		  Relief and Emergency Assistance Act to provide for reimbursement of certain

		  for-profit hospitals.</official-title>

		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Hospital Emergency Assistance Act of

			 2005</short-title></quote>.</text>

		</section><section commented="no" display-inline="no-display-inline" id="idD164DB473CC34DEA99911B9A45EA28E5" section-type="subsequent-section"><enum>2.</enum><header>Federal assistance to

			 for-profit hospitals</header><text display-inline="no-display-inline">Title IV

			 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act is

			 amended by inserting after section 408 (42 U.S.C. 5174) the following:</text>

				<section commented="no" display-inline="no-display-inline" id="id4114CCB55B844E6C82459C611784C4F1" section-type="subsequent-section"><enum>409.</enum><header>Federal assistance

				to for-profit hospitals</header>

					<subsection commented="no" display-inline="no-display-inline" id="id507220B09C424FBCB0BE396D7E48B6CD"><enum>(a)</enum><header>In

				general</header><text display-inline="yes-display-inline">Notwithstanding any

				other provision of this Act, the President may provide, from any funds made

				available to carry out this Act, reimbursement to a for-profit hospital for

				damage to, or an expense incurred by, the hospital during a major disaster or

				emergency, as declared under this Act, in accordance with this section.</text>

					</subsection><subsection commented="no" display-inline="no-display-inline" id="id88222814A62A4D3A9ABF9B8020862556"><enum>(b)</enum><header>Eligibility</header><text display-inline="yes-display-inline">A for-profit hospital shall be eligible to

				receive reimbursement under subsection (a) if, as determined by the President,

				in consultation with the Governor of a State—</text>

						<paragraph commented="no" display-inline="no-display-inline" id="idC4089480A94F4EF3A1F74105071C7319"><enum>(1)</enum><text display-inline="yes-display-inline">the damage to, or expense incurred by, the

				for-profit hospital was a result of a declared major disaster;</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD52E1578EFF14C168664CA139A2C6BE1"><enum>(2)</enum><text display-inline="yes-display-inline">during the declared major disaster, all

				public hospitals and private nonprofit facilities located within 30 miles of

				the for-profit hospital met or exceeded the capacity of the public hospitals

				and private nonprofit facilities; and</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id36473E0271E543AFAF8C1FB04E445C2C"><enum>(3)</enum><text display-inline="yes-display-inline">during the declared major disaster, the

				for-profit hospital acted in accordance with any requirement that would apply

				to a private nonprofit facility seeking, and eligible for, reimbursement under

				this Act.</text>

						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idC688EADD861B47198BC5BEC3331A74D4"><enum>(c)</enum><header>Limitation</header><text display-inline="yes-display-inline">The amount of reimbursement provided to a

				for-profit hospital under this section shall be not greater than the amount of

				reimbursement available under this Act for a public hospital or private

				nonprofit facility to reimburse the hospital or facility for similar damage or

				incurred

				expenses.</text>
