			<section commented="no" display-inline="no-display-inline" id="ID5CEF5781D874461C88F95DC3F7EE85B2" section-type="subsequent-section"><enum>100.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="IDEB71E19393E44E95BBEEDE657C383C26"><enum>(1)</enum><text display-inline="yes-display-inline">violent crime and drug trafficking are

			 pervasive problems at the national, State, and local level;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1E9346B5E6EA45749727D3B6A1BEA491"><enum>(2)</enum><text display-inline="yes-display-inline">the crime rate is exacerbated by the

			 association of persons in gangs to commit acts of violence and drug

			 offenses;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDB2E546BA3BBE4063A2FA12D63BCDE321"><enum>(3)</enum><text display-inline="yes-display-inline">according to the most recent National Drug

			 Threat Assessment, criminal street gangs are responsible for the distribution

			 of much of the cocaine, methamphetamine, heroin, and other illegal drugs being

			 distributed in rural and urban communities throughout the United States;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE0837B94F276473A818AEEEC6778EF7F"><enum>(4)</enum><text display-inline="yes-display-inline">gangs commit acts of violence or drug

			 offenses for numerous motives, such as membership in or loyalty to the gang,

			 for protecting gang territory, and for profit;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID45315095839844D0A942FBB724C79BD6"><enum>(5)</enum><text display-inline="yes-display-inline">gang presence has a pernicious effect on

			 the free flow of commerce in local businesses and directly affects the freedom

			 and security of communities plagued by gang activity;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID14D821CE827E489C88ADC8CAD15079BA"><enum>(6)</enum><text display-inline="yes-display-inline">gangs often recruit and utilize minors to

			 engage in acts of violence and other serious offenses out of a belief that the

			 criminal justice systems are more lenient on juvenile offenders;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1DCB89F25BF347C5AF444A122BCF6144"><enum>(7)</enum><text display-inline="yes-display-inline">gangs often intimidate and threaten

			 witnesses to prevent successful prosecutions;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDB1E3036AEB0A44CA98B2070B6897DFC1"><enum>(8)</enum><text display-inline="yes-display-inline">gang recruitment can be deterred both

			 through increased vigilance, strong criminal penalties, equal partnerships with

			 State and local law enforcement, and proactive intervention efforts,

			 particularly targeted at juveniles, prior to gang involvement; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9FFAC50216334CE4AE8145FEDE59DB74"><enum>(9)</enum><text display-inline="yes-display-inline">State and local prosecutors, in hearings

			 before the Committee on the Judiciary of the Senate, enlisted Congress’s help

			 in the prevention, investigation, and prosecution of gang crimes and in the

			 protection of witnesses and victims of gang crimes.</text>

				</paragraph></section><section commented="no" display-inline="no-display-inline" id="ID61C85F0ADED54F319DD61C6DC60E28F4" section-type="subsequent-section"><enum>101.</enum><header>Criminal street

			 gangs; definitions</header><text display-inline="no-display-inline">Section 521

			 of title 18, United States Code, is amended to read as follows:</text>

				<quoted-block display-inline="no-display-inline" id="ID23F16EDB1CBF4F43B4A90FEE0353F69C" style="USC">

					<section commented="no" display-inline="no-display-inline" id="IDF4A1E812E9D143468F43DE89580AE421" section-type="subsequent-section"><enum>521.</enum><header>Criminal street

				gang; definitions</header><text display-inline="no-display-inline">As used in

				this chapter:</text>

						<paragraph commented="no" display-inline="no-display-inline" id="ID076F2F72C86E43599739CD716DA5E6FF"><enum>(1)</enum><header>Criminal street

				gang</header>

							<subparagraph commented="no" display-inline="no-display-inline" id="IDADB26E5911C04DE192EFA7270A1788F0"><enum>(A)</enum><header>In

				general</header><text display-inline="yes-display-inline">The term

				<term>criminal street gang</term> means an ongoing formal or informal group,

				club, organization, or association of 3 or more persons through or for which

				they individually, jointly, or in combination, have committed or attempted to

				commit, for the direct or indirect benefit of, at the direction of, or in

				association with the group, club, organization, or association, 3 or more

				unrelated predicate gang crimes, provided that—</text>

								<clause commented="no" display-inline="no-display-inline" id="ID7AF0550D5BA6495EAA12EEDBA5BB0813"><enum>(i)</enum><text display-inline="yes-display-inline">one of the predicate gang crimes is a

				violent gang crime;</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="ID51AD382EE8F742DA915A1B73F818C906"><enum>(ii)</enum><text display-inline="yes-display-inline">one predicate gang crime must occur after

				the date of enactment of the ANTI-GANG Act, and the last of which must occur

				not later than 10 years (excluding any period of imprisonment) after the

				commission of a prior predicate gang crime; and</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="IDF817C69713D24F0D9126C888EABDF461"><enum>(iii)</enum><text display-inline="yes-display-inline">the activities of the criminal street gang

				must substantially affect interstate or foreign commerce.</text>

								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDCFA3B2F6EB15484B86684AE9A8695725"><enum>(B)</enum><header>Ongoing</header>

								<clause commented="no" display-inline="no-display-inline" id="ID85D318A41EED4FBB9F9EB667C4B45A62"><enum>(i)</enum><header>In

				general</header><text display-inline="yes-display-inline">As used in this

				paragraph, the term <term>ongoing</term>, means that the criminal street gang

				has an independent identity and existence extending beyond the planning or

				carrying out of any offense or series of offenses which happen to be predicate

				gang crimes.</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="IDBA0C256CB0554B31888711B30B61AC0B"><enum>(ii)</enum><header>Factors</header><text display-inline="yes-display-inline">The presence or absence of any of the

				following evidentiary factors is relevant to show the existence or nonexistence

				of an ongoing criminal street gang, or to show that any predicate gang crime

				was committed through or for a criminal street gang:</text>

									<subclause commented="no" display-inline="no-display-inline" id="ID902586F567154641896D01217087C22D"><enum>(I)</enum><text display-inline="yes-display-inline">A common name, insignia, flag, means of

				recognition, secret signal or code.</text>

									</subclause><subclause commented="no" display-inline="no-display-inline" id="ID56DB90E52B544E57815C4C7E6FA1E470"><enum>(II)</enum><text display-inline="yes-display-inline">A common creed, belief, structure,

				leadership or command structure, method of operation or criminal enterprise,

				concentration or specialty.</text>

									</subclause><subclause commented="no" display-inline="no-display-inline" id="ID3B15EDC5C76F47D7AF6AC1FD8D138513"><enum>(III)</enum><text display-inline="yes-display-inline">Membership, age or other qualifications,

				initiation rites, geographical or territorial situs, boundary, or location, or

				other unifying mark, manner, protocol, or method of expressing or indicating

				membership.</text>

									</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4AC7A031D4BD4EC5922B963B3D800C31"><enum>(C)</enum><header>Three or more

				persons</header><text display-inline="yes-display-inline">As used in this

				paragraph, the term <term>3 or more persons</term>, shall not require that the

				same 3 or more persons be involved in 2 or more predicate gang crimes.</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID5F8624C820AF4EED8D3F5B95BAC83789"><enum>(D)</enum><header>Unrelated</header><text display-inline="yes-display-inline">As used in this paragraph, the term

