		<official-title display="yes">To provide for enhanced Federal enforcement

		  of, and State and local assistance in the enforcement of, the immigration laws

		  of the United States, and for other purposes.</official-title>

		<section commented="no" display-inline="no-display-inline" id="IDCB269BE5F18D45EDA96370C589D63544" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Homeland Security Enhancement Act of

			 2005</short-title></quote>.</text>

		</section><section commented="no" display-inline="no-display-inline" id="idC3E7820574B048CA8146588DEF3A4BAB" section-type="subsequent-section"><enum>2.</enum><header>State

			 Defined</header><text display-inline="no-display-inline">In this Act, the term

			 <quote>State</quote> has the meaning given that term in section 101(a)(36) of

			 the Immigration and Nationality Act (8 U.S.C. 1101 (a)(36)).</text>

		</section><section commented="no" display-inline="no-display-inline" id="ID271A5B0B02E7475FB2E1DC8F23A6A1FC" section-type="subsequent-section"><enum>3.</enum><header>Federal affirmation of

			 immigration law enforcement by States and political subdivisions of

			 States</header><text display-inline="no-display-inline">Notwithstanding any

			 other provision of law and reaffirming the existing inherent authority of

			 States, law enforcement personnel of a State or a political subdivision of a

			 State have the inherent authority of a sovereign entity to investigate,

			 identify, apprehend, arrest, detain, or transfer to Federal custody aliens in

			 the United States (including the transportation of such aliens across State

			 lines to detention centers), for the purpose of assisting in the enforcement of

			 the immigration laws of the United States in the normal course of carrying out

			 the law enforcement duties of such personnel. This State authority has never

			 been displaced or preempted by a Federal law.</text>

		</section><section commented="no" display-inline="no-display-inline" id="IDEB3C5C75E25549A39D05A4E390DF7E63" section-type="subsequent-section"><enum>4.</enum><header>State and local law

			 enforcement provision of information regarding aliens</header>

			<subsection commented="no" display-inline="no-display-inline" id="ID307209AE430D4D1D86D4AB97D783FB63"><enum>(a)</enum><header>Violations of

			 Federal law</header><text display-inline="yes-display-inline">A statute,

			 policy, or practice that prohibits a law enforcement officer of a State, or of

			 a political subdivision of a State, from enforcing Federal immigration laws or

			 from assisting or cooperating with Federal immigration law enforcement in the

			 course of carrying out the law enforcement duties of the officer or from

			 providing information to an official of the United States Government regarding

			 the immigration status of an individual who is believed to be illegally present

			 in the United States is in violation of section 642(a) of the Illegal

			 Immigration Reform and Immigrant Responsibility Act of 1996 (8 U.S.C. 1373(a))

			 and section 434 of the Personal Responsibility and Work Opportunity

			 Reconciliation Act of 1996 (8 U.S.C. 1644).</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="id0DCC34AAEB804F4D9A2ECDF6DD67A146"><enum>(b)</enum><header>Provision of

			 information regarding apprehended illegal aliens</header>

				<paragraph commented="no" display-inline="no-display-inline" id="idBB58881D964D4892B7CC65B48EFFE730"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">In compliance with

			 section 642(a) of the Illegal Immigration Reform and Immigrant Responsibility

			 Act of 1996 (8 U.S.C. 1373(a)) and section 434 of the Personal Responsibility

			 and Work Opportunity Reconciliation Act of 1996 (8 U.S.C. 1644), States and

			 localities should provide to the Secretary of Homeland Security the information

			 listed in subsection (c) on each alien apprehended or arrested in the

			 jurisdiction of the State or locality who is believed to be in violation of an

			 immigration law of the United States. Such information should be provided

			 regardless of the reason for the apprehension or arrest of the alien.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idECFD6FD64A984B45A803798F0E8CA04C"><enum>(2)</enum><header>Time

			 limitation</header><text display-inline="yes-display-inline">Not later than 10

			 days after an alien described in paragraph (1) is apprehended, information

			 requested to be provided under paragraph (1) should be provided in such form

			 and in such manner as the Secretary of Homeland Security may, by regulation or

			 guideline, require.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idA4E695A4FEE54716B4DE061E26EA5EBC"><enum>(c)</enum><header>Information

			 required</header><text display-inline="yes-display-inline">The information

			 listed in this subsection is as follows:</text>

				<paragraph commented="no" display-inline="no-display-inline" id="id99B932055447453CBE6CE792EEE4DF4A"><enum>(1)</enum><text display-inline="yes-display-inline">The name of the alien.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1EA575D44CBD4DE9A55FDB0C88B0F6F0"><enum>(2)</enum><text display-inline="yes-display-inline">The address or place of residence of the

			 alien.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCEC050A2BC1540A0B2AE199879A03ABE"><enum>(3)</enum><text display-inline="yes-display-inline">A physical description of the alien.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1A2C5E4A9B9540BCA68AC5251BC0F3E0"><enum>(4)</enum><text display-inline="yes-display-inline">The date, time, and location of the

