			<paragraph commented="no" display-inline="no-display-inline" id="ID18B59B98E5F7457DA941E758F4C4B622"><enum>(1)</enum><text display-inline="yes-display-inline">A vibrant and growing small business sector

			 is critical to creating jobs in a dynamic economy.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7ACDE27B41E4426993876F7679C6259A"><enum>(2)</enum><text display-inline="yes-display-inline">Regulations designed for application to

			 large-scale entities have been applied uniformly to small businesses and other

			 small entities, even though the problems sought to be solved by such

			 regulations are not always caused by these small businesses and other small

			 entities.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID99B7A3E3F2404432A70FF75064326F57"><enum>(3)</enum><text display-inline="yes-display-inline">Uniform Federal regulatory and reporting

			 requirements in many instances have imposed on small businesses and other small

			 entities unnecessary and disproportionately burdensome demands, including

			 legal, accounting, and consulting costs.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3D3ED19F47894B93BB814E93BCF1A449"><enum>(4)</enum><text display-inline="yes-display-inline">Since 1980, Federal agencies have been

			 required to recognize and take account of the differences in the scale and

			 resources of regulated entities, but have failed to do so.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD52C1094D7BE4B1B9251AF9FE619BEB2"><enum>(5)</enum><text display-inline="yes-display-inline">Alternative regulatory approaches that do

			 not conflict with the stated objectives of the statutes the regulations seek to

			 implement may be available and may minimize the significant economic impact of

			 regulations on small businesses and other small entities.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD2A1E122995841FF87C0AA57E16BED72"><enum>(6)</enum><text display-inline="yes-display-inline">Federal agencies have failed to analyze and

			 uncover less-costly alternative regulatory approaches, despite the fact that

			 the chapter 6 of title 5, United States Code (commonly known as the Regulatory

			 Flexibility Act), requires them to do so.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID423D6D5958D14681AC6A4E1576A4574D"><enum>(7)</enum><text display-inline="yes-display-inline">Federal agencies continue to interpret

			 chapter 6 of title 5, United States Code, in a manner that permits them to

			 avoid their analytical responsibilities.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4539BFDBE16C4068B37E5EC64180E182"><enum>(8)</enum><text display-inline="yes-display-inline">The existing oversight of the compliance of

			 Federal agencies with the analytical requirements to assess regulatory impacts

			 on small businesses and other small entities and obtain input from the Chief

			 Counsel for Advocacy has not sufficiently modified the Federal agency

			 regulatory culture.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID73067030730D4F5E9D92E468B429CB3E"><enum>(9)</enum><text display-inline="yes-display-inline">Significant changes are needed in the

			 methods by which Federal agencies develop and analyze regulations, receive

			 input from affected entities, and develop regulatory alternatives that will

			 lessen the burden or maximize the benefits of final rules to small businesses

			 and other small entities.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1D71B6D38AC148BE84AE545BAC5304FB"><enum>(10)</enum><text display-inline="yes-display-inline">It is the intention of Congress to amend

			 chapter 6 of title 5, United States Code, to ensure that all impacts, including

			 foreseeable indirect effects, of proposed and final rules are considered by

			 agencies during the rulemaking process and that the agencies assess a full

			 range of alternatives that will limit adverse economic consequences or enhance

			 economic benefits.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID52497456657F4FF296BA9CA40A29933A"><enum>(11)</enum><text display-inline="yes-display-inline">Federal agencies should be capable of

			 assessing the impact of proposed and final rules without delaying the

			 regulatory process or impinging on the ability of Federal agencies to fulfill

			 their statutory mandates.</text>

			</paragraph></section><section commented="no" display-inline="no-display-inline" id="ID2AA2C8F7C9C8430FAED5E25F4048E700" section-type="subsequent-section"><enum>3.</enum><header>Clarification and

			 expansion of rules covered by the Regulatory Flexibility Act</header><text display-inline="no-display-inline">Section 601 of title 5, United States Code,

			 is amended by adding at the end the following:</text>

			<quoted-block display-inline="no-display-inline" id="IDEDADB1282A9144CE82A8F32D92940636" style="OLC">