				<term>unrelated</term>, means that the predicate gang crimes are not part of a

				single course of conduct with a single criminal objective, and do not represent

				essentially 1 composite harm even if such gang crimes constitute legally

				distinct offenses occurring at different times. Violent gang crimes committed

				on different days shall always be considered to be unrelated.</text>

							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD50B6D2E2A64445F827690A7CDD81F19"><enum>(2)</enum><header>Predicate gang

				crime</header><text display-inline="yes-display-inline">The term

				<term>predicate gang crime</term>, means any act or threat, or attempted act or

				threat, which is chargeable under Federal or State law, and punishable by

				imprisonment for more than 1 year, involving—</text>

							<subparagraph commented="no" display-inline="no-display-inline" id="ID0143F6520C6F42878BF1D6D6DBE211D1"><enum>(A)</enum><text display-inline="yes-display-inline">a violent gang crime, which

				includes—</text>

								<clause commented="no" display-inline="no-display-inline" id="ID1A8570AFDC8F48318E13DD6B50874990"><enum>(i)</enum><text display-inline="yes-display-inline">murder;</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="IDD46F02E3B66146DA912B6DC932DD2BA6"><enum>(ii)</enum><text display-inline="yes-display-inline">attempted murder;</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="IDD66B169E2EDE451B90CBAE5434E6A208"><enum>(iii)</enum><text display-inline="yes-display-inline">manslaughter;</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="IDE65E968AE23143D8BECB8B9C5DC019CE"><enum>(iv)</enum><text display-inline="yes-display-inline">kidnapping;</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="ID4789B0549A7145F1B8E0DDAB615DD659"><enum>(v)</enum><text display-inline="yes-display-inline">robbery;</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="IDBE8EE8F62F70435D9F701D56C7A5C8C8"><enum>(vi)</enum><text display-inline="yes-display-inline">assault;</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="ID9DEF72BB4F564A0696602008A1CED936"><enum>(vii)</enum><text display-inline="yes-display-inline">extortion;</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="IDAA1F92095B444E1A814A7062C343005B"><enum>(viii)</enum><text display-inline="yes-display-inline">arson;</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="ID6ED4AE9766A24B139A6B18625494C305"><enum>(ix)</enum><text display-inline="yes-display-inline">burglary;</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="ID2B9BFFF6FBF0402DB0EE9F489F113F59"><enum>(x)</enum><text display-inline="yes-display-inline">sexual assault;</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="IDAD72221E716245FEBC19F3C6287D6FAF"><enum>(xi)</enum><text display-inline="yes-display-inline">carjacking; and</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="IDFCBB46353DF84095A5E73A8113BC32A1"><enum>(xii)</enum><text display-inline="yes-display-inline">explosive materials under subsection (d),

				(e), (f), or (i) of section 844;</text>

								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDBF46FBC9685F4608823CDC830EEE809A"><enum>(B)</enum><text display-inline="yes-display-inline">a <quote>serious drug offense</quote>, as

				that term is defined under section 924(e)(2)(A);</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDBABD24CC861544D794598EE7C99E38EB"><enum>(C)</enum><text display-inline="yes-display-inline">obstruction of justice (including offenses

				under sections 1503 and 1510);</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID0DF766A424BE47FEB5A20D36503A0A3A"><enum>(D)</enum><text display-inline="yes-display-inline">tampering with or retaliating against a

				witness, victim, or informant (including offenses under sections 1512 and

				1513);</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID51E94E7FA3754F0384760EC51FDE5D78"><enum>(E)</enum><text display-inline="yes-display-inline">fraud and related activity in connection

				with identification documents or access devices under sections 1028 and

				1029;</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDB32967942E0946ED9B8BC261A14C0647"><enum>(F)</enum><text display-inline="yes-display-inline">interference with commerce by threats of

				violence under section 1951;</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDB01BC0C9E150471ABF6C45129DE89708"><enum>(G)</enum><text display-inline="yes-display-inline">money laundering under section 1956;</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1139AF9D51FC4A63A813C4817914A24E"><enum>(H)</enum><text display-inline="yes-display-inline">engaging in monetary transactions in

				property derived from specified unlawful activity under section 1957;</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDD7226FB973A14CB09A80AF28D9599F32"><enum>(I)</enum><text display-inline="yes-display-inline">the use of interstate commerce facilities

				in the commission of murder-for-hire;</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID788B283FDD214669AFA790BDCBEAF832"><enum>(J)</enum><text display-inline="yes-display-inline">the interstate transportation, sale, or

				receipt of stolen goods under sections 2312 through 2315;</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID84CB88726ECE49EB911CAFB2E0CCFE9D"><enum>(K)</enum><text display-inline="yes-display-inline">the receipt, possession, and transfer of

				firearms, except for violations of section 922(g); or</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDCB928D0C6469476DA5EB29CF97DF6AAA"><enum>(L)</enum><text display-inline="yes-display-inline">any act involving the

				<act-name parsable-cite="INA">Immigration and Nationality Act</act-name>,

				section 274 (relating to bringing in and harboring certain aliens), section 277

				(relating to aiding or assisting certain aliens to enter the United States), or

				section 278 (relating to importation of aliens for immoral purposes).</text>

							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC2B39F80DC5B4F01B3CE136419BF31C8"><enum>(3)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> means each of

				the several States of the United States, the District of Columbia, and any

				commonwealth, territory, or possession of the United

				States.</text>

			</section><section commented="no" display-inline="no-display-inline" id="IDABE4E58D320F466C9D3861A8C391F354" section-type="subsequent-section"><enum>102.</enum><header>Criminal street

			 gangs—prohibited acts, penalties, and forfeiture</header><text display-inline="no-display-inline">Chapter 26 of title 18, United States Code,

			 is amended by adding at the end the following:</text>

				<quoted-block display-inline="no-display-inline" id="ID4886F7D3995E4112AE802BEB49484D57" style="USC">

