		<official-title display="yes">To reduce and prevent childhood obesity by

		  encouraging schools and school districts to develop and implement local,

		  school-based programs designed to reduce and prevent childhood obesity, promote

		  increased physical activity, and improve nutritional choices.</official-title>

		<section commented="no" display-inline="no-display-inline" id="ID1DF9903D27844D6694B1AF429939C86D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Childhood Obesity Reduction

			 Act</short-title></quote>.</text>

		</section><section commented="no" display-inline="no-display-inline" id="ID6E601195FAC245569FEF17DB5244BC83" section-type="subsequent-section"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following

			 findings:</text>

			<paragraph commented="no" display-inline="no-display-inline" id="ID24FAFD2D585F4F0CAC330BFB7C0D2F38"><enum>(1)</enum><text display-inline="yes-display-inline">According to the Centers for Disease

			 Control and Prevention, obesity may soon overtake tobacco as the leading

			 preventable cause of death.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9BCEE92E1E1D4239872449417CEAF10C"><enum>(2)</enum><text display-inline="yes-display-inline">In 1999, 13 percent of children aged 6 to

			 11 years and 14 percent of adolescents aged 12 to 19 years in the United States

			 were overweight. This prevalence has nearly tripled for adolescents in the past

			 2 decades.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDAD0B9AE700E7414BA1424B49FD106803"><enum>(3)</enum><text display-inline="yes-display-inline">Risk factors for heart disease, such as

			 high cholesterol and high blood pressure, occur with increased frequency in

			 overweight children and adolescents compared to children with a healthy

			 weight.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID989DD19E98E14D8681CDAA300AE2BAC3"><enum>(4)</enum><text display-inline="yes-display-inline">Type 2 diabetes, previously considered an

			 adult disease, has increased dramatically in children and adolescents.

			 Overweight and obesity are closely linked to type 2 diabetes.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6CE4049B7C414665A346926194865390"><enum>(5)</enum><text display-inline="yes-display-inline">Obesity in children and adolescents is

			 generally caused by a lack of physical activity, unhealthy eating patterns, or

			 a combination of the 2, with genetics and lifestyle both playing important

			 roles in determining a child’s weight.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1E88CCA6A65B49D490FEF3C70FE55EB5"><enum>(6)</enum><text display-inline="yes-display-inline">Overweight adolescents have a 70 percent

			 chance of becoming overweight or obese adults.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDF287F98E1FAA4B33BA1495104D044467"><enum>(7)</enum><text display-inline="yes-display-inline">The 2001 report <quote>The Surgeon

			 General’s Call to Action to Prevent and Decrease Overweight and Obesity</quote>

			 suggested that obesity and its complications were already costing the United

			 States $117,000,000,000 annually.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID082EB6B5193B400D9EFFDCFADEBA8491"><enum>(8)</enum><text display-inline="yes-display-inline">Substantial evidence shows that public

			 health risks can be reduced through increased public awareness and community

			 involvement.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDAC22115C1F1F41EBB14F4B4E8B3C1CEC"><enum>(9)</enum><text display-inline="yes-display-inline">Congress needs to challenge students,

			 teachers, school administrators, and local communities to voluntarily

			 participate in the development and implementation of activities to successfully

			 reduce and prevent childhood obesity.</text>

			</paragraph></section><title commented="no" id="ID7057FE690DAB4AB79C6F4B305F9421C4" style="OLC"><enum>I</enum><header>Congressional Council on Childhood

			 Obesity</header>

			<section commented="no" display-inline="no-display-inline" id="ID5ECE89C97B4E47BF95EC04E9B1E3627A" section-type="subsequent-section"><enum>101.</enum><header>Congressional

			 Council on Childhood Obesity</header>

				<subsection commented="no" display-inline="no-display-inline" id="IDC5C5843785B843908B52CA75A5B4499C"><enum>(a)</enum><header>Establishment

			 of Council</header><text display-inline="yes-display-inline">There is

			 established a <quote>Congressional Council on Childhood Obesity</quote>

			 (referred to in this title as the <quote>Council</quote>).</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID0D04B707B10F41EFBA850E83D6F88C64"><enum>(b)</enum><header>Purposes</header><text display-inline="yes-display-inline">The purposes of the Council shall

			 be—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="ID87FADE6FEFE447F8A0A77822882B9DD1"><enum>(1)</enum><text display-inline="yes-display-inline">to encourage every elementary school and

			 middle school in the United States, whether public or private, to develop and

			 implement a plan to reduce and prevent obesity, promote improved nutritional

			 choices, and promote increased physical activity among students; and</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDDC7119BCD09E400489F14DDB6FC67A6F"><enum>(2)</enum><text display-inline="yes-display-inline">to provide information as necessary to

			 secondary schools.</text>

					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID14FAB915098A421FADCF2D19E4E114A3" section-type="subsequent-section"><enum>102.</enum><header>Membership of the

			 Council</header>

				<subsection commented="no" display-inline="no-display-inline" id="IDBBC5EE61CFA94429B6B0D2DB95D86DE5"><enum>(a)</enum><header>Composition of

			 the Council</header><text display-inline="yes-display-inline">The Council shall

			 be composed of 8 members as follows:</text>

					<paragraph commented="no" display-inline="no-display-inline" id="IDEE62324E69494270B06762A9E1FF2A4C"><enum>(1)</enum><text display-inline="yes-display-inline">The majority leader of the Senate or the

			 designee of the majority leader of the Senate.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDCFBEF52411E64B60981A2A819126A860"><enum>(2)</enum><text display-inline="yes-display-inline">The minority leader of the Senate or the

			 designee of the minority leader of the Senate.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8CA814470CAF44BABFA4E760B563A421"><enum>(3)</enum><text display-inline="yes-display-inline">The Speaker of the House of Representatives

			 or the designee of the Speaker of the House of Representatives.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID627AB14A80734FCD93A5008AFBA46501"><enum>(4)</enum><text display-inline="yes-display-inline">The minority leader of the House of

