			<header>Short title</header>

			<text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Small Business Federal Contractor

			 Safeguard Act of 2005</short-title></quote>.</text>

			<enum>2.</enum>

			<header>Contract consolidation</header>

				<enum>(a)</enum>

				<header>Definitions</header>

				<text><external-xref legal-doc="act" parsable-cite="SBA/3(o)">Section

			 3(o)</external-xref> of the <act-name parsable-cite="SBA">Small Business

			 Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/632(o)">15

			 U.S.C. 632(o)</external-xref>) is amended to read as follows:</text>

				<quoted-block act-name="Small Business Act" id="ID0BE62AEE74C441E7BAFFD3F5EAACC93A">

					<subsection id="ID61E74A606FDF4B9AA65E7821C8E4DC01">

						<enum>(o)</enum>

						<header>Definitions relating to consolidation of contract

				requirements</header>

						<text>For purposes of this Act—</text>

						<paragraph id="IDCAC9E1E9E534407EB60F3122131303E2">

							<enum>(1)</enum>

							<text>the terms <term>consolidation of contract requirements</term>

				and <term>consolidation</term>, with respect to contract requirements of a

				military department, Defense Agency, Department of Defense Field Activity, or

				any other Federal department or agency having contracting authority mean a use

				of a solicitation to obtain offers for a single contract or a multiple award

				contract to satisfy 2 or more requirements of that department, agency, or

				activity for goods or services that—</text>

							<subparagraph id="IDC19721169DA943E28D2A96FAE5CB4AD1">

								<enum>(A)</enum>

								<text>have previously been provided to or performed for that

				department, agency, or activity under 2 or more separate contracts that are

				smaller in cost than the total cost of the contract for which the offers are

				solicited; or</text>

							</subparagraph><subparagraph id="IDD9139A731030492E85CAFF5F3ED3E90A">

								<enum>(B)</enum>

								<text>are of a type capable of being provided or performed by a small

				business concern for that department, agency, or activity under 2 or more

				separate contracts that are smaller in cost than the total cost of the contract

				for which the offers are solicited;</text>

							</subparagraph></paragraph><paragraph id="ID8C59F89FE53A4C87917BA2280D2C37D6">

							<enum>(2)</enum>

							<text>the term <term>multiple award contract</term> means—</text>

							<subparagraph id="IDFF1EB43663AD4B38BFE827CF4DB6AE82">

								<enum>(A)</enum>

								<text>a contract that is entered into by the Administrator of General

				Services under the multiple award schedule program referred to in section

				2302(2)(C) of title 10, United States Code;</text>

							</subparagraph><subparagraph id="IDCFE0990F5F304A11B7EE6AC6545104CD">

								<enum>(B)</enum>

								<text>a multiple award task order contract or delivery order contract

				that is entered into under the authority of sections 2304a through 2304d of

				title 10, United States Code, or sections 303H through 303K of the

				<act-name parsable-cite="FPASA">Federal Property and Administrative Services

				Act of 1949</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/41/253h">41 U.S.C. 253h</external-xref> through 253k);

				and</text>

							</subparagraph><subparagraph id="ID8EE30FE3E36C4DE1825AE79818EAABF4">

								<enum>(C)</enum>

								<text>any other indeterminate delivery, indeterminate quantity

				contract that is entered into by the head of a Federal agency with 2 or more

				sources pursuant to the same solicitation; and</text>

							</subparagraph></paragraph><paragraph id="ID830702309A674375B148BD362E970279">

							<enum>(3)</enum>

							<text>the term <term>senior procurement executive</term>

				means—</text>

							<subparagraph id="IDAA1FCFE5D3B34A9BA4F46CCDB695A349">

								<enum>(A)</enum>

								<text>with respect to a military department, the official designated

				under section 16(3) of the Office of Federal Procurement Policy Act

				(<external-xref legal-doc="usc" parsable-cite="usc/41/414(3)">41 U.S.C.