			 encounter with the alien and reason for stopping, detaining, apprehending, or

			 arresting the alien.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idEB18E84A471A4A89AFE00A58B4766678"><enum>(5)</enum><text display-inline="yes-display-inline">If applicable, the driver’s license number

			 issued to the alien and the State of issuance of such license.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFC926D26EB924D89A1967D0926B70A18"><enum>(6)</enum><text display-inline="yes-display-inline">If applicable, the type of any other

			 identification document issued to the alien, any designation number contained

			 on the identification document, and the issuing entity for the identification

			 document.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8B28E616672D44B0B3E7B41BC7012376"><enum>(7)</enum><text display-inline="yes-display-inline">If applicable, the license plate number,

			 make, and model of any automobile registered to, or driven by, the

			 alien.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0DB1FDC75D644C57832EBCC6FB817DE3"><enum>(8)</enum><text display-inline="yes-display-inline">A photo of the alien, if available or

			 readily obtainable.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id13EB2233D3E7400AA2A9B3A1DB746CBA"><enum>(9)</enum><text display-inline="yes-display-inline">The fingerprints of the alien, if available

			 or readily obtainable, including a full set of 10 rolled fingerprints if

			 available or readily obtainable.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idC69D88BBB40A4637853F82EF59193480"><enum>(d)</enum><header>Reimbursement</header><text display-inline="yes-display-inline">The Secretary of Homeland Security shall

			 reimburse States and localities for all reasonable costs, as determined by the

			 Secretary of Homeland Security, incurred by that State or locality as a result

			 of providing information required by this section.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID5EE7A18552B34A0FB57576905EE01F6D"><enum>(e)</enum><header>Technical and

			 conforming amendments</header>

				<paragraph commented="no" display-inline="no-display-inline" id="idF673758D19C84587A70F235AA4265C0D"><enum>(1)</enum><header>Illegal

			 Immigration Reform and Immigrant Responsibility Act of 1996</header>

					<subparagraph commented="no" display-inline="no-display-inline" id="id17AC741D13CB45E586E90A17DF27E99D"><enum>(A)</enum><header>Technical

			 amendment</header><text display-inline="yes-display-inline">Section 642 of the

			 Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (8 U.S.C.

			 1373) is amended—</text>

			 authorized to be appropriated such sums as are necessary to provide the

			 reimbursements required by subsection (d).</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="ID876C55E353F84374A3C468E0800200CA" section-type="subsequent-section"><enum>5.</enum><header>Civil and criminal

			 penalties and forfeiture for aliens unlawfully present in the United

			 States</header>

			<subsection commented="no" display-inline="no-display-inline" id="ID28630E1DA8834D6382E1C27C744E5063"><enum>(a)</enum><header>Aliens

			 unlawfully present</header><text display-inline="yes-display-inline">Title II

			 of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name>

			 (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C.

			 1151</external-xref> et seq.) is amended by adding after section 275 the

			 following:</text>

				<quoted-block act-name="Immigration and Nationality Act" display-inline="no-display-inline" id="IDE738EC55E5C6461F9E723544E0BEBB71" style="traditional"><section commented="no" display-inline="no-display-inline" id="IDAF02B9583C324B54B1EC02028B36F1DF" section-type="subsequent-section"><enum>275A.</enum><header>Criminal penalties for unlawful presence

		  in the United States</header><subsection commented="no" display-inline="yes-display-inline" id="IDAF820DF55DBC44BEA47F23340364345C"><enum>(a)</enum><header>In

				general</header><text display-inline="yes-display-inline">In addition to any

				other violation, an alien present in the United States in violation of this Act

				shall be guilty of a misdemeanor and shall be fined under title 18, United

				States Code, imprisoned not more than 1 year, or both. The assets of any alien

				present in the United States in violation of this Act shall be subject to

				forfeiture under title 19, United States Code.</text>

						</subsection><subsection commented="no" display-inline="no-display-inline" id="IDF9390B5D7BF543D885E8C5F1B4716401"><enum>(b)</enum><header>Affirmative

				defense</header><text display-inline="yes-display-inline">It shall be an

				affirmative defense to a violation of subsection (a) that the alien overstayed

				the time allotted under the alien’s visa due to an exceptional and extremely

				unusual hardship or physical illness that prevented the alien from leaving the

				United States by the required

				date.</text>

						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID16BD74EEC8C14D57B42F010668BCC469"><enum>(b)</enum><header>Increase in

			 criminal penalties for illegal entry</header><text display-inline="yes-display-inline"><external-xref legal-doc="act" parsable-cite="INA/275(a)">Section 275(a)</external-xref> of the

			 <act-name parsable-cite="INA">Immigration and Nationality Act</act-name>

			 (<external-xref legal-doc="usc" parsable-cite="usc/8/1325(a)">8 U.S.C.

