			 notice to court of disclosure of foreign intelligence information</header><text display-inline="no-display-inline">Section 2517 of title 18, United States

			 Code, is amended by adding at the end the following:</text>

				<paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="IDf6465a67a7df4eb5acfe170f8ceceeab" indent="up1" reported-display-style="strikethrough"><enum>(9)</enum><text display-inline="yes-display-inline">Within a reasonable time after disclosure

				is made, pursuant to paragraph (6), (7), or (8), of the contents of any wire,

				oral, or electronic communication, an attorney for the Government must file,

				under seal, a notice with the judge that issued the order authorizing or

				approving the interception of such wire, oral, or electronic communication,

				stating that such contents or evidence was disclosed and the departments,

				agencies, or entities to which the disclosure was

				made.</text>

			 requirement</header><text display-inline="yes-display-inline">Section

			 105(c)(1)(A) of the Foreign Intelligence Surveillance Act of 1978 (50 U.S.C.

			 1805(c)(1)(A)) is amended by inserting before the semicolon at the end the

			 following: <quote>, and if the nature and location of each of the facilities or

			 places at which the surveillance will be directed is not known, and if the

			 identity of the target is not known, the order shall include sufficient

			 information to describe a specific target with particularity</quote>.</text>

			</subsection><subsection changed="deleted" commented="no" display-inline="no-display-inline" id="IDf74db333eeec44fba14dec0ceb82abed" reported-display-style="strikethrough"><enum>(b)</enum><header>Additional

			 directions</header><text display-inline="yes-display-inline">Section 105(c) of

			 the Foreign Intelligence Surveillance Act of 1978 (50 U.S.C. 1805(c)) is

			 amended—</text>

				<paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="ID5cb673bb5944455d80814d3a181a2493" reported-display-style="strikethrough"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>An order approving an

				is unknown shall direct the applicant to provide notice to the court within 10

				days after the date on which surveillance begins to be directed at any new

				facility or place of—</text>

							<subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="ID857fbb7266b84b7cb79a21dde358abb1" reported-display-style="strikethrough"><enum>(A)</enum><text display-inline="yes-display-inline">the nature and location of each facility or

				place at which the electronic surveillance is directed;</text>

							</subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="ID020d82bb39f84edabf1616f34e2253ef" reported-display-style="strikethrough"><enum>(B)</enum><text display-inline="yes-display-inline">the facts and circumstances relied upon by

				the applicant to justify the applicant's belief that each facility or place at

				which the electronic surveillance is directed is being used, or is about to be

				used, by the target of the surveillance; and</text>

							</subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="ID346491928341433da042ca377c6d6781" reported-display-style="strikethrough"><enum>(C)</enum><text display-inline="yes-display-inline">a statement of any proposed minimization

				procedures that differ from those contained in the original application or

				order, that may be necessitated by a change in the facility or place at which

				the electronic surveillance is

				directed.</text>

							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph></subsection><subsection changed="deleted" commented="no" display-inline="no-display-inline" id="IDded78758a24f409c99963a1c4df1fbdb" reported-display-style="strikethrough"><enum>(c)</enum><header>Enhanced

			 oversight</header>

				<paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="IDb2ba356bc8c549cc9e6bd20677cf3521" reported-display-style="strikethrough"><enum>(1)</enum><header>Report to

			 congress</header><text display-inline="yes-display-inline">Section 108(a)(1) of

			 the Foreign Intelligence Surveillance Act of 1978 (50 U.S.C. 1808(a)(1)) is

			 amended by inserting <quote>, and the Committee on the Judiciary of the House

			 of Representatives and the Committee on the Judiciary of the Senate,</quote>

			 after <quote>Senate Select Committee on Intelligence</quote>.</text>

			 semiannual report requirement on activities under foreign intelligence

			 surveillance act of 1978</header><text display-inline="yes-display-inline">Paragraph (2) of section 108(a) of the

			 Foreign Intelligence Surveillance Act of 1978 (50 U.S.C. 1808(a)) is amended to

			 read as follows:</text>

						<paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="ID2f2383babc5d4ba78838f0ac4ebc3e72" indent="up1" reported-display-style="strikethrough"><enum>(2)</enum><text display-inline="yes-display-inline">Each report under the first sentence of

				paragraph (1) shall include a description of—</text>

							<subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="idB7BB28BE80144A33A6B55ADFA29B6486" reported-display-style="strikethrough"><enum>(A)</enum><text display-inline="yes-display-inline">the total number of applications made for

				orders and extensions of orders approving electronic surveillance under this

				title where the nature and location of each facility or place at which the

				electronic surveillance will be directed is not known; and</text>

							</subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="ID3c3d8743c00e40c9a6f153c4fa1ad835" reported-display-style="strikethrough"><enum>(B)</enum><text display-inline="yes-display-inline">each criminal case in which information

				acquired under this Act has been authorized for use at trial during the period

				covered by such

				report.</text>

							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph></subsection></section><section changed="deleted" commented="no" display-inline="no-display-inline" id="IDf1cbd243d79144579a735d453fa325d9" reported-display-style="strikethrough" section-type="subsequent-section"><enum>4.</enum><header>Patriot section 207;

			 duration of FISA surveillance of non-United States persons</header>

			<subsection changed="deleted" commented="no" display-inline="no-display-inline" id="ID11175bbfe9e2446e9e7746275ea972f9" reported-display-style="strikethrough"><enum>(a)</enum><header>Electronic

			 surveillance orders</header><text display-inline="yes-display-inline">Section

			 first place it appears the following: <quote>, except that in cases where the

			 applicant has certified that the information likely to be obtained is foreign

			 intelligence information not concerning a United States person, an order issued

			 under this section may be for a period not to exceed 1 year</quote>; and</text>

				</paragraph><paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="IDf07d26df40fa4f40be2f8093c9006925" reported-display-style="strikethrough"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after <quote>90 days</quote>

