		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Health Care for Young Adults Act of

			 2005</short-title></quote>.</text>

		</section><section commented="no" display-inline="no-display-inline" id="H97B02B7072B6421AB31DD56F97900087" section-type="subsequent-section"><enum>2.</enum><header>Providing State option

			 for SCHIP and medicaid coverage of young adults up to age 23</header>

			<subsection commented="no" display-inline="no-display-inline" id="HA1EDEDEC47F54C889FDFFA6E45FA9F2"><enum>(a)</enum><header>In

			 general</header>

				<paragraph commented="no" display-inline="no-display-inline" id="H1EB88B0FCF85489CAF35ECE118ED61CA"><enum>(1)</enum><header>Medicaid</header><subparagraph commented="no" display-inline="yes-display-inline" id="H83E072026BD940F5AB00A49432ACC746"><enum>(A)</enum><text display-inline="yes-display-inline">Section 1902(l)(1)(D) of the

			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.

			 1396a(l)(1)(D)) is amended by inserting <quote>(or, at the option of the State,

			 who have not attained 20, 21, or 22 years of age, as the State may

			 elect)</quote> after <quote>have not attained 19 years of age</quote>.</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD236E1BF53D44D60B6C2FC577F3CD8D5" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">Clause (i) of section 1905(a) of the

			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.

			 1396d(a)) is amended by striking <quote>under the age of 21, or, at the option

			 of the State, under the age of 20, 19, or 18 as the State may choose</quote>

			 and inserting <quote>under the age of 23, or, at the option of the State, under

			 the age of 22, 21, 20, 19, or 18 as the State may elect</quote>.</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H045A14AC2A174B129F397000AB872C29"><enum>(2)</enum><header>SCHIP</header><text display-inline="yes-display-inline">Section 2110(c)(1) of such Act (42 U.S.C.

			 1397jj(c)(1)) is amended by inserting after <quote>19 years of age</quote> the

			 following: <quote>(or, at the option of the State and subject to the

			 availability of additional allotments under section 2104(d), 20, 21, 22, or 23

			 years of age)</quote>.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H78785BEC6FF54F93A59DB05B88FA5F"><enum>(b)</enum><header>Additional SCHIP

			 allotments for providing coverage of optional young adults</header>

				<paragraph commented="no" display-inline="no-display-inline" id="HE309FA77AA634AF5B557821FA195AB1D"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Section 2104 of such

			 Act (42 U.S.C. 1397dd) is amended by inserting after subsection (c) the

			 following:</text>

					<quoted-block display-inline="no-display-inline" id="H15B45891091A48FCB1A4DBC79EFB44C" style="OLC">

						<subsection commented="no" display-inline="no-display-inline" id="H0A52976738504F949CC4A011CECD7E"><enum>(d)</enum><header>Additional

				allotments for the provision of coverage to optional young adults</header>

							<paragraph commented="no" display-inline="no-display-inline" id="HE6B15F7570804E22BC35812EF6A470E9"><enum>(1)</enum><header>Appropriation;

				total allotment</header><text display-inline="yes-display-inline">For the

				purpose of providing additional allotments to States under this title, there is

				appropriated, out of any money in the Treasury not otherwise appropriated, for

				each of fiscal years 2006 through 2009, $500,000,000.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H431633BB2A7E41349DFA22EDFDC4649B"><enum>(2)</enum><header>State and

				territorial allotments</header><text display-inline="yes-display-inline">In

				addition to the allotments provided under subsections (b) and (c), subject to

				paragraph (3), of the amount available for the additional allotments under

				paragraph (1) for a fiscal year, the Secretary shall allot to each State with a

				State child health plan approved under this title—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="H14A90DA969B94D0DA6E1A09222E2FB09"><enum>(A)</enum><text display-inline="yes-display-inline">in the case of such a State other than a

				commonwealth or territory described in subparagraph (B), the same proportion as

				the proportion of the State’s allotment under subsection (b) (determined

				without regard to subsection (f)) to the total amount of the allotments under

				subsection (b) for such States eligible for an allotment under this paragraph

				for such fiscal year; and</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBBD9B475CF4E4D89A26BECEC30C659DF"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of a commonwealth or territory

				described in subsection (c)(3), the same proportion as the proportion of the

				commonwealth’s or territory’s allotment under subsection (c) (determined

				without regard to subsection (f)) to the total amount of the allotments under

				subsection (c) for commonwealths and territories eligible for an allotment

				under this paragraph for such fiscal year.</text>

								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H39C2D453CCF3489E8DBDE7D35B2E96E0"><enum>(3)</enum><header>Use of

				additional allotment</header><text display-inline="yes-display-inline">Additional allotments provided under this

				subsection are not available for amounts expended before October 1, 2005. Such

				amounts are available for amounts expended on or after such date only

				for—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="H555286A067954162B23282087FFDA0A8"><enum>(A)</enum><text display-inline="yes-display-inline">expenditures described in section