					<section commented="no" display-inline="no-display-inline" id="ID376067FAE4DC4ED7A91EB268368817CE" section-type="subsequent-section"><enum>522.</enum><header>Prohibited acts;

				penalties and forfeiture</header>

						<subsection commented="no" display-inline="no-display-inline" id="ID27CF146BDFCF44C89C1D250324ACE3E2"><enum>(a)</enum><header>Recruitment and

				retention in criminal street gangs</header><text display-inline="yes-display-inline">It shall be unlawful for any person—</text>

							<paragraph commented="no" display-inline="no-display-inline" id="IDCF42485B432B4042930DCB307F4D6598"><enum>(1)</enum><text display-inline="yes-display-inline">to recruit, solicit, command, employ,

				persuade, induce, entice, or coerce any person to become a member of or

				participate in, any criminal street gang with the intent that the person

				recruited will do any act to effect the criminal activities of a criminal

				street gang; or</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDB8238B7518D34D81AE8C765A7B6F17AA"><enum>(2)</enum><text display-inline="yes-display-inline">by use of force, threat, or intimidation

				directed at any person, or by the infliction of bodily injury upon any person,

				to knowingly prevent a person from leaving a criminal street gang.</text>

							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID1FD3E6B975A04219971BAC77D2633BE0"><enum>(b)</enum><header>Participation

				in a criminal street gang</header><text display-inline="yes-display-inline">It

				shall be unlawful for any person—</text>

							<paragraph commented="no" display-inline="no-display-inline" id="ID8AB3AEE61CED4ED28693F452AFA0E48B"><enum>(1)</enum><text display-inline="yes-display-inline">to do any act with the intent to effect the

				criminal activities of a criminal street gang;</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4377B37683534A2EAAE4B66D099350E9"><enum>(2)</enum><text display-inline="yes-display-inline">to commit, attempt to commit, aid or abet

				the commission of, or conspire to commit any predicate gang crime—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="ID0873655749564F72949010D2B483AEDB"><enum>(A)</enum><text display-inline="yes-display-inline">in furtherance or in aid of the activities

				of the criminal street gang;</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID810B9011586E4F86B2A24B24EAED14F8"><enum>(B)</enum><text display-inline="yes-display-inline">for the direct or indirect benefit of the

				criminal street gang, or in association with the criminal street gang;

				or</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDD1FB66D2F1EB45E8BCFD3645B0CDAD5E"><enum>(C)</enum><text display-inline="yes-display-inline">for the purpose of gaining entrance to, or

				maintaining or increasing position in, the criminal street gang;</text>

								</subparagraph><continuation-text commented="no" continuation-text-level="paragraph">while knowingly being a member of or

				participating in a criminal street gang; or</continuation-text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2DD932D3386644B1B75E09CF30967BEC"><enum>(3)</enum><text display-inline="yes-display-inline">to employ, use, command, counsel, persuade,

				induce, entice, or coerce any individual to commit any predicate gang

				crime—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="IDFE5620A47F3A460981F4411033573943"><enum>(A)</enum><text display-inline="yes-display-inline">in furtherance or in aid of the activities

				of the criminal street gang;</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID551BD7CD1A784698952275A803249F93"><enum>(B)</enum><text display-inline="yes-display-inline">for the direct or indirect benefit of the

				criminal street gang, or in association with the criminal street gang;

				or</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9BF5609C99424485AFE7BF202A4F344B"><enum>(C)</enum><text display-inline="yes-display-inline">for the purpose of gaining entrance to or

				maintaining or increasing position in the criminal street gang;</text>

								</subparagraph><continuation-text commented="no" continuation-text-level="paragraph">while knowingly being a member of or

				participating in a criminal street gang.</continuation-text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID2618E57998DF4AF983FF7751211C44CE"><enum>(c)</enum><header>Witness

				intimidation</header><text display-inline="yes-display-inline">It shall be

				unlawful for any person to travel in interstate or foreign commerce, or use the

				mail or any facility in interstate or foreign commerce, or to employ, use,

				command, counsel, persuade, induce, entice, or coerce any individual to do the

				same, to threaten, influence, or prevent from testifying any witness in a

				Federal or State criminal proceeding—</text>

							<paragraph commented="no" display-inline="no-display-inline" id="IDAD2504ECD3EC476E8AC4EEFAD2B8CFA7"><enum>(1)</enum><text display-inline="yes-display-inline">in furtherance or in aid of the activities

				of a criminal street gang;</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7F8D5226DD014CA595EB8C31ADC03256"><enum>(2)</enum><text display-inline="yes-display-inline">for the direct or indirect benefit of, at

				the direction of, or in association with a criminal street gang; or</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1A1C501064994DA48FAAF97D98A4637B"><enum>(3)</enum><text display-inline="yes-display-inline">for the purpose of gaining entrance to or

				maintaining or increasing position in a criminal street gang.</text>

							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDF1E64AFF233B4DE59E5B842F2594FC45"><enum>(d)</enum><header>Underlying

				offenses</header>

							<paragraph commented="no" display-inline="no-display-inline" id="ID324B2FB5792F4D2CA3C804C123B1C98D"><enum>(1)</enum><header>No limitation

				on underlying offenses</header><text display-inline="yes-display-inline">Nothing in this section shall be construed

				to prohibit the conviction or sentencing of any person for an underlying

				offense that is included in the definition of <quote>predicate gang

				crimes</quote>.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4259E35913FC44D58B032425B1B88DE3"><enum>(2)</enum><header>Venue for

				underlying offenses</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law,

				venue for any Federal underlying offense charged as a predicate gang crime in a

				prosecution under this section shall lie in the same district as a prosecution

				under this section.</text>

							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID49FFED69817A4FFAA89691D3B75C875F"><enum>(e)</enum><header>Penalties</header>

							<paragraph commented="no" display-inline="no-display-inline" id="ID54C582682C9C4562A5FFC0B5DB9D7779"><enum>(1)</enum><header>Recruiting</header><text display-inline="yes-display-inline">Whoever violates subsection (a)(1) or

