			 Preservation Act amendments</header>

			<subsection commented="no" display-inline="no-display-inline" id="IDF2BF55D2BE1E40C0B9A5D63BEC8EF3C9"><enum>(a)</enum><header>Short

			 title</header><text display-inline="yes-display-inline">This Act may be cited

			 as the <quote><short-title>National Historic Preservation

			 Act Amendments Act of 2005</short-title></quote>.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID0C0D702B7D5F4D5BBFE4F21C54DDD56B"><enum>(b)</enum><header>Reference</header><text display-inline="yes-display-inline">A reference in this Act to <quote>the

			 Act</quote> shall be a reference to the National Historic Preservation

			 Act.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="idBDC31804F71B48E78060A886382582C1"><enum>(c)</enum><header>Historic

			 Preservation Fund</header><text display-inline="yes-display-inline">Section 108

			 of the Act (16 U.S.C. 470h) is amended by striking <quote>2005</quote> and

			 inserting <quote>2011</quote>.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID0C86F4B3DA274CED8D561E4270244C06"><enum>(d)</enum><header>Membership of

			 Advisory Council on Historic Preservation</header>

				<paragraph commented="no" display-inline="no-display-inline" id="ID3C190259A7A24125867A023DE3E67150"><enum>(1)</enum><header>Additional

			 members</header><text display-inline="yes-display-inline">Section 201(a)(4) of

			 the Act (16 U.S.C. 470i(a)(4)) is amended by striking <quote>four</quote> and

			 inserting <quote>seven</quote>.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3007CAFB89EA4565A4041C39698783EE"><enum>(2)</enum><header>Allowing

			 designee for governor member</header><text display-inline="yes-display-inline">Section 201(b) of the Act (16 U.S.C.

			 470i(b)) is amended by striking <quote>(5) and</quote>.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE745279213EB474EA46B5ACB187BA5EA"><enum>(3)</enum><header>Quorum</header><text display-inline="yes-display-inline">Section 201(f) of the Act (16 U.S.C.

			 470i(f)) is amended by striking <quote>Nine</quote> and inserting

			 <quote>Eleven</quote>.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID656178DC1B6C44C9A445FCB393C7BE2A"><enum>(e)</enum><header>Financial and

			 administrative services for the Advisory Council on Historic

			 Preservation</header><text display-inline="yes-display-inline">Section 205(f)

			 of the Act (16 U.S.C. 470m(f)) is amended to read as follows:</text>

				<quoted-block display-inline="no-display-inline" id="ID4E2D9F51FB1A495C8226D10663442726" style="OLC">

					<subsection commented="no" display-inline="no-display-inline" id="ID991AC2DF0964408289748B18DF9B1DAB"><enum>(f)</enum><text display-inline="yes-display-inline">Financial and administrative services

				(including those related to budgeting, accounting, financial reporting,

				personnel and procurement) shall be provided the Council by the Department of

				the Interior or, at the discretion of the Council, such other agency or private

				entity that reaches an agreement with the Council, for which payments shall be

				made in advance or by reimbursement from funds of the Council in such amounts

				as may be agreed upon by the Chairman of the Council and the head of the agency

				or, in the case of a private entity, the authorized representative of the

				private entity that will provide the services. When a Federal agency affords

				such services, the regulations of that agency for the collection of

				indebtedness of personnel resulting from erroneous payments (5 U.S.C. 5514(b))

				shall apply to the collection of erroneous payments made to or on behalf of a

				Council employee and regulations of that agency for the administrative control

				of funds (31 U.S.C. 1513(d), 1514) shall apply to appropriations of the

				Council. The Council shall not be required to prescribe such

				regulations.</text>

					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDFD21FDA8962844B28B816457130BFF86"><enum>(f)</enum><header>Donation

			 authority of the Advisory Council on Historic Preservation</header><text display-inline="yes-display-inline">Section 205(g) of the Act (16 U.S.C.

			 470m(g)) is amended—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="ID3CA592E1099A47BAB8CF46F51AA59772"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>obtain,</quote> and

			 inserting <quote>solicit and obtain,</quote>; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4354A201C15B4E61A7BB403A65D1DE88"><enum>(2)</enum><text display-inline="yes-display-inline">by striking <quote>may also receive</quote>

			 and inserting <quote>may also solicit and receive</quote>.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID1A8A298F48DB498698C624EB9BA8ED02"><enum>(g)</enum><header>Appropriation

			 authorization of the Advisory Council on Historic Preservation</header><text display-inline="yes-display-inline">Section 212(a) of the Act (16 U.S.C.

			 470t(a)) is amended by striking <quote>for purposes of this title not to exceed

			 $4,000,000 for each fiscal year 1997 through 2005</quote> and inserting

			 <quote>such amounts as may be necessary to carry out this title</quote>.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID5EFF8F4F2D2345D3B9FE9804DFCAE9B0"><enum>(h)</enum><header>Effectiveness

			 of Federal grant and assistance programs in meeting the purposes and policies

			 of the National Historic Preservation Act</header><text display-inline="yes-display-inline">Title II of the Act is amended by adding at

			 the end the following new section:</text>

				<quoted-block display-inline="no-display-inline" id="ID00874355A42B426D9A80E3E61F3BA231" style="OLC">

					<section commented="no" display-inline="no-display-inline" id="id7AFCAF6628404F7E9228FBD448272DCF" section-type="subsequent-section"><enum>216.</enum><header>Effectiveness of

				Federal grant and assistance programs</header>

						<subsection commented="no" display-inline="no-display-inline" id="id9D6B557961014E8489D75074B8CC91E5"><enum>(a)</enum><header>Cooperative

				agreements</header><text display-inline="yes-display-inline">The Council may

				enter into a cooperative agreement with any Federal agency that administers a

				grant or assistance program for the purpose of improving the effectiveness of

				the administration of such program in meeting the purposes and policies of this

				Act. Such cooperative agreements may include provisions that modify the

				selection criteria for a grant or assistance program to further the purposes of

				this Act or that allow the Council to participate in the selection of

				recipients, if such provisions are not inconsistent with the grant or

				assistance program's statutory authorization and purpose.</text>

						</subsection><subsection commented="no" display-inline="no-display-inline" id="idE73B567014904770B3DE19F29105ADBA"><enum>(b)</enum><header>Review of grant

				and assistance programs</header><text display-inline="yes-display-inline">The

				Council may—</text>

							<paragraph commented="no" display-inline="no-display-inline" id="id1F0B48A992A748C3BA75B9AD9D6DD17A"><enum>(1)</enum><text display-inline="yes-display-inline">review the operation of any Federal grant

				or assistance program to evaluate the effectiveness of such program in meeting

				the purposes and policies of this Act;</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id40C66FE6AA33418B849A0348E0F862E4"><enum>(2)</enum><text display-inline="yes-display-inline">make recommendations to the head of any

				Federal agency that administers such program to further the consistency of the

				program with the purposes and policies of the Act and to improve its

				effectiveness in carrying out those purposes and policies; and</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA5C2CBB79D3D4AD484F5AC8C2A24A9F3"><enum>(3)</enum><text display-inline="yes-display-inline">make recommendations to the President and

				Congress regarding the effectiveness of Federal grant and assistance programs

				in meeting the purposes and policies of this Act, including recommendations

				with regard to appropriate funding

				levels.</text>

							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
