council (ecosoc)</header>
<section commented="no" display-inline="no-display-inline" id="ID7825EB33DAEE433B9D7AB9F8A3EF2F63" section-type="subsequent-section"><enum>201.</enum><header>Human
Rights</header>
<subsection commented="no" display-inline="no-display-inline" id="IDC43BE32613B34D96903DC6D3DBC69DD2"><enum>(a)</enum><header>Statement of
policy</header><text display-inline="yes-display-inline">It shall be the policy
of the United States to use its voice, vote, and influence at the United
Nations to ensure that a credible and respectable Human Rights Council or other
human rights body is established within the United Nations whose participating
Member States uphold the values embodied in the Universal Declaration of Human
Rights.</text>
</subsection><subsection commented="no" display-inline="no-display-inline" id="ID1A97B9B8255B4B25863424FDBD9913AB"><enum>(b)</enum><header>Human Rights
reforms at the United Nations</header><text display-inline="yes-display-inline">The President shall direct the United
States Permanent Representative to the United Nations to ensure that the
following human rights reforms have been adopted by the United Nations:</text>
<paragraph commented="no" display-inline="no-display-inline" id="ID513C1C2994734EBEAC85498F5379E9EF"><enum>(1)</enum><text display-inline="yes-display-inline">A Member State that fails to uphold the
values embodied in the Universal Declaration of Human Rights shall be
ineligible for membership on any United Nations human rights body.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID538EC70A024D4C61B6594573FA6EE36F"><enum>(2)</enum><text display-inline="yes-display-inline">A Member State shall be ineligible for
membership on any United Nations human rights body if such Member State
is—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="IDBA9C820AFC8E4408B62569B6261FCA0E"><enum>(A)</enum><text display-inline="yes-display-inline">subject to sanctions by the Security
Council; or</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDA5333F4C85004DA69B849FB403477120"><enum>(B)</enum><text display-inline="yes-display-inline">under a Security Council-mandated
investigation for human rights abuses.</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID958793024FD04640AC775A25EED698C9"><enum>(3)</enum><text display-inline="yes-display-inline">A Member State that is currently subject to
an adopted country specific resolution, in the principal body in the United
Nations for the promotion and protection of human rights, relating to human
rights abuses perpetrated by the government of such country in such country, or
has been the subject of such an adopted country specific resolution in such
principal body within the previous 3 years, shall be ineligible for membership
on any United Nations human rights body. For purposes of this subsection, an
adopted country specific resolution shall not include consensus resolutions on
advisory services.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID22BB7655D8964BA7A6AF8695130B6745"><enum>(4)</enum><text display-inline="yes-display-inline">A Member State that violates the principles
of a United Nations human rights body to which it aspires to join shall be
ineligible for membership on such body.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDBD5A798A89574FDABEDB7D0594E1ED9C"><enum>(5)</enum><text display-inline="yes-display-inline">No human rights body has a standing agenda
item that relates only to one country or region.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID006A43759D614EB6B836C4F0AA2CCC94"><enum>(6)</enum><text display-inline="yes-display-inline">The practice of considering in the
principal body in the United Nations for the promotion and protection of human
rights country specific resolutions relating to human rights abuses perpetrated
by the government of a Member State within such Member State shall not be
eliminated.</text>
</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID5DA1391D06624B7DA80B8E2126BA7362"><enum>(c)</enum><header>Certification</header><text display-inline="yes-display-inline">In accordance with section 601, a
certification shall be required that certifies that the human rights reforms
described under subsection (b) have been adopted by the United Nations.</text>
</subsection><subsection commented="no" display-inline="no-display-inline" id="ID0537126ACEE64AE3927601B487B6F0D7"><enum>(d)</enum><header>Prevention of
abuse of <quote>no action</quote> motions</header><text display-inline="yes-display-inline">The United States Permanent Representative
shall work to prevent abuse of <quote>no action</quote> motions, particularly
as such motions relate to country specific resolutions.</text>
</subsection><subsection commented="no" display-inline="no-display-inline" id="IDAFCC657C91984310B787176626CDC96C"><enum>(e)</enum><header>Office of the
United Nations High Commissioner for Human Rights</header>
<paragraph commented="no" display-inline="no-display-inline" id="IDDA8C44F1B79544F79987774AA270A203"><enum>(1)</enum><header>Statement of
policy</header><text display-inline="yes-display-inline">It shall be the policy
of the United States to continue to strongly support the Office of the United
Nations High Commissioner for Human Rights.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID47C17B6EC421474E8F12EF8413D24029"><enum>(2)</enum><header>Certification</header><text display-inline="yes-display-inline">In accordance with section 601, a
certification shall be required that certifies that the Office of the United
Nations High Commissioner for Human Rights has been given greater authority in
field operation activities, such as in the Darfur region of Sudan and in the
Democratic Republic of the Congo, in furtherance of the purpose and mission of
the United Nations.</text>
</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID1D1D8D276582472D952C6B1C4905E215"><enum>(f)</enum><header>Prohibition on
contact with Member States Subject to sanctions</header><text display-inline="yes-display-inline">An employee from of any United Nations
entity, bureau, division, department, or specialized agency may not have
unauthorized contact, including business contact, with a Member State that is
subject to United Nations sanctions.</text>
</subsection></section><section commented="no" display-inline="no-display-inline" id="IDC89214B3480A414DBB800E835CD923B1" section-type="subsequent-section"><enum>202.</enum><header>Economic and Social
Council (ecosoc)</header>
<subsection commented="no" display-inline="no-display-inline" id="IDE85370A00DA149FA892490BEA080C9F9"><enum>(a)</enum><header>Statement of
policy</header><text display-inline="yes-display-inline">It shall be the policy
of the United States to use its voice, vote, and influence at the United
Nations to—</text>
<paragraph commented="no" display-inline="no-display-inline" id="IDDE9850AB335B47D5ACD99D60DC67C229"><enum>(1)</enum><text display-inline="yes-display-inline">abolish secret voting in the Economic and
Social Council (ECOSOC);</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDAF1F27F7062B4C51AF06E1D60F0EA07A"><enum>(2)</enum><text display-inline="yes-display-inline">ensure that, until such time as the
Commission on Human Rights of the United Nations is abolished, only countries
that are not ineligible for membership on a human rights body in accordance
with paragraph (1) through (4) of section 201(b) shall be considered for
membership on the Commission on Human Rights; and</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2708EFCAE00A4AC2A5680CAB158B5643"><enum>(3)</enum><text display-inline="yes-display-inline">ensure that after candidate countries are
nominated for membership on the Commission on Human Rights, the Economic and
Social Council conducts a recorded vote to determine such membership.</text>
</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDA5CF5E39D00048449066688DB0926C4F"><enum>(b)</enum><header>Certification</header><text display-inline="yes-display-inline">In accordance with section 601, a
certification shall be required that certifies that the policies described in
subsection (a) have been implemented by the Economic and Social Council.</text>
</subsection></section><section commented="no" display-inline="no-display-inline" id="IDC7839411B269423A82D74D0E710F200E" section-type="subsequent-section"><enum>203.</enum><header>United Nations
Democracy Fund</header>
<subsection commented="no" display-inline="no-display-inline" id="ID50429657101C4BB8AF57D9C9F91B0160"><enum>(a)</enum><header>In
general</header><text display-inline="yes-display-inline">The President shall
direct the United States Permanent Representative to the United Nations to use
the voice, vote, and influence of the United States at the United Nations to
make every effort to—</text>
<paragraph commented="no" display-inline="no-display-inline" id="IDF30E929F0D1B4DE39ACCF6216E0379BE"><enum>(1)</enum><text display-inline="yes-display-inline">establish a Democracy Fund at the United
Nations to be administered by Member States of the United Nations Democracy