				414(3)</external-xref>) as the senior procurement executive for the military

				department;</text>

							</subparagraph><subparagraph id="IDDF9E01AC25C14846963374E984133199">

								<enum>(B)</enum>

								<text>with respect to a Defense Agency or a Department of Defense

				Field Activity, the official so designated for the Department of Defense;

				and</text>

							</subparagraph><subparagraph id="ID91FFFE7F466E47B4A6D69EBAAC91CE92">

								<enum>(C)</enum>

								<text>with respect to a Federal department or agency other than those

				referred to in subparagraphs (A) and (B), the official so designated by that

				department or agency.</text>

							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

				<enum>(b)</enum>

				<header>Procurement strategies</header>

				<text><external-xref legal-doc="act" parsable-cite="SBA/15(e)">Section

			 15(e)</external-xref> of the <act-name parsable-cite="SBA">Small Business

			 Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/644(e)">15

			 U.S.C. 644(e)</external-xref>) is amended—</text>

							<header>Limitation on use of acquisition strategies involving

				consolidation</header>

							<subparagraph id="ID58A7DC56A8C241A290A6727E7BE009E3">

								<enum>(A)</enum>

								<header>Certain defense contract requirements</header>

								<text>An official of a military department, defense agency, or

				Department of Defense Field Activity shall not execute an acquisition strategy

				that includes a consolidation of contract requirements of the military

				department, agency, or activity with a total value in excess of $5,000,000,

				unless the senior procurement executive first—</text>

								<clause id="IDA8193307BA2C4EBB81008114B469F885">

									<enum>(i)</enum>

									<text>conducts market research;</text>

								</clause><clause id="IDF79501AAF1724A7C86C23596C7440EDE">

									<enum>(ii)</enum>

									<text>identifies any alternative contracting approaches that would

				involve a lesser degree of consolidation of contract requirements; and</text>

								</clause><clause id="ID5A8AF8463AD043B18F907493600E31A7">

									<enum>(iii)</enum>

									<text>determines that the consolidation is necessary and

				justified.</text>

								</clause></subparagraph><subparagraph id="IDB5DC10B91A104100AA311FB33BE7A3F8">

								<enum>(B)</enum>

								<header>Certain civilian agency contract requirements</header>

								<text>The head of a Federal agency not described in subparagraph (A)

				that has contracting authority shall not execute an acquisition strategy that

				includes a consolidation of contract requirements of the agency with a total

				value in excess of $2,000,000, unless the senior procurement executive of the

				agency first—</text>

								<clause id="ID77B8A3AD7E2E4F5D92AE29C17E37F8AF">

									<enum>(i)</enum>

									<text>conducts market research;</text>

								</clause><clause id="IDF4F9A7D618644BF3AA826CADE53945DF">

									<enum>(ii)</enum>

									<text>identifies any alternative contracting approaches that would

				involve a lesser degree of consolidation of contract requirements; and</text>

								</clause><clause id="ID75B2F3524F1F4C169824C541C7D1D2DD">

									<enum>(iii)</enum>

									<text>determines that the consolidation is necessary and

				justified.</text>

								</clause></subparagraph><subparagraph id="IDD2ACE65F474F4E2DB49E5EA8F44C7703">

								<enum>(C)</enum>

								<header>Additional requirements for higher value consolidated

				contracts</header>

								<text>In addition to meeting the requirements under subparagraph (A)