			 the second place it appears the following: <quote>, except that in cases where

			 the applicant has certified that the information likely to be obtained is

			 foreign intelligence information not concerning a United States person, an

			 extension of an order issued under this section may be for a period not to

			 exceed 1 year</quote>.</text>

			 enhanced oversight of good-faith emergency disclosures</header>

			 oversight</header><text display-inline="yes-display-inline">Section 2702 of

			 title 18, United States Code, is amended by adding at the end the

			 following:</text>

					<subsection changed="deleted" commented="no" display-inline="no-display-inline" id="ID4a2378714d3b4f4790aa7f8a3da61529" reported-display-style="strikethrough"><enum>(d)</enum><header>Reporting of

				emergency disclosures</header><text display-inline="yes-display-inline">On an

				annual basis, the Attorney General shall submit to the Committee on the

				Judiciary of the House of Representatives and the Committee on the Judiciary of

				the Senate a report containing—</text>

						<paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="IDe70f54f54adc40079a62987856f2d69f" reported-display-style="strikethrough"><enum>(1)</enum><text display-inline="yes-display-inline">the number of accounts from which the

				Department of Justice has received voluntary disclosures under subsection

				(b)(8); and</text>

						</paragraph><paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="ID41962106f37040b890a4ec8307a9786b" reported-display-style="strikethrough"><enum>(2)</enum><text display-inline="yes-display-inline">a summary of the basis for disclosure in

				those instances where—</text>

							<subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="ID3668708691124fb78b8cf30f80791df7" reported-display-style="strikethrough"><enum>(A)</enum><text display-inline="yes-display-inline">voluntary disclosures under subsection

				(b)(8) were made to the Department of Justice; and</text>

							</subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="ID24b32d929f1f4b519138abfe0ffd347f" reported-display-style="strikethrough"><enum>(B)</enum><text display-inline="yes-display-inline">the investigation pertaining to those

				disclosures was closed without the filing of criminal

				charges.</text>

							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection changed="deleted" commented="no" display-inline="no-display-inline" id="ID1de82da1739b4863955de32e5733d6be" reported-display-style="strikethrough"><enum>(b)</enum><header>Technical

			 amendments To conform communications and customer records exceptions</header>

				<paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="ID128f5038e8284b999a95128392ff1aa2" reported-display-style="strikethrough"><enum>(1)</enum><header>Voluntary

			 disclosures</header><text display-inline="yes-display-inline">Section 2702 of

			 title 18, United States Code, is amended—</text>

					<subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="IDd112309cc40840d6b27f4f50e18977f6" reported-display-style="strikethrough"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (b)(8)—</text>

						<clause changed="deleted" commented="no" display-inline="no-display-inline" id="ID29b51dd14a2f4bbbada5094e30e8fe0e" reported-display-style="strikethrough"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>Federal, State, or

			 Code, is amended—</text>

				after the expiration of a warrant authorizing delayed notice (including any

				extension thereof) entered under this section, or the denial of such warrant

				(or request for extension), the issuing or denying judge shall report to the

				period of usage (or sessions) by the customer or subscriber; and</text>

								</subclause><subclause changed="deleted" commented="no" display-inline="no-display-inline" id="IDd8b4d4ec322a40e380382a8c3407be6b" reported-display-style="strikethrough"><enum>(VII)</enum><text display-inline="yes-display-inline">any mechanisms and sources of payment for

				such service, including the number of any credit card or bank account utilized

				for payment for such service; and</text>

								</subclause></clause><clause changed="deleted" commented="no" display-inline="no-display-inline" id="ID483adfc6f2ef469f8b73538a0da7db00" reported-display-style="strikethrough"><enum>(ii)</enum><text display-inline="yes-display-inline">if available, with respect to any customer

				covered by the order—</text>

				</paragraph></subsection><subsection changed="deleted" commented="no" display-inline="no-display-inline" id="IDd2411094bc334393bb429b38da295ec6" reported-display-style="strikethrough"><enum>(b)</enum><header>Additional

			 protections</header><text display-inline="yes-display-inline">Section 501(c) of

			 the Foreign Intelligence Surveillance Act of 1978 (50 U.S.C. 1861(c)) is

			 amended—</text>

				<paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="ID59279611a2ab4dc6b421f98a0fa61666" reported-display-style="strikethrough"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (2), by inserting after

			 <quote>An order under this subsection</quote> the

				provide a reasonable period of time within which the tangible things can be

						</subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="IDc1a424de17944e4cbb20f444429bea90" reported-display-style="strikethrough"><enum>(C)</enum><text display-inline="yes-display-inline">shall provide clear and conspicuous notice

				of the principles and procedures set forth in subsections (d) and (f);

				and</text>

						</subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="IDe026d9de6f5e46598dbdcdd8412cbc65" reported-display-style="strikethrough"><enum>(D)</enum>

						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>

				section for an order requiring the production of library circulation records,

				library patron lists, book sales records, book customer lists, firearms sales

				records, or medical records containing personally identifiable information

				without the prior written approval of the Director of the Federal Bureau of

				Investigation. The Director may delegate authority to approve such an

				application to the Deputy Director of the Federal Bureau of Investigation, but

				such authority may not be further

				delegated.</text>

				</paragraph></subsection><subsection changed="deleted" commented="no" display-inline="no-display-inline" id="IDde4243dd8e1d4db6b86c1c20f8b72fa0" reported-display-style="strikethrough"><enum>(d)</enum><header>Prohibition on

			 disclosure</header><text display-inline="yes-display-inline">Section 501(d) of

			 the Foreign Intelligence Surveillance Act of 1978 (50 U.S.C. 1861(d)) is

			 amended to read as follows:</text>

				<quoted-block changed="deleted" display-inline="no-display-inline" id="id953D97F81BB8427E9D0925A90C95FB2F" reported-display-style="strikethrough" style="OLC">