Caucus;</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9A19C2425163499D9159C2FA2D93413D"><enum>(2)</enum><text display-inline="yes-display-inline">secure political and financial support for
the Democracy Fund from Member States of the United Nations Democracy Caucus;
and</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3316C8C925644FA4982A69C74DD83DB8"><enum>(3)</enum><text display-inline="yes-display-inline">establish criteria that limits recipients
of assistance from the Democracy Fund to Member States that—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="ID9C4E4ACFED9249618BE8FEE18512CC9A"><enum>(A)</enum><text display-inline="yes-display-inline">are not ineligible for membership on any
United Nations human rights body, in accordance with paragraphs (1) through (4)
of section 201(b); and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDFAEA20175963424A813614B8445A648E"><enum>(B)</enum><text display-inline="yes-display-inline">are determined by the Secretary of State to
be emerging democracies or democracies in transition.</text>
</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDEFAEDF8881E1405EA380A9B6F856ED99"><enum>(b)</enum><header>Policy relating
to funding for the Democracy Fund</header><text display-inline="yes-display-inline">It shall be the policy of the United States
to shift contributions of the United States to the regularly assessed budget of
the United Nations for a biennial period to initiate and support the Democracy
Fund referred to in subsection (a).</text>
</subsection><subsection commented="no" display-inline="no-display-inline" id="ID508509DF7BEC4067B8DA9FA535DA25B2"><enum>(c)</enum><header>Certification</header><text display-inline="yes-display-inline">In accordance with section 601, a
certification shall be required that certifies that the requirements described
in subsection (a) have been satisfied.</text>
</subsection></section><enum>III</enum><header>International Atomic Energy Agency</header>
<section commented="no" display-inline="no-display-inline" id="ID184560D599FE4C4FA528B39F83CBD129" section-type="subsequent-section"><enum>301.</enum><header>International Atomic
Energy Agency</header>
<subsection commented="no" display-inline="no-display-inline" id="IDACFD383B47BD4781BF84F44D1D621E01"><enum>(a)</enum><header>Enforcement and
compliance</header>
<paragraph commented="no" display-inline="no-display-inline" id="IDE895AD1182F74DD0B10CCBFA16173B26"><enum>(1)</enum><header>Office of
Compliance</header>
<subparagraph commented="no" display-inline="no-display-inline" id="IDDC364E584F2D4CCF99B123B4993000BD"><enum>(A)</enum><header>Establishment</header><text display-inline="yes-display-inline">The President shall direct the United
States Permanent Representative to International Atomic Energy Agency (IAEA) to
use the voice, vote, and influence of the United States at the IAEA to
establish an Office of Compliance in the Secretariat of the IAEA.</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDA71ABB0B67D2474CBA0D812BDA08F257"><enum>(B)</enum><header>Operation</header><text display-inline="yes-display-inline">The Office of Compliance shall—</text>
<clause commented="no" display-inline="no-display-inline" id="IDBDE85694F42D4CF9A08DE04CA7FDB65B"><enum>(i)</enum><text display-inline="yes-display-inline">function as an independent body composed of
technical experts who shall work in consultation with IAEA inspectors to assess
compliance by IAEA Member States and provide recommendations to the IAEA Board
of Governors concerning penalties to be imposed on IAEA Member States that fail
to fulfill their obligations under IAEA Board resolutions;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="IDB6C61294001F4219A23D43F395077139"><enum>(ii)</enum><text display-inline="yes-display-inline">base its assessments and recommendations on
IAEA inspection reports; and</text>
</clause><clause commented="no" display-inline="no-display-inline" id="ID3ACCC4FED7B74FFEA36754740F9895D7"><enum>(iii)</enum><text display-inline="yes-display-inline">shall take into consideration information
provided by IAEA Board Members that are one of the five nuclear weapons states
as recognized by the Treaty on the Non-Proliferation of Nuclear Weapons (21 UST
483) (commonly referred to as the <quote>Nuclear Nonproliferation
Treaty</quote> or the <quote>NPT</quote>).</text>
</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID91F105A4F3834DE9BF4EB449CB2CA11F"><enum>(C)</enum><header>Staffing</header><text display-inline="yes-display-inline">The Office of Compliance shall be staffed
from existing personnel in the Department of Safeguards of the IAEA or the
Department of Nuclear Safety and Security of the IAEA.</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDFC512396C6DC4703BBE83D83EB85E7E4"><enum>(2)</enum><header>Special
Committee on Safeguards and Verification</header>
<subparagraph commented="no" display-inline="no-display-inline" id="ID837D8EEE23B04D4B9EDBC24B90A06B31"><enum>(A)</enum><header>Establishment</header><text display-inline="yes-display-inline">The President shall direct the United
States Permanent Representative to the IAEA to use the voice, vote, and
influence of the United States at the IAEA to establish a Special Committee on
Safeguards and Verification.</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID17F9B0190DF341998F9B6444D83E4A0C"><enum>(B)</enum><header>Responsibilities</header><text display-inline="yes-display-inline">The Special Committee shall—</text>
<clause commented="no" display-inline="no-display-inline" id="IDF5C9B26999D24094BF1DE2C514A18424"><enum>(i)</enum><text display-inline="yes-display-inline">improve the ability of the IAEA to monitor
and enforce compliance by Member States of the IAEA with the Nuclear
Nonproliferation Treaty and the Statute of the International Atomic Energy
Agency; and</text>
</clause><clause commented="no" display-inline="no-display-inline" id="IDAAFA38F1682D44DDABBE469787A1C4D4"><enum>(ii)</enum><text display-inline="yes-display-inline">consider which additional measures are
necessary to enhance the ability of the IAEA, beyond the verification
mechanisms and authorities contained in the Additional Protocol to the
Safeguards Agreements between the IAEA and Member States of the IAEA, to detect
with a high degree of confidence undeclared nuclear activities by a Member
State.</text>
</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID38570FB198F7457EBF1A05585A49C1B1"><enum>(3)</enum><header>Penalties with
respect to the IAEA</header>
<subparagraph commented="no" display-inline="no-display-inline" id="ID568F5A4678FB4A84B16B1D436DEB645C"><enum>(A)</enum><header>In
general</header><text display-inline="yes-display-inline">The President shall
direct the United States Permanent Representative to the IAEA to use the voice,
vote, and influence of the United States at the IAEA to ensure that a Member
State of the IAEA that is under investigation for a breach of or noncompliance
with its IAEA obligations or the purposes and principles of the Charter of the
United Nations has its privileges suspended, including—</text>
<clause commented="no" display-inline="no-display-inline" id="ID684A73DAF5CF4EC98F99D274B2287176"><enum>(i)</enum><text display-inline="yes-display-inline">limiting its ability to vote on its
case;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="ID09574869B4E04A1595B4996AC57A9FF2"><enum>(ii)</enum><text display-inline="yes-display-inline">being prevented from receiving any
technical assistance; and</text>
</clause><clause commented="no" display-inline="no-display-inline" id="IDE1D54E75176548459FFA88AD5EA720AA"><enum>(iii)</enum><text display-inline="yes-display-inline">being prevented from hosting
meetings.</text>
</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDE178B864F4E5494DB4DC7168477230C8"><enum>(B)</enum><header>Termination of
penalties</header><text display-inline="yes-display-inline">The penalties
specified under subparagraph (A) shall be terminated when such investigation is
concluded and such Member State is no longer in such breach or
noncompliance.</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDF49A88B9F1414E5C91DA3D98F8A7BF58"><enum>(4)</enum><header>Penalties with
respect to the Nuclear Nonproliferation Treaty</header><text display-inline="yes-display-inline">The President shall direct the United
States Permanent Representative to the IAEA to use the voice, vote, and
influence of the United States at the IAEA to ensure that a Member State of the
IAEA that is found to be in breach of, in noncompliance with, or has withdrawn
from the Nuclear Nonproliferation Treaty shall return to the IAEA all nuclear
materials and technology received from the IAEA, any Member State of the IAEA,
or any Member State of the Nuclear Nonproliferation Treaty.</text>
</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID3D086B3FB349477D96576263B573C71A"><enum>(b)</enum><header>United States
contributions</header>
<paragraph commented="no" display-inline="no-display-inline" id="ID10A1B4E2C845442390997278D1AE1992"><enum>(1)</enum><header>Voluntary