				<paragraph commented="no" display-inline="no-display-inline" id="ID2008BE38FE1940338A0E3D76E9A1E1F3"><enum>(9)</enum><header>Economic

				impact</header><text display-inline="yes-display-inline">The term

				<term>economic impact</term> means, with respect to a proposed or final

				rule—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="IDF71EA6BCBC8F47E985A484EE92CA2799"><enum>(A)</enum><text display-inline="yes-display-inline">any direct economic effect on small

				entities of such rule; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDEA0747316AE54A2FB13F6757CE998B56"><enum>(B)</enum><text display-inline="yes-display-inline">any indirect economic effect on small

				entities which is reasonably foreseeable and results from such rule (without

				regard to whether small entities will be directly regulated by the

				rule).</text>

					</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

		</section><section commented="no" display-inline="no-display-inline" id="ID870E85E9701F483DB60599A44CA3EC6C" section-type="subsequent-section"><enum>4.</enum><header>Requirements providing

			 for more detailed analyses</header>

			<subsection commented="no" display-inline="no-display-inline" id="ID7829FD4A955548A88D37F526ABC5FFAA"><enum>(a)</enum><header>Initial

			 regulatory flexibility analysis</header><text display-inline="yes-display-inline">Section 603 of title 5, United States Code,

			 is amended—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="idF14ACE5D35024E21A7D96B0AF5AF3243"><enum>(1)</enum><text display-inline="yes-display-inline">by striking subsection (b) and inserting

			 the following:</text>

					<quoted-block display-inline="no-display-inline" id="IDDF4717FA779B4207B1D276815A1080DD" style="OLC">

						<subsection commented="no" display-inline="no-display-inline" id="ID7E9FBBA86B3149DFACE29E6DDDF80CC3"><enum>(b)</enum><text display-inline="yes-display-inline">Each initial regulatory flexibility

				analysis required under this section shall contain a detailed statement—</text>

							<paragraph commented="no" display-inline="no-display-inline" id="ID0086CEF99A9348C9B2A96342CA5B4B5C"><enum>(1)</enum><text display-inline="yes-display-inline">describing the reasons why action by the

				agency is being considered;</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE0BB103F5E044101BCAFC0F353A95FD2"><enum>(2)</enum><text display-inline="yes-display-inline">describing the objectives of, and legal

				basis for, the proposed rule;</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID33DD86F27B444239B07755BC3298F167"><enum>(3)</enum><text display-inline="yes-display-inline">estimating the number and type of small

				entities to which the proposed rule will apply;</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDED9EB21CE5744743A6E947148DAB9F3E"><enum>(4)</enum><text display-inline="yes-display-inline">describing the projected reporting,

				recordkeeping, and other compliance requirements of the proposed rule,

				including an estimate of the classes of small entities which will be subject to

				the requirement and the type of professional skills necessary for preparation

				of the report and record;</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDECDF93ADFE2149A48E9F203C03FE99F7"><enum>(5)</enum><text display-inline="yes-display-inline">describing all relevant Federal rules which

				may duplicate, overlap, or conflict with the proposed rule, or the reasons why

				such a description could not be provided; and</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1339C94B05D14A42B88EE1C3F87954D7"><enum>(6)</enum><text display-inline="yes-display-inline">estimating the additional cumulative

				economic impact of the proposed rule on small entities beyond that already

				imposed on the class of small entities by the agency or why such an estimate is

				not available.</text>

							</paragraph></subsection><after-quoted-block>;

				and</after-quoted-block></quoted-block>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id685A6766EFB5433B9D727F6ABDF043DB"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>

					<quoted-block act-name="" display-inline="no-display-inline" id="idE3B0479B4FB641A59F3F0B060B4B8243" style="USC">

						<subsection commented="no" display-inline="no-display-inline" id="ID662fb572af074d9c904efc451880f1d8"><enum>(d)</enum><text display-inline="yes-display-inline">An agency shall notify the Chief Counsel

				for Advocacy of the Small Business Administration of any draft rules that may

				have a significant economic impact on a substantial number of small entities

				either—</text>

							<paragraph commented="no" display-inline="no-display-inline" id="IDad5b2bd3ce7549bdb324acc5c779c911"><enum>(1)</enum><text display-inline="yes-display-inline">when the agency submits a draft rule to the