			 1325(a)</external-xref>) is amended by striking <quote>6 months,</quote> and

			 inserting <quote>1 year,</quote>.</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="ID27DAC81E7FF84FE08DE9D8EF1874B351" section-type="subsequent-section"><enum>6.</enum><header>Listing of immigration

			 violators in the National Crime Information Center database</header>

			<subsection commented="no" display-inline="no-display-inline" id="IDB404279B7B5D484FB15CDC6BDE37C866"><enum>(a)</enum><header>Provision of

			 information to the NCIC</header>

				<paragraph commented="no" display-inline="no-display-inline" id="idBE3170A8AAEE4D25BA593DF3D100382E"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Not later than 180

			 days after the date of enactment of this Act, the Under Secretary for Border

			 and Transportation Security of the Department of Homeland Security shall

			 provide the National Crime Information Center of the Department of Justice with

			 such information as the Director may have related to—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="id14A9C07F88D84889A22D61483CEE4F28"><enum>(A)</enum><text display-inline="yes-display-inline">any alien against whom a final order of

			 removal has been issued;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC528E40D27CA48FC96C17FB22F4D0BE6"><enum>(B)</enum><text display-inline="yes-display-inline">any alien who is subject to a voluntary

			 departure agreement;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8879D2F698334E9D9DB8476B6CAB41FF"><enum>(C)</enum><text display-inline="yes-display-inline">any alien who has remained in the United

			 States beyond the alien’s authorized period of stay; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4646EF67692246C6AC40222BA7E89BFC"><enum>(D)</enum><text display-inline="yes-display-inline">any alien whose visa has been

			 revoked.</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC16B6254DD6A42FC847ECEEE61F18B9A"><enum>(2)</enum><header>Requirement to

			 provide and use information</header><text display-inline="yes-display-inline">The information described in paragraph (1)

			 shall be provided to the National Crime Information Center, and the Center

			 shall enter the information into the Immigration Violators File of the National

			 Crime Information Center database, regardless of whether—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="id71B45EB83DAE43EE903F6F84631C1740"><enum>(A)</enum><text display-inline="yes-display-inline">the alien received notice of a final order

			 of removal;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9BA2E72BB1DC4A9B8DA4366BCFB36D6A"><enum>(B)</enum><text display-inline="yes-display-inline">the alien has already been removed;

			 or</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idAFD00B30290A46EA988B3DA2FAFA980D"><enum>(C)</enum><text display-inline="yes-display-inline">sufficient identifying information is

			 available for the alien, such as a physical description of the alien.</text>

					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID72D133338B72471FB55B585E6D782CCC"><enum>(b)</enum><header>Inclusion of

			 information in the NCIC database</header><text display-inline="yes-display-inline">Section 534(a) of title 28, United States

			 Code, is amended—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="IDD4C765D4537041BABA0024412C32FFD4"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (3), by striking

			 <quote>and</quote> at the end;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDB405887A6D8347649C6B0141FFF7D457"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating paragraph (4) as paragraph

			 (5); and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID37E2633C2F6745478EDEDC1EC2A6D7EE"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after paragraph (3) the

			 following:</text>

				of whether the alien has received notice of the violation, sufficient

				identifying information is available for the alien, or the alien has already

				been removed;

						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID50C38BC04D1C4FEAA8399B515337E400"><enum>(c)</enum><header>Permission To

			 depart voluntarily</header><text display-inline="yes-display-inline"><external-xref legal-doc="act" parsable-cite="INA/240B">Section 240B</external-xref> of the

			 <act-name parsable-cite="INA">Immigration and Nationality Act</act-name>

			 (<external-xref legal-doc="usc" parsable-cite="usc/8/1229c">8 U.S.C.

			 1229c</external-xref>) is amended—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="ID005686791D3F40F1B3E409C594305E33"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>Attorney General</quote>

			 each place that term appears and inserting <quote>Secretary of Homeland

			 Security</quote>; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4A70CE69C2BA415CB33F09ECF32BF858"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (a)(2)(A), by striking

			 <quote>120</quote> and inserting <quote>30</quote>.</text>

				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="IDE310178091FC4A6A81516290AD641DD3" section-type="subsequent-section"><enum>7.</enum><header>Increase of Federal

			 detention space and the utilization of facilities identified for closures as a

			 result of the Defense Base Closure Realignment Act of 1990</header>

			<subsection commented="no" display-inline="no-display-inline" id="IDAAA089FB6FD146F9B5D9FDDD2E7E874C"><enum>(a)</enum><header>Construction or

			 acquisition of detention facilities</header>

				<paragraph commented="no" display-inline="no-display-inline" id="ID0E8CD5505B1B46D9B8499E8F9DDCB4A5"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Secretary of

			 Homeland Security shall construct or acquire, in addition to existing

			 facilities for the detention of aliens, 20 detention facilities in the United

			 States that have the capacity to detain a total of not less than 10,000

			 individuals at any time for aliens detained pending removal or a decision on

			 removal of such alien from the United States.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDDE3F23FFF8244171BC8794212B00425B"><enum>(2)</enum><header>Determination

			 of location</header><text display-inline="yes-display-inline">The location of

			 any detention facility built or acquired in accordance with this subsection

			 shall be determined by the Deputy Assistant Director of the Office of Detention

			 and Removal Operations within the Bureau of Immigration and Customs

			 Enforcement.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDB53C06D1265841AD953DC682EC5958DE"><enum>(3)</enum><header>Use of

			 installations under base closure laws</header><text display-inline="yes-display-inline">In acquiring detention facilities under

			 this subsection, the Secretary of Homeland Security shall, to the maximum

			 extent practical, request the transfer of appropriate portions of military

			 installations approved for closure or realignment under the Defense Base

			 Closure and Realignment Act of 1990 (part A of title XXIX of

			 <external-xref legal-doc="public-law" parsable-cite="pl/101/510">Public Law

			 101–510</external-xref>;