					<subsection changed="deleted" commented="no" display-inline="no-display-inline" id="IDaccffd79a3554abaad2aef6dd08ca74d" reported-display-style="strikethrough"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id9ADDC96D865D45948ED4119C38C76852"><enum>(1)</enum><text display-inline="yes-display-inline">No person shall disclose to any other

				person that the Federal Bureau of Investigation has sought or obtained tangible

				things pursuant to an order under this section other than to—</text>

							<subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="IDeabf22b3bbe1465088b05cb27254c578" indent="up1" reported-display-style="strikethrough"><enum>(A)</enum><text display-inline="yes-display-inline">those persons to whom such disclosure is

				necessary to comply with such order;</text>

							</subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="ID02955abf23904dab8078b60647f326f3" indent="up1" reported-display-style="strikethrough"><enum>(B)</enum><text display-inline="yes-display-inline">an attorney to obtain legal advice or

				assistance with respect to the production of things in response to the order;

				or</text>

							</subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="ID8605f64cc2d341a6b3e62f33b552e729" indent="up1" reported-display-style="strikethrough"><enum>(C)</enum><text display-inline="yes-display-inline">other persons as permitted by the Director

				of the Federal Bureau of Investigation or the designee of the Director.</text>

							</subparagraph></paragraph><paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="IDdf572bca2e7d4eee8d98836b61e2c4dc" indent="up1" reported-display-style="strikethrough"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id37A0B7D74DC34520A78C6F65168E21D6"><enum>(A)</enum><text display-inline="yes-display-inline">Any person having received a disclosure

				under subparagraph (A), (B), or (C) of paragraph (1) shall be subject to the

				prohibitions on disclosure under that paragraph.</text>

							</subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="ID893d638587a44bcfae84b73d4bca5123" indent="up1" reported-display-style="strikethrough"><enum>(B)</enum><text display-inline="yes-display-inline">Any person making a further disclosure

				authorized by subparagraph (A), (B), or (C) of paragraph (1) shall notify the

				person to whom the disclosure is made of the prohibitions on disclosure under

				this subsection.</text>

							</subparagraph></paragraph><paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="ID7647fefa0932443299876b01fa3dac0b" indent="up1" reported-display-style="strikethrough"><enum>(3)</enum><text display-inline="yes-display-inline">An order under this section shall notify,

				in writing, the person to whom the order is directed of the nondisclosure

				requirements under this

				subsection.</text>

						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection changed="deleted" commented="no" display-inline="no-display-inline" id="ID238923bec46742baa78ad052cbc94a2a" reported-display-style="strikethrough"><enum>(e)</enum><header>Judicial

			 review</header><text display-inline="yes-display-inline">Section 501 of the

			 Foreign Intelligence Surveillance Act of 1978 (50 U.S.C. 1861) is amended by

			 adding at the end the following:</text>

				<quoted-block changed="deleted" display-inline="no-display-inline" id="id5625D1772E894E9DA7AF19C0BCDB2A48" reported-display-style="strikethrough" style="OLC">

					<subsection changed="deleted" commented="no" display-inline="no-display-inline" id="ID8704fd80a0704dbd8b0e57fd1fa67329" reported-display-style="strikethrough"><enum>(f)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id7EC1C22C6FC84518AB93D85A824CF8D6"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idDD44FCDBC169402EABB6906A8DBACD00"><enum>(A)</enum><text display-inline="yes-display-inline">Any person receiving an order to produce

				any tangible thing under this section may challenge the legality of that order

				by filing a petition in the court established under section 103(a).</text>

							</subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="id57FDEDC19ACC4B2BA3083B5F3C2D40C4" indent="up2" reported-display-style="strikethrough"><enum>(B)</enum><text display-inline="yes-display-inline">That petition may be considered by any

				judge of the court.</text>

							</subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="id251C65D3B8324175BF6F63AB91EA4401" indent="up2" reported-display-style="strikethrough"><enum>(C)</enum><text display-inline="yes-display-inline">The judge considering the petition may

				modify or set aside the order if the judge finds that the order does not meet

				the requirements of this section or is otherwise unlawful.</text>

							</subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="idFB849D445CB54ED98D6374AFD68439DD" indent="up2" reported-display-style="strikethrough"><enum>(D)</enum><text display-inline="yes-display-inline">Any petition for review of a decision to

				affirm, modify, or set aside an order under this paragraph by the United States

				or any person receiving such order shall be sent to the court of review

				established under section 103(b), which shall have jurisdiction to consider

				such petitions.</text>

							</subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="id97F8C960B3234CEAAEF2D4116E1409F9" indent="up2" reported-display-style="strikethrough"><enum>(E)</enum><text display-inline="yes-display-inline">The court of review shall immediately

				provide for the record a written statement of the reasons for its decision and,

				on petition of the United States or any person receiving such order for a writ

				of certiorari, the record shall be transmitted under seal to the Supreme Court,

				which shall have jurisdiction to review such decision.</text>

							</subparagraph></paragraph><paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="IDcea23c2eabc04c5082d5e1f7daf71fae" indent="up1" reported-display-style="strikethrough"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id9B0E7C01EFF04A3F89804BFB74B390DC"><enum>(A)</enum><text display-inline="yes-display-inline">Judicial proceedings under this subsection

				shall be concluded as expeditiously as possible.</text>

							</subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="id4A76F060B04841A18FD2E60D6A91F244" indent="up1" reported-display-style="strikethrough"><enum>(B)</enum><text display-inline="yes-display-inline">The record of proceedings, including