			 Representatives or the designee of the minority leader of the House of

			 Representatives.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID02074AC4EC024B79886B8D88A9730143"><enum>(5)</enum><text display-inline="yes-display-inline">4 citizen members to be appointed in

			 accordance with subsection (b).</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID44BB8634F1464B61A03A4482FB3ADD09"><enum>(b)</enum><header>Appointment of

			 citizen Council members</header>

					<paragraph commented="no" display-inline="no-display-inline" id="IDF7A76AFBEE50445B827392D0C7325F92"><enum>(1)</enum><header>Method of

			 appointment</header><text display-inline="yes-display-inline">For the purpose

			 of subsection (a)(5), each of the 4 members described in paragraphs (1) through

			 (4) of subsection (a) shall appoint to the Council a citizen who is an expert

			 on children’s health, nutrition, or physical activity.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE6C725F3ADCC4D6CA4762EC60F5B6AFB"><enum>(2)</enum><header>Date of

			 appointment</header><text display-inline="yes-display-inline">The appointments

			 made under paragraph (1) shall be made not later than 120 days after the date

			 of enactment of this Act.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID7CDCAD8546C84608A32190A91A23CCAA"><enum>(c)</enum><header>Vacancies</header><text display-inline="yes-display-inline">Any vacancy in the Council shall not affect

			 its powers, but shall be filled in the manner in which the original appointment

			 was made under subsection (a).</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID58858A4B263E4050A82CFD0CA300654D"><enum>(d)</enum><header>Chairperson</header><text display-inline="yes-display-inline">The members of the Council shall elect,

			 from among the members of the Council, a Chairperson.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="IDA38C7786776D4F3BA4547DA76F0EDD9D"><enum>(e)</enum><header>Initial

			 meeting</header><text display-inline="yes-display-inline">The Council shall

			 hold its first meeting not later than 120 days after the date of enactment of

			 this Act.</text>

				</subsection></section><section commented="no" display-inline="no-display-inline" id="ID8C2E7121AE57436092C7438D2CD20313" section-type="subsequent-section"><enum>103.</enum><header>Responsibilities of

			 the Council</header>

				<subsection commented="no" display-inline="no-display-inline" id="ID372AC7523C37454CBF85117ABFD30F3B"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Council shall

			 engage in the following activities:</text>

					<paragraph commented="no" display-inline="no-display-inline" id="IDBFD6BD248A4A44EF927E6347DCF99266"><enum>(1)</enum><text display-inline="yes-display-inline">Work with outside experts to develop the

			 Congressional Challenge to Reduce and prevent Childhood Obesity, which shall

			 include the development of model plans to reduce and prevent childhood obesity

			 that can be adopted or adapted by elementary schools or middle schools that

			 participate.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6411F43CE22B4F93BA8447B37FD0BB40"><enum>(2)</enum><text display-inline="yes-display-inline">Develop and maintain a website that is

			 updated not less than once a month on best practices in the United States for

			 reducing and preventing childhood obesity.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID64B660AF74684EB0921DFCE672DC83F7"><enum>(3)</enum><text display-inline="yes-display-inline">Assist in helping elementary schools and

			 middle schools in establishing goals for the healthy reduction and prevention

			 of childhood obesity.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDCCB0270572B04409BA8683961C9036AE"><enum>(4)</enum><text display-inline="yes-display-inline">Consult and coordinate with the President’s

			 Council on Physical Fitness and other Federal Government initiatives conducting

			 activities to reduce and prevent childhood obesity.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID38153E9925CB4EBDB4D4E1636BFDFDAC"><enum>(5)</enum><text display-inline="yes-display-inline">Reward elementary schools, middle schools,

			 and local educational agencies promoting innovative, successful strategies in

			 reducing and preventing childhood obesity.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID188236D2F593461B9DDC2E42D3B57DA0"><enum>(6)</enum><text display-inline="yes-display-inline">Provide information to secondary

			 schools.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDD08360F519DD452AAE2D69768A0940FA"><enum>(b)</enum><header>Congressional

			 Challenge winners</header>

					<paragraph commented="no" display-inline="no-display-inline" id="ID8520CA503F70499AB9D37D3AF147060E"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Council

			 shall—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="ID2C1B287B5EBC4C8DA495B3D350222597"><enum>(A)</enum><text display-inline="yes-display-inline">evaluate plans submitted by elementary

			 schools, middle schools, and local educational agencies under paragraph

			 (2);</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDEA40D1B7F8254248A12D8FB916614B91"><enum>(B)</enum><text display-inline="yes-display-inline">designate the plans submitted under

			 paragraph (2) that meet the criteria under paragraph (3) as Congressional

			 Challenge winners; and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID2279ACDAB57D41FB8F726795691C733E"><enum>(C)</enum><text display-inline="yes-display-inline">post the plans of the Congressional

			 Challenge winners designated under subparagraph (B) on the website of the

			 Council as model plans for reducing and preventing childhood obesity.</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDA078ACAF81BC47B18856A19507C314D7"><enum>(2)</enum><header>Submission of

			 plans</header><text display-inline="yes-display-inline">Each elementary school,

			 middle school, or local educational agency that desires to have the plan to

			 reduce and prevent childhood obesity of such entity designated as a

			 Congressional Challenge winner shall submit to the Council such plan at such

			 time, in such manner, and accompanied by such information as the Council may

			 reasonably require.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDA14AEA5910904385BBDDE005AE6F2428"><enum>(3)</enum><header>Selection

			 criteria</header>

						<subparagraph commented="no" display-inline="no-display-inline" id="IDEF30D310F7CC47B8900203DAC4828250"><enum>(A)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Council shall

			 evaluate plans submitted by elementary schools, middle schools, and local

			 educational agencies under paragraph (2) and shall designate as Congressional

			 Challenge winners the plans that—</text>

							<clause commented="no" display-inline="no-display-inline" id="IDFA9387983D7B45C892EC3ACB61A9E9FC"><enum>(i)</enum><text display-inline="yes-display-inline">show promise in successfully increasing

			 physical activity, improving nutrition, and reducing and preventing obesity;

			 or</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="IDCB87BC1405CB4D41BF78F210276FDD2F"><enum>(ii)</enum><text display-inline="yes-display-inline">have maintained efforts in assisting

			 children in increasing physical activity, improving nutrition, and reducing and

			 preventing obesity.</text>

							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDBEB002C92B324FAFA39101FEACE2ED8E"><enum>(B)</enum><header>Criteria</header><text display-inline="yes-display-inline">The Council shall make the determination

			 under subparagraph (A) based on the following criteria:</text>

							<clause commented="no" display-inline="no-display-inline" id="IDA9E3E7C1A9B74DE2B22A3EC7F2EE6F6E"><enum>(i)</enum><text display-inline="yes-display-inline">Strategies based on evaluated

			 interventions.</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="ID46FA4CA6E59942428EA717E3D3D95B21"><enum>(ii)</enum><text display-inline="yes-display-inline">The number of children in the community in

			 need of assistance in addressing obesity and the potential impact of the

			 proposed plan.</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="ID1BDAA597E35B401BA2656C5A8B20B411"><enum>(iii)</enum><text display-inline="yes-display-inline">The involvement in the plan of the

			 community served by the school or local educational agency.</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="IDE29433472BC345C0A1F4B32B5ADB0B93"><enum>(iv)</enum><text display-inline="yes-display-inline">Other criteria as determined by the