			 <external-xref legal-doc="usc" parsable-cite="usc/10/2687 note">10 U.S.C. 2687

			 note</external-xref>) for use in accordance with paragraph (1).</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDFD2DB46A33DF4EDE9F4B9EE1E3DE0204"><enum>(b)</enum><header>Technical and

			 conforming amendment</header><text display-inline="yes-display-inline"><external-xref legal-doc="act" parsable-cite="INA/241(g)(1)">Section 241(g)(1)</external-xref> of the

			 <act-name parsable-cite="INA">Immigration and Nationality Act</act-name>

			 (<external-xref legal-doc="usc" parsable-cite="usc/8/1231(g)(1)">8 U.S.C.

			 1231(g)(1)</external-xref>) is amended by striking <quote>may expend</quote>

			 and inserting <quote>shall expend</quote>.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDAA1FD70C871C4B949828781858C7E41C"><enum>(c)</enum><header>Authorization

			 of appropriations</header><text display-inline="yes-display-inline">There are

			 authorized to be appropriated such sums as necessary to carry out this

			 section.</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="ID3B3CFCA111DE46C5BD764280941110E5" section-type="subsequent-section"><enum>8.</enum><header>Federal custody of

			 illegal aliens apprehended by State or local law enforcement</header>

			<subsection commented="no" display-inline="no-display-inline" id="ID5589D03B746740F08212F85223940057"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Title II of the

			 <act-name parsable-cite="INA">Immigration and Nationality Act</act-name>

			 (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C.

			 1151</external-xref> et seq.) is amended by adding after section 240C the

			 following:</text>

				<quoted-block act-name="Immigration and Nationality Act" display-inline="no-display-inline" id="ID2386562C0EEA4B9BA070B83518A2526F" style="traditional"><section commented="no" display-inline="no-display-inline" id="IDCD697A4D0D5F4474AF833D98FBEDD708" section-type="subsequent-section"><enum>240D.</enum><header>Transfer of illegal aliens from State to

		  Federal Custody</header><subsection commented="no" display-inline="yes-display-inline" id="ID3E87863EE39345AF948EBF63AA01CEB1"><enum>(a)</enum><header>In

				general</header><text display-inline="yes-display-inline">If the head of a law

				enforcement entity of a State (or, if appropriate, a political subdivision of

				the State) exercising authority with respect to the apprehension or arrest of

				an illegal alien submits a request to the Secretary of Homeland Security that

				the alien be taken into Federal custody, the Secretary of Homeland

				Security—</text>

							<paragraph commented="no" display-inline="no-display-inline" id="IDB4BB43F809C84FB7BF28C94565CE31D7"><enum>(1)</enum><text display-inline="yes-display-inline">shall—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="ID7E742A519276478A91B13BD38BCA3F4C"><enum>(A)</enum><text display-inline="yes-display-inline">not later than 72 hours after the

				conclusion of the State charging process or dismissal process, or if no State

				charging or dismissal process is required, not later than 72 hours after the

				illegal alien is apprehended, take the illegal alien into the custody of the

				Federal Government and incarcerate the alien; or</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4B6258148B4B4ED5856DD7F24902F598"><enum>(B)</enum><text display-inline="yes-display-inline">request that the relevant State or local

				law enforcement agency temporarily detain or transport the illegal alien to a

				location for transfer to Federal custody; and</text>

								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID66E66D233FBC4550986F496300B2083B"><enum>(2)</enum><text display-inline="yes-display-inline">shall designate at least one Federal,

				State, or local prison or jail or a private contracted prison or detention

				facility within each State as the central facility for that State to transfer

				custody of criminal or illegal aliens to the Department of Homeland

				Security.</text>

							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

				<quoted-block act-name="Immigration and Nationality Act" display-inline="no-display-inline" id="IDC60A8ECC47DA44D8AFE0F7999F2F8248" style="OLC">

					<subsection commented="no" display-inline="no-display-inline" id="ID86AD2683D7684945A076F02766EF00C9"><enum>(b)</enum><header>Reimbursement</header>

						<paragraph commented="no" display-inline="no-display-inline" id="id9572C570A18446CD8AD1F2413FE2176F"><enum>(1)</enum><header>In

				general</header><text display-inline="yes-display-inline">The Department of

				Homeland Security shall reimburse a State or a political subdivision of a State

				for all reasonable expenses, as determined by the Secretary of Homeland

				Security, incurred by the State or political subdivision in the detention and

				transportation of a criminal or illegal alien as described in subparagraphs (A)

				and (B) of subsection (a)(1).</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id886FFD6DF04A4658AF0A92C7BE611FF9"><enum>(2)</enum><header>Cost

				computation</header><text display-inline="yes-display-inline">Compensation

				provided for costs incurred under subparagraphs (A) and (B) of subsection

				(a)(1) shall be—</text>

							<subparagraph commented="no" display-inline="no-display-inline" id="id442C5675FBF64EC0B6D5035AEF10EEB8"><enum>(A)</enum><text display-inline="yes-display-inline">the product of—</text>