				applications made and orders granted, shall be maintained under security

				measures established by the Chief Justice of the United States in consultation

				with the Attorney General and the Director of National Intelligence.</text>

							</subparagraph></paragraph><paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="ID36f39047931e4a5b85ada183fc5ff58d" indent="up1" reported-display-style="strikethrough"><enum>(3)</enum><text display-inline="yes-display-inline">All petitions under this subsection shall

				be filed under seal, and the court, upon the request of the Government, shall

				review any Government submission, which may include classified information, as

				well as the application of the Government and related materials, ex parte and

				in

				camera.</text>

						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection changed="deleted" commented="no" display-inline="no-display-inline" id="ID2b5bb0c8655247ba8928cd0d743a9178" reported-display-style="strikethrough"><enum>(f)</enum><header>Enhanced

			 oversight</header><text display-inline="yes-display-inline">Section 502 of the

			 Foreign Intelligence Surveillance Act of 1978 (50 U.S.C. 1862) is

			 amended—</text>

				<paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="IDaa3388199e9d457092d354a8920a6b5f" reported-display-style="strikethrough"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by inserting <quote>,

			 and the Committee on the Judiciary of the House of Representatives and the

			 Committee on the Judiciary of the Senate,</quote> after <quote>of the

			 Senate</quote>; and</text>

				</paragraph><paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="ID792ca152f65342519aad3c93e048b9be" reported-display-style="strikethrough"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b)—</text>

					<subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="IDc584aaaeee9e49649e3059cd019286cf" reported-display-style="strikethrough"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>On a semiannual

			 basis</quote> through <quote>the preceding 6-month period</quote> and inserting

			 Congress a report setting forth with respect to the preceding calendar

			 year</quote>;</text>

					</subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="ID2a1b8762b419421b9fb10963c5de23a5" reported-display-style="strikethrough"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking

				the application or order involved any of the following:</text>

								<subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="IDfff345658bc1434d8239e89eeb290357" reported-display-style="strikethrough"><enum>(A)</enum><text display-inline="yes-display-inline">The production of tangible things from a

				library, as defined in section 213(2) of the Library Services and Technology

				Act (20 U.S.C. 9122(2)).</text>

								</subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="ID1df3af12c9d44226aa4769bcf0825239" reported-display-style="strikethrough"><enum>(B)</enum><text display-inline="yes-display-inline">The production of tangible things from a

				person or entity primarily engaged in the sale, rental, or delivery of books,

				journals, magazines, or other similar forms of communication whether in print

				or digitally.</text>

								</subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="ID8b169639e5e34baf87e47585ba50b742" reported-display-style="strikethrough"><enum>(C)</enum><text display-inline="yes-display-inline">The production of records related to the

				purchase of a firearm, as defined in section 921(a)(3) of title 18, United

				States Code.</text>

								</subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="ID87deb6bc8d5c469280a9cebc6f3de397" reported-display-style="strikethrough"><enum>(D)</enum><text display-inline="yes-display-inline">The production of health information, as

				defined in section 1171(4) of the Social Security Act (42 U.S.C.

				1320d(4)).</text>

								</subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="ID6905521db92340edadf2a7e5678323d7" reported-display-style="strikethrough"><enum>(E)</enum><text display-inline="yes-display-inline">The production of taxpayer return

				information, return, or return information, as defined in section 6103(b) of

				the Internal Revenue Code of 1986 (26 U.S.C. 6103(b)).</text>

								</subparagraph></paragraph><subsection changed="deleted" commented="no" display-inline="no-display-inline" id="ID91a1461fd3d64a92a46e70bc359961a2" reported-display-style="strikethrough"><enum>(c)</enum><text display-inline="yes-display-inline">Each report under subsection (b) shall be

				submitted in unclassified form, but may include a classified annex.</text>

							</subsection><subsection changed="deleted" commented="no" display-inline="no-display-inline" id="IDafa82fff0bc0420d97379bc18ceeb82b" reported-display-style="strikethrough"><enum>(d)</enum><text display-inline="yes-display-inline">In April of each year, the Attorney General

				shall transmit to the Administrative Office of the United States Courts and to

				Congress a report setting forth with respect to the preceding calendar

				year—</text>

				or set aside such a nondisclosure requirement if there is no reason to believe

				that disclosure may endanger the national security of the United States,

				interfere with a criminal, counterterrorism, or counterintelligence

				investigation, interfere with diplomatic relations, or endanger the life or

				physical safety of any person. In reviewing a nondisclosure requirement, the

				certification by the Government that the disclosure may endanger the national

				security of the United States or interfere with diplomatic relations shall be

				treated as conclusive unless the court finds that the certification was made in

				bad

				faith.</text>

				from which the Department of Justice has received voluntary disclosures under

				subsection (b)(8); and</text>

						</paragraph><paragraph changed="added" id="IDf049abc4935e471c89e6f5263ff71fcd" reported-display-style="italic"><enum>(2)</enum><text>a summary of the basis

				for disclosure in those instances where—</text>

							<subparagraph changed="added" id="ID94508d4d24564371b7988281a5f77bfe" reported-display-style="italic"><enum>(A)</enum><text>voluntary disclosures

				under subsection (b)(8) were made to the Department of Justice; and</text>

							</subparagraph><subparagraph changed="added" id="ID70e3d8bdca3b47359c326b15209078ff" reported-display-style="italic"><enum>(B)</enum><text>the investigation

				pertaining to those disclosures was closed without the filing of criminal

				charges.</text>

				judge</header><text>Not later than 30 days after the expiration of a warrant

				authorizing delayed notice (including any extension thereof) entered under this

				section, or the denial of such warrant (or request for extension), the issuing

				or denying judge shall report to the Administrative Office of the United States

				Courts—</text>

							<subparagraph changed="added" id="IDb29df5c7868147808f507984796ba7c6" reported-display-style="italic"><enum>(A)</enum><text>the fact that a warrant