				(b)(1) of this section shall be fined under this title, or imprisoned not more

				than 3 years, or both; provided that if the person recruited under subsection

				(a)(1) is a minor and the violator is 18 years of age or older, then the

				violator shall be fined under this title, imprisoned not more than 10 years, or

				both.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7194D2EBA6AB44B4AE6D677293FAD3D4"><enum>(2)</enum><header>Preventing from

				leaving</header><text display-inline="yes-display-inline">Whoever violates

				subsection (a)(2) or (c) shall be fined under this title, or imprisoned not

				more than 10 years, or both; provided that if the person prevented from leaving

				under subsection (a)(2) is a minor and the violator is 18 years of age or

				older, then the violator shall be fined under this title, imprisoned not more

				than 15 years, or both.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDACED547119DC4D09939AD99E424A6861"><enum>(3)</enum><header>Gang

				crimes</header><text display-inline="yes-display-inline">Whoever violates

				subsection (b)(2) or (b)(3) shall be fined under this title, imprisoned not

				more than 20 years, or both; except—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="IDE63CED4FBEA14483819D9D70ABF28C39"><enum>(A)</enum><text display-inline="yes-display-inline">where the predicate gang crime is a serious

				drug offense, then whoever violates these subsections shall be fined under this

				title, imprisoned not more than 30 years, or both; or</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6AE364104D5845D482A7B1AE64268F4B"><enum>(B)</enum><text display-inline="yes-display-inline">where the predicate gang crime is a violent

				gang crime, whoever violates these subsections shall be fined under this title,

				imprisoned for any term of years or for life, or both.</text>

								</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID6E78BC53CEBB4459A200E3A28732E031"><enum>(f)</enum><header>Forfeiture</header>

							<paragraph commented="no" display-inline="no-display-inline" id="ID7EB37CC37F1F4A7E88F40C98AB67F04A"><enum>(1)</enum><header>In

				general</header><text display-inline="yes-display-inline">A person who violates

				any provision of this section shall, in addition to any other penalty and

				irrespective of any provision of State law, forfeit to the United

				States—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="ID5B6F6ED1D1B64CA7974CECE1114C06CE"><enum>(A)</enum><text display-inline="yes-display-inline">any property constituting, or derived from,

				any proceeds the person obtained, directly or indirectly, as a result of the

				violation; and</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDCCEEE66084254CC5B696BBA794D21328"><enum>(B)</enum><text display-inline="yes-display-inline">any property used, or intended to be used,

				in any manner or part, to commit, or to facilitate the commission of the

				violation.</text>

								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0B417A4C2B85447AA6E4D696710ABC3E"><enum>(2)</enum><header>Application of

				<act-name parsable-cite="CSA">Controlled Substances

				Act</act-name></header><text display-inline="yes-display-inline">Subsections

				(b), (c), (e), (f), (g), (h), (i), (j), (k), (l), (m), (n), (o), and (p) of

				section 413 of the <act-name parsable-cite="CSA">Controlled Substances

				Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/853">21

				U.S.C. 853</external-xref>) shall apply to a forfeiture under this

				section.</text>

							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID085F8C4508544673BFE7618300ACC4D3"><enum>(g)</enum><header>Certification

				by the United States attorney</header><text display-inline="yes-display-inline">No prosecution of any offense described

				under this section involving a predicate gang crime that is otherwise

				exclusively chargeable under State law shall be undertaken by the United States

				except upon the certification in writing of the Attorney General, the Deputy

				Attorney General, the Associate Attorney General, any Assistant Attorney

				General specially designated by the Attorney General, or the United States

				attorney for the district in which the offense will be prosecuted, after

				consultation with State and local prosecutors, that in his judgment a

				prosecution by the United States is in the public interest and necessary to

				secure substantial justice, which function of certification may not be

				delegated.</text>

						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

			 assistance for <quote>high intensity</quote> interstate gang activity

			 areas</header>

				<subsection commented="no" display-inline="no-display-inline" id="ID950677B970BF49CD9AAFF3541FB5B813"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>

					<paragraph commented="no" display-inline="no-display-inline" id="IDECB7E1820A024137B9B76AEC183C0813"><enum>(1)</enum><header>Governor</header><text display-inline="yes-display-inline">The term <term>Governor</term> means a

			 Governor of a State or the mayor of the District of Columbia.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE734BDE3F33E404EAF10D91779F3306D"><enum>(2)</enum><header>High intensity

			 interstate gang activity area</header><text display-inline="yes-display-inline">The term <term>high intensity interstate

			 gang activity area</term> means an area within a State that is designated as a

			 high intensity interstate gang activity area under subsection (b)(1).</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID48716D10CC41482BA894CC02CA8ACBE0"><enum>(3)</enum><header>High intensity

			 interstate gang and drug trafficking area</header><text display-inline="yes-display-inline">The term <term>high intensity interstate

			 gang and drug trafficking area</term> means an area within a State that is

			 cross-designated as a high intensity interstate gang and drug trafficking area

			 under subsection (b)(2).</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID09AAE439299D4DE69A28B2B13ACA0DA9"><enum>(4)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> means a State

			 of the United States, the District of Columbia, and any commonwealth,

			 territory, or possession of the United States. The term <term>State</term>

			 shall include an <quote>Indian tribe</quote>, as defined under section 102 of

			 the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/479a">25 U.S.C.

			 479a</external-xref>).</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID1233B0871E7A40BA82CB885992EB8429"><enum>(b)</enum><header>High intensity

			 interstate gang activity areas</header>

					<paragraph commented="no" display-inline="no-display-inline" id="IDB9521D71C478448CBCDA6AC7B5EBF3C0"><enum>(1)</enum><header>Designation</header><text display-inline="yes-display-inline">The Attorney General, after consultation

			 with the Governors of appropriate States, may designate specific areas that are

			 located within 1 or more States as high intensity interstate gang activity

			 areas.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5099900AD3B14202AB82A201D8716946"><enum>(2)</enum><header>Cross-designation</header><text display-inline="yes-display-inline">The Attorney General, after consultation

			 with the Governors of appropriate States and the Director of the Office of

			 National Drug Control Policy, may cross-designate specific areas already

			 designated as high intensity interstate drug trafficking areas under section

			 707 of the Office of National Drug Control Policy Reauthorization Act of 1998

			 (<external-xref legal-doc="usc" parsable-cite="usc/21/1706">21 U.S.C.

