			<header>Yosemite National Park authorized payments</header>

				<enum>101.</enum>

				<header>Payments for educational services</header>

				<subsection id="IDF8E25C0980DA4930BEC50D08AACEBF03">

					<enum>(a)</enum>

					<header>In general</header>

					<paragraph commented="no" display-inline="yes-display-inline" id="ID9D3D6A1CCFDE4FDEB8606350B62E672C"><enum>(1)</enum>

						<text>For fiscal years 2006 through 2009, the Secretary of the Interior

			 may provide funds to the Bass Lake Joint Union Elementary School District and

			 the Mariposa Unified School District in the State of California for educational

			 services to students—</text>

						<subparagraph id="IDF2DBDA9A72E34BD8BB3DA282EB2CB691" indent="up1">

							<enum>(A)</enum>

							<text>who are dependents of persons engaged in the administration,

			 operation, and maintenance of Yosemite National Park; or</text>

						</subparagraph><subparagraph id="IDD2848BFB29864D1F9FB4D8A20A26AF3F" indent="up1">

							<enum>(B)</enum>

							<text>who live within or near the park upon real property owned by the

			 United States.</text>

						</subparagraph></paragraph><paragraph id="ID5D7EC11D24704076A6ED686DF80E0DE8" indent="up1">

						<enum>(2)</enum>

						<text>The Secretary’s authority to make payments under this section

			 shall terminate if the State of California or local education agencies do not

			 continue to provide funding to the schools referred to in subsection (a) at per

			 student levels that are no less than the amount provided in fiscal year

			 2005.</text>

					</paragraph></subsection><subsection id="ID6E39F723080048E78594986A30481BCF">

					<enum>(b)</enum>

					<header>Limitation on use of funds</header>

					<text>Payments made under this section shall only be used to pay public

			 employees for educational services provided in accordance with subsection (a).

			 Payments may not be used for construction, construction contracts, or major

			 capital improvements.</text>

				</subsection><subsection id="IDC108FA2CA0314B90869BE93943A646EE">

					<enum>(c)</enum>

					<header>Limitation on amount of funds</header>

					<text>Payments made under this section shall not exceed the lesser

			 of—</text>

					<paragraph id="IDF4AF18C8B0934E6692CBE27E6E39FBBC">

						<enum>(1)</enum>

						<text>$400,000 in any fiscal year; or</text>

					</paragraph><paragraph id="ID3303B58F5A304C5A8D646F220E1E7383">

						<enum>(2)</enum>

						<text>the amount necessary to provide students described in subsection

			 (a) with educational services that are normally provided and generally

			 available to students who attend public schools elsewhere in the State of

			 California.</text>

					</paragraph></subsection><subsection id="IDA4E060DD1CED4990A6D81EE74AE8CFDC">

					<enum>(d)</enum>

					<header>Source of payments</header>

					<paragraph commented="no" display-inline="yes-display-inline" id="IDCE1D80982B594FE1852CE09945A43515"><enum>(1)</enum>

						<text>Except as otherwise provided in this subsection, the Secretary

			 may use funds available to the National Park Service from appropriations,

			 donations, or fees.</text>

					</paragraph><paragraph id="ID98BD410C218D42EBBF6C59D9469F0C10" indent="up1">

						<enum>(2)</enum>

						<text>Funds from the following sources shall not be used to make

			 payments under this section:</text>

						<subparagraph id="IDC599A7FC3A24435483949582CC8FEAA8">

							<enum>(A)</enum>

							<text>Any law authorizing the collection or expenditure of entrance or

			 use fees at units of the National Park System, including the

			 <act-name parsable-cite="LWCFA">Land and Water Conservation Fund Act of

			 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/16/460l-4">16 U.S.C. 460l–4</external-xref> et seq.); the

			 recreational fee demonstration program established under section 315 of the

			 Department of the Interior and Related Agencies Appropriations Act, 1996

			 (<external-xref legal-doc="usc" parsable-cite="usc/16/460l-6a note">16 U.S.C.

			 460l–6a note</external-xref>); and the National Park Passport Program

			 established under section 602 of the National Parks Omnibus Management Act of

			 1998 (<external-xref legal-doc="usc" parsable-cite="usc/16/5992">16 U.S.C.

			 5992</external-xref>).</text>

						</subparagraph><subparagraph id="ID360C553BECF545CE83C7C492FF781D5D">

							<enum>(B)</enum>

							<text>Emergency appropriations for flood recovery at Yosemite National

			 Park.</text>

						</subparagraph></paragraph><paragraph id="ID0BF08F6CAE4B40E78039C17BEAB72321" indent="up1">

						<enum>(3)</enum>

						<subparagraph commented="no" display-inline="yes-display-inline" id="ID658617C2704C4083A9821E249E5770A0"><enum>(A)</enum>

							<text>The Secretary may use an authorized funding source to make

			 payments under this section only if the funding available to Yosemite National

			 Park from such source (after subtracting any payments to the school districts

			 authorized under this section) is greater than or equal to the amount made

			 available to the park for the prior fiscal year, or in fiscal year 2005,

			 whichever is greater.</text>

						</subparagraph><subparagraph id="IDB0C1342D50C449FF97D3F20E47E898F3" indent="up1">

							<enum>(B)</enum>

							<text>It is the sense of Congress that any payments made under this

			 section should not result in a reduction of funds to Yosemite National Park

			 from any specific funding source, and that with respect to appropriated funds,

			 funding levels should reflect annual increases in the park’s operating base

			 funds that are generally made to units of the National Park System.</text>

						</subparagraph></paragraph></subsection></section><section id="ID976DA1FE0E3344438BC663EBC535AAAF">

				<enum>102.</enum>

				<header>Authorization for park facilities to be located outside the

			 boundaries of Yosemite National Park</header>

				<subsection id="IDE4F23F48645F44FE86A7887A7D035455">

					<enum>(a)</enum>

					<header>Funding authority for transportation systems and external

			 facilities</header>

					<text>Section 814(c) of the Omnibus Parks and Public Lands Management

			 Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/16/346e">16

			 U.S.C. 346e</external-xref>) is amended—</text>

					<paragraph id="ID4CAC30876A424612931A7D6999F2D2B8">

						<enum>(1)</enum>

						<text>in the heading by inserting <quote><header-in-text>and Yosemite

			 National Park</header-in-text></quote> after <quote><header-in-text>Zion

			 National Park</header-in-text></quote>;</text>

						<enum>(2)</enum>

						<text>in the first sentence—</text>

			 <quote>Zion National Park</quote>; and</text>

			 amendment for transportation fee authority</header><text>Section 501 of the

			 National Parks Omnibus Management Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/16/5981">16 U.S.C. 5981</external-xref>) is amended in the

			 first sentence by striking <quote>service contract</quote> and inserting

			 <quote>service contract, cooperative agreement, or other contractual

			 arrangement</quote>.</text>

					<enum>(a)</enum>

			 92–589</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/16/460bb-1(a)">16 U.S.C. 460bb–1(a)</external-xref>) is