				was applied for;</text>

							</subparagraph><subparagraph changed="added" id="IDcaac93dd031f4aabb935da65e5b546d6" reported-display-style="italic"><enum>(B)</enum><text>the fact that the warrant

				or any extension thereof was granted as applied for, was modified, or was

				denied;</text>

							</subparagraph><subparagraph changed="added" id="IDda6e91e9b9674578a1b76c183d6f6244" reported-display-style="italic"><enum>(C)</enum><text>the period of delay in

				the giving of notice authorized by the warrant, and the number and duration of

				any extensions; and</text>

							</subparagraph><subparagraph changed="added" id="ID33a4c33f42174ed6b1f3bdedb40136cf" reported-display-style="italic"><enum>(D)</enum><text>the offense specified in

				the warrant or application.</text>

							</subparagraph></paragraph><paragraph changed="added" id="IDd192d7f225fb4113b70a08f72b18610d" reported-display-style="italic"><enum>(2)</enum><header>Report by

				administrative office of the United States courts</header><text>In April of

				each year, the Director of the Administrative Office of the United States

				Courts shall transmit to Congress a full and complete report—</text>

							<subparagraph changed="added" id="ID462456186a4e4a2cbc065b59138f4fe6" reported-display-style="italic"><enum>(A)</enum><text>concerning the number of

				applications for warrants and extensions of warrants authorizing delayed notice

				pursuant to this section, and the number of warrants and extensions granted or

				denied pursuant to this section during the preceding calendar year; and</text>

							</subparagraph><subparagraph changed="added" id="ID73c3515475584c9882af6379cb9fb65a" reported-display-style="italic"><enum>(B)</enum><text>that includes a summary

				and analysis of the data required to be filed with the Administrative Office by

				paragraph (1).</text>

							</subparagraph></paragraph><paragraph changed="added" id="IDe62bd4910a4e4203bde26838e16c3ca5" reported-display-style="italic"><enum>(3)</enum><header>Regulations</header><text>The

				Director of the Administrative Office of the United States Courts, in

				consultation with the Attorney General, is authorized to issue binding

				regulations dealing with the content and form of the reports required to be

				filed under paragraph

				(1).</text>

						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

				or subscriber;</text>

								</subclause><subclause changed="added" id="IDa98f69fb8daa4837ac1bb71bd9c77ce8" reported-display-style="italic"><enum>(II)</enum><text>the address of the

				customer or subscriber;</text>

								</subclause><subclause changed="added" id="ID553b0b2fdb884c908ac464557986b286" reported-display-style="italic"><enum>(III)</enum><text>the telephone or

				instrument number, or other subscriber number or identifier, of the customer or

				subscriber, including any temporarily assigned network address or associated

				routing or transmission information;</text>

				provision of service by such provider to the customer or subscriber and the

				types of services utilized by the customer or subscriber;</text>

				of local or long distance telephone service, any local or long distance

				telephone records of the customer or subscriber;</text>

								</subclause><subclause changed="added" id="ID6ede19194d714c47ba6383c82ff15ddb" reported-display-style="italic"><enum>(VI)</enum><text>if applicable, any

				records reflecting period of usage (or sessions) by the customer or subscriber;

				and</text>

								</subclause><subclause changed="added" id="ID64050ba83ac745f181624ff4d4e3a936" reported-display-style="italic"><enum>(VII)</enum><text>any mechanisms and

				sources of payment for such service, including the number of any credit card or

				bank account utilized for payment for such service; and</text>

								</subclause></clause><clause changed="added" id="IDf824eef5af7d4a9aab3e740f41ef0e89" reported-display-style="italic"><enum>(ii)</enum><text>if available, with

				respect to any customer or subscriber of incoming or outgoing communications to

				or from the service covered by the order—</text>

								<subclause changed="added" id="IDbd5545c634f14dd68adb9a7f86b7e26c" reported-display-style="italic"><enum>(I)</enum><text>the name of such customer

				or subscriber;</text>

								</subclause><subclause changed="added" id="ID5f0ce762747f4981a973d64487205f94" reported-display-style="italic"><enum>(II)</enum><text>the address of such

				customer or subscriber;</text>

								</subclause><subclause changed="added" id="ID52eb047fc37a415490d24d3bbe62420e" reported-display-style="italic"><enum>(III)</enum><text>the telephone or

				or subscriber, including any temporarily assigned network address or associated

							</subparagraph><subparagraph changed="added" id="IDeb5a76ad339545589a9878bc5d5b1e56" reported-display-style="italic"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id3CCC1D5F67084986A6F857F3D829C833"><enum>(i)</enum><text>pertain to a foreign

				power or an agent of a foreign power;</text>

								</clause><clause changed="added" id="idB36255530B44420994F592FB12BC18D5" indent="up1" reported-display-style="italic"><enum>(ii)</enum><text>are relevant to the

				activities of a suspected agent of a foreign power who is the subject of such

				authorized investigation; or</text>

								</clause><clause changed="added" id="id095F5B5EDC154BA0A053FF63F496D30A" indent="up1" reported-display-style="italic"><enum>(iii)</enum><text>pertain to an

				individual in contact with, or known to, a suspected agent of a foreign

				power.</text>

								</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph><paragraph changed="added" id="IDb6c080f604a94b1f8dc4f39f11787986" reported-display-style="italic"><enum>(2)</enum><header>Order</header><text>Section

			 501(c)(1) of the Foreign Intelligence Surveillance Act of 1978 (50 U.S.C.