								<clause commented="no" display-inline="no-display-inline" id="id2C2126A79B4E4CB9AE3C8E22ADC8FEDA"><enum>(i)</enum><text display-inline="yes-display-inline">the average cost of incarceration of a

				prisoner in the relevant State, as determined by the chief executive officer of

				a State (or, as appropriate, a political subdivision of the State); multiplied

				by</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="id2FC2D9E94ADB40ACAD817F2685774B4A"><enum>(ii)</enum><text display-inline="yes-display-inline">the number of days that the alien was in

				the custody of the State or political subdivision; added to</text>

								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8768E6A9B1424DD38215E0B501EE77C9"><enum>(B)</enum><text display-inline="yes-display-inline">the cost of transporting the criminal or

				illegal alien from the point of apprehension or arrest to the location of

				detention, and if the location of detention and of custody transfer are

				different, to the custody transfer point.</text>

							</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID37DA5BD325F8400497AE3C8EC72F76E2"><enum>(c)</enum><header>Requirement for

				appropriate security</header><text display-inline="yes-display-inline">The

				Secretary of Homeland Security shall ensure that illegal aliens incarcerated in

				Federal facilities pursuant to this subsection are held in facilities which

				provide an appropriate level of security.</text>

					</subsection><subsection commented="no" display-inline="no-display-inline" id="IDB3C67E5D668D41F70048FDD400665891"><enum>(d)</enum><header>Requirement for

				schedule</header>

						<paragraph commented="no" display-inline="no-display-inline" id="idA7DCDE521F7A4E3A81768A928D3CCC38"><enum>(1)</enum><header>In

				general</header><text display-inline="yes-display-inline">In carrying out this

				section, the Secretary of Homeland Security shall establish a regular circuit

				and schedule for the prompt transfer of apprehended illegal aliens from the

				custody of States and political subdivisions of States to Federal

				custody.</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1665C2522C7B491A95DBE5B4C129E462"><enum>(2)</enum><header>Authority for

				contracts</header><text display-inline="yes-display-inline">The Secretary of

				Homeland Security may enter into contracts with appropriate State and local law

				enforcement and detention officials to implement this subsection.</text>

						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDB3609A987AA04BF3AEE1F1FE7C409D9F"><enum>(e)</enum><header>Illegal alien

				defined</header><text display-inline="yes-display-inline">For purposes of this

				section, the term <term>illegal alien</term> means an alien who—</text>

						<paragraph commented="no" display-inline="no-display-inline" id="IDE6104A2D2F6A48C788B1A86CE6DB4690"><enum>(1)</enum><text display-inline="yes-display-inline">entered the United States without

				inspection or at any time or place other than that designated by the Secretary

				of Homeland Security;</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID371980AE050743968F15B0E9B5DB005C"><enum>(2)</enum><text display-inline="yes-display-inline">was admitted as a nonimmigrant and who, at

				the time the alien was taken into custody by the State or a political

				subdivision of the State, had failed to—</text>

							<subparagraph commented="no" display-inline="no-display-inline" id="IDD993FE99AFFE4C0784CA9B9482DB00D4"><enum>(A)</enum><text display-inline="yes-display-inline">maintain the nonimmigrant status in which

				the alien was admitted or to which it was changed under section 248; or</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID8B4C0E309BC84BD99308545BEC65DA3E"><enum>(B)</enum><text display-inline="yes-display-inline">comply with the conditions of any such

				status;</text>

							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID59999470161847F39C7146A967BA6F47"><enum>(3)</enum><text display-inline="yes-display-inline">was admitted as an immigrant and has

				subsequently failed to comply with the requirements of that status; or</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID42AE4F38EEF3445E9B98F8F5FBFBB22F"><enum>(4)</enum><text display-inline="yes-display-inline">failed to depart the United States under a

				voluntary departure agreement or under a final order of

				removal.</text>

						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDEED264212B83460F002D33028206C49E"><enum>(b)</enum><header>Authorization

			 of appropriations for the detention and transportation to Federal custody of

			 aliens not lawfully present</header><text display-inline="yes-display-inline">There is authorized to be appropriated