			 1706</external-xref>) as high intensity interstate gang and drug trafficking

			 areas.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8492C9616512455F8478590FA1B281EC"><enum>(3)</enum><header>Assistance</header><text display-inline="yes-display-inline">In order to provide Federal assistance to

			 high intensity interstate gang activity areas or high intensity interstate gang

			 and drug trafficking areas, the Attorney General shall—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="IDB38A2D941F1848CC95713EA5462F6C2C"><enum>(A)</enum><text display-inline="yes-display-inline">establish criminal street gang enforcement

			 teams, consisting of Federal, State, and local law enforcement authorities, for

			 the coordinated investigation, disruption, apprehension, and prosecution of

			 criminal street gangs and offenders in each high intensity interstate gang

			 activity area or high intensity interstate gang and drug trafficking

			 area;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID8E228F6A926141F48686EB9F6387D659"><enum>(B)</enum><text display-inline="yes-display-inline">direct the reassignment or detailing from

			 any Federal department or agency (subject to the approval of the head of that

			 department or agency, in the case of a department or agency other than the

			 Department of Justice) of personnel to each criminal street gang enforcement

			 team; and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDC303B7FD7A9A4277BE1BE0D19B75BFE9"><enum>(C)</enum><text display-inline="yes-display-inline">provide all necessary funding for the

			 operation of the criminal street gang enforcement team in each high intensity

			 interstate gang activity area or high intensity interstate gang and drug

			 trafficking area.</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1C70A81AAD924F08809ABFDB219A01F2"><enum>(4)</enum><header>Composition of

			 criminal street gang enforcement team</header><text display-inline="yes-display-inline">The team established under paragraph (2)(A)

			 shall consist of agents and officers, where feasible, from—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="IDD7523E892EAE49B6BB358B91F61917D2"><enum>(A)</enum><text display-inline="yes-display-inline">the Bureau of Alcohol, Tobacco, Firearms,

			 and Explosives;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDDDA220D2CD184736ABC28C62FF9BDF33"><enum>(B)</enum><text display-inline="yes-display-inline">the Department of Homeland Security;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9F50AC471EED45E79FDDCD87BDD130F9"><enum>(C)</enum><text display-inline="yes-display-inline">the Department of Housing and Urban

			 Development;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID8ED8A8FC33C94E46A0B05728A52D58B9"><enum>(D)</enum><text display-inline="yes-display-inline">the Drug Enforcement Administration;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID0E17F42B3A3E43DE98C5EC4255AB2CE7"><enum>(E)</enum><text display-inline="yes-display-inline">the Internal Revenue Service;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID199EE96E358F41298215000BAE2D54ED"><enum>(F)</enum><text display-inline="yes-display-inline">the Federal Bureau of Investigation;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID0A881D9C410B4C4A9E834E82771DF1DA"><enum>(G)</enum><text display-inline="yes-display-inline">the United States Marshal’s Service;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3C070552FE204E39BBA8ED843299C991"><enum>(H)</enum><text display-inline="yes-display-inline">the United States Postal Service;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID27F9AEBC3B024672A90C676A25078EFF"><enum>(I)</enum><text display-inline="yes-display-inline">State and local law enforcement; and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDDD02FFE73B2F4415BFF679FB5E15BB2E"><enum>(J)</enum><text display-inline="yes-display-inline">Federal, State, and local

			 prosecutors.</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7046C771335446C6B47868CF54C951FD"><enum>(5)</enum><header>Coordination</header><text display-inline="yes-display-inline">In each area cross-designated as a high

			 intensity interstate gang and drug trafficking area, the team established under

			 paragraph (2)(A) shall fully coordinate its antigang activities with antidrug

			 trafficking activities undertaken by Federal, State, and local officials under

			 section 707 of the Office of National Drug Control Policy Reauthorization Act

			 of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/21/1706">21 U.S.C.

			 1706</external-xref>).</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD13A2B67139D404EAD40016D2DC1C435"><enum>(6)</enum><header>Criteria for

			 designation</header><text display-inline="yes-display-inline">In considering an

			 area for designation as a high intensity interstate gang activity area or high

			 intensity interstate gang and drug trafficking area under this section, the

			 Attorney General shall consider—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="ID9400D9C71DE34D0C94D7D370A1CAA881"><enum>(A)</enum><text display-inline="yes-display-inline">the current and predicted levels of gang

			 crime activity in the area;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID2347007FB90B4FDEB82BD2827C3EC366"><enum>(B)</enum><text display-inline="yes-display-inline">the extent to which violent crime in the

			 area appears to be related to criminal street gang activity, such as drug

			 trafficking, murder, robbery, assaults, carjacking, arson, kidnapping,

			 extortion, and other criminal activity;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID0CADB80565AA432AA9E7E1A453926BAC"><enum>(C)</enum><text display-inline="yes-display-inline">the extent to which State and local law

			 enforcement agencies have committed resources to—</text>

							<clause commented="no" display-inline="no-display-inline" id="IDC22A1A6C6CBD4AEE8523B7B5BB52BD68"><enum>(i)</enum><text display-inline="yes-display-inline">respond to the gang crime problem;

			 and</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="ID113F894D070D488EBA6D54C5EC9D1881"><enum>(ii)</enum><text display-inline="yes-display-inline">participate in a gang enforcement

			 team;</text>

							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID930EB8EC3D6D4BAFA0C7FF72075AA587"><enum>(D)</enum><text display-inline="yes-display-inline">the extent to which a significant increase

			 in the allocation of Federal resources would enhance local response to the gang

			 crime activities in the area; and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID073DF1A72FC643B5BFCBE91C8ED533DF"><enum>(E)</enum><text display-inline="yes-display-inline">any other criteria that the Attorney

			 General considers to be appropriate.</text>

						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID5FFACB02718543AFA8B20E0384742475"><enum>(c)</enum><header>Authorization

			 of appropriations</header><text display-inline="yes-display-inline">There are

			 authorized to be appropriated $40,000,000 for each of fiscal years 2006 through

			 2010 to carry out this section.</text>

				</subsection></section><section commented="no" display-inline="no-display-inline" id="IDD7AB8F7EA2EA4BE9A910099803532127" section-type="subsequent-section"><enum>106.</enum><header>Gang prevention

			 grants</header>

				<subsection commented="no" display-inline="no-display-inline" id="ID087099E21459446F88AB43C7E5D3464E"><enum>(a)</enum><header>Authority To

			 make grants</header><text display-inline="yes-display-inline">The Office of

			 Justice Programs of the Department of Justice shall make grants, in accordance

			 with such regulations as the Attorney General may prescribe, to States, units

			 of local government, tribal governments, and qualified private entities, to

			 develop community-based programs that provide crime prevention, research, and

			 intervention services that are designed for gang members and at-risk

			 youth.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="IDE37EFDE86AF8478292C7A320E3DD1393"><enum>(b)</enum><header>Use of grant

