		<section commented="no" display-inline="no-display-inline" id="id11F417CED81B4B9CB0805BC43B78E190" section-type="section-one"><enum>1.</enum><header>Border preparedness on Indian

			 land</header><text display-inline="no-display-inline">Subtitle D of title IV of

			 the Homeland Security Act of 2002 (6 U.S.C. 251 et seq.) is amended by adding

			 at the end the following:</text>

				<section commented="no" display-inline="no-display-inline" id="ID85230333CAD1456A9E3696C86E8BE1A5" section-type="subsequent-section"><enum>447.</enum><header>Border preparedness

				pilot program on Indian land</header>

					<subsection commented="no" display-inline="no-display-inline" id="ID7CD7B1E2C9E34F89A928BBF29FBAA43A"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>

						<paragraph commented="no" display-inline="no-display-inline" id="ID1C060507BA314928BF3745064C3D8914"><enum>(1)</enum><header>Indian

				land</header><text display-inline="yes-display-inline">The term <term>Indian

				land</term> means—</text>

							<subparagraph commented="no" display-inline="no-display-inline" id="ID80EF7285D3354F75B57608EAA9ADFA4D"><enum>(A)</enum><text display-inline="yes-display-inline">all land within the boundaries of any

				Indian reservation; and</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDF00AFFD4B02246EF91ADB9C173AC740F"><enum>(B)</enum><text display-inline="yes-display-inline">any land the title to which is—</text>

								<clause commented="no" display-inline="no-display-inline" id="IDCBD8D4F1E8BF44DDA768745AECC30B06"><enum>(i)</enum><text display-inline="yes-display-inline">held in trust by the United States for the

				benefit of an Indian tribe or individual; or</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="ID1BC9382EFC0D44358462A59780A4A02C"><enum>(ii)</enum><text display-inline="yes-display-inline">held by any Indian tribe or

				individual—</text>

									<subclause commented="no" display-inline="no-display-inline" id="ID0CEAA59F3A054F6DB732DDC06EB027F7"><enum>(I)</enum><text display-inline="yes-display-inline">subject to a restriction by the United

				States against alienation; and</text>

									</subclause><subclause commented="no" display-inline="no-display-inline" id="IDEE400480067A487F9E66A373D008ECE3"><enum>(II)</enum><text display-inline="yes-display-inline">over which an Indian tribe exercises

				governmental authority.</text>

									</subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDBADD3E43613248FCADA0921998A106D8"><enum>(2)</enum><header>Indian

				Tribe</header><text display-inline="yes-display-inline">The term <term>Indian

				tribe</term> means any Indian tribe, band, nation, or other organized group or

				community that is recognized by the Secretary as—</text>

							<subparagraph commented="no" display-inline="no-display-inline" id="ID02712B911EAB4912AAEFFDC4529CEAA6"><enum>(A)</enum><text display-inline="yes-display-inline">eligible for the special programs and

				services provided by the United States to Indians because of their status as

				Indians; and</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDFE36A4F46CC2458E91A6C5EFC8122C1B"><enum>(B)</enum><text display-inline="yes-display-inline">possessing powers of

				self-government.</text>

							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID774FD8AFC5654085BA61755AAEAF3C84"><enum>(3)</enum><header>Tribal

				Government</header><text display-inline="yes-display-inline">The term

				<term>tribal government</term> means the governing body of an Indian

				tribe.</text>

						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID5CD931FBED844D8EA08612B177AF33A0"><enum>(b)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purpose of this section is to require

				the Secretary, acting through the Office of Domestic Preparedness, to establish

				a pilot program for not fewer than 6 tribal governments on Indian land located

				on or near the border of the United States with Canada or Mexico in order

				to—</text>

						<paragraph commented="no" display-inline="no-display-inline" id="IDF10DB623C1894F34A1975B6CECD794E3"><enum>(1)</enum><text display-inline="yes-display-inline">facilitate the coordination of the response

				of an Indian tribe to a threat to the security of an international border of

				the United States with the responses of Federal, State, and local

				governments;</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDB28E1AA4501E49DCAEE3F8C396E03332"><enum>(2)</enum><text display-inline="yes-display-inline">enhance the capability of an Indian tribe

				as a first responder to an illegal crossing of an immigrant over an

				international border of the United States;</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4479A69FF2AA48E9921D183F34EC870A"><enum>(3)</enum><text display-inline="yes-display-inline">provide training and technical assistance

				to Indian tribes in the use by the tribes of effective surveillance

				technologies, integrated communication systems and equipment, and personnel

				training; and</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD35BB932EFD84E42A1212A3372DB744B"><enum>(4)</enum><text display-inline="yes-display-inline">provide technical advice and assistance to