			 1861(c)(1)) is amended to read as follows:</text>

				made pursuant to this section, the judge shall enter an ex parte order as

				requested, or as modified, approving the release of records or tangible things

				if the judge finds that—</text>

								<subparagraph changed="added" id="IDf78ca33d4d9d4d09a7b27d3d4a2044ae" indent="up1" reported-display-style="italic"><enum>(A)</enum><text>the

				statement of facts contained in the application establishes reasonable grounds

				to believe that the records or other things sought are relevant to an

				authorized investigation conducted in accordance with subsection (a)(2) to

				obtain foreign intelligence information not concerning a United States person

				or to protect against international terrorism or clandestine intelligence

				activities;</text>

								</subparagraph><subparagraph changed="added" id="ID06f6d4e8715648c0975dc9ebe1b213bf" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>the

				statement of facts contained in the application establishes reasonable grounds

				to believe that the records or other things sought—</text>

									<clause changed="added" id="ID8d59c754135c4ccfa5a2d17dc4ad3e2c" reported-display-style="italic"><enum>(i)</enum><text>pertain to a foreign

				power or an agent of a foreign power;</text>

									</clause><clause changed="added" id="ID776ebc0e587640d5b945f99d5b2f63b5" reported-display-style="italic"><enum>(ii)</enum><text>are relevant to the

				activities of a suspected agent of a foreign power who is the subject of such

				authorized investigation; or</text>

									</clause><clause changed="added" id="ID301f8f6e95da40278e29fafc54c60f39" reported-display-style="italic"><enum>(iii)</enum><text>pertain to an

				individual in contact with, or known to, a suspected agent of a foreign power;

				and</text>

									</clause></subparagraph><subparagraph changed="added" id="ID957dfd8eb1bb4292b6ba821e0fe99379" indent="up1" reported-display-style="italic"><enum>(C)</enum><text>the

				application meets the other requirements of this

				section.</text>

								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph></subsection><subsection changed="added" id="ID1a478344c0fa426cac60e021146f3c12" reported-display-style="italic"><enum>(b)</enum><header>Additional

			 protections</header><text>Section 501(c) of the Foreign Intelligence

			 Surveillance Act of 1978 (50 U.S.C. 1861(c)) is amended—</text>

				<paragraph changed="added" id="IDfe0b81e4942e433fbf6730e151f20cba" reported-display-style="italic"><enum>(1)</enum><text>in paragraph (2), by

			 inserting after <quote>An order under this subsection</quote> the

			 following:</text>

					<quoted-block changed="added" display-inline="no-display-inline" id="id8ADDA733B7874E88A263402917A8AF40" reported-display-style="italic" style="OLC">

						<subparagraph changed="added" id="ID950d65c2b74c46b29962b8db06ae45dd" reported-display-style="italic"><enum>(A)</enum><text>shall describe the

				tangible things concerned with sufficient particularity to permit them to be

				fairly identified;</text>

						</subparagraph><subparagraph changed="added" id="IDbfcb2cc53ed4416d8bf3992a03cacb89" reported-display-style="italic"><enum>(B)</enum><text>shall prescribe a return

				date which will provide a reasonable period of time within which the tangible

				things can be assembled and made available;</text>

						</subparagraph><subparagraph changed="added" id="IDddb0956ec6854400b4fa3e79f864f469" reported-display-style="italic"><enum>(C)</enum><text>shall provide clear and

				conspicuous notice of the principles and procedures set forth in subsection

				(d);</text>

						</subparagraph><subparagraph changed="added" id="ID841b381fb6f04f30a1505b23260b6b22" reported-display-style="italic"><enum>(D)</enum><text>shall not require the

				production of anything that would be protected from production under the

				standards applicable to a subpoena duces tecum issued by a court of the United

				States in aid of a grand jury investigation; and</text>

						</subparagraph><subparagraph changed="added" id="IDd55d2e6e87d74575a9e5ca678ca2d5d4" reported-display-style="italic"><enum>(E)</enum>

						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph></subsection><subsection changed="added" id="IDe8871e3791e041559fa7f3eaa5f6eb1d" reported-display-style="italic"><enum>(c)</enum><header>Director approval for

			 certain applications</header><text>Section 501(a) of the Foreign Intelligence

			 Surveillance Act of 1978 (50 U.S.C. 1861(a)) is amended—</text>

				<paragraph changed="added" id="ID7b2c2b38154c4161928b5756e1613014" reported-display-style="italic"><enum>(1)</enum><text>in paragraph (1), by

			 striking <quote>The Director</quote> and inserting <quote>Except as provided in

			 paragraph (3), the Director</quote>; and</text>

				</paragraph><paragraph changed="added" id="ID3b417858a9d84746ad6246e26714b494" reported-display-style="italic"><enum>(2)</enum><text>by adding at the end the

			 following:</text>

					<quoted-block changed="added" display-inline="no-display-inline" id="idE85A1E8AB723488099935FB1D62B1D1A" reported-display-style="italic" style="OLC">

						<paragraph changed="added" id="ID31360b9d56d84942891c88313ea243d4" reported-display-style="italic"><enum>(3)</enum><text>No application shall be

				made under this section for an order requiring the production of library

				circulation records, library patron lists, book sales records, book customer

				lists, firearms sales records, or medical records containing personally

				identifiable information without the prior written approval of the Director of

				the Federal Bureau of Investigation. The Director may delegate authority to

				approve such an application to the Deputy Director of the Federal Bureau of

				Investigation, but such authority may not be further

				delegated.</text>

						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph></subsection><subsection changed="added" id="ID5ae163b84f364bbb88e48ee846975a76" reported-display-style="italic"><enum>(d)</enum><header>Prohibition on

			 disclosure</header><text>Section 501(d) of the Foreign Intelligence

			 Surveillance Act of 1978 (50 U.S.C. 1861(d)) is amended to read as

			 follows:</text>

				<quoted-block changed="added" display-inline="no-display-inline" id="id154E473701734D69B2C40E036C073897" reported-display-style="italic" style="OLC">