contributions</header><text display-inline="yes-display-inline">Voluntary
contributions of the United States to the IAEA should primarily be used to fund
activities relating to Nuclear Safety and Security or activities relating to
Nuclear Verification.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID10EBEF66AB824B2FBF71D09EFD0C4824"><enum>(2)</enum><header>Limitation on
use of funds</header><text display-inline="yes-display-inline">The President
shall direct the United States Permanent Representative to the IAEA to use the
voice, vote, and influence of the United States at the IAEA to—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="ID2979F1050FD54F24AECB9AE9CFFDF54B"><enum>(A)</enum><text display-inline="yes-display-inline">ensure that funds for safeguards
inspections are prioritized for countries that have newly established nuclear
programs or are initiating nuclear programs; and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID0E26518B8DB34D589C9229A3E9F9CFA5"><enum>(B)</enum><text display-inline="yes-display-inline">block the allocation of funds for any other
IAEA development, environmental, or nuclear science assistance or activity to a
country—</text>
<clause commented="no" display-inline="no-display-inline" id="ID8AC619D5B2B644D787D3CF3FA6B9FF13"><enum>(i)</enum><text display-inline="yes-display-inline">the government of which the Secretary of
State has determined, for purposes of section 6(j) of the
<act-name parsable-cite="EAA79">Export Administration Act of 1979</act-name>,
section 620A of the <act-name parsable-cite="FAA61">Foreign Assistance Act of
1961</act-name>, section 40 of the <act-name parsable-cite="AECA">Arms Export
Control Act</act-name>, or other provision of law, is a government that has
repeatedly provided support for acts of international terrorism and the
government of which the Secretary has determined has not dismantled and
surrendered its weapons of mass destruction programs under international
verification;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="ID8C83B38ED4BB497FB0D0CEAA05A85C1D"><enum>(ii)</enum><text display-inline="yes-display-inline">that is under investigation for a breach of
or noncompliance with its IAEA obligations or the purposes and principles of
the Charter of the United Nations; or</text>
</clause><clause commented="no" display-inline="no-display-inline" id="ID5D0AF5ECF97D4AC89CA0C1E4A04C1410"><enum>(iii)</enum><text display-inline="yes-display-inline">that is in violation of its IAEA
obligations or the purposes and principles of the Charter of the United
Nations.</text>
</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID58027562DEC9422881D56437109C458E"><enum>(3)</enum><header>Detail of
expenditures</header><text display-inline="yes-display-inline">The President
shall direct the United States Permanent Representative to the IAEA to use the
voice, vote, and influence of the United States at the IAEA to secure, as part
of the regular budget presentation of the IAEA to Member States of the IAEA, a
detailed breakdown by country of expenditures of the IAEA for safeguards
inspections and nuclear security activities.</text>
</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID718182E9E5934DB6A51EBC431AAED1F9"><enum>(c)</enum><header>Membership</header>
<paragraph commented="no" display-inline="no-display-inline" id="ID844A5B6122C94933A866307E6BB8FD12"><enum>(1)</enum><header>In
general</header><text display-inline="yes-display-inline">The President shall
direct the United States Permanent Representative to the IAEA to use the voice,
vote, and influence of the United States at the IAEA to block the membership on
the Board of Governors of the IAEA for a Member State of the IAEA that has not
signed and ratified the Additional Protocol and—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="IDFD0AD004B99B44D287273B9064F25891"><enum>(A)</enum><text display-inline="yes-display-inline">is under investigation for a breach of or
noncompliance with its IAEA obligations or the purposes and principles of the
Charter of the United Nations; or</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDACFACC843091436A9C383538670BF74C"><enum>(B)</enum><text display-inline="yes-display-inline">that is in violation of its IAEA
obligations or the purposes and principles of the Charter of the United
Nations.</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDB2C5A25C4C98474D9483973CC8A0D351"><enum>(2)</enum><header>Criteria</header><text display-inline="yes-display-inline">The United States Permanent Representative
to the IAEA shall make every effort to modify the criteria for Board membership
to reflect the principles described in paragraph (1).</text>
</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID95F46D8376A549CF8A340E3B77E2572C"><enum>(d)</enum><header>Small
Quantities Protocol</header><text display-inline="yes-display-inline">The
President shall direct the United States Permanent Representative to the IAEA
to use the voice, vote, and influence of the United States at the IAEA to make
every effort to ensure that the IAEA changes the policy regarding the Small
Quantities Protocol in order to—</text>
<paragraph commented="no" display-inline="no-display-inline" id="ID554AA5096FE3407CAEE2056E150507A7"><enum>(1)</enum><text display-inline="yes-display-inline">rescind and eliminate the Small Quantities
Protocol;</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1B8D1748A7B34FFCBB751AE677291415"><enum>(2)</enum><text display-inline="yes-display-inline">require that any IAEA Member State that has
previously signed a Small Quantities Protocol to sign, ratify, and implement
the Additional Protocol, provide immediate access for IAEA inspectors to its
nuclear-related facilities, and agree to the strongest inspections regime of
its nuclear efforts; and</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID330C27E8F0B9459088D5D25A0BB6B6F7"><enum>(3)</enum><text display-inline="yes-display-inline">require that any IAEA Member State that
does not comply with paragraph (2) to be ineligible to receive nuclear
material, technology, equipment, or assistance from any IAEA Member State and
subject to the penalties described in section 301(a)(3).</text>
</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDA3001E78F7E1420C9932C7DDF7465F5F"><enum>(e)</enum><header>Nuclear program
of Iran</header>
<paragraph commented="no" display-inline="no-display-inline" id="ID82BA2792C9BA473E899B74C406BEEBC3"><enum>(1)</enum><header>United States
action</header><text display-inline="yes-display-inline">The President shall
direct the United States Permanent Representative to the IAEA to use the voice,
vote, and influence of the United States at the IAEA to make every effort to
ensure the adoption of a resolution by the IAEA Board of Governors that makes
Iran ineligible to receive any nuclear material, technology, equipment, or
assistance from any IAEA Member State and ineligible for any IAEA assistance
not related to safeguards inspections or nuclear security until the IAEA Board
of Governors determines that Iran—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="IDFE9A30DAF9024C779815D5B599242299"><enum>(A)</enum><text display-inline="yes-display-inline">is providing full access to IAEA inspectors
to its nuclear-related facilities;</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDA1B1FC4E0A61446B803F81E4B953CA2B"><enum>(B)</enum><text display-inline="yes-display-inline">has fully implemented and is in compliance
with the Additional Protocol; and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID950A37B5A8754D02B37D72074AA90437"><enum>(C)</enum><text display-inline="yes-display-inline">has permanently ceased and dismantled all
activities and programs related to nuclear-enrichment and reprocessing.</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD1D7897B81DE4CDAB3E91FA639AA6DF9"><enum>(2)</enum><header>Penalties</header><text display-inline="yes-display-inline">If an IAEA Member State is determined to
have violated the prohibition on assistance to Iran described in paragraph (1)
before the IAEA Board of Governors determines that Iran has satisfied the
conditions described in subparagraphs (A) through (C) of such paragraph, such
Member State shall be subject to the penalties described in section 301(a)(3),
shall be ineligible to receive nuclear material, technology, equipment, or
assistance from any IAEA Member State, and shall be ineligible to receive any
IAEA assistance not related to safeguards inspections or nuclear security until
such time as the IAEA Board of Governors makes such determination with respect
to Iran.</text>
</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID4184401DB81D4D68B2935EAB6FF400B5"><enum>(f)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 6 months after the date of
the enactment of this Act and annually for 2 years thereafter, the President
shall submit to the appropriate congressional committees a report on the
implementation of this section.</text>
</subsection></section><section commented="no" display-inline="no-display-inline" id="IDC272AA97E5EC4E0A9EB02779D14E01EF" section-type="subsequent-section"><enum>302.</enum><header>Sense of Congress