				Indian tribes to plan and implement strategies to detect and prevent—</text>

							<subparagraph commented="no" display-inline="no-display-inline" id="id9874188DE4704DAA899FB7887E0B7CA0"><enum>(A)</enum><text display-inline="yes-display-inline">any illegal entry by a person into the land

				of the tribes; and</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idFF9148D32B62413C9B30DDB09EE2BF06"><enum>(B)</enum><text display-inline="yes-display-inline">the transportation of any illegal substance

				within or near the boundaries of the land of the tribes.</text>

							</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDA715410CFE7D44D7878AC918DE4823A7"><enum>(c)</enum><header>Pilot

				program</header>

						<paragraph commented="no" display-inline="no-display-inline" id="IDBCC23BA4D7394C50A158D0B9657F6131"><enum>(1)</enum><header>In

				general</header><text display-inline="yes-display-inline">Not later than 180

				days after the date of enactment of this section, the Secretary, acting through

				the Office of Domestic Preparedness, shall establish a pilot program under

				which the Secretary provides direct grants to eligible tribal governments, as

				determined by the Secretary, to achieve the purposes of this section.</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDF770AB2A94D64A2A83E18913A256F398"><enum>(2)</enum><header>Use of funds

				and assistance</header>

							<subparagraph commented="no" display-inline="no-display-inline" id="IDE728E7DE6DC9496AA0101D7060F99B66"><enum>(A)</enum><header>In

				general</header><text display-inline="yes-display-inline">A tribal government

				shall use any funds or assistance provided under paragraph (1) consistent with

				the purposes of this section.</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID5170D9F8676543B28D347429B04591B5"><enum>(B)</enum><header>Administration

				by tribal governments</header><text display-inline="yes-display-inline">A

				tribal government that receives any funds or assistance under paragraph (1)

				shall administer the funds or assistance in accordance with any requirement or

				regulation promulgated by the Secretary.</text>

							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID36AB54E36DEF43D09454C0C7F2A17C37"><enum>(3)</enum><header>Selection

				criteria</header><text display-inline="yes-display-inline">In selecting a

				tribal government to receive funds or assistance under paragraph (1), the

				Secretary may take into consideration—</text>

							<subparagraph commented="no" display-inline="no-display-inline" id="ID5525F07957A64D7983E98BFF7F427387"><enum>(A)</enum><text display-inline="yes-display-inline">the distance between the Indian land in the

				jurisdiction of the tribal government and an international border of the United

				States;</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE88DA23CB9BE40A58147B5EF4A812CFE"><enum>(B)</enum><text display-inline="yes-display-inline">the extent to which the resources of the

				Indian tribe are affected by—</text>

								<clause commented="no" display-inline="no-display-inline" id="idA90EB87CFBAC44499CE18F2FEF26DDAE"><enum>(i)</enum><text display-inline="yes-display-inline">a border enforcement effort; or</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="idF6E87549DF4B484C8F1209B4B047CBE8"><enum>(ii)</enum><text display-inline="yes-display-inline">the threat of illegal immigration;

				and</text>

								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID491A6266EB654819BB603EEA89A8DF15"><enum>(C)</enum><text display-inline="yes-display-inline">the interests of the Indian tribe.</text>

							</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDFC1D5BE77C7D4D649959340F89F905EA"><enum>(d)</enum><header>Reports</header>

