		<section commented="no" display-inline="no-display-inline" id="IDE8987AF34AEA4C7AA4822606473742D5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Sunshine in Litigation Act of

			 2005</short-title></quote>.</text>

		</section><section commented="no" display-inline="no-display-inline" id="IDA7EF395820364D9391584EB8CB41181E" section-type="subsequent-section"><enum>2.</enum><header>Restrictions on

			 protective orders and sealing of cases and settlements</header>

			<subsection commented="no" display-inline="no-display-inline" id="ID69E9A49BC7934BBD815D00779C055C96"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Chapter 111 of title

			 28, United States Code, is amended by adding at the end the following:</text>

				<quoted-block display-inline="no-display-inline" id="ID3B5178B6149E4802A3880000CEFD944D" style="USC">

					<section commented="no" display-inline="no-display-inline" id="ID6BC99B57795B404A80F7D0CAB521B53B" section-type="subsequent-section"><enum>1660.</enum><header>Restrictions on

				protective orders and sealing of cases and settlements</header>

						<subsection commented="no" display-inline="no-display-inline" id="ID6F2DD1C764284E2C8100F3C0C1059827"><enum>(a)</enum><paragraph commented="no" display-inline="yes-display-inline" id="IDBA831B21717F4E1AB268ED019831F895"><enum>(1)</enum><text display-inline="yes-display-inline">A court shall not enter an order under rule

				26(c) of the Federal Rules of Civil Procedure restricting the disclosure of

				information obtained through discovery, an order approving a settlement

				agreement that would restrict the disclosure of such information, or an order

				restricting access to court records in a civil case unless the court has made

				findings of fact that—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="ID9F3A0E2AFE544B1CB4186F5078403454" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">such order would not restrict the

				disclosure of information which is relevant to the protection of public health

				or safety; or</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID77E802A6844C47EE8730A18F3FD78D81" indent="up1"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="ID94E05A5EC97249EEB8AD56785B773ECB"><enum>(i)</enum><text display-inline="yes-display-inline">the public interest in the disclosure of

				potential health or safety hazards is outweighed by a specific and substantial

				interest in maintaining the confidentiality of the information or records in

				question; and</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="ID8266C04D7C714DEEB36B406C67B07F91" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">the requested protective order is no

				broader than necessary to protect the privacy interest asserted.</text>

									</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID759E7EB411314A2B96F95E6F0321BE72" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">No order entered in accordance with

				paragraph (1), other than an order approving a settlement agreement, shall

				continue in effect after the entry of final judgment, unless at the time of, or

				after, such entry the court makes a separate finding of fact that the

				requirements of paragraph (1) have been met.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID963BB08F655B48C58EA5695348A5EF18" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">The party who is the proponent for the

				entry of an order, as provided under this section, shall have the burden of

				proof in obtaining such an order.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID666F10339791473A911191055E2502DD" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">This section shall apply even if an order

				under paragraph (1) is requested—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="ID69A52AF85A694FB3999433828089CD6C"><enum>(A)</enum><text display-inline="yes-display-inline">by

				motion pursuant to rule 26(c) of the Federal Rules of Civil Procedure;

				or</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID04BB8C71A297428AB3391B35BB727898"><enum>(B)</enum><text display-inline="yes-display-inline">by

				application pursuant to the stipulation of the parties.</text>

								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID088F9D47460445D69BC732D836CED7A6" indent="up1"><enum>(5)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="ID4808518F514D4A0F89F269E37FABBDFA"><enum>(A)</enum><text display-inline="yes-display-inline">The provisions of this section shall not

				constitute grounds for the withholding of information in discovery that is

				otherwise discoverable under rule 26 of the Federal Rules of Civil

				Procedure.</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3E5B83C8BEE443C9A0492800C935A652" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">No party shall request, as a condition for

				the production of discovery, that another party stipulate to an order that

				would violate this section.</text>

								</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID02DE25A8C79D414AB8F4D8DB1061FC9D"><enum>(b)</enum><paragraph commented="no" display-inline="yes-display-inline" id="IDFF223C5261974ECD81548E94B9F03004"><enum>(1)</enum><text display-inline="yes-display-inline">A court shall not approve or enforce any

				provision of an agreement between or among parties to a civil action, or

				approve or enforce an order subject to subsection (a)(1), that prohibits or

				otherwise restricts a party from disclosing any information relevant to such

				civil action to any Federal or State agency with authority to enforce laws

				regulating an activity relating to such information.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE1903BB029204814AF5D87606433C0F9" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Any such information disclosed to a Federal

				or State agency shall be confidential to the extent provided by law.</text>

							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID70DDEE27E7AE4A7DA0B0E10011AC86BD"><enum>(c)</enum><paragraph commented="no" display-inline="yes-display-inline" id="IDA0525743C3A14FAA9DAC7FA8D87FF01B"><enum>(1)</enum><text display-inline="yes-display-inline">Subject to paragraph (2), a court shall not

				enforce any provision of a settlement agreement between or among parties that

				prohibits 1 or more parties from—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="ID09B9F6A5F0074434A159A34E566B1CAF" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">disclosing that a settlement was reached or

				the terms of such settlement, other than the amount of money paid; or</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDAE4C3371A7B14A3C8EA958AB26357D44" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">discussing a case, or evidence produced in

				the case, that involves matters related to public health or safety.</text>

								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9E55E42F01CC44AB811D2E2585234351" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Paragraph (1) does not apply if the court

				has made findings of fact that the public interest in the disclosure of

				potential health or safety hazards is outweighed by a specific and substantial

				interest in maintaining the confidentiality of the

				information.</text>

							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID49DEA33B61EC4D44AB00F7D9CBAFC347"><enum>(b)</enum><header>Technical and

			 conforming amendment</header><text display-inline="yes-display-inline">The

			 table of sections for chapter 111 of title 28, United States Code, is amended

			 by adding after the item relating to section 1659 the following:</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="ID73148738BA4245E2B55E9C1543778E6D" section-type="subsequent-section"><enum>3.</enum><header>Effective

			 date</header><text display-inline="no-display-inline">The amendments made by

			 this Act shall—</text>

			<paragraph commented="no" display-inline="no-display-inline" id="IDBD3DF06E3BCC42049B89F55C6460B591"><enum>(1)</enum><text display-inline="yes-display-inline">take effect 30 days after the date of

			 enactment of this Act; and</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1BC73BF25ED544F9BB4505E633441B22"><enum>(2)</enum><text display-inline="yes-display-inline">apply only to orders entered in civil

			 actions or agreements entered into on or after such date.</text>