				1905(u)(4)(A); and</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBB80FEC8E08C49D0987F9E000930DAB7"><enum>(B)</enum><text display-inline="yes-display-inline">child health assistance for individuals who

				are targeted low-income children and over 18 years of age and who are

				low-income children only because of an election by the State under section

				2110(c)(1).</text>

								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H417919E266124F3FAB535C98C8AD00FF"><enum>(2)</enum><header>Conforming

			 amendments</header><text display-inline="yes-display-inline">Section 2104 of

			 such Act (42 U.S.C. 1397dd) is amended—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="HBBF3DEAFA80A4788AEEFE7A347DC82F0"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (a), in the matter preceding

			 paragraph (1), by inserting <quote>subject to subsection (d),</quote> after

			 <quote>under this section,</quote>;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H764840DBEB5B4DDABD7BCB827855EC9C"><enum>(B)</enum><text display-inline="yes-display-inline">in subsection (b)(1), by inserting

			 <quote>and subsection (d)</quote> after <quote>Subject to paragraph

			 (4)</quote>; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9FD4309F304B4B96AD8C34F733D89C17"><enum>(C)</enum><text display-inline="yes-display-inline">in subsection (c)(1), by inserting

			 <quote>subject to subsection (d),</quote> after <quote>for a fiscal

			 year,</quote>.</text>

					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H41FB2041F8F643A8853DF7E1EC001600"><enum>(c)</enum><header>Modification of

			 medicaid caps for territories</header><text display-inline="yes-display-inline">Section 1108 of such Act (42 U.S.C. 1308)

			 is amended—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="H6849A9005EBB4D92B5E8CE0037808722"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (f), by striking

			 <quote>subsection (g)</quote> and inserting <quote>subsections (g) and

			 (h)</quote>; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6FBAE8B6EDF64A7A8BB2AE129B329F00"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following new

			 subsection:</text>

					<quoted-block display-inline="no-display-inline" id="H614602B9984E4C40A31127D4CFEEBCD3" style="OLC">

						<subsection commented="no" display-inline="no-display-inline" id="HC65A0A87D31542E79BAC08E535F2D6B0"><enum>(h)</enum><text display-inline="yes-display-inline">The Secretary shall provide for such

				increase in the limitations under subsections (f) and (g) with respect to each

				of the territories as may be necessary for each such territory to provide for

				an expansion of medicaid coverage to young adults described in section

				1902(l)(1)(D).</text>

						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HC7839084FB264A73AF7F00D43452AC05"><enum>(d)</enum><header>Effective

			 date</header><text display-inline="yes-display-inline">The amendments made by

			 this section apply to items and services furnished on or after October 1, 2005,

			 without regard to whether regulations implementing such amendments have been

			 promulgated.</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="H813A5C49F3474449A9CFF1DAF4CC00E8" section-type="subsequent-section"><enum>3.</enum><header>Grants to implement

			 medicaid and schip expansions</header>

			<subsection commented="no" display-inline="no-display-inline" id="H84D19186D1A340B39C314BC91999BFFE"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Secretary of

			 Health and Human Services shall provide for grants to States (as defined for

			 purposes of titles XIX and XXI of the Social Security Act) in order to enable

			 such States to implement expansions of eligibility for children and young

			 adults their State medicaid plans under title XIX of the

			 <act-name parsable-cite="SSA">Social Security Act</act-name> and State child

			 health plans under title XXI of such Act. Such grants shall be available for

			 planning, implementation, and outreach with respect to such expanded

			 eligibility populations.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="HF94F594C5EB64F3BA42157DA90FCAA83"><enum>(b)</enum><header>Terms and

			 conditions</header><text display-inline="yes-display-inline">Grants under this

			 section shall be made available under such terms and conditions, including the

			 approval of a grant application, as the Secretary shall specify.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="HD397D4E36D534F6AA5DDC6A4069FDFD9"><enum>(c)</enum><header>Authorization of

			 appropriations</header><text display-inline="yes-display-inline">There are

			 authorized to be appropriated such sums as may be necessary to provide for

			 grants under this section.</text>
