		<section commented="no" display-inline="no-display-inline" id="id31BAFCC3D8AA46DB96B59CCEB134793B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Pascua Yaqui Mineral Rights Act of

			 2005</short-title></quote>.</text>

		</section><section commented="no" display-inline="no-display-inline" id="id2278963807AC4EF3AB687F7FB5CFF285" section-type="subsequent-section"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>

			<paragraph commented="no" display-inline="no-display-inline" id="idFBBDC12BA8B64665BE36A44130523952"><enum>(1)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the

			 Secretary of the Interior.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6000D70BF8284DF08FC57376E2348A2B"><enum>(2)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> means the State

			 of Arizona.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6738FE95F30C4EA7B3F8DC9793C1AE0A"><enum>(3)</enum><header>Tribe</header><text display-inline="yes-display-inline">The term <term>Tribe</term> means the

			 Pascua Yaqui Tribe.</text>

			</paragraph></section><section commented="no" display-inline="no-display-inline" id="idE41DDDEEB2F14AD5A03CE8ABB5418D20" section-type="subsequent-section"><enum>3.</enum><header>Acquisition of

			 subsurface mineral interests</header>

			<subsection commented="no" display-inline="no-display-inline" id="idD5C976B0A0D54551A00CBFF70F657750"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Not later than 180

			 days after the date of enactment of this Act, the Secretary, in coordination

			 with the Attorney General of the United States and with the consent of the

			 State, shall acquire through eminent domain the following:</text>

				<paragraph commented="no" display-inline="no-display-inline" id="IDe751f64ec98749edbca70f602f97e5a1"><enum>(1)</enum><text display-inline="yes-display-inline">All subsurface rights, title, and interests

			 (including subsurface mineral interests) held by the State in the following

			 tribally-owned parcels:</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="ID7511e7fb81fa4dfdaf81192d698182a1"><enum>(A)</enum><text display-inline="yes-display-inline">Lot 2, sec. 13, T. 15 S., R. 12 E., Gila

			 and Salt River Meridian, Pima County Arizona.</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDecfe9b7c4ae541bc80ff3507d23b9cda"><enum>(B)</enum><text display-inline="yes-display-inline">Lot 4,

			 W<fraction>1/2</fraction>SE<fraction>1/4</fraction>, sec. 13, T. 15 S., R. 12

			 E., Gila and Salt River Base &amp; Meridian, Pima County, Arizona.</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID57eeb698e84c4a39a88ee1fc626d8f52"><enum>(C)</enum><text display-inline="yes-display-inline">NW<fraction>1/4</fraction>NW<fraction>1/4</fraction>,

			 N<fraction>1/2</fraction>NE<fraction>1/4</fraction>NW<fraction>1/4</fraction>,

			 SW<fraction>1/4</fraction>NE<fraction>1/4</fraction>NW<fraction>1/4</fraction>,

			 sec. 24, T. 15 S., R. 12 E., Gila and Salt River Base &amp; Meridian, Pima

			 County Arizona.</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDb21c4db1243e4654ab8ac1ebe77b9f0b"><enum>(D)</enum><text display-inline="yes-display-inline">Lot 2 and Lots 45 through 76, sec. 19, T.

			 15 S., R. 13 E., Gila and Salt River Base &amp; Meridian, Pima County,

			 Arizona.</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd676d5fbe9d64d7095213fd54e0de698"><enum>(2)</enum><text display-inline="yes-display-inline">All subsurface rights, title, and interests

			 (including subsurface mineral interests) held by the State in the following

			 parcels held in trust for the benefit of Tribe:</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="ID584ed8466c274d8c9caaea77c00dbe26"><enum>(A)</enum><text display-inline="yes-display-inline">Lots 1 through 8, sec. 14, T. 15 S., R. 12

			 E., Gila and Salt River Base &amp; Meridian, Pima County, Arizona.</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4466379faea14af98db762b4f7c8498c"><enum>(B)</enum><text display-inline="yes-display-inline">NE<fraction>1/4</fraction>SE<fraction>1/4</fraction>,