			 $500,000,000 for the detention and removal of aliens not lawfully present in

			 the United States under the <act-name parsable-cite="INA">Immigration and

			 Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref> et seq.) for fiscal

			 year 2006 and each subsequent fiscal year.</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="ID759E2A2C29664E14BFA3324C36FF8E00" section-type="subsequent-section"><enum>9.</enum><header>Immigration law

			 enforcement training of State and local law enforcement personnel</header>

			<subsection commented="no" display-inline="no-display-inline" id="ID3C15DBF1581C4B6AB723429BB048153C"><enum>(a)</enum><header>Training manual

			 and pocket guide</header>

				<paragraph commented="no" display-inline="no-display-inline" id="IDABDF23F0DC6943CE914041B2C69FB0DA"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 180 days after the date of

			 enactment of this Act, the Secretary of Homeland Security shall

			 establish—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="ID3DCF71CEA0DB470886D688927BF41DD3"><enum>(A)</enum><text display-inline="yes-display-inline">a training manual for law enforcement

			 personnel of a State or political subdivision of a State to train such

			 personnel in the investigation, identification, apprehension, arrest,

			 detention, and transfer to Federal custody of aliens in the United States

			 (including the transportation of such aliens across State lines to detention

			 centers and the identification of fraudulent documents); and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDF12EE5C06C8D4AC0B4D637A38CEAA03D"><enum>(B)</enum><text display-inline="yes-display-inline">an immigration enforcement pocket guide for

			 law enforcement personnel of a State or political subdivision of a State to

			 provide a quick reference for such personnel in the course of duty.</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID24F1290169D04C88A1ECC2F9F9AFA5CA"><enum>(2)</enum><header>Availability</header><text display-inline="yes-display-inline">The training manual and pocket guide

			 established in accordance with paragraph (1) shall be made available to all

			 State and local law enforcement personnel.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8194DC51E92B4F6186A3328609AA4B29"><enum>(3)</enum><header>Applicability</header><text display-inline="yes-display-inline">Nothing in this subsection shall be

			 construed to require State or local law enforcement personnel to carry the

			 training manual or pocket guide established in accordance with paragraph (1)

			 with them while on duty.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID67F8C4F1AC7740E79678D38EA8340363"><enum>(4)</enum><header>Costs</header><text display-inline="yes-display-inline">The Secretary of Homeland Security shall be

			 responsible for any and all costs incurred in establishing the training manual

			 and pocket guide under this subsection.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDB312FBEA2BB9419EA4F0223716D084EE"><enum>(b)</enum><header>Training

			 flexibility</header>

				<paragraph commented="no" display-inline="no-display-inline" id="IDB2F742C984E841CAA0E90004DF7979CF"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Secretary of

			 Homeland Security shall make training of State and local law enforcement

			 officers available through as many means as possible, including residential

			 training at the Center for Domestic Preparedness of the Department of Homeland

			 Security, onsite training held at State or local police agencies or facilities,

			 on-line training courses by computer, teleconferencing, and videotape, or the

			 digital video display (DVD) of a training course or courses.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3B67AD5AA4E648F09AAEE04572EE7C37"><enum>(2)</enum><header>On-line

			 training</header><text display-inline="yes-display-inline">The head of the

			 Distributed Learning Program of the Federal Law Enforcement Training Center

			 shall make training available for State and local law enforcement personnel via

			 the Internet through a secure, encrypted distributed learning system that has

			 all its servers based in the United States, is sealable, survivable, and is

			 capable of having a portal in place within 30 days.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID109B2F50002341ADB885CF8FE1666189"><enum>(3)</enum><header>Federal

			 personnel training</header><text display-inline="yes-display-inline">The

			 training of State and local law enforcement personnel under this section shall

			 not displace the training of Federal personnel.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID341C3EB9353A4D019796D1DDE94D3558"><enum>(c)</enum><header>Clarification</header><text display-inline="yes-display-inline">Nothing in this Act or any other provision

			 of law shall be construed as making any immigration-related training a

			 requirement for, or prerequisite to, any State or local law enforcement officer

			 exercising the inherent authority of the officer to investigate, identify,

			 apprehend, arrest, detain, or transfer to Federal custody illegal aliens during

			 the normal course of carrying out the law enforcement duties of the

			 officer.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID53F85C40730447D7912165136832CA34"><enum>(d)</enum><header>Training

			 limitation</header><text display-inline="yes-display-inline"><external-xref legal-doc="act" parsable-cite="INA/287(g)">Section 287(g)</external-xref> of

			 the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name>

			 (<external-xref legal-doc="usc" parsable-cite="usc/8/1357(g)">8 U.S.C.

			 1357(g)</external-xref>) is amended—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="ID2FCD80B6C47C40ABA55D63F9BF8CA458"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>Attorney General</quote>

			 each place that term appears and inserting <quote>Secretary of Homeland

			 Security</quote>; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDF885F89F28D94501A63F7D03F27B5BAF"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (2), by adding at the end the

			 following: <quote>Such training shall not exceed 14 days or 80 hours, whichever

			 is longer.</quote>.</text>

				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID306C0D2C35E44F53938613ED7E6E1D3E" section-type="subsequent-section"><enum>10.</enum><header>Immunity</header>