			 Council.</text>

							</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID5FC823A6C46F444EBCA49AF900793A14"><enum>(c)</enum><header>Meetings</header><text display-inline="yes-display-inline">The Council shall hold not less than 1

			 meeting each year, and all meetings of the Council shall be public meetings,

			 preceded by a publication of notice in the Federal Register.</text>

				</subsection></section><section commented="no" display-inline="no-display-inline" id="IDB404FAF3105B4F38B63A5C7DF3D7FAEA" section-type="subsequent-section"><enum>104.</enum><header>Administrative

			 matters</header>

				<subsection commented="no" display-inline="no-display-inline" id="ID736D486E03B44F72AAA076394518C3B3"><enum>(a)</enum><header>Pay and travel

			 expenses</header>

					<paragraph commented="no" display-inline="no-display-inline" id="ID695A4289450944A09C7DACC4126B55D2"><enum>(1)</enum><header>Prohibition of

			 pay</header><text display-inline="yes-display-inline">Members of the Council

			 shall receive no pay, allowances, or benefits by reason of their service on the

			 Council.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID41C87AA7F6264106BA07AF4E73625937"><enum>(2)</enum><header>Travel

			 expenses</header>

						<subparagraph commented="no" display-inline="no-display-inline" id="ID6725094B95414E15B0742713FC30BA5A"><enum>(A)</enum><header>Compensation

			 for travel</header><text display-inline="yes-display-inline">Each member of the

			 Council shall be allowed travel expenses, including per diem in lieu of

			 subsistence, at rates authorized for employees of agencies under subchapter I

			 of chapter 57 of title 5, United States Code, while away from their homes or

			 regular places of business in the performance of services for the Council, to

			 the extent funds are available under subparagraph (B) for such expenses.</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDDF7425CA992140A0A9919558C6FECE03"><enum>(B)</enum><header>Limit on travel

			 expenses</header><text display-inline="yes-display-inline">Travel expenses

			 under subparagraph (A) shall be appropriated from the amounts appropriated to

			 the legislative branch and shall not exceed $1,000,000.</text>

						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID8E734E8C3FAF46D48DE8A0AF6C39ED70"><enum>(b)</enum><header>Staff</header><text display-inline="yes-display-inline">The Chairperson of the Council may appoint

			 and terminate, as may be necessary to enable the Council to perform its duties,

			 not more than 5 staff personnel, all of whom shall be considered employees of

			 the Senate.</text>

				</subsection></section><section commented="no" display-inline="no-display-inline" id="ID9C10FD01124645B3B4C2C6C8D0D53416" section-type="subsequent-section"><enum>105.</enum><header>Termination of

			 Council</header><text display-inline="no-display-inline">The Council shall

			 terminate on September 30 of the second full fiscal year following the date of

			 enactment of this Act.</text>

			</section><section commented="no" display-inline="no-display-inline" id="ID3F52892B96A141549EAD462C4BD5CFC2" section-type="subsequent-section"><enum>106.</enum><header>Authorization of

			 appropriations</header><text display-inline="no-display-inline">There are

			 authorized to be appropriated to carry out this title $2,200,000 for each of

			 fiscal years 2006 and 2007.</text>

			</section></title><title commented="no" id="ID62C0EF45E7094191831FCE745E56A3CE" style="OLC"><enum>II</enum><header>National Foundation for the Prevention and

			 Reduction of Childhood Obesity</header>

			<section commented="no" display-inline="no-display-inline" id="IDAD492D83B28A4891BDCFE86275217F1C" section-type="subsequent-section"><enum>201.</enum><header>Establishment and

			 duties of Foundation</header>

				<subsection commented="no" display-inline="no-display-inline" id="ID61D35030EF48444187A6E6B72603CA5B"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">There shall be

			 established in accordance with this section a nonprofit private corporation to

			 be known as the National Foundation for the Prevention and Reduction of

			 Childhood Obesity (referred to in this title as the <quote>Foundation</quote>).

			 The Foundation shall not be an agency or instrumentality of the Federal

			 Government, and officers, employees, and members of the board of the Foundation

			 shall not be officers or employees of the Federal Government.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID5F9E8515834B48289EBA0A27B61D5DCE"><enum>(b)</enum><header>Purpose of

			 Foundation</header><text display-inline="yes-display-inline">The purpose of the

			 Foundation shall be to support and carry out activities for the prevention and

			 reduction of childhood obesity through school-based activities.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID56C786045CC246D4A21B980A7B4CE57D"><enum>(c)</enum><header>Endowment

			 fund</header>

					<paragraph commented="no" display-inline="no-display-inline" id="IDEA9B5B361D2044F68FFC7CF31AD383B2"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">In carrying out

			 subsection (b), the Foundation shall establish a fund for providing endowments

			 for positions that are associated with the Congressional Council on Childhood

			 Obesity and the Department of Health and Human Services (referred to in this

			 title as the <quote>Department</quote>) and dedicated to the purpose described

			 in such subsection. Subject to subsection (g)(1)(B), the fund shall consist of

			 such donations as may be provided by non-Federal entities and such non-Federal

			 assets of the Foundation (including earnings of the Foundation and the fund) as

			 the Foundation may elect to transfer to the fund.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID558A9774AC9F4D43B4A40DA2300C97BF"><enum>(2)</enum><header>Authorized

			 expenditures of fund</header><text display-inline="yes-display-inline">The

			 provision of endowments under paragraph (1) shall be the exclusive function of

			 the fund established under such paragraph. Such endowments may be expended only

			 for the compensation of individuals holding the positions, for staff,

			 equipment, quarters, travel, and other expenditures that are appropriate in

			 supporting the positions, and for recruiting individuals to hold the positions

			 endowed by the fund.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID12EB32DD5DAD4C7B93992CBE3B215958"><enum>(d)</enum><header>Certain

			 activities of Foundation</header><text display-inline="yes-display-inline">In

			 carrying out subsection (b), the Foundation may provide for the following with

			 respect to the purpose described in such subsection:</text>

					<paragraph commented="no" display-inline="no-display-inline" id="ID53D836D2E8204E789C58A5ED9E82F6C9"><enum>(1)</enum><text display-inline="yes-display-inline">Evaluate and make known the effectiveness

