			 <quote><short-title>Clean Water Infrastructure Financing

			 Act of 2005</short-title></quote>.</text>

		</section><section commented="no" display-inline="no-display-inline" id="ID4ADF46E4C5DB4887992C35332D56938F" section-type="subsequent-section"><enum>2.</enum><header>General authority for

			 capitalization grants</header><text display-inline="no-display-inline">Section

			 601(a) of the <act-name parsable-cite="FWPCA">Federal Water Pollution Control

			 Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/33/1381(a)">33 U.S.C. 1381(a)</external-xref>) is amended by

			 striking <quote>(1) for construction</quote> and all that follows through the

			 period at the end and inserting <quote>to accomplish the purposes of this

			 Act.</quote>.</text>

		</section><section commented="no" display-inline="no-display-inline" id="ID66033BC6CF29431483D8003EA6958E66" section-type="subsequent-section"><enum>3.</enum><header>Capitalization grants

			 agreements</header>

			<subsection commented="no" display-inline="no-display-inline" id="ID9AFBCBCCF0D948E79B6700F23CF28160"><enum>(a)</enum><header>Requirements

			 for construction of treatment works</header><text display-inline="yes-display-inline"><external-xref legal-doc="act" parsable-cite="FWPCA/602(b)(6)">Section 602(b)(6)</external-xref> of the

			 <act-name parsable-cite="FWPCA">Federal Water Pollution Control Act</act-name>

			 (<external-xref legal-doc="usc" parsable-cite="usc/33/1382(b)(6)">33 U.S.C.

			 1382(b)(6)</external-xref>) is amended—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="ID9FFF9EC1CEA1425EB1AE999913D3BC57"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>before fiscal year

			 1995</quote>; and</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID353DE2C7E5AA4392913742C475886BA1"><enum>(b)</enum><header>Guidance for

			 small systems</header><text display-inline="yes-display-inline"><external-xref legal-doc="act" parsable-cite="FWPCA/602">Section 602</external-xref> of the

			 <act-name parsable-cite="FWPCA">Federal Water Pollution Control Act</act-name>

			 (<external-xref legal-doc="usc" parsable-cite="usc/33/1382">33 U.S.C.

			 1382</external-xref>) is amended by adding at the end the following:</text>

				small systems</header>

						<paragraph commented="no" display-inline="no-display-inline" id="IDB9E2A3039F8A46D1A265E9002993091D"><enum>(1)</enum><header>Simplified

				procedures</header><text display-inline="yes-display-inline">Not later than 1

				year after the date of enactment of this subsection, the Administrator shall

				assist the States in establishing simplified procedures for small systems to

				obtain assistance under this title.</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID42018289DAB9490DBB4F9942C6A989A9"><enum>(2)</enum><header>Publication of

				manual</header><text display-inline="yes-display-inline">Not later than 1 year

				after the date of enactment of this subsection, after providing notice and

				opportunity for public comment, the Administrator shall publish—</text>

							<subparagraph commented="no" display-inline="no-display-inline" id="ID13F7EA5082BC4C63A0BB05BB009F973B"><enum>(A)</enum><text display-inline="yes-display-inline">a manual to assist small systems in

				obtaining assistance under this title; and</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDAE57535E6B3A49368FD54706EEA7CED3"><enum>(B)</enum><text display-inline="yes-display-inline">in the Federal Register, notice of the

				availability of the manual.</text>

							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID911B8BCDB0304E6189BF727895E6A53F"><enum>(3)</enum><header>Definition of

				small system</header><text display-inline="yes-display-inline">In this title,

				the term <term>small system</term> means a system for which a municipality or

				intermunicipal, interstate, or State agency seeks assistance under this title

				and that serves a population of 20,000 or fewer

				inhabitants.</text>

						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="ID617A9C3DC40B431A82133931EEA5A842" section-type="subsequent-section"><enum>4.</enum><header>Water pollution

			 control revolving funds</header>

			<subsection commented="no" display-inline="no-display-inline" id="IDABA2BB8F474C40D8B1C0FCC9381996F4"><enum>(a)</enum><header>Activities

			 eligible for assistance</header><text display-inline="yes-display-inline"><external-xref legal-doc="act" parsable-cite="FWPCA/603">Section 603</external-xref> of the

			 <act-name parsable-cite="FWPCA">Federal Water Pollution Control Act</act-name>

			 (<external-xref legal-doc="usc" parsable-cite="usc/33/1383">33 U.S.C.