			<subsection commented="no" display-inline="no-display-inline" id="ID02B8FB798DC249F580476C60191200A7"><enum>(a)</enum><header>Personal

			 immunity</header><text display-inline="yes-display-inline">Notwithstanding any

			 other provision of law, a law enforcement officer of a State, or of a political

			 subdivision of a State, shall be immune, to the same extent as a Federal law

			 enforcement officer, from personal liability arising out of the enforcement of

			 any immigration law. The immunity provided in this subsection shall only apply

			 to an officer of a State, or of a political subdivision of a State, who is

			 acting within the scope of such officer’s official duties.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID8E906466C0ED4D50A06C2DC6BFE0EB33"><enum>(b)</enum><header>Agency

			 immunity</header><text display-inline="yes-display-inline">Notwithstanding any

			 other provision of law, a law enforcement agency of a State, or of a political

			 subdivision of a State, shall be immune from any claim for money damages based

			 on Federal, State, or local civil rights law for an incident arising out of the

			 enforcement of any immigration law, except to the extent that the law

			 enforcement officer of that agency, whose action the claim involves, committed

			 a violation of Federal, State, or local criminal law in the course of enforcing

			 such immigration law.</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="IDF5E8D6D0E61C41548356E900C88F6819" section-type="subsequent-section"><enum>11.</enum><header>Places of detention

			 for aliens detained pending examination or decision on removal</header>

			<subsection commented="no" display-inline="no-display-inline" id="IDC91C4413DAB3410C8C019EE9906CA3CD"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline"><external-xref legal-doc="act" parsable-cite="INA/241(g)">Section 241(g)</external-xref> of

			 the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name>

			 (<external-xref legal-doc="usc" parsable-cite="usc/8/1231(g)">8 U.S.C.

			 1231(g)</external-xref>) is amended by adding at the end the following:</text>

				<quoted-block act-name="Immigration and Nationality Act" display-inline="no-display-inline" id="IDD6ECABAF8C464FB79417AC314086AEEB" style="OLC">

					<paragraph commented="no" display-inline="no-display-inline" id="ID40A4D47980E349F98F2048969ECD8CEB"><enum>(3)</enum><header>Policy on

				detention in State and local detention facilities</header><text display-inline="yes-display-inline">In carrying out paragraph (1), the

				Secretary of Homeland Security shall ensure that an alien arrested under

				section 287(a) is detained, pending the alien being taken for the examination

				described in that section, in a State or local prison, jail, detention center,

				or other comparable facility, if—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="ID21AA18DDD8A84E32B4E127A35B20264D"><enum>(A)</enum><text display-inline="yes-display-inline">such a facility is the most suitably

				located Federal, State, or local facility available for such purpose under the

				circumstances;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDC8D32FF0958F45C8BA2E0216EE6C2DF7"><enum>(B)</enum><text display-inline="yes-display-inline">an appropriate arrangement for such use of

				the facility can be made; and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDB40D8E12C18E4A61820033B656A8091F"><enum>(C)</enum><text display-inline="yes-display-inline">such facility satisfies the standards for

				the housing, care, and security of persons held in custody of a United States

				marshal.</text>

						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDF7CDBD42E0384FF69B90B9007759382C"><enum>(b)</enum><header>Detention

			 facility suitability</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law,

			 a facility described in

			 <external-xref legal-doc="act" parsable-cite="INA/241(g)(3)(C)">section

			 241(g)(3)(C)</external-xref> of the <act-name parsable-cite="INA">Immigration

			 and Nationality Act</act-name>, as added by subsection (a), is adequate for

			 detention of persons being held for immigration related violations.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID0FBC209CE6304DB6A207578247CFAD14"><enum>(c)</enum><header>Technical and

			 conforming amendment</header><text display-inline="yes-display-inline"><external-xref legal-doc="act" parsable-cite="INA/241">Section 241</external-xref> of the

			 <act-name parsable-cite="INA">Immigration and Nationality Act</act-name>

			 (<external-xref legal-doc="usc" parsable-cite="usc/8/1231">8 U.S.C.

			 1231</external-xref>) is amended by striking <quote>Attorney General</quote>

			 each place that term appears and inserting <quote>Secretary of Homeland

			 Security</quote>.</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="IDAD1BB385ED354B84B5678E62B5AC2300" section-type="subsequent-section"><enum>12.</enum><header>Institutional Removal

			 Program</header>

			<subsection commented="no" display-inline="no-display-inline" id="IDCCC81241764B40E1AF89CB410040C6CC"><enum>(a)</enum><header>Continuation</header>

				<paragraph commented="no" display-inline="no-display-inline" id="IDC139E73723FE4686B33D0081756C0845"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Department of

			 Homeland Security shall continue to operate and implement the program known on

			 the date of the enactment of this Act as the Institutional Removal Program

			 which—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="ID70158ECDAB734DC99EC449AD18F4F6FF"><enum>(A)</enum><text display-inline="yes-display-inline">identifies removable criminal aliens in

