		<official-title display="yes">To authorize the Secretary of the Interior

		  to allow the Columbia Gas Transmission Corporation to increase the diameter of

		  a natural gas pipeline located in the Delaware Water Gap National Recreation

		  Area.</official-title>

	<legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC">

		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Delaware Water Gap National Recreation

			 Area Natural Gas Pipeline Enlargement Act</short-title></quote>.</text>

		</section><section commented="no" display-inline="no-display-inline" id="id8197D4A994104634BFEC1479F0F2A9E8" section-type="subsequent-section"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>

			<paragraph commented="no" display-inline="no-display-inline" id="idB61EF4518F764F128BB5F535972426B7"><enum>(1)</enum><header>Corporation</header><text display-inline="yes-display-inline">The term <term>Corporation</term> means the

			 Columbia Gas Transmission Corporation.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD20068966EA847C5A3FF690546D40B35"><enum>(2)</enum><header>Pipeline</header><text display-inline="yes-display-inline">The term <term>pipeline</term> means that

			 portion of the pipeline of the Corporation numbered 1278 that is—</text>

				<subparagraph commented="no" display-inline="no-display-inline" id="idEAAFC253A68D4D0F97AE3A032D4E6195"><enum>(A)</enum><text display-inline="yes-display-inline">located in the Recreation Area; and</text>

				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5A5637599E664F6A98FF2D1384851C5B"><enum>(B)</enum><text display-inline="yes-display-inline">situated on 2 tracts designated by the

			 Corporation as ROW No. 16405 and No. 16414.</text>

				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id087C3A8370244C11B2E1B896B41D9C32"><enum>(3)</enum><header>Recreation

			 area</header><text display-inline="yes-display-inline">The term

			 <term>Recreation Area</term> means the Delaware Water Gap National Recreation

			 Area in the Commonwealth of Pennsylvania.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8839F8E4B2C94A57ACA5E1A67805CD59"><enum>(4)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the

			 Secretary of the Interior.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC25472C5151948BD8A6B2B3504402403"><enum>(5)</enum><header>Superintendent</header><text display-inline="yes-display-inline">The term <quote>Superintendent</quote>

			 means the Superintendent of the Recreation Area.</text>

			</paragraph></section><section commented="no" display-inline="no-display-inline" id="id71B191FDB7414F2B9F90E369B78321CC" section-type="subsequent-section"><enum>3.</enum><header>Easement for expanded

			 natural gas pipeline</header>

			<subsection commented="no" display-inline="no-display-inline" id="idC6F7AD47A44A47DEBC6C705CC55E5FC9"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Secretary may

			 enter into an agreement with the Corporation to grant to the Corporation, for

			 no consideration, an easement to enlarge the diameter of the pipeline from 14

			 inches to not more than 20 inches.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="id2C76748C527942ABA78AE0A8A23ECBA0"><enum>(b)</enum><header>Terms and

			 conditions</header><text display-inline="yes-display-inline">The easement

			 authorized under subsection (a) shall—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="idAB2A6106A8324A388438E03453B17415"><enum>(1)</enum><text display-inline="yes-display-inline">be consistent with—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="id7EB27063603E45BC996C6EFC7989B277"><enum>(A)</enum><text display-inline="yes-display-inline">the recreational values of the Recreation

			 Area; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA3496D99B5444F47B0B737AC2E928D9E"><enum>(B)</enum><text display-inline="yes-display-inline">protection of the resources of the

			 Recreation Area;</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE211863E62DC4A7988F64A31AAF4C657"><enum>(2)</enum><text display-inline="yes-display-inline">include provisions for the protection of

			 resources in the Recreation Area that ensure that only the minimum and

			 necessary amount of disturbance, as determined by the Secretary, shall occur

			 during the construction or maintenance of the enlarged pipeline;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id01AC08F26772439B901AEFCA8AE8B2F9"><enum>(3)</enum><text display-inline="yes-display-inline">be consistent with the laws (including

			 regulations) and policies applicable to units of the National Park System;

			 and</text>

				</paragraph><paragraph changed="not-changed" commented="no" display-inline="no-display-inline" id="idE17B317A242B46169806C509DC49FFFA"><enum>(4)</enum><text display-inline="yes-display-inline">be subject to any other terms and

			 conditions that the Secretary determines to be necessary;</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id7E6D04EEEB394E9F8012F1878F6B1D2F"><enum>(c)</enum><header>Permits</header>