regarding the Nuclear Security Action Plan of the IAEA</header><text display-inline="no-display-inline">It is the sense of Congress that the
national security interests of the United States are enhanced by the Nuclear
Security Action Plan of the IAEA and the Board of Governors should recommend,
and the General Conference should adopt, a resolution incorporating the Nuclear
Security Action Plan into the regular budget of the IAEA.</text>
</section><enum>IV</enum><header>Peacekeeping</header>
<section commented="no" display-inline="no-display-inline" id="IDBCFE2FC79EF24A349C351C92A276EAE4" section-type="subsequent-section"><enum>401.</enum><header>Sense of Congress
regarding reform of United Nations Peacekeeping Operations</header><text display-inline="no-display-inline">It is the sense of Congress that—</text>
<paragraph commented="no" display-inline="no-display-inline" id="IDEC9AAEFE212E4A4886F6596CF798B14C"><enum>(1)</enum><text display-inline="yes-display-inline">although United Nations peacekeeping
operations have contributed greatly toward the promotion of peace and stability
for the past 57 years and the majority of peacekeeping personnel who have
served under the United Nations flag have done so with honor and courage, the
record of United Nations peacekeeping has been severely tarnished by
operational failures and unconscionable acts of misconduct; and</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9AC8EB30B0664D2AA9BF3CCCF806C9DC"><enum>(2)</enum><text display-inline="yes-display-inline">if the reputation of and confidence in
United Nations peacekeeping operations is to be restored, fundamental and
far-reaching reforms, particularly in the areas of planning, management,
training, conduct, and discipline, must be implemented without delay.</text>
</paragraph></section><section commented="no" display-inline="no-display-inline" id="IDC8E7718B27FF4EA18B8194E54D8C069B" section-type="subsequent-section"><enum>402.</enum><header>Statement of policy
relating to reform of United Nations Peacekeeping Operations</header><text display-inline="no-display-inline">It shall be the policy of the United States
to pursue reform of United Nations peacekeeping operations in the following
areas:</text>
<paragraph commented="no" display-inline="no-display-inline" id="IDC032AAAFC6E64FB282E5B9F69531EB39"><enum>(1)</enum><header>Planning and
Management</header>
<subparagraph commented="no" display-inline="no-display-inline" id="ID0AA338EDC8734A39874567E42580D5CB"><enum>(A)</enum><header>Global
audit</header><text display-inline="yes-display-inline">As the size, cost, and
number of United Nations peacekeeping operations have increased substantially
over the past decade, an independent audit of each such operation, with a view
toward <quote>right-sizing</quote> operations and ensuring that such operations
are cost effective, should be conducted and its findings reported to the
Security Council.</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDE8C2BB9E7F444DCEB2F879996155BFCA"><enum>(B)</enum><header>Review of
mandates and closing operations</header><text display-inline="yes-display-inline">In conjunction with the audit described in
subparagraph (A), the United Nations Department of Peacekeeping Operations
should conduct a comprehensive review of all United Nations peacekeeping
operation mandates, with a view toward identifying objectives that are
practical and achievable, and report its findings to the Security Council. In
particular, the review should consider the following:</text>
<clause commented="no" display-inline="no-display-inline" id="ID792D525905B1428E9042276B4FA42C77"><enum>(i)</enum><text display-inline="yes-display-inline">Activities that fall beyond the scope of
traditional peacekeeping activities should be delegated to a new Peacebuilding
Commission, described in paragraph (3).</text>
</clause><clause commented="no" display-inline="no-display-inline" id="ID403B8F00A6A34256AA90ACE24612F4A3"><enum>(ii)</enum><text display-inline="yes-display-inline">Long-standing operations that are static
and cannot fulfill their mandate should be downsized or closed.</text>
</clause><clause commented="no" display-inline="no-display-inline" id="ID0D6D4EA73FF94E0BA8F22D30E0C2FFF1"><enum>(iii)</enum><text display-inline="yes-display-inline">Where there is legitimate concern that the
withdrawal from a country of an otherwise static United Nations peacekeeping
operation would result in the resumption of major conflict, a burden-sharing
arrangement that reduces the level of assessed contributions, similar to that
currently supporting the United Nations Peacekeeping Force in Cyprus, should be
explored and instituted.</text>
</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDA2728E7E828C49DF957E6C21E9957A2B"><enum>(C)</enum><header>Leadership</header><text display-inline="yes-display-inline">As peacekeeping operations become larger
and increasingly complex, the Secretariat should adopt a minimum standard of
qualifications for senior leaders and managers, with particular emphasis on
specific skills and experience, and current senior leaders and managers who do
not meet those standards should be removed or reassigned.</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDB24E18E0689742FEAC028CC6368449AA"><enum>(D)</enum><header>Pre-deployment
training</header><text display-inline="yes-display-inline">Pre-deployment
training on interpretation of the mandate of the operation, specifically in the
areas of use of force, civilian protection and field conditions, the Code of
Conduct, HIV/AIDS, and human rights should be mandatory, and all personnel,
regardless of category or rank, should be required to sign an oath that each
has received and understands such training as a condition of participation in
the operation.</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6BF474F99E03407C9337DDA9B488D4C9"><enum>(E)</enum><header>Gratis military
personnel</header><text display-inline="yes-display-inline">The General
Assembly should lift restrictions on the utilization at the headquarters in New
York, the United States, of the Department of Peacekeeping Operations of gratis
military personnel by the Department so that the Department may accept
secondments from Member States of military personnel with expertise in mission
planning, logistics, and other operational specialties.</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDA14081C70B264E00BAEDB296D11E3125"><enum>(2)</enum><header>Conduct and
discipline</header>
<subparagraph commented="no" display-inline="no-display-inline" id="ID51BD021624BC4995B32F0D6F080BC1E2"><enum>(A)</enum><header>Adoption of a
uniform Code of Conduct</header><text display-inline="yes-display-inline">A
single, uniform Code of Conduct that has the status of a binding rule and
applies equally to all personnel serving in United Nations peacekeeping
operations, regardless of category or rank, should be promulgated, adopted, and
enforced.</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID0B939C2A77F249F6A6E5B84C2130D5B4"><enum>(B)</enum><header>Understanding
the Code of Conduct</header><text display-inline="yes-display-inline">All
personnel, regardless of category or rank, should receive training on the Code
of Conduct prior to deployment with a peacekeeping operation, in addition to
periodic follow-on training. In particular—</text>
<clause commented="no" display-inline="no-display-inline" id="ID9EFD164BC17343149FFB9EB2FCC6EAED"><enum>(i)</enum><text display-inline="yes-display-inline">all personnel, regardless of category or
rank, should be provided with a personal copy of the Code of Conduct that has
been translated into the national language of such personnel, regardless of
whether such language is an official language of the United Nations;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="ID0DC28AA9ED914D6098BD929908EE2275"><enum>(ii)</enum><text display-inline="yes-display-inline">all personnel, regardless of category or
rank, should sign an oath that each has received a copy of the Code of Conduct,
that each pledges to abide by the Code of Conduct, and that each understands
the consequences of violating the Code of Conduct, including immediate
termination of the participation of such personnel in the peacekeeping
operation to which such personnel is assigned as a condition of appointment to
such operation; and</text>
</clause><clause commented="no" display-inline="no-display-inline" id="IDB5B156560E654E668EABAFBED1BBEC6C"><enum>(iii)</enum><text display-inline="yes-display-inline">peacekeeping operations should conduct
educational outreach programs to reach local communities where peacekeeping
personnel of such operations are based, including explaining prohibited acts on
the part of United Nations peacekeeping personnel and identifying the
individual to whom the local population may direct complaints or file
allegations of exploitation, abuse, or other acts of misconduct.</text>
</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDD6794D8D00A946B5847074B5664D0C36"><enum>(C)</enum><header>Monitoring