					<subsection changed="added" id="ID916c671544ba4be0b2c75498cb19349b" reported-display-style="italic"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idBB9F7173A2BB4A52A84667BC94E2818D"><enum>(1)</enum><text>No person shall

				disclose to any other person that the Federal Bureau of Investigation has

				sought or obtained tangible things pursuant to an order under this section

				other than to</text>

							<subparagraph changed="added" id="ID88a9552dc968439a89857286278d6ea4" indent="up1" reported-display-style="italic"><enum>(A)</enum><text>those

				persons to whom such disclosure is necessary to comply with such order;</text>

							</subparagraph><subparagraph changed="added" id="IDe29d45098f8c4a61ad3057e16fcafb0e" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>an

				attorney to obtain legal advice or assistance with respect to the production of

				things in response to the order; or</text>

							</subparagraph><subparagraph changed="added" id="ID071f93de497041c3a6b9d4aa87424a8e" indent="up1" reported-display-style="italic"><enum>(C)</enum><text>other

				persons as permitted by the Director of the Federal Bureau of Investigation or

				the designee of the Director.</text>

							</subparagraph></paragraph><paragraph changed="added" id="ID50d08bb60d9142cfbac12c4a9e8bfc01" indent="up1" reported-display-style="italic"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id77ADDFD4E4D346438911F099034F37AA"><enum>(A)</enum><text>Any person having

				received a disclosure under subparagraph (A), (B), or (C) of paragraph (1)

				shall be subject to the prohibitions on disclosure under that paragraph.</text>

							</subparagraph><subparagraph changed="added" id="IDf6b19514f8d1487ea5c40ad8447b9861" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>Any

				person making a further disclosure authorized by subparagraph (A), (B), or (C)

				of paragraph (1) shall notify the person to whom the disclosure is made of the

				prohibitions on disclosure under this subsection.</text>

							</subparagraph></paragraph><paragraph changed="added" id="ID40f9dfe7e2e84f8cb12301864f871b68" indent="up1" reported-display-style="italic"><enum>(3)</enum><text>An

				order under this section shall notify, in writing, the person to whom the order

				is directed of the nondisclosure requirements under this

				subsection.</text>

						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection changed="added" id="ID4f92a6cbf088454fa3d8d43a9c786072" reported-display-style="italic"><enum>(e)</enum><header>Judicial

			 review</header><text>Section 501 of the Foreign Intelligence Surveillance Act

			 of 1978 (50 U.S.C. 1861) is amended by adding at the end the following:</text>

				<quoted-block changed="added" display-inline="no-display-inline" id="id21CE0C94DB7B4ABBAA7EAC24D0F8722D" reported-display-style="italic" style="OLC">

					<subsection changed="added" id="IDc335ccf790d84e95abc78c106d9a724a" reported-display-style="italic"><enum>(f)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id720A317F73154472801C89BA1AD9927E"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idBCC6C032FDB0472C8CA2FD51FCD236F4"><enum>(A)</enum><text>Any person receiving an

				order to produce any tangible thing under this section may challenge the

				legality of that order, including any prohibition on disclosure, by filing a

				petition in the court established under section 103(a).</text>

							</subparagraph><subparagraph changed="added" id="ID31c037735d7d4e949ca993d880a033a7" indent="up2" reported-display-style="italic"><enum>(B)</enum><text>That

				petition may be considered by any judge of the court.</text>

							</subparagraph><subparagraph changed="added" id="IDe83e9f497f13401781d5ddf73d756f73" indent="up2" reported-display-style="italic"><enum>(C)</enum><text>The

				judge considering the petition may modify or set aside the order if the judge

				finds that the order does not meet the requirements of this section or is

				otherwise unlawful.</text>

							</subparagraph><subparagraph changed="added" id="IDe0feacdf324143e3a937667e198e3e1a" indent="up2" reported-display-style="italic"><enum>(D)</enum><text>Any

				petition for review of a decision to affirm, modify, or set aside an order or

				prohibition on disclosure under this paragraph by the United States or any

				person receiving such order shall be sent to the court of review established

				under section 103(b), which shall have jurisdiction to consider such

				petitions.</text>

							</subparagraph><subparagraph changed="added" id="ID57142ac0f9444d59b97e5cc51ad4a42b" indent="up2" reported-display-style="italic"><enum>(E)</enum><text>The

				court of review shall immediately provide for the record a written statement of

				the reasons for its decision and, on petition of the United States or any

				person receiving such order for a writ of certiorari, the record shall be

				transmitted under seal to the Supreme Court, which shall have jurisdiction to

				review such decision.</text>

							</subparagraph></paragraph><paragraph changed="added" id="IDa3fad3ae965944efbfa5501bd824ea62" indent="up1" reported-display-style="italic"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id16BB747251BC4366819E1096D76A30CB"><enum>(A)</enum><text>Judicial proceedings

				under this subsection shall be concluded as expeditiously as possible.</text>

							</subparagraph><subparagraph changed="added" id="ID3cdfdc4af41243deb9296d7b582cc749" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>The

				record of proceedings, including applications made and orders granted, shall be

				maintained under security measures established by the Chief Justice of the

				United States in consultation with the Attorney General and the Director of

				National Intelligence.</text>

							</subparagraph></paragraph><paragraph changed="added" id="IDa8cde8ddd41348cb9c9fb92268607f14" indent="up1" reported-display-style="italic"><enum>(3)</enum><text>All

