		<section commented="no" display-inline="no-display-inline" id="ID5D15A4151E124D54A76CC49C226FE77E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Community College Partnership Act of

			 2005</short-title></quote>.</text>

		</section><section commented="no" display-inline="no-display-inline" id="ID204821D538B6431BA8D23900C7CEE995" section-type="subsequent-section"><enum>2.</enum><header>Community college

			 opportunity; college preparation programs authorized</header><text display-inline="no-display-inline">Subpart 2 of part A of title IV of the

			 <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name>

			 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070a-11">20 U.S.C.

			 1070a–11 et seq.</external-xref>) is amended—</text>

			<paragraph commented="no" display-inline="no-display-inline" id="ID2D3A692B3B8B46A5BB38D2DD310869B0"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating section 407E as section

			 406E; and</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDCA02BBA5CE0441238EEC829305BC9863"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>

					<chapter changed="not-changed" commented="no" id="IDEB6DEE12F82E4E29B0CC7BD7C7754CF3"><enum>4</enum><header>Community college

				opportunity</header>

						<section changed="not-changed" commented="no" display-inline="no-display-inline" id="ID8C106DFD0454470F991B29E0097BF58C" section-type="subsequent-section"><enum>407A.</enum><header>Purpose</header><text display-inline="no-display-inline">It is the purpose of this chapter to

				enhance—</text>

							<paragraph changed="not-changed" commented="no" display-inline="no-display-inline" id="IDE6FB2603713C4F74B0FF35B4DF00A7E6"><enum>(1)</enum><text display-inline="yes-display-inline">the retention of students at community or

				technical colleges;</text>

							</paragraph><paragraph changed="not-changed" commented="no" display-inline="no-display-inline" id="ID1D000D8957944B698731B25BABED4519"><enum>(2)</enum><text display-inline="yes-display-inline">the opportunities for students to transfer

				to 4-year institutions of higher education and complete baccalaureate degrees;

				and</text>

							</paragraph><paragraph changed="not-changed" commented="no" display-inline="no-display-inline" id="ID930BC5997EE94684AD318F7EBFB10162"><enum>(3)</enum><text display-inline="yes-display-inline">the preparation of students for

				high-quality and high-demand emerging and established occupations.</text>

							</paragraph></section><section changed="not-changed" commented="no" display-inline="no-display-inline" id="ID5FAEAEB33B844B15871DD2FACC13E670" section-type="subsequent-section"><enum>407B.</enum><header>Activities</header>

							<subsection changed="not-changed" commented="no" display-inline="no-display-inline" id="ID3CB2B05F97E14DFE869E24F2BF705EAE"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this chapter:</text>

								<paragraph changed="not-changed" commented="no" display-inline="no-display-inline" id="ID4D36F7E3CEB04BD3AF26005360655BA9"><enum>(1)</enum><header>Community or

				technical college</header><text display-inline="yes-display-inline">The term

				<term>community or technical college</term> means an institution of higher

				education—</text>

									<subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="ID0CB4A2695931451AA05E5DC3B1D375D9"><enum>(A)</enum><text display-inline="yes-display-inline">that admits as regular students,

				individuals who are beyond the age of compulsory school attendance in the State

				in which the institution is located and who have the ability to benefit from

				the training offered by the institution;</text>

									</subparagraph><subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="IDDB680C04398040829B1641AED1D29B93"><enum>(B)</enum><text display-inline="yes-display-inline">that predominately does not provide an

				educational program for which it awards a baccalaureate degree (or an

				equivalent degree);</text>

									</subparagraph><subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="IDFE9647C6208149439F00F1321440EB20"><enum>(C)</enum><text display-inline="yes-display-inline">that—</text>