			 amounts</header><text display-inline="yes-display-inline">Amounts received by a

			 grantee under this section may be used by the grantee, directly or through

			 subgrants, only for 1 or more of the following activities:</text>

					<paragraph commented="no" display-inline="no-display-inline" id="ID964DE6D62E9943629FBFBC0746B81B62"><enum>(1)</enum><text display-inline="yes-display-inline">Preventing initial gang recruitment and

			 involvement among younger teenagers.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID92ECB3C38D9F441BA7C591EF586EE68A"><enum>(2)</enum><text display-inline="yes-display-inline">Reducing gang involvement through

			 nonviolent and constructive activities, such as community service programs,

			 development of nonviolent conflict resolution skills, employment and legal

			 assistance, family counseling, and other safe, community-based alternatives for

			 high-risk youth.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4B43AD6C32B24BA191C2119BE67098EB"><enum>(3)</enum><text display-inline="yes-display-inline">Developing in-school and after-school gang

			 safety, control, education, and resistance procedures and programs.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID515061460E0C4A9CA9E56803F5A5C94F"><enum>(4)</enum><text display-inline="yes-display-inline">Identifying and addressing early childhood

			 risk factors for gang involvement, including parent training and childhood

			 Justice Programs of the Department of Justice shall make grants, in accordance

			 with such regulations as the Attorney General may prescribe, to States, units

			 of local government, and tribal governments to fund technology, equipment, and

			 training for State and local sheriffs, police agencies, and prosecutor offices

			 in order to—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="ID1F974DD9AAE449A6A7A5C9D48BA33E7D"><enum>(1)</enum><text display-inline="yes-display-inline">increase accurate identification of gang

			 members and violent offenders;</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4AD0E8FEE92247AE8122857512F5BE01"><enum>(2)</enum><text display-inline="yes-display-inline">maintain databases with such information to

			 facilitate coordination among law enforcement and prosecutors; and</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD983B0E4410F46FCA3CEEF9A52DC08F7"><enum>(3)</enum><text display-inline="yes-display-inline">otherwise improve the investigation and

			 prosecution of criminal street gangs.</text>

			 Project Safe Neighborhoods Initiative to improve enforcement of criminal laws

			 against violent gangs</header>

			 general</header><text display-inline="yes-display-inline">The Attorney General

			 shall expand the Project Safe Neighborhoods program to require each United

			 States attorney to—</text>

			 significant criminal street gangs operating within their district;</text>

			 investigation, and prosecution of criminal street gangs among Federal, State,

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDA4B7E3A019F24609978BE566C102E471"><enum>(3)</enum><text display-inline="yes-display-inline">consult with State and local prosecutors to

			 Attorney General shall require the Federal Bureau of Investigation to—</text>

			 is authorized to make grants to State and local prosecutors and the United

			 States attorney for the District of Columbia for the purpose of providing

			 short-term protection to witnesses in trials involving an organized criminal

			 activity, criminal street gang, serious drug offense, homicide, or other

			 serious offense.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID66977599305E4A2887693B4E9CD359E2"><enum>(2)</enum><header>Allocation</header><text display-inline="yes-display-inline">Each prosecutor receiving a grant under

			 this section may either—</text>

			 Attorney General determines to be essential to ensure compliance with the

						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID19D5B9F780B14A3BB40A5A77BDC481AD"><enum>(c)</enum><header>Minimum

			 allocation</header><text display-inline="yes-display-inline">Unless all

			 eligible applications submitted by State and local prosecutors within a State

			 for planning or implementation grants under this section have been funded, the

			 grantees within the State shall be allocated in each fiscal year under this

			 section not less than 0.75 percent of the total amount appropriated in the

			 fiscal year for planning or implementation grants pursuant to this

			 section.</text>

				reimbursable if the investigation or prosecution in any way relates to crimes

				of violence committed by a gang, as defined under the laws of the relevant

				State seeking assistance under this

				title.</text>

			 prosecution</header>

			<section commented="no" display-inline="no-display-inline" id="ID1567B0083B5B4C1584876A109557C8CD" section-type="subsequent-section"><enum>201.</enum><header>Study on expanding

			 Federal authority for juvenile offenders</header>

				<subsection commented="no" display-inline="no-display-inline" id="IDA4A75EB70D9441038323C6CA732AB850"><enum>(a)</enum><header>In

			 months after the date of enactment of this Act, the Comptroller General of the

			 United States shall submit to the Committees on the Judiciary of the Senate and

			 the House of Representatives a report on the costs and benefits associated with

			 expanding Federal authority to prosecute offenders under the age of 18 who are

			 gang members who commit criminal offenses.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID4AB287DD853C4734885833A17486CCD7"><enum>(b)</enum><header>Contents</header><text display-inline="yes-display-inline">The report submitted under subsection (a)

			 shall—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="ID1BB7BF0F51404B56A1313137FD4F2DA7"><enum>(1)</enum><text display-inline="yes-display-inline">examine the ability of the judicial systems

			 of the States to respond effectively to juveniles who are members of

			 <quote>criminal street gangs</quote>, as defined under section 521 of title 18,

			 United States Code;</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1C80A4C540004173A1480C6E6C553195"><enum>(2)</enum><text display-inline="yes-display-inline">examine the extent to which offenders who

			 are 16 and 17 years old are members of criminal street gangs, and are accused

			 of committing violent crimes and prosecuted in the adult criminal justice

			 systems of the individual States;</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID649E6D801A5C43F5945D2CC90298C1D6"><enum>(3)</enum><text display-inline="yes-display-inline">determine the percentage of crimes

			 committed by members of <quote>criminal street gangs</quote> that are committed

			 by offenders who are 16 and 17 years old;</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDB85CE2D9D0194A799E44645E6FD57DA0"><enum>(4)</enum><text display-inline="yes-display-inline">examine the extent to which United States

			 attorneys currently bring criminal indictments and prosecute offenders under

			 the age of 18, and the extent to which United States attorneys’ offices include

			 prosecutors with experience prosecuting juveniles for adult criminal

			 violations;</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0DF21B0382234E6CB66F2524010BD144"><enum>(5)</enum><text display-inline="yes-display-inline">examine the extent to which the Bureau of