			 1383</external-xref>) is amended by striking subsection (c) and inserting the

			 following:</text>

				eligible for assistance</header>

						<paragraph commented="no" display-inline="no-display-inline" id="ID789D66E918F846FC91F6DC571E2E8C57"><enum>(1)</enum><header>In

				general</header><text display-inline="yes-display-inline">The water pollution

				control revolving fund of a State shall be used only for providing financial

				assistance for activities that have, as a principal benefit, the improvement or

				protection of the water quality of navigable waters to a municipality,

				intermunicipal, interstate, or State agency, or other person, including

				activities such as—</text>

							<subparagraph commented="no" display-inline="no-display-inline" id="IDAF397E985A164D72A0410084AC2883FA"><enum>(A)</enum><text display-inline="yes-display-inline">construction of a publicly owned treatment

				works;</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9C2BDA95166C4ADFB43BB43B5526332F"><enum>(B)</enum><text display-inline="yes-display-inline">implementation of lake protection programs

				and projects under section 314;</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6981F686D53441DA9FC490657EDFB5D6"><enum>(C)</enum><text display-inline="yes-display-inline">implementation of a nonpoint source

				management program under section 319;</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID974FF469185346F790641FE0E1B0D71C"><enum>(D)</enum><text display-inline="yes-display-inline">implementation of an estuary conservation

				and management plan under section 320;</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDAF051FD5BBE64CEAA0D600F3C868CBA2"><enum>(E)</enum><text display-inline="yes-display-inline">restoration or protection of publicly or

				privately owned riparian areas, including acquisition of property

				rights;</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID08E1C6FE4C3540F5B1321EDAB6816532"><enum>(F)</enum><text display-inline="yes-display-inline">implementation of measures to improve the

				efficiency of public water use;</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6C670B66FA3A4026BA6066B502F7307B"><enum>(G)</enum><text display-inline="yes-display-inline">development and implementation of plans by

				a public recipient to prevent water pollution; and</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID8A560AF396454A6CA9A90021A52C9E17"><enum>(H)</enum><text display-inline="yes-display-inline">acquisition of land necessary to meet any

				mitigation requirements related to construction of a publicly owned treatment

				works.</text>

							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDDBCDB5C6B0FD49E49B9200D0075B9566"><enum>(2)</enum><header>Fund

				amounts</header>

							<subparagraph commented="no" display-inline="no-display-inline" id="ID54311ECF66A740E8B6B0A632B107628D"><enum>(A)</enum><header>Repayments</header><text display-inline="yes-display-inline">The water pollution control revolving fund

				of a State shall be established, maintained, and credited with

				repayments.</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9C2D2E4AD6E449B8BA93F63E852592C9"><enum>(B)</enum><header>Availability</header><text display-inline="yes-display-inline">The balance in the fund shall be available

				in perpetuity for providing financial assistance described in paragraph

				(1).</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDBF1C2AA1BFB946E18885E9A21C107085"><enum>(C)</enum><header>Fees</header><text display-inline="yes-display-inline">Fees charged by a State to recipients of

				the assistance may be deposited in the fund and may be used only to pay the

				cost of administering this

				title.</text>

							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDF459567B480D468CAACDCE5B3FA1E52F"><enum>(b)</enum><header>Extended

			 repayment period for financially distressed communities</header><text display-inline="yes-display-inline"><external-xref legal-doc="act" parsable-cite="FWPCA/603(d)(1)">Section 603(d)(1)</external-xref> of the

			 <act-name parsable-cite="FWPCA">Federal Water Pollution Control Act</act-name>

			 (<external-xref legal-doc="usc" parsable-cite="usc/33/1383(d)(1)">33 U.S.C.

			 1383(d)(1)</external-xref>) is amended—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="ID217060417E7A41FD8872921E514D6700"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (A), by inserting after

			 <quote>20 years</quote> the following: <quote>or, in the case of a financially

			 distressed community, the lesser of 40 years or the expected life of the

			 project to be financed with the proceeds of the loan</quote>; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6FEF190F432E4D8C94CDB8C7F3DA62FF"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking <quote>not

			 later than 20 years after project completion</quote> and inserting <quote>on

			 the expiration of the term of the loan</quote>.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDBE73043E5A964185AB6B6451AF614729"><enum>(c)</enum><header>Loan

			 guarantees</header><text display-inline="yes-display-inline"><external-xref legal-doc="act" parsable-cite="FWPCA/603(d)">Section 603(d)</external-xref> of

			 the <act-name parsable-cite="FWPCA">Federal Water Pollution Control

			 Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/33/1383(d)">33 U.S.C. 1383(d)</external-xref>) is amended by

			 striking paragraph (5) and inserting the following:</text>

				<quoted-block act-name="Federal Water Pollution Control Act" display-inline="no-display-inline" id="IDE13E1DCD86AB4401A7973DBB9B46EA01" style="OLC">