mechanisms</header><text display-inline="yes-display-inline">Dedicated
monitoring mechanisms, such as the Personnel Conduct Units already deployed to
support United Nations peacekeeping operations in Haiti, Liberia, Burundi, and
the Democratic Republic of Congo, should be present in each operation to
monitor compliance with the Code of Conduct, and—</text>
<clause commented="no" display-inline="no-display-inline" id="IDE7FE3723FDE34D42B339642FB7141859"><enum>(i)</enum><text display-inline="yes-display-inline">should report simultaneously to the Head of
Mission, the United Nations Department of Peacekeeping Operations, and the
Associate Director of OIOS for Peacekeeping Operations (established under
section 104(b)(10)); and</text>
</clause><clause commented="no" display-inline="no-display-inline" id="IDE28ED6CE4B7E4BECB00035A0234AF17C"><enum>(ii)</enum><text display-inline="yes-display-inline">should be tasked with designing and
implementing mission-specific measures to prevent misconduct, conduct follow-on
training for personnel, coordinate community outreach programs, and assist in
investigations, as OIOS determines necessary and appropriate.</text>
</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDACFBB93FCB764C018A8F2B3524113F78"><enum>(D)</enum><header>Investigations</header><text display-inline="yes-display-inline">A permanent, professional, and independent
investigative body should be established and introduced into United Nations
peacekeeping operations. In particular—</text>
<clause commented="no" display-inline="no-display-inline" id="ID8A8B28BDCB3540D98232024C4B3A614C"><enum>(i)</enum><text display-inline="yes-display-inline">the investigative body should include
professionals with experience in investigating sex crimes, as well as experts
who can provide guidance on standards of proof and evidentiary requirements
necessary for any subsequent legal action;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="ID42E963DC7BBD44A98BE2A0DD1DAF6407"><enum>(ii)</enum><text display-inline="yes-display-inline">provisions should be included in a Model
Memorandum of Understanding that obligate Member States that contribute troops
to a peacekeeping operation to designate a military prosecutor who will
participate in any investigation into an allegation of misconduct brought
against an individual of such Member State, so that evidence is collected and
preserved in a manner consistent with the military law of such Member
State;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="ID72B2A1F151E144AB987FF3320C42DD94"><enum>(iii)</enum><text display-inline="yes-display-inline">the investigative body should be regionally
based to ensure rapid deployment and should be equipped with modern forensics
equipment for the purpose of positively identifying perpetrators and, where
necessary, for determining paternity; and</text>
</clause><clause commented="no" display-inline="no-display-inline" id="IDEAA8B84FE3AA402EA20DE6B6AC7F5280"><enum>(iv)</enum><text display-inline="yes-display-inline">the investigative body should report
directly to the Associate Director of OIOS for Peacekeeping Operations, while
providing copies of any reports to the Department of Peacekeeping Operations,
the Head of Mission, and the Member State concerned.</text>
</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDE7FC5BFDB7BC434B97A0F75C6961C558"><enum>(E)</enum><header>Follow-up</header><text display-inline="yes-display-inline">A dedicated unit, similar to the Personnel
Conduct Units, staffed and funded through existing resources, should be
established within the headquarters of the United Nations Department of
Peacekeeping Operations and tasked with—</text>
<clause commented="no" display-inline="no-display-inline" id="ID8C2AABB8E9D4427BA2C42426659FBC05"><enum>(i)</enum><text display-inline="yes-display-inline">promulgating measures to prevent
misconduct;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="IDF32CA22F24264ED0A3FF2633F53AD9C0"><enum>(ii)</enum><text display-inline="yes-display-inline">coordinating allegations of misconduct, and
reports received by field personnel; and</text>
</clause><clause commented="no" display-inline="no-display-inline" id="IDF6866F84C96A47548F73390CD9459B69"><enum>(iii)</enum><text display-inline="yes-display-inline">gathering follow-up information on
completed investigations, particularly by focusing on disciplinary actions
against the individual concerned taken by the United Nations or by the Member
State that is contributing troops to which such individual belongs, and sharing
such information with the Security Council, the Head of Mission, and the
community hosting the peacekeeping operation.</text>
</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9E8824552B124C95BE0D1B42D7B6591D"><enum>(F)</enum><header>Financial
liability and victims assistance</header><text display-inline="yes-display-inline">Although peacekeeping operations should
provide immediate medical assistance to victims of sexual abuse or
exploitation, the responsibility for providing longer-term treatment, care, or
restitution lies solely with the individual found guilty of the misconduct. In
particular, the following reforms should be implemented:</text>
<clause commented="no" display-inline="no-display-inline" id="ID86788AD6CEAB4697B679C1131E297091"><enum>(i)</enum><text display-inline="yes-display-inline">The United Nations should not assume
responsibility for providing long-term treatment or compensation by creating a
<quote>Victims Trust Fund</quote>, or any other such similar fund, financed
through assessed contributions to United Nations peacekeeping operations,
thereby shielding individuals from personal liability and reinforcing an
atmosphere of impunity.</text>
</clause><clause commented="no" display-inline="no-display-inline" id="ID9122F07732D24D848D29213CB23F0279"><enum>(ii)</enum><text display-inline="yes-display-inline">If an individual responsible for misconduct
has been repatriated, reassigned, redeployed, or is otherwise unable to provide
assistance, responsibility for providing assistance to a victim should be
assigned to the Member State that contributed the troops to which such
individual belonged or to the manager concerned.</text>
</clause><clause commented="no" display-inline="no-display-inline" id="ID8CB7DC15536B4E6CBD6A2C139053AFD7"><enum>(iii)</enum><text display-inline="yes-display-inline">In the case of misconduct by a member of a
military contingent, appropriate funds shall be withheld from the troop
contributing country concerned.</text>
</clause><clause commented="no" display-inline="no-display-inline" id="IDC0657B651426451E999C7D3D61A09E39"><enum>(iv)</enum><text display-inline="yes-display-inline">In the case of misconduct by a civilian
employee or contractor of the United Nations, appropriate wages shall be
garnished from such individual or fines shall be imposed against such
individual, consistent with existing United Nations Staff Rules.</text>
</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID724CB3F75BA441B480029A5D2C076AD1"><enum>(G)</enum><header>Managers and
commanders</header><text display-inline="yes-display-inline">The manner in
which managers and commanders handle cases of misconduct by those serving under
them should be included in their individual performance evaluations, so that
managers and commanders who take decisive action to deter and address
misconduct are rewarded, while those who create a permissive environment or
impede investigations are penalized or relieved of duty, as appropriate.</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID99B79AAD9E1F41FA9F84AA6F4CADBB13"><enum>(H)</enum><header>Data
base</header><text display-inline="yes-display-inline">A centralized data base
should be created and maintained within the United Nations Department of
Peacekeeping Operations to track cases of misconduct, including the outcome of
investigations and subsequent prosecutions, to ensure that personnel who have
engaged in misconduct or other criminal activities, regardless of category or
rank, are permanently barred from participation in future peacekeeping
operations.</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID7663AE1544D44BF399A37EBFD4BB4F88"><enum>(I)</enum><header>Welfare</header><text display-inline="yes-display-inline">Peacekeeping operations should assume
responsibility for maintaining a minimum standard of welfare for mission
personnel to ameliorate conditions of service, while adjustments are made to
the discretionary welfare payments currently provided to Member States that
contribute troops to offset the cost of operation-provided recreational
facilities.</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDA701937D01534541B72E42E4E250CD8F"><enum>(3)</enum><header>Peacebuilding
Commission</header>
<subparagraph commented="no" display-inline="no-display-inline" id="ID1D9C2DE5655B4D82925C84AE9E159623"><enum>(A)</enum><header>Establishment</header><text display-inline="yes-display-inline">Consistent with the recommendations of the
High Level Panel Report, the United Nations should establish a Peacebuilding