				<paragraph commented="no" display-inline="no-display-inline" id="idF5C80238A83848848879FDD9F96584D4"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Superintendent

			 may issue a permit to the Corporation for the use of the Recreation Area in

			 accordance with subsection (b) for the temporary construction and staging areas

			 required for the construction of the enlarged pipeline.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7C53BB57E409431D8E1254A8064C0828"><enum>(2)</enum><header>Prior to

			 issuance</header><text display-inline="yes-display-inline">The easement

			 authorized under subsection (a) and the permit authorized under paragraph (1)

			 shall require that before the Superintendent issues a permit for any clearing

			 or construction, the Corporation shall—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="idC369CEF1D9DC458DA7F2BD0C6408BA80"><enum>(A)</enum><text display-inline="yes-display-inline">consult with the Superintendent;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id95BAAE3A5DD0424F953C2464501F94CA"><enum>(B)</enum><text display-inline="yes-display-inline">identify natural and cultural resources of

			 the Recreation Area that may be damaged or lost because of the clearing or

			 construction; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id19CF477AAC6F4540959AA41DDBF699A2"><enum>(C)</enum><text display-inline="yes-display-inline">submit to the Superintendent for approval a

			 restoration and mitigation plan that—</text>

						<clause commented="no" display-inline="no-display-inline" id="id343A5965DD6E4ADB8AB0C1331B732819"><enum>(i)</enum><text display-inline="yes-display-inline">describes how the land subject to the

			 easement will be maintained; and</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="id1A9B90DFF3B041889E3C6A6174EA99B1"><enum>(ii)</enum><text display-inline="yes-display-inline">includes a schedule for, and description

			 of, the specific activities to be carried out by the Corporation to mitigate

			 the damages or losses to, or restore, the natural and cultural resources of the

			 Recreation Area identified under subparagraph (B).</text>

						</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id1F402FFF3B8C4CC6BA1E6FC20F2AA7A6"><enum>(d)</enum><header>Pipeline

			 replacement requirements</header><text display-inline="yes-display-inline">The

			 enlargement of the pipeline authorized under subsection (a) shall be considered

			 to meet the pipeline replacement requirements required by the Research and

			 Special Programs Administration of the Department of Transportation (CPF No.

			 1–2002–1004–H).</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="id6665E0A684754F7BA81F3E3697DFA9C0"><enum>(e)</enum><header>FERC

			 consultation</header><text display-inline="yes-display-inline">The Corporation

			 shall comply with all other requirements for certification by the Federal

			 Energy Regulatory Commission that are necessary to permit the increase in

			 pipeline size.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="idA466F9080BBB4AE5886DDD1006DA7E4A"><enum>(f)</enum><header>Limitation</header><text display-inline="yes-display-inline">The Secretary shall not grant any

			 additional increases in the diameter of, or easements for, the pipeline within

			 the boundary of the Recreation Area after the date of enactment of this

			 Act.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="idABFE3A756B1046869F569454A4A156B9"><enum>(g)</enum><header>Effect on

			 right-of-Way easement</header><text display-inline="yes-display-inline">Nothing

			 in this Act increases the 50-foot right-of-way easement for the

			 pipeline.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="id539433E18B714A0EAD28198819957714"><enum>(h)</enum><header>Penalties</header><text display-inline="yes-display-inline">On request of the Secretary, the Attorney

			 General may bring a civil action against the Corporation in United States

			 district court to recover damages and response costs under

			 <external-xref legal-doc="public-law" parsable-cite="pl/101/337">Public Law

			 101–337</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/16/19jj">16 U.S.C. 19jj et seq.</external-xref>) or any

			 other applicable law if—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="id9677E83E54964D8D8E1B7B6F9D0E6709"><enum>(1)</enum><text display-inline="yes-display-inline">the Corporation—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="idF0BBFA06C62340B6A92CC70BE43B96DA"><enum>(A)</enum><text display-inline="yes-display-inline">violates a provision of—</text>

						<clause commented="no" display-inline="no-display-inline" id="id6DDE25F100094A80B759A5A66ECAE4F4"><enum>(i)</enum><text display-inline="yes-display-inline">an easement authorized under subsection

			 (a); or</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="idD8877230FF484FBDAC41B06B9B0983F3"><enum>(ii)</enum><text display-inline="yes-display-inline">a permit issued under subsection (c);

			 or</text>

						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2945EA6C5D1249B39CE2C78387EB3166"><enum>(B)</enum><text display-inline="yes-display-inline">fails to submit or timely implement a

			 restoration and mitigation plan approved under subsection (c)(3); and</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2CF742166488423887E5D6DF0B620751"><enum>(2)</enum><text display-inline="yes-display-inline">the violation or failure destroys, results

			 in the loss of, or injures any park system resource (as defined in section 1 of

			 <external-xref legal-doc="public-law" parsable-cite="pl/101/337">Public Law

			 101–337</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/16/19jj">16 U.S.C. 19jj</external-xref>)).</text>

				</paragraph></subsection></section></legis-body>