				Office of Information and Regulatory Affairs at the Office of Management and

				Budget under Executive Order 12866, if that order requires such submission;

				or</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID14691312087545a7ba2a923aec750173"><enum>(2)</enum><text display-inline="yes-display-inline">if no submission to the Office of

				Information and Regulatory Affairs is so required, at a reasonable time prior

				to publication of the rule by the

				agency.</text>

							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDD80EFA5ED9454694B6C165CA00C41283"><enum>(b)</enum><header>Final

			 regulatory flexibility analysis</header>

				<paragraph commented="no" display-inline="no-display-inline" id="ID118D5E63018C49898C76BDFF36A026EE"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Section 604(a) of

			 title 5, United States Code, is amended—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="ID530146E4EC7747699FE588395BD9F2FC"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking

			 title 5, United States Code, is amended—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="ID038ABC3CEA8F4BBB963DBD316DB8FDDB"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting <quote>detailed</quote> before

			 <quote>statement</quote>; and</text>

				the effects of the proposed or final rule and alternatives to the proposed or

				detailed statement explaining why quantification is not practicable or

				reliable.</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="IDE33198A33A954E68AC19B1297A31E987" section-type="subsequent-section"><enum>5.</enum><header>Periodic review of

			 rules</header><text display-inline="no-display-inline">Section 610 of title 5,

			 United States Code, is amended to read as follows:</text>

			<quoted-block display-inline="no-display-inline" id="ID539F501CF98C4298BF23CB5409A99DDA" style="USC">

				<section commented="no" display-inline="no-display-inline" id="ID59C6A6A894D24DFCA1B824BC95576281" section-type="subsequent-section"><enum>610.</enum><header>Periodic review of

				rules</header>

					<subsection commented="no" display-inline="no-display-inline" id="ID58893C10DF1D405DA4A072069A55DD51"><enum>(a)</enum><text display-inline="yes-display-inline">Not later than 180 days after the enactment

				of the <short-title>Regulatory Flexibility Reform Act of

				2005</short-title>, each agency shall publish in the Federal Register and place

				on its Web site a plan for the periodic review of rules issued by the agency

				that the head of the agency determines has a significant economic impact on a

				substantial number of small entities. Such determination shall be made without

				regard to whether the agency performed an analysis under section 604. The

				purpose of the review shall be to determine whether such rules should be

				continued without change, or should be amended or rescinded, consistent with

				the stated objectives of applicable statutes, to minimize any significant

				adverse economic impacts on a substantial number of small entities. Such plan

				may be amended by the agency at any time by publishing the revision in the

				Federal Register and subsequently placing the amended plan on the agency’s Web

				site.</text>

					</subsection><subsection commented="no" display-inline="no-display-inline" id="IDD1ED39FBAA11445695562B64400D5DD7"><enum>(b)</enum><text display-inline="yes-display-inline">The plan shall provide for the review of

				all such agency rules existing on the date of the enactment of the

				<short-title>Regulatory Flexibility Reform Act of

				2005</short-title> within 10 years after the date of publication of the plan in

				the Federal Register and every 10 years thereafter and for review of rules

				adopted after the date of enactment of the <short-title>Regulatory Flexibility Reform Act of 2005</short-title>

				within 10 years after the publication of the final rule in the Federal Register

				and every 10 years thereafter. If the head of the agency determines that

				completion of the review of existing rules is not feasible by the established

				date, the head of the agency shall so certify in a statement published in the

				Federal Register and may extend the review for not longer than 2 years after

				publication of notice of extension in the Federal Register. Such certification

				and notice shall be sent to the Chief Counsel for Advocacy and Congress.</text>

					</subsection><subsection commented="no" display-inline="no-display-inline" id="IDBCD48CECF73949408CD2FCCE19BB86EA"><enum>(c)</enum><text display-inline="yes-display-inline">Each agency shall annually submit a report