			 of model plans used by schools to reduce and prevent childhood obesity.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID54D2EF48932E48F6A8AF576C46C9295F"><enum>(2)</enum><text display-inline="yes-display-inline">Create a website to assist in the

			 distribution of successful plans, best practices, and other information to

			 assist elementary schools, middle schools, and the public to develop and

			 implement efforts to reduce and prevent childhood obesity.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID945D70D51A5E45919C3E29752B51EC87"><enum>(3)</enum><text display-inline="yes-display-inline">Participate in meetings, conferences,

			 courses, and training workshops.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID65450F9A666D4D35B1CB741E6E7F54FE"><enum>(4)</enum><text display-inline="yes-display-inline">Assist in the distribution of data

			 concerning childhood obesity.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID99AA1EE2EE9D4EA49B0CF0E2FA0D7D9A"><enum>(5)</enum><text display-inline="yes-display-inline">Make Challenge awards, pursuant to

			 subsection (e), to elementary schools, middle schools, and local educational

			 agencies for the successful development and implementation of school-based

			 plans.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID52D976C9530F41C180E0C72A322AD2A6"><enum>(6)</enum><text display-inline="yes-display-inline">Other activities to carry out the purpose

			 described in subsection (b).</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID23126FE358314B729AF3F128474183ED"><enum>(e)</enum><header>Challenge

			 awards</header>

					<paragraph commented="no" display-inline="no-display-inline" id="IDD33708740663461CA9393604B392FE95"><enum>(1)</enum><header>Program

			 authorized</header><text display-inline="yes-display-inline">The Foundation may

			 provide Challenge awards to elementary schools, middle schools, and local

			 educational agencies that submit applications under paragraph (2).</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5BFC297C092C46C488E13297EED372ED"><enum>(2)</enum><header>Application</header><text display-inline="yes-display-inline">Each elementary school, middle school, or

			 local educational agency that desires to receive a Challenge award under this

			 subsection shall submit an application that includes a plan to reduce and

			 prevent childhood obesity to the Foundation at such time, in such manner, and

			 accompanied by such additional information as the Foundation may reasonably

			 require.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7E9A60F456FC49C998BAE67B8AAC5094"><enum>(3)</enum><header>Selection

			 criteria</header><text display-inline="yes-display-inline">In the program

			 authorized under paragraph (1), the Foundation shall provide Challenge awards

			 based on—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="IDC846F5912BA74FBFACCB62316678AAE9"><enum>(A)</enum><text display-inline="yes-display-inline">the success of the plans of the elementary

			 schools, middle schools, and local educational agencies in meeting the plans’

			 stated goals;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID69D6AD45ECC84584B8F8D56AB1491D72"><enum>(B)</enum><text display-inline="yes-display-inline">the number of children in the community

			 served by the elementary school, middle school, or local educational agency who

			 are in need of assistance in addressing obesity; and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9B0F80B47CDE489FA8DE52FB6FA08A40"><enum>(C)</enum><text display-inline="yes-display-inline">other criteria as determined by the

			 Foundation.</text>

						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDCFB1AF653127452682E24C70A998AFCA"><enum>(f)</enum><header>General

			 structure of Foundation; nonprofit status</header>

					<paragraph commented="no" display-inline="no-display-inline" id="ID377766A4C77A4C66B2B6518DBE99A391"><enum>(1)</enum><header>Board of

			 directors</header><text display-inline="yes-display-inline">The Foundation

			 shall have a board of directors (referred to in this title as the

			 <quote>Board</quote>), which shall be established and conducted in accordance

			 with subsection (g). The Board shall establish the general policies of the

			 Foundation for carrying out subsection (b), including the establishment of the

			 bylaws of the Foundation.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD8D077703EF8429BA9F89D5B17154B57"><enum>(2)</enum><header>Executive

			 Director</header><text display-inline="yes-display-inline">The Foundation shall

			 have an executive director (referred to in this title as the

			 <quote>Director</quote>), who shall be appointed by the Board, who shall serve

			 at the pleasure of the Board, and for whom the Board shall establish the rate

			 of compensation. Subject to compliance with the policies and bylaws established

			 by the Board pursuant to paragraph (1), the Director shall be responsible for

			 the daily operations of the Foundation in carrying out subsection (b).</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDCAFDA7C311E34BF19B3B33F49D07D759"><enum>(3)</enum><header>Nonprofit

			 status</header><text display-inline="yes-display-inline">In carrying out

			 subsection (b), the Board shall establish such policies and bylaws under

			 paragraph (1), and the Director shall carry out such activities under paragraph

			 (2), as may be necessary to ensure that the Foundation maintains status as an

			 organization that—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="IDCE895D427A924D248E7FFBF55736FACB"><enum>(A)</enum><text display-inline="yes-display-inline">is described in subsection (c)(3) of

			 section 501 of the Internal Revenue Code of 1986; and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6D4FB8A42B864960BB1DA4D8E01E51D3"><enum>(B)</enum><text display-inline="yes-display-inline">is, under subsection (a) of such section,

			 exempt from taxation.</text>

						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDBD5AD97F24E745A493E1FCFFAD83C052"><enum>(g)</enum><header>Board of

			 directors</header>

					<paragraph commented="no" display-inline="no-display-inline" id="IDFA1936931D034735BD2457EED0487F62"><enum>(1)</enum><header>Certain

			 bylaws</header>

						<subparagraph commented="no" display-inline="no-display-inline" id="ID169A72234BB24DDC85DF5C82B1869255"><enum>(A)</enum><header>Inclusions</header><text display-inline="yes-display-inline">In establishing bylaws under subsection

			 (f)(1), the Board shall ensure that the bylaws of the Foundation include bylaws

			 for the following:</text>

							<clause commented="no" display-inline="no-display-inline" id="ID5693AB00FC964B26B8907DB849DFBC4B"><enum>(i)</enum><text display-inline="yes-display-inline">Policies for the selection of the officers,

			 employees, agents, and contractors of the Foundation.</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="ID0F99BFF7354940909BEC364E52AE4C43"><enum>(ii)</enum><text display-inline="yes-display-inline">Policies, including ethical standards, for

			 the acceptance and disposition of donations to the Foundation and for the

			 disposition of the assets of the Foundation.</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="ID8870C549896B456FB049E156B82BD7D6"><enum>(iii)</enum><text display-inline="yes-display-inline">Policies for the conduct of the general

			 operations of the Foundation.</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="ID6C1A4C664B2E414BB5235B3D82D7509C"><enum>(iv)</enum><text display-inline="yes-display-inline">Policies for writing, editing, printing,

			 and publishing of books and other materials, and the acquisition of patents and

			 licenses for devices and procedures developed by the Foundation.</text>

							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID218D0AEE966C44509104C1C3E4067718"><enum>(B)</enum><header>Exclusions</header><text display-inline="yes-display-inline">In establishing bylaws under subsection