			 Prisons houses offenders under the age of 18, and has the ability and

			 experience to meet the needs of young offenders;</text>

			 prosecutions that would be realized by expanding Federal authority to bring

			 charges against 16 and 17 year olds who are members of criminal street gangs

			 and are accused of violent crimes.</text>

				<subsection commented="no" display-inline="no-display-inline" id="ID7B411816347340C091F335EF0221518B"><enum>(a)</enum><header>Short

			 title</header><text display-inline="yes-display-inline">This section may be

			 cited as the <quote><short-title>Prosecutors and Defenders

			 Incentive Act</short-title></quote>.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="IDA263743743514F6F9975841A84B2FA8C"><enum>(b)</enum><header>Loan repayment

			 for prosecutors and public defenders</header><text display-inline="yes-display-inline">Title I of the

			 <act-name parsable-cite="OCCSS">Omnibus Crime Control and Safe Streets Act of

			 1968</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/3711">42

			 U.S.C. 3711</external-xref> et seq.) is amended by adding at the end the

			 following:</text>

						<part commented="no" id="ID577F0C626D7E4CD0B2B3DBF53D7418B7"><enum>HH</enum><header>Loan repayment

				for prosecutors and public defenders</header>

							<section commented="no" display-inline="no-display-inline" id="ID36E3A995A3D345D69E38E6148FF444CC" section-type="subsequent-section"><enum>2901.</enum><header>Grant

				authorization</header>

								<subsection commented="no" display-inline="no-display-inline" id="IDC01FC2312E2E46FBAFD2DADD122C21B7"><enum>(a)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purpose of this section is to encourage

				qualified individuals to enter and continue employment as prosecutors and

				public defenders.</text>

								</subsection><subsection commented="no" display-inline="no-display-inline" id="ID310100FD65E248EFB918B8A8E2C9735E"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>

									<paragraph commented="no" display-inline="no-display-inline" id="IDAD383E260B36473BBFEB0ACDECE2B7E2"><enum>(1)</enum><header>Prosecutor</header><text display-inline="yes-display-inline">The term <term>prosecutor</term> means a

				full-time employee of a State or local agency who—</text>

										<subparagraph commented="no" display-inline="no-display-inline" id="ID782C9B2D9919419290BD2FCE3E058500"><enum>(A)</enum><text display-inline="yes-display-inline">is continually licensed to practice law;

				and</text>

										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4DF9F03B5C534E26AD78E9501452FFED"><enum>(B)</enum><text display-inline="yes-display-inline">prosecutes criminal cases at the State or

				local level.</text>

										</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDA3E9840930A34D378C7D2C39DEB80F6A"><enum>(2)</enum><header>Public

				defender</header><text display-inline="yes-display-inline">The term

				<term>public defender</term> means an attorney who—</text>

										<subparagraph commented="no" display-inline="no-display-inline" id="ID160E0EA0E9AF4707AFAEA6CB7D9C50F7"><enum>(A)</enum><text display-inline="yes-display-inline">is continually licensed to practice law;

				and</text>

										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID7E7617C7354041368969854D8A9DD412"><enum>(B)</enum><text display-inline="yes-display-inline">is—</text>

											<clause commented="no" display-inline="no-display-inline" id="IDF62B37C5190F4BF4A32E60AD930DFD92"><enum>(i)</enum><text display-inline="yes-display-inline">a full-time employee of a State or local

				agency or a nonprofit organization operating under a contract with a State or

				unit of local government, that provides legal representation to indigent

				persons in criminal cases; or</text>

											</clause><clause commented="no" display-inline="no-display-inline" id="IDE1BBC6FE7D684545BFD909AD5CFA399B"><enum>(ii)</enum><text display-inline="yes-display-inline">employed as a full-time Federal defender

				attorney in a defender organization established pursuant to subsection (g) of

				section 3006A of title 18, United States Code, that provides legal

				representation to indigent persons in criminal cases.</text>

											</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID98EE6963069B400B82B9B8C18A143F19"><enum>(3)</enum><header>Student

				loan</header><text display-inline="yes-display-inline">The term <term>student

				loan</term> means—</text>

										<subparagraph commented="no" display-inline="no-display-inline" id="IDC6004220AA094851B5C2B2A3F8D83702"><enum>(A)</enum><text display-inline="yes-display-inline">a loan made, insured, or guaranteed under

				part B of title IV of the <act-name parsable-cite="HEA65">Higher Education Act

				of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/1071">20 U.S.C. 1071</external-xref> et seq.);</text>

										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID5067BDE44B7D4974986D8CDB31C605BB"><enum>(B)</enum><text display-inline="yes-display-inline">a loan made under part D or E of title IV

				of the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name>

				(<external-xref legal-doc="usc" parsable-cite="usc/20/1087a">20 U.S.C.

				1087a</external-xref> et seq. and 1087aa et seq.); and</text>

										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6E0BA3B42638445CB9279B2725E97060"><enum>(C)</enum><text display-inline="yes-display-inline">a loan made under section 428C or 455(g) of

				the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name>

				(<external-xref legal-doc="usc" parsable-cite="usc/20/1078-3">20 U.S.C. 1078–3

				and 1087e(g)</external-xref>) to the extent that such loan was used to repay a

				Federal Direct Stafford Loan, a Federal Direct Unsubsidized Stafford Loan, or a

				loan made under section 428 or 428H of such Act.</text>

										</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDEEC82CC85D4D418CA64644AF55DDAAD2"><enum>(c)</enum><header>Program

				authorized</header><text display-inline="yes-display-inline">The Attorney

				General shall establish a program by which the Department of Justice shall

				assume the obligation to repay a student loan, by direct payments on behalf of

				a borrower to the holder of such loan, in accordance with subsection (d), for

				any borrower who—</text>

									<paragraph commented="no" display-inline="no-display-inline" id="IDB5C86C12E28E479FB20DD96B88EF3EA0"><enum>(1)</enum><text display-inline="yes-display-inline">is employed as a prosecutor or public

				defender; and</text>

									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC963875EA4F148A8A4248C8DD581F26E"><enum>(2)</enum><text display-inline="yes-display-inline">is not in default on a loan for which the

				borrower seeks forgiveness.</text>

									</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDC93D9DB440AA45098671FDE6E65301C5"><enum>(d)</enum><header>Terms of

				agreement</header>

									<paragraph commented="no" display-inline="no-display-inline" id="IDF545538F5E294245A1FFF555330D9E6D"><enum>(1)</enum><header>In

				general</header><text display-inline="yes-display-inline">To be eligible to

				receive repayment benefits under subsection (c), a borrower shall enter into a

				written agreement that specifies that—</text>

										<subparagraph commented="no" display-inline="no-display-inline" id="IDF9D2F3329A8847148ED1FEEC8CA63867"><enum>(A)</enum><text display-inline="yes-display-inline">the borrower will remain employed as a