				regarding the results of its review pursuant to such plan to Congress and, in

				the case of agencies other than independent regulatory agencies (as defined in

				section 3502(5) of title 44, United States Code), to the Administrator of the

				Office of Information and Regulatory Affairs of the Office of Management and

				Budget. Such report shall include the identification of any rule with respect

				to which the head of the agency made a determination of infeasibility under

				paragraph (5) or (6) of subsection (d) and a detailed explanation of the

				reasons for such determination.</text>

					</subsection><subsection commented="no" display-inline="no-display-inline" id="ID80C46B8836574D47AFE6C18605C55E20"><enum>(d)</enum><text display-inline="yes-display-inline">In reviewing rules under such plan, the

				agency shall consider—</text>

						<paragraph commented="no" display-inline="no-display-inline" id="IDD2CB7945D29F40899F70BFC1AF4601D0"><enum>(1)</enum><text display-inline="yes-display-inline">the continued need for the rule;</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDA9F54D12B96045DF86123D147A7A931C"><enum>(2)</enum><text display-inline="yes-display-inline">the nature of complaints received by the

				agency from small entities concerning the rule;</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9DCDBC311AB34A53AF29A6B6BBBDF2BF"><enum>(3)</enum><text display-inline="yes-display-inline">comments by the Regulatory Enforcement

				Ombudsman and the Chief Counsel for Advocacy;</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID12B4D79D8DFF463F8C229DF94C599D98"><enum>(4)</enum><text display-inline="yes-display-inline">the complexity of the rule;</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID64435984C89246118347E92A4A5418D1"><enum>(5)</enum><text display-inline="yes-display-inline">the extent to which the rule overlaps,

				duplicates, or conflicts with other Federal rules and, unless the head of the

				agency determines it to be infeasible, State and local rules;</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID408F699E08224D8FABDE9ECC22CC6CDC"><enum>(6)</enum><text display-inline="yes-display-inline">the contribution of the rule to the

				cumulative economic impact of all Federal rules on the class of small entities

				affected by the rule, unless the head of the agency determines that such

				calculations cannot be made and reports that determination in the annual report

				required under subsection (c);</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8851A4BF64FB491AA2A4DB0756D94313"><enum>(7)</enum><text display-inline="yes-display-inline">the length of time since the rule has been

				evaluated or the degree to which technology, economic conditions, or other

				factors have changed in the area affected by the rule; and</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0012271469944aa8b86c4076ba41f6ff"><enum>(8)</enum><text display-inline="yes-display-inline">the current impact of the rule,

				including—</text>

							<subparagraph commented="no" display-inline="no-display-inline" id="id786D41AE04DF444A92331D8850244B52"><enum>(A)</enum><text display-inline="yes-display-inline">the number of small entities to which the

				rule will apply; and</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id75E2264827BD47E3B7A008A05A7EB568"><enum>(B)</enum><text display-inline="yes-display-inline">the projected reporting, recordkeeping and

				other compliance requirements of the proposed rule, including—</text>

								<clause commented="no" display-inline="no-display-inline" id="id138F6C2BDCE3482FBC957E51E82E5929"><enum>(i)</enum><text display-inline="yes-display-inline">an estimate of the classes of small

				entities that will be subject to the requirement; and</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="id3EF545CBEAEA42B5884B0C71BC184141"><enum>(ii)</enum><text display-inline="yes-display-inline">the type of professional skills necessary

				for preparation of the report or record.</text>

								</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID5283DCB25DB142339AED738F062FBE42"><enum>(e)</enum><text display-inline="yes-display-inline">The agency shall publish in the Federal

				Register and on its Web site a list of rules to be reviewed pursuant to such

				plan. Such publication shall include a brief description of the rule, the

				reason why the agency determined that it has a significant economic impact on a

				substantial number of small entities (without regard to whether it had prepared

				a final regulatory flexibility analysis for the rule), and request comments

				from the public, the Chief Counsel for Advocacy, and the Regulatory Enforcement

				Ombudsman concerning the enforcement of the

				rule.</text>