			 (f)(1), the Board shall ensure that the bylaws of the Foundation (and

			 activities carried out under the bylaws) do not—</text>

							<clause commented="no" display-inline="no-display-inline" id="ID326C941AD9D746959BE7C0A53D448E21"><enum>(i)</enum><text display-inline="yes-display-inline">reflect unfavorably upon the ability of the

			 Foundation, or the Department, to carry out its responsibilities or official

			 duties in a fair and objective manner; or</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="ID2AA1FEFF05F64427BA4FE89A09F12068"><enum>(ii)</enum><text display-inline="yes-display-inline">compromise, or appear to compromise, the

			 integrity of any governmental program or any officer or employee involved in

			 such program.</text>

							</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID413AD9B3B61C48F9B0904EBE268A0E62"><enum>(2)</enum><header>Composition</header>

						<subparagraph commented="no" display-inline="no-display-inline" id="IDC218DD582C7449018D3BDF97919040AC"><enum>(A)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Subject to

			 subparagraph (B), the Board shall be composed of 7 individuals, appointed in

			 accordance with paragraph (4), who collectively possess education or experience

			 appropriate for representing the fields of children’s health, nutrition, and

			 physical fitness or organizations active in reducing and preventing childhood

			 obesity. Each such individual shall be a voting member of the Board.</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID280825FFB59A4FFD8ABD0166F920E838"><enum>(B)</enum><header>Greater

			 number</header><text display-inline="yes-display-inline">The Board may, through

			 amendments to the bylaws of the Foundation, provide that the number of members

			 of the Board shall be a greater number than the number specified in

			 subparagraph (A).</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD173550C771F41308CCCE958531779FC"><enum>(3)</enum><header>Chairperson</header><text display-inline="yes-display-inline">The Board shall, from among the members of

			 the Board, designate an individual to serve as the Chairperson of the Board

			 (referred to in this subsection as the <quote>Chairperson</quote>).</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4761E61C642345FBA30F5B8B563FD21D"><enum>(4)</enum><header>Appointments,

			 vacancies, and terms</header><text display-inline="yes-display-inline">Subject

			 to subsection (k) (regarding the initial membership of the Board), the

			 following shall apply to the Board:</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="IDB833B8D125C6455B92A98CACB17D20F9"><enum>(A)</enum><text display-inline="yes-display-inline">Any vacancy in the membership of the Board

			 shall be filled by appointment by the Board, after consideration of suggestions

			 made by the Chairperson and the Director regarding the appointments. Any such

			 vacancy shall be filled not later than the expiration of the 180-day period

			 beginning on the date on which the vacancy occurs.</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID19C6AEABF6364ED4BA49769D9E1D555A"><enum>(B)</enum><text display-inline="yes-display-inline">The term of office of each member of the

			 Board appointed under subparagraph (A) shall be 5 years. A member of the Board

			 may continue to serve after the expiration of the term of the member until the

			 expiration of the 180-day period beginning on the date on which the term of the

			 member expires.</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDA94FD2CE97B14E2284A1BC725AE8CE47"><enum>(C)</enum><text display-inline="yes-display-inline">A vacancy in the membership of the Board

			 shall not affect the power of the Board to carry out the duties of the Board.

			 If a member of the Board does not serve the full term applicable under

			 subparagraph (B), the individual appointed to fill the resulting vacancy shall

			 be appointed for the remainder of the term of the predecessor of the

			 individual.</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID48F5FAE0E13A41F89F238E967C28D514"><enum>(5)</enum><header>Compensation</header><text display-inline="yes-display-inline">Members of the Board may not receive

			 compensation for service on the Board. The members may be reimbursed for

			 travel, subsistence, and other necessary expenses incurred in carrying out the

			 duties of the Board.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDD7C8289609EE44ECAEDA644B7886571E"><enum>(h)</enum><header>Certain

			 responsibilities of executive Director</header><text display-inline="yes-display-inline">In carrying out subsection (f)(2), the

			 Director shall carry out the following functions:</text>

					<paragraph commented="no" display-inline="no-display-inline" id="IDBDBB2EE8408E4FC99901241AEE893F90"><enum>(1)</enum><text display-inline="yes-display-inline">Hire, promote, compensate, and discharge

			 officers and employees of the Foundation, and define the duties of the officers

			 and employees.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID26FEF34E3F3E4C8BA997D6656B412A4B"><enum>(2)</enum><text display-inline="yes-display-inline">Accept and administer donations to the

			 Foundation, and administer the assets of the Foundation.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1D3CD0A0A18D4A25B643A5DD3E626386"><enum>(3)</enum><text display-inline="yes-display-inline">Establish a process for the selection of

			 candidates for holding endowed positions under subsection (c).</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4D9B6A57F87D43CFB48958E5E81DC54F"><enum>(4)</enum><text display-inline="yes-display-inline">Enter into such financial agreements as are

			 appropriate in carrying out the activities of the Foundation.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2C463B7007274D2084BE66F7DD83F1D8"><enum>(5)</enum><text display-inline="yes-display-inline">Take such action as may be necessary to

			 acquire patents and licenses for devices and procedures developed by the

			 Foundation and the employees of the Foundation.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2AF58D6EA0AC46C9B98D5B81726BDE6C"><enum>(6)</enum><text display-inline="yes-display-inline">Adopt, alter, and use a corporate seal,

			 which shall be judicially noticed.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0A1CC9BAAB5440B7910EFEA5FC7821E9"><enum>(7)</enum><text display-inline="yes-display-inline">Commence and respond to judicial

			 proceedings in the name of the Foundation.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID47AC4AFA2C4B4FED8CC9AC43025D745A"><enum>(8)</enum><text display-inline="yes-display-inline">Other functions that are appropriate in the

			 determination of the Director.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID2FCA046067FB4B3F9A78DB16E889E5DD"><enum>(i)</enum><header>General

			 provisions</header>

					<paragraph commented="no" display-inline="no-display-inline" id="ID31F9B29296DC4E18B726F9B577CB4B18"><enum>(1)</enum><header>Authority for