						<paragraph commented="no" display-inline="no-display-inline" id="ID78A9D7649AF843BDA9102108905D2715"><enum>(1)</enum><header>Tribal

				governments</header>

							<subparagraph commented="no" display-inline="no-display-inline" id="ID70E535F7417647579A56C55BFAF56DE6"><enum>(A)</enum><header>In

				general</header><text display-inline="yes-display-inline">Not later than 1 year

				after receiving funds or assistance under subsection (c) and annually

				thereafter, a tribal government shall submit to the Secretary a report in such

				a manner and containing such information as the Secretary may require.</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID2E7E65F59C3D49B788B3130F6846A657"><enum>(B)</enum><header>Inclusion</header><text display-inline="yes-display-inline">A report under subparagraph (A) shall

				include a description of—</text>

								<clause commented="no" display-inline="no-display-inline" id="ID6CEC1D2E485D4F4AA2DAE4D187FCC073"><enum>(i)</enum><text display-inline="yes-display-inline">any funds or assistance received by the

				tribal government under this section;</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="ID421514C2DF4A4369AD2F84C9D74F2E1D"><enum>(ii)</enum><text display-inline="yes-display-inline">the use of the funds or assistance by the

				tribal government;</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="ID3DF8005752334640AAA3F76499BF6CC7"><enum>(iii)</enum><text display-inline="yes-display-inline">any obstacle encountered by the tribal

				government in administering the funds or assistance; and</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="id53D274E435C84E12B96335DC4D1794D7"><enum>(iv)</enum><text display-inline="yes-display-inline">any accomplishment made or obstacle

				encountered by the tribal government in developing a cooperative effort with

				another Indian tribe, the Federal Government, or a State or local government,

				and the effect of the accomplishment or obstacle on the tribe.</text>

								</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3CE9468537064CB39CDA52CF519E1E35"><enum>(2)</enum><header>Secretary</header><text display-inline="yes-display-inline">Not later than 2 years after the date of

				enactment of this Act, the Secretary shall submit to Congress a report

				describing—</text>

							<subparagraph commented="no" display-inline="no-display-inline" id="IDFAEBDF87E565463BAD703FFE1DF8B549"><enum>(A)</enum><text display-inline="yes-display-inline">the information contained in the reports

				under paragraph (1);</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id509721D58B9A49C48FDF7EAD489B41AC"><enum>(B)</enum><text display-inline="yes-display-inline">the degree of success of—</text>

								<clause commented="no" display-inline="no-display-inline" id="id4C73A3510C5248C6B32EAFA68819A2C6"><enum>(i)</enum><text display-inline="yes-display-inline">the Secretary in implementing the pilot

				program; and</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="id99F638F00BE54C98A2EC8F1D6A1E93BA"><enum>(ii)</enum><text display-inline="yes-display-inline">each project under the pilot program under

				subsection (c) in achieving the goals of the pilot program; and</text>

								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDAB973ACF6C8D40D3846628AD08C17260"><enum>(C)</enum><text display-inline="yes-display-inline">any recommendation, including a legislative

				recommendation, of the Secretary relating to the pilot program.</text>

							</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idBD1B1F82F3564307A04711A73149150B"><enum>(e)</enum><header>Effect of

				section</header><text display-inline="yes-display-inline">Nothing in this

				section affects—</text>

						<paragraph commented="no" display-inline="no-display-inline" id="id0EB3753AFFDB4D79A2646A80EDA14F16"><enum>(1)</enum><text display-inline="yes-display-inline">the authority of the Commissioner of the

				Bureau of Customs and Border Protection; or</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF28FBFD57C7B43D5A2736400AB4C6E96"><enum>(2)</enum><text display-inline="yes-display-inline">any authority of an Indian tribe, tribal

				organization, or tribal government participating in a program under this

				section.</text>

						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idD7166D06BC3743A3A4FFAC2D76D9190A"><enum>(f)</enum><header>Effect of fund

				allocation</header><text display-inline="yes-display-inline">Any funds

				allocated under this section shall be in addition to, and not in lieu of, any

				funds available to an Indian tribe, tribal organization, or tribal government

				under this Act.</text>

					</subsection><subsection commented="no" display-inline="no-display-inline" id="id159CD377C87E44E9BB7603E529DB020A"><enum>(g)</enum><header>Authorization

				of appropriations</header><text display-inline="yes-display-inline">There is

				authorized to be appropriated to carry out this section $3,500,000 for each of

				fiscal years 2006 through

				2008.</text>