					<paragraph commented="no" display-inline="no-display-inline" id="ID4CEF68B92FDA47B487C472235F2E2232"><enum>(5)</enum><text display-inline="yes-display-inline">to provide loan guarantees for—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="ID5F778D41ABE6429C007F6585F1CA9B2F"><enum>(A)</enum><text display-inline="yes-display-inline">similar revolving funds established by

				municipalities or intermunicipal agencies; and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID8B523257174D41EBA449E68FC6693FE9"><enum>(B)</enum><text display-inline="yes-display-inline">developing and implementing innovative

				technologies;</text>

						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID47D7F409B2BF40618D5FA6BFC5F976C9"><enum>(d)</enum><header>Administrative

			 expenses</header><text display-inline="yes-display-inline"><external-xref legal-doc="act" parsable-cite="FWPCA/603(d)(7)">Section

			 603(d)(7)</external-xref> of the <act-name parsable-cite="FWPCA">Federal Water

			 Pollution Control Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/33/1383(d)(7)">33 U.S.C. 1383(d)(7)</external-xref>) is

			 amended by inserting before the period at the end the following: <quote>or the

			 greater of $400,000 per year or an amount equal to <fraction>1/2</fraction>

			 percent per year of the current valuation of the fund, plus the amount of any

			 fees collected by the State under subsection (c)(2)(C)</quote>.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID7FB140ECF30F4350B7E23EE9B072BCC4"><enum>(e)</enum><header>Technical and

			 planning assistance for small systems</header><text display-inline="yes-display-inline"><external-xref legal-doc="act" parsable-cite="FWPCA/603(d)">Section 603(d)</external-xref> of the

			 <act-name parsable-cite="FWPCA">Federal Water Pollution Control Act</act-name>

			 (<external-xref legal-doc="usc" parsable-cite="usc/33/1383(d)">33 U.S.C.

			 1383(d)</external-xref>) is amended—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="ID15D6B09A19A0476090E8CCB377B21B8B"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (6), by striking

			 <quote>and</quote> at the end;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC698935B375445459F8CB4212CCDB2D5"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (7), by striking the period at

			 the end and inserting <quote>; and</quote>; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4A8C827895744673B4004377007EE477"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>

						<paragraph commented="no" display-inline="no-display-inline" id="ID00C9BA3F1710426CB096AF5B1987CDC9"><enum>(8)</enum><text display-inline="yes-display-inline">to provide to small systems technical and

				planning assistance and assistance in financial management, user fee analysis,

				budgeting, capital improvement planning, facility operation and maintenance,

				repair schedules, and other activities to improve wastewater treatment plant

				operations, except that the amounts used under this paragraph for a fiscal year

				shall not exceed 2 percent of all grants provided to the fund for the fiscal

				year under this

				title.</text>

						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID5A7AEFBC846F4BC0B7C760E25062692D"><enum>(f)</enum><header>Consistency

			 with planning requirements</header><text display-inline="yes-display-inline"><external-xref legal-doc="act" parsable-cite="FWPCA/603(f)">Section 603(f)</external-xref> of the

			 <act-name parsable-cite="FWPCA">Federal Water Pollution Control Act</act-name>

			 (<external-xref legal-doc="usc" parsable-cite="usc/33/1383(f)">33 U.S.C.

			 1383(f)</external-xref>) is amended by striking <quote>is consistent</quote>

			 and inserting <quote>is not inconsistent</quote>.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDD1D2B07C4BF54814897B3CEB007621AF"><enum>(g)</enum><header>Construction

			 assistance</header><text display-inline="yes-display-inline"><external-xref legal-doc="act" parsable-cite="FWPCA/603">Section 603</external-xref> of the

			 <act-name parsable-cite="FWPCA">Federal Water Pollution Control Act</act-name>

			 (<external-xref legal-doc="usc" parsable-cite="usc/33/1383">33 U.S.C.