			 accepting funds</header><text display-inline="yes-display-inline">The Secretary

			 of Health and Human Services (referred to in this title as the

			 <quote>Secretary</quote>) may accept and utilize, on behalf of the Federal

			 Government, any gift, donation, bequest, or devise of real or personal property

			 from the Foundation for the purpose of aiding or facilitating the work of the

			 Department. Funds may be accepted and utilized by the Secretary under the

			 preceding sentence without regard to whether the funds are designated as

			 general-purpose funds or special-purpose funds.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID01AE5D8AB02949378F0806107D3530B2"><enum>(2)</enum><header>Authority for

			 acceptance of voluntary services</header>

						<subparagraph commented="no" display-inline="no-display-inline" id="ID50292EADE24145D2BD5E37A58A184FB2"><enum>(A)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Secretary may

			 accept, on behalf of the Federal Government, any voluntary services provided to

			 the Department by the Foundation for the purpose of aiding or facilitating the

			 work of the Department. In the case of an individual, the Secretary may accept

			 the services provided under the preceding sentence by the individual for not

			 more than 2 years.</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID963C03EBF23146A58C9544AD385F0975"><enum>(B)</enum><header>Non-federal

			 government employees</header><text display-inline="yes-display-inline">The

			 limitation established in subparagraph (A) regarding the period of time in

			 which services may be accepted applies to each individual who is not an

			 employee of the Federal Government and who serves in association with the

			 Department pursuant to financial support from the Foundation.</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDA25FDFAD8F5A452EAC85BE13C57A9938"><enum>(3)</enum><header>Administrative

			 control</header><text display-inline="yes-display-inline">No officer, employee,

			 or member of the Board may exercise any administrative or managerial control

			 over any Federal employee.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID763B84C9BE8E46AAA574EA60B59D9C49"><enum>(4)</enum><header>Applicability

			 of certain standards to non-federal employees</header><text display-inline="yes-display-inline">In the case of any individual who is not an

			 employee of the Federal Government and who serves in association with the

			 Department pursuant to financial support from the Foundation, the Foundation

			 shall negotiate a memorandum of understanding with the individual and the

			 Secretary specifying that the individual—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="IDE6641D76BA8C4DB1B150BE68600E99C8"><enum>(A)</enum><text display-inline="yes-display-inline">shall be subject to the ethical and

			 procedural standards regulating Federal employment, scientific investigation,

			 and research findings (including publications and patents) that are required of

			 individuals employed by the Department, including standards under this Act, the

			 Ethics in Government Act of 1978 (5 U.S.C. App.), and the Federal Technology

			 Transfer Act of 1986 (<external-xref legal-doc="public-law" parsable-cite="pl/99/502">Public Law 99–502</external-xref>;

			 <external-xref legal-doc="statute-at-large" parsable-cite="stat/100/1785">100

			 Stat. 1785</external-xref>); and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID210F3AFB6CFD4492A43AD6A0ECD348AE"><enum>(B)</enum><text display-inline="yes-display-inline">shall be subject to such ethical and

			 procedural standards under chapter 11 of title 18, United States Code (relating

			 to conflicts of interest), as the Secretary determines is appropriate, except

			 such memorandum may not provide that the individual shall be subject to the

			 standards of section 209 of such chapter.</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDAB72689A949D4835AA9683095352F893"><enum>(5)</enum><header>Financial

			 conflicts of interest</header><text display-inline="yes-display-inline">Any

			 individual who is an officer, employee, or member of the Board may not directly

			 or indirectly participate in the consideration or determination by the

			 Foundation of any question affecting—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="ID24987148234242D58762F7B1C6C2239C"><enum>(A)</enum><text display-inline="yes-display-inline">any direct or indirect financial interest

			 of the individual; or</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6233D473D2624C878B5F396AB6429330"><enum>(B)</enum><text display-inline="yes-display-inline">any direct or indirect financial interest

			 of any business organization or other entity of which the individual is an

			 officer or employee or in which the individual has a direct or indirect

			 financial interest.</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3A6F45804B2740E89D3BAFBD0CA97C18"><enum>(6)</enum><header>Audits;

			 availability of records</header><text display-inline="yes-display-inline">The

			 Foundation shall—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="ID30521CE526BD4D0D8C263967561F5F2D"><enum>(A)</enum><text display-inline="yes-display-inline">provide for biennial audits of the

			 financial condition of the Foundation; and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4DC9851E6B7B4DF0A8BBB5E341BB2278"><enum>(B)</enum><text display-inline="yes-display-inline">make such audits, and all other records,

			 documents, and other papers of the Foundation, available to the Secretary and

			 the Comptroller General of the United States for examination or audit.</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID43E30EEBC3D14AC8A619A37FDD58BB61"><enum>(7)</enum><header>Reports</header>

						<subparagraph commented="no" display-inline="no-display-inline" id="ID96E15A996D604468AF468A8556ABF7A5"><enum>(A)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Not later than

			 February 1 of each fiscal year, the Foundation shall publish a report

			 describing the activities of the Foundation during the preceding fiscal year.

			 Each such report shall include for the fiscal year involved a comprehensive

			 statement of the operations, activities, financial condition, and

			 accomplishments of the Foundation.</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9200435396E64647A3197586C3C8D7DD"><enum>(B)</enum><header>Inclusions</header><text display-inline="yes-display-inline">With respect to the financial condition of

			 the Foundation, each report under subparagraph (A) shall include the source,

			 and a description, of all gifts to the Foundation of real or personal property,

			 and the source and amount of all gifts to the Foundation of money. Each such

			 report shall include a specification of any restrictions on the purposes for

			 which gifts to the Foundation may be used.</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDC7DDA10424AC40AE8729C924B4D0B00B"><enum>(C)</enum><header>Public

			 inspection</header><text display-inline="yes-display-inline">The Foundation

			 shall make copies of each report submitted under subparagraph (A) available for

			 public inspection, and shall upon request provide a copy of the report to any

			 individual for a charge not exceeding the cost of providing the copy.</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5904B3933E8743C2926BCEED8F6F7365"><enum>(8)</enum><header>Liaisons</header><text display-inline="yes-display-inline">The Secretary shall appoint liaisons to the