Commission, supported by a Peacebuilding Support Office, to marshal the efforts
of the United Nations, international financial institutions, donors, and
non-governmental organizations to assist countries in transition from war to
peace.</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDCE476295732C4A548617E5466A017E18"><enum>(B)</enum><header>Structure and
membership</header><text display-inline="yes-display-inline">The Commission
should—</text>
<clause commented="no" display-inline="no-display-inline" id="IDF79BAFDB1AE845989A1F699FF0F9D317"><enum>(i)</enum><text display-inline="yes-display-inline">be a subsidiary body of the United Nations
Security Council, limited in size to ensure efficiency;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="ID63A8F0D9C50E4B6C98FDF121861C2EF1"><enum>(ii)</enum><text display-inline="yes-display-inline">include members of the United Nations
Security Council, major donors, major troop contributing countries, appropriate
United Nations organizations, the World Bank, and the International Monetary
Fund; and</text>
</clause><clause commented="no" display-inline="no-display-inline" id="ID540E11ECE6B44B0CB46871ED0585A44B"><enum>(iii)</enum><text display-inline="yes-display-inline">invite the President of ECOSOC, regional
actors, Member States that contribute troops, regional development banks, and
other concerned parties that are not already members, as determined
appropriate, to consult or participate in meetings as observers.</text>
</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDD9806518D78746669ECB117C19BDEAE0"><enum>(C)</enum><header>Responsibilities</header><text display-inline="yes-display-inline">The Commission should seek to ease the
demands currently placed upon the Department of Peacekeeping Operations to
undertake tasks that fall beyond the scope of traditional peacekeeping,
by—</text>
<clause commented="no" display-inline="no-display-inline" id="ID1276AC91A52E432595A94BFC0E743DEF"><enum>(i)</enum><text display-inline="yes-display-inline">developing and integrating country-specific
and system-wide conflict prevention, post-conflict reconstruction, and
long-term development policies and strategies; and</text>
</clause><clause commented="no" display-inline="no-display-inline" id="IDA6448C60D32E477FBCBA9C7F7A7DA1E2"><enum>(ii)</enum><text display-inline="yes-display-inline">serving as the key coordinating body for
the design and implementation of military, humanitarian, and civil
administration aspects of complex missions.</text>
</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDE6B0667DBCEB45188FB06B18B08634F8"><enum>(D)</enum><header>Resources</header><text display-inline="yes-display-inline">The establishment of the Peacebuilding
Commission and the related Peacebuilding Support Office, should be staffed
within existing resources.</text>
</subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="IDD6EC4D45AB5A48538F214E11A2C74EAF" section-type="subsequent-section"><enum>403.</enum><header>Certification</header>
<subsection commented="no" display-inline="no-display-inline" id="ID01C61D8D7553490E84D203DB9C3F8426"><enum>(a)</enum><header>New or expanded
Peacekeeping Operations contingent upon presidential certification of
Peacekeeping Operations reforms</header>
<paragraph commented="no" display-inline="no-display-inline" id="ID0D61FE60624C408B85928470A1A2AF86"><enum>(1)</enum><header>No new or
expanded Peacekeeping Operations</header>
<subparagraph commented="no" display-inline="no-display-inline" id="IDDF79CC15C0A7450AA20BBF92574C7728"><enum>(A)</enum><header>Certification</header><text display-inline="yes-display-inline">Except as provided in subparagraph (B),
until the Secretary of State certifies that the requirements described in
paragraph (2) have been satisfied, the President shall direct the United States
Permanent Representative to the United Nations to use the voice, vote, and
influence of the United States at the United Nations to oppose the creation of
new, or expansion of existing, United Nations peacekeeping operations.</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID418313C20A7F4A09B462C9BA679B3E09"><enum>(B)</enum><header>Exception and
notification</header><text display-inline="yes-display-inline">The requirements
described under subparagraphs (F) and (G) of paragraph (2) may be waived until
January 1, 2007, if the President determines that such is in the national
interest of the United States. If the President makes such a determination, the
President shall, not later than 15 days before the exercise of such waiver,
notify the appropriate congressional committees of such determination and
resulting waiver.</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE2EA6495E7FC4378988FD1D5D00DBDB5"><enum>(2)</enum><header>Certification
of Peacekeeping Operations reforms</header><text display-inline="yes-display-inline">The certification referred to in paragraph
(1) is a certification made by the Secretary to the appropriate congressional
committees that the following reforms, or an equivalent set of reforms, related
to peacekeeping operations have been adopted by the United Nations Department
of Peacekeeping Operations or the General Assembly, as appropriate:</text>
<subparagraph commented="no" display-inline="no-display-inline" id="ID4AA9B4E83216452F9C0F381BB9934E6B"><enum>(A)</enum><text display-inline="yes-display-inline">A single, uniform Code of Conduct that has
the status of a binding rule and applies equally to all personnel serving in
United Nations peacekeeping operations, regardless of category or rank, has
been adopted by the General Assembly and mechanisms have been established for
training such personnel concerning the requirements of the Code and enforcement
of the Code.</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDEF92C564EA364F2DB76CC40327934774"><enum>(B)</enum><text display-inline="yes-display-inline">All personnel, regardless of category or
rank, serving in a peacekeeping operation have been trained concerning the
requirements of the Code of Conduct and each has been given a personal copy of
the Code, translated into the national language of such personnel.</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID8617F78E8B25441B8E6764A2076FF582"><enum>(C)</enum><text display-inline="yes-display-inline">All personnel, regardless of category or
rank, are required to sign an oath that each has received a copy of the Code of
Conduct, that each pledges to abide by the Code, and that each understands the
consequences of violating the Code, including the immediate termination of the
participation of such personnel in the peacekeeping operation to which such
personnel is assigned as a condition of the appointment to such
operation.</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID072498D8204349C8ABA025E46D84E3F0"><enum>(D)</enum><text display-inline="yes-display-inline">All peacekeeping operations have designed
and implemented educational outreach programs to reach local communities where
peacekeeping personnel of such operations are based to explain prohibited acts
on the part of United Nations peacekeeping personnel and to identify the
individual to whom the local population may direct complaints or file
allegations of exploitation, abuse, or other acts of misconduct.</text>

the United Nations and each Member State that contributes troops to a
peacekeeping operation has been adopted by the United Nations Department of
Peacekeeping Operations that specifically obligates each such Member State
to—</text>
<clause commented="no" display-inline="no-display-inline" id="IDF492FD1369E54580B14642C0A2FBDF48"><enum>(i)</enum><text display-inline="yes-display-inline">designate a competent legal authority,
preferably a prosecutor with expertise in the area of sexual exploitation and
abuse, to participate in any investigation into an allegation of misconduct
brought against an individual of such Member State;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="IDAF564BBCEBE84DCA8DB176D4897B5F31"><enum>(ii)</enum><text display-inline="yes-display-inline">refer to its competent national or military
authority for possible prosecution, if warranted, any investigation of a
violation of the Code of Conduct or other criminal activity by an individual of
such Member State;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="ID328AF71CA96E4E05A80B5C166EEF40C9"><enum>(iii)</enum><text display-inline="yes-display-inline">report to the Department of Peacekeeping
Operations on the outcome of any such investigation;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="ID94898339E8FA4799A657FDB17703E095"><enum>(iv)</enum><text display-inline="yes-display-inline">undertake to conduct on-site court martial
proceedings relating to allegations of misconduct alleged against an individual
of such Member State; and</text>
</clause><clause commented="no" display-inline="no-display-inline" id="ID4F57B4D3ACF44B5CB21D16E46AE51063"><enum>(v)</enum><text display-inline="yes-display-inline">assume responsibility for the provision of