				or (B), a procurement strategy by a civilian agency that includes a

				consolidated contract valued at more than $5,000,000, or by a defense agency

				that includes a consolidated contract valued at more than $7,000,000 shall

				include—</text>

								<clause id="ID17739E426F8847F8AB7EBAC8BECA4003">

									<enum>(i)</enum>

									<text>an assessment of the specific impediments to participation by

				small business concerns as prime contractors that will result from the

				consolidation;</text>

								</clause><clause id="ID058EBC536A434873853F925A69DE71B6">

									<enum>(ii)</enum>

									<text>the identification of the alternative strategies that would

				reduce or minimize the scope of the consolidation and the rationale for not

				choosing those alternatives;</text>

								</clause><clause id="IDB47B8B83BEA14DE985D7D5BA9067C527">

									<enum>(iii)</enum>

									<text>actions designed to maximize small business participation as

				prime contractors, including provisions that encourage small business teaming

				for the consolidated requirement; and</text>

								</clause><clause id="ID1F87F0FC17F24A0393D52D890B2F9CCB">

									<enum>(iv)</enum>

									<text>actions designed to maximize small business participation as

				subcontractors (including suppliers) at any tier under the contract or

				contracts that may be awarded to meet the requirements.</text>

								</clause></subparagraph><subparagraph id="ID4CBA7F83E87044E1975590135B7153A2">

								<enum>(D)</enum>

								<header>Necessary and justified</header>

								<text>A senior procurement executive may determine that an

				acquisition strategy involving a consolidation of contract requirements is

				necessary and justified for purposes of subparagraph (A), (B), or (C), if the

				benefits of the acquisition strategy substantially exceed the benefits of each

				of the possible alternative contracting approaches identified under clause (ii)

				of any of those subparagraphs, as applicable. Savings in administrative or

				personnel costs alone shall not constitute, for such purpose, a sufficient

				justification for a consolidation of contract requirements in a procurement,

				unless the total amount of the cost savings is expected to be substantial in

				relation to the total cost of the procurement.</text>

							</subparagraph><subparagraph id="IDD231D16BD2B14D5A80BA85E0786CAFEF">

								<enum>(E)</enum>

								<header>Benefits</header>

								<text>Benefits considered for purposes of this paragraph may include

				cost and, regardless of whether quantifiable in dollar amounts—</text>

								<clause id="IDEC9D281B9108445783D0535D66ADB5B5">

									<enum>(i)</enum>

									<text>quality;</text>

								</clause><clause id="ID6169E5DDCBA54378969211C7485BFCBA">

									<enum>(ii)</enum>

									<text>acquisition cycle;</text>

								</clause><clause id="IDFDAC77154515464E81A3D84B2C00AAB6">

									<enum>(iii)</enum>

									<text>terms and conditions; and</text>

								</clause><clause id="ID766B97159A7243EAB09F1042B90F096E">

									<enum>(iv)</enum>

									<text>any other benefit directly related to national security or

				homeland defense.</text>

								</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

				<enum>(c)</enum>

				<header>Additional to technical advisers</header>

				<text><external-xref legal-doc="act" parsable-cite="SBA/15(k)">Section

			<header>Agency accountability</header>

			<subsection id="ID9C13013362BD4AD3B5F591F6B96FA943">

				<enum>(a)</enum>

				<header>In general</header>

				<text>Each procurement employee—</text>

				<paragraph id="IDC07861F8ABCC4A0F80E1D4602491F5EB">

					<enum>(1)</enum>

					<text>shall communicate to their subordinates the importance of

			 achieving small business goals; and</text>

				</paragraph><paragraph id="ID4D73686D63684CB9BCF7389CA8143D1B">

					<enum>(2)</enum>

					<text>shall have as an annual performance evaluation factor, if

			 appropriate, the success of that procurement employee in small business

			 utilization, in accordance with the goals established under this

			 section.</text>

				</paragraph></subsection><subsection id="ID2229FE5462FF4D5D9F15A48173200708">

				<enum>(b)</enum>

				<header>Definition</header>

				<text>As used in this section, the term <term>procurement

			 employee</term> means a senior procurement executive, senior program manager,

			 or small and disadvantaged business utilization manager of a Federal agency

			 having contracting authority.</text>

			<enum>4.</enum>

			<header>Small business participation in prime contracting</header>

				<enum>(a)</enum>

				<header>Reserved contracts</header>

			 15(j)</external-xref> of the <act-name parsable-cite="SBA">Small Business

			 Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/644(j)">15

			 U.S.C. 644(j)</external-xref>) is amended by adding at the end the

			 following:</text>

				<header>Participation in multiple award contracts</header>

			 Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/644(j)">15

							<header>Payments pending reports</header>

							<text>Each Federal agency having contracting authority shall ensure

				that the terms of each contract for goods and services includes a provision

				allowing the contracting officer of an agency to withhold an appropriate amount

				of payment with respect to a contract (depending on the size of the contract)

				until the date of receipt of complete, accurate, and timely subcontracting

				reports in accordance with paragraph (11).</text>