			 Foundation from relevant Federal agencies, including the Office of the Surgeon

			 General and the Centers for Disease Control and Prevention. The Secretary of

			 Agriculture shall designate liaisons to the Foundation as appropriate.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3B2142A31A5E4ED8B0A95DF87C28704E"><enum>(9)</enum><header>Inclusion of

			 the president’s Council</header><text display-inline="yes-display-inline">The

			 Foundation shall ensure that the President’s Council on Physical Fitness is

			 included in the activities of the Foundation.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID314A2CE4587F45F78B27A7B210C751A2"><enum>(j)</enum><header>Federal

			 funding</header>

					<paragraph commented="no" display-inline="no-display-inline" id="ID45030161E3144511954E4BE5A0050BB9"><enum>(1)</enum><header>Authority for

			 annual grants</header>

						<subparagraph commented="no" display-inline="no-display-inline" id="IDC34952239F204C8DAFE2566AFCFE86BD"><enum>(A)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Secretary

			 shall—</text>

							<clause commented="no" display-inline="no-display-inline" id="ID56EE73D3375C4CC3B71C66EE5D5180FA"><enum>(i)</enum><text display-inline="yes-display-inline">for fiscal year 2006, make a grant to an

			 entity described in subsection (k)(9) (relating to the establishment of a

			 committee to establish the Foundation);</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="ID04CDBB70C9E04BE09F22148D586B7F8C"><enum>(ii)</enum><text display-inline="yes-display-inline">for fiscal years 2007 and 2008, make a

			 grant to the committee established under such subsection, or if the Foundation

			 has been established, to the Foundation; and</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="ID6CAD923CEF07488491FF772E05AAC1C2"><enum>(iii)</enum><text display-inline="yes-display-inline">for fiscal year 2009 and each subsequent

			 fiscal year, make a grant to the Foundation.</text>

							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID26325EAEA6D84DC9B7773474526B429A"><enum>(B)</enum><header>Rules on

			 expenditures</header><text display-inline="yes-display-inline">A grant under

			 subparagraph (A) may be expended—</text>

							<clause commented="no" display-inline="no-display-inline" id="IDF18A0C7198E945A48F94599144C76075"><enum>(i)</enum><text display-inline="yes-display-inline">in the case of an entity receiving the

			 grant under subparagraph (A)(i), only for the purpose of carrying out the

			 duties established in subsection (k)(9) for the entity;</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="IDFDCB54F153B245209549EE78B3888F34"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of the committee established

			 under subsection (k)(9), only for the purpose of carrying out the duties

			 established in subsection (k) for the committee; and</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="ID9357C3CED017482EBCED4099977703BE"><enum>(iii)</enum><text display-inline="yes-display-inline">in the case of the Foundation, only for the

			 purpose of the administrative expenses of the Foundation.</text>

							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6768C1FE9B784E69A17DCD228A3E7650"><enum>(C)</enum><header>Restriction</header><text display-inline="yes-display-inline">A grant under subparagraph (A) may not be

			 expended to provide amounts for the fund established under subsection

			 (c).</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID7FF997719EE242F6940A4861DE9237D3"><enum>(D)</enum><header>Unobligated

			 grant funds</header><text display-inline="yes-display-inline">For the purposes

			 described in subparagraph (B)—</text>

							<clause commented="no" display-inline="no-display-inline" id="ID038F1220D3FC4A3CAC36BB2DD1CD14FA"><enum>(i)</enum><text display-inline="yes-display-inline">any portion of the grant made under

			 subparagraph (A)(i) for fiscal year 2006 that remains unobligated after the

			 entity receiving the grant completes the duties established in subsection

			 (k)(9) for the entity shall be available to the committee established under

			 such subsection; and</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="ID5344623447A54B71932642B4338B6751"><enum>(ii)</enum><text display-inline="yes-display-inline">any portion of a grant under subparagraph

			 (A) made for fiscal year 2006 or 2007 that remains unobligated after such

			 committee completes the duties established in such subsection for the committee

			 shall be available to the Foundation.</text>

							</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4609B1427A6B498C87990D3BDFCD7F42"><enum>(2)</enum><header>Funding for

			 grants</header>

						<subparagraph commented="no" display-inline="no-display-inline" id="IDF51E93C2BB1D4183B70912B801C00F53"><enum>(A)</enum><header>In

			 general</header><text display-inline="yes-display-inline">For the purpose of

			 grants under paragraph (1), there is authorized to be appropriated $2,200,000

			 for each fiscal year.</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID35C29DA6A15C43F6889C95FD0270BF54"><enum>(B)</enum><header>Programs of the

			 Department</header><text display-inline="yes-display-inline">For the purpose of

			 grants under paragraph (1), the Secretary may for each fiscal year make

			 available not more than $2,200,000 from the amounts appropriated for the fiscal

			 year for the programs of the Department. Such amounts may be made available

			 without regard to whether amounts have been appropriated under subparagraph

			 (A).</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID451893DB17564CAA90356E00868258E9"><enum>(3)</enum><header>Certain

			 restriction</header><text display-inline="yes-display-inline">If the Foundation

			 receives Federal funds for the purpose of serving as a fiscal intermediary

			 between Federal agencies, the Foundation may not receive such funds for the

			 indirect costs of carrying out such purpose in an amount exceeding 10 percent

			 of the direct costs of carrying out such purpose. The preceding sentence may

			 not be construed as authorizing the expenditure of any grant under paragraph

			 (1) for such purpose.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID7E6E2F06A48D4D5EA1D978DFE4FC89B8"><enum>(k)</enum><header>Committee for

			 establishment of Foundation</header>

					<paragraph commented="no" display-inline="no-display-inline" id="IDE39225DB179E4B2DBA691BAD19FF9595"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">There shall be

			 established, in accordance with this subsection and subsection (j)(1), a

			 committee to carry out the functions described in paragraph (2) (referred to in

			 this subsection as the <quote>Committee</quote>).</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDEFC5B3F019174C1A9C9DB646EBCFB7A5"><enum>(2)</enum><header>Functions</header><text display-inline="yes-display-inline">The functions referred to in paragraph (1)

			 for the Committee are as follows:</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="ID5681C6CEA8DC4CFEB7E468F7D52DBC6F"><enum>(A)</enum><text display-inline="yes-display-inline">To carry out such activities as may be

			 necessary to incorporate the Foundation under the laws of the State involved,

			 including serving as incorporators for the Foundation. Such activities shall

			 include ensuring that the articles of incorporation for the Foundation require

			 that the Foundation be established and operated in accordance with the

			 applicable provisions of this title (or any successor to this title), including

			 such provisions as may be in effect pursuant to amendments enacted after the

			 date of enactment of this Act.</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID60F5D7AC2A8B4180B6771DB3B137AA46"><enum>(B)</enum><text display-inline="yes-display-inline">To ensure that the Foundation qualifies for

			 and maintains the status described in subsection (f)(3) (regarding

			 taxation).</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID31FE59F1A2AA40D6B410675E5C901D20"><enum>(C)</enum><text display-inline="yes-display-inline">To establish the general policies and

			 initial bylaws of the Foundation, which bylaws shall include the bylaws

			 described in subsections (f)(3) and (g)(1).</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6DF513570A9C4263A0D83525F96DD9A7"><enum>(D)</enum><text display-inline="yes-display-inline">To provide for the initial operation of the