appropriate assistance to a victim of misconduct committed by an individual of
such Member State.</text>
</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID52E9AE843AD8430E9FDD4CC0258EDD57"><enum>(G)</enum><text display-inline="yes-display-inline">A professional and independent
investigative and audit function has been established within the United Nations
Department of Peacekeeping Operations and the OIOS to monitor United Nations
peacekeeping operations.</text>
</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID28CCC5ABB8A140FE9DD7FA0E37BBFFE0" section-type="subsequent-section"><enum>404.</enum><header>Rule of construction
relating to Protection of United States officials and members of the Armed
Forces</header><text display-inline="no-display-inline">Nothing in this title
shall be construed as superseding the Uniform Code of Military Justice or
operating to effect the surrender of United States officials or members of the

congressional budget justification shall include a detailed itemized request in
support of the assessed contribution of the United States to the regular
assessed budget of the United Nations.</text>
</subsection><subsection commented="no" display-inline="no-display-inline" id="IDA24C5E5951C4438EBB98D77DB9664C98"><enum>(b)</enum><header>Contents of
detailed itemization</header><text display-inline="yes-display-inline">The
detailed itemization required under subsection (a) shall—</text>
<paragraph commented="no" display-inline="no-display-inline" id="IDF1C51A713749433E9010E7946CBE18A3"><enum>(1)</enum><text display-inline="yes-display-inline">contain information relating to the amounts
requested in support of each of the various sections and titles of the regular
assessed budget of the United Nations; and</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID59DB1906646A45AD8467C5B1051F327B"><enum>(2)</enum><text display-inline="yes-display-inline">compare the amounts requested for the
current year with the actual or estimated amounts contributed by the United
States in previous fiscal years for the same sections and titles.</text>
</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDE61BA08D0FE645309D77DE488B24AFEF"><enum>(c)</enum><header>Adjustments and
notification</header><text display-inline="yes-display-inline">If the United
Nations proposes an adjustment to its regular assessed budget, the Secretary of
State shall, at the time such adjustment is presented to the Advisory Committee
on Administrative and Budgetary Questions (ACABQ), notify and consult with the
appropriate congressional committees.</text>
</subsection></section><section commented="no" display-inline="no-display-inline" id="ID0EDA777A5E09406EAA7C828A30B1DE1E" section-type="subsequent-section"><enum>503.</enum><header>Review and
report</header><text display-inline="no-display-inline">Not later than 6 months
after the date of the enactment of this Act, the Secretary of State shall
conduct a review of programs of the United Nations that are funded through
assessed contributions and submit to the appropriate congressional committees a
report containing—</text>
<paragraph commented="no" display-inline="no-display-inline" id="IDBC041A6C82404A389EB93118BFE66D9F"><enum>(1)</enum><text display-inline="yes-display-inline">the findings of such review; and</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDA897F913F2444EC386FABE1B6A0CE396"><enum>(2)</enum><text display-inline="yes-display-inline">recommendations relating to—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="ID38024D888AB04D85A76CEFD074C5E6ED"><enum>(A)</enum><text display-inline="yes-display-inline">the continuation of such programs;
and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID191E4D90A94F41DF9BDAD3B179261F8F"><enum>(B)</enum><text display-inline="yes-display-inline">which of such programs should be
voluntarily funded, other than those specified in subparagraphs (A) through (R)
of subsection (c)(2) of section 11 of the United Nations Participation Act of
1945, as amended by section 101(c) of this Act.</text>
</subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="ID7467C47B21E842539011AF0AC1ED3245" section-type="subsequent-section"><enum>504.</enum><header>Government
Accountability Office</header>
<subsection commented="no" display-inline="no-display-inline" id="ID02075E9F17A34056B66E2575C56E5AE4"><enum>(a)</enum><header>Report on
United Nations reforms</header><text display-inline="yes-display-inline">Not
later than 12 months after the date of the enactment of this Act and again 12
months thereafter, the Comptroller General of the United States of the
Government Accountability Office shall submit to the appropriate congressional
committees a report on the status of the 1997, 2002, and 2005 management
reforms initiated by the Secretary General and on the reforms mandated by this
Act.</text>
</subsection><subsection commented="no" display-inline="no-display-inline" id="ID0734084C952B4C3B9897C9F9B23F32F8"><enum>(b)</enum><header>Report on
Department of State certifications</header><text display-inline="yes-display-inline">Not later than 6 months after each
certification submitted by the Secretary of State to the appropriate
congressional committees under this Act and subsection (d)(3) of section 11 of
the United Nations Participation Act of 1945 (as amended by section 101(c) of
this Act), the Comptroller General shall submit to the appropriate
congressional committees a report on each such certification. The Secretary
shall provide the Comptroller General with any information required by the
Comptroller General to submit any such report.</text>
</subsection><subsection commented="no" display-inline="no-display-inline" id="IDD3E95103F10243089B21342011BD85BA"><enum>(c)</enum><header>United Nations
construction and contracting</header><text display-inline="yes-display-inline">Not later than 6 months after the date of
the enactment of this Act, the Comptroller General shall submit to the
Committee on International Relations of the House of Representatives, the
Committee on Foreign Relations of the Senate, the Committee on Appropriations
of the House of Representatives, and the Committee on Appropriations of the
Senate a report describing the costs associated with the contracting for and
construction of the Geneva, Switzerland, buildings of the World Meteorological
Organization (WMO) and the World Intellectual Property Organization (WIPO). The
report shall include analyses of the procurement procedures for each such
building and shall specifically address issues of any corrupt contracting
practices that are discovered, such as rigged bids and kickbacks, as well as
other improprieties. The report shall also include an identification of other
credible allegations of corrupt contracting at United Nations construction
projects that involve major construction on a scale comparable to the WMO and
WIPO construction projects, and a description of the results of an
investigation into each such credible allegation.</text>
</subsection></section><enum>VI</enum><header>Certifications and withholding of
contributions</header>
<section commented="no" display-inline="no-display-inline" id="IDA7E77AC2ED454D2EB96AD0976F478527" section-type="subsequent-section"><enum>601.</enum><header>Certifications and
withholding of contributions</header>
<subsection commented="no" display-inline="no-display-inline" id="ID5003412F085E40F38946EDED956BD924"><enum>(a)</enum><header>Certifications</header>
<paragraph commented="no" display-inline="no-display-inline" id="IDDC6541BFCE3E4D4FA888FC4BD670528B"><enum>(1)</enum><header>In
general</header><text display-inline="yes-display-inline">Except as provided in
paragraph (3), the certifications required under subsection (d)(3) of section
11 of the United Nations Participation Act of 1945 (as amended by section
101(c) of this Act) and section 103, sections 104(a) through 104(g), sections
113 and 114, sections 201(c) and 201(e), and sections 202 and 203 of this Act
are certifications submitted to the appropriate congressional committees by the
Secretary of State that the requirements of each such section have been
satisfied with respect to reform of the United Nations.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0255BFE0DA87483FA8DCCF87E6A4069F"><enum>(2)</enum><header>Alternate
certification mechanism</header>
<subparagraph commented="no" display-inline="no-display-inline" id="ID764F287A342648F4A8F695114D6BB75C"><enum>(A)</enum><header>In
general</header><text display-inline="yes-display-inline">Except as provided in
paragraph (3), in the event that the Secretary is unable to submit a
certification in accordance with paragraph (1), the Secretary may submit to the
appropriate congressional committees, in accordance with subparagraph (B), an
alternate certification that certifies that the requirements of the section to
which the original certification applies have been implemented through reforms
that are substantially similar to the requirements of such section or