										<clause changed="not-changed" commented="no" display-inline="no-display-inline" id="ID6C7A4EC994BD41BDAE0700F71E7983AC"><enum>(i)</enum><text display-inline="yes-display-inline">provides an educational program of not less

				than 2 years that is acceptable for full credit toward a baccalaureate degree;

				or</text>

										</clause><clause changed="not-changed" commented="no" display-inline="no-display-inline" id="ID42168EDE74DC4E0E9E839C664D708816"><enum>(ii)</enum><text display-inline="yes-display-inline">offers a 2-year program in engineering,

				mathematics, or the physical or biological sciences, designed to prepare a

				student to work as a technician or at the semiprofessional level in

				engineering, scientific, or other technological fields requiring the

				understanding and application of basic engineering, scientific, or mathematical

				principles of knowledge; and</text>

										</clause></subparagraph><subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="ID860CDD0875C64625A40386BA6442F0C5"><enum>(D)</enum><text display-inline="yes-display-inline">that is accredited by a regional

				accrediting agency or association recognized by the Secretary under section

				496.</text>

									</subparagraph></paragraph><paragraph changed="not-changed" commented="no" display-inline="no-display-inline" id="ID90F46A2753EB45DA9B4488F23653499E"><enum>(2)</enum><header>Eligible

				entity</header><text display-inline="yes-display-inline">The term

				<term>eligible entity</term> means—</text>

									<subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="ID2234A6BFF76E4726AAAF31D57E158D36"><enum>(A)</enum><text display-inline="yes-display-inline">a statewide governance or coordinating

				board with jurisdiction over community or technical colleges and institutions

				of higher education that offer a baccalaureate or postbaccalaureate

				degree;</text>

									</subparagraph><subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="ID2BF9EB3F2FAC421B92DDCCDE1755B000"><enum>(B)</enum><text display-inline="yes-display-inline">a partnership between—</text>

										<clause changed="not-changed" commented="no" display-inline="no-display-inline" id="id1522EEE478BC455F9ED26CD223ACB3C1"><enum>(i)</enum><text display-inline="yes-display-inline">a statewide governance or coordinating

				board with jurisdiction over community or technical colleges; and</text>

										</clause><clause changed="not-changed" commented="no" display-inline="no-display-inline" id="id9A955995A61B4A66A8DD2A465BD2F3A8"><enum>(ii)</enum><text display-inline="yes-display-inline">a statewide governance or coordinating

				board with jurisdiction over institutions of higher education that offer a

				baccalaureate or postbaccalaureate degree; or</text>

										</clause></subparagraph><subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="IDDBA3AC681B4F41EA92BFFF33E44246A8"><enum>(C)</enum><text display-inline="yes-display-inline">a partnership between—</text>

										<clause changed="not-changed" commented="no" display-inline="no-display-inline" id="ID439DA0465EA745738CF6C353D67E6F66"><enum>(i)</enum><text display-inline="yes-display-inline">1 or more community or technical colleges;

				and</text>

										</clause><clause changed="not-changed" commented="no" display-inline="no-display-inline" id="ID1EE7F5B156FF49CF99B4C73591507D9D"><enum>(ii)</enum><text display-inline="yes-display-inline">1 or more institutions of higher education

				that offer a baccalaureate or postbaccalaureate degree which is not awarded by

				a college described in clause (i) with which the institution is

				partnered.</text>

										</clause></subparagraph></paragraph></subsection><subsection changed="not-changed" commented="no" display-inline="no-display-inline" id="ID70F35D150E864605B622A592A7D578A4"><enum>(b)</enum><header>Grants

				authorized</header><text display-inline="yes-display-inline">From the amounts

				appropriated under section 407C, the Secretary shall award not less than 6 and

				not more than 12 grants to eligible entities.</text>

							</subsection><subsection changed="not-changed" commented="no" display-inline="no-display-inline" id="IDEB89FABB7BB44BDC0066BDBC39E0D8C2"><enum>(c)</enum><header>Applications</header><text display-inline="yes-display-inline">Any eligible entity that desires to obtain

				a grant under this chapter shall submit to the Secretary an application at such

				time, in such manner, and containing such information or assurances as the

				Secretary may require.</text>

							</subsection><subsection changed="not-changed" commented="no" display-inline="no-display-inline" id="ID8F72FD7845B4494BBB31A677281C43EB"><enum>(d)</enum><header>Awarding of

				grants</header>

								<paragraph changed="not-changed" commented="no" display-inline="no-display-inline" id="IDF183FD63FC384F8CA02D83E5D799508C"><enum>(1)</enum><header>Criteria</header><text display-inline="yes-display-inline">The Secretary shall establish criteria for

				awarding grants under this chapter.</text>

								</paragraph><paragraph changed="not-changed" commented="no" display-inline="no-display-inline" id="ID87E5A52D62604408AD00954336049CFF"><enum>(2)</enum><header>Priority</header><text display-inline="yes-display-inline">In awarding grants under this chapter, the