			 Federal and State correctional facilities;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID143F9F497AAD44F29030F3BB455092C7"><enum>(B)</enum><text display-inline="yes-display-inline">ensures such aliens are not released into

			 the community; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID857F0A2C5E0D4A6FAE9771102EABB7A7"><enum>(C)</enum><text display-inline="yes-display-inline">removes such aliens from the United States

			 after the completion of their sentences.</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4163759FEBD34043BAB548558F14A16B"><enum>(2)</enum><header>Expansion</header><text display-inline="yes-display-inline">The Institutional Removal Program shall be

			 extended to all States. Any State that receives Federal funds for the

			 incarceration of criminal aliens shall—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="ID3652AF38ED154E1A86B109214B19547D"><enum>(A)</enum><text display-inline="yes-display-inline">cooperate with Federal officials who carry

			 out the Institutional Removal Program;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDA7291B69F0C142E998140047FD67B877"><enum>(B)</enum><text display-inline="yes-display-inline">expeditiously and systematically identify

			 criminal aliens in its prison and jail populations; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID5142C2BD994E4121BB2000ED5D4700F7"><enum>(C)</enum><text display-inline="yes-display-inline">promptly convey such information to the

			 Federal officials who carry out the Institutional Removal Program as a

			 condition for receiving such funds.</text>

					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID77FA0CEC2C6F48489FC9D43C7DF700D6"><enum>(b)</enum><header>Authorization

			 for detention after completion of State or local prison sentence</header><text display-inline="yes-display-inline">Law enforcement officers of a State or

			 political subdivision of a State have the authority to—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="ID14C007B157524A73BD6B148EC4962EB0"><enum>(1)</enum><text display-inline="yes-display-inline">hold an illegal alien for a period of up to

			 14 days after the alien has completed the alien’s State prison sentence in

			 order to effectuate the transfer of the alien to Federal custody when the alien

			 is removable or not lawfully present in the United States; or</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID21CDF269C2094A1596401028A64727AA"><enum>(2)</enum><text display-inline="yes-display-inline">issue a detainer that would allow aliens

			 who have served a State prison sentence to be detained by the State prison

			 until personnel from the Bureau of Immigration and Customs Enforcement can take

			 the alien into custody.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID3A16C14390594CF08917C5DDB6030144"><enum>(c)</enum><header>Technology

			 usage</header><text display-inline="yes-display-inline">Technology such as

			 videoconferencing shall be used to the maximum extent possible in order to make

			 the Institutional Removal Program available in remote locations. Mobile access

			 to Federal databases of aliens, such as the IDENT database maintained by the

			 Secretary of Homeland Security, and live scan technology shall be used to the

			 maximum extent practicable in order to make these resources available to State

			 and local law enforcement agencies in remote locations.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID0456C7F9C4894DD782CE670567C7EFA4"><enum>(d)</enum><header>Authorization

			 of appropriations</header><text display-inline="yes-display-inline">There is

			 authorized to be appropriated to carry out the Institutional Removal

			 Program—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="ID924960B8B1364C3A83BC895EC972C6EE"><enum>(1)</enum><text display-inline="yes-display-inline">$40,000,000 for fiscal year 2007;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDBD34527F525443E899B550C45C77EDE7"><enum>(2)</enum><text display-inline="yes-display-inline">$50,000,000 for fiscal year 2008;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID052F6188738E424F80891E1E2088E6C1"><enum>(3)</enum><text display-inline="yes-display-inline">$60,000,000 for fiscal year 2009;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0D5455672C7C4BFFBA9368A8F37DF5B9"><enum>(4)</enum><text display-inline="yes-display-inline">$70,000,000 for fiscal year 2010;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID383074350D4B426E8F54D53CAB3B1251"><enum>(5)</enum><text display-inline="yes-display-inline">$80,000,000 for fiscal year 2011;

			 and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF23FB58639434E0CA73A77B9C3C1E92C"><enum>(6)</enum><text display-inline="yes-display-inline">$80,000,000 for each fiscal year after

			 fiscal year 2011.</text>

				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id7C9FBE2F4BE145CC96742BDB260CA011" section-type="subsequent-section"><enum>13.</enum><header>Construction</header><text display-inline="no-display-inline">Nothing in this Act may be construed to

			 require law enforcement personnel of a State or political subdivision of a

			 State to—</text>

			<paragraph commented="no" display-inline="no-display-inline" id="id5D11192E812F40F6BD415C4FBFA29061"><enum>(1)</enum><text display-inline="yes-display-inline">report the identity of a victim of, or a

			 witness to, a criminal offense to the Secretary of Homeland Security for

			 immigration enforcement purposes;</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCC42824DFC6A430EA2E42BCA29201261"><enum>(2)</enum><text display-inline="yes-display-inline">arrest such victim or witness for a

			 violation of the immigration laws of the United States; or</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2B4FE5F9960A474FAE640C09853AC8E6"><enum>(3)</enum><text display-inline="yes-display-inline">enforce the immigration laws of the United

			 States.</text>

			</paragraph></section><section commented="no" display-inline="no-display-inline" id="idCC2D1A0438A548AB93576DC84E2190EF" section-type="subsequent-section"><enum>14.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act, including any

			 amendment made by this Act, or the application of such provision to any person

			 or circumstance, is held invalid, the remainder of this Act, and the

			 application of such provision to other persons not similarly situated or to

			 other circumstances, shall not be affected by such invalidation.</text>