accomplish the same purposes as the requirements of such section.</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDBE82D6776EAC498A946A263F41373453"><enum>(B)</enum><header>Equivalency</header><text display-inline="yes-display-inline">Reforms are substantially similar or
accomplish the same purposes if—</text>
<clause commented="no" display-inline="no-display-inline" id="ID507F1A2A56284886A19C135BE77897CC"><enum>(i)</enum><text display-inline="yes-display-inline">such reforms are formally adopted in
written form by the entity or committee of the United Nations or of its
specialized agency that has authority to enact or implement such reforms or are
issued by the Secretariat or the appropriate entity or committee in written
form; and</text>
</clause><clause commented="no" display-inline="no-display-inline" id="IDF8642BD67B924C2DBC45B0B205E84932"><enum>(ii)</enum><text display-inline="yes-display-inline">such reforms are not identical to the
reforms required by a particular certification but in the determination of the
Secretary will have the same, or nearly the same effect, as such
reforms.</text>
</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID60B92813DF5C478089AD15FDE9374EC8"><enum>(C)</enum><header>Written
justification and consultation</header>
<clause commented="no" display-inline="no-display-inline" id="IDF91F26E8FF394B448CD1704688C2687B"><enum>(i)</enum><header>Written
justification</header><text display-inline="yes-display-inline">Not later than
30 days before submitting an alternate certification in accordance with
subparagraph (A), the Secretary shall submit to the appropriate congressional
committees a written justification explaining in detail the basis for such
alternate certification.</text>
</clause><clause commented="no" display-inline="no-display-inline" id="IDC203068EE51449B89B434627A362B686"><enum>(ii)</enum><header>Consultation</header><text display-inline="yes-display-inline">After the Secretary has submitted the
written justification under clause (i), but no later than 15 days before the
Secretary exercises the alternate certification mechanism described under
subparagraph (A), the Secretary shall consult with the appropriate
congressional committees regarding such exercise.</text>
</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID249B4B4AD0074B6BB6E89D9EE2B2E7C0"><enum>(3)</enum><header>Limited
exception for substantial compliance</header>
<subparagraph commented="no" display-inline="no-display-inline" id="ID5D3EF6AA78BB402EBFD9D9CCD0D1C276"><enum>(A)</enum><header>Substantial
compliance</header><text display-inline="yes-display-inline">Subject to
subparagraph (B), if at least 32 of the 40 reforms represented by the 11
certifications specified under paragraph (1) have been implemented, all such
reforms (including the unimplemented reforms) so represented shall be deemed to
have been implemented for the year in which the Secretary submits such
certifications.</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDCF2219B53F5A4C708B4C26AD1746ABC6"><enum>(B)</enum><header>Mandatory
implementation of certain reforms</header>
<clause commented="no" display-inline="no-display-inline" id="ID6DD5A956F1DD484E8C6C3316DB95FAA5"><enum>(i)</enum><header>In
general</header><text display-inline="yes-display-inline">The provisions of
subparagraph (A) shall not apply unless the reforms under the following
sections have been implemented for the year to which subparagraph (A)
applies:</text>
<subclause commented="no" display-inline="no-display-inline" id="IDD199C3EE5EBE4A95854B5221B5C886FC"><enum>(I)</enum><text display-inline="yes-display-inline">Subsection (d)(3) of section 11 of the
United Nations Participation Act of 1945 (as amended by section 101(c) of this

</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDD0A6965EBDFF4AA3A2419F2C2F793191"><enum>(b)</enum><header>Withholding of
United States contributions to regular assessed budget of the United
Nations</header>
<paragraph commented="no" display-inline="no-display-inline" id="ID083388F7B48547AF8C8F38CA1E8B7B88"><enum>(1)</enum><header>In
general</header><text display-inline="yes-display-inline">Except as provided in
paragraph (4) and in accordance with paragraph (2), until such time as all
certifications (or alternate certifications) are submitted in accordance with
subsection (a), the United States shall appropriate, but withhold from
expenditure, 50 percent of the contributions of the United States to the
regular assessed budget of the United Nations for a biennial period.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID680A90C7E4EB443F88C680CE8A71A4DD"><enum>(2)</enum><header>Available until
expended</header><text display-inline="yes-display-inline">The contributions
appropriated but withheld from expenditure under paragraph (1) are authorized
to remain available until expended.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE85C4C25073C4A6EBF19B9B743B0FE4D"><enum>(3)</enum><header>Application
with respect to Section <enum-in-header>11(b)</enum-in-header> of the united
nation participation Act of 1945</header><text display-inline="yes-display-inline">Until such time as all certifications (or
alternate certifications) are submitted in accordance with subsection (a),
subsection (b) of section 11 of the United Nations Participation Act of 1945
(as amended by section 101(c) of this Act) shall be administered as though such
section reads as follows: <quote>The Secretary may not make a contribution to a
regularly assessed biennial budget of the United Nations in an amount greater
than 11 percent of the amount calculable under subsection (c).</quote>.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID099E8B7C58524D5AAF5CA5610F714AE3"><enum>(4)</enum><header>Section
<enum-in-header>11(d)(3)</enum-in-header> of United Nations Participation Act
of 1945</header>
<subparagraph commented="no" display-inline="no-display-inline" id="IDED6B9C3674F044B79789DEB54FD6FB97"><enum>(A)</enum><header>Special
Rule</header><text display-inline="yes-display-inline">A certification under
subsection (d)(3) of section 11 of the United Nations Participation Act of 1945
(as amended by section 101(c) of this Act) (relating to the 2008–2009 biennial
period and subsequent biennial periods) shall not be required until such time
as the United Nations makes its formal budget presentation for the 2008–2009
biennial period.</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID78D6CBF3AD49400BB9C9F2316D07706E"><enum>(B)</enum><header>Application</header><text display-inline="yes-display-inline">If the Secretary does not submit a
certification under such section, the 50 percent withholding described under
paragraph (1) shall apply.</text>
</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID9CC02D416AE94A9CB79DCF6BF5657D6D"><enum>(c)</enum><header>Release of
funds</header><text display-inline="yes-display-inline">At such time as all
certifications (or alternate certifications) are submitted in accordance with
subsection (a), the United States shall transfer to the United Nations amounts
appropriated but withheld from expenditure under subsection (b).</text>
</subsection><subsection commented="no" display-inline="no-display-inline" id="ID8FBC22615C414D4FBF06F138F24B3804"><enum>(d)</enum><header>Annual
reviews</header>
<paragraph commented="no" display-inline="no-display-inline" id="IDEC4B51654F2A4CCD9AB903A90702D624"><enum>(1)</enum><header>In
general</header><text display-inline="yes-display-inline">The Secretary shall
conduct annual reviews, beginning 1 year after the date on which the Secretary
submits the final certification (or alternate certification) in accordance with
subsection (a), to determine if the United Nations continues to remain in
compliance with all such certifications (or alternate certifications). Not
later than 30 days after the completion of each such review, the Secretary
shall submit to the appropriate congressional committees a report containing
the findings of each such review.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1AAEC2C1DA9049E984BF1ABC86A51F2D"><enum>(2)</enum><header>Action</header><text display-inline="yes-display-inline">If during the course of any such review the
Secretary determines that the United Nations has failed to remain in compliance
with a certification (or an alternate certification) that was submitted in
accordance with subsection (a), the 50 percent withholding described under
subsection (b) shall re-apply with respect to United States contributions each
fiscal year to the regular assessed budget of the United Nations beginning with
the fiscal year immediately following such review and subsequent fiscal years
until such time as all certifications (or alternate certifications) under
subsection (a) have been submitted.</text>
</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDDCFFB72FDEAE4E2597BA1DA5AF83BE94"><enum>(e)</enum><header>Effective
date</header><text display-inline="yes-display-inline">The certifications (or
alternate certifications) specified under subsection (a) shall be required with
respect to United States contributions towards payment of regular assessed dues
of the United Nations for 2007 and subsequent years.</text>