			 Foundation, including providing for quarters, equipment, and staff.</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDE80D3D1C725B4971BF7672AC82F5BAB2"><enum>(E)</enum><text display-inline="yes-display-inline">To appoint the initial members of the Board

			 in accordance with the requirements established in subsection (g)(2)(A) for the

			 composition of the Board, and in accordance with such other qualifications as

			 the Committee may determine to be appropriate regarding such composition. Of

			 the members so appointed—</text>

							<clause commented="no" display-inline="no-display-inline" id="ID8A474477CF1046B5AAF94A23D4011F97"><enum>(i)</enum><text display-inline="yes-display-inline">2 shall be appointed to serve for a term of

			 3 years;</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="ID546B674F36854D428FD3595C138E4CCE"><enum>(ii)</enum><text display-inline="yes-display-inline">2 shall be appointed to serve for a term of

			 4 years; and</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="ID7A0F051F2EB24AA49CB70F171642F54E"><enum>(iii)</enum><text display-inline="yes-display-inline">3 shall be appointed to serve for a term of

			 5 years.</text>

							</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9435C7A69623493194D6845A4034E2FD"><enum>(3)</enum><header>Completion of

			 functions of Committee; initial meeting of Board</header>

						<subparagraph commented="no" display-inline="no-display-inline" id="IDC991B675E76E49B884EDD2F7AC3636E0"><enum>(A)</enum><header>Completion of

			 functions</header><text display-inline="yes-display-inline">The Committee shall

			 complete the functions required in paragraph (1) not later than September 30,

			 2008. The Committee shall terminate upon the expiration of the 30-day period

			 beginning on the date on which the Secretary determines that the functions have

			 been completed.</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDD1D454D0E9424C8999E8B33020052ABF"><enum>(B)</enum><header>Initial

			 meeting</header><text display-inline="yes-display-inline">The initial meeting

			 of the Board shall be held not later than November 1, 2008.</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC31116E8160E4253AA5A6209A4C23782"><enum>(4)</enum><header>Composition</header><text display-inline="yes-display-inline">The Committee shall be composed of 5

			 members, each of whom shall be a voting member. Of the members of the

			 Committee—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="ID5EC10245763F44AEAF0612AFF6C2DF52"><enum>(A)</enum><text display-inline="yes-display-inline">no fewer than 2 of the members shall have

			 expertise in children’s health, nutrition, and physical activity; and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDDE4B236E6D4E4C108016D2FADFBEB158"><enum>(B)</enum><text display-inline="yes-display-inline">no fewer than 2 of the members shall have

			 broad, general experience in nonprofit private organizations (without regard to

			 whether the individuals have experience in children’s health, nutrition, and

			 physical activity).</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1B5734AC9CA7476C8E667DB207BA4866"><enum>(5)</enum><header>Chairperson</header><text display-inline="yes-display-inline">The Committee shall, from among the members

			 of the Committee, designate an individual to serve as the Chairperson of the

			 Committee.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID01B2D7C1D14446BFACEEE4F10DF56863"><enum>(6)</enum><header>Terms;

			 vacancies</header><text display-inline="yes-display-inline">The term of members

			 of the Committee shall be for the duration of the Committee. A vacancy in the

			 membership of the Committee shall not affect the power of the Committee to

			 carry out the duties of the Committee. If a member of the Committee does not

			 serve the full term, the individual appointed by the Secretary to fill the

			 resulting vacancy shall be appointed for the remainder of the term of the

			 predecessor of the individual.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID638E51E6217B4A768E144250CF1F15F1"><enum>(7)</enum><header>Compensation</header><text display-inline="yes-display-inline">Members of the Committee may not receive

			 compensation for service on the Committee. Members of the Committee may be

			 reimbursed for travel, subsistence, and other necessary expenses incurred in

			 carrying out the duties of the Committee.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6A78B9BDCC11426D8D43BA0D619B46DC"><enum>(8)</enum><header>Committee

			 support</header><text display-inline="yes-display-inline">The Secretary may,

			 from amounts available to the Secretary for the general administration of the

			 Department, provide staff and financial support to assist the Committee with

			 carrying out the functions described in paragraph (2). In providing such staff

			 and support, the Director may both detail employees and contract for

			 assistance.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7BBD3724C09D4A2BBD7857FA5E149504"><enum>(9)</enum><header>Grant for

			 establishment of Committee</header>

						<subparagraph commented="no" display-inline="no-display-inline" id="IDD4CA5FAE775C447E8FD22FA5E9B56B36"><enum>(A)</enum><header>In

			 general</header><text display-inline="yes-display-inline">With respect to a

			 grant under paragraph (1)(A)(i) of subsection (j) for fiscal year 2006, an

			 entity described in this paragraph is a private nonprofit entity with

			 significant experience in children’s health, nutrition, and physical activity.

			 Not later than 180 days after the date of enactment of this Act, the Secretary

			 shall make the grant to such an entity (subject to the availability of funds

			 under paragraph (2) of such subsection).</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID5106DF6171A54FEABCFC042ADA28C6D9"><enum>(B)</enum><header>Conditions</header><text display-inline="yes-display-inline">The grant referred to in subparagraph (A)

			 may be made to an entity only if the entity agrees that—</text>

							<clause commented="no" display-inline="no-display-inline" id="IDB996173EC66B4C038C73600309B74CB7"><enum>(i)</enum><text display-inline="yes-display-inline">the entity will establish a committee that

			 is composed in accordance with paragraph (4); and</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="IDDBFA436938DC450AA00B99BDD9B96D50"><enum>(ii)</enum><text display-inline="yes-display-inline">the entity will not select an individual

			 for membership on the Committee unless the individual agrees that the Committee

			 will operate in accordance with each of the provisions of this subsection that

			 relate to the operation of the Committee.</text>

							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDA514563140274A32ACFC9AF6887E98E6"><enum>(C)</enum><header>Agreement</header><text display-inline="yes-display-inline">The Secretary may make a grant referred to

			 in subparagraph (A) only if the applicant for the grant makes an agreement that

			 the grant will not be expended for any purpose other than carrying out

			 subparagraph (B). Such a grant may be made only if an application for the grant

			 is submitted to the Secretary containing such agreement, and the application is

			 in such form, is made in such manner, and contains such other agreements and

			 such assurances and information as the Secretary determines to be necessary to

			 carry out this paragraph.</text>

						</subparagraph></paragraph></subsection></section></title></legis-body>