			 E<fraction>1/2</fraction>NW<fraction>1/4</fraction>SE<fraction>1/4</fraction>,

			 SW<fraction>1/4</fraction>NW<fraction>1/4</fraction>SE<fraction>1/4</fraction>,

			 N<fraction>1/2</fraction>SE<fraction>1/4</fraction>SE<fraction>1/4</fraction>,

			 SE<fraction>1/4</fraction>SE<fraction>1/4</fraction>SE<fraction>1/4</fraction>,

			 sec. 14, T. 15 S., R. 12 E., Gila and Salt River Base &amp; Meridian, Pima

			 County, Arizona.</text>

					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID849d618c7eae4b1cb29f15deecdebb30"><enum>(b)</enum><header>Consideration</header><text display-inline="yes-display-inline">Subject to subsection (c), as consideration

			 for the acquisition of subsurface mineral interests under subsection (a), the

			 Secretary shall pay to the State an amount equal to the market value of the

			 subsurface mineral interests acquired, as determined by—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="ID52a6824585824dd2afa5e1610a16149b"><enum>(1)</enum><text display-inline="yes-display-inline">a mineral assessment that is—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="ID32a3ccaacc984fc3b49e1f203d3f6635"><enum>(A)</enum><text display-inline="yes-display-inline">completed by a team of mineral specialists

			 agreed to by the State and the Tribe; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID81fecc3820034ae2ac16d9ac9da2e81c"><enum>(B)</enum><text display-inline="yes-display-inline">reviewed and accepted as complete and

			 accurate by a certified review mineral examiner of the Bureau of Land

			 Management;</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID47b441cd46764ba088efac306eb46587"><enum>(2)</enum><text display-inline="yes-display-inline">a negotiation between the State and the

			 Tribe to mutually agree on the price of the subsurface mineral interests;

			 or</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDadf3e2013dce4ad3a93d9e7c34ecb329"><enum>(3)</enum><text display-inline="yes-display-inline">if the State and the Tribe cannot mutually

			 agree on a price under paragraph (2), an appraisal report that is—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="idB8D9417213E84FCB8BD4F5AA858EB802"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="id4BBB8621984F44A89EE537F028433A32"><enum>(i)</enum><text display-inline="yes-display-inline">completed by the State in accordance with

			 subsection (d); and</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="id74A75277C6484564B86CB4E4F59FA0E5" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">reviewed by the Tribe; and</text>

						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3bc199a579fb4a3f821f611ca43429ee"><enum>(B)</enum><text display-inline="yes-display-inline">on a request of the Tribe to the Bureau of

			 Indian Affairs, reviewed and accepted as complete and accurate by the Office of

			 the Special Trustee for American Indians of the Department of the

			 Interior.</text>

					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID140a500bce1a4fe892d8a2c9a980ea38"><enum>(c)</enum><header>Conditions of

			 Acquisition</header><text display-inline="yes-display-inline">The Secretary

			 shall acquire subsurface mineral interests under subsection (a) only if—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="IDd7b5547218384d7b9b093fa168a8f292"><enum>(1)</enum><text display-inline="yes-display-inline">the payment to the State required under

			 subsection (b) is accepted by the State in full consideration for the

			 subsurface mineral interests acquired;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID477b2e16f60a4222ade3cb45269590f3"><enum>(2)</enum><text display-inline="yes-display-inline">the acquisition terminates all right,

			 title, and interest of any party other than the United States in and to the

			 acquired subsurface mineral interests; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID489f6ea085da45b49f6ed3cb14cd37ac"><enum>(3)</enum><text display-inline="yes-display-inline">the Tribe agrees to fully reimburse the