				prosecutor or public defender for a required period of service of not less than

				3 years, unless involuntarily separated from that employment;</text>

										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID94171E3C930E46C59AD110558C4197CB"><enum>(B)</enum><text display-inline="yes-display-inline">if the borrower is involuntarily separated

				from employment on account of misconduct, or voluntarily separates from

				employment, before the end of the period specified in the agreement, the

				borrower will repay the Attorney General the amount of any benefits received by

				such employee under this section;</text>

										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDF8901B23857F41E1801621EE869D7FAF"><enum>(C)</enum><text display-inline="yes-display-inline">if the borrower is required to repay an

				amount to the Attorney General under subparagraph (B) and fails to repay such

				amount, a sum equal to that amount shall be recoverable by the Federal

				Government from the employee (or such employee’s estate, if applicable) by such

				methods as are provided by law for the recovery of amounts owed to the Federal

				Government;</text>

										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID846A2068E7844134A19A3A12DD758610"><enum>(D)</enum><text display-inline="yes-display-inline">the Attorney General may waive, in whole or

				in part, a right of recovery under this subsection if it is shown that recovery

				would be against equity and good conscience or against the public interest;

				and</text>

										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDC30E3C8D893A4494B82C02C6BC0A9E25"><enum>(E)</enum><text display-inline="yes-display-inline">the Attorney General shall make student

				loan payments under this section for the period of the agreement, subject to

				the availability of appropriations.</text>

										</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0FB3C51A977B4F46B0580A62615B91F1"><enum>(2)</enum><header>Repayments</header>

										<subparagraph commented="no" display-inline="no-display-inline" id="IDB9B94C30F0C54C308A502A4DE1AD716E"><enum>(A)</enum><header>In

				general</header><text display-inline="yes-display-inline">Any amount repaid by,

				or recovered from, an individual or the estate of an individual under this

				subsection shall be credited to the appropriation account from which the amount

				involved was originally paid.</text>

										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID8A5E34DFDA7B4D26B9071308E9AD8488"><enum>(B)</enum><header>Merger</header><text display-inline="yes-display-inline">Any amount credited under subparagraph (A)

				shall be merged with other sums in such account and shall be available for the

				same purposes and period, and subject to the same limitations, if any, as the

				sums with which the amount was merged.</text>

										</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4851B700FD544514BDFA06F17B613A0C"><enum>(3)</enum><header>Limitations</header>

										<subparagraph commented="no" display-inline="no-display-inline" id="ID3A131C8F641348CB91E6681249DAE701"><enum>(A)</enum><header>Student loan

				payment amount</header><text display-inline="yes-display-inline">Student loan

				repayments made by the Attorney General under this section shall be made

				subject to such terms, limitations, or conditions as may be mutually agreed

				upon by the borrower and the Attorney General in an agreement under paragraph

				(1), except that the amount paid by the Attorney General under this section

				shall not exceed—</text>

											<clause commented="no" display-inline="no-display-inline" id="IDE78395EA62FC431F93457B5AB3465978"><enum>(i)</enum><text display-inline="yes-display-inline">$10,000 for any borrower in any calendar

				year; or</text>

											</clause><clause commented="no" display-inline="no-display-inline" id="ID1681B485D55045B983EDC4FCAB194F1A"><enum>(ii)</enum><text display-inline="yes-display-inline">an aggregate total of $60,000 in the case

				of any borrower.</text>

											</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID45A721C05A604A67AE1AD0DA21900F4D"><enum>(B)</enum><header>Beginning of

				payments</header><text display-inline="yes-display-inline">Nothing in this

				section shall authorize the Attorney General to pay any amount to reimburse a

				borrower for any repayments made by such borrower prior to the date on which

				the Attorney General entered into an agreement with the borrower under this

				subsection.</text>

										</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID531DF2B939F34627BF9A2E495127F548"><enum>(e)</enum><header>Additional

				agreements</header>

									<paragraph commented="no" display-inline="no-display-inline" id="ID5B026ACD98434CAF9B4E126B8AE8F03D"><enum>(1)</enum><header>In

				general</header><text display-inline="yes-display-inline">On completion of the

				required period of service under an agreement under subsection (d), the

				borrower and the Attorney General may, subject to paragraph (2), enter into an

				additional agreement in accordance with subsection (d).</text>

									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7ABCBAEFE0624CC6ACB19CF8B1564FBA"><enum>(2)</enum><header>Term</header><text display-inline="yes-display-inline">An agreement entered into under paragraph

				(1) may require the borrower remain employed as a prosecutor or public defender

				for less than 3 years.</text>

									</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDE92499BB4A86484F8CC658AFF75CAF9A"><enum>(f)</enum><header>Award basis;

				priority</header>

									<paragraph commented="no" display-inline="no-display-inline" id="IDFC17E0547A604F64A32FA858D89EEF4B"><enum>(1)</enum><header>Award

				basis</header><text display-inline="yes-display-inline">Subject to paragraph

				(2), the Attorney General shall provide repayment benefits under this section

				on a first-come, first-served basis, and subject to the availability of

				appropriations.</text>

									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1C77F14328DC457FA2CF1DECFE2722A5"><enum>(2)</enum><header>Priority</header><text display-inline="yes-display-inline">The Attorney General shall give priority in

				providing repayment benefits under this section in any fiscal year to a

				borrower who—</text>

										<subparagraph commented="no" display-inline="no-display-inline" id="IDAD446D7A66B34F36A78F2C8C663D43D4"><enum>(A)</enum><text display-inline="yes-display-inline">received repayment benefits under this

				section during the preceding fiscal year; and</text>

										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID8FD59F1FC283490DAF479EC2F7CD8B47"><enum>(B)</enum><text display-inline="yes-display-inline">has completed less than 3 years of the

				first required period of service specified for the borrower in an agreement

				entered into under subsection (d).</text>

										</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDDCA6E773D92C47FD8AE7B8B8CC4C5F25"><enum>(g)</enum><header>Regulations</header><text display-inline="yes-display-inline">The Attorney General is authorized to issue

				such regulations as may be necessary to carry out the provisions of this

				section.</text>

								</subsection><subsection commented="no" display-inline="no-display-inline" id="ID9C0E963640E344F0BF62BEB9701B9114"><enum>(h)</enum><header>Authorization

				of appropriations</header><text display-inline="yes-display-inline">There are

				authorized to be appropriated to carry out this section $25,000,000 for fiscal

				year 2006 and such sums as may be necessary for each succeeding fiscal

				year.</text>