			 1383</external-xref>) is amended by striking subsection (g) and inserting the

			 following:</text>

				<quoted-block act-name="Federal Water Pollution Control Act" display-inline="no-display-inline" id="ID634C3BF4276F41FD0018D4D96F5C1518" style="OLC">

					<subsection commented="no" display-inline="no-display-inline" id="IDE0D6601EE4B14B73954FDD7B2F9B3BF6"><enum>(g)</enum><header>Construction

				assistance</header>

						<paragraph commented="no" display-inline="no-display-inline" id="IDC219DFADA68B4704BA004983806B3C37"><enum>(1)</enum><header>Priority list

				requirement</header><text display-inline="yes-display-inline">The State may

				provide financial assistance from the water pollution control revolving fund of

				the State for a project for construction of a publicly owned treatment works

				only if the project is on the priority list of the State under section 216,

				without regard to the rank of the project on the list.</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDF9624FA65BCF442CAEE573B898B11919"><enum>(2)</enum><header>Eligibility of

				certain treatment works</header><text display-inline="yes-display-inline">A

				treatment works shall be treated as a publicly owned treatment works for

				purposes of subsection (c) if the treatment works, without regard to ownership,

				would be considered a publicly owned treatment works and is principally

				treating municipal waste water or domestic

				sewage.</text>

						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID25832551E2EB407287B62F731D595968"><enum>(h)</enum><header>Principal

			 subsidization</header><text display-inline="yes-display-inline"><external-xref legal-doc="act" parsable-cite="FWPCA/603">Section 603</external-xref> of the

			 <act-name parsable-cite="FWPCA">Federal Water Pollution Control Act</act-name>

			 (<external-xref legal-doc="usc" parsable-cite="usc/33/1383">33 U.S.C.

			 1383</external-xref>) is amended by adding at the end the following:</text>

				<quoted-block act-name="Federal Water Pollution Control Act" display-inline="no-display-inline" id="IDB78D2B72E024424880078312B9DAEA72" style="OLC">

					<subsection commented="no" display-inline="no-display-inline" id="ID2C3383BD4CB24E47AF372076F88DD709"><enum>(i)</enum><header>Principal

				subsidization</header>

						<paragraph commented="no" display-inline="no-display-inline" id="ID047930BC16244C709155967C50B662D0"><enum>(1)</enum><header>In

				general</header><text display-inline="yes-display-inline">Subject to paragraph

				(2), in a case in which a State makes a loan under subsection (d)(1) to a

				financially distressed community, the State may provide additional

				subsidization to the loan recipient (including forgiveness of

				principal).</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1C58BE0FF39746FF9D532F88CB17B08B"><enum>(2)</enum><header>Limitation</header><text display-inline="yes-display-inline">For each fiscal year, the total amount of

				loan subsidies made by a State under this subsection shall not exceed 30

				percent of the amount of the capitalization grant received by the State for

				that fiscal year.</text>

						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID43C520000A694D9190656324C3B05689"><enum>(j)</enum><header>Information to

				assist States</header><text display-inline="yes-display-inline">The

				Administrator may publish information to assist States in establishing the

				affordability criteria referred to in subsection (l).</text>

					</subsection><subsection commented="no" display-inline="no-display-inline" id="ID986DA580CFC142C88EC43FB6DB03E6A3"><enum>(k)</enum><header>Priority</header><text display-inline="yes-display-inline">In making a loan under this section, a

				State may give priority to a financially distressed community.</text>

					</subsection><subsection commented="no" display-inline="no-display-inline" id="ID9A5A9670B0DD404D90EB58EB24B0AF56"><enum>(l)</enum><header>Definition of

				financially distressed community</header><text display-inline="yes-display-inline">In this section, the term <term>financially

				distressed community</term> means any community that meets affordability

				criteria that are—</text>

						<paragraph commented="no" display-inline="no-display-inline" id="IDF4307A0AC69A4AFB8CFA420027E37D02"><enum>(1)</enum><text display-inline="yes-display-inline">established by the State in which the

				community is located; and</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC32E34F5832C43F290B6ADCAC86F6B22"><enum>(2)</enum><text display-inline="yes-display-inline">developed after public review and

				comment.</text>

						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="ID555D6D636E7540220001006231116546" section-type="subsequent-section"><enum>5.</enum><header>Authorization of

			 appropriations</header><text display-inline="no-display-inline">Section 607 of

			 the <act-name parsable-cite="FWPCA">Federal Water Pollution Control

			 Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/33/1387">33

			 U.S.C. 1387</external-xref>) is amended by striking <quote>the following

			 sums:</quote> and all that follows through the period at the end of paragraph

			 (5) and inserting <quote>$4,000,000,000 for each of fiscal years 2006 through

			 2010.</quote>.</text>