				petitions under this subsection shall be filed under seal, and the court, upon

				the request of the Government, shall review any Government submission, which

				may include classified information, as well as the application of the

				Government and related materials, ex parte and in camera.</text>

						</paragraph><paragraph changed="added" id="IDd21bb2aa38cc49e0b88e0110e09f6734" indent="up1" reported-display-style="italic"><enum>(4)</enum><text>Not

				later than 60 days after the date of enactment of the USA PATRIOT Improvement

				and Reauthorization Act of 2005, the court established under section 103(a)

				shall develop and issue procedures for the review of petitions filed under

				paragraph

				(1).</text>

						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection changed="added" id="ID2dc0ead22f184f0aaf23e370d4de6801" reported-display-style="italic"><enum>(f)</enum><header>Enhanced

			 oversight</header><text display-inline="yes-display-inline">Section 502 of the

			 Foreign Intelligence Surveillance Act of 1978 (50 U.S.C. 1862) is

			 amended</text>

				<paragraph changed="added" id="ID9cb936d2c20a40348922874a366f05d4" reported-display-style="italic"><enum>(1)</enum><text>in subsection (a), by

			 inserting <quote>, and the Committee on the Judiciary of the House of

			 Representatives and the Committee on the Judiciary of the Senate,</quote> after

			 <quote>of the Senate</quote>; and</text>

				</paragraph><paragraph changed="added" id="IDfc32a575300f4606b346f830e5a59ab4" reported-display-style="italic"><enum>(2)</enum><text>in subsection (b)—</text>

					<subparagraph changed="added" id="IDd1b97915a27d4e1ebd0b8bf032e9a3bd" reported-display-style="italic"><enum>(A)</enum><text>by striking <quote>On a

			 semiannual basis</quote> through <quote>the preceding 6-month period</quote>

			 and inserting <quote>In April of each year, the Attorney General shall transmit

			 to the Congress a report setting forth with respect to the preceding calendar

			 year</quote>;</text>

					</subparagraph><subparagraph changed="added" id="IDca814a081db54504b45f02de70d162ef" reported-display-style="italic"><enum>(B)</enum><text>in paragraph (1), by

			 striking <quote>and</quote> at the end;</text>

					</subparagraph><subparagraph changed="added" id="ID3f236aa279794d02bdf61b2ae582a80f" reported-display-style="italic"><enum>(C)</enum><text>in paragraph (2), by

				applications made for orders approving requests for the production of tangible

				things under section 501, and the total number of orders either granted,

				modified, or denied, when the application or order involved any of the

				following:</text>

								<subparagraph changed="added" commented="no" display-inline="no-display-inline" id="ID646155e477d94bfa8f6c0e13df8cade7" reported-display-style="italic"><enum>(A)</enum><text>The production of

				tangible things from a library, as defined in section 213(2) of the Library

				Services and Technology Act (20 U.S.C. 9122(2)).</text>

								</subparagraph><subparagraph changed="added" id="ID1e26b0e309cc4f25978f0df9c3eeb0f8" reported-display-style="italic"><enum>(B)</enum><text>The production of

				tangible things from a person or entity primarily engaged in the sale, rental,

				or delivery of books, journals, magazines, or other similar forms of

				communication whether in print or digitally.</text>

								</subparagraph><subparagraph changed="added" id="ID6c065374e8d641d991c5c08ab519cb33" reported-display-style="italic"><enum>(C)</enum><text>The production of records

				related to the purchase of a firearm, as defined in section 921(a)(3) of title

				18, United States Code.</text>

								</subparagraph><subparagraph changed="added" id="ID825113c40dcd4299a9bbb7f7e796c071" reported-display-style="italic"><enum>(D)</enum><text>The production of health

				information, as defined in section 1171(4) of the Social Security Act (42

				U.S.C. 1320d(4)).</text>

								</subparagraph><subparagraph changed="added" id="ID28504136018c4ffb9c1b71041c350961" reported-display-style="italic"><enum>(E)</enum><text>The production of

				taxpayer return information, return, or return information, as defined in

				section 6103(b) of the Internal Revenue Code of 1986 (26 U.S.C.

				6103(b)).</text>

								</subparagraph></paragraph><subsection changed="added" id="IDdd98942bab05430997d01d9bda339110" reported-display-style="italic"><enum>(c)</enum><text>Each report under

				subsection (b) shall be submitted in unclassified form, but may include a

				classified annex.</text>

							</subsection><subsection changed="added" id="ID9044b219b368407184e4fe4a985fec94" reported-display-style="italic"><enum>(d)</enum><text>In April of each year,

				the Attorney General shall transmit to the Administrative Office of the United

				States Courts and to Congress a report setting forth with respect to the

				preceding calendar year—</text>

						</paragraph><paragraph changed="added" id="IDe58ae95221bf4d96894a8168153937a3" reported-display-style="italic"><enum>(4)</enum><header>Standard of

				review</header><text>The court may modify or set aside such a nondisclosure

				requirement if there is no reason to believe that disclosure may endanger the

				national security of the United States, interfere with a criminal,

				counterterrorism, or counterintelligence investigation, interfere with

				diplomatic relations, or endanger the life or physical safety of any person. In

				reviewing a nondisclosure requirement, the certification by the Government that

				the disclosure may endanger the national security of the United States or

				interfere with diplomatic relations shall be treated as conclusive unless the

				court finds that the certification was made in bad

				faith.</text>

						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph></subsection><subsection changed="added" id="ID79c0507342134292bbaa227296ecc0fc" reported-display-style="italic"><enum>(c)</enum><header>Enforcement of national

			 security letters</header><text>Section 2709(a) of title 18, United States Code,

			 as amended by subsection (b), is amended by adding at the end the

			 following:</text>

			 for FISA courts</header><text display-inline="yes-display-inline">Section 103

			 of the Foreign Intelligence Surveillance Act of 1978 (50 U.S.C. 1803) is

			 amended by adding at the end the following:</text>