			 Secretary for costs incurred by the Secretary relating to the acquisition,

			 including payment to the State for the acquisition.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDa0ff72c5102a4616b6640a792b321bd7"><enum>(d)</enum><header>Determination

			 of Market Value</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law,

			 unless the State and the Tribe otherwise agree to the market value of the

			 subsurface mineral interests acquired by the Secretary under this section, the

			 market value of those subsurface mineral interests shall be determined in

			 accordance with the Uniform Appraisal Standards for Federal Land Acquisition,

			 as published by the Appraisal Institute in 2000, in cooperation with the

			 Department of Justice and the Office of Special Trustee for American Indians of

			 the Department of Interior.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDde9dc6032ea14cb19cd9451679001b80"><enum>(e)</enum><header>Additional

			 Terms and Conditions</header><text display-inline="yes-display-inline">The

			 Secretary may require such additional terms and conditions with respect to the

			 acquisition of subsurface mineral interests under this section as the Secretary

			 considers to be appropriate to protect the interests of the United States and

			 any valid existing right.</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="ID17bebee3f9bf490c99f0db80c6adcfc9" section-type="subsequent-section"><enum>4.</enum><header>Interests taken into

			 trust</header>

			<subsection commented="no" display-inline="no-display-inline" id="ID1e035558dcf14e94825960afa2755e18"><enum>(a)</enum><header>Land

			 Transferred</header><text display-inline="yes-display-inline">Subject to

			 subsections (b) and (c), notwithstanding any other provision of law, not later

			 than 180 days after the date on which the Tribe makes the payment described in

			 subsection (c), the Secretary shall take into trust for the benefit of the

			 Tribe the subsurface rights, title, and interests, formerly reserved to the

			 United States, to the following parcels:</text>

				<paragraph commented="no" display-inline="no-display-inline" id="ID7a7ea125306b43b39fe94938bcf22315"><enum>(1)</enum><text display-inline="yes-display-inline">E<fraction>1/2</fraction>NE<fraction>1/4</fraction>,

			 SW<fraction>1/4</fraction>NE<fraction>1/4</fraction>, sec. 14, T. 15 S., R. 12

			 E., Gila and Salt River Base &amp; Meridian, Pima County, Arizona.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDc55454583a4040ba85ec166980b18126"><enum>(2)</enum><text display-inline="yes-display-inline">W<fraction>1/2</fraction>SE<fraction>1/4</fraction>,

			 SW<fraction>1/4</fraction>, sec. 24, T. 15 S., R. 12 E., Gila and Salt River

			 Base &amp; Meridian, Pima County, Arizona.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID6dec7b63a1254b41a7905595d6604da3"><enum>(b)</enum><header>Exceptions</header><text display-inline="yes-display-inline">The parcels taken into trust under

			 subsection (a) shall not include—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="id155C9AF6F2A6409BA527C2C543FF32E7"><enum>(1)</enum><text display-inline="yes-display-inline">NE<fraction>1/4</fraction>SW<fraction>1/4</fraction>,

			 sec. 24, except the southerly 4.19 feet thereof;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9FCCF3E0053F47B6B4CCA74C20C7D570"><enum>(2)</enum><text display-inline="yes-display-inline">NW<fraction>1/4</fraction>SE<fraction>1/4</fraction>,

			 sec. 24, except the southerly 3.52 feet thereof; or</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID319701ea688b465f9f8f703dea542adb"><enum>(3)</enum><text display-inline="yes-display-inline">S<fraction>1/2</fraction>SE<fraction>1/4</fraction>,

			 sec. 23, T. 15 S., R. 12 E., Gila and Salt River Base &amp; Meridian, Pima

			 County, Arizona.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDfb041de5e4c6404ea0cffc3c7783824c"><enum>(c)</enum><header>Consideration

			 and Costs</header><text display-inline="yes-display-inline">The Tribe shall pay

			 to the Secretary only the transaction costs relating to the assessment, review,

			 and transfer of the subsurface rights, title, and interests taken into trust

			 under subsection (a).</text>