				Secretary shall give priority to eligible entities that demonstrate the

				capacity to identify and address systemic problems related to college retention

				and the transfer of community or technical college students to institutions of

				higher education that offer a baccalaureate or postbaccalaureate degree.</text>

								</paragraph></subsection><subsection changed="not-changed" commented="no" display-inline="no-display-inline" id="ID4296B57D428A47F6B049335576B9F57B"><enum>(e)</enum><header>Duration</header><text display-inline="yes-display-inline">A grant under this chapter shall be awarded

				for a period of 5 or 6 years, which period shall include a planning and

				implementation phase.</text>

							</subsection><subsection changed="not-changed" commented="no" display-inline="no-display-inline" id="ID4AACB24845AC4F239371D11000033787"><enum>(f)</enum><header>Use of

				funds</header><text display-inline="yes-display-inline">Grants funds awarded

				under this chapter shall be used for—</text>

								<paragraph changed="not-changed" commented="no" display-inline="no-display-inline" id="ID217C02DA4F2447DCA1C5B799400048B6"><enum>(1)</enum><text display-inline="yes-display-inline">the development of policies to expand

				opportunities for community or technical college students to earn baccalaureate

				degrees, including promoting the transfer of academic credits between

				institutions and expanding articulation and guaranteed transfer

				agreements;</text>

								</paragraph><paragraph changed="not-changed" commented="no" display-inline="no-display-inline" id="IDCBD9C4D251C0496600E32C089583F812"><enum>(2)</enum><text display-inline="yes-display-inline">support services for students participating

				in the program, such as tutoring, mentoring, and academic and personal

				counseling, as well as any service that facilitates the transition of students

				from a community or technical college to an institution of higher education

				that offers a baccalaureate or postbaccalaureate degree;</text>

								</paragraph><paragraph changed="not-changed" commented="no" display-inline="no-display-inline" id="ID154C6C7FC0ED489D004E04CD4095B122"><enum>(3)</enum><text display-inline="yes-display-inline">academic program enhancements at a

				community or technical college that result in increasing—</text>

									<subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="id2726B5A480814463B171BE2EEEFC1939"><enum>(A)</enum><text display-inline="yes-display-inline">the quality of the program offered;</text>

									</subparagraph><subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="id0163A7C577DB4841882173A6A7BA64A6"><enum>(B)</enum><text display-inline="yes-display-inline">the connection to high-quality and

				high-demand emerging and established occupations; and</text>

									</subparagraph><subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="idB4F1C71117EB4C6E9CEEDB38A5052EE5"><enum>(C)</enum><text display-inline="yes-display-inline">the number of student participants in a

				dual degree program offered in conjunction with an institution of higher

				education that offers a baccalaureate or postbaccalaureate degree; and</text>

									</subparagraph></paragraph><paragraph changed="not-changed" commented="no" display-inline="no-display-inline" id="ID2DFDED7BD78D401AA32B7B14DC5C0000"><enum>(4)</enum><text display-inline="yes-display-inline">programs to identify barriers that inhibit

				student transfers.</text>

								</paragraph></subsection><subsection changed="not-changed" commented="no" display-inline="no-display-inline" id="ID86B9D455BF944B45BFE6E0D7BCE96C13"><enum>(g)</enum><header>Regulations</header><text display-inline="yes-display-inline">The Secretary shall prescribe such

				regulations as may be necessary to carry out this chapter.</text>

							</subsection></section><section changed="not-changed" commented="no" display-inline="no-display-inline" id="ID01A97C22C1D14F41958DDF92970226D1" section-type="subsequent-section"><enum>407C.</enum><header>Authorization of

				appropriations</header><text display-inline="no-display-inline">There are

				authorized to be appropriated to carry out this chapter $70,000,000 for fiscal

				year 2006 and such sums as may be necessary for each of the 3 succeeding fiscal

				years.</text>
